Class3andclass4relativeshaveaplaceundertheHinduSuccessionAct.Theyare respectivelyagnates(relationsthataresolelybasedonmen)andcognates(relationsthat arepartiallybasedonmales).IntheHinduSuccessionAct,agnatesaregivenhigher precedencethancognates.

Theclass1relativesundertheHinduSuccessionActarecomparableforHinduwomen.The husband,kids,andkidsofthedeceasedson/daughterareonthelist.Theestatewillgoto thehusband'sheirsifatleastoneofthemisstillliving.Ifthedeceased'smother&father arestillaliveandthespousehasnoheirs,theywillinherittheproperty.TheHindu SuccessionActhasaspecialclauseforpropertythatafemaleHinduinheritsfromher fatherormother.Suchpropertywillpasstoherfather'slegalheirsifshedoesnotleavea sonordaughterbehind.

AccordingtotheHinduSuccessionAct,iftwopeoplepassawaysimultaneously,suchasina caroraeroplaneaccident,anditisimpossibletopinpointexactlywheneachpersonpassed away,itisassumedthattheolderpersonpassedawayfirstuntilthecontraryisestablished. Additionally,thepropertyofsomeonewhomurdersanotherpersonwillnotbepassedon tothem.Ontheotherhand,hisheirsarenotbarred.TheHinduSuccessionAct's aforementionedprovisionsarecrucialbecausetheychangethesuccessionlineand/or ratioofpropertytransferringtolegitimateheirs.

TheHanafiLawstatesthatlegaciesarerestrictedtoathirdofwhatisstillavailable aftermakingalloftheaforementionedpayments. 

Theremainingtwo-thirdswillbegiventoheirsinthesamemannerasintestacy.

Musliminheritancelawsgrantthewidowofthedeceasedone-fourthoftheestateifsheis childless&one-eighthifshehaschildren,incontrasttoTheIndianSuccessionActorHindu SuccessionAct.Ontheotherhand,awidowerreceivesone-fourthoftheestateifthereare childrenpresentandhalfofitiftherearenone.Itiscustomaryforasontobegiventwice asmuchashissisters.Halfofherfather'sbelongingsaregiventoonedaughteronly.

ThenextofkinisclassifiedasresidueundertheMuslimLawofInheritance,whereasthe wife,mother,andchildrenarethesharers.Theestatebelongstodistantkinifthereareno sharersorresiduary.

For Indian Christians, the Indian Succession Act

ChristiansinIndiahavepropertyrightsthataregovernedbytheIndianSuccessionAct. Before1925,distinctlawsappliedtotheprovincesofCochin,Travancore,Pondicherry, Goa,Daman,andDiu,buttheIndianSuccessionActbroughtthemalltogether.Some Christianscontinuetoadheretotheirtraditionallaws.Menandwomenaretreatedequally inChristianlawregardingsuccessionandinheritance.AccordingtoSections31to49ofthe IndianSuccessionAct,ifamandieswithoutleavingawifeandchildren,hiswidowwill receiveathirdofhisestate,withtheremainingtwo-thirdsgoingtohisdirectlineage.If therearenochildren,thewomanreceiveshalftheestateandtheotherhalfisdistributedto thefamily.Iftherearenochildrenorrelatives,thewidowwillreceivetheentireshare.The propertywillbesplitevenlybetweenthechildreninthewidow'sabsence.Iftheirparents aredeceased,thechildrenofthechildren(grandkids)willreceiveaportion.
