Cook County State’s Attorney says she and her office are ‘widely misunderstood,’

Cook County State’s Attorney Kim Foxx visited Maywood to set the record straight about the role and responsibilities of her office, which she said are widely misunderstood, and to explain her position on charged issues like cash bail reform, which goes into effect on Jan. 1.

“People have had conversations about our justice system and some people are knowingly wrong, and some people just don’t know,” Foxx said during a community conversation held Dec. 13 at PLCCA, 411 Madison St. in Maywood.

“If you watch the news, you will see an incident has happened and usually they end with saying, ‘No arrests have yet been made,’” Foxx said. “People seem to believe that every time an incident occurs, there’s an arrest, and it then comes to our office.”

Foxx said her office does not investigate crimes once they occur; instead, they only get involved once police officers make an arrest on a felony charge. A felony is a crime for which

Candidates for local elementary and high school districts had until Dec. 19 to file their nominating petitions with the Cook County Clerk’s office. Although people still have until Dec. 27 to file objections to nominating petitions,

District 88 serves six suburbs, including Bellwood, Broadview, Hillside, Maywood, Melrose Park and Stone Park Three seats are open on the District 88 Board of Education. All three incumbents whose terms are up have filed to run for reelection: Board President Sondra McClendon, Madalyn Ar redondo and board Vice-President Lindsley Griffin.

Berkeley School District 87 District 87 serves six suburbs, including Bellwood, Berkeley, Hillside, Melrose Park, Northlake and Stone Park. Four seats are open on the District 87 Board of Education. Three incumbents have filed to run: Bellwood resident and current board President Calvin Hightower, Northlake resident Nancy Mora and Bellwood resident and current board Vice-President Carlos G. Chave z.

Still, Foxx said, contrary to speculation about her of fice being lax on crime and criminals, the overwhelming majority of felony ar rests are approved by the Felony Review Unit.

According to the State’s Attor ney’s Felony Dashboard, of the 7,787 cases presented to the Felony Review Unit for initiation in 2022, 5,349 were approved, 857 were rejected and 633 were continued for investigation.

“When we reject a case, it is not because of some theory we have that we want people to go out and har m folks,” Foxx said. “We want to charge cases where they’re appropriate and for the most part, we do.”

Foxx also cleared up misconceptions about her of fice’s authority in detaining suspects She said judges have that authority, not the State’s Attor ney’s of fice.

“A judge makes a deter mination as to whether or not someone is held in custody or not,” she said. “Now listen here. Do you know how many times I have heard, ‘Kim Foxx has let people out of jail’? I don’t have the power to let anyone out of jail. That is not a deter mination that the State’s Attor ney’s of fice makes.”

Foxx said Illinois currently has the lowest thresholds for felony shoplifting in the country. In Wisconsin, the threshold is $2,000 worth of merchandise stolen and in Indiana it’s $750. In Illinois, however, it’s $300.

“I’m not condoning stealing but something is fundamentally wrong [when] our prosecutors are spending more time going after shoplifting than after guns,” she said, adding that 2016 was “the bloodiest year since 1999,” with “somewhere around 900” homicides in Cook County, the second-largest county in the country.

“The number one referred prosecution to our of fice Felony Review Unit wasn’t guns or murder — it was shoplifting,” Foxx said. “Seventy percent of the people in our jail in 2016 were there for nonviolent of fenses they couldn’t af ford their bond.”

When bail reform takes ef fect on Jan. 1, Foxx said, if “you’re charged with murder or a violent of fense, you can’t write a check and get out. We now have to say you have to be held. There is no amount of money you can post to get out. You are a danger to the public and your danger won’t go away just because somebody said to give me $1 million. That’s what’s changing.”

“With the rise of violent crime, people have been given bail amounts for having a gun or having shot a gun, and they ’re able to pay that amount,” she said. “So what judges have done is say, ‘If they’re going to get out, I want to put a bracelet on their ankle.’ So we see this large population of people on electronic monitoring because we have a system in place right now for some folks we could not detain in jail These are complicated things [and] I think we have a moral responsibility in law enforcement to tell the truth.”

