DDA staff in attendance included Raphael Clemente, Teneka James, Shelly Williams, Samantha Moore, Catherine Ast, Michelle Barascout, Sherryl Muriente, Tiffany Faublas, and Max Lohman Esq. (Lohman Law Group). CALL TO ORDER Chairman Sanders called the meeting to order at 9:06 a.m.

PUBLIC COMMENTS No public comments.

PRESENTATIONS Banyan Boulevard Reconstruction Representatives from The City of West Palm Beach, consultants from WGI, and contractors from Whiting Turner presented the plans for the upcoming Banyan Boulevard Streetscape Improvements Project.

Phase 1 of construction will commence next month and will be from Australian Avenue to Quadrille Blvd expected to complete 2022. Phase 2 of construction will be from Quadrille Blvd to Flagler Drive and expected to be completed in 2023. There will be at least one lane of both eastbound and west bound traffic maintained throughout construction. Goals of the reconstruction project include improved infrastructure, drainage and lighting, enhanced mid-block crossing, crosswalks, and intersections, new trees and shrubs, and pedestrian and bicycle lanes. The Project hotline number is 1-877-810-3044.

Marketing/PR Update Faublas provided an overview of Marketing efforts, focusing on response to COVID-19. She shared images of the online campaign created “While we’re apart … You’re Still in our heart” and a dedicated webpage for all official updates related to COVID – 19. It also includes all open downtown businesses and for entertainment coloring pages of downtown landscapes and free Zoom Downtown West Palm Beach backgrounds the marketing team created. Faublas presented highlights from the new virtual series’ Saturday soiree and Downtown Coffee break and invited the board to attend.

CONSENT CALENDAR Minutes of Regular Board Meeting of March 25, 2020 Board Action: Reikenis made a motion to approve the Minutes of March 25, 2020 Regular Board Meeting. Jacobson seconded the motion. The motion passed unanimously.

Financial Statements of March 31, 2020 Board Action: Reikenis made a motion to approve the Financial Statements of March 31, 2020. Jacobson seconded the motion. The motion passed unanimously.

OLD BUSINESS Interlocal Agreement Funding of Police Lieutenant Clemente reviewed the proposed Interlocal Agreement between the City of West Palm Beach and the DDA defining responsibilities and outcomes of the Entertainment District Command Lieutenant position that will be funded this year by an allocation from the DDA’s budget with the board.

Staff seeks board approval to execute this agreement.

Lohman suggested edits to section 3.1 to state DDA agrees to provide funding of $100,000 toward the employment of an additional police lieutenant position to work exclusivity in the Downtown Entertainment District. As well as section 5.1 the addition of the following sentence, Expenditure of the funds provided by the DDA shall be exclusively limited to the purposes set forth in this agreement.

The Board discussed whether holding the funding of the position until stakeholders are reopened, and fully operating would be beneficial. The Board reiterated previous discussions that this is to be the DDA’s final investment dedicated to the Downtown Lieutenant position.

Board Action: Reikenis made a motion to accept changes to the Interlocal Agreement and direct Clemente to discuss with Mayor and Police Chief if funds should be expensed now or held. Hurley Lane seconded the motion. The motion passed unanimously.

COVID – 19 Economic Development Recovery Assistance Program Update The business assistance loan program that has been established with Valley National Bank’s Community Development Financial Institution (CDFI) to provide short-term micro-loans to small businesses impacted by the pandemic has received dozens of applications to date. These applications are in the process of being approved and funds will be disbursed to those businesses that have been approved. Within the Downtown District, at the time of this memo, there are 15 applications. Staff has identified an additional $100,000 within our budget that can be reallocated to provide much needed funding for the COVID-19 business assistance program. Staff is requesting board approval to reallocate these funds for use in the business assistance loan program. As with the initial $50,000 allocation, these funds are restricted for the use of businesses within the DDA district. Clemente and Roog shared an example of an application in progress.

Board Action: Reikenis made a motion to approve allocating an additional $100,000 to the COVID – 19 Economic Development Recovery Assistance Program.

Shabazz seconded the motion. The motion passed unanimously.

Clematis Streetscape Update Due to time restraints, The Clematis Streetscape update was moved to the next DDA Board Meeting.

NEW BUSINESS Carryforwards Resolution No. 04-2020 As we wrap up the annual audit process, remaining funding from Fiscal Year 2018/2019 will be brought forward by Resolution No. 04-2019 as attached. This resolution will also reallocate funding to meet operational needs for the remainder of the year as described below.

