twice the foot traffic at her business this summer compared with last summer, she admits the vacant space at the southwest corner of the shopping center is an impediment to neighboring businesses.

But the Publix-owned plaza could soon get two new tenants: a restaurant and a Chase Bank.

“We do have initial interest from restaurants, and we’re in the process of negotiating a deal,” said leasing agent Sandra Woodworth, of Crossman & Co. “I can’t elaborate on that.”

Town staff is also vetting plans for a new Chase Bank on the outparcel at the north end of the shopping center.

The 2,500-square-foot end space has been vacant the three years since the plaza’s completion.

“They’re in negotiations nonstop with restaurants,” said Longboat Key Fitness owner Petar Sibinkic.

Still, Sibinkic would like to see a breakfast-and-lunch diner similar to Peaches in Sarasota or a deli open in the space.

Summerall would like to see a Starbucks move into the vacant space, which also affords a potential tenant patio seating.

“Even the older people drink Starbucks,” Summerall said.

The Chase Bank is slated for the northeast corner of the Shoppes of Bay Isles, meaning it will be closer to the Bay Isles Parkway entrance of the plaza than the Bank of America and SunTrust Bank farther north.

The 2,500-square-foot space at the south end of the Shoppes of Bay Isles has been vacant for three years, but a restaurant could be coming to the plaza.

Director Alaina Ray said that during a July 13 Development Review Committee meeting, staff had only minor issues with the application.

The Planning and Zoning Board will consider a site plan for the new bank in September. The site plan will then go before the Town Commission for final approval.

Although Sibinkic would like more traffic in the plaza during

the summer months, he said his clientele has grown by 2% to 3% each year since his gym opened.

“That’s about as good as it gets with this type of business,” Sibinkic said.

Publix purchased the shopping center property for $14 million in 2008. It tore down the existing Avenue of the Flowers shopping center and built the new Shoppes of Bay Isles in 2013.

im Kessler’s family has lived in the house at 690 Fox St. for more than four decades.

“We came out here about the same time the peacocks came,” Kessler said.

Since then, her family has started naming and feeding the peacocks on Fox Street. She watched as one of those birds, nicknamed Leo, was struck with a dart and taken away during the July 7 trapping.

According to Kessler, at least two trappers wielded rifles and handheld tranquilizer guns, and manhandled the peacocks gathered that day by dragging the birds by their feet across lawns.

Adding more emotion to the incident: Two of the peacocks struck with darts and removed from the Village were Leo and Mr. P., two peacocks that Kessler had fed cat food and bread for the past several years.

“He was carrying Leo just like he was a sack of potatoes,” Kessler said.

Her neighbors, who declined to give their names to the Longboat Observer, told Kessler they witnessed the trappers trespassing onto private property before shooting the birds.

“A neighbor who hunts said it was the most brutal thing he had ever witnessed,” she said.

As the truck pulled away, Kessler gave chase.

“I was hobbling down the street as fast as I could with my cane shouting ‘Leo, Leo’,” she said.

After the capture, at least six neighbors were sobbing in the street, consoling one another for at least a half hour, Kessler said.

Kessler said she was also troubled because she did not know where trappers were taking the captured peacocks.

Just six of the 41 peacocks captured this year have been taken to Birds of Paradise in eastern Manatee County, the facility that agreed to take on the peacocks, due to a lack of space. The remaining peacocks have gone to private facilities.

Village residents WORTH THE COST? Since the beginning of 2016, the town has spent $9,775 on peafowl removal through its contract with Nuisance Wildlife Removal, which has so far trucked 41 of the birds off the Key. Former Village Association President Fred Kagi was hopeful when the contract began, but he now thinks the contractor isn't spending enough time in the Village.

Nuisance Wildlife Removal Vice President Christy Norris said the firm has been going out consistently, but it never announces its presence to the neighborhood.

Some neighbors had started feeding the birds before contractors arrived to foil their strategy of luring the birds into traps using food, according to Norris.

“Would I like it to be more scheduled? Maybe. But I understand, it’s a business, and they have their way of doing things,” said Streets, Facilities and Parks and Recreation Manager Mark Richardson.

n the afternoon of July 7, the Bradenton-based Nuisance Wildlife Removal trappers arrived in the Longbeach Village with 4-foot tranquilizer rifles in tow.

The town’s contractor completed its first organized effort to collect peacocks using tranquilizer darts that day, removing six bird. Trappers followed up July 20 by capturing another eight birds. The efforts followed bird roundups that took place earlier this year in which trappers used food to lure peacocks.

Depending on your point of view, what occurred was either bird brutality or a peaceful culling of the controversial birds.

“Peacocks on Longboat Key has always been an emotionally charged issue,” said Town Manager Dave Bullock.

“There’s always two side to every story, obviously,” Richardson said. “I was onsite the entire time this went down, and no one went on anyone’s private property to dart peacocks.”

Indeed, trappers shot tranquilizing darts from public rights of way at birds.

But peacocks don’t go down immediately when they are struck with darts, he explained. They may stagger for five to 10 minutes, during which time they could walk onto a resident’s property.

“If a bird gets darted, we have to retrieve it,” said Nuisance Wildlife Rescue Vice President Christy Norris. “It would be inhumane to just leave them.”

As for why trappers were carrying the birds by their feet?

“Whether they’re awake, or whether they’re darted, the way you carry them is by their feet like you would a chicken,” Richardson. “I didn’t see any dragging of the peacocks on the street.”

Richardson said the operation was moving smoothly July 7, until trappers approached Fox Street. After trappers struck several peacocks with darts, Richardson consoled two women — one of whom was Kessler — who were crying in the street. It wasn’t the first time emotions ran high during peafowl removal, he said.

“There were tears shed even before then — when there was a trap,” Richardson said. “Two women were visibly upset when we were trapping them in the cages back in June.”

Following the July 7 incident, the town and Nuisance Wildlife would tweak the darting process to avoid a situation like that in the future, Richardson said. For one, he advised trappers to return their tranquilizer guns to their vehicle before they retrieve the bird for transportation.

