It was with great celebration that we began our 99th year at the Whittier Chamber last month! We held our first Wake Up Whittier of 2013 at Parnell Park, hosted by IHOP, with over 200 local business owners and Chamber members in attendance. The Whittier Daily News was also on hand to document the morning activities with pictures and an article, which I hope you all got a chance to read, about our progress and continued success thus far. Now is a good time to remind you to utilize your Whittier Chamber membership by participating in the many networking opportunities the Chamber has to offer!

$ TAX TIPS Deductions of Investor who Manages His Own Investments

Richard Scrivanich You recently asked about the deductibility of your investmentrelated expenses, including the cost of subscriptions to financial periodicals, clerical expenses, etc. You wanted to know whether you could deduct these expenses as business expenses in arriving at adjusted gross income, rather than as production of income expenses which are deductible only as itemized deductions and thus are subject to the 2% floor on miscellaneous itemized deductions.

In order to deduct your investmentrelated expenses as business expenses, you must be engaged in a trade or business. The Supreme Court held many years ago that an individual investor isn’t engaged in a trade or business merely because he manages his own securities investments, regardless of the amount of the investments or the extent of the work required. If a taxpayer can show that his investment activities rise to the level of carrying on a trade or business, however, he may be considered a trader, who is engaged in a trade or business, rather than an

investor, who isn’t. A trader is entitled to deduct his investment-related expenses as business expenses. A trader is also entitled to deduct home office expenses if the home office is used exclusively on a regular basis as his principal place of business. An investor, on the other hand, isn’t entitled to home office deductions since his investment activities aren’t a trade or business.

Since the Supreme Court’s decision, there has been extensive litigation on the issue of whether a taxpayer is a trader or investor. The Tax Court has recently developed a two-part test that must be satisfied in order for a taxpayer to be a trader. Under this two-part test, a taxpayer’s investment activities are considered a trade or business only where both of the following are true: (1) the taxpayer’s trading is substantial (i.e., sporadic trading won’t be a trade or business), and (2) the taxpayer seeks to catch the

swings in the daily market movements, and to profit from these short-term changes, rather than to profit from longterm holding of investments.

Thus, the fact that a taxpayer’s investment activities are regular, extensive, and continuous isn’t in itself sufficient for determining that a taxpayer is a trader. In order to be considered a trader, a taxpayer must show that he buys and sell securities with reasonable frequency in an effort to profit on a shortterm basis. Even a taxpayer who made over 1,000 trades a year with trading activities averaging about $16 million annually was held to be an investor because the holding periods for stocks sold averaged about one year.

Progress at the Fred C. Nelles site is finally being made. This is great news for the community as it has been eight years since the site closed. The city will interview environmental consulting firms this month and will begin the development review process. The state of California and Brookfield Homes amended their contract last summer and it’s great to see the developer moving forward on this project that will most certainly be a positive addition to Whittier.

This month’s Business Owners Seminar Series (B.O.S.S.) will be presented by Dr. Manuel Urteaga, chiropractor at Uptown Wellness Center. With the flu season in full swing, you are encouraged to attend the workshop on February 28 to learn more about “Motivating Yourself & Your Team to Stay Healthy During Flu Season.”

City Council passes ordinance; Whittier parks to go “smoke-free” February 8

In response to the growing concern over the health dangers resulting from second-hand smoke, the Whittier City Council has passed an ordinance which will prohibit smoking in the City’s parks, effective as of Friday, February 8, 2013.

The no-smoking ordinance had its first reading at the December 11, 2012 Council meeting, followed by the second reading at the January 8, 2013 meeting. After the second reading is held, a new ordinance goes into effect in 30 days.

Smoking will be prohibited within City parks, including parking lots, or within 50 feet of such a facility. The prohibition shall not affect smoking on private property, such as a home’s front yard, if it is within 50 feet of a park, or to people smoking while passing a park on a street or sidewalk.

In addition, the ordinance prohibits the disposal of any tobacco product, such as cigarettes and cigars, in the areas where smoking is not allowed.

Signs will be posted prior to the effective date of the ordinance to alert and educate park visitors about the new ban on smoking.

The road leading to the ban on smoking in public parks began as a grassroots movement, spearheaded

by Activate Whittier. Activate Whittier, a consortium made up of representatives from the YMCA of Greater Whittier, PIH Health, Los Angeles County Public Health Department, Kaiser Permanente, the Boys and Girls Club of Whittier, Whittier College and the City of Whittier studies and makes recommendations for public and private programs and activities to help improve the health and wellness of Whittier residents.

Activate Whittier is currently working with HEAL and ACHIEVE grant funding to encourage increased physical activity, better nutrition and access to healthy foods, as well as advocacy and policy changes in the community toward these goals.

