Town attorney lobbies for local noise control WHY AN OPINION WAS NEEDED

Can a town do anything about noise from boaters?

Existing Florida law allows counties to set noise pollution and exhaust regulations for vessels, but the statute (Florida statute 327.65.) is silent on the ability of a municipality to adopt and enforce a similar sound ordinance.

Therefore, Longboat requested an opinion to see if it could enforce its noise ordinances in the Intracoastal Waterway.

It can get loud out on the water with party music, revved boat engines and boisterous voices.

Can a municipality do anything about it when such noise reaches levels intolerable to residents?

According to Florida Attorney General Pam Bondi, nope.

In August, Bondi issued an opinion declaring the Florida Fish and Wildlife Conservation Commission has jurisdiction involving noise restrictions over the Intracoastal Waterway.

The nonbinding opinion raised the issue of local municipality rights versus state rights in regulating vessel noise on the Intracoastal Waterway in Florida.

Maggie Mooney-Portale, Longboat Key town attorney, said Bondi’s ruling was overly broad, noting the Gulf Intracoastal Waterway includes municipalities from Anclote Key near Tarpon Springs south to Fort Myers in five counties and dozens of towns and cities.

“Courts have repeatedly held regulations of nuisance sound as an inherent authority of local governments under the police power,” Mooney-Portale said in a presentation Sept. 30 disagreeing with Bondi’s stance.

the town could regulate nonmotorized sounds from vessels in the Intracoastal Waterway. Loud music from boats around Jewfish Key was a major motivation for the request, said Mooney-Portale.

Bondi’s informal opinion issued Aug. 2 was diametrically opposed to Mooney-Portale’s stance: “Local governments have no authority to enact, continue in effect or enforce ‘any ordinance or local regulation’ that regulates any vessel on the Florida Intracoastal Waterway.”

Bondi’s opinion doesn’t carry the weight of legal precedent, but it is worth challenging, according to Mooney-Portale.

Mooney-Portale was in Orlando lobbying against Bondi’s

opinion Friday to 70 officials from around the state attending a Florida League of Cities meeting.

“Local governments can regulate sound on land within their jurisdiction,” according to the presentation Mooney-Portale made with St. Petersburg lawyer Regina Kardash at the FLC Growth Management and Economic Development Legislative Policy Committee meeting.

Although the League of Cities did not place the issue on its legislative agenda, it said it would help gather support for legislative changes to aid municipalities.

North Port Commissioner Linda Yates, president of the ManaSota League of Cities, invited Mooney-Portale to discuss the issue at the Nov. 10 MSLC meet-

ing on Longboat Key. “The (attorney general’s) response certainly appears to have implications as it applies to any other municipality,” Yates said in her invitation.

Longboat Key’s municipal code rules noise illegal if it’s “plainly audible, an annoyance and a disturbance,” Mooney-Portale said.

An officer can issue a warning if the sound violation is plainly audible from the complainant’s property. If it’s not corrected within 15 minutes or if it happens again within the next year, the officer can issue a citation.

The Longboat Key Police Department last issued a notice to appear to a boater on the shoal about two years ago, said Police Chief Pete Cumming.

PROPOSED CHANGES Town Attorney Maggie Mooney-Portale would like the Legislature to adapt the following changes: n Clarify Florida statute 327.60 so that prohibitions on local government regulation of vessels on the Florida Intracoastal Waterway only apply to the operation of vessels. n Clarify in Florida statute 327.65 that municipalities have the same powers and limitations as counties on the regulation of vessel noise. Allow cities to adopt ordinances regulating engine, exhaust and noise pollution from vessels at the prescribed state levels.

SEEING RED On the north end of the island, fish kills and red tide smells remained prevalent over the weekend.

s Longboat Key holds its collective breath over the latest encounter with red tide, residents, business owners and town officials say they remain hopeful this won’t be a lengthy ordeal.

Josh Kelly, 41, of Sarasota, was paddling his covered kayak on a beautiful Saturday around noon in the inlet just off New Pass Bridge at the south end of Longboat Key. It’s his favorite hangout, he said, although red tide makes it less so.

“Last week, the whole inlet was covered in fish,” he said. “I’ve never really noticed it this bad in (Sarasota Bay.)” Red tide is caused when the Karenia brevis algae grows in large blooms. It releases toxins that kill fish and other marine life and can cause respiratory irritation in humans.