The Longboat Key Police Department will be on-site to oversee future removal efforts involving darts and answer questions from residents. Chief Pete Cumming was present during the July 20 capture.

“The trappers were doing everything the way they were supposed to,” Cumming said.

Norris said she has transported six of the peacocks to Birds of Paradise, and the rest go to private collectors or sanctuaries — some as far north as Hillsborough County.

Richardson said there is always the potential for controversy when it comes to the peacock trapping.

“In the end, a guy with a gun darting something is always going to bother someone,” he said. “It’s not a pretty picture, but it’s not hurting the bird either.”

Town Clerk Trish Granger can’t predict voter turnout for the upcoming density referendum Aug. 30.

“We haven’t really had anything on the ballot in August before,” she said.

But Granger wants full-time and seasonal residents to know they must be registered to vote on Longboat Key by the 5 p.m. Aug. 1 deadline to cast ballots in the referendum.

The vote will determine whether Floridays Development Co. obtains density on the north-end parcels it is under contract to purchase. If approved, the density could pave the way for Floridays to build a 120-room hotel.

Key residents who live in Manatee County can register by visiting VoteManatee.com to download the form, or visit the Manatee County Supervisor of Elections Office at 600 301 Blvd. W., Suite 108, Bradenton.

Sarasota County island residents should visit SarasotaVotes. com and download the application, or visit 101 S. Washington Blvd., in Sarasota.

Forms are also available at Longboat Key Town Hall, 501 Bay Isles Road.

Both counties require registration to be hand-delivered or mailed to the supervisor of election’s office.

Because it’s off-season, snowbirds and residents who will be out of town Aug. 30 should update their addresses with the supervisor of elections office in their county to ensure they receive their absentee ballots.

Absentee ballot request forms for both the Sarasota and Manatee County supervisor of elections offices are available at Town Hall.

The deadline for residents to request an absentee ballot is Aug. 24.

In both counties, early voting starts Aug. 20, although there are no early voting locations on the Key. Voters can cast ballots at both supervisor of elections offices, the West Manatee Fire and Rescue Administrative Offices in Bradenton and Westfield Sarasota Square Mall in Sarasota.

Polls will be open from 7 a.m. to 7 p.m. on election day, and there will be free bus service to Town Hall, where Sarasota County residents vote, and Longboat Island Chapel, the island’s Manatee County polling location.

The Aug. 30 ballot will also include primary election races.

Floridays officials have described the project as a “boutique hotel.” However, some residents, including a group of Longbeach Village residents who formed a group called Keep Longboat Special, say it is incompatible with the surrounding area.

W

hen Spanish Main Yacht Club resident Tom Freiwald first heard about Longboat key’s neighborhood underground utilities project, he thought his community would be safe from large assessments.

Then he saw the final project map.

“I said, ‘You’ve made a mistake’,” Freiwald recalled. The community has only one nearby set of wires above-ground, located south of the 50-year-old condominium complex. But because those wires are within 55 feet of units, the neighborhood was assessed more than $2 million over the next 30 years using the town’s latest methodology.

After a packed Town Commission meeting July 5, and a July 18 meeting with Town Manager Dave Bullock and staff, Spanish Main now plans to spend up to $1,500 to explore burying its own wires.

“We know it’s not going to cost more than $2 million,” Freiwald said.

During the July 5 meeting, representatives from at least six neighborhoods spoke against the underground utilities assessment method. And local land use attorney Robert Lincoln announced plans to formally protest the analysis.

Commissioner Phill Younger made a motion to redo the study and come up with a new methodology. The motion failed 3-4.

Younger attended the July 18 meeting with Bullock, staff and Spanish Main residents but declined to speak about the presentation.

On July 5, commissioners directed Bullock to return in October with a new analysis of the 55-foot rule, recommendations relating to neighborhoods self-funding their underground utilities and advice on potential savings or other non-ad valorem sources to offset the lost revenue from those neighborhoods.

The town originally gave communities a May 9 deadline to pursue burying their power lines.

“The clock had ticked so many seconds off, and there wasn’t enough time to get that done,” Freiwald said. “Now, that clock

has been reset, and we have some time to open that conversation.”

Lincoln said he will not challenge the assessment method in court until town commissioners formally adopt a methodology.

“At this point, while I’m representing one of the homeowners in Club Longboat, my understanding is that they’re continuing to work on identifying everything they would have to do to underground the line they have,” Lincoln said.

Although the Town Commission won’t decide on whether to extend the timeframe for selffunding until later this year, Spanish Main intends to move forward with a survey of its wiring. Representatives will contact Florida Power & Light for an estimate.

Representatives from Country Club Shores have also reached out to town staff, but they haven’t formally moved forward with plans to bury utilities, Bullock said.

“I think everyone’s in the factfinding stage,” he said.

It could take up to six months for Spanish Main to receive an estimate from FPL, but Freiwald said he aims to make significant progress by the time the commission discusses the issue.

“We don’t want to wait until October to begin,” he said.

During the July 5 meeting, Lincoln said Club Longboat received a $25,000 estimate from FPL to bury its wires.

“Even if the commission chooses at the October meeting not to allow communities to bury their own wires, our investment will be time and that $1,500,” Freiwald said. “When you weigh that against the opportunity to impact 212 taxpayers, that’s not much of a risk.”

APRIL 2009 Bank of America filed a foreclosure suit against longtime Colony owner Murray “Murf” Klauber and seven of his corporations. The suit came two-and-a-half years after unit owners stopped paying for operational expenses after disagreeing with Klauber over who was responsible for paying for $10.6 million worth of repairs and improvements.

AUGUST 2010 The Colony closed after U.S. Bankruptcy Judge K. Rodney May’s ruling dissolved the hotel partnership and gave the resort’s 232 unit owners complete control of their units, effectively closing the resort.

SEPTEMBER 2013 Colony Lender LLC foreclosed on the Klauber loans and won a $13 million judgment in Sarasota County court.

