The Longboat Key Town Commission was one vote away from moving forward with a sea turtle ordinance that town officials said would be unenforceable.

Commissioners spent 50 minutes Monday debating the balance between the needs of property owners and turtles — a debate

that has occurred multiple times at Town Hall in recent months.

Commissioner Ed Zunz submitted tweaks to the proposed ordinance that he hoped would give property owners relief from excessive enforcement in a May 19 memo to Town Manager Dave Bullock.

The revisions would have given new homes and developments more time to come into compli-

ance with new lighting codes.

But when commissioners voted 3-3 to add the new language regarding proposed lighting regulations to the ordinance, the amendment died due to the tie.

The ordinance moved ahead to second reading as originally presented, though Zunz’s amendment could return on second reading next month.

“This ordinance should be able to be balanced and stand on its own two feet,” Zunz said.

Zunz’s proposed revision included the phrase, “it has been found to be impractical to set, measure or enforce the precise level of such artificial illumination, if any, at a particular time” — a provision that would strip the town of its power to uphold the entire ordinance, Bullock said during the meeting.

Commissioners Phill Younger and Armando Linde voted in favor Zunz’s revised ordinance.

Commissioner Jack Daly was absent because he is recovering from surgery.

Younger and Linde argued the proposed regulations were too subjective, because they rely on the code enforcement officer’s line of sight from the beach to determine lighting violations — and could encourage excessive enforcement by civilians.

“It’s just very broad, but it opens the door for very wellmeaning people to start patrolling the beaches,” Linde said. “We should inject less subjectivity into this.”

The current ordinance limits Code Enforcement Officer Elbon’s enforcement to a moonless night.

If the proposed ordinance passes without Zunz’s amendment, it

would allow Elbon to patrol the beach on other nights. The proposed ordinance also addresses 13 types of lighting, up from the nine varieties the current ordinance enforces. It also makes interior lighting visible from the beach illegal during nesting season.

“I don’t want to vote against this thing, but how can you put your names on something like that?” Zunz asked fellow commissioners.

Younger, who said he isn’t against more stringent regulations, again pushed for a measurable enforcement method, despite Elbon’s insistence that no other jurisdiction has one. And if the town wanted to experiment by measuring light intensity, it would have to spend more than $20,000 on new equipment.

“You’ve got clear and sanctioned standards for virtually every law except when we get into a politically correct, touchy-feely situation like we are on some of these turtle laws,” Younger said.

As Bullock has worked through state and federal permitting for the more than $10 million in beach renourishment projects this year, U.S. Fish and Wildlife officials said the town would need more stringent regulations if it wanted to undertake sand projects in the future.

“I don’t know why this commission goes out of its way to look for trouble,” Vice Mayor Terry Gans said during the meeting. “We have a damn gun to our head saying we need to change our ordinances, right?”

The commission will discuss the ordinance on second reading July 5. After Monday’s meeting, Zunz said he had not decided whether he would reintroduce the language then.

niversity of North Florida students Tabitha Bingham and Max Moneuse spent Monday kayaking and fishing on Longboat Key — literally.

The couple glided along the flooded roadways of Lyons Lane and Norton Street as Tropical Storm Colin chugged toward the Gulf Coast.

Though the storm barely grazed the region, town staff and emergency personnel said it was a good exercise for their emergency response strategy that came just six days into the six-month hurricane season. And, in the midst of what state and local emergency management officials have dubbed “hurricane amnesia,” it could serve as a warning to residents about what could happen if a larger storm were to hit the island.

“When we tell you to evacuate, we mean it,” said Public Works Director Juan Florensa. “You’ve got to go.”

He specifically noted an incident on the flooded streets of the north end — the same roads Bingham and Moneuse traversed by kayak — in which two elderly residents and a caretaker requested to be transported to higher land on Gulf of Mexico Drive where they could meet family friends to drive them to the mainland.

Fire Chief Paul Dezzi worried an ambulance wouldn’t make it through the submerged roadway, so he contacted the Public Works Department, which provided transport in one of its pick-up trucks. In the event of a major storm, that might not be possible.

“That was the good deed for the day,” Florensa said. “But that should show how important it is to evacuate when we tell you to evacuate.”

The fire department responded to 20 calls throughout Monday, most of which were fire alarms and downed power lines.

