Trouble in Paradise Bird Key residents are concerned about crime.

But there’s no gateway in city codes for the island community to restrict access to the public.

In late July, Bird Key Homeowners Association President Bill Lloyd reached out to city officials to inquire about a pressing issue facing his neighborhood.

Lloyd asked about the potential legality of installing a boom gate at the entrance of Bird Key in an email to Sarasota City Commissioner Liz Alpert. Already, that entrance has a gatehouse at which a security guard is stationed, but residents wondered if they could do more to control entry to the neighborhood.

“This has arisen as a direct result of criminal activity on the Key, which has recently shown a dramatic increase,” Lloyd wrote.

According to city legal staff, the answer is a simple no — access to the neighborhood’s public roads can’t be restricted. For Bird Key residents who hope to boost security on the island, then, a question arises: How do they achieve their goals while complying with the realities of city regulations?

REPEATING HISTORY

When the city finally responded to Lloyd’s inquiry Tuesday, it was able to draw on an existing reserve of research related to this specific request.

City Attorney Robert Fournier said this type of inquiry arises every decade or so. The question last came up in 2009. Both then and now, the city attorney’s office referred back to memos from 1996 answering the same question

about a gated entrance to Bird Key. At that time, Deputy City Attorney Michael Connolly cited a 1990 Florida Attorney General’s ruling as he stated a gate would not be allowed at the entrance to the neighborhood.

“Currently, the streets within Bird Key are dedicated to the public and maintained by the public,” Connolly wrote. “As such, it would be illegal to install a security gate which would limit access to the public road.”

In 1996, residents expressed an interest in potentially purchasing the neighborhood streets from the city to get around that restriction. Connolly doubted that was a viable course of action — which makes the gate a non-starter from the city’s perspective.

RAISING AWARENESS

There is already a good deal of security in place. Because the streets are public, the Sarasota Police Department does patrol Bird Key regularly.

In addition, the homeowners association contracts with a private security firm that monitors the vehicles coming and going from the neighborhood and assists visitors and residents. Security cameras are posted at the entry point near John Ringling Boulevard, and about five years ago, residents agreed to pay to have the security patrol on-duty 24/7.

According to SPD crime data, there were a total of five serious crimes on Bird Key between May 1 and July 21. Those incidents fell into three categories: burglary,

larceny from vehicle and motor vehicle theft.

Charlene Creel is a member of the Bird Key Homeowners Association who’s lived in the area for a decade. She acknowledges that the neighborhood’s crime rate is typically very low, but said criminal activity occasionally rises — relatively speaking — during the summer months.

Creel says she can think of two boat thefts in the past few months in the neighborhood. With many seasonal residents out of town during this time of the year, Creel calls many of the incidents crimes of opportunity.

“Someone leaves the car parked in the driveway, doesn’t lock it and there’s an iPad on the seat,” Creel said. “Or, we have a lot of older homes — someone may leave a window open, and it’s very easy for someone to get into a home that way.”

In search of a way to target that sort of crime, Creel said one of the neighborhood’s most effective tools might simply be education.

Ensuring that doors are locked, vehicles are secured and lawns are mowed even when residents are out of town so potential robbers can’t pounce on an easy target — these are ways Bird Key can reduce criminal activity.

Still, Bird Key residents are likely to continue exploring their options. The homeowners association’s security committee is constantly working with the city and the third-party security firm to brainstorm ways to cut down on crime in the neighborhood, Creel said.

“Some of those may be possible without significant cost,” Creel said. “Some of them may be costprohibitive, some of them may be legally prohibited. It never hurts to ask.”

Although the entrance to Bird Key is already watched by private security and cameras 24 hours a day, the community’s homeowners association is interested in exploring other ways of targeting criminal activity.

Future development of the Colony Beach & Tennis Resort relies on a long-disputed recreational lease, which includes a $2.5 million judgment that U.S. Bankruptcy Chapter 7 Trustee Douglas Menchise controls.

And at 10 a.m. Friday, both the rec lease and its judgment will go to the highest-bidder hearing in U.S. Bankruptcy Judge K. Rodney May’s Tampa-based courtroom.

On Aug. 14, May denied an emergency motion from the Colony Beach & Tennis Resort Association to keep its $600,000 settlement with Menchise intact.