Kelly pointed to faint pinkish lines running all along the shorelines.

“That’s what’s left of the red tide after the tide goes out,” he said. “It lifts up the fish and takes them out, too.”

Debbie Stanick of Exit Art, 5380 Gulf of Mexico Drive just off New Pass Bridge, said the ill smells of red tide and number of dead fish eased last weekend.

“It seems like it’s not as bad,” she said. “We’re basically in a wind tunnel here, so if there’s red tide we know it.”

Stanick, a 26-year Longboat Key resident, said she has a theory on how to help ward off red tide: Stop using so much fertilizer, which runs into the Gulf of Mexico and is known to encourage blooms.

“We’re a very affluent island that overfertilizes,” she said. “It’s got to go somewhere, so it goes in the ocean.”

Science seems to back Stanick’s theory. The Sarasota County Health Department reports the red tide has resulted in wrack lines containing numerous dead fish and marine organisms.

“Recent rains in the area that wash accumulated pollutants, including bacteria from birds, pet feces, and wildlife into local waters, are also an important factor,” according to the report.

Red tide is not the only complication to island life right now.

Sandra Rios, spokeswoman for The Resort at Longboat Key Club, noted her patrons have had to deal with trucks hauling sand for beach renourishment as well as red tide. But with two pools, a

spa, golf course and tennis courts, there’s plenty to enjoy, she said.

“The effect of red tide has been nominal,” she said. “We haven’t had any guests complain or had any cancellations.”

Closer to the Gulf, laborer Tim Ivey, 54, of Sarasota was working the beach renourishment job behind The Resort at Longboat Key Club. He said it has been smelly.

“It’s been terrible,” Ivey said.

“We’ve been wearing masks.”

Ivey was mask-free Saturday and the air around the club seemed clear of funky fish smells.

“Not a whiff today,” he said.

On the north end of the Key, fish kills and red tide smells remained prevalent during the weekend.

Bartender Jeff DeBorde, of Mar-Vista Dockside Restaurant and Pub at 760 Broadway, said his crew raked the beach Saturday morning but the tide kept bringing in more dead grouper, pinfish, catfish and baitfish. The cleanup helped though, he said.

“We’ve only had one table leave,” he said in the early afternoon Saturday with several outside tables filled next to the dock.

Town Manager David Bullock said the town budgets $50,000 annually to deal with red tide.

From 2007 until late 2015, however, Longboat Key had no red tide costs. It did spend about $35,000 to deal with last year’s outbreak around Thanksgiving, he said.

Public Works employees worked during the weekend removing dead fish with a beach rake in areas where there was turtle clearance, Bullock said. South from Gulfside Road beach access is one of the heaviest areas for

dead fish, he reported.

“It is not pleasant work, but the town crews are doing a great job, and I appreciate their dedication and hard work,” Bullock said.

The beach rake came to the town as a result of the Deepwater Horizon accident, Bullock reported.

“It does a good job on the beach and is a much-improved method from the hand work done in previous years,” Bullock said.

The dead fish are hauled to the Manatee County landfill.

The Florida Fish and Wildlife Conservation Commission says red tide is a naturally occurring microscopic alga documented almost every year since the 1840s somewhere along Florida’s Gulf Coast. Red tide begins 10 to 40 miles offshore and is transported inshore by winds and currents.

The latest FWC report indicates high concentrations of Karenia brevis, the technical term for red tide, in eight samples collected from Manatee County and very low to high concentrations in 31 samples collected in Sarasota County. So, the red tide affliction isn’t going away just yet.

Bob Nunnally, 70, a Longbeach Village resident, had the freshly restored beach on the north end of the island virtually to himself Saturday. Only one car was parked outside the 100 North Shore access, which is usually lined with vehicles. Several fish carcasses and one dead eel littered the new beach and the whiff of red tide was in the air, but it didn’t deter Nunnally.

“I think the beach is great,” Nunnally said. “I hope it lasts more than six months.”

On Sept. 28, the state approved funding 80% of the study, said Tricia Labud, the Florida Department of Transportation traffic studies and analysis specialist handling the project. The Sarasota-Manatee Metropolitan Planning Organization will pick up the remaining 20% of costs, Labud said. The study is projected to cost $675,000, but has a budget of up to $1.5 million, depending on consultant costs.