Foxx also said she’s not anti-police, contrary to what some people may claim. She said her office relies on police officers to be credible to secure convictions.

“Why would it behoove me to tear you down? Make it make sense The reason I talk about those of ficers who have defiled the badge These are of ficers whom the courts have said are not credible I don’t just randomly [pick on officers] …

“The breakdown between community and the police is real, and if I, as the State’s Attor ney, don’t acknowledge that, I can’t expect you to come into my courthouse and just say, ‘Trust me.’ Not in Cook County, not when we have led the country for the last four years in wrongful convictions

Karen Mansfield, a retired labor attor ney, had never taken an art class before stepping inside of Maywood artist Jesse Howard’s drawing class at the Oak Park Art League several years ago.

“I had absolutely no talent and I really had to push myself, but it’s something I wanted to conquer,” Mansfield said. “And I stuck with it. It’s a challenge.”

The fruit of Mansfield’s artistic labor, along with the work of several other advanced students who have taken Howard’s class over the years, is on display in “Mark Making With Piccolo,” an exhibition that runs through Jan. 7 in the second-floor Main Gallery at the Oak Park Public Library, 834 Lake St.

“He looked so poignant and I thought about what may have been going through his mind,” Mansfield said during the exhibition’s opening reception on Dec. 17. “Probably, ‘It should’ve been me.’”

All of the pieces on display are homework assignments that the students drew for Howard’s class The pieces are all cases in mark making (the “lines, dots, marks, patter ns and textures that artists use,” according to the Tate Moder n) and piccolo, which refers to a “pop of color or an item that stands out in a composition,” according to a description on the library’s website.

For instance, in the case of Mansfield’s drawing, Ber nie’s brown knitted mittens comprise the piccolo, which draws the viewer’s attention to Mansfield’s humorous rif f on the original photo. In her drawing, the Democratic Socialist is knitting his own hand-war mers.

“When you look at the show, we try to have dif ferent social issues and a little still

life,” said Howard, who is an accomplished artist himself. “When we put the pieces together, we wanted them to contrast one another.”

John Dames, another Howard student, displayed a drawing of pillows next to a drawing of “highway trash with a butterfly,” Dames said. The drawing came about when Howard told the class to go out and draw something from the expressway.

“I don’t tell them what to draw,” Howard said. “They have to solve that themselves.”

Dames said the class has been life-changing for him. Howard said he hopes more people from the Proviso Township area take advantage of his life-changing course. The next sessions start in January.

“I have lear ned so much from this man, I get choked up, because it’s spiritual, it’s enlightening, it’s encouraging, it’s growth,

its compassion, it’s love,” he said. “And the critiques You lear n so much from those critiques It’s such a wonderful educational experience. It’s a high.”

Broadview gets $300K to fight storm water collection

The Village of Broadview recently announced that it received a $300,000 grant to alleviate stor m water collection in the principal parking lot of Village Hall, 2350 S. 25th Ave. in Broadview.

Broadview Public Works Director Matthew Ames made the announcement during a re gular village board meeting on Dec. 19.

“We applied to the Metropolitan Water Reclamation District six months ago for the grant, and lear ned today that we would receive $300,000 to alleviate stor m water collection in the village parking lot,” said Ames “The $300,000 should cover about two-thirds of the cost of the project.”

Mayor Katrina Thompson, who noted that Broadview had sought $362,000 from the Metropolitan Water Reclamation District, said the project aligns with the

village’s broader green infrastructure strategy to fight climate change.

“We work hard in the environmental space and seek to invest in green infrastructure projects to reduce the expensive and har mful consequences of climate change in Broadview, and fighting stor ming collection is part of our strategy,” said Thompson. “In addition to alleviating stor m water collection, we are also investing in solar panels and electric vehicle charging stations so that Broadview can be a 21st Century community and draw new businesses and residents to the community.”