Menchise filed a motion Aug. 6 to rescind that agreement, which had expired and contained a mutual mistake of fact.

On Aug. 7, after the agreement expired, Unicorp President Chuck Whittall announced he reached an approximately $1.4 million cash settlement agreement with Menchise that acquires the rec lease judgment and provides more cash for Menchise to settle claims.

Colony Association attorney Jeff Warren urged May in the emergency order to consider that Menchise undermined the association agreement.

May denied the association’s request to uphold the previous agreement and decided the rec lease and its judgment will be sold to the highest bidder Friday.

May recently described the association settlement as “coming in second place” to Unicorp’s settlement as the offers currently stand.

Whittall, who has an agreement to purchase Colony Lender LLC’s 95% interest in the recreational property, said he expects to come in first place for the rec lease.

“We believe we already own the rec lease and the judgment, but we’re moving forward with this to end the dispute,” Whittall said.

“If someone else walks out with the rec lease and the judgment Friday, we will appeal the decision in court because we’re confident we own the lease and the judgment against unit owners.”

Association President Jay Yablon, though, says he expects the association to place the winning bid Friday. A unit owner meeting held last week also approved unit owner assessments to fund settlement cash involved with settling disputes.

said, which led her to consider a larger room for the meeting.

At the meeting, town staff will review plans with restaurant owners Mark Caragiulo and Tom Leonard. The meeting is open to the public, but the public is unable to provide comment at this time.

Ray said she expects the meeting “to be a lengthy one.”

“We’re concerned with parking and the number of seats being asked for,” Ray said.

The application, Ray said, also doesn’t provide “competent and substantial evidence” as required to justify why the restaurant needs additional seats, yet does not need to provide more parking.

The site currently has 49 parking spaces. Moore’s, which closed in July, had 185 seats.

Power problems remain on Longboat Key FPL: OUTAGES AREN’T NORMAL

er outages before they decide whether to approve a $25.5 million Gulf of Mexico Drive undergrounding project in November.

District 5 Commissioner and Lands End resident Pat Zunz has complained for years about frequent power outages on the north end of the Key. “Now the southern end of the Key is finding out how frustrating frequent power outages are,”

Zunz said. “I’m concerned about the undergrounding question. We may be getting into something too fast without having all of our questions answered.”

The town has heard from residents about the surge of outages.

“We’ve been getting a lot of calls from residents about the power outages and are trying to address it,” Ross said. “People aren’t happy about it.”

Seven outages in seven weeks: Does that reflect what a $25.5 million undergrounding project could buy the town?

That was what town officials wanted to know during an Aug. 19 meeting with six FPL officials.

“Knowing that town residents will soon be considering undergrounding overhead electric lines, we asked FPL if this current (power problem) situation is indicative of typical underground systems reliability,” Ross said.

But FPL staff said that the recent number of outages is not typical, even for an older electrical system, according to Ross, and the faulty equipment is to blame.

“FPL representatives explained our recent experience is unusual and not reflective of their normal system reliability,” Ross said. “The FPL representatives stated that the number of outages and issues in a short period of time are unusual for their system. They apologize and will continue to be proactive to minimize future interruptions.”

Longboat Key has a power problem — and now, Florida Power & Light Co. officials have confirmed it.

Since approximately 3,500 Longboaters lost power the night of July 7 — many for up to 10 hours — the Key has experienced at least six other confirmed outages and several power flickering outages that aren’t documented by FPL. Last week, FPL Southwest Florida Area Manager Rae Dowling confirmed the statistics and that issues with the main feeder lines that run under Sarasota Bay are the cause of some outages.

“Outages have been related to two main feeder cables supplying Longboat Key,” Assistant Town Manager Anne Ross wrote in an Aug. 21 email to the Longboat Key Town Commission.

The feeders originate at various points within the city of Sarasota and run underground through Sarasota Bay. Other power outages were the results of lightning strikes and equipment failures, either on the Key or the mainland.

The town and the Longboat Observer requested a breakdown of outage causes from FPL. The information was not available at press time.

Ross said that six FPL officials confirmed during an Aug. 19 meeting that the most problematic feeder crossing New Pass from City Island has been in design and

Summer floods Mote with tiny turtles Blame it on the rain: Summer storms could be responsible for a surge in hatchling patients.