A big concern for Longboat Key, however, is whether it will take into account mainland traffic.

Town Manager Dave Bullock and Commissioner Jack Daly warned the study is worthless at any cost without doing so.

Daly said the scope of the study approved by the Metropolitan Planning Organization was understood to include a focus on mainland traffic issues contributing to traffic congestion on the barrier islands.

Daly, who sits on the MPO board as the town’s representative and helped persuade FDOT to pay for the study by arguing barrier island traffic is a statewide problem, said he was concerned the focus was being lost.

Bullock reached out to Labud the last week of September to discuss Longboat Key concerns.

Labud’s response was reassuring, Bullock said. She thanked Bullock for pointing out the current wording of the scope of the study is unclear.

“We agree that it is vital to the success of this study to include the mainland connections to the east,” Labud said. “We will certainly be adding clarifying language within the scope to define the limits of the study before con-

A steering committee will help define study parameters once a consultant is selected, Labud said. The timeline for the project targets hiring a consultant near the end of January.

FDOT estimates peg island traffic on Gulf of Mexico Drive in a category of fewer than 15,000 vehicles a day, which works out to a maximum of 5.47 million vehicles annually.

At least four previous traffic studies have been done since 2005, looking at a variety of traffic issues (see timeline, below). The MPO has been involved in several studies, including the 2005 Water Taxi Feasibility Study, the 2007 Barrier Islands Traffic Congestion Study and the 2013 Park and Ride Implementation Plan.

Labud listed all these previous surveys and more in a scope of service proposal for the newest Sarasota/Manatee Barrier Island study.

“For the most part these studies have been performed, but as for how much has been implemented, I’m not sure,” Labud said.

Longboat Key has a long history of studying its traffic woes. Fixing the problem is another issue.

Would-be developer holds out hope for Colony While Unicorp waits for unit owners to approve its proposal, Manfred Welfonder maintains he has a viable plan B. TERRY O’CONNOR NEWS EDITOR

As a proposed $1 billion redevelopment plan for the Colony Beach and Tennis Resort awaits the first of several approvals needed, Manfred Welfonder continues to wait.

Welfonder, principal of Longboat Key-based MW Development Group, has sought to redevelop the Colony for more than seven years. He says now he’s just waiting for the current plan to fall apart.

Welfonder holds out hope for his plan, with Naples-based The Lutgert Cos., because he said the current proposal by Unicorp Acquisitions LLC to unit owners is too rich to make business sense.

“He’s promising a huge amount,” Welfonder said of Orlando developer and Unicorp President Chuck Whittall. “It is above market value.”

Colony unit owners’ votes will be tallied Nov. 10 on whether they accept Unicorp’s offer to end all litigation and sell their units. If 91% of owners agree, the deal with Unicorp can move on to the next hurdles.

Jay Yablon, president of Colony Beach and Tennis Club Association, said votes are coming in, but it’s too early to have a projection.

Manfred Welfonder remains confident his plan for the Colony’s redevelopment will come to fruition. He said the current plan doesn’t make business sense.

“It’s a good agreement for the owners. It solves the problem of having a unified 18-acre development,” he said.

If approved by unit owners, perhaps the largest hurdle in Unicorp’s plan is a request to increase density on the property. That will require town voters to approve a referendum in the spring to add 180 units, for a total of 437. It must also change zoning.

That’s a lot of moving parts, Welfonder said.

“The MW Group is currently in a stand-by position with its qualified Colony redevelopment proposal,” read an email sent to

town commissioners Sept. 24 by MW Corp. and Welfonder. “We are in such a situation because we do not want to interfere with the recent Colony board’s developer selection.”

Town Attorney Maggie Mooney-Portale said she was “not familiar with the standby position term” when asked by commissioners for an opinion on Welfonder’s email at the Sept. 26 commission meeting.

Whittall rebutted Welfonder.

“Mr. Welfonder has nothing, no agreement,” Whittall said. “I’m not a developer who flips properties. I plan on building the resort.

… It will not leave my plans. I will not sell that property.

“It’s very certain to me someone is stirring the pot.”