FEBRUARY 2010 Colony Lender LLC, managed by developer/entrepreneur Randy Langley and businessman/attorney David Siegal, purchased overdue loans on key Klauber Colony properties from Bank of America for an undisclosed amount.

JULY 14, 2014 Colony Lender LLC, through an agreement with Unicorp National Development Inc., paid $15,200,001 for an 80% interest in the 2.3-acre property — bringing its ownership to 95% — plus 100% ownership of the restaurant complex and Klauber’s former penthouse at an auction.

SEPTEMBER 2014 Unicorp sent demand letters to unit owners warning them they could face liabilities of more than $42.3 million stemming from a longdisputed lease of the recreational property and offering $20,000 per unit and a waiver of liability. Colony Lender then sued unit owners for $5.1 million for unpaid rent and real estate taxes going back to October 2008.

Colony case: Close to closure?

A court ruling that favors the Colony Beach and Tennis Association and a vote scheduled at press time could pave the road for redevelopment.

On July 20, U.S. Bankruptcy Judge K. Rodney May issued two orders in the Colony case, both of which tilted in favor of the Colony Beach and Tennis Association.

May sanctioned Colony Lender LLC and Unicorp, the two entities that control 2.3 acres of recreational land at the resort, and ordered them to pay $69,628.50 for allegedly violating an automatic bankruptcy stay when they sued unit owners in 2014, demanding payments for that land.

Further, May determined that Colony Lender had not acquired the recreational lease associated

with the property itself. Colony Lender had previously sought damages and rent from unit owners in connection with the rec lease — an amount they threatened could amount to $42.3 million.

“Well, it wasn’t surprising to me,” Colony Association President Jay Yablon said of the orders. “We were expecting them, because we felt we were right here.”

In a July 21 memo updating the Longboat Key Town Commission on the status of the litigation surrounding the property, Assistant Town Attorney Kelly Fernandez wrote: “Other than remaining appeal rights, the vast majority of the

litigation involving the Colony property has now been resolved.”

But those awaiting resolution in the 8-year-old legal saga shouldn’t celebrate just yet.

Representatives of Colony Lender say they plan to appeal the decision.

“As far as the two rulings go, we believe they are clearly erroneous,” said Colony Lender principal David Siegal. “And we will be appealing both of them to the district judge, as we have in the past.”

At press time Tuesday evening, the Colony Association’s board of directors was scheduled to meet later that night to determine whether to send a development agreement with Unicorp to unit owners for a vote. The two sides

would need approval from 75% to 90% of owners to proceed, an amount that varies due to legal uncertainty over the possibility of the agreement being challenged, Yablon said.

If approved, the development agreement would include a global settlement of most litigation surrounding the property.

“If unit owners approve the development agreement, the rulings are irrelevant,” Siegal said.

If not, the case would continue through the appeals process.

But Unicorp President Chuck Whittall is clearly hopeful about Tuesday’s vote: He’s planning a press conference at 10:30 a.m.

“I think Colony Lender will be ‘bye-bye’ (this) week,” Siegal said, which means one less player in the Colony saga.

Whittall said he plans to be a good community partner in the redevelopment effort.

“I don’t give up on stuff like this,” Whittall said. “It makes sense to be there, and it’s going to be a great project for the Key.”

Into the liar’s den Republican Carlos Beruff knew that being a candidate for the U.S. Senate could get ugly. But calling him a ‘Charlie Crist Republican’? Now that’s nasty — and a lie.

E

veryone knows that political campaigns and political advertising — especially the advertising of political action committees — often have the integrity of, well, career politicians. The truth is twisted, nuanced, parsed, obfuscated. And more often than not, the campaigns and advertisements spew downright lies.

No wonder voters have such a low opinion these days of career politicians. And no wonder “the outsiders” are disrupting the 2016 election cycle.

Case in point: Manatee homebuilder Carlos Beruff, running for incumbent Marco Rubio’s U.S. Senate seat on the Republican side.

If you talk to Beruff, he’ll tell you that even he — a businessman who has made close to $1 million in political contributions in the past decade and a half; who has served on state boards as a gubernatorial appointee; and even as someone considered by some a political insider — even he has been surprised at the ugliness and nastiness that goes on behind the scenes and the lying that goes on in public.

Welcome to the Bigs, Mr. Beruff.

The operators of Rubio’s political action committee, First Florida Project, started their smear attacks with a TV ad portraying Beruff as a “Charlie Crist Republican.”

Talk about an insult. Of course, anyone who knows Beruff’s politicophilosophical beliefs laughs at the claim. Beruff and Crist are almost philosophical opposites — ever since Crist’s political sex change. Beruff is to the right of Rubio.

But this is politics. And as they say: All is fair in love, war and politics.

To that end, Rubio’s hit squad is a group of longtime Republican political operatives from South Carolina, some of whom advised Rubio in his surprising 2010 Senate race and who ran one of his presidential PACs. Their list of clients — Bushes, McCain, Giuliani, Schwarzenegger, Ernst, DeMint, among others — gives you the sense they can be real pros at fudging the truth and creating negative perceptions in the minds of under-informed voters.

And so it goes: Discredit Beruff among the state’s diehard Republicans. Rubio’s PAC men know there is a viscerally negative reaction among Republicans toward Crist, and they also are trying to hold on to the Republicans who backed Rubio over Crist in 2010.

Anatomy of a smear Longtime election campaign advisers and operators of political action committees for U.S. Sen. Marco Rubio over the past 10 days began a negative TV-ad assault against Rubio’s Republican rival, rookie politician and longtime Manatee County homebuilder Carlos Beruff.

The strategy: Berate Beruff, calling him a Charlie Crist Republican.

1. The media takes the bait News media love name-calling stories. Below is a sampling of the “news” stories in Florida media that resulted from a Rubio PAC TV ad.

