Supreme Court of Canada allows Appeal brought by Dairn Shane, and Rules in Favour of Compensation for Mental Injuries

On June 2nd 2017 the Supreme Court of Canada accepted the argument of Dairn Shane, and held that mental injuries are to be proved and compensated in the same manner as physical injuries.

That ended almost seven weeks of shameless maneuvers by Premier Christy Clark who disgraced herself

like no other premier could have as she tried every trick in the book to hang on desperately to power instead of graciously stepping down and allowing the NDP that had the backing of the Green Party MLAs to form the next government.

She even stooped so low as to advise the Lieutenant Governor to dissolve the House, but Guichon saw through her dirty politics and rejected her advice. Instead, she called Horgan and asked him to form a government.

ANEIL Sanghera, 28, of Richmond was arrested on Wednesday and charged with manslaughter in the death of Pardeep “Terry” Dulay, 41, of Richmond.

Detectives from the Vancouver Police’s Major Crime Section made the arrest following an investigation into Dulay’s death at a wedding celebration in mid-April.

Around 11:30 p.m. on April 15, police and the BC Ambulance Service were called to Fraserview Hall in South Vancouver after Dulay was found dead by party guests.

It originally appeared that Dulay had died of natural causes, but information collected at the scene showed the victim had been involved in a physical altercation just before his death.

This is Vancouver’s tenth homicide of 2017.

Police said that no additional information can be provided at this time as the matter is before the courts.

Then there are Jinny Sims (Surrey-Panorama) and Jagrup Brar (Surrey-Fleetwood) in the second tier.

Finally there are the rookies: Rachna Singh (Surrey-Green Timbers) and Ravi Kahlon (delta North).

Meanwhile, don’t expect Clark to stop her vicious scheming against the NDP because if the NDP stay in power for a few months, the knives will be out for Clark in the Liberal Party. Many Liberal MLAs are just waiting for an opportunity to kick her out.

And even if another election may be necessary in a few months, there is no guarantee whatsoever that the Liberals will win a majority.

What a slap in loser Christy Clark’s face as Lieutenant Governor asks John Horgan to form a government!

CHRISTY Clark used every dirty trick in the book to shamelessly cling on to power, bringing utter disgrace upon herself and the B.C. Liberal Party.

Every day, her cunning nature became more and more twisted, baffling decent British Columbians.

But she didn’t flinch.

She was hell-bent on causing chaos because of her naked political ambition.

And she has cost us taxpayers big bucks – but she couldn’t give a rat’s ass, could she?

Not a shred of decency!

Not a modicum of humility!

Not an iota of graciousness!

Not a grain of repentance!

After the election result was out, Clark should have taken full responsibility for the B.C. Liberals’ humiliating defeat and offered to step down from the party leadership.

That would have won her a great deal of sympathy – and we would have praised her for her graciousness, her humility, her feisty spirit and her service (even though most people were angry with her for a variety of reasons).

But NO! She had to go down that nasty path where she ended up exposing herself left, right and center as a sore loser with no principles.

For crying out loud, Christy, how could you have so shamelessly stolen the NDP agenda just to survive!

How desperate was that!

Didn’t you and your poodle-in-chief Mike de Jong feel SOME shame about it?

Now history will condemn and mock you!

You have vitiated the political atmosphere in B.C. Who told you to do what you did?

The NDP noted: “Last week, Christy Clark delivered a desperate throne speech that lifted numerous policies directly from the B.C. NDP’s broadly popular platform.

“But during the campaign, the B.C. Liberals dispatched Mike de Jong to attack the financial implications of the B.C. NDP platform elements they now claim to support.

“Not only have the B.C. Liberals copied the “big ticket” items from the B.C. NDP platform, but they’ve refused to adopt the revenue measures designed to pay for them: modest tax hikes on profitable corporations and the richest two per cent.”

Then the NDP mentioned some of his quotes that put down the B.C. NDP platform during the campaign and asked: “Does he stand by his statements now that the B.C. Liberals

Abbotsford Police’s Gang Task Force arrests youth for trafficking drugs with fentanyl A 17-year-old male was taken into custody on Wednesday (June 28) and charged with two counts of trafficking in a controlled substance, and one count each of possession for the purpose of trafficking, dangerous operation of a motor vehicle, fail to stop for police and breach of undertaking.