Welfonder does have his supporters, despite Unicorp having been chosen by the Colony board as its official developer.

Unit owner Peter Kohnstamm, 67, said he wants to see the Colony redeveloped, but is dubious it will gain approval for 180 more units.

“I’m not in favor of what’s in front of us,” he said of Unicorp’s plan.

One of his biggest concerns, however, involves tennis amenities, he said.

“We bought a unit to play endless tennis,” Kohnstamm said.

Whittall said tennis will be prominently featured in the redevelopment with at least three courts and a tennis shop.

Another unit owner said he still has concerns made public earlier about the Colony developers. Original penthouse unit owner Ken Byers sent a letter to the association board in March underlining his misgivings about the Unicorp choice.

Byers said in his letter the Colony board became “infatuated with the unrealistic and unsustainable $130,800 base unit offer.”

“In order for Unicorp to pay that, they will have to develop way beyond what the city will approve,” Byers wrote.

Whittall said there is no reason to even consider another developer.

“I think we’re coming along,” he said.

COLONY RESORT DEAL Below are some of the terms of the deal on which Colony unit owners are voting by Nov. 10: n Owners to receive a minimum of $167,851 at closing for each Colony unit owned. n Owners of beachfront units will receive a $200,000 premium and owners of midrise units will receive a $100,000 premium. n Unicorp proposes to redevelop the Colony as a five-star hotel with a mix of hotel and residential units available for permanent, year-round occupancy. Tourist units will allow no more than 30 consecutive days occupancy by any person. n Owners will also receive reimbursements for special assessments and some general assessments over the last two budget years to repay loans. n Closing in late 2018 is contingent upon Unicorp obtaining land use and development approvals for the new resort.

Your ‘fair share’

Observer

One of the presidential candidates has a mantra of vowing to make you rich people pay your ‘fair share’ (i.e. more) in taxes. But what is ‘fair?’ And who defines it?

I

t’s her class warfare card. She plays it every day.

Hillary Clinton tells us she will pay for free college and expanded Social Security and everything else by making sure Americans who earn the most income pay even more than what they are already paying in federal income taxes.

Clinton says she is going to make sure “they pay their fair share.” What’s more, she is appalled that Donald Trump complied with the federal tax code in the 1990s and therefore qualified not to owe federal income taxes. (Never mind all of the sales taxes, property taxes, excise taxes and payroll taxes his companies paid. Clinton eschews any mention of that.)

But we digress.

Clinton’s mantra of “fair share” always prompts the questions: What is a “fair share?” And who will be the impartial, all-knowing, benevolent, fair-minded judge and jury to decide what “fair” is? Clinton? A Democratic Congress? A Republican Congress? The Supreme Court?

“Fair” is like art — it’s in the eye of the beholder, although most of us know it when we see and feel it. But in Clinton’s eyes, what decades of Democratic and Republican congresses and presidents have created is unfair. Those who earn the most are not paying enough.

But judge for yourself (see box).

“If we are to build a better world, we must remember that the guiding principle is this — a policy of freedom for the individual is the only truly progressive policy.”

Why I ran for the U.S. Senate We are foolish if we think we will achieve change by sending the same people back to run our government again and again.

I

’m going to say a few things in here that folks in the political arena know to be true, but they refuse to say publicly.

Our country is miserably off track.

This is something on which most Americans agree. I personally came to the point where I felt a responsibility to try to do something about it, and I’ve been blessed enough in business to be able to take a shot at a running for office.

Here’s the American situation: We have moved from a culture of independence to a culture of dependence.

We have moved from capitalism into the direction of socialism. We have moved from being a beacon of strength internationally to a position of weakness. And we have moved from a strong financial base to an unprecedented level of debt beyond description or compare.

Of one thing I am certain: We are foolish if we think we will achieve change by sending the same crowd of people back to run our government again and again.

This is the definition of insanity — doing the same thing over and over,

but expecting different results.

I got into this race because the Senate seat was open and I was underwhelmed by our potential choices to represent the Republican Party.

In fact, prior to Marco Rubio going back on his word, our campaign had moved into first place in the Republican primary.

But sometimes life throws you a curveball.

I made the miscalculation of taking Rubio at his word that he wouldn’t seek re-election if he lost the presidential primary. Even in March, he reiterated that he has told people “10,000” times that he is not running for re-election. I guess I was silly to believe the words of a Washington politician.