2. Distort the truth; make false statements.

The coup de grace in the ad comes at the end when it states “Beruff supported Crist even when Crist switched parties.” The evidence? Beruff attended a reception for Crist at the home of Dr. Gary Kompothecras after the switch. But money talks: As shown below, Crist left the Republican Party on April 29, 2010. Beruff’s final contributions to Crist, according to the Federal Election Commission, were 11 months earlier, June 2009.

But Beruff has his own trump cards — Gov. Rick Scott and Scott voters and running as a non-career politician, businessman outsider like Donald Trump. What’s more, while Beruff may be a neophyte political candidate, he also is an adept business competitor. He hired his own Big League campaign managers, Maryland-based OnMessage — the same group that ran Gov. Scott’s re-election campaign and campaigns for dozens of other Republican congressional candidates.

Turnabout is fair play. OnMessage and Beruff’s strategy: Paint Rubio as a lying, career politician (“I will not run for re-election.”).

Be prepared for another month of political ugliness. Hopefully, you’ll be able to sort out the truth.

3. Leave out “the rest of the story.”

It’s standard practice in political TV advertising to leave out context and “the rest of the story.” The “Beruff is a Charlie Crist Republican” ad notes that Crist appointed Beruff to three state boards — State College of Florida board, Sarasota-Manatee Airport Authority Board of Commissioners and the Governing Board of the Southwest Florida Water Management District. And that he made contributions to Crist when he was governor. (Of course, so did most other loyal big Republican donors.)

But the ad neglects to inform voters that after Crist left the Republican Party, Beruff did not support Crist in his failed 2010 Senate race or his failed 2014 gubernatorial race. Nor does it say anything about Beruff supporting Gov. Rick Scott with more than $75,000 in contributions to Scott’s PAC, Let’s Get to Work or Beruff serving on Scott’s transition team, as head of a state hospital board or continuing on the three boards to which Crist appointed him.

crowd the pristine beaches … bringing noise and trash, damaging dunes and impacting turtle and bird nesting” and your comment that “And that’s not happening now?” … I am sorry, but I am incredulous that you suggest in seeming resignation that it’s a public beach, so hey, what can we do?

If you have gate crashers and rowdy strangers overrunning your block party, do you just throw up your hands and invite more?

6. You say having a park on the land in question is a “losing proposition.” When our town commissioners wish to either appease certain vocal groups (tennis players a few years ago) or appeal to ego (commercial land purchase next to Publix), the money magically appears, and your expressed concerns are all dismissed.

I have said at town meetings and in letters to the editor that for less than the $1.5 million the town spent on the commercial land near Publix, the town could have bought the site in question and created a beautiful gateway park on the north end.

7. You suggest as an option that supporters of Keep Longboat Special and Village residents who oppose the hotel can buy the property for themselves and create their own private park. Gee, where was

one to two hours for a table.

Consider what it will be like when the Zota Beach Resort opens this fall with 187 rooms.

The Colony will add 237 units eventually, and most importantly, the Key Club will add 259 rooms that were approved by referendum last year. (You forgot about that!) That’s 683 more hotel units than we have now and double the amount the voters approved in 2008.

In your editorial, you endorsed the referendum, but you failed to point out the benefit to the residents. There are none.

The only benefit is to the papers for additional advertising revenue.

When the referendum is defeated, the town should buy the gas station property and create a pleasant gateway to LBK from the north. After all, there are no parks on the north end like there are on the south end. A park could be developed for far less than what the town paid for that “scrub” piece of property next to the Tennis Center.

This is a residential island, and the residents’ interests should come first and foremost.

this obnoxious position when the south-end tennis group petitioned and got the town to build them their own Forest Hills Tennis Stadium?

When you close with saying the Floridays hotel project “will contribute positively to north Longboat Key’s quality of life,” you clearly do not live with the rest of us. But most assuredly, you think you know what’s best for us.

“It’s deja vu all over again” — on that point we agree.

Floridays’ plan has no benefit to residents Your opinion in the July 21 issue left out some important information regarding the August referendum.

A more appropriate Yogi Berra quote would be, “No one goes there nowadays. It’s too crowded,” because that’s what potential buyers visiting Longboat Key will be thinking. Last season, some real estate agents expressed that very concern.

Even now, with the old Hilton and Colony closed, our traffic seems worse than ever.

In response to your July 21 editorial praising and supporting the Floridays project, I have several comments: 1. “I-got-miners” is your condescending insult to those who saw a peaceful, safe and relatively quiet location of natural beauty and made a carefully reasoned decision to invest significant sums of money to buy a Longboat Key residence.

Newcomers are always welcome to do the same with the implied understanding that we all wish to preserve the qualities and attributes, indeed “static and lush” as you state, that persuaded us to buy in the first place. That does not include more motels and transient visitors.

New, properly zoned residential construction and redevelopment — absolutely.

But “shoehorning” a threestory building with parking underneath, bordering a quaint neighborhood — absolutely not.

2. I was here in 2008 and would like to remind you that the “loss of visitors” was (a) not a negative to many residents; and (b) was a result of the significant national economic downturn that affected

all economies everywhere.

As to more tourists equals more buyers, I have cited this example in previous letters to your publication: Orlando and Las Vegas are the two most visited cities in the U.S. Why are their property values not the highest in the country? I see your Yogi quote and raise you: “Nobody goes there any more.

It’s too crowded.”

3. You write, “If Floridays were to develop a hotel with 120 rooms, (with) the addition of 85 rooms to the Zota Beach Resort, Longboat Key still would not have as many hotel rooms as it did in the 1980s and 1990s.”

You have discounted and ignored that we have more residences (Positano replaced the Holiday Inn) and significant new home construction. The Resort at Longboat Key Club and successors at the Colony Beach & Tennis Resort also are expected to propose hundreds of new hotel rooms. Perhaps it will indeed become a crisis and “an issue of overdevelopment.”

4. Longboat Key should not aspire to be a center of commercial activity. As to the number of cars, statistics comparing the decades would be more convincing than supposition.

5. As to Keep Longboat Special’s assertions that “hundreds of hotel guests would

GHOST SHIP 6:29 p.m. — 700 block of Linley Street Boat: A man reported that a sailboat broke from its moorings and was drifting into other boats.

