It wasn’t chewing gum that damaged Sift Bakery’s front window. Owners think it was shot out by a BB gun around 8 p.m. Wednesday. After discovering the damage, owners and employees decided some humor was in order and covered their window in the style of the 1994 movie “Clerks.”

“We had to run with it and have some fun,” employee Emily Marable said. They still don’t know who is responsible for the damage, but the bakery is offering free cake for life to anybody who has any information.

The Gulfcoast Wonder and Imagination Zone science museum will not fall to the wrecking ball, or not immediately at least. Some groups have expressed an interest in using the building.

The former home of the Gulfcoast Wonder and Imagination Zone science museum isn’t going to be razed after all — not just yet, at least.

On Monday, the City Commission voted unanimously to delay any decision on the future of the building at 1001 Boulevard of the Arts. Previously, the commission asked staff to investigate the cost of demolishing the vacant building, which requires $43,443 in annual upkeep.

Staff said the building also needs $300,000 in improvements to return it to a functional condition. The preliminary cost estimate to demolish the building is $142,600.

City Manager Tom Barwin encouraged the commission to hold off on demolition until after Sarasota Bayfront 20:20 has produced a plan for redeveloping 42 acres of city-owned land surrounding the Van Wezel Performing Arts Hall. He said two or three

groups have expressed interest in using the building.

“I would classify demolishing the GWIZ as a major decision, and there are a lot of complexities to that decision,” Barwin said.

The board eventually agreed — although commissioners said they could revisit the topic before the bayfront planning process is complete.

“It just opens up the flood gates,” she said.

A Siesta Key activist has started the fight against plans to change Sarasota County regulations to make way for a new island hotel.

“I know this is in the preliminary stages, but I want to nip this in the bud,” said Lourdes Ramirez.

Ramirez has started gathering petitions to oppose a comprehensive plan amendment that would allow property owners in commercial general-zoned areas to increase the density or intensity as long as they are redeveloping it into a hotel.

The ban on increasing the two development attributes has been in place since 1989.

Gary Kompothecras, founder of 1-800-ASK-GARY and a Siesta resident, is pursuing the change.

“He’s long wondered why Siesta has not had the hotel accommodations one would expect to find near our own Siesta Beach, known around the country and the world for its beauty,” said land use attorney Charlie Bailey, who is representing Kompothecras.

State offers feedback on Big Pass dredge Lido Key residents are anxious to get more sand. Siesta Key residents fear the worst from the Army Corps of Engineers’ plans. As the state nears a decision on the proposed Big Pass dredge, what else is new?

ob Brantly stood in the back of a crowded room at the Waldemere Fire Station for 90 minutes Nov. 30 and offered a vigorous defense of the Army Corps of Engineers’ proposal to dredge Big Pass and renourish Lido Key. If Siesta Key residents were hoping the state would block the project, Brantly’s comments were deflating — because he works as an engineer for the Florida Department of Environmental Protection.

FDEP is still reviewing the application to dredge Big Pass, which is also supported by the city of Sarasota. The state agency has a Dec. 27 deadline for announcing whether it intends to issue a permit for the project, and held a workshop last week to gather public input in advance of a decision.

The project seeks to take 1.2 million cubic yards of sand from Big Pass, which has never been dredged, to renourish critically eroded portions of the Lido shoreline. Siesta residents, worried about the project’s impact on their shoreline to the south of Big Pass, continued to argue the Army Corps’ proposal was flawed.

To their dismay, Brantly was quick to reject the criticisms.

“In my opinion, the concerns the residents on Siesta Key have raised have been answered by the work reported in the package the Army Corps submitted,” Brantly said.

adverse effects following the dredge, the Army Corps would be prohibited from taking more sand before addressing that issue.

He also endorsed the Army Corps’ modeling, which has been the subject of criticism from opponents. Peter van Roekens, chairman of Save our Siesta Sand 2, cited a 2008 Sarasota Countyordered study that notes sediment transport modeling cannot be done “without a considerable margin of error.”

Brantly acknowledged there could be errors in the Corps model that shows no impact on Siesta Key. He said that’s because the coastal system can vary greatly from year to year — even without any human impact. Still, he said

the models provided assurance that Big Pass wouldn’t be radically impacted by the project.

“What it did show is there wasn’t going to be any sudden and significant deflation of the ebb shoal,” Brantly said.

But what if, one resident asked, the effects of the project were so severe that Siesta Key Beach was significantly damaged after the initial dredging effort?

Brantly said that’s a scenario that’s so unlikely that it’s not worth considering, given the robust state of the Siesta shoreline.

Siesta stakeholders now seem to see the intent to issue announcement as inevitable — though that doesn’t mean they’re giving up the fight. Immediately following the meeting, van Roekens said Save our Siesta Sand 2 would contest the issuance of any permit for the project.

“If the intent to permit is issued in its present form, consider this our notice of intent to challenge,” van Roekens wrote. “Once Pandora’s Box has been opened, there is no going back.”

Catherine Luckner, a Siesta Key Association board member, shared a similar perspective. At a Dec. 1 SKA meeting, she assured the audience that the residents association would contest the proposed dredging at every stage of the process, which will include the Corps’ effort to obtain federal funding.

Luckner believed Siesta residents offered compelling reasons to block the Big Pass dredge, but she was also resigned to the fact that state approval appeared imminent.

“I wish it weren’t true, but I believe they have essentially

As a result, Leatherman said, he’s protective of the Siesta shoreline. He encouraged the Army Corps to conduct a more detailed Environmental Impact Statement to get a clearer picture of the potential impact of the dredge.

“I think we really need to study this very carefully and leave no stone unturned,” Leatherman said. “If it takes a little more time, so be it.”

The county has already requested an Environmental Impact Statement — a request the Army Corps of Engineers formally rejected last week. Although the Army Corps remains confident the project will have no impact on Siesta Key, Leatherman still recommended a cautious approach.

If the Army Corps produced an EIS that showed no impact on Siesta Key, Leatherman said he’d still be hesitant to move forward with the planned dredging.