Once Rubio went back on his word, all the other candidates (being the politicians that they are) ran scurrying for the exits. David Jolly and Ron DeSantis went back to running for their respective seats in the U.S. House of Representatives. Lt. Gov. Carlos Lopez-Cantera went back to doing whatever it is that he does, which is basically nothing except collect a check from the Florida taxpayers.

The directive out of Washington was for everyone to kiss Sen. Rubio’s ring and bow out of the race.

But we did not yield to the Washington political establishment, and even though we did not win, I make no apologies.

Herein lies the big problem in America today. The folks in Washington, in both parties, think they can give orders to us. It is supposed to be just the opposite. They are supposed to take orders from us. I do not take orders from Washington, and I sug-

gest that no one else should, either.

Critics will say it was a fool’s errand to stay in the Senate race. They will say we had no chance of beating Rubio, and they will say I wasted money.

Of course, critics are most often those people who lack the courage or commitment to enter the arena.

I care deeply about the direction of our country. I wanted to go to Washington to say enough is enough.

And to fight for the American Dream that has been so good to my family, and is clearly slipping through our fingers today with the mindless and naïve liberalism of Barak Obama and Hillary Clinton.

We came up short, but I make no apologies for fighting for what is right.

One last thing. I will vote for Donald Trump and Marco Rubio in November. With all of Trump’s sins, and we all have them, his message is one of change and for America embracing those values that made us the greatest country in the world.

With regard to Rubio, in my judgment he made a life mistake. A man’s word is the most important thing he has. Rubio must live with that decision. Sadly, he could have learned a lot about America and about himself by leaving politics and spending some time in the real world. Nonetheless, he is the best of the remaining options.

We as a campaign, and I personally, am appreciative of the support of those who sought change for this country. I will never have the right words to show my sincere appreciation to all those friends who gave of their time and resources. Thank you for your efforts, and most importantly, your votes of confidence.

Jack Daly wants to retain Longboat Key Commission seat Of three Longboat Key commissioners whose terms expire in March, only one is eligible to return.

Commissioner Jack Daly, 80, picked up qualifying papers Sept.

27 at the Longboat Key Town Hall for re-election to the District 4 seat in the March election.

His health is not a concern this year, he said, after having heart valve replacement surgery June 2. Four days after surgery, he was back at work.

Two other commissioners will not return.

Mayor Jack Duncan is at the end of his term limit and said he will return to the private sector.

At-large Commissioner Phill Younger is also at the end of his term limit in March.

Former Longboat Key Mayor Jim Brown filed Sept. 20 to run for Younger’s post in the 2017 election.

Two Yamaha 300-horsepower boat motors valued at $4,200 apiece were reported stolen at 3:57 p.m. Sept. 21, according to a Longboat Key Police Department report.

A fully covered white 2014 Grady Freedom was up on a lift when the theft occurred, according to the report. The Grand Rapids, Mich., boat owner said he had not seen his 30-foot boat in several months.

A person who watches the boat reported the thefts must have happened sometime between Sept. 14 and Sept. 21, according to the report.

The police report pegged the total value of the theft at $12,169.

The vessel was processed for fingerprints and video from two nearby cameras checked, according to the report.

The investigation is ongoing.

The certificate is the highest form of recognition in governmental accounting and financial reporting.

Longboat Key’s Finance Department and Director Sue Smith are primarily responsible for preparing the CAFR.

As anyone who has ever explained new technology to an aging parent understands, it takes patience.

Compare that to the rapid speed it takes a teenager to navigate a smartphone.

Through the Teens and Elders Achieve More, or eTEAM, volunteer program at Plymouth Harbor on Sarasota Bay, students from local high schools give up part of their Saturdays to guide residents through technology. Students as young as 14 are partnered with residents to help with everything from tablets to cellphones and personal computers.

Becky Pazkowski, senior vice president of philanthropy at Plymouth Harbor, started the program three years ago to meet the need of residents struggling with technology and to push teens to volunteer.

“I think it’s rather humbling for both of them,” Pazkowski said.

In three years, 17 students have given more than 600 hours volunteering to help 160 residents.

Through the eTEAM volunteer program, students have access to residents who have had a variety of careers with varying levels of expertise. Residents in turn become mentors for students.