The loose vessel came to rest at the south end of the Longbeach Village dock. Officers could not find a registered owner for the sailboat.

DAMAGE DELIVERY 7:21 p.m. — 600 block of Yardarm Lane Vandalism: A woman reported that her mailbox was damaged.

She checked her mail the previous day and did not see damage but noticed its slot was twisted and bent the following day. The rest of the mailbox was not damaged.

BLINDED BY THE LIGHT 9:20 a.m. — 4200 block of GMD Property Damage: While directing church traffic, an officer noticed a light pole lying on the ground, a broken sprinkler head and tire tracks near the damage.

The officer walked to the church parking lot and found a vehicle with matching damage. The owner told police the sun was in her eyes and that she had already talked to the property owner about paying for repairs.

CURIOSITY KILLED THE CAT 11:24 p.m. — 200 block of Sands Point Road Property Damage: A man heard a strange noise coming from underneath the hood of his rental van and found a dead cat in the engine’s fan. The damage was estimated at $300 for four fan blades. Hotel staff disposed of the cat.

MOVING TARGET 12:08 p.m. — Off the Key Assist Other Agency: Officers responded to reports of a man in a white vessel shooting an unknown weapon into the water.

Police interviewed nearby boaters and witnesses, who said they didn’t see or hear gunfire.

UNWANTED PHOTO-OP 9:50 p.m. — 500 block of Bay Isles Parkway Battery: A man said a woman broke his $800 cellphone during a dispute that occurred in front of a drugstore.

The man said he was taking photos of a vehicle parked illegally across two handicappedaccessible spaces, and its occupants began arguing with him. The woman, who he assumed was with the vehicle’s passengers, exited the store and pushed him, causing his phone to fall to the ground. The man told officers he had his cane with him but did not swing it at anyone. Police are investigating the case.

They’re small and go largely unnoticed by the average human swimmer, but scallops provide insight into the state of Sarasota Bay. “Monitoring the scallop population and how they’re doing gives us an idea of the health of the bay as a whole,” Sarasota Bay Watch Program Director Ronda Ryan said. “If the scallop population is healthy, chances are, the rest of the bay is too.”

On Aug. 13, volunteers can become citizen scientists during Sarasota Bay Watch’s ninth annual scallop search.

More than 125 volunteers of all ages participate in the event annually. Each group or boat is assigned a specific area to search for scallops. Ryan is hoping for 50 boats. Participants who don’t have a boat will be placed with boaters during the search.

“This is by far, hands down, the most popular event we have,” Ryan said. “For one thing, it gets people out on the water. It’s a family event. It’s a time when

people who love the water and are interested in scallops can be a part of the forward motion of bay restoration.”

Citizen scientists found 31 live scallops at last year’s scallop search. In 2014, there were 40, but in 2013, there were just 11.

“There are a lot of factors that determine the population, such as predation, red tide and environmental issues,” Ryan said.

“But the numbers are increasing as a whole, and I think the prognosis is good this year.”

This year, the search will not be held at Mar Vista because of ongoing construction. Volunteers will instead meet at Sarasota Sailing Squadron, but experienced participants who want to search the north part of the bay can pick up equipment on Coquina Beach at a designated time before the search.

The scallop search is part of Sarasota Bay Watch’s 10-year scallop restoration program.

TROUBLEINPARADISE

When it comes to major crime on the Key, someone must pay.

Editor’s Note: Ten years ago, Longboat Key author H. Terrell Griffin made his debut as a mystery writer with the “Killer Summer” serial in the Longboat Observer featuring the fictional Detective Jake Bass.

he shout of “Bomb!” was still echoing through the restaurant. Charlie Goins seemed to be glued to his chair.

I told Charlie to get outside and call the police and fire departments. The customers were in a panic, running for the exit. The mayor was leading the pack. A bottleneck quickly developed, and I went to the door to see if I could unjam it.

My name is Jake Bass, and I’m the detective in the major crimes division of the Longboat Key Police Department. I’d been enjoying a quiet evening at the Hooters restaurant that had taken over the old Moore’s building.

The logjam was caused by the mayor placing a sawhorse in the doorway. She wouldn’t let anybody out until they paid their bill.

“Mayor,” I said, “you’ve got to let these people out of here. Now.”

the bomb guy said. “I think there’s another one in there made with dynamite.”

“Well, get back in there and take care of it.”

“We need to talk about the police pension fund.”

“You guys get enough,” the mayor said.

“The firefighters will get more if you vote for it,” the bomb guy said.

“How did you know I was going to vote for it?” she asked.

“News travels fast on this island,” he said.

“OK. How much do you want?

You get that bomb out of my restaurant, I’ll have your back.”

“Five dollars more than the firefighters.”

“I’ll do it,” she said. “Now go get that bomb.”

The bomb guy picked up the duffle that was still smoking and started out toward the docks.

“Hey, where are you taking that thing?” I asked.

“Going to throw it in the bay.”

“What about the dynamite?”

I asked. “If that thing blows it’s going to kill a lot of fish. Maybe a turtle, and then you’ll be in big trouble.

“There was no dynamite. Just a smoke bomb. I needed the mayor’s support for our pension plan.”

“Not a problem.” I wondered how that was going to affect my pension. When you make $1 a year and pay 3% into the pension fund, it takes a while to become meaningful. Like a thousand years. But the bomb guy was a fellow cop, and everybody knows we deserve more than the firefighters.

I went looking for Charlie Goins. I was beginning to have a bad feeling about the undercover anti-terrorism agent with the fertilized big hair. He had shot the mayor with a stun gun and left the scene. Didn’t even try to do anything about the bomb.

I found Charlie sitting on the dock with the mayor, his arm around her shoulders. “Is she hurt?” I asked.

“I coulda died,” she shouted at me. “As it was, I lost a lot of money. Some of those old chicken wing eaters would rather die than pay for their exotic experience in a bombed-out cafe run by a beautiful woman trying to make it on her own.”