Instead, he suggested the Army Corps could take a smaller amount of sand from Big Pass to study the impacts of the dredge.

“We have to do no harm,” Leatherman said. “That’s the first rule, isn’t it?”

Lido Key leaders, meanwhile, are forced to play a waiting game as Siesta residents mount a challenge. Carl Shoffstall, president of the Lido Key Residents Association, said Lido and St. Armands residents were discussing legal options against Siesta Key factions attempting to block the renourishment effort.

Hugh Fiore, president of the St. Armands Residents Association, said members of that group were just as anxious as Lido residents to see the beach renourished.

“Lido Beach is consistently the No. 1 reason people purchase homes on St. Armands,” Fiore said.

While Siesta residents are offering an array of potential problems with the proposed project, Lido residents are making a more straightforward argument in favor of the dredging.

“Lido needs this sand,” Shoffstall said. “We’re at the end.”

Seaward Development plans to redevelop the Versailles, built in 1974, into a new condominium with as many as 25 units and up to 18 stories, according to a zoning code confirmation letter sent to the city by Seaward principal Patrick DiPinto.

dominium Association filed a lawsuit against the developers of Echelon, complaining the construction crossed onto the Essex House property line. Before it was dismissed in June, Essex residents posted three large canvas billboards decrying the construction in front of their building.

Although the Echelon construction has also affected the Royal St. Andrews condo complex — a crane dumped wet concrete onto the pool deck this summer — association manager Shelley Williams said she isn’t worried about the proposal to redevelop the neighboring Versailles building as long as contractors maintain a constant level of communication with the buildings along Gulfstream Avenue.

“They came right over and cleaned it up,” Williams said, noting the construction manager had early on established a relationship with her association.

There are more than 1,400 units across the city somewhere in development. That list includes large portions of Vue Sarasota Bay and Sarasota Bayside.

Drake said she expects the trend toward new luxury building to continue over the next several years, but predicts it will obviously level off as construction prices — particularly the cost of building a high-rise — climbs to pre-recession levels.

And don’t expect many more redevelopment projects similar to what Seaward is trying to accomplish, since Versailles is the last of the smaller condo developments overlooking the bay and therefore had fewer unit owners to buy out.

“When you get into these much older bigger buildings, that’s a very challenging thing to do,” Drake said.

Case in point: She has four buyers from Siesta Key, one buyer from Longboat and a buyer from Casey Key slated to move into the Echelon on Palm.

Further, the open, flowing design buyers favor just wasn’t around before the past several years.

“Even compared to the last building boom, the approach to architecture is very different now,” Drake said.

Just north of the proposed Palm Avenue projects, the 18-story, 17-unit Sansara has sales pending for 15 of its residences, said Michael Saunders & Co. Realtor Jonathan Abrams.

Most of those prospective buyers are “switching seasons” — as in, instead of spending a few months here and the rest out of state, they are buying more permanent residences to stay for more than eight months.

“I think that paints a good picture of the luxury buyer finding Sarasota and wanting luxury here,” he said.

While luxury high-rise construction raises property values, it can create tension with nearby property owners, particularly on South Palm, where the onslaught of new construction triggered a lawsuit.

Siesta strikes up no-smoking conversation The county can’t enforce a smoking ban on Siesta Key Beach, but residents are still working to curb the impacts of tobacco.

If Siesta Key Beach is going to be named the No. 1 beach in the country again, it’s probably going to have to kick its smoking habit.

Stephen Leatherman, better known as Dr. Beach, appeared at the Dec. 1 Siesta Key Association meeting and announced he would be making some changes to his annual ranking of the nation’s top 10 beaches. One change: He’s allowing beaches that have previously been ranked No. 1 to compete for the top spot again.

That means Siesta Key Beach could once again get the same attention it got in 2011, when Leatherman named it the No. 1 beach in the country.

There is a hurdle, though. In addition to reopening the No. 1 spot, Leatherman is creating a series of “extra credit” categories in addition to the 50 criteria he uses to evaluate beaches. One of the new factors that will be taken into consideration is whether a beach prohibits smoking.

Right now, smoking is allowed on Siesta Key Beach. It’s not for a lack of trying from Siesta Key residents, who have lobbied to change the regulations — although they

believe it’s an uphill challenge.

Catherine Luckner, a member of the Siesta Key Association board of directors, recalls a conversation she had a few years ago with then-state Rep. Doug Holder.

“He made it really clear that, in the Legislature, there was no will to pursue that,” Luckner said. “It had a lot to do with the tobacco lobby.”

Why is this a state issue? Until 2013, the county did prohibit smoking on Siesta Key Beach.

That changed following a 2012 case regarding the city of Sarasota’s smoking restrictions in public parks, which highlighted a Florida law that “expressly pre-empts regulation of smoking to the state and supersedes any municipal or county ordinance.”

In other words, the county can’t regulate smoking on the beach without the state’s consent.

After the Siesta smoking ban was overturned, the county has attempted to regain local authority to prohibit smoking. Those efforts have been unsuccessful, but the issue remains a legislative priority for the county. Still, no change appears imminent.

“There is not currently any proposed legislation filed for the 2017 legislative session, but we certainly will advocate for any proposed measures that would support providing the county the authority to regulate smoking on public beaches,” Rob Lewis, the county’s director of community and intergovernmental relations, said in a statement.

The county wants to regain the power to impose a beach smoking ban, but the state is slow to respond.

Even without the state, residents hope to affect some change.

Kelli Pond, a health educator with the Florida Department of Health in Sarasota County, spoke at Thursday’s SKA meeting about the local Tobacco Free Partnership program’s effort to address the impacts of smoking.

She said Manatee and Hillsborough counties have been able to curb smoking waste by about 50%, and said the beach could be an initial area of emphasis for a similar effort in Sarasota County.

“We’re looking to try to reduce the tobacco litter here, maybe specifically on Siesta Beach first,” Pond said.