Ames explained that the project would allow the stor m water to be absorbed into the ground of the park lot rather than running of f and flooding sur rounding property or collecting in the lot.

The village expects the project to be gin in the Summer/Fall 2023.

Maywood appoints members to new Cannabis and Tobacco Commission,

Maywood’s ac ting manager sixmonth gets extension

approved a six-month contract extension for Acting Village Manager James Krischke. The board voted on the contract, which would be from Dec 31 through June 30, 2023, at a re gular meeting on Dec. 6. The village board is currently searching for a new per manent manager after ter minating for mer manager Chasity Wells-Ar mstrong, who was fired over the summer after a third-par ty investigation found that she had created a hostile workplace, among other alle gations. WellsAr mstrong was hire in 2021 in lieu of a for mal search based on the strong urging of Mayor Nathaniel George Booker After her ter mination, the board voted to conduct a national search for Wells-Ar mstrong’s per manent successor.

Closed Harlem/North Sears site to get $100M me dical facility

Redevelopment plans on the site of a for mer West Side Sears store and other nearby vacant land have expanded to include a 62,000-square-foot medical facility that eerily fits the description of Rush University Medical Center. Developers and city of ficials attended a virtual meeting about the redevelopment project organized by Ald. Chris Taliafer ro (29th) on Dec. 14.

Residents have waited years for the now-demolished Sears at North and Harlem avenues to be replaced with new development. Plans for a mixed-use development fell through in 2020, and of ficials at the time promised a grocery store was coming. The pandemic has slowed down the project, however.

During the meeting, the developers of the property and two adjacent sites said a yet-to-be-finalized grocery store is still coming, and shared details of a medical facility that was first announced in Aug. 30.

Ald. Taliafer ro and executives with Novak Construction, which owns the North and Harlem site, declined to share the name of the medical tenant. They said the tenant will be revealed with the next three months once that entity gets the necessary state approvals

John Novak, CEO of Novak Construction, said during the meeting that the medical facility could cost up to $100 million and be done by late 2024.

The grocery store and a residential area with 125 apartments and 25 townhomes would be built nearby at Neva and Wabansia avenues, with construction set to be gin next summer.

Taliafer ro and Novak representatives said the hospital and the other projects represent new community development and investment.

“I want to build something that we’re going to be proud of,” Novak said. “I think this is going to set the stage for our work on the West Side and bring a lot of value to the community.”

The proposed medical building would stand three stories and 60 feet tall and have 300 parking spaces It would provide same-day appointments and services such as X-rays, MRIs, mammograms and ultrasounds. It stops short of being a fully realized hospital, however, as it would not provide surgeries, 24-hour care, or beds for over night stays.

“Our goal was to design a building that was an asset for many years,” said Jake Paschen, senior vice president of Novak Construction. “We wanted to get highprofile healthcare to the community, to of fer quick and convenient care. We believe it was worth it to get this healthcare provider and they will be a tremendous asset to the community.”

Pascen declined to share any details about the medical building’s operator, saying only that the organization has been around for 180 years, has a well-known

teaching hospital and is “a hospital that you know well.” The description would fit the Rush University Medical Center.

When reached for comment, a Rush spokesperson neither confir med nor denied the speculation that their institution was considering locating to the cor ner of North and Harlem.

Rush, he said, is “regularly evaluating opportunities for collaboration and clinical space, but we do not speak to any such ventures until the timing is appropriate. Par tnership opportunities and new care sites are thoroughly evaluated with an overarching goal of making it more convenient for people living and working in the re gion to receive the most coordinated, advanced health care available.”

