the new tariff scheme effective from January 2013 onwards. While the calculations of the VDMK are accurate, including as they do parameterssuch as the duration of time for an event and number of events per years, a recently launched Gema online calculator is not. This only shows the rates for events lasting 5 hours and only includes factors allowing for entrance fees and the size of the room. All these results merely indicate that from next year on Gema wishes to receive 10 percent of the gross income. Results evaluated via the Gema online calculator are misleading, as this application only evaluates the lowest of the new basic rates. Gema does not even mention or give any notification on the particular website that the new proposed rate will see events lasting longer than 5 hours attracting another 50 percent for each additional 3 hours. Meanwhile the collection society has issued press releases, again only coming up with examples that indicate that Gema would only charge a 10 percent share on the ticket gross, making no mention the “5 hours trap” revealed by studying the newly proposed tariff. This recent tariff increase applies to the usage of recorded music in discotheques, gastronomic and other events such as street fairs or carnival events. As reported in the previous issue, the new tariff scheme foresees significantincreases for events that last longer than 5 hours. In certain case the new rates increase by more than 400% for some events and in some cases will even see a hike of a 1000 percent on previous rates.

Do you expect that this discussion could lead to GEMA reconsidering their proposed tariff scheme? – The meeting of the VDMK and GEMA took place on the 24th of April. As you might have expected, the VDMK firstly put forward its arguments to make clear that the proposed rates are not appropriate in any way and cannot form a basis for negotiations. However there has been no indication from GEMA that there would be any re-think regarding the tariffs.