Taking the lead in the effort to ban smoking in public parks, Activate Whittier brought the matter to the attention of the Parks, Recreation and Community Services Commission, seeking the Commission’s recommendation to City Council to eliminate smoking in City parks.

At its June 20, 2012 meeting, the Commission discussed Activate Whittier’s request and recommended that the City Council approve an ordinance amending the Whittier Municipal Code to this effect, which was accomplished by Council action at the January 8, 2013 meeting with the

second reading of the ordinance.

In presenting the case for smokefree parks, Activate Whittier brought up the following concerns to City of Whittier officials: • In 2006, a United States Surgeon General study concluded that people who breathe secondhand smoke inhale more than 50 cancer-causing chemicals.

• The Surgeon General has stated that secondhand smoke causes diseases and premature death in non-smokers and maintained that there is no risk-free level of exposure to secondhand smoke.

• Stanford University research concluded this to be true outdoors as well as indoors.

• Cigarettes are a top litter item in parks which could impact children at play in parks.

In addition, when presenting the case for no smoking in City parks, Activate Whittier noted that when, in 1998, the State of California adopted a law prohibiting smoking in public buildings, within 20 feet of the main entrances, exits and windows of these buildings, the State also took action authorizing cities to enact more restrictive smoking bans as they felt necessary. This provided the springboard for the smoke free parks effort.

While planning this no smoking request to the C i t y, t h e L o s Angeles County Public Health Tobacco Control and Prevention Program conducted an informal survey of 508 residents within both the City of Whittier and the unincorporated Whittier area, including a cross-section of various age, sex and ethnic groups. Of those surveyed, 90.8% did not use tobacco and 9.2% were tobacco users. The results of this informal survey showed that 78.2% favored no smoking in public parks and 62.2% said they would feel more comfortable asking someone to stop smoking in a park if it were illegal.

Although smoking in Whittier parks will now be illegal, the City will be relying primarily on community selfregulation and courtesy rather than a proactive approach, however repeat offenders could be cited if they refuse to stop smoking when asked by other park visitors.

Whittier now joins more than 140 California cities, along with Los Angeles County, which prohibits smoking in public parks as a way to protect the health of its residents.

WHAT’S COOL IN YOUR SCHOOL Capital Fellowship Program deadlines fast approaching The Jesse Marvin Unruh Assembly Fellowship, the California Senate Fellows, the Executive Fellowship and the Judicial Administration Fellowship Programs are excellent opportunities for students or others to gain firsthand knowledge of the operations of the three branches of state government.

The Jesse Marvin Unruh Assembly Fellowship Program, founded in 1957, by the legendary former Speaker Jesse Unruh and renamed in his honor in 1987, is the oldest of the four programs and one of the most prestigious legislative fellowship programs in the nation.

Each year, 18 college graduates are selected for the Unruh Assembly Fellowship from an international applicant pool. Assembly Fellows spend 11 months gaining firsthand knowledge of the California Legislature by working in Sacramento as staff to a legislative committee or an Assemblymember. Their duties are similar to those of legislative assistants and consultants, which include developing and researching legislative proposals, responding to constituent requests, analyzing bills, and writing speeches and press releases.

Deadline: February 11, 2013 Cal Grant scholarship application deadlines set for March 2 The Cal Grant Program ensures that any qualified student will not be turned away from a college education due to financial difficulty. The Cal Grant Program provides eligible students with financial aid in the form of need-based grants funded by the State of California.

The program is administered by the California Student Aid Commission (CSAC). Cal Grants are intended for middle and low-income California residents attending California post-secondary schools (both public and private institutions).

Recently enacted legislation expanded the Cal Grant Program. AB 130, also known as the California Dream Act of 2011, makes undocumented students that are exempt from paying out-of-state fees at California’s public higher education institutions eligible to receive scholarships that are funded by non-state funds. Its companion bill, AB 131, allows students that qualify for in-state tuition at public colleges and universities, regardless of immigration status, to be eligible for institutional financial aid awards, effective January 1, 2013.

The deadline for qualifying for Cal Grants is March 2, 2013. For more information on Cal Grants, please call the California Student Aid Commission at (888) 224-7268. Customers, by the way, think this is hilarious! If you are a retail store, extend the appreciation and include a pair of wild socks with every purchase.

Post a thank you note on someone’s door, computer screen or cubicle.

Say thank you. Sincerely, honestly and for a specific action or behavior. Better, say thank you with a handwritten card.

New Disability, Workers’ Comp Rules Changes to Fair Employment/Housing Disability Regulation take effect Several changes to the disability regulations under the Fair Employment and Housing Commission (FEHC) went into effect on December 30, 2012.