“Mayor,” I said, “don’t overdramatize this. It was just a smoke bomb. Somebody’s idea of a joke.”

“But I coulda died,” she wailed.

“That would have been a tragedy for the town.”

“Not really,” Charlie said.

“There are plenty of people who could take over.”

“You’re a hard person, Charlie Goins,” she said, a tear trailing down her cheek.

“Nope. I’m just realistic. Maybe a little paranoid, but I don’t want you to worry about the town if you weren’t here to run it.”

“If I get killed, the vice mayor will take over. Did you ever think about that?”

Charlie looked at me. “Jake, can you arrange an around-the-clock security detail for our mayor? We can’t lose her. It’d be a tragedy for the town.”

“Most of these people left without a check.”

“Then they can pay a cover charge. Thirty bucks.”

“This place is about to blow,” I said. “We need to clear it out.

Now.” “They pay their bill, they’ll get out.”

I heard the firetruck sirens turning onto Broadway. I went back inside to find the counterterrorism agent and identify the bomb. The man was gone, but the duffle bag that the Canadian peacock killer had carried when he walked into the restaurant was on the floor near the bar. I could hear it ticking. I decided to retreat.

The line at the door was still not moving. I watched as the firefighters pushed through them, one of them dragging the mayor by the arm. “Let me go,” she hollered. “Those people owe me money.”

“We’ve got to talk about the firefighters’ pension fund,” the fireman said.

“Come to my office tomorrow,” she said. “Get the bomb squad in here.”

“First, the pension reform,” he said.

“But, my restaurant.”

“My pension.”

“OK,” she said. “What do you want?”

“Five dollars more than the police get,” the firefighter said.

“Five dollars isn’t much.”

“A week.”

“Every week?” the mayor said.

“Oh, OK. I’ll vote for it. Now go get that bomb out of here.”

“That’s a job for the police,” the firefighter said. “They have the bomb squad.”

“Then, why did I have to vote for your raise?” she asked.

“Because it’s the right thing to do.” He turned and walked out the door. He passed a person wearing some sort of armored suit who was coming in the door, pointed at him and mouthed the words “bomb squad.”

The customers had begun to stream out the door. The mayor hurried past them, knocking over three old guys in her rush to get outside. She picked up the sawhorse and repositioned it to block the flow of people. “Pay your bill here,” she said. “Then you can go home. We’ll be open tomorrow.”

The sound of an explosion rumbled outward from the bar area. The crowd waiting in line to leave rushed the barricade as smoke boiled up in the area where the duffle had been. The mayor was pushed to the ground and stepped on by a number of elderly gentlemen. Luckily, they didn’t weigh much, so the mayor wasn’t hurt. She was screaming at the top of her lungs. I couldn’t make out what she was saying, but I did hear the words “money” and “wing bandits.”

The bomb squad person came out of the building, looming out of the smoke like an apparition.

He went to the mayor and helped her to her feet.

“Did it do much damage to my restaurant?” she asked.

“That was just a smoke bomb,”

He was born to Harry and Lillian Levine Cohodas in 1914, in Menominee, Mich. For most of his life, he resided in the Upper Peninsula of Michigan and worked as a businessman and civic leader in Ishpeming, Mich. He was an official of Cohodas Brothers and the Michigan Financial Corp. before it was acquired by Wells Fargo. He was a founder of the Ishpeming Cancer Society and a supporter of Northern Michigan University and Bay Cliff Health Camp. When he wasn’t working, he was participating as an active member in the Rotary Club, serving as a 32nddegree Mason and ringing bells for the Salvation Army during the holiday season.

In 1939, he married Lois Wenk. The couple was together for almost eight decades and had two children to whom Bill was a hands-on father.

In 1953, he co-founded Temple Beth Sholom, in Ishpeming, and mentored several generations of student rabbis from Hebrew Union College in Cincinnati, where he met his future son-in-law, Rabbi Samuel Stahl. During his time at Temple Beth Sholom, he served as the lay rabbi, officiated life-cycle occasions, edited the Temple He, was a key innovator of implementing Holocaust education programs in the Upper Peninsula and sponsored an interfaith Holocaust memorial service, which has since been held for more than 40 years in Marquette, Mich.

Each year, he journeyed to Jerusalem to attend American Friends of the Hebrew University board meetings and received an honorary doctorate from Finlandia University.

Murray Greenwald, 84, of Longboat Key and Louisville, Ky., died June 10.

Born March 20, 1923, in Philadelphia, to the late Lottie Marder and A. Herman Greenwald, he considered himself a Kentucky native because he lived there since he was 6 months old.

The son of a Polish immigrant butcher, he was a selfmade man and graduated from the University of Louisville School of Law in 1955, receiving his Juris Doctor without an undergraduate degree in threeand-a-half years. Asked once why he graduated so quickly, he said, “I couldn’t afford not to.”

Throughout his career, he was considered the patriarch of the local real estate bar and was proud of his decades of service to the Jefferson County Public Defender’s Office, the Louisville Bar Foundation and the Louisville Bar Association.

He was a part-time resident of Longboat Key and was a member of the Standard Country Club, Longboat Key Club and The Temple. He also served as a board member and chairman of Paramount Foods prior to its sale in the early 1990s. He was an avid Louisville Cardinals fan, but much to the chagrin of his children and grandchildren, he also became a Kentucky Wildcats fan later in life.

He always said his greatest triumph in life was his children. He was always inventing some excuse to brag to unsuspecting bystanders about a recent feat of his children, no matter how minute or inconsequential. He was proud of the educational legacy he afforded all three of them to be able to obtain graduate degrees in their respective fields.

He is remembered for always being there for his children, be it as a confidant, standing on the sidelines at a rainsoaked soccer game or giving a big bear hug when one was needed, but just as often when it was not. He never let any of his children or grandchildren leave the house without a hug and a kiss or end a telephone call without them hearing his parting signature words: “I love you.”