Luckner said it’s difficult for

authorities to identify individuals responsible for tobacco litter because they must be caught in the act. To effectively discourage littering through enforcement would demand an intense focus on that specific issue, she said.

“I don’t know if we want to have that kind of oversight,” Luckner said. “It’s so hard to do, and there are so many other things people are focused on the beach.”

As the search for short-term solutions continues, Luckner still believes the optimal conclusion is to have smoking prohibited completely.

“It’s better to have a location as an all-or-nothing area than to try to monitor everybody,” she said.

“We’re looking to try to reduce the tobacco litter here, maybe specifically on Siesta Beach first.”

It’s time for the city to free the food trucks

arasota County wisely relaxed rules and opened up the market for food trucks in commercial areas of the county. It is time the city of Sarasota, and other municipalities like North Port, to follow suit.

Food truck dining has been a vibrant part of bringing new interest and vitality to downtowns from Portland, Ore., to Atlanta, bringing jobs, economic opportunity, greater commerce for downtown economies, boosts in tax revenue and happy onthe-go customers.

The “roach coaches” of yesteryear have been replaced with clean, professional food trucks that serve safe, sophisticated and often made-to-order meals that attract consumers and boost business at their locations.

Moreover, food trucks often set up in underserved areas of cities and attract different customers from traditional restaurants.

Yet, incumbent brick-andmortar restaurants often perceive food trucks as competition.

But it is not the role of local governments to protect incumbent businesses from competition.

Food trucks are specialty restaurants, and a flourishing and competitive restaurant scene is the best way for consumer tastes to encourage the good ones to grow and the bad ones to pack up and make way for the new.

A steady flow of new dining opportunities helps create excitement and interest for consumers. Just as the city does not limit the number of restaurants that can operate, so it should not limit the number of food trucks or their locations. Just as with any other business, patronage should dictate whether a business survives, not government regulators or incumbent businesses.

standards as any other restaurant, and should be subject to costs that are appropriate to their business model, with a few special considerations based on their status as vehicles. Government should ensure that any restrictions are necessary, clear and enforceable, serving only public health and safety.

Because of their small size, many food trucks use (often cooperatively) commercial kitchens called “commissaries” for greater food storage and preparation, and clean areas to dispose of grease, used water and waste. Just like traditional restaurant kitchens, these commercial kitchens must be inspected according to state and county codes. For food trucks that prepare foods on-site, the same food-safety regulations should apply, as well as the presence of hand-washing stations, just as for brick-and-mortar restaurants.

Public safety is a unique concern for the food truck industry.

Because of their often on-street locations, regulations regarding traffic safety must apply to food trucks.

Learning from U.S. cities that have already experimented with these regulations, Sarasota should consider prohibiting food trucks from parking within 20

feet of an intersection, and from operating in a way that creates enough congestion to block sidewalks, streets and parkways. This should not preclude parking in metered parking areas (as long as the food truck pays the metered rate) or on private property.

The proximity to brick-andmortar restaurants has also been a touchpoint of controversy. In some cities, such as in Cincinnati, food truck associations and restaurant alliances seeking to defuse friction have often reached agreements for how many feet from a brick-andmortar restaurant a food truck can park. But it is not the province of government to protect restaurants from new competition by regulating such proximities. After all, it is common to see one restaurant opening next door to another one, without government restriction. Main Street is block after block of restaurants cheek and jowl with one another. As long as sidewalks and streets remain open enough for pedestrian and vehicle traffic, food trucks should be able to park and vend from wherever it is legally possible for any other vehicle to park.

Booming cities such as Portland, Ore., and Austin have welcomed food trucks as an expansion of their local economies. Portland and Austin have promoted using private vacant lots as “food truck hubs.” This allows for shared use of electricity, restrooms, hand-washing stations, refuse disposal, etc. similar to what malls provide for brick-and-mortar businesses.

Boston’s Mobile Food Truck Committee, composed of representatives from all government departments concerned with food truck permitting, from Department of Transportation to the fire department, makes for a one-stop permit and license shop that gets new entrepreneurs up and running quickly and with a minimum of bureaucracy.

A bigger, more diverse economy is the tide that lifts all boats for a city’s businesses and residents. Sarasota should encourage food trucks, using policies that support fair competition and seek to serve the economy on the whole and the public in particular.

Siesta hotel proposal deserves extra scrutiny

Be wary of greyhound racing’s supposed virtues

Sarasota’s growth and economic health has always had at its foundation the fact that it is the premier cultural center of Florida.

The Woman’s Exchange has always been committed to that cultural presence and the belief that the arts enrich our way of life, as well as the economic health of our community.

We will continue to pursue that objective, which was at the heart of our decision to purchase the adjacent property located on Rawls Avenue and design our expansion around it. The design of that expansion was approved by the city staff and found to meet all requirements of the zoning code, including providing a loading space meeting the city’s requirements.

We are obviously disappointed in Judge (Brian) Iten’s brief ruling, that appears to support the City Commission’s elevation of the personal fears and opinions of neighborhood activists over the expertise of its own professional staff.

We continue to strongly believe that the City Commission failed to read, apply and enforce the binding language of the city’s zoning code, and disrespected the hard work of its own excellent staff.

When I read the article in the Sarasota Observer that stated hotels are not allowed on Siesta Key, I was confused.

Transient accommodations are allowed on Siesta Key by special exception. In fact, a few were built above Gidget’s retails shop in the Village just a few years ago.

When I asked the question, Sarasota County’s staff confirmed my belief that hotels are allowed on Siesta Key and then sent me the developer’s proposed language.

The truth is the developer’s proposed change to our comprehensive plan seeks to have exemptions on density and intensity requirements for hotels.

We currently have maximum density limits and other limitations such as height of buildings for any hotel being built on Siesta Key. The developer wants his hotel to be exempt from those limitations so he can build a big hotel with no limit to number of rooms.

It’s important for the citizens to know what is actually being proposed.

Of course greyhounds love to run: No one is saying they don’t (“Greyhound racing gives audiences a thrill and dogs a purpose,” 12-1-16). But the racing industry exploits this talent at the dogs’ expense.