The changes to the disability regulations include:

• An expansion of the definitions of • •

“mental” and “physical” disability; Clarification of what evidence might be used to show that a particular function is “essential” to a job; A description of the interactive process and obligations of both the employer and the employee or job applicant; and A description of what constitutes a reasonable accommodation and specific examples, including a discussion of when a leave of absence might be an appropriate accommodation.

The text of the regulations is identical to the version adopted by the FEHC on December 18, 2012. A copy of the approved disability regulations is available at www.dfeh.ca.gov/Fair EmploymentAndHousingCouncil.htm.

These amendments to the disability regulations are separate from the recently approved amended pregnancy disability leave regulations, which also took effect on December 30, 2012.

HRCalifornia Updates HRCalifornia has been updated with an expanded discussion of these regulations. California Chamber of Commerce customers also can get an expanded discussion of the disability regulations and the pregnancy disability leave regulations and their impact on state law in the 2013 California Labor Law Digest.

February Seminar CalChamber employment law experts will hold a live half-day seminar in Sacramento on February 15 that will cover the amended regulations in detail, and their impact on employers and employees. Emergency Workers’ Comp Rules Implement Reform Legislation Emergency regulations to implement cost-saving elements in the workers’ compensation reform bill enacted last year went into effect on January 1.

The California Chamber of Commerce supported the reform bill, SB 863 (De León; D-Los Angeles; Chapter 363, Statutes of 2012), which contained critical reforms for improving efficiency and reducing unnecessary costs in the California workers’ compensation system, which are necessary to offset the $1 billion benefit increase provided under the bill and dampen the trend of increasing costs to employers.

The reforms potentially lower system costs for employers by reducing delays and litigation in the system, addressing the lien epidemic, shortening the medical-legal process, implementing an independent medical review system and streamlining the permanent disability schedule.

Regulation Changes Although the benefit increases kick in automatically, most of the costsaving reforms require regulatory implementation. The Brown administration made notable progress against an extremely tight deadline in December. Regulatory changes now in effect include:

• changes to the Supplemental Job Displacement Voucher;

• new systems for resolving medical treatment and billing disputes;

• filing fees from service providers who file liens;

• new requirements for medical examiners;

• payment changes to surgery centers •

and hospitals that perform spinal implant procedures; and new requirements for interpreters and chiropractors.

Some of these changes will be followed by formal rulemaking in 2013.

Whether you’re a Fortune 500 company or a one-person shop, to be successful, you must have a plan to attract customers and you must implement it consistently. However, it doesn’t have to cost a fortune and you don’t have to be a creative genius.

The key to attracting customers is developing a marketing strategy that forms a solid foundation for your promotional efforts, by implementing advertising, direct mail, social media and one-to-one sales efforts.

To develop a strong marketing foundation: Define your product or service: How is your product or service packaged?

What is it that your customers are really buying? You may be selling webbased software tools but your clients are buying increased productivity, improved efficiency and cost savings.

What problem does your service solve?

What need does your product meet?

What want does it fulfill?

Identify your ideal customer: Everyone or anybody might be a potential client or customer for your product. However, you probably don’t have the time or money to market to Everyone or Anybody. Who is your ideal customer? Who does it make sense for you to spend your time and money promoting your service or product to?

For example: a massage therapist might decide her target market is a woman with a household income of $75,000 or more who lives in the nice area of town.

Differentiate yourself from the competition: Even if there are no direct competitors for your service,

there is always competition of some kind. Something besides your product is competing for the potential customer’s money. What is it and why should the potential customer spend his or her money with you instead? What is your competitive advantage or unique selling proposition?

Find a niche: Is there a customer group that is not currently being served or is not being served well? Are there customer wants that are not being met?

A niche strategy allows you to focus your marketing efforts and dominate your market, even if you are a small player.

Develop awareness: It is difficult for a potential customer to buy your product or service if they don’t even know or remember it exists. Generally a potential customer will have to be exposed to your product 5 to 15 times before they are likely to think of your product when the need arises.

Needs often arise unexpectedly. You must stay in front of your clients and customers consistently if they are going to remember your product when that need arises.

Build credibility: Not only must clients be aware of your product or service, they also must have a positive disposition toward it. Potential customers must trust that you will deliver what you say you will. Often, especially with large or risky purchases, you need to give them the opportunity to sample, touch, or taste the product in some way.

Be Consistent: Be consistent in every way and in everything you do.