Mr. Greenwald was preceded in death by his wife of nearly 53 years, Peggy Hirsch Greenwald, and his daughter, Brooke Greenwald Cohen.

He is survived by his sons, Bart and Brent Greenwald; 10 grandchildren; and two trusted employees and friends, Bonnie Johnston and Sue Moore, who worked with him for 47 years and 25 years, respectively.

A service was held July 8, in Louisville.

Born Dec. 2, 1917, in New York City, her father, Julius Klepper, was a well-known physician and head of the Poly Clinic Hospital. Her mother, Francis Klepper, was the third woman to graduate from the Columbia School of Pharmacy. She loved growing up in New York City.

The landscape and grounds of Central Park, the brownstone house where her father had his medical practice and the museums around the corner were all her playground.

At Camp Wicosutain, in New Hampshire, she met her future husband, Leonard Kasle, who was from Detroit. It was love at first sight. When Leonard was ordained as a rabbi in New York, they moved to Charleston, S.C., where he served at Congregation Beth Eloheim, the oldest synagogue in the U.S. After a few years, they moved to Detroit, where she became a well-known art dealer. She had a love of art, and in the 1960s, she opened the Gertrude Kasle Gallery. She carried the art of Hans Hofmann, Larry Rivers, Philip Guston, William de Kooning, Robert Goodnough, Grace Hartigan, Ian Hornak, Robert Rauschenberg and many more.

The couple moved to Longboat Key in the 1980s, after she gave up her gallery. When Leonard died in 1995, she moved to Sarasota.

She had a long involvement with the Democratic Party.

He was an Eagle Scout and Order of the Arrow, avid outdoorsman, lifelong member and former president of U.N.I.C.O., member of Plainfield Moose, past president of Chaney Club and usher at Cathedral of St. Raymond’s and St. Mary, Star of the Sea, Catholic Church, where he headed an annual golf outing for charity. He was a board member and treasurer of Seaplace.

He is survived by his loving and devoted wife of 39 years, Peg; children, Christopher and Andrea; man’s best friend, Polo; his very special friend, Kevin Rutkowski; and several siblings, nieces, nephews and other relatives and loved ones.

ith summer comes humid mornings, sunny days and extra free time to spend at the beach. Four Longboat Key authors share what they’re reading now, so you can fill those lazy summer days on the beach with a good book.

PATRICIA GUSSIN Patricia Gussin, thriller writer and co-owner of Longboat Key-based Oceanview Publishing, loves a good mystery. A physician, Gussin incorporates her medical background into her writing.

She is the author of six books, four of which make up the Dr. Laura Nelson series. She published the final installment in the series, “After the Fall,” in 2015.

She is currently reading “Find Her” by one of her favorite authors, Lisa Gardner. The next book on her list is “The Lost Concerto” by Helaine Mario.

“I like the characters in the books,” Gussin said. “They’re such individual characters, and the authors have done such a good job of bringing them to life, so you actually feel like you know them, and you don’t want the book to end.”

But her favorite summer read is “Pride and Prejudice” by Jane Austen.

“It’s such perfect, perfect, exquisite prose,” Ellsworth said. “I love Jane Austen.”

H. Terrell Griffin is the author of 10 Longboat Key-based mystery novels. His favorite authors are other mystery writers, including Michael Connelly, Daniel Silva, Ward Larsen and Robert Crais.

“When I read those guys, I think, ‘Damn, I wish I could write like that,’” Griffin said. “It’s interesting. They always tell a good tale. They write well.

Their dialogue is realistic.

Some writers just never get down to dialogue.”

Griffin, who has been a part-time resident of Longboat Key for 35 years, also enjoys reading history and biographies.

Sea Sleuths camp explores the ocean

A

fter impatiently listening to instructions, Mote Marine Laboratory and Aquarium campers splashed into the water hoping to find marine life Friday.

It was all part of the weeklong Sea Sleuths: Generation H2O camp. Open to sixth- through eighth-graders, the camp teaches participants about the history of the ocean.

Campers explored Sarasota Bay while snorkeling and skimming the shore with nets, looking for marine wildlife such as shrimp, crabs and seahorses.

Throughout the week, campers also enjoyed kayaking, boat excursions and experiments to better understand what past explorers hypothesized about the oceans.

The final Sea Sleuths camp session is Aug. 1-5. For more information, call 388444.

Last Valentine’s Day, Marie Selby Botanical Gardens in Sarasota opened an exhibit that seemed a natural extension of the 15-acre site’s focus and mission. More than 1,000 orchids and other plants were displayed as part of “The Orchid Show: Celebrating 40 Years at Selby Gardens.”

The exhibit highlighted a specialty of Selby — the world’s only botanical garden dedicated to the study, research and display of

epiphytes. Those are plants such as orchids, bromeliads and ferns that grow on other plants without harming them.

The six-week show was also a test of a new living museum business model for Selby Gardens, and the results proved overwhelmingly positive. Comparing the run of the exhibit to the same sixweek period in 2015, Selby posted a 42% increase in admissions revenue, a 45% increase in retail shop revenue, a 50% increase in food sales and a 67% increase in memberships.

“Shifting to this exhibition model translated to all the different earned revenue areas of the organization across the board,” says Selby President and CEO Jennifer Rominiecki. “What’s so exciting about being a living museum is we’re really changing the scope of what an exhibit is. With a museum exhibit, you might expect you’re going to go into a gallery, look at art and then leave. But what we’re doing is much more interdisciplinary and experiential.”

The orchid show drew 45,000 visitors, almost half from outside Florida. Of the Floridian visitors, about a third were from outside Sarasota County. “If a tourist comes to Sarasota, they need to feel that Selby Gardens is a mustsee destination,” says Rominiecki.

“Part of that is giving everybody a reason to come, and these exhibits are a way to do that.”