Greyhounds often suffer horrific injuries during races, including broken legs, heart attacks, neck and spine injuries, concussions or electrocution when they fall into the rail.

A dog dies at a Florida track every three days on average.

When the dogs get injured and/or can no longer run fast enough to win races — usually by the time they are just 3 to 5 years old — they are discarded.

In 2002, the bodies of about 3,000 greyhounds were discovered at a property belonging to a former Florida racetrack security guard who had been shooting unwanted greyhounds for decades. No one knows how many dogs are killed after their careers end because the industry is not required to report these figures.

For dogs, racing is a losing bet. Please don’t support this cruel business by attending or betting on greyhound races.

complied with the essential requirements of the law, its own zoning code. In fact, the judge’s order does not cite to any provisions of the zoning code. We are further disappointed that Judge Iten did not grant our counsel’s request to be heard in oral argument before ruling.

The city placed the Woman’s Exchange in an impossible situation by demanding a codecompliant loading zone and then denying its site plan due to the loading zone it demanded. We are simply not able to discern the court’s reasons for

upholding that decision.

We are disheartened to learn that vocal activists are permitted to override the city’s zoning code and determine the fate of property owners trying to use their property in compliance with the zoning code.

It is a sad day for the city when property owners cannot rely on the zoning code as it is written to protect their financial interests.

The Woman’s Exchange is considering its options.

City loosens public art rules Developers will be allowed to bundle public art contributions into one large project — and the city may use public funds to enhance those projects.

The city agreed on Monday to spend up to $70,000 in public art funds to place a sculpture on what is currently private property next to a development under construction.

The agreement represents a new strain of public-private partnership when it comes to public art. The city funds will be combined with money from developer Mark Kauffman and art gallery Alfstad& Contemporary to buy a $200,000 sculpture that will be installed on Ringling Boulevard.

There are several new wrinkles to this collaboration. Kauffman is the developer of several properties near the downtown core, including developments at 1500 State St., 242 S. Washington Blvd. and 1936 S. Ringling Blvd.

When a developer undertakes a new project, the city requires a contribution to its public art fund. In total, Kauffman’s three projects would generate $61,525 for that fund.

Kauffman was interested in exploring another option. Developers are allowed to provide public art on-site instead of paying

into the public art fund, but the artwork is tied to individual projects. Kauffman wanted to combine his contributions to purchase a more significant piece of artwork.

He wanted to go even bigger than that, too. He targeted the intersection of Ringling Boulevard, Links Avenue and Golf Street — right next to his Sabal Palm bank building — as the site for what he envisions as a truly outstanding sculpture. He reached out to Sam Alfstad, the owner of Alfstad& Contemporary, and honed in on a piece he was selling by Brooklyn sculptor Boaz Vaadia.

“We have a significant amount of inventory now in art, and they’re all around the city and they’re very enjoyable,” Kauffman said. “But we don’t have a single world-class piece of sculpture.”

One problem: That sculpture came with a $200,000 price tag.

Even if the city allowed Kauffman to bundle his public art contributions, he was asking for $140,000 in public art funds to secure the statue — a figure the Public Art Committee balked at during a November meeting.

With Kauffman’s proposal at risk of falling apart, Alfstad stepped up. He agreed to contribute $70,000 toward the sculpture, forging the basis for the agreement approved Monday.

Why did a private citizen agree to fund a significant public art expense? For Alfstad, he hoped it would be precedent-setting — that other residents would feel motivated to contribute to the artistic fabric of the city. He said Sarasota is capable of growing as an arts destination, particularly when it comes to visual arts.

“We have the institutions here,” Alfstad said. “We just need to make some investments, make

some news and let people know Sarasota isn’t just going to throw together little bits and pieces of sculpture.”

The city, Kauffman and Alfstad& Contemporary will split the cost three ways of the sculpture, titled “Ba’al & Yizhaq.” Kauffman will donate part of his Ringling Boulevard property to the city, and will cover the cost of installing the statue on that land. The city will assume full ownership of the statue.

Now, the city will work on revising its regulations to allow other developers to bundle their public art contributions and seek public funds.

The city also approved a $150,000 budget for the construction of “Bravo!” the Jorge Blanco sculpture (prototype pictured above).

The colorful statue will occupy the center of a forthcoming roundabout at Orange Avenue and Ringling Boulevard. Although the commission voted 4-1 to approve the expenditure, land use attorney Dan Lobeck offered a pointed critique of the artwork.

“It’s a visual cacophony,” he said. “That looks like an erector set hangover.”

Lobeck’s withering critique failed to sway the commission. As a result, the local artist’s sculpture will be placed in the roundabout after it is constructed next year.

Alex Hay wants to make one thing perfectly clear: His company would not have purchased the land at 1329 Fourth St. if it wasn’t confident it could remove two large trees from the property.

Hay is the executive director of property with DRAPAC Capital Partners, which plans to develop the site. He appeared at a community workshop regarding the property, which includes 62 residential units.

City code does not require a workshop for the project, but the developer held one to address residents’ concerns. As DRAPAC begins the development review process, neighbors want to save those two ficus trees, which each measure more than 100 inches in diameter at breast height.

Hay wanted to assure residents their concerns were being heard, but the development team made no effort to mislead those in attendance. The group still intends to remove the trees.

“We have to take down those trees to build this project,” Hay said. “We have a lot of faith that this is an area that needs change, and this will be good change.”

Hay, along with landscape architect Phil Smith and architect Michael Halflants, explained the trees were diseased and classified David Conway as invasive. design for the project that creates a wider tree-lined sidewalk along Fourth Street. Although residents were happy about that change, they remained worried about the loss of green space in the rapidly developing Rosemary District.

Initial plans call for the installation of off-site trees in Centennial Park, which is located outside the Rosemary District. DRAPAC representatives said the city could not immediately identify sites within the neighborhood that could take the trees, but residents encouraged them to keep looking.

Those in attendance expressed broader concern about a lack of park space in the neighborhood.