It’s the time of nesting season when baby turtles are finally hatching and heading to sea. This year, however, many of these turtles are washing back to shore and fighting for their lives.

“They swim out and don’t make it far enough and wash back on the beach during storms or high winds and waves,” said Holly West, Mote Marine Laboratory sea turtle care coordinator, of the tiny turtles known as washbacks.

Although washbacks are seen every year, this season’s hatchlings are washing back in unusually high numbers.

During last year’s turtle nesting season from May through October, Mote cared for 2,600 hatchlings in its hospital. This season, the hospital has already treated 1,880 hatchlings. More than 1,000 hatchlings were at Mote in July, and on Aug. 8 alone, 150 were brought to Mote.

Many rescued hatchlings are found after they become disoriented or have been excavated from their nests. Those otherwise healthy hatchlings gain their strength back at Mote and are released within one to three days.

Washbacks, however, usually need more attention, and Mote has treated more than 400 hatchlings in need of critical care.

To identify turtles in critical care, scientists paint letters on the shells with nail polish. The hospital is in its 17th round of the alphabet, and scientists ran out of nail polish colors.

The high number of turtle washbacks correlates to the stormy weather the area has seen, but the exact cause of the washbacks is not known.

“We have storms all the time, every season, but these ones did coincide with the peak hatching period,” West said. “We are putting a lot more out there, and there’s a chance for more washbacks. Storms may and probably do have an influence, but we can’t say for sure.”

Barring problems, when a turtle hatches, it heads to the ocean. As soon as it hits the water, it swims for three days straight out to the weed line, where it has food and is covered from predators. Those first days, it receives nutrition from its yolk.

But when it washes back onto shore, its yolk is depleted, and it is not receiving proper nutrition.

“Those who don’t make it are very malnourished and starving,” West said. “We get a lot of roughlooking ones.”

Although the washback problem is unusual for the Gulf Coast, it is common on Florida’s Atlantic side, possibly due to its rougher surf and larger ocean.

“They are much more equipped to handle this,” said Cyndi Seamon, Longboat Key Turtle Watch vice president. “We just do what we can do. This is really weird for us, but for the other side of Florida, it’s not. I don’t know that we’ve ever experienced something like this.”

Of the 400 hatchlings that

have been through critical care at Mote, about 30 remain in the hospital. To be released back into the wild, a hatchling must be completely healed of its injury and able to dive to the bottom of the tank and eat independently.

“We’re getting a good chunk of them back out,” West said. “We try to put as many back into the wild as possible. There’s very little hope for washbacks if they’re not brought here. Every little one counts.”

As of Aug. 8, there were 2,362 loggerhead, 36 green and two Kemp’s ridley sea turtle nests this season spanning from Venice to Longboat Key beaches.

Each nest has about 100 eggs.

But only one in 1,000 hatchlings will make it to adulthood. Thanks to Mote, more hatchlings will live.

“Some people were reporting a bird had a turtle in its mouth,” Seamon said. “In the daytime, they are getting eaten by birds and crabs or they’re starving. If they weren’t found, they had no chance. They’re getting this second chance at life.”

SLURRING SAILOR 4:08 p.m. — Off the Key Assist Other Agency: The U.S. Coast Guard patrol boat requested Longboat Key marine patrol assistance in stopping a sailboat southwest of Jewfish Key because officers believed its captain was “very intoxicated.” The boat was escorted to the Linley Street boat ramp, and its owner had slurred speech and acted confused.

The boat owner said he was taking several medications that affect his balance. He was charged with boating under the influence and refusing to submit to a Breathalyzer test.

As a fire lieutenant and paramedic at Longboat Key Fire Rescue Station 91, Thomas “Tom” Batchelor has a resume that shows his passion for helping others.

Now 54, Batchelor plans to retire in June. But, he hopes to serve his community in another way. He is challenging Manatee County Commissioner Vanessa Baugh for her District 5 seat.

So far, he is Baugh’s only challenger in the 2016 general election. Although he’s facing an incumbent who has held the position for three years, Batchelor doesn’t see himself as the underdog.

He is running as a nonpartisan candidate but describes himself as a fiscal conservative and a moderate on other issues.

“I don’t want to be stereotyped and for residents to think I always side one way or another, just because of my political beliefs,” Batchelor said. “I’ll be working for the entire county, and I prefer to look at everything down the middle. A middle view is the best way to see both sides, and that’s the best way to make a decision.”