Their time together inspired Yaegers to pursue studying aerospace and mechanical engineering at the University of Florida.

“When I talk to these youngsters who are enthusiastic anyway, I told them about some of the experiences I’ve had and they loved hearing about it,” Gehrie said.

Ron Johnson remembered for dedication to community A celebration of his life was held Sunday at Mote Marine Laboratory and Aquarium.

Johnson’s younger sister, Eileen, spoke Sunday at his celebration of life. At the end of her speech, she thanked Johnson for being her brother.

in local government, an advocate for Mote Marine Laboratory and Aquarium and the Longboat Key Center for the Arts, and a key figure in the construction of the Ringling Bridge.

At the memorial, retired Army Lt. Gen. Howard G. Crowell presented Johnson’s wife, Jinny, with a resolution the Mote Board of Trustees signed on Sept. 1 in appreciation for Johnson’s dedication to the mission of advancing the science of the sea through Mote.

Mote President and CEO Michael Crosby sent a recorded speech because he was unable to attend. Crosby noted Johnson was always ready to get involved and volunteer.

“When we think of Ron’s life, he lived a long and full life, a very, very full life,” Crosby said. “But his passing has left a void. A void for Jinny, his family, for all of us here in the community, but I think it’s important that we remember at his celebration of life all the joy he brought to us and touched our

lives for the positive.”

Dan Idzik, past president of the Longboat Key for the Center of the Arts, said the best way to honor Johnson would be to follow in his footsteps. Susan Phillips, assistant to the town manager and president of the Longboat Key Garden Club, said the world would be a better place if people acted like Johnson.

“He had a habit of rising to the top of absolutely everything he joined, and there is evidence everywhere as we can see,” Eileen Johnson said. “It was just a natural thing for him to do.”

“It was just so heartwarming, and the tribute to Ron would have made him so happy,” Jinny Johnson said.

Eileen Johnson’s brother really liked to tease her. Whether he was hiding under the bed and grabbing her feet or staring at her forehead while she yelled at him, he always having fun.

He was a prankster and a giver, one who knew his creativity was not limited to his role as big brother.

He was Ron Johnson.

On Sunday, family and friends gathered to honor Johnson, who died June 27 at the age of 84.

“He knew he had places to go and things to do, and he did not know where yet,” Eileen Johnson said. “He didn’t have an inkling why or what was going to happen next, but that energy was bursting forward within him.”

Johnson wore many hats throughout his life. He was a die maker at Goodyear, a businessman, family man, photographer, mayor, town commissioner, volunteer and friend.

Susan Mackey, 74, of Kansas City, died Sept. 29.

She was born to Bill and Nickie Smith on May 2, 1942.

She attended Sunset Hill School and Northwestern University, where she was a member of the Kappa Kappa Gamma women’s fraternity. She married Edmonds P. Mackey on June 26, 1965.

She loved swimming, fishing, the Kansas City Royals, the symphony and spending her spring season on Longboat Key. She enjoyed knitting and the arts and was a devoted member of the Knickerbocker Investment Group.

She is survived by her husband, Edmonds; son Peter Mackey and his wife, Dawn; daughter Laura Urquidez and her husband, Chris; three granddaughters; brother Bill Smith; sister Laurie; and a niece and nephew.

She attended Marshall County High School and David Lipscomb University. She graduated from the Peabody School at Vanderbilt. Following school she moved to Washington, D.C, and worked at the Pentagon.

She returned to Nashville and met her husband, Clarence Shaub. The couple spent their winters on Longboat Key playing golf and spending time with friends.

In her free time, Jane enjoyed gardening and bridge. Through her avid golfing, she volunteered and helped introduce golf to the next female generation. She was active in Nashville’s golf programs to develop play between women throughout the area. She was an officer of the Nashville Women’s Golf Association. She was an active volunteer in the Nashville community, specifically aiding children and families, the Fannie Battle Day Home and sponsored missionaries for Christian outreach throughout Asia and Israel.