As fire trucks and ambulances patrolled the island and police officers and Public Works staff helped clear roadways of debris, the contractor for the mid-Key beach renourishment continued to truck sand onto the island.

Instead of spreading it along the shoreline, workers stacked the new sand near dunes, waiting for the Gulf of Mexico to calm.

Florensa said he won’t know the extent of erosion damage until Friday but wasn’t worried about losing the newly placed sand.

“I will tell you we have less sand, but that’s the whole purpose of putting sand there in the first place,” Florensa said. “Because the purpose of that is to protect the mainland.”

A group that formed to oppose Floridays Development Co.’s plan for a 120-room north-end hotel has restructured as a nonprofit organization with a political action committee.

Longbeach Village resident Pete Rowan, who co-founded Keep Longboat Special with his wife, Carla, in March, said the move will allow the group to spend more than $500 to oppose the Aug. 30 referendum in which voters will decide whether to create the density Floridays needs for the project.

The Florida Division of Election’s website states that a group of two or more individuals must file as a committee if it accepts contributions of more than $500 or spends in excess of that amount during a calendar year to advocate the election or defeat of a candidate or issue.

“That doesn’t buy a whole lot of stamps,” said Keep Longboat Special Chairman Craig Walters, also a Village resident.

Walters said by forming as a nonprofit, the group could create different PACs in the future to address other issues.

Rowan estimates the group has about 60 volunteers and a distribution list of 700 to 800 residents that it’s targeting with direct mail and emails.

“I consider it a grassroots

organization in that we’re trying to represent the residents instead of the developers,” Rowan said.

The Floridays proposal isn’t the only issue the group is discussing. In a recent email, Keep Longboat Special addressed residents’ options for paying their assessments for a neighborhood underground utilities project that voters approved in March.

Walters said the new structure could form the basis for an organization similar to the Longboat Key Public Interest Committee (PIC), which formed in the mid-1980s and dissolved in early 2014, that “seeks to protect the interests of the island.”

Voters will decide in the August referendum whether Floridays can add density of up to six units per acre on a 2.6-acre cluster of properties southeast of the intersection of Broadway and Gulf of Mexico Drive — a total of 15 units.

If voters approve the measure, Floridays could then apply for 105 additional tourism units from the town’s pool of voter-approved potential rooms to build 120 units.

If the referendum is successful, Floridays will then have to file for a rezone and comprehensive plan amendment to change the property’s future land use in September.

Those proposals would then go before the Planning and Zoning Board for recommendation and the Town Commission for approval.

Town approves firefighter contract The agreement limits firefighter pension contributions and reinstates step wage increases.

In an emotional meeting, the Longboat Key commission nearly overturned its support for a new three-year contract with the town’s firefighter union Monday.

But ultimately, Commissioner Irwin Pastor’s motion to approve the new contract that brings key pension changes passed 4-3.

The new contract limits firefighters’ Florida Retirement System payments to 3% of their salaries and reinstitutes the step pay increase system that’s been frozen since 2008.

Mayor Jack Duncan and commissioners Armando Linde and Phill Younger voted against the agreement.

The contract, which results in an average pay cut of about 1.1% for the current fiscal year, came under scrutiny after former Commissioner Lynn Larson launched an email campaign opposing the changes to FRS contributions.

Before last night’s vote, the town split FRS’ required employer contribution with firefighters. As a result, the town currently pays 11.02% of firefighters’ salaries, or half of the required 22% set by the Legislature each year.

“I thank the commission for seeing what we did and believing in what we did, and it’s a step forward,” said Longboat Key Fire Rescue Lt. Keith Tanner, the district vice president of the firefighter union who signed the agreement on the union’s behalf, after the vote. “That’s all I care about.”

The town was the only municipality in Florida that required firefighters to pay more than their state-mandated 3% into FRS, as the result of the contract the town and firefighters approved in 2013.

But Larson and others argued that the employer contribution split and a stipulation that capped town contributions at 13% were part of a compromise aimed at balancing firefighters’ desire to maintain a defined-benefit retirement plan and the town’s

goal of limiting its future pension liability.

Vice Mayor Terry Gans said although commissioners at the time saw the capped-contributions model as a trailblazing strategy to control long-term pension costs, other municipalities did not follow suit by negotiating similar agreements.