Still, residents remained determined to find some way to incorporate as many trees and plants into the fabric of the neighborhood as possible — even if the two big trees at 1329 Fourth St. can’t be saved.

Judge rejects Woman’s Exchange appeal A court has backed the city’s decision to reject plans to expand the store.

A judge has sided with the city regarding a controversial decision to reject plans to expand the Woman’s Exchange consignment store on Orange Avenue.

Twelfth Judicial Circuit Court Judge Brian Iten denied the Woman’s Exchange’s petition for a writ of certiorari Monday, affirming the city’s decision in the process.

In April, the City Commission rejected the proposal to build an expansion at 526 Rawls Ave. In the two-page ruling, Iten said the city provided due process, followed the essential requirements of law and made its decision based on competent substantial evidence.

Attorney Robert Lincoln, representing the Woman’s Exchange, had argued the city ignored its own zoning regulations and the input of city staff, who approved the project before the commission reversed that decision.

Iten disagreed. He said the appeal from Laurel Park residents, who argued the proposed loading zone was incompatible with the nearby neighborhood, presented a valid reason to reject the plans.

“The court finds that the commission properly considered the non-expert, fact-based testimony of local residents regarding the safety of pedestrians and bicyclists in the area of the proposed site plan,” Iten wrote.

The city is in the process of rewriting its zoning regulations to allow for the proposed expansion without the inclusion of a loading zone on Rawls Avenue.

Woman’s Exchange CEO Karen Koblenz expressed frustration with Iten’s ruling and said the nonprofit was still considering its options for the future.

“It is a sad day for the city when property owners cannot rely on the zoning code as it is written to protect their financial interests,” Koblenz wrote in a statement.

Kate Lowman, the Laurel Park Neighborhood Association board member who led the residents’ appeal, applauded Iten’s ruling. She said the neighborhood focused on ensuring its testimony met the legal threshold of “competent substantial evidence,” a lesson from which she hoped other residents could learn.

“I think the challenge for citizens is that you have to really work to make your case,” Lowman said. “You’re not a lawyer or engineer where automatically, it’s assumed the evidence you have is substantial and seriously factual — not just an opinion.”

Orange Avenue residents lobby for speed table The city installed a temporary speed table in an attempt to slow down drivers in a residential area.

On Sunday — months after removing a speed table on Orange Avenue — city workers installed a temporary speed table on the same street.

Both projects, located a little more than two blocks apart, were carried out at the request of nearby residents. And both projects were designed to mitigate the impacts of the closure of the Osprey Avenue bridge.

It might seem strange, but city staff said there’s a method to the madness.

First, the temporary speed table. The city installed the traffic-calming device at 1231 S. Orange Ave., just south of the intersection with Bahia Vista Street. The project was a response to concerns from nearby residents, who reported drivers were speeding down Orange Avenue.

Those residents attributed an uptick in speeding to the August closure of the Osprey Avenue

bridge, according to Rob Patten, president of the Hudson Bayou Neighborhood Association.

“People used to going down Osprey at a certain speed don’t realize the speed on Orange is 25 mph,” Patten said.

The residents near the temporary speed table feared the problem would only get worse as more part-time residents returned to the area.

“Now that season is starting, we have a lot more people coming down Orange that aren’t familiar with the speed limit,” Patten said.

“They want to get to 41 as fast as they did when they went down Osprey. It’s a residential street; it’s not going to happen.”

The city required the approval of 60% of neighboring property owners before it would install the speed table, which residents were able to obtain. As a result, the temporary speed table will be in place on Orange Avenue until the bridge is reopened.

Because residents near that speed table wanted it gone.

Just north of Alta Vista Street, at the entrance to the Hudson Bayou neighborhood, two speed humps sat on either side of a median filled with trees and plants.

People living nearby reported a series of issues with the speed humps. City staff investigated, and discovered structural deficiencies.

“It was an old speed table, probably from the early ’90s,

that became substandard,” said Ryan Chapdelain, a chief planner with the city. “It was causing a lot of noise and vibrations from vehicles going over it that impacted those homes.”

With the Osprey Avenue bridge closure looming, the volume of cars traveling over the speed table was set to spike. As a result, residents asked the city to take out the humps to prevent any additional issues.

They weren’t concerned about cars speeding in front of their homes because they believed

that segment of Orange Avenue was already designed to encourage slower driving speeds.

“The fact that they had a landscaped median there and the travel lanes are quite narrow, they felt that already served as a traffic calming measure,” Chapdelain said.

With that speed table out — and the new temporary speed table in place — the city hopes it’s finally struck the perfect balance to manage traffic along Orange Avenue.

Downtown circulator plans move ahead DEPUTY MANAGING EDITOR

Nothing is final yet, but if everything breaks right, John Moran believes there could be a new transit service running throughout downtown by next month.

The city is negotiating with The Gotcha Group, a Charleston, S.C.-based transportation company, to operate a fleet of downtown circulator vehicles.

Moran, the operations manager of the Downtown Improvement District, said a contract could be finalized as soon as this week.

For a two-year period, the city would be responsible for funding the circulator vehicles, which would operate without a charge for riders. By year three, the Gotcha Group would depend on advertisements wrapped around the vehicles to fund and sustain the service.

“We’re essentially kick-start-

ing a private venture,” Moran said.

Initially, the city began negotiations with a Delray Beach, Fla.-based service called The Downtowner. That company ultimately determined it wasn’t a good match for what the city was seeking, and city staff moved onto negotiations with its second choice, The Gotcha Group. The Gotcha Group primarily focuses on offering free rides to students on college campuses.

Any agreement is subject to final approval from the City Commission. Moran, who has been a leading advocate for creating a downtown circulator service for several years, said he hoped to get a contract on the commission’s agenda next month.

“I sense we’re getting close to a deal,” Moran said at Tuesday’s Downtown Improvement District meeting. “The timing is such that we could have vehicles on the street in January.”

The Riverview High School Kiltie Band has a rich history of success, and band director Mark Spreen has an equally successful history.