When Sears closed, the property was owned by Seritage Growth Holdings, Sears’ real estate ar m. Seritage eventually spun of f into a separate company and hired Tucker Development, which decided to pursue a mixed-use development on the site that would incorporate the refurbished store building and apartments on the east parking lot. In September 2020, Seritage

Bringing the grocery store to the site has been Taliafer ro’s priority since the Sears closed and a grocery store was once part of Tucker’s proposal. But during his Aug. 30 community meeting, the alder man said that, while Jewel-Osco expressed strong interest, Novak decided to go with a medical tenant. During the Dec 14 meeting, Pascen said that Novak has had “several extensive discussions” with grocery tenants that eventually fell through before noting that the fir m is still actively looking for a grocery store tenant. He declined to say whether or not they were still in ne gotiations with Jewel-Osco.

The vacant lots sit on the wester n edge of the city between Austin’s Galewood neighborhood and the intersection of suburban River Forest, Oak Park and Elmwood Park Neighbors were largely receptive to the changes being made, with one resident welcoming the hospital. He said lack of healthcare access would force him to often go to Northbrook for treatment.

“That area has been an eyesore so I’m glad that something is finally being done with it,” J. Bosco said. “I’m really excited for this; it will be a great addition to the community.

One resident, Charley Nelson, told Block Club he’s concer ned about traf fic coming from busy North Avenue. Nonetheless, he believes it is a net positive for the area.

“There’s so much potential for the Nor th Ave. cor ridor and I hope that the Sears site can be a catalyst for the whole cor ridor’s development and livability,” Nelson said.

Steve Green, chair of the Galewood Neighbors community organization’s board of directors, said he was pleased with the way Novak responded to residents concer n about site cleanliness

“It’s nice to see something coming to fruition,” he said. “It’s a beautiful building.”

Judith Alexander, the chair of The North Avenue District business development organization, said that she has no issue with the proposal, and that she wants to the make sure that any development is pedestrian-friendly and aesthetically pleasing.

“Whatever fronts North Avenue, please don’t make it a blank wall,” she said.

New pandemic-era emergency housing now faces a fiscal cliff

Advocates are calling on the state to fund noncongregate hotel room shelters

SPRINGFIELD – For Illinois’ homeless populations and those that serve them, the COVID-19 pandemic accelerated a crisis –the volunteer, mostly faith-based shelters that had long been the backbone of the state’s emergency housing system were closing their doors.

But with the crisis – and a sudden influx of temporary federal, state and philanthropic funding – came an opportunity to move away from an already-stressed emergency housing system to what advocates say is a more dignified and ef fective one

Those same advocates, however, say the new system, largely based on using gover nment vouchers to fund private hotel rooms, is on the edge of a fiscal clif f as federal COVID-19 response funding dries up.

It’s a pressing issue, more than 220 housing advocacy organizations wrote to Gov. JB Pritzker this week, because Illinois is already about 4,500 beds short of the 11,300 it needs to accommodate all individuals seeking shelter on a given night, according to a recent report to a state homelessness task force.

“Without a significant increase in state funding, the severe shelter shortage will worsen,” the advocates wrote in the letter dated Dec 21, coinciding with the first day of winter “(Illinois Shelter Alliance) members estimate that at least 1,600 existing shelter beds could be lost during 2023 due to federal COVD-19 relief funds, mostly being spent on hotel vouchers, being fully expended.”

The Illinois Shelter Alliance is a coalition of more than 50 emergency and transitional housing organizations from throughout Illinois that have organized to push for increased state emergency housing investment.

The ask for the upcoming fiscal year which be gins July 1 is a $51 million, sixfold increase to a long-stagnant emergency housing line item to sustain the new system

It’s increasingly important, the letter noted, as Alliance members reported up to 76 percent of the churches and other facilities that have provided cong re gate shelters previously are unable or unwilling to resume doing so due to closures, declining membership and COVID-19 concer ns

“So, pre-pandemic, the shelter model was people survive the winter because churches let them sleep on the floor,” Doug Kenshol, executive director of the emergency housing organization South Suburban PADS, one of the signers of the letter, said in a phone call.

The pandemic, he said, changed things “almost over night.”