He believes there are paral-

lels to running for government office and the previous positions he has held.

“We need more listeners,” Batchelor said. “As a firefighter, that’s how you learn your instructions, and then you act on the mission you’re given.”

Batchelor, a dog-lover who rarely goes on a motorcycle ride without his 3-year-old rescue dog, Ichabot, decided to run after disagreeing with the county’s handling of recent animalrelated issues.

The recent discussion on the fate of Padi, a dog accused of biting a boy’s ear off at a local veterinary office, prompted Batchelor to enter the race.

He believes the commission hasn’t held the Public Safety Department accountable for what he believes is a lack of oversight of animal services issues.

“We need to make sure people who work for the commission are properly overseeing what’s happening in the county,” Batchelor said. “Someone’s not paying enough attention.”

If elected, he plans to increase the number of EMS personnel throughout the county.

“We’re overburdening our EMS people,” Batchelor said.

and we still need more of them on the road. Period.”

Although he doesn’t know where the funding will come from yet, he supports a millage increase or shifting other dollars in the budget to fund those positions.

Batchelor also hopes to help create community budget and public safety committees to give residents a say in local decisionmaking.

“The commission serves its constituents,” Batchelor said.

“Working together more closely with them might show us that someone else might have another mousetrap that works better than what we already have.”

WILD RIDE 11:51 a.m. — Intersection of GMD and Longboat Club Road Reckless Driving: Police witnessed the operator of a blue BMW driving southbound recklessly, weaving in and out of lanes. The car then drove head on toward a truck, causing the truck’s driver to drive onto the sidewalk to avoid a collision. The BMW driver told police he didn’t feel well after a dentist visit after police pulled him over. He was checked out by firefighter/paramedics and given a ride home.

Progressive forces continue to rant for forcing businesses to pay a $15-perhour minimum wage. There is no convincing them that this hurts the very people they hope to help.

But Donald J. Boudreaux, a senior fellow with the F.A. Hayek Program for Advanced Study in Philosophy, Politics, and Economics at George Mason University, recently addressed the issue on his blog, Cafe Hayek: “So rather than play the futile game of Dueling Studies to decide whether to put at risk with minimum-wage legislation the employment prospects of hundreds of thousands, and perhaps millions, of low-skilled workers, let’s ask a simple yet probing question: Does anyone doubt that fewer people would vote if government raised the cost of voting by imposing a poll tax?

“The unambiguous answer is no.

Yet the same logic that leads to this answer strongly suggests that firms will employ fewer low-skilled workers when government raises the costs of employing such workers by imposing a minimum wage.”

A

lthough Longboat Key is an affluent community, many of its neighbors in Sarasota don’t know how they’ll get their next meal. Queens Harbour residents Bob and Teresa Simmons have been combating this problem since January by coordinating a food pantry at Tuttle Elementary School. The pantry provides food to more than 100 families and children in need every other week.

Why did you become coordinators of the food pantry?

Bob: The Rotary Club last year contacted Tuttle and asked if they would be interested in having a pantry, and the principal, Tomas Dinverno, was interested.

Sarasota has five or six Title I schools, and we worked last summer at Alta Vista Elementary School. When our president, Sydelle Pittas, said she wanted to start one, we decided to become coordinators.

Teresa: We were looking for a school to work with, and Tuttle had the need. The room we have and the setup is perfect. It’s also one of the closest schools to Longboat Key. How does the program work?

Teresa: Families stand in this big, long line, and the parents go into the pantry a few at a time and shop. The kids stay outside to color. It doesn’t take long for the shelves to go bare.

Bob: It’s after school, and the kids are with their buddies, coloring. It allows the parents to feel comfortable doing this because their kids are with their friends.

How many families have you served?

Teresa: At our first pantry in January, we had 23 clients. During our last school year pantry, we had 101 or 103 families. Each week, we beat ourselves and got more and more shoppers.

Bob: In the beginning, it was slow because there’s a stigma, but when people saw that their neighbors and friends did this, it grew. It’s open to the entire neighborhood in the summer, not just families of the students.

We had 104 at our last one. That was our record.

How much food do you serve per week?