She was preceded in death by her parents; husband Clarence; and siblings Martin, Lilla, John, Margaret, Grace, Polly, George and Sam. She is survived by sons Robert Judd Shaub, John Selden Shaub and James Luton Shaub II; daughter Margaret Ann Barton; 13 grandchildren; and 17 great grandchildren. Bud was a lawyer, real estate developer, farmer and World War II Army officer. In 1980, Bud and Patricia moved to Martha’s Vineyard where they developed Thimble Farm and grew and sold strawberries and hydroponic tomatoes for 23 years.

In 2009, he married Beth Ann Toomey. Aside from his careers, he was a sailor, small-plane pilot and loved animals. He will be remembered for his zest for life, compassion for others and curiosity.

He is preceded in death by his parents and first two wives.

He is survived by wife, Beth; Beth’s five children; daughters from his first marriage, Patrice Moskow, Cathy Moskow and Nancy Moskow; granddaughters Julia Moskow Alter and Emma Ferguson; brother J. I. Moskow; and numerous cousins.

pair of Longboat Key mute swans are settling into a permanent home after their parents booted them from the roost.

The two males were hesitant to step out of their red and blue carrying bags when they arrived at their new digs in Sarasota, but finally ventured into the fenced hut as if playing follow the leader.

The boys stuck together, found refuge in a corner and stayed there while their former keepers, David Novak and Eric Bors-Koefed, talked with their new human handlers. The two are now at home at Sarasota Jungle Gardens, where Kara Krimers is animal department supervisor and Chris Lavick

is general manager.

At first the swans were a bit frustrated and let it be known, stretching their legs and necks and making huffing sounds. But soon they calmed down and huddled together.

The pair, which had been at Camelot Lakes after their initial move off Longboat Key, moved into their new home at the Sarasota Jungle Gardens on Sept. 28 as an animal donation and first placement by the Gracie Swan Foundation’s Community Placement Program.

The program was established to prevent overpopulation on Longboat Key. The Key already has between 16 and 20 swans. Susie and Sully, the sole breeding pair on Longboat Key, produce three to six cygnets a year. If the cyg-

You have until Oct. 31 to email marketing@sarasotajunglegardens.com with the subject line “Swan Name Contest” with your suggestions and contact information. The winner will receive a free family pass to the Holiday Lights Spectacular at the gardens that begins Dec. 2.

Interested communities need to have a plan for the swans and offer a natural lake or pond free of alligators and river otters, among other requirements.

“A typical clutch of cygnets is going to average around four,” said Novak, who cares for the swans on Longboat Key. “I don’t really anticipate four are going to die, so for that fact, then we’re probably always going to have extra.”

Sarasota Jungle Gardens reached out to the Gracie Swan Foundation after deciding that swans would be a great addition to the famed Florida attraction.

The foundation, Lavick said, “fulfilled a need we had.”

For the next four weeks, the swans are under quarantine. The 28-day quarantine is to make sure they don’t have parasites and are dewormed. It also gives Sarasota

The move was a positive one, even if the reason for the relocation is a bit unnerving. Swans are territorial and see their cygnets as intruders as they mature.

Bors-Koefed, who had been the swans’ caretaker at Camelot Lakes, said he couldn’t be happier with the new location, noting the new environment will be elaborate. Like any good caretaker, he understood he couldn’t keep them forever.

“We can’t protect them from everything,” he said.

The swans are a beloved part of Longboat Key, and their placement at Sarasota Jungle Gardens will allow residents to still see them. The swans were born on Longboat Key to Susie and Sully, but after nine months their

parents kicked them out, which prompted their move to Camelot Lakes. In May, the duo moved to Sunnyside Village. But after only four days, predators became an issue, and the two moved back to Camelot Lakes.

Novak has been the unofficial swan keeper of Longboat Key since 2007. He takes his duties seriously, evidenced by how he felt obligated to check out the swans’ new home at Sarasota Jungle Gardens. He said their new home is open enough for them, for they would have similar amounts of openness at other residential areas.

So, does Novak get sad when they leave?

“No, because everything is focused on what’s right for the bird,” he said. “I want to do things that are right for the bird and anyone else and right for the reputation of Longboat Key.” But, before walking out the door of Sarasota Jungle Gardens, Novak turned to Lavick and told him, “as of today, they’re your babies. Take good care of them.”

All Faiths seeks to end child hunger AMANDA MORALES COMMUNITY REPORTER

In Sarasota County, 14% of residents experience food insecurity, meaning they have limited or uncertain access to adequate food.