Providers rallied to raise the funds for hotel rooms before federal aid was provided in late March 2020 via the Coronavirus Aid, Relief, and Economic Security, or CARES Act. Federal allotments have largely sustained the new model since that point.

“The current model has been so much better than what came before,” Kenshol said. “Now that we have people in hotel rooms, it’s more dignified. They have privacy, they have stability, safety They’ve got a locked door. They can take showers.”

Kenshol, who is also a founding member of the ISA, said while the pandemic has represented a breaking point, the old system was always inadequate and underfunded.

Since Fiscal Year 2003, state funding stagnated at about $10 million annually, a number that, factoring in inflation, amounted to a 50 percent cut over that span, advocates wrote. It amounts to just 6 percent of the funding that would be needed to make sure that all who need it have shelter

Kenshol illustrated the ef fects of disinvestment on human ter ms, recalling an individual who was dropped of f by ambulance at a suburban shelter in the years prior to the pandemic. The person had been out in the cold, experienced frostbite and had all his fingers amputated.

“And then the individual was dumped of f at a shelter, a place with no professional staf fing. A place operated entirely by volunteers,” Kenshol said. “This person could not feed himself or bathe himself and he was being dropped of f at the church for shelter.”

As federal funds dry up, he said, the emergency housing system could end up in worse shape than it was prior to the pandemic if more funds are not made available.

“And so we’ve been in a panic at various points during the last two years that funding is ending and we have no other option, that we’ ll hit a clif f and everybody is just going to be put out into the street,” he said.

The requested increase would bring state emergency and transitional housing funding to $61.4 million, up from a $10.4 million allotment that’s been relatively static for years.

Of that, $20 million would sustain 1,600 beds which advocates say are in danger of disappearing. Roughly $29 million would go toward increasing the number of emergency shelter beds by 1,500, leasing approximately 1,000 apartments to rapidly rehouse families, and increasing the number of available hotel vouchers by more than 500.

About $2 million of the budget request would be used to help agencies with employee recruitment and retention, including hiring staf f to work with people to find alter natives to going to a homeless shelter.

But it’s also part of a broader long-ter m vision that, in the coming years, could add as many as 3,000 beds.

The ISA members noted that while the federal hotel voucher funds are drying up, state agencies will soon make available another $57 million in federal funding allocated specifically for the purchase or renovation of sites to serve as fixed-site and non-cong re gate shelter. Many local gover nments are also providing capital development funds from their federal allocations

While this creates a “once-in-a-generation opportunity to build a more humane and ef fective crisis housing system” with federal resources, the advocates wrote, state funding is “crucial” to providing the ongoing operational funding for the new system.

Thus, a large part of the money used for vouchers in the upcoming fiscal year could be used in later years to fund the providerrun shelters that are created with the federal funds

Kenshol said for organizations like South Suburban PADS – which is looking to

purchase up to two hotels and potentially an apartment building – the state funding is necessary for it to be able to demonstrate fiscal solvency on its applications for federal funding.

The Pritzker administration has acknowledged the importance of providing such shelter, both in a June housing report, entitled “Home Illinois,” and through a recent Dec. 8 announcement that the Department of Human Services was increasing cur rent-year emergency housing appropriation by $5 million through a redistribution of funds already allocated to IDHS.

“I’ve said it before and I’ ll say it again: shelter is not a privilege — it’s a right,” Pritzker said in a news release coinciding with the recent funding announcement.

“With the winter season well underway and snowy days on our horizon, we are investing $5 million to ensure that no Illinoisan goes without the shelter they need to stay war m, safe, and healthy.”

A spokesperson for Pritzker said he and IDHS “look forward to working with advocates to ensure sustained investments in these critical programs in the years to come.” He noted that the current-year IDHS budget included an additional $15 million for homeless prevention programs, including the recent $5 million increase.

In their letter, the advocates thanked the Pritzker administration for its focus on ending homelessness Increasing emergency housing capacity, they said, is the most important next step to getting there.