The overall CRA budgeted carryforward is increased by $1,370,375 which will be allocated to the following line items to cover programing in the following line items.

Within the DDA District, as with any urban environment, restaurants are a critical element of the business mix, street life, and appeal of the place. Perception surveys consistently find that patrons who visit Downtown rank restaurants at or near the top of reasons that they visit downtown. For residents and non-restaurant businesses owners and their employees, restaurants contribute greatly to the quality of place and quality of life in Downtown and are a key reason that non-restaurant businesses choose to locate Downtown. For these reasons restaurants have been a targeted industry for the DDA’s business development and support programs for many years.

The business shutdown in response to the Coronavirus Pandemic has hit all business sectors hard, including restaurants and cafes. Revenues for restaurants that have remained open for takeout and delivery are down between 70% and 90% from normal. Many have closed and remain closed because it is not possible for them to generate enough revenue with takeout only or at significantly reduced occupancy levels. With reliable forecasts that the requirement for reduced occupancy will continue for an extended period, there is great concern that many restaurants will not be able to survive financially and will close permanently.

To help respond to this crisis, the DDA has created a program to assist restaurateurs as they reopen their businesses at the mandated reduced capacity of 25% occupancy. In response to this challenge, staff has worked hand in hand with business owners, City officials, and others to develop a simple plan to increase dining capacity by creating outdoor dining areas in locations adjacent to or nearby restaurant locations. The program is effectively a temporary extension of premises to allow for expanded dining capacity and increased business revenues.

The plan relies on the use of rented seating set on a grid to accommodate spacing requirements, a management and cleaning plan, and careful coordination with restaurant managers.

Due to the urgent need to support local businesses as quickly as possible, staff worked on a compressed timeline to coordinate with City officials, obtain quotes for rentals and other necessary services, and to establish protocols for operation. A presentation detailing these elements of the program is included with this memo and will be discussed during the board meeting.

The costs for the rental of equipment, staffing, and miscellaneous items associated with this program as it is currently planned are approximately $45,000 per month. Staff is requesting board approval to allocate funding not to exceed $125,000 for the operations of this program for up to 2 months.

Projected costs include equipment rentals, additional staffing to clean and manage dining areas, signage, and other miscellaneous costs.

PROGRAM OVERVIEW The Business Incentive Grant program offered by the West Palm Beach Downtown Development Authority (DDA) provides funding to new businesses or existing businesses within the DDA District to assist with significant, permanent modifications to existing Downtown buildings. Through this program, the DDA encourages major tenant improvements necessary for successful tenancy of commercial spaces. The goal of this program is to attract the desired mix of uses to the Downtown and assist with the rehabilitation of commercial properties.

INCENTIVE BOUNDARIES West Palm Beach Downtown Development Authority District Retail businesses in ground floor level of residential condominiums in the area between Datura Street, Evernia Street, Fern Street, from Quadrille Boulevard (east of the FEC railroad tracks) to Flagler Drive (Includes properties adjacent to both sides of listed streets) - Maximum allowable amount not to exceed $10,000 GRANT DETAILS Up to 25% of Total Improvement Cost for Leasehold Improvements (must stay with building) Maximum allowable amount not to exceed $50,000 (Incentive Boundary)

If awarded a Business Incentive program grant the reimbursement terms are: 100% paid upon completion of qualifying leasehold improvements (as determined by City of West Palm Beach officials), proof of paid invoices for the improvements and Business Tax Receipt occupies the space and opens for business.

The Business Incentive Committee met on Monday, May 11, 2020 to review two (2) business incentive grant applications.

Grant Program Overview

The Downtown Development Authority (DDA) and Community Redevelopment Agency (CRA) entered an interlocal agreement in 2006 that addressed our Incentive grant process. The DDA and CRA agreed to phase out Business Incentive and Large Project grant programs in 2014.

In 2017 the CRA and DDA worked closely on reestablishing the grants program focused on business recruitment in Downtown West Palm Beach. Due to the current circumstances, we would like to review our current programs and discuss options post COVID-19 to better assist the business community.

Since FY 2011, the DDA has provided more than $1.4 million in incentives to property owners and businesses in the DDA district.

Staff will be presenting information on the DDA’s incentive programs.