But for children, the rate is even more staggering at 24%.

Now, All Faiths Food Bank wants to bring organizations in the community to the table to learn how they can help end child hunger in Sarasota.

Community leaders were invited to that table Sept. 27 during the 2016 Child Hunger Summit at Sarasota Municipal Auditorium.

All Faiths Food Bank CEO Sandra Frank said the organization serves 60,000 people per year, but that’s not enough, given the level of food insecurity in Sarasota and DeSoto counties.

“Hunger is a health issue,” Frank said.

Frank called on community organizations to collaborate to help solve child hunger in Sarasota County, where 53% of children in school are enrolled in free and reduced-price meal programs.

Sarasota schools with the highest rates of free and reducedpriced lunches are Alta Vista Elementary School at 96% and Tuttle Elementary School at 91%.

Both schools have pantries supported by All Faiths Food Bank.

“When children are not in school or families are not on campus receiving meals, there isn’t a consistent source of nutrition,” said Barbara Shirley, Alta Vista’s principal.

Manasota BUDS book club sets sail

B

efore members of the Manasota BUDS, Bringing Up Down Syndrome, book club could learn the ins and outs of sailing, they had to finish some homework first.

The six teenagers present took turns going around the circle and sharing a little bit about the book they had just finished reading. Each of them had read a book about sailing or boating, which brought them to the Sarasota Sailing Squadron on Sept. 24. Between “The Magic Tree House” series by Mary Pope Osborne and “Aqualicious” by Victoria Kahn, each member picked a book with a boating theme that suited his or her interest.

After talking about their books, members got a boat ride around the bay so they could watch some of the sailors on the water. They also learned how to steer a sailboat.

About five or six times a year, the book club gets together and discusses the books each member read. Each time the group picks a different theme and then the members pick their books based off that.

While the debate continues over the next theme, some suggestions were cooking, bears, lemurs, mermaids and skiing.

ernard Croghan hopes to spend the next few years in jail — by choice.

A Manatee County developer who has mostly leased shared services space for the past 15 years, Croghan isn’t going to be locked up. He and his team instead seek to turn the abandoned Manatee County jail, in downtown Bradenton in the new Judicial Center complex, into a 100-unit apartment complex geared to young professionals. “I’ve always liked urban redevelopment more than suburban new development,” Croghan said. “And I’ve always wanted to do one in downtown Bradenton.”

It also includes turning the rooftop prisoner basketball court, into a courtyard barbecue deck.

Croghan estimates the redevelopment is at least a $9.5 million project, which includes renovations of the building after leasing it from the county. Apartments, in the early planning stages, will be listed for $600 to $900 a month, including utilities.

Rents like that in the area are rare, said Ogden Clark, cofounder of the Manatee Millennial Movement and a Manatee County Neighborhood Services employee. “There is virtually no housing in downtown Bradenton millennials could afford,” Ogden said.

Yet Croghan was somewhat skeptical when Manatee County Property Manager Charlie Bishop called him earlier this year with what the official termed an “interesting project.” The pair toured the six-story jail, at 1051 Manatee Ave. W. “It was a hot,

Croghan quickly grew passionate about the project. He and his team submitted the only proposal to county officials by a Sept.

15 deadline. County staff has 30 days to go over the proposal, suggest changes and present it to county officials.

A Philadelphia native, Croghan worked for banks and lenders in commercial real estate and moved to Manatee County in 1999. He and some partners built ComCenters into one of the largest sharedservices office landlord firms in the Bradenton area. ComCenters provided small offices, meeting space, administrative functions and other executive suite services for a variety of small business.

Croghan sold his stake in ComCenters and turned to the next

evolution of the field: co-work space.

In a project separate from the proposed jail redevelopment, but could be complementary, Croghan is also working on Connect Bradenton. It’s a planned cowork space in the former BB&T Insurance office at 801 Old Main St. in downtown Bradenton. Features at Connect Bradenton, says Croghan, will include premium coffee in the morning and cold craft beer in the evenings. That project, a $600,000 renovation, is expected to be open early next year.

The key to both projects, says Croghan is to listen to what potential customers — young professionals — want in workspace and housing. “We have to build communities for young folks,” he says.

“These are the people who will someday run this town.”