“We and others will do everything we can do to make sure the State of Illinois does create enough af fordable housing that will end homelessness, but, even under the best circumstances, that will take a number of years,” Bob Palmer, an ISA member and policy director for Housing Action Illinois, said in an email. “Right now, we have to have a much more well-resourced emergency shelter system, especially not to go backwards in ter ms of serving people who are without a home today.”

Lindop School District 92

Four seats are open on the District 92 Board of Education. All four incumbents whose terms are up have filed to run for reelection: board President Shryl Griffin, board Vice-President Aaron Hannah, Brian Dawson and new member Jeanine Alexander. Gregory Buchanan, of Broadview, is the only non-incumbent candidate in the field.

Mannheim School District 83

District 83 serves four suburbs, including Franklin Park, Melrose Park and Northlake. Five seats are open on the District 83 Board of Education. Four incumbents whose terms are up have filed to run for reelection: Melrose Park resident and board President Marianne Anderson, Northlake resident Lyvette Jones, Melrose Park resident Maribel Ayala and Northlake resident Magdalena Kalinowski. Franklin Park resident Pascuala Her rera is also running. Board member Sandra Mich, whose term is also up, has not filed to run for reelection.

Maywood-Melrose Park-Broadview District 89

District 89 serves the suburbs of Broadview, Maywood and Melrose Park. Four seats are open on the District 89

Board of Education. Three incumbents whose seats are contested have filed to run for reelection: Melrose Park resident Jesse Macias, Maywood resident Oscar Giron and Maywood resident Kasharii J. Parker. Shakeesta Williams, of Maywood, is the only non-incumbent in the field. Current D89 board President and Maywood Clerk Gwaine Dianne-Williams, whose term will expire next year, has not filed to run for reelection.

Westchester District School District 92.5

District 92.5 serves Westchester primarily. Four seats are open on the District 92.5 Board of Education. Two incumbents are running: Rose Marie Ortiz and Stephanie Boyd. Non-incumbents Cynthia Peranich, Jerrid M. Neal and TiShaunda McPherson are also running. Board President Bryan Voegtle and board Secretary Molly Quiroz, whose terms are up next year, have not filed to run for reelection.

Proviso Township High School District 209

District 209 draws students from 10 feeder communities in the Proviso Township area, including Bellwood, Berkeley, Broadview, Hillside, Maywood, Melrose Park, Northlake, Stone Park and Westchester. Three seats are open on the District 209 Board of Education.

Incumbent school board members Theresa Kelly of Maywood, and Claudia Medina of Forest Park, have filed to run for reelection, while Ned Wagner of Forest Park, will not seek reelection. All three candidates were on the first slate created by the Proviso Together party. Kelly, Medina and Wagner were elected together in 2015 and again in 2019.

Three more candidates with the newly for med Proviso 209 Cooperative have filed to run for board seats: Forest Park resident

Jennifer Wenzel Barbahen, Westchester resident David Ocampo and Westchester resident Sandra Lee Hixson. Three other candidates have also filed, although any organizational affiliations are currently unclear. They are Maribel Aguir re of Hillside, Jayda James of Hillside and Jon Kubricht of Forest Park

The high school race is likely to be the most contentious of all the school board races in the Proviso area.

Earlier this year, the Proviso Together party dissolved, months after relationships between some party members had fractured, with tensions often spilling out into the open during board meetings.

The April election could be a referendum on the performance of D209 Supt. James Henderson, who was hired in 2020. The board has since given the superintendent two 5-year contracts, with Kelly joining board majorities in voting for both of them. Medina has voted against the contracts.

Since his hiring, Henderson has overseen a nearly month-long teacher strike, a mass exodus of veteran teachers and staf f, complaints about a lack of financial transparency, alle gations of intimidation among current and for mer employees, and widespread frustration with his leadership style.

In an interview earlier this year, Barbahen and Kathleen Franzwa, the cofounders of Proviso 209 Cooperative, said they started the group, which might be considered a successor to Proviso Together, to hold Henderson accountable.