The Abbotsford Police Department’s Gang Task Force attempted to pull over the male in his vehicle on Highway #11, however, the 17-year-old male failed to stop for the police, ran a red light and went into oncoming traffic at a high rate of speed attempting to evade the police. The male parked the vehicle and was arrested a short time later by police. Early indication is that the drugs seized contain fentanyl.

The identity of the accused is protected by the Youth Criminal Justice Act. This is the second arrest in the past two weeks of young people connected to the Lower Mainland Gang Conflict.

On June 21, Abbotsford Police had announced the arrest of Akshay Sachdeva, 18, who is associated to the Lower Mainland conflict. He was charged with four counts of possession for the purposes of trafficking in controlled substances (including fentanyl)

as a result of their investigation after they executed a search warrant at his home on June 7. He was on a recognizance of bail for a May 26 assault charge at the time of this arrest.

On June 14, Abbotsford Police arrested 18-year-old Inderdeep Minhas for failure to appear in court on charges connected to three firearms-related weapons offences and for obstructing a police officer.

Police, in an unusual move, released a photo of Minhas being arrested, apparently in a move to send a strong message to youth involved in the gang conflict and their families that such a lifestyle is not the best choice to make.

The mandate of the APD Gang Task Force is to specifically focus their efforts on individuals involved in the current Lower Mainland Gang Conflict and to improve public safety through targeted enforcement.

Two South Asians arrested for violent attack in Brampton JASHAN Sharma, 19, and Gurmail Sandhar, 46, both of Brampton, have been arrested for a violent attack in Brampton.

Ontario’s Peel Regional Police on Tuesday announced that the two males were arrested and charged in a violent assault that has left a 44-year-old Brampton man in hospital with serious injuries.

On Monday (June 27) at approximately 12:35 a.m., the two accused males, who were known to the victim, confronted him in a dispute over property on Oaklea Boulevard, near Ray Lawson Boulevard, in Brampton.

The victim attempted to run from the men

and they chased him to an area behind Pauline Vanier Catholic Elementary School. The men then tied the victim’s hands and proceeded to physically assault him by repeatedly punching him and striking him with a shoe.

Police were called to the area and located the victim behind the school, suffering from serious physical trauma. He was transported by ambulance to a trauma centre in Toronto, where he remains in critical condition.

Sharma and Sandhar were arrested at the scene and have been charged with aggravated assault and forcible confinement.

Two South Asian victims of Sunday’s shooting are associated to drug trade

SURREY RCMP Cpl. Scotty Schumann said on Monday that the two victims of the shooting on Sunday afternoon in the 15300-block of 86th Avenue in Fleetwood are known to police and are associated to the drug trade.

However, whether the shooting is related to the drug trade has yet to be determined.

One of the victims is a 24-year-old male from Vancouver and the other is a 23-year-old male from Surrey.

(Sources told The VOICE both victims are South Asians. However, the other two involved in the incident have yet to be identified.)

On June 25, at 3 p.m., police were alerted to the shooting. They found that multiple rounds had been fired from a firearm. The area was secured as the Surrey RCMP Serious Crime unit investigated the incident.

Approximately 30 minutes later, Surrey RCMP received a report that two males in their 20s attended a local area hospital with injuries consistent with being shot. Officers attended the hospital and determined that the injuries were non-life-threatening. Serious Crime investigators will be interviewing these males in relation to this incident.

CTV obtained surveillance video that shows a sedan driving off the road to avoid a truck from which two men with guns jump out and take aim at the sedan. Only one person appears to be shooting.

Police say that it is not possible to identify the shooter or shooters from that footage because of the poor resolution. They will be looking at traffic cameras as well.

A short time later on Sunday afternoon, Surrey RCMP received a report of a vehicle fire in Cloverdale. Police say that only after a forensic investigation will they be able to determine whether the vehicle was one of the two that were involved in the shooting. The vehicle

has been seized and will be processed for evidence related to the shooting.