He attended Riverview High School from 1976-1979 and played saxophone in the school’s marching band. After attending college and spending 10 years as a band director for three Florida high schools, Spreen got a chance to come back home.

“It's something I had always dreamed of, but I never thought would happen,” Spreen said.

ers working here that I had in school,” Spreen said. “To be a member of the faculty was kind of a strange feeling at first, but I have become accustomed to it now.”

It’s been 24 years since Spreen returned to his alma mater. During his tenure, he has continued the band’s winning legacy, continuing its 55 consecutive superior ratings at the Florida Bandmasters Association’s district competitions.

In November, his success was recognized by the Florida Bandmasters Association when he was inducted into the group’s hall of fame.

Spreen said it’s hard to say what the induction means to him. The countless practices and relationships he has fos-

tered with students and parents, he said, all have meant so much to him.

“It’s hard to put into words what it means,” Spreen said.

“But it’s something very special and very humbling.”

Although he values the Riverview community’s support of the program, he admits he does feel some pressure to continue its legacy of success. But he's not worried. His students have shown an ability to rise to the challenge.

“We always feel like there is an expectation to be the best we can be,” Spreen said. “The kids have always worked really hard … We ask them to do a lot, and they always come through for us.”

back up and allowed him to pass. The man said there was no damage to his vehicle, and he alerted police just because the bridge alarm was going up and he wanted to make sure he was not in trouble. Bridge maintenance personnel said they were able to fix the bridge alarm and there was no damage to the gate.

The man was also unable to access his storage unit because the manager changed the access locks. They didn’t want much for their birthdays — just to give Sarasota County Sheriff’s Office’s canine deputies a barking good time. they and a few friends could go to Woof Gang Bakery, and the Sheriff’s Office could bring a few dogs to the party for treats and tummy rubs.

But when the siblings’ mother, Ellen Barry, approached Woof Gang Bakery owner Mark Austin, he had other plans.

“Mark (Austin) said, ‘Let’s go big. Let’s invite everybody.’” Ellen Barry said.

So that’s exactly what they did.

Austin offered his bakery as the venue and partnered with Sarasota County Search and Rescue, while Ellen Barry invited food trucks and marketed the event on Facebook. In two weeks, the pair had put together a howling good party.

Being one of the four-legged members of Sarasota County Sheriff’s Office’s K-9 units can be a rough.

It’s a tough job with long hours and dangerous assignments, which is why two Sarasota County children wanted to thank Sarasota’s pawed protectors.

Siblings Anna Cate and Michael Barry decided to forgo their birthday party this year, and instead threw a K-9 Pawty.

“I read a book about police dogs,” 9-year-old Michael Barry said. “I like that they help the county.”

Family, friends and the K-9 units gathered at Woof Gang Bakery at 8278 Bee Ridge Road on Sunday afternoon to celebrate Sarasota’s courageous canines.

Attendees were encouraged to donate to the K-9 medical fund, which is used to address the medical needs of retired K-9s. Partygoers also donated toys and colored doggy bags so officers could take home the dog treats children decorated during the bash.

Deputies thanked Michael and Anna Cate for recognizing their dogs.

“They’re really special animals to us,” Sgt. Troy Sasse said.

“They’re part of our families.”

Deputies also showed off the dogs’ skills by staging an alter-

cation between Deputies Ryan McBride and Chris Indico.

As McBride walked out into the field in front of Woof Gang Bakery, partygoers had a hunch what was about to happen, and they were correct. As Indico and McBride began pushing each other, the audience could hear anxious barking from the K-9 Unit SUV parked about 30 feet away.

People gasped in disbelief when the door flew open and Indico’s canine partner raced to his rescue.

Without the cumbersome protective suit, McBride still would not have stood a chance. He was taken down with ease, much to the delight of the audience.

Following the demonstration, Sasse said officers carry a remote

device that opens their backdoors in case of emergency.

After demonstrating their skills in criminal apprehension, the dogs showed their softer side, cuddling against children's legs to receive scratches behind the ears.

“I hope the dogs felt loved and thanked and appreciated,” Ellen Barry said.

Austin said he was thankful to get to participate in the event and will continue to accept toy donations throughout this week.

“This is a great opportunity to introduce kids to law enforcement in a positive environment,” Austin said.

n his first day walking through the doors at Sarasota High School, Emmanuel Lambright told boys basketball coach Kevin Fields that he was going to change the culture, and turn the Sailors, who won just six games last season, into winners.

Fields believed him.

The 6-foot-6 senior played at Cardinal Mooney last year, and Sarasota Christian the two years prior. Lambright has moved around a bunch, trying to find the situation meant for him, where he can provide the most help both on and off the court. Fields also coached Lambright during his 10th grade year with the Blazers.

He is well aware of how Lambright is the total package.

Lambright is listed on scouting services as a shooting guard, but Fields said he can play all five positions on the court in different circumstances.

His versatility makes him a unique asset, and it helps that

Lambright has the skills to go with it. Last season, Lambright averaged 18 points and nine rebounds per game. He is in talks with several NCAA Division 1 schools, including Georgia Tech, the University of Louisville and Virginia Tech.

It is Lambright’s leadership, however, that truly makes him stand out from the crowd.

After practice on the day before a road game against Venice, Lambright quieted the team down and made sure everyone had a ride to the game, pairing passengers with drivers.

crashing to the court, hitting the back of his head. Instead of getting up filled with aggression and doing something regretful, Lambright immediately ran toward his team’s bench and held them back, preventing them from getting a technical foul.

Even in immense pain, he thinks of the impact on the team first, not himself. Lambright said there was never animosity about his role from other upperclassmen on the team who had been there longer.

“I love to lead,” Lambright said.

“I love to make sure that our team is all on the same page, all fighting for that one goal. Our motto this year is ‘We over I.’ We’re all fighting for each other.

“It’s a testament to how willing and how ready the guys on our team are to win. None of them hold any type of pride where they’re saying, ‘Oh, this is my team, I’ve been here for four years.’ They say ‘I’m going to buy in, I’m going to be behind him, we’re going to go for this goal and ride with him.’ I have nothing but respect for those guys, even just knowing them for a few months.