Bob: People donate the food to All Faiths Food Bank, and they give us a packing list every time that tells us what’s coming based on our estimates for how many families we expect. We then divide the food to how many of each item can go per family, and we tell each person how much food they can get.

Bob and Teresa Simmons have served 11,296 meals and 13,556 pounds of food since January at Tuttle Elementary School in Sarasota as coordinators of the Tuttle Elementary Nutrition (TEN) program.

How aware are people on Longboat Key that childhood hunger and poverty exist just a short drive away?

Teresa: I can’t speak for everyone else, but for us, I don’t think I realized the need so close to home until last summer. It’s so prevalent, and it’s not just one school here. It’s everywhere.

It’s not a commercial on TV for starving children in other countries. It’s right here. We have a huge homeless problem that can’t be resolved.

Why is this important?

Bob: There are a lot of needy families in the area. Most of us chose Rotary in the first place to help others, and we don’t want these kids to go hungry. Many have said they would starve without us. I think everybody has a desire to be of service to their fellow man. On Longboat Key, everybody is so affluent, and I think we have a duty to help.

Teresa: When you realize the need, how can you not want to help? We have such hunger under our noses, and something must be done.

What other food programs do you provide at Tuttle?

Bob: They get food during the week for breakfast and lunch.

When they go home on Friday, about 180 students get their backpacks filled up with food. It helps tide them over for a weekend when they otherwise might go hungry.

Are any families you serve homeless?

Teresa: We ask for a zip code and no other information. This could be where their cars are, but we just don’t know for sure. Sometimes, we have bigger meats like a turkey, and some people shy away from them because they either can’t store them or cook them. Many only have a microwave.

Bob: Some of these kids may live in a hotel room or subsidized housing. At Alta Vista, they have courses for parents to learn to cook food in a microwave.

How can people become involved with the program?

Bob: Most of our volunteers are Rotary members or what we call friends of Rotary. For each pantry, we like to have at least 10 helpers. We’re hoping for more, and we’d love to see some new

JOHN ‘JACK’ MCCORMICK

GARY OZAROFF

John “Jack” McCormick, 88, of Bradenton and formerly of Longboat Key and Buffalo, N.Y., died Aug. 21.

Born Oct. 21, 1926, in Buffalo, N.Y., after serving in the U.S. Army during World War II, Dr. McCormick attended Canisius College and Syracuse University before graduating from Cornell University School of Veterinary Medicine in 1949.

Soon after, he took over the Amherst Small Animal Hospital in Snyder, N.Y., which became a pioneer in areas such as eye surgery. Dr. McCormick was very involved with organizations in his professions and was named Veterinarian of the Year in New York State in 1977.

After practicing for 30 years and tiring of the cold winters, Dr. McCormick relocated to Longboat Key, where served as a town commissioner from 1982 to 1984. He began a second career as a Realtor with Kevin Levins Realty, now Wagner Realty. He was named Business Person of the Year in 1990 by the Longboat Key Chamber of Commerce and continued to work until 2010.

He also served as a lector at St. Mary, Star of the Sea, Catholic Church for many years.

Dr. McCormick was a longtime member of Bradenton Country Club and former member of the Park Club in Buffalo. His self-stated proudest accomplishments, however, were his 62-year marriage to Barbara and his five children.

Dr. McCormick is survived by his wife, Barbara; children Timothy, John, Michael, Maureen and Todd; siblings Joan and Peggy; 12 grandchildren; a great-granddaughter; and many nieces and nephews.

A memorial Mass was held Aug. 22.

Gary Roger Ozaroff, 81, of Longboat Key, died Aug. 21.

Dick Gravino sailed through life

Born Nov. 4, 1933 in Brooklyn, N.Y., Mr. Ozaroff spent much of his youth in Connecticut and was a graduate of the Choate and Cornell University. He spent his career as an executive at several large retailers, including Macy’s and Dayton Hudson, and was an executive vice president of the QVC Network. He retired and moved to the area in 1996.

Mr. Ozaroff is remembered as a brave, irreverently funny and caring man of enormous energy and a love of action.

Mr. Ozaroff is survived by his wife, Melinda Ozaroff; children Shelley Wolland, Leslie Killingsworth and Steve Ozaroff; stepchildren Robert Ackerman and Lison Cole; sister, Sharon Scull; 13 grandchildren; and his cat, Jasmine.