“Shootings of any kind are a concern to both police and the community, however, a mid-day shooting in a quiet family neighbourhood displays disrespect coupled with a complete and utter callous disregard for

the safety of the community,” said Surrey RCMP Staff-Sgt. Dale Carr on Sunday.

Cpl. Schumann told The VOICE on Monday said that any kind of shooting in a neighbourhood is risky because you can have ricochets or bullets going off target. “And that is exactly what happened in this case.

COQUITLAM RCMP are asking for the public’s help in identifying a man who used pepper spray during a dispute with another driver.

On April 17, at about 7:15 p.m., occupants of two vehicles began arguing over who had the right of way near Lougheed Highway and Brunette Avenue in Coquitlam. The driver of one of the vehicles, described by witnesses as Asian or South Asian, in his late teens or early twenties, just under six feet tall and with a slim build, got out of the driver’s seat of a black Mercedes and used pepper spray on the occupants of a grey Kia. “There is no excuse for getting out of your vehicle and using a weapon against people in another vehicle,” says Cpl. Michael McLaughlin.

“Having said that, the initial dispute about who should yield to whom was totally preventable. If you can control your own actions, keep a cool head behind the wheel and avoid confrontations on the road, you will make things safer for everyone.”

Only 15% of B.C. residents wanted a new election. 55% wanted NDP and Green Party to form government AS the Legislative Assembly on Thursday prepared for a vote of confidence that would finally bring down the current provincial government in British Columbia, more than half of residents believed it was time to allow the BC New Democratic Party (NDP) and the BC Green Party to take over, a new Insights West poll found before the vote.

In the online survey of a representative provincial sample, more than half of British Columbians (55%) preferred to give the BC NDP and the BC Greens a chance to form a government. One-in-four (25%) said they would allow the BC Liberal government that was sworn in earlier in June to continue, while 15% said they would dissolve the Legislative Assembly and hold a new provincial election.

On June 22, the Government of British Columbia—formed by the BC Liberals—presented the Speech from the Throne. Twoin-five British Columbians (42%) claimed to have followed the speech and related media coverage “very closely” or “somewhat closely”.

The document incorporated specific policy proposals that were included in the platforms of opposition parties. At least three-in-four residents voiced support for banning union and corporate political donations (80%), naming a Minister of State for Mental Health, Addictions and Recovery (76%) and implementing new regulations on the activities of lobbyists (75%).

More than half of British Columbians were in favour of investing $1 billion in new child care spaces (63%) and holding a referendum on Electoral Reform (58%), while fewer supported eliminating all tolls on the Port Mann and Golden Ears bridges (46%) and carrying on with the construction of the Site C dam near Peace River (45%).

When asked about the commitment they expect from the BC Liberal government on each of these proposals, the numbers shifted drastically. Most British Columbians thought it was “very likely” or “somewhat likely” that the current government would carry on with Site C construction (72%) and name a Minis-

If a new election were held tomorrow, 41% of decided voters would cast a ballot for the BC NDP candidate in their riding. The BC Liberals were second with 36%, followed by the

Support for the BC Liberals was strongest among voters aged 55 and over (46%), while the BC New Democrats continued to dominate among voters aged 18-to-34 (49%). The Greens had their best numbers in Vancouver Island (30%, tied with the BC Liberals but six points behind the BC NDP).

A third of British Columbians (32%, -6 since the final Insights West provincial election poll conducted in May) approved of the performance of Premier and BC Liberals leader Christy Clark, while 63% disapproved (+5).

The rating improved for the two other party leaders, with the NDP’s John Horgan at 49% (+7) and the Greens’ Andrew Weaver at 50% (+4).

In the event a new provincial election would take place soon, 65% of British Columbians said they would be “very happy” or “somewhat happy” if the BC Liberals replaced Clark as leader of the party—including 53% of those who voted for the party last month.

The notion of the BC NDP and the BC Green Party agreeing to have only a “joint” candidate running in some constituencies would be welcomed by 43% of British Columbians,

Calgary Police said that on June 5, a female victim was contacted by a man she met online and agreed to meet him later that evening at a business located in the 2800 block of Sunridge Way N.E. At approximately 7:45 p.m., the man arrived to the business and immediately identified himself as a police officer and stated that he had search warrant for drugs. The woman asked for the man’s badge number, at which point the offender grabbed and pushed her and began yelling at her to stop resisting arrest.