“We can hope, we can wish, and we can dig our heels in and stick to our guns,” Gans said.

“What we cannot do long term, is stand alone and be tenable as an employer that retains its skilled labor force or attracts the level of professionals we want for the future.”

During negotiations, union representatives identified the FRS contributions as the biggest stumbling block in attracting new hires. Longboat Key, due to its

older population with frequent medical needs, tends to hire firefighter/paramedics with at least five years of experience.

“We can kid ourselves that it is a soft gig,” Gans said. “That’s true until it’s not, and there is a dangerous event.”

The new contract includes average raises of 2.7% in the next fiscal year, and 3.9% in Fiscal 2018.

Pastor was critical of his fellow commissioners who opposed the contract despite the consensus the commission reached during previous closed sessions.

“This is absolutely unbelievable when you tell your town manager and your labor attorney to go over there and sell a contract and people flip, that’s not acceptable,” Pastor said.

Though the contract results

in $236,000 in savings over the three years of the contract compared to a proposal Town Manager Dave Bullock presented to union representatives March 31, Duncan said he was concerned about the long-term strain on the town’s finances.

“I believe we’re putting ourselves in a situation — and now I’m going to say the unholiest of the unholiest — and that is that were going have to give up our fire department and our EMTs at some point,” Duncan said.

“Because we cannot continue to sit and watch the debt hemorrhage and continue to grow.”

But Pastor believes citizens largely support the decision.

“I can tell you my constituency — my friends — would support this if it were a referendum, which it isn’t,” Pastor said.

Colony judgment day moves to January The resort will keep its grandfathered units for now, but several structures will be demolished soon.

A hearing to extend the Colony Beach & Tennis Resort’s nonconforming density turned into a three-and-a-half-hour discussion Monday.

Unicorp National Development, which has an agreement to purchase key Colony properties — including a 95% interest in 2.3 acres at the center of the resort — asked the Town Commission to extend the grandfathered use of its 129 nonconforming tourism units to maintain a total 237 tourism units on the 18-acre parcel until February 2018.

The Colony’s 237 units were built on 18 acres before the town created its tourism resort commercial classification, which allows for just six units per acre.

As a result, 129 of the resort’s 237 units are considered grandfathered. If that nonconforming use disappears, only 108 units would be permitted on the site.

Ultimately, both parties agreed to extend the deadline to Jan. 9, 2017.

The commission also accepted

a good-faith offer from Chuck Whittall, president of the Orlando-based Unicorp, to pay more than $60,000 to demolish five crumbling structures and some tiki huts within 120 days.

But Mayor Jack Duncan expressed frustration about not having enough time to consider the request and the overall Colony redevelopment process. (See sidebar, right.)

“If I thought I could get the vote, I would table the entire thing, and we would come back and discuss it after we have had a workshop, but it doesn’t appear as though legally I can do that,” Duncan said.

Other commissioners bristled at what they see as a lack of progress nearly six years after the resort closed.

“I will not support a two-year plan at this time,” said Commissioner Phill Younger. “And I will barely, barely, barely support six months.”

But Whittall, who remained at the meeting until after 11 p.m., insisted that real progress is happening behind the scenes. He said his firm is close to signing a

development agreement with the Colony Beach & Tennis Resort Association.

Association attorney Jeff Warren thought a February deadline would provide a realistic timeframe for settling bankruptcy cases, allowing Unicorp to acquire units and starting construction.

“Mr. Whittall in the last few months has done everything he told the association board he would do,” Warren said.

The association needs at least 80% of the resort’s unit owners’ votes to dissolve the condominium association and move forward with a development plan.

Whittall told commissioners he plans to meet with an architect to draw up plans for a 180-unit hotel, plus 180 condominiums.

But he will seek approval for up to 417 units — 237 tourism units plus 180 condos — in case of the unlikely event that owners of every unit opt to keep a unit with a 30-day stay option — which drew concern from commissioners.

“You may have heard that there are people on this island who are very concerned about traffic issues,” said Commissioner Armando Linde.

what? We’re not going to extend it, and you’re down to this many units,’ I’ve just pissed away a million-and-a-half to $2 million in plans,” he said.

