We have a vast amount of experience across the team. Some recent examples that give an idea of the level of work we regularly undertake are:
• Issued judicial review proceedings against a Local Planning Authority. The case was of particular note because it was submitted outside the statutory six-week time limit and so we were required to apply for an extension of time.
• Advising a registered provider on a stopping up application concerning highway land which affected their ability to develop land pursuant to an obtained planning consent for residential development.
• Advising several landowners on the service of counter notices and blight notices in connection with land to be compulsorily purchased by HS2.
• Advised a top ranked university on a Section 106 Agreement and provided planning advice in relation to new Social Sciences Block.
• Advised a client in relation to a Section 215 TCPA 1990 notice in relation to two demolished barns relating to our client’s poultry operation.
• Negotiated and drafted a complex Section 106 Agreement and provided planning advice for a multi-million residential and hotel development.
• Acted for a land promoter in connection with a hybrid option and promotion agreement over green belt land comprising circa 90 acres between 5 separate freehold titles.
• Acting for a local authority in the Cotswolds AONB in its acquisition from a local sport club of freehold land and its sale of part of this land plus our client’s land to a housebuilder. The transaction will enable a residential development of circa 115 dwellings (including affordable housing), the relocation and redevelopment of new sports facilities and the establishment of a nature/wildlife reserve on gravel pits adjoining the residential development.
• Acted for the sellers on the freehold sale of a residential development site to a housebuilder purchaser for In excess of £10 Million. The transaction included the variation and release of an existing option agreement and a 50% deferred payment secured by a first ranking legal charge.
• Acting for the beneficiary of an existing overage agreement in relation to its variation by way of a very novel four way put and call option which will enable the party subject to the overage to enter into a land pool trust (“LPT”) with adjoining landowners and the LPT to then enter into a hybrid option and promotion agreement with a developer. over part of the site.
• Acted for a land promoter in connection with a series of interconnected agreements relating to strategic land comprising extinguishment of existing option, grant of new option, deed of variation to an existing easement, grant of new modern deed easement with delayed exercise date and a hybrid planning, promotion and option agreement.
• Acted for a registered provider on a conditional (on planning) site assembly project relating to a residential development site in the North West of England which will provide circa 150 affordable apartments.