The offender is believed to be the same man responsible for similar offences that occurred earlier this year, and is not a legitimate police officer.

In Ontario, the York Regional Police Special Victims Unit – Human Trafficking Team had announced last week that they had identified the suspect in a sexual assault that took place in the City of Vaughan and were seeking public assistance to locate him.

On Thursday, June 8, at approximately 8 p.m., the suspect met with an 18-year-old female escort after arranging a date at a hotel, in the area of Interchange Way and Highway 7. The suspect told the female that he was a police officer and showed a document claiming that he was executing a warrant.

He then sexually assaulted the victim and left with a quantity of currency.

They said that Asif Choudhry aka Brandon, 33, of Sechelt, British Columbia was charged with sex assault with a firearm, forcible confinement, robbery with a firearm, and impersonation of a police officer. He was considered armed and dangerous.

THE Independent Investigations Office of B.C., which is continuing its investigation into a fatal incident on Sunday, June 18 in Port Coquitlam, said on Monday that following an autopsy, it has been determined that the male’s death was not self-inflicted.

Initial reports made to the IIO on the evening of Sunday June 18 by the RCMP, suggested that a distraught male may have shot himself following an exchange of gunfire with police.

Witnesses reported the distraught male fired shots in the 2100-block of Audrey Drive in Port Coquitlam.

No other physical injuries were reported to members of the public or police as a result of the shots fired.

The IIO is also investigating serious injuries sustained by a male relative of the deceased in the following hours. This incident is being treated as a separate investigation.

For both of these investigations, the IIO’s focus is determining whether police actions were lawful, proportionate and reasonable, or if any offence may have been committed.

The IIO has interviewed approximately 30 witnesses and six police officers, and asks that any potential witnesses contact the IIO witness line at 1-855-446-8477.

Rohit Chokhani launches “Project SAT” (South Asian Theatre) PRODUCER, director and recipient of the 2017 Jessie Award for Significant Artistic Achievement (Large Theatre), Rohit Chokhani, on Tuesday announced the launch of Project SAT (South Asian Theatre) - an initiative aimed at creating a network for developing, touring, producing, and presenting national and international South Asian theatre projects in Canada.

“With Project SAT, I want to help train and educate the next generation of South Asian artists,” says Chokhani. “It’s important to me to be able to create opportunities and establish a new mainstream for them. This is unlike anything being offered anywhere else in B.C. and Canada.”

Project SAT kicks off in July at the new Jim Green House Studio with free workshops, which will focus on grant writing and how to pitch project ideas to presenters and producers. The Grant Writing workshop is scheduled for July 22 from 10 a.m. to 4 p.m. and the Pitch Presentation workshops are scheduled for July 22, 25, 26, and August 1 from 6 to 9 p.m.

These workshops will take a unique, culturally specific approach to training and will be tailored to those in the South Asian community who experience marginalization. Translators for Punjabi, Hindi, and ASL participants will be available upon request. Workshops on producing, playwriting, dramaturgy and Natya Shas-

Calgary joins Toronto, Ottawa and Montreal as the most likely cities to welcome visitors AS the country marks its 150th birthday, Canadians look at three destinations in the West as the most attractive places to visit, but three cities in the East and one in Alberta can expect to see more tourists in the next six months, a new Canada-wide Insights West poll has found.

Calgary the next six months, Toronto is the top choice for Canadians, with one third (34%) saying they intend to take an overnight leisure trip there.

Three other cities will be visited by at least one-in-five Canadian tourists before the end of the year: Ottawa (26%), Montreal (23%) and Calgary (21%).

“It is no surprise to see Toronto, Ottawa and Montreal leading the way when Canadians are asked where they will travel, especially this year,” says Mario Canseco, Vice President, Public Affairs, at Insights West. “Calgary has joined these three long-standing classic destinations in Ontario and Quebec as the most likely cities to welcome visitors.”

VISITING U.S. More than three-in-four Canadians (78%) say the declining Canadian dollar has had an impact on their travel plans, including 86% of Albertans, 84% of Quebecers, and 83% of those aged 18-to-34.