A dispute between former Colony owner Murray “Murf” Klauber and unit owners over repairs that began in 2004 and a series of bankruptcy filings that followed led to the resort’s closure in 2010.

Mayor Jack Duncan was clearly upset with the lack of discussion leading up to Monday’s hearing about tourism units at the former Colony Beach & Tennis Resort. Specifically, he wanted time to workshop the proposal.

But Town Attorney Maggie Mooney-Portale explained repeatedly to commissioners during the hearing that they can’t hold workshops for land-use decisions about specific properties because those hearings are quasi-judicial. That means commissioners are required to act as judges and make decisions by weighing evidence, rather than voting based on their personal feelings.

Commissioners spent more than an hour deliberating about the application before representatives from Unicorp, Colony Lender LLC or the association spoke.

“That doesn’t mean I’m not willing to give it a couple more months,” said Younger before the applicants spoke. “But if we just vote strictly on this right now, I will go home perfectly happy voting this over — I’m done.”

That prompted MooneyPortale to warn commissioners about violating the quasi-judicial process.

“I just want to be very careful, because it’s getting very close to sounding like we’re making decisions here before we’ve afforded everybody their due process right to be heard,” MooneyPortale said. “So, I respectfully request we readjust this proceeding.”

Four Longboat Key commissioners gave up a cap on firefighter pension payments in favor of obligating taxpayers to more risk and more cost. How did that work before?

Remember these names when you read future news stories about how the town of Longboat Key’s unfunded firefighter pension liabilities continue to rise: n Vice Mayor Terry Gans n Commissioner Irwin Pastor n Commissioner Jack Daly n Commissioner Ed Zunz They voted to ratify the latest contract with the International Firefighters Association Local 2546.

And in that contract, these four commissioners pledged Longboat Key taxpayers to paying into a definedbenefit plan with no caps on the percentage of the firefighters’ pay that must be contributed to the Florida Retirement System. Those percentages and costs will be left in the hands of the Legislature, not the town, not you, the taxpayer.

This is in complete contrast to the previous contract, which capped the taxpayers’ obligation at no more than 13%. And just to give you a sense of how that changes taxpayers’ obligations: The Florida Retirement System now requires 25% of firefighters’ pay

to be contributed to the fund. Before this latest contract, the town was obligated for 11.02% of that. Under the new contract, taxpayers will cover the entire 22.02%. (Firefighters are required to pay the first 3%.)

Who knows what that percentage will rise to during the next year or next recession.

In their arguments in favor of the proposed contract, commissioners articulated all of the same old, same old — how the town’s firefighters and paramedics do such a great job (agree); how people move to Longboat Key because it’s such a safe place, thanks to our first responders (it’s a reason, not the primary reason); how we need to stay competitive to hire the best. You’ve read and heard it all before.

Unfortunately, those are the same kind of arguments Congress and our presidents have used to run up $20 trillion in federal debt. In Longboat’s case, taxpayers are obligated to cover $25 million in accumulated unfunded pension liabilities, thanks to previous Town Commissions that let the feel-

good stories guide their votes rather than business and economic sense.

From a taxpayers’ perspective, the town had a good contract — the one that expired. Commissioners should have let it go to impasse and kept it in place, because here is what ultimately needs to occur, at the least: The town should require firefighters to convert to the same defined contribution plans (401(k) plans) that general employees and the police union have.

Mark this point: This contract won’t be the end of the Town Commission’s pain with firefighter pension costs. As long as commissioners continue to believe they have no choice but to buy the services of one supplier — the International Firefighters Association — the costs will continue to rise.

Last year, taxpayers contributed $1.6 million on behalf of firefighter pensions. Meanwhile, the unfunded firefighters’ pension liabilities from 2014 to 2015 increased 10.8% — from $12.94 million to $14.35 million.

Remember those names.

Ill effects of limiting hospital competition Imagine you’re ready to start a business.

And let’s say when you go to the county courthouse for your government-mandated occupational business license, the clerk behind the counter tells you: “I’m sorry, but the State Business Regulators in Tallahassee have ruled that you failed to demonstrate on your application that your business would foster competition and promote quality and cost effectiveness to all residents of Sarasota and Manatee counties. Therefore, you cannot open your business.”