Donations in his memory can be made to the American Cancer Society and SPCA Florida.

In November 1962 while stationed in Germany with the U.S. Air Force, Dick Gravino had a second date with a German woman — but he stood her up. He had to attend a class, but he asked the woman to let him take her on another date.

Five months later, they were engaged. They were married for 51 years.

“At that time, I thought, ‘Oh well’ and that I’d never see him again,” Margit Gravino said.

“But I gave him another chance, and the rest is history.”

Gravino, a Longboat Key resident and past commodore of Sarasota Yacht Club, died Aug. 18. He was 73.

Born Sept. 23, 1941, in Lebanon, Pa., Gravino grew up in Hershey, Pa. Despite living across the street from a Hershey’s chocolate plant, he was never fond of chocolate.

Gravino graduated from Lebanon Catholic High School in 1959 and joined the Air Force shortly thereafter, serving from 1960 to 1963.

To earn his bachelor’s degree from the University of Maryland, Gravino attended night school and military courses.

After he was honorably discharged from the Air Force, he pursued a career in finance.

He moved 19 times for his job.

It later took him three tries to finally retire.

“He just missed working,” Margit Gravino said. “He missed challenging himself and wanted to learn new, different aspects of the financial business.”

Gravino discovered Longboat Key during a short vacation in 1997. The couple bought a condo in Grand Bay in 1998, and Gravino fully retired in 2004.

Gravino fell in love with Sarasota Yacht Club and was instrumental in the development of a

Jann Wilshire Shearson, 77, of Longboat Key, died Aug. 11.

Born April 18, 1938, in Sydney, Australia, Mrs. Shearson is remembered for her prowess on the tennis court and ski slopes and her talent as a chef, artist and gardener. She will also be remembered for her 15 years of service as a volunteer at Mote Marine Laboratory & Aquarium.

Mrs. Shearson is survived by her husband, Alec; daughter, Jennifer; and two granddaughters.

A private interment will take place in Halifax, Nova Scotia in September.

“It was Dick who was the driving force to make the new club to where it is today,” Sarasota Yacht Club member Sandra Ceshker said. “It would not be what it is today without him.”

During a span of 30 years, Gravino owned five boats, each one bigger than the last. Four years ago, he took his current boat, the Mardi Gra — a combination of his and his wife’s names — to the Bahamas. He also enjoyed tennis, reading, traveling and biking and was passionate about animals, especially his dogs.

Gravino is remembered for his love of life and sense of humor.

“He was certainly a people person and loved telling stories and jokes,” Gravino’s nephew, Mike Dunlap, said. “He was bigger than life.”

Gravino was preceded in death by his son, Richard. He is survived by his wife, Margit; daughter, Jill; a granddaughter; and siblings Nicholas Gravino, Robert Dowhower, David Dowhower, Joseph Lanphier and Thomas Lanphier.

A public viewing was held Aug. 22.

isitors at Mote Marine Laboratory and Aquarium enjoyed its inaugural Shark Days Aug. 10 through Aug. 15.

Guests enjoyed six days of events focused on sharks, some of the ocean’s most interesting creatures. The events included Google Hangouts, an adultsonly conversation with shark experts, the Fins and Fun family festival and Sharks and Crafts.

Mote is the only center for shark research recognized by Congress.

Jerald and Patricia Good, of Lakewood Ranch, sold their home at 433 Meadow Lark Drive to John and Gail Craig, of Shillington, Pa., for $4.3 million. Built in 2006, it has four bedrooms, five and a half baths, a pool and 5,965 square feet of living area. It previously sold for $5.75 million in 2007.

Sleepy Lagoon Bonaire LBK LLC sold the home at 6381 Gulf of Mexico Drive to James and Valerie Brown, of Lakeland, Tenn., for $1,675,000. Built in 1964, it has three bedrooms, two baths and 1,650 square feet of living area. It previously sold for $1,175,000 in 2014.

It previously sold for $64,000 in 1976.

Windward Bay Janet Rush, trustee, of Grandville, Mich., sold the Unit PH-5 condominium at 4500 Gulf of Mexico Drive to Brian and Eileen Gillen, of Moorestown, N.J., for $414,000. Built in 1975, it has two bedrooms, one bath and 1,096 square feet of