Three-in-five Canadians who say their travel plans have been impacted by the declining loonie (59%) plan to vacation in other areas of Canada instead of visiting the United States.

Across the country, 23% of Canadians say their household has been personally impacted by the current economic downturn. While the nationwide numbers are consistent with a similar survey conducted by Insights West last year, there are two areas that are having a tougher time with household finances: Alberta (50%, up eight points since 2016) and Manitoba and Saskatchewan (33%, up nine points since 2016).

One third of Canadians who have been personally affected by the economic downturn (33%) say they will still travel as planned, but spend less, while 21% have cancelled some of their travel plans.

Vancouver to mark Canada 150 with giant, record-breaking flag of Canada at a scale of 1 to 1,000,000. Organizers plan to have the flag recognized in the Guinness Book of World Records.

When it became a challenge to find a venue suitable for displaying such a large flag, local MP Don Davies stepped in and worked with the Vancouver Park Board to secure the Brockton Oval to display it.

“Canada Day is a time to reflect on our shared history and look forward to the future with hope and optimism,” said Davies.

“This initiative to create a colossal symbol

of our nation was something that we just had to support.

“I encourage Canadians and tourists alike to visit Stanley Park on Canada Day to see this record-breaking flag and wish Canada a happy 150th birthday!”

The flag will be available for public viewing all day July 1, at the Brockton Oval in Stanley Park, at 1151 Stanley Park Drive.

24-year-old Burnaby resident known to police shot BURNABY RCMP are investigating a shooting that occurred on Tuesday evening in the park behind Edmonds Community Centre, at Humphries Avenue and Elwell Street.

On June 27, at approximately 9 p.m., police responded to a report of a male being shot in the park near the basketball courts. The victim, a 24-year-old Burnaby resident, was transported to hospital with non-life threatening injuries and has since been released.

The investigation is still in its early stages; however, officers believe this is a targeted incident. The male victim is known to police.

Extra transit service on Canada Day TO make it easier for people to plan ahead and take transit around Metro Vancouver this Canada Day weekend, TransLink will provide extra service and extended hours for its customers.

HandyDART riders file human rights complaint against Premier Christy Clark and TransLink for inadequate service THE HandyDART Riders’ Alliance on Wednesday filed a class-action complaint with the

B.C. Human Rights Tribunal alleging discrimination in the form of inadequate HandyDART

service. The complaint alleges inferior transit service is provided to people with physical

and mental disabilities compared to people who can use conventional public transit.

“We are filing this complaint today because we want it to be clear that Christy Clark and the BC Liberal government are responsible for this discrimination people with disabilities have faced since 2009,” said HandyDART Riders’ Alliance Co-chair Beth McKellar who filed the complaint on behalf of all HandyDART riders. “We hope the Human Rights Commission will order future provincial governments to improve the quality of service and increase the HandyDART service hours provided by fully trained drivers in HandyDART buses.”

The complaint states: “People are being denied access to transit because they are unable to use conventional transit without assistance. Dignity & self-esteem are damaged. Safety is put at risk. People are being isolated from family, friends and community.” The complaint also notes that TransLink CEO Kevin Desmond stated that bringing HandyDART in-house to improve service quality would cost too much.

“People have been feeling imprisoned in their own homes for years as a result of this unjust treatment,” said HandyDART Riders’ Alliance board member Roseanne Shannon. “But this is not just for people who are disabled now, our population is aging rapidly and with that the number of people needing HandyDART will increase rapidly too.”

The complaint was filed against Clark, former TransLink Minister Peter Fassbender, and Minister of Transportation Todd Stone, along with TransLink and the US-based corporation TransLink contracts to run HandyDART.

Canada Day will end with a fantastic fireworks show along the historic Steveston waterfront.

Parking in Steveston is limited and there will be extensive road closures throughout the village all day on Canada Day. Festival goers are encouraged to take transit, cycle or walk to avoid traffic and parking congestion. A shuttle service will be available with schedule information available on the event website.

CBSA’s travel tips for the Canada Day long weekend THE Canada Border Services Agency (CBSA) advises travellers to prepare for a busy Canada Day long weekend at the border.