This is not a made-up scenario, mind you. It’s real. And if it happened to you, your initial reaction likely might go something like this: You would look at the clerk, slack-jawed, and say: “I thought this was America … The land of free enterprise. What do you mean I can’t open my business? It’s a free country.”

But that’s how it really works in Florida’s hospital industry. Before anyone can open a new hospital, or say, add beds or MRI or CT scanners to an existing hospital, the hospital must receive approval from the Florida Agency for Health Care Administration. It controls the supply of hospitals in Florida and is the arbiter of what cities, counties or communities “need” or can have a hospital.

Last week, the agency rejected Sarasota Memorial Healthcare System’s state-mandated certificate of need application to open a hospital in Venice. Its rejection said exactly what we quoted above — that Sarasota Memorial failed to demonstrate that its new hospital would foster competition and promote quality and cost effectiveness to all residents of Sarasota County.

In a real free-enterprise system, none of this would be any business or concern of “the state.” Sarasota Memorial, or anyone else, would have the freedom to the use of its own property (e.g. capital) to provide whatever medical services its operators believe would be useful to the community — and at a price and cost that would be profitable for the hospital. It would have the freedom to take its own risks.

Of course, this free-market idea becomes somewhat distorted in the case of Sarasota Memorial. It is taxpayer supported, and its countywide elected board of trustees has moral and fiduciary duties to serve Sarasota County taxpayers as fairly and equitably as it can.

Nonetheless, even as a tax-supported, nonprofit organization, Sarasota Memorial’s board still has some freedom to determine what services are in the best interest of the organization and community.

Except when it comes to expanding.

Ever since 1973, Florida has been among 36 states restricting the supply of hospitals and medical services through the certificate-of-need process. A year after its adoption, the federal government enacted more laws that tied federal health care dollars and funding contingent on having a certificate-of-need process.

The theory was that if federal and state governments restricted and limited the supply of hospitals and some services, they would stop overinvestment in hospital facilities and equipment, which would help avoid overutilization of health services and help save on Medicare and Medicaid costs.

COMPARING SUPPLY OF HOSPITAL BEDS According to national averages, of the four counties in this region, only Manatee County has fewer hospital beds per 100,000 population than the national average.

Nice theory. But flawed. More on that below.

In addition, Florida also has used its certificate-of-need process to help subsidize and pay for the “charity care” the state requires hospitals to provide to the poor. Here is how it works, according to a 2015 study of Florida’s certificateof-need laws by the Mercatus Center at George Mason University: “By limiting the number of providers that can enter a particular practice, and by limiting the expansion of incumbent providers, certificate-of-need regulations effectively give a limited monopoly privilege to providers who receive approval in the form of a certificate of need.

“Approved providers are therefore able to charge higher prices than would be possible under truly competitive conditions. As a result, it is hoped that providers will use their enhanced profits to cover the losses from providing otherwise unprofitable, uncompensated care to the poor. In effect, those who can pay are charged higher prices to subsidize those who cannot.”

But here is what the Mercatus researchers also found out: “In reality, however, this cross-subsidization is not occurring.”

The Mercatus study details how Florida’s certificate-of-need laws have resulted in fewer hospital beds per 100,000 than the national average.

The table below shows that Sarasota, Charlotte and Pinellas counties actually are above the national average of 362 hospital beds per 100,000 population.

But if you viewed the data another way, patients in Pinellas and Charlotte counties have more choices than those in Manatee and Sarasota counties.

Likewise, the Mercatus study reveals that Florida has fewer MRI and CT machines per 500,000 than the national average.

The authors of the Mercatus study concluded by noting “40 years of evidence demonstrate that these (certificate-of-need) programs do not achieve their intended outcomes but rather decrease the supply and availability of health care services by limiting entry and competition.”

Yet another example of when lawmakers intervene to regulate a market, they always make it worse for consumers.

When an employee asked him to stop yelling, the resident bumped his chest and flipped the hat off his head, according to another staffer. The employee did not want to file charges. The property manager, who called police, told officers it is an ongoing problem.

DOUBLE TROUBLE 11:39 p.m. — 100 block of Broadway Code Enforcement: A man parked in a convertible was blocking the gates to a beach access. He received a warning because the park was closed, and he was parked illegally.