It’s been so much fun hanging out with them and fighting for them on the court.”

Lambright’s favorite basketball memory is playing with his AAU team, Impact ELITE, against Nike South Beach and the duo of Zach Brown and JJ Smith, two blue-chip recruits in the class of 2017. Lambright and teammate Sean Price each scored 20 points in a single half. Impact ELITE ended up losing by three, but the experience of going against top

competition and finding personal success was rewarding for Lambright.

While basketball is fun for Lambright, it is not the most important thing in his life. That, he said, is his faith.

“Nothing even flows in my life if not for God,” he said.

For fun, Lambright said he writes down philosophical thoughts about people and things, and listens to theological speakers like Ravi Zacharias give theirs.

While still early in the season,

as of Dec. 6, the Sailors were 2-0, winning their games by an average of 22 points. Lambright has averaged 28 points and eight rebounds in those two games. That promise he made to Fields on his first day as a Sailor isn’t looking so crazy.

The coach knows how lucky he is to have a player like Lambright on his team again.

“I have a son,” Fields said. “I wish my son grows up to be like him (Lambright), even 10% of what Emmanuel has to offer, and carries that the rest of his life.

Teen boxer trains with grown men — and can beat them

T

here’s a sparring session going on at Sarasota Boxing Club. I watch from just inside the dimly lighted gym as two men tap gloves, circle up, feign a few punches then clash in the center of the gym’s lone ring.

The men take it slow at first to warm up. A few minutes in, they’re taking shots to the cheek (with headgear on) like they’re nothing. It’s an even bout for a while. Suddenly, one of the men gets his opponent on the ropes.

He takes advantage.

He throws a sharp right jab to his opponent’s temple. Another,

in quick succession. Then, viciously, another.

The electronic bell rings. The aggressor and defender tap gloves again, this time covered in much more sweat. As they leave the ring, they take off their headgear, and I realize my perception of what I was watching had been off the entire time.

The defender was indeed a grown man. The aggressor was not. He was a teenager.

A 14-year-old named Andrew Cano, to be exact.

Cano attends Booker Middle School. He’s been boxing for

three years now, and holds a 4-1 record in the Intermediate Male division of USA Boxing.

That one loss, well, Cano said he “just didn’t have it” that night.

That must have been the case, because otherwise, I don’t see how anyone in his class could stand a chance.

He’s preparing for a fight on Jan. 21 against a 15-year-old in Bonita Springs. Cano just turned 14 in September, so that’s a sizable age difference. Not that it matters to Cano. The kid just wants to box.

Why does Cano like the sport?

It’s simple, really.

“It’s such a fun sport. There aren’t many sports where you can punch someone in the face and not get in trouble for it,” Cano said.

Sometimes I wonder why more teens and tweens don’t take up boxing, or at least ask their parents to invest in a punching bag.

It’s a great way to work out all of the things you’re feeling.

Despite the performance he put on in the sparring session, Cano insists he’s more of a defensive boxer.

There are no knockouts on his resume. Instead, Cano wears his opponents out with speed and tries to outpoint them, getting in enough shots to impress the judges while avoiding much damage himself. Cano’s go-to punches are his straight right and his left hook.

pening if not for Andrew’s father, Jose Cano. The pair used to watch Friday Night Fights together every week. Andrew Cano loved it. Jose Cano decided to put that love to the test, and took his son to Sarasota Boxing Club so he could get a taste of the sport in real life.

At Sarasota Boxing Club, Cano trains under Harold Wilen, a 2015 inductee to the Florida Boxing Hall of Fame. Wilen grew up in New York and New Jersey, but has lived in Sarasota since 1985.

He has coached seven amateur boxers to top-10 rankings.

Wilen believes Cano has what it takes to be the eighth.

“He’s got a combination of intelligence, listening well and technique,” Wilen said. “Even before he really learned technique he had a bent for it. Some people are very hard to instill technique. They want to do it their way. But it seemed initially

that he had that thing of listening to a coach and good skills.

“He has to continue to focus on this and not be distracted by the other things. There’s so many things in life. Girls, schoolwork. He’s learning to fit everything in so that things work.”

Wilen has Cano spar against experienced amateur boxers, sometimes even pros, and he said that Cano holds his own, occasionally even getting the better of them.

Cano said he could not get his legs to stop shaking before his first fight, which makes sense.

I’ve never been in a fight in my whole life, though I was framed for one (That’s a story for another time). I’d be paler than Casper if I had to step into the ring now, let alone in middle school.

After that first fight, though, it has been all confidence for Cano, and it should be. I was really impressed by what I saw from the young boxer. Add strength over time, increase quickness and cardio through running, and the boxing world has itself a lean, mean fighting machine.

Sarasota kicks off the holiday season with lions and tigers and Santa Claus (oh my)!

s residents began to pack the sidewalks along the route for the Downtown Sarasota Holiday Parade, Main Street between East Avenue and U.S. 301 became a frenzy of holiday spirit.

Dancers practiced their routines and singers warmed up, their music mixing together.

The parade, organized this year by Danny Bilyeu with a Salute to Veterans theme, featured many veterans to thank them for their service. It also featured classic floats, such as the Circus Conservatory and Big Cat Habitat’s mobile zoo, complete with the large felines.

Yet, even in the face of all the fanfare, it was clear who everyone was waiting for — Santa.

As Santa Claus made his way down Main Street, fake snow showered the parade goers.

Even after Santa Claus finished his route through downtown and the crowds dispersed, the holiday cheer was there to stay as families wished each other a happy holiday season.

Santa sparks holiday cheer

T

urns out not even Santa Claus is perfect.

Santa sat on a throne in Five Points Park Thursday, Dec. 1, a 34-foot Christmas tree behind him and a crowd of about 50 anxious event goers in front of him, all counting down to the big moment — when he would plug in the downtown tree.

“Five, four, three, two, one...”