This includes the look of your business,

marketing materials, the message you deliver, the level of customer service, and the quality of the product. Being consistent is more important than having the best product. This in part is the reason for the success of chains. Whether you re going to Little Rock, Arkansas or New York City, if you reserve a room at a Courtyard Marriott you know exactly what you’re going to get.

Maintain Focus: Focus allows for more effective utilization of the scarce resources of time and money. Your promotional budget will bring you greater return if you use it to promote a single product to a narrowly defined group of customers and if you promote that same product to that same customer group over a continuous period of time.

Before you develop marketing materials, run an ad, implement a direct mail campaign, join a networking group, start a Facebook page, add a Twitter or Pinterest account, ask yourself this question, Do I really know who my ideal customers are and not only what they need but also what they want?

AROUND TOWN Free advanced training to be held at Fix Auto Whittier for emergency responders Fix Auto Whittier is dedicated to the safety of their customers and would like to take an opportunity to thank all of their first responders for the vital services they provide within our community. In appreciation for their service, Fix Auto would like to invite members of first responder departments in the area to attend a night of advanced training on them. The class will be held at their office, 12130 Washington Blvd. in Whittier, on Tuesday, February 19 from 6 p.m. to 10 p.m.

The course that will be offered is “Rescue 4 Disabled” presented by Todd Hoffman from Scene of the Accident. Rescue 4 Disabled is a classroom course developed to provide first responders with the information they need to properly handle and care for persons with disabilities at the scene of a motor vehicle accident or

mass casualty event. This course covers advanced extrication and safety procedures for mobility vehicles equipped with special devices for the disabled, advanced steels, altered and additional restraint systems and electric and hybrid systems. Special procedures required when working with prisoner vehicles with advanced restraint and containment devices are also outlined.

There are no prerequisites for this course.

Upon completion of the course, students will be able to identify and categorize persons with disabilities and initiate the appropriate diagnosis and care for each disability. Students will also learn how to recognize mobility and prisoner vehicles and execute the best procedures to safely and efficiently extricate their occupants.

East Whittier Lions Club hosts Christmas party for local students In December, 55 students from East Whittier City School District filed into the ballroom at the Radisson Hotel to attend the East Whittier Lions Club annual Children’s Christmas Party. Sam Defeo, the Club’s Tail Twister, has been chairing the event for over 20 years and the Club has been hosting this event for over 40 years. The students were from elementary schools including Orchard Dale, Mulberry, Evergreen, Laurel and La Colima. According to Irene Yoshioka of Evergreen School, all the students attending are special education students with autism, dyslexia or other learning challenges.

Students were treated to a pancake/ waffle breakfast buffet followed by singing of Christmas carols and “The Night

Bear Before Christmas” puppet show presented by Tait Hill of Jim Gamble Puppet Productions. St. Nicholas also made an appearance giving stockings filled with goodies, a coloring book and a stuffed toy to each student. The cost of the annual event is covered almost in full by Club members. Thank you to the Radisson Hotel for providing the ballroom.

Rio Hondo Symphony celebrates 80 th birthday The Rio Hondo Symphony will celebrate its 80th year of free concerts at a special 80th Birthday Dinner Gala at 6 p.m. on Saturday, March 16 in the A.J. Villalobos Hall on the Whittier College campus. The celebration will include a gourmet dinner catered by Bon Appetit, special live music, a live auction and more. The theme will be the 1920’s and the event will be a semi-formal affair, with 20’s-inspired clothing optional. Among the many live auction items will be a $3,000 mini vacation trip for two to Montana with lodging in a historic home. Other auction opportunities will include short trips, gourmet dining experiences and more.

In addition to a celebration of the orchestra’s 80th milestone, the event will be the Symphony Association’s major fundraiser for the 2012-2013 seasons of four free concerts.

Local organization aims to prevent child homelessness Please join Pacific Western Bank, Rose Hills Memorial Park & Mortuary, PIH Health and Popular Community Bank in making a difference in the lives of homeless families. The Whole Child will hold its 43rd Annual The Heart of A Child Luncheon on Friday, February 8 from 10:30 a.m. to 2:30 p.m. at the Sheraton in Cerritos. Annually, the luncheon draws nearly 400 participants representing businesses, government (including the City of Whittier, the City of Santa Fe Springs and the City of Pico Rivera) and community-based organizations, as well as community members, who come together to support the important work of The Whole Child.

In the southeastern Los Angeles County there are currently over

1,000 families without housing. The devastation experienced by these homeless children is significant.

They have twice the rate of learning disabilities and three times the rate of emotional and behavioral problems of non-homeless children. Many families are forced to separate when they become homeless. Nationwide, approximately one-third of children in foster care have a homeless or unstable house parent. The Whole Child is working toward a solution with its Family Housing Program and you can help.