Kind response eased tragic loss On May 25 at 7:30 a.m., my beloved Chanel was hit by a hit-and-run driver traveling at about 80 mph down Gulf of Mexico Drive in the bicycle lane.

The driver missed me by about 4 inches and hit her with such speed that she died instantly.

The driver never stopped, but police confiscated a few pieces of the car and notified all body repair shops, etc. to be on the lookout for a severely damaged vehicle.

I know in my heart he will never be found.

The police came to take information, removed her collar and leash for me, and waited until my vet came himself to gather her up. He didn’t want to wait the two or more hours for animal control, so he came himself.

Thus goes the life of the most remarkable, loving, sweetest dog in the world. I shall mourn and miss her every minute of every day. My one consolation is that she never felt a thing.

I am grateful to my friend Roger, Officer Reno, and of course my friend, Dr. Watkins, who came up to make certain I was alright. They were all so solicitous and caring.

I am broken-hearted but miraculously lucky to be alive.

GENERATION GAP 4:05 p.m. — 300 block of North Shore Road Disturbance: A man reported that several teenagers wandered onto his property and began talking about things he didn’t understand. They then began cursing at and threatening him but fled when he said he would call police.

The man told officers he wasn’t intimidated by them.

CAR CREEPER 7:22 p.m. — 500 block of Bay Isles Parkway Suspicious Person: A woman noticed a man taking pictures of the back of her car as she was leaving for work. She told police she did not get a good look at him because he immediately fled the area. Officers did not find evidence of tampering or damage on the car.

PARANORMAL ACTIVITY 6:36 p.m. — 6700 block of GMD Suspicious Circumstance: A woman called police from Orlando to report she saw an intruder in her Key home via a security camera feed.

She told officers the suspect was a white male with a beard and dark clothing, but they did not find signs of forced entry or theft at the residence. The woman said it might have been a maintenance person, although she did not receive a call about such work.

GYM BULLY 4:23 p.m. — 3800 block of GMD Battery: Two condominium residents began arguing in the complex’s gym. The man who reported the incident said another man had threatened to knock his lights out, then bumped him while moving from the stationary bicycle to a treadmill. The man showed a partial video of the incident to police.

DEFAULT PARANOIA 7:05 p.m. — 4100 block of GMD Fraud: A man suspects that someone has been hacking into his phone and work computer because for the last year-and-ahalf, when he turns on his computer, the settings are different than how he had left them. The man said he was afraid someone might use his IP address to conduct illegal activity. The officer noted that the man had tape over his iPhone camera.

Although this may not be reality, Spanish Main Yacht Club resident Meredith Ellsworth uses real-life settings in her mystery novels, including “Mai Tais and Mayhem: Murder at Mote Marine,” published in December.

“A woman has come down here to settle and comes to Mote Marine to take in a baby pufferfish,” Ellsworth said. “She goes into the turtle pool and finds a dead body.”

Under the pseudonym M.S. Spencer, Ellsworth has published 10 mystery and action/adventure novels.

Ellsworth, who moved to Longboat Key in 2013, is currently writing her second book that’s set in the Sarasota area. The yetto-be-named novel focuses on Longboat Key’s ghost hotel.

“John Ringling was going to build a Ritz-Carlton where the Chart House is now,” Ellsworth said. “He stopped building it in 1926, and from 1926 to 1964, it just sat there. What do you find in a ghost hotel? Ghosts.”

The book will begin in modern times but go back to the time of Ringling and the construction of the hotel.

“They’re doing work in the parking lot of the Chart House and find a skeleton,” Ellsworth said.

The book also features a reporter from the fictional “Longboat Key Sun” and other characters and plot lines that are inspired by local people and businesses.

“I get advice from people in the professions I’m writing about to get everything accurate,” Ellsworth said. “With the skeleton, somebody has knocked out all its teeth. I asked my dentist’s advice, and he was so excited.”

Ellsworth’s first book, “Lost in His Arms,” was published in 2009.

Ellsworth uses her settings as inspiration.

“For me, it usually begins with the setting instead of a storyline or characters, which is unusual for writers,” she said. “Once I know where I want it to take place, I might Google around or start thinking about what it could be on a walk. You start writing, and the characters take off, and sometimes the plot takes off.”

Ellsworth believes the hardest part of writing a book, especially her mysteries, is the consistency.