Santa joined two ends of an oversized extension cord and the tree was lit, but not for long.

While setting the cord down, Santa accidentally unplugged the tree.

The children didn’t seem fazed by the momentary mishap. They lined up to tell Santa

their Christmas wishes.

The Downtown Merchants Association hosted the event.

This year, the association upgraded its 15-foot tree for a 34-footer, at a cost of $20,000.

Downtown Merchants Association President Ron Soto said an additional $75,000 worth of holiday decorations were put up downtown, some by Soto himself.

Soto said seeing how people react to the lights makes it more than worth it, and he’s not finished yet.

“I’ll stop when we decorate (downtown) from (U.S.) 41 to (U.S.) 301,” Soto said.

THE MAGIC IS IN THE DETAILS When Patrick Sanders was first asked to put together a Christmas performance for his grandson’s kindergarten class he was thrilled.

“Anybody can read a book,” Sanders remembers saying. Instead, Sanders and his wife set out to create a persona, down to the smallest detail.

The Bell: The bell, like many of Sanders’ other costume items, belonged to his grandmother. She used to hang the bells on her Christmas tree. It continues to play a role in Sanders’ Christmas traditions as the bell that Santa Claus gives him at the North Pole.

The Pocket Watch: What is a conductor without a pocket watch? Sanders uses his grandfather’s old pocket watch to help him get to the North Pole on time.

The Glasses: Sanders said he was trying to emulate Tom Hanks’ look from the movie adaptation of the story, which called for a pair of wire-framed glasses. Sanders didn’t have to look far, though. He uses a pair of his grandfather’s old spectacles.

The Train Whistle: Sanders’ favorite part of the performance is blowing the train whistle to announce the arrival of the Polar Express.

The Hat: When Sanders was assembling his costume, he was nervous he wouldn’t be able to find a hat that matched Hanks’, but he lucked out when he found a French train conductor’s hat at a Sarasota costume store.

After his wife sewed the Polar Express logo on the front, the look was complete.

Seeing is believing Patrick Sanders wants to keep the Christmas spirit alive, and he has just the ticket to make it work.

Patrick Sanders entered Barnes and Noble’s children’s section on Dec. 2 to the sound of gasps.

“It’s the conductor!” children exclaimed as Sanders made his way to a section surrounded by a semicircle of small benches.

With a flat-topped train conductor’s hat, thin, oval glasses perched halfway down his nose and a white mustache he grows out every Christmas for his role, Sanders looks just like he sounds.

In a gentle, smooth, Southern voice he tells a familiar story.

“All aboard the Polar Express!” he says.

Sanders has made narrating “The Polar Express” for young audiences a Christmas tradition.

He began performing the story in 2007 for his grandson’s class at Ashton Elementary School.

After doing a similar enactment of Johnny Appleseed earlier that year, his grandson’s teacher asked Sanders to put something togeth-

er for Christmas. He said he chose “The Polar Express” because it was different. There were no talking snowmen or misfit reindeer. It was about real children struggling to believe.

He rewrote the story to fit a first-person narrative, and his wife sewed gold stripes on the cuffs of a black suit she found at Goodwill. They even found a French train conductor’s hat at a costume store to complete the ensemble.

Sanders now makes the rounds to several schools in the district, including his youngest grandson Tripp Hines’ class at Phillippi Elementary School, in addition to his annual performance at Barnes and Noble.

“It’s gotten to be the biggest part of my Christmas,” Sanders said.

Sanders starts his story by explaining that before he was the conductor of the Polar Express he was a kindergartner. His friend had told him that Santa Claus didn’t exist, so Sanders set out to prove them wrong. He stayed up all night on Christmas Eve aching to see Santa glide down his chimney. Instead of reindeer bells, Sanders tells his audience he heard train whistles.

Instead of toys or riches, Sanders tells the children he chose a bell from one of Santa’s reindeer, which made the sweetest sound he had ever heard. But it can only be heard by those who truly believe in Santa’s magic.

When he arrives home, Sanders said he realizes the bell fell out of his pocket. He thought it was gone forever. But on Christmas Day he received a package from

He tells his audience he has kept the bell for all these years.

His friend can’t hear it ring anymore and neither can his little sister. But for Sanders, the bell still jingles because he still believes in the magic of Christmas.

“I try to get across it’s not about what they receive for Christmas that’s important,” Sanders said.

“It’s the whole idea of the Christmas spirit.”

To Sanders, that is a spirit of inclusion.

“As I’m walking down the aisle to find my seat I say, ‘There are boys and girls everywhere — all different ages, all different sizes, all different colors,” Sanders said.

“I think it kind of emphasizes that there shouldn’t be discrimination … Santa Claus doesn’t discriminate between where you’re from or what you look like, just if you’re good.”

It’s been nine years since his first performance, but for Sanders, the magic hasn’t faded. He still looks forward to the rapt looks and excited gasps. At 74, he knows his days as the conductor will end, but for now there is no closing curtain in sight.

How long is he going to continue his Christmas tradition?

“I guess as long as I can remember the story,” he said.

St. Armands shines brightly at Holiday Night

anta Claus is making his list and checking it twice.

And perhaps to give his list a third check, he visited St. Armands Circle on Dec. 2.

Santa and Mrs. Claus stopped by the 38th Annual Holiday Night on St. Armands and spoke with children about their Christmas wishes. Some wanted golf clubs, others wanted superhero action figures.

Before the youngsters could meet Santa, he had a job to do — lighting the 55-foot-tall Christmas tree in the Circle’s park.

Diana Corrigan, executive director of the St. Armands Circle Association, said it’s the tallest tree on Florida’s Gulf Coast and has more than 40,000 lights and 800 ornaments.

“After 17 years of lighting that tree, it’s still magic to me,” she said.

Corrigan said the evening reminds her of an old-fashioned Christmas celebration. Before Santa arrived, those present sang Christmas carols. The Rev. Keith Copeland of St. Armands Key Lutheran Church led the group in a blessing. He added that the evening is what Christmas is really about.