Last year, approximately 86,163 vehicles entered Canada through the five Lower Mainland border crossings during the Canada Day long weekend (June 30 to July 3, 2016).

The busiest crossings were the Douglas and Pacific Highway ports of entry (POE), which processed approximately 31,837 and 24,217 vehicles respectively.

The CBSA anticipates higher than normal traffic volumes; therefore, here are a few things you can do to make your cross-border trip a little easier: Plan ahead: Cross the border in the morning, especially if you plan to cross on a Sunday or Monday. The Douglas POE is the busiest land border crossing in British Columbia, and longer wait times begin building in the afternoon and carry on throughout the evening. Alternatively, travellers can return to Canada through nearby POEs like the ports of Aldergrove, AbbotsfordHuntingdon, Boundary Bay or Pacific Highway. For border wait times, download the mobile CanBorder app or visit the CBSA website.

Be prepared: Have your travel documents, proper identification for all persons in the vehicle, and receipts from purchases outside of Canada ready to present to the border services officer. Be ready to declare all goods purchased and/or received while outside the country.

Know your exemption limits: If you plan to make purchases or pick up online purchases across the border, be aware of your exemption limits. Be sure to check the CBSA duty and taxes estimator to calculate taxes on goods purchased in the United States and to help you make informed decisions when shopping abroad.

Ask the CBSA officer: To enter into Canada as quickly as possible, the single best thing you can do is to be open and honest with the CBSA officer. If you are not sure about what to declare, don’t hesitate to ask. The officers are there to help you.

ICBC’s top tips to help keep kids safe on summer break WITH B.C. school children and teens starting their summer break from school this week, ICBC is asking drivers to be especially alert this season, particularly near playgrounds and around youth walking or riding their bikes.

Every year in B.C., five pedestrians aged five to 18 die and 250 are injured in crashes involving a vehicle. A young cyclist dies every year in B.C. and another 120 young cyclists are injured in crashes involving a vehicle.

Tips for drivers:

* Playground speed limits are year-round: With longer summer days, drivers should remember that the 30km/hr speed limit is from dawn to dusk, every day. * Summer school speed limits are in effect: For schools that hold summer classes, the school zone speed limit of 30 km/hr is in effect from 8 a.m. to 5 p.m. on school days.

School zone signs will indicate if a school is holding summer sessions. * Wait at crosswalks: Parents and their young children may need more time when crossing the street. Don’t pass any car waiting at a crosswalk as they may be stopped for those crossing the street. Wait for pedestrians to get to the other side of the street before resuming your travel. * Slow down on residential streets: Expect the unexpected when children are at play, including the possibility of a teen running to catch an errant ball or a child running out from between parked cars. Slow down and be prepared to stop suddenly. * Be patient with younger cyclists: Leave plenty of room between your car and young

cyclists, in particular. Shoulder check for cyclists before turning right and watch for oncoming cyclists before turning left. * Distracted walkers: Be aware of pedestrians around you, especially for teens who are wearing headphones or using their cell phones while walking, as they not be paying close attention to the road.

Tips for parents: * Review safety rules: Review road safety rules with your children and practice how to use crosswalks safely. Set limits to where they can walk alone and where they must be accompanied by an adult. * Accompany young children: Children under 10 should always be accompanied by an adult when crossing a street or walking close to the road. * Safe outdoor play areas: Establish safe play areas around your home for younger children, such as your backyard. Supervise your children or assign an older child to be in charge. Teach your child that the road is never a safe place to play, even if their toy rolls into the street or a driveway. * Demonstrate good walking habits: Practice good walking habits that keep you and your family safe. Teach your child to stand a few steps from the curb while waiting at a crosswalk. Instruct your child to always use a crosswalk, and that jaywalking is never OK. * Distracted walking: Remind your teen to be aware of their surroundings when walking. Looking at their cell phone or wearing headphones can prevent them from noticing oncoming cars and other hazards. * Cycling safety: Teach safe cycling behaviour to your children such as cycling in a straight line, performing hand signals and shoulder checking. Outfit their bike with a bell, lights and reflective materials. Children should wear bright, reflective clothing so they can be seen in the dark. * Head safety: Make wearing a helmet a rule for your child if they want to use their bike, skateboard or rollerblades.