“I was reading over my story, before it was published, that had already been read by several editors, and I realized my character had a skirt on at the beginning of the scene and pants on at the end, and no one had caught it,” she said. “I’m glad we can read it over several times before it’s published.”

M. JEANNE BOOTH

Jeanne Booth, 91, formerly of Longboat Key, died May 24.

Born in Toledo, Ohio, she and her husband, Robert, also lived in Harbor Springs, Mich. and Longboat Key, where she was a regular volunteer at the Longboat Library. She was a member of the Toledo Woman’s Club, where she was an avid bridge player.

Following the death of her husband, she moved to the West Coast to be near family.

She is survived by her daughter, Debra Booth Ramsey, and her husband, Craig, of Seattle; son, Michael, and his wife, Joanne, of Perrysburg, Ohio; and several grandchildren and great-grandchildren.

Cletus School in La Grange, Ill. She served as athletic director for the entire program and also taught physical education there for 16 years.

She was an avid tennis and bridge player at the Longboat Key Club.

In lieu of flowers, memorial donations can be made to: St. Irene’s Catholic Church, 28 W. 441 Warrenville Road, Warrenville, IL 60555.

A private memorial visitation and Mass will be held at St. Irene Catholic Church.

Friedrich-Jones Funeral Home & Cremation Services in Naperville is responsible for arrangements.

The exhibit, which showcases art the teachers created outside the classroom, will be on display until June 24.

Ann Halpin, 90, of Naperville, Ill. and formerly of Longboat Key and Western Springs, Ill., died June 2.

Born May 12, 1926, in Cairo, Ill. to George and Corinne Wichert, she was married to the late Thomas Halpin Sr. for 65 years.

She was the mother of Thomas “Jim” (Donna) Halpin Jr., Cliff (Keri) Halpin, Helen (Larry) Kline, Patty (Rich) Stern and Lynda (Ray) Connelly; grandmother of Jen, Tom, Lori, Dan, Kris, Katy, Brooke and Brett; great-grandmother of four; and sister of the late George Wichert.

She was born during the Depression era in 1932, in Greenpoint, Brooklyn, N.Y., and was one of six children of John and Mary Rutledge Reardon.

“Ayne,” as her husband of 63 years, Matthew, called her, grew up with grit, honesty and integrity. He fell in love with her flaming red hair, fiery temperament and extensive family devotion.

She was preceded in death by her daughter, Jean Anne Carr; her parents; brothers, Charles and Robert Reardon; and the rest of her Irish clan. She is survived by her husband, Matthew Mayer; lifelong best friend and sister, Marie Prusak, and her husband, Robert; brother, Jack Reardon, and his wife, Betty; sister-in-law, Lorraine Reardon; son, Douglas Matthew Mayer and daughter-in-law, June Thompson Mayer; son-in-law Michael Patrick Carr; daughters Mary Jane Berkowitz, Jacqueline Marie Mayer and Virginia Anne Low and her husband, Alexander; 10 grandchildren; and three great-grandchildren.

Services were held May 28, in Sarasota.

he night was dragging on.

The crowd was wet from the fire hoses and still milling around Town Hall. Here I was, the man in charge of the major crimes division of the Longboat Key Police Department and the only cop on the scene. Every few minutes, someone grabbed the bullhorn and threw out some red meat, stirring up the natives.

“What do you mean that we can’t take our dogs onto the beach?”

“Are we really going to let them build a Motel 6 in the Village?”

“The first thing we do, we kill all the peacocks.” (Apologies to Shakespeare.)

“Who cares about a motel?

Our beaches are eroding.”

“Leave the peacocks alone. I like to drive through the Village and look at them.”

“Bring back Moore’s.”

I watched the crowd splitting into two groups: the SOPs and the NOPs. The SOPs, those who lived

south of Publix, were worried about their beaches washing away, and the NOPs, those who lived north of Publix, wanted immunity for strangling the Village peacocks.

The dogs-on-the-beach crowd was truly a bipartisan effort that included both NOPs and SOPs. They wanted free rein for their dogs to roam the beach. They were chanting, “Dogs are people, too. Open the beach.”