EXHIBITING AN IMPACT

The living museum — featuring changing, interdisciplinary, artistic and cultural exhibitions tied to the gardens’ plant collections — aims to both attract first-time visitors and encourage repeat visits to Selby, which welcomed nearly 160,000 guests in 2015. “I never want to hear someone say, ‘I’ve been to Selby; it’s beautiful,’ as if they don’t need to go back,” says Rominiecki. “I think the onus is on us to create these happenings in order to give you reasons to keep coming back.”

The new model is also a chance for Selby to further diversify its revenue streams away from private fundraising, a big goal for a nonprofit. Selby had $4.25 million in 2013 revenues, down slightly

The addition of the Ann Goldstein Children’s Rainforest Garden in November 2013 is a catalyst for the membership surge, especially for families.

It’s really adding to the vitality of the organization.”

To further increase earned revenues, Selby Gardens recently partnered with Sarasota restaurant and caterer Michael’s On East. The deal makes Michael’s the exclusive food service provider for weddings and other events at Selby Gardens and the Selby Café. Now a higher percentage of event revenues goes directly to Selby than it did before, when a variety of caterers were used.

And Michael’s On East handles all steps in the event process, from scheduling to menu planning.

“They’re horticulturalists; they’re not in the food business,” says Phil Mancini, co-proprietor of Michael’s On East. “This takes the location out of the food service business and lets them do what they do best. You’re going to see this more and more.”

Mancini has already had experience with this, creating the Deep Sea Diner at Mote Marine Laboratory and Aquarium in Sarasota, now run by his brother. “Everybody is looking at these models and how important they are,” he says. “They’re realizing that food service operations are important to the future of the location.”

The partnership will also make possible an expansion of Selby’s event space, scheduled to begin Aug 1. Plans call for doubling the indoor seating to up to 400 guests, boosting the outdoor patio size from 880 square feet to 2,400 square feet, remodeling the current kitchen and adding new restrooms. Michael’s on East will pay for the majority of improvements, while Selby will chip in for updates that would have been necessary regardless of whether it was expanded.

Mancini, who proposed this kind of plan to the gardens about a decade ago, declined to disclose the cost of the project. Michael’s on East also made investments in redoing the Selby Café, and has seen sales double there since it took it over in December.

“This is the one I’ve been waiting for 10 to 15 years,” he says. “I always said that if I was going to do another banquet space in Sarasota, it would be on the water.

That’s where the demand is.”

Selby owes its existence to its namesake, Marie Selby. The first woman to cross the country by car, she directed the landscaping plan for the property on Sarasota Bay, where she lived with her husband, Bill, beginning in the early 1920s.

Upon her death in 1971, she left the property to the community as a botanical garden “for the enjoyment of the general public.” A board of directors was appointed, which then consulted with the New York Botanical Garden and the University of Florida on a focus for the gardens.

The current shift to the exhibition model is the result of a recent strategic planning process at Selby. Rominiecki’s previous employer, the New York Botanical Garden, had success with a similar approach.

“A garden is ever-changing, and you have to really highlight that,” she says. “Many gardens are doing outdoor sculpture exhibits because they don’t have the facilities to do indoor ones. But we were primed for it right from the beginning, so I thought this was a perfect thing for us to explore.”

Selby Gardens has hosted art exhibits in its historic Payne Mansion since 1979, so it had an exhibit site already in place. It held a fundraising campaign to improve the mansion’s climate control, lighting and security systems to better showcase highquality artwork.

The gardens will start off its new model by showcasing rare botanical illustrations and preserved plant specimens from its own collection in “Selby’s Secret Garden,” which opens Aug. 26.

“We have rare botanical books and prints dating to the 1700s that have never been shown to the public before, and they’re absolutely spectacular,” says Rominiecki.

Next February, it will unveil its most significant exhibit to date as part of a series sponsored by Sarasota philanthropists Jean and Alfred Goldstein. “Marc Chagall’s Cote d’Azur: The Artist’s Botanical Imagery and Inspiration Found on the French Riviera” will include as its centerpiece “The Lovers,” a circa-1937 oil painting by Chagall that will be on loan from the Israel Museum in Jerusalem. It will travel the 6,650 miles from Jerusalem to Sarasota with security guards and a licensed transporter.

“We’re so excited about the fact that tens of thousands of people, if not more, will be able to experience this exhibit in a living garden,” says Howard Tevlowitz, executive director of the Jewish Federation of Sarasota-Manatee, the lead sponsor for the exhibit.

“They’re going to be experiencing something many people have never experienced before — a piece of art coming to life in ways that not many people can do.”

Rominiecki hopes those exhibits are two of many more to come.

“I think the community is really excited about Selby doing something new,” says Rominiecki, “and I think that there’s a lot of momentum and energy.”

Both Swors are doctors and they needed a home that works.

Attention to detail is everywhere, and sometimes in the most unexpected places. The cozy family room, for example, does double duty as an aviary for Gray’s 20-year-old macaw, Elmo.

She raised him from a hatchling, and by now, he’s an established member of the family. He lives in a spacious cage in the corner, with a spectacular view at his disposal and a chance to interact with the family as he chatters away during meals.

Gray has long collected antiques, and she knew her dream house would have to accommodate her collection.

“Then, we traveled to Italy and fell in love with the architecture,” Gray says.

Everything came into focus: the old stone villas, the terraces and balconies, the pergolas that shaded outdoor dining areas. Now, she knew what she wanted.

She and Michael contacted Sarasota designer and builder J.E. Tucker, and they literally sketched their ideas on the back of a napkin.

“He made it work,” Gray says.

They already had a home — a 1,200-square-foot bungalow set on a spectacular piece of land in Coconut Bayou. But with six kids in the family — two were still living at home — they needed more space. Fortunately, their 0.70acre lot had plenty of room for expansion, not to mention 260

With the children gone, the Swors have bought a smaller house that they are currently renovating. It’s just a short stroll away, because the couple have no intention of leaving their neighborhood. Most residents of Coconut Bayou feel that way — it’s considered the jewel in the crown of north Siesta Key. Developed by Elbridge Boyd, who also developed the Sanderling Club, it has large lots, tropical vegetation and an atmosphere of complete peace and privacy.