Charlie Goins had joined the pro-dog group even though he hated dogs. His reasoning was that if we let dogs on the beach, pretty soon he’d be able to take his pet camel, Jeremiah, for a walk in the sand. He thought it would remind his pet of the desert where he grew up. “Progress,” Charlie said, “is a wonderful thing.”

“They’re never going to let a camel on the beach,” I said.

“They’ll have to. It’s a matter of Jeremiah’s civil rights.”

“Animals don’t have civil rights,” I said.

“Don’t tell that to the Animal Rights section of The Florida Bar. They’ve got lawyers standing around every slaughterhouse in the state to make sure the butch-

ers do their business in a humane manner.”

“Lawyers are nuts.”

“Still,” Charlie said, “civil rights for animals is a sensitive subject, and there are lawyers out there just chomping at the bit to make their reputations by defending the downtrodden. Like Jeremiah.

The only sand around here is on the beach, and Jeremiah was born to run in the sand. I wouldn’t be surprised if the ACLU jumped into the fray on Jeremiah’s behalf.

I used to be a lawyer, you know, and I know a good case when I see one.”

“Charlie, you almost went to jail for practicing law without a license.”

“A mere technicality.”

“And some innocent people you represented went to prison.”

“Yeah, but when you think about it, they were probably guilty of something, even if they weren’t charged.”

“They’re still rotting in a jail cell.”

“Not a problem. I got the retainer upfront.”

I wasn’t getting anywhere with Charlie. He seemed quite attached to his camel.

“People are worried that dog poop might cause disease,” I said.

“You really think they’re going to allow a camel on the beach?”

“The beach erodes so fast that the poop won’t last a day or two at the most.”

“What about the turtles?”

“What about them?”

“Those Turtle Watch people are very powerful and they’re not going to like any kind of animals on the beach,” I said. “Other than turtles, that is.”

“I’m telling you, Jake, if it’s OK for turtles to be on the beach, it’s got to be OK for dogs and camels,” Charlie said. “They’ve all got rights, and you know there are no poop-less turtles. If they can use the beach for their droppings, so can dogs and camels.”

“If all these animals have rights, then so do the peacocks,” I said.

“You’re right, and if I were still practicing law I’d file a class action lawsuit against the city,” Charlie said. “Do you know our taxes are paying something like, a lot, for each peacock the bird catchers trap?”

“Is it working?” I asked.

“I think so,” he said. “They’ve gotten two of the little buggers in the past two months.”

“That seems kind of slow.”

“Yeah. I think it has to do with the amount we’re paying the trappers. They catch one bird and take a few weeks off. I’m planning to get into the business.”

“Trapping peacocks?”

“Nah, those are mean birds,” he said. “And stupid. They’ll peck your car if they think you’re trying to trap them. I’m going to talk to the city fathers about trapping seagulls. Lots more of them than there are peacocks, and they’re even dumber.”

“Don’t you have to have a license to be a wildlife trapper?”

“Yeah, but you gotta have a license to sell real estate or practice law. I did pretty good in both those professions without one.”

The crowd was getting rowdier. I was nearly run down by five people, four of them wearing large name tags. There were three women and two men, all with big hair, running away from the torches.

If a spark had hit one of them, all that hair would have exploded and taken out a lot of our citizens.

I tripped the last guy in the group, and he went sprawling. I put my knee in his back and handcuffed him.

“You’re under arrest.”

“For what?”

“Running in a public place.”

“I’m a minister,” he said. “This is not going to end well for you.”

“I thought you were a real estate salesman.”

“That’s the devil’s work.”

“But you’ve got big hair.”

“I’m from Georgia. Got a little church outside Waycross.”

I uncuffed him and let him up.

“Why were you running?”

“I was following those other preachers.”

“The ones with the name tags?”

“Yessir.”

“Those were real estate people.”

“They’ve got big hair.”

“Yeah,” I said. “That’s kind of their uniform.”

“How do the preachers here do their hair?”

“Most of them don’t have enough hair to mess with.

Besides, I think they’re all Episcopal, Catholic, or Presbyterian.”

“Oh.” “Why are you here?” I asked.

“Mildred Goins asked me to come here to save the soul of her son, Charlie.”

“We need to talk. Want a beer?”

“Heavens no. You got any white lightning?”

“Let’s go see Sammy at the Haye Loft.”
