Long-time Town Manager Rick McGuire retires

For the first time in 22 years, the Town of Williston is without the calm, steady leadership of Rick McGuire.

The town manager retired Monday, and was celebrated Tuesday at a small gathering at the Isham Family Farm. It wasn’t the public celebration befitting two-plus decades of dedication to the town and relationships built with residents and co-workers, but it did allow town leaders to mark the occasion under pandemic health protocols.

McGuire has been admired for his ability to guide the town through large projects, like the 2019 acquisition and protection of the Catamount Community Forest, as well as handle the day-to-day operations of a town of 9,000 residents no matter what challenges arise. “He is very good at diffusing difficult situations,� said Town Clerk Sarah Mason. “He is always calm in the storm.�

Mason worked with McGuire for eight years. “I have really enjoyed working with him. He is approachable all the time. He’s always very calm, supportive and helpful,� she said.

McGuire has helped the town manage significant land development and population growth of about 100 new residents a year, while prioritizing the acquisition

and conservation of public land.

Under his leadership, the town constructed a new fire station, public works garage and water storage tank. He supported the expansion of the fire department and creation of an ambulance service, as well as creating a stormwater utility program to fund infrastructure to foster water quality improvement in the Allen Brook and Lake Champlain.

Selectboard chair Terry Macaig spoke at Tuesday’s celebration of McGuire’s retirement. “We congratulate Rick on his 22 and a half years as town manager,� he said earlier in a town press release. “His vision for the town and innovative approach to solving problems has been recognized not only by our residents and selectboards, but also by his peers in Chittenden County and statewide.

McGuire’s career in public administration started in Connecticut 44 years ago. He has served at both state and municipal levels. He had planned to retire at the end of June, but agreed to stay on as the town’s hiring process for his successor was slowed by the pandemic. “It has been a tremendous honor for me to have served the Williston community for these past 22 and a half years,â€? McGuire said. “I am thankful I was given the opportunity to work with so many citizens, volunteers, elected officials and staff who all worked tirelessly to the benefit of our community. A manager accomplishes nothing without those efforts. “Any accomplishments attributed to me belong to the community,â€? he added. “I am just happy to have been a part of it.â€?Â

Voters get a jump on primary election

Hundreds of ballots cast by mail; in-person polling set for Tuesday

With mail-in voting at record numbers, the majority of votes are already cast for next week’s state-

wide party primary elections.

But a traditional polling place is still an indispensible part of the election. In-person voting is scheduled from 7 a.m. to 7 p.m.

Tuesday, Aug. 11 at the National Guard Armory at 7846 Williston Rd., under public health mandates and restrictions brought on by the coronavirus pandemic.

As of Monday, roughly 1,800 ballots had been filled out and re-

turned to the town offices in Williston, Town Clerk Sarah Mason said. That is more than the entire turnout of the last primary election in 2018, when 1,683 Williston residents voted. That year, 310 absentee ballots were cast.

The addition this year of a postcard sent to all of Williston’s roughly 8,000 registered voters with instructions how to request an absentee ballot has driven the

rise in voting by mail. For the general election in November, ballots will be automatically mailed to all voters, without the need to make a request. Postage is covered by the Secretary of State’s office.

“Voting by mail is making it easier for people and proving that participation goes through the roof,” Mason said. “It has just been extraordinary.”

The pandemic was the impe-

tus for expanding voting by mail, to reduce the number of people gathering at in-person polling places. On Tuesday, voters will be required to wear masks, and no more than 20 voters will be allowed in the armory at a time.

Voters are asked to bring their own pens and maintain 6 feet of physical distance from others — and to not come in if feeling ill. Voters see VOTERS page 3

Mysterious seeds show up in Vermont Several Vermont residents have received unsolicited packages containing seeds that appear to have originated from China, according to the Vermont Agency of Agriculture. The types of seeds in the packages have not yet been identified. Unsolicited seeds could be invasive species, could introduce diseases to local plants or could be harmful to livestock, the agency says.

“We are not denying anyone their right to go to a polling place,” said Mason.

She said the group of election volunteers is entirely new; older, experienced election workers opted out due to concerns about coronavirus exposure.

The roughly 1,800 ballots already mailed in will be combined with ballots cast on election day for counting, with results ex-

pected by Tuesday night.

Voters are able to choose one of three party primaries to participate in by choosing to vote one of the three available ballots: Democrat, Republican or Progressive.

Nominations for the general election in the statewide offices of governor, lieutenant governor, treasurer, secretary of state, auditor and attorney general will be determined. Also, nominations for state representative in Williston and state senator in Chittenden County are up for grabs, as well as Vermont representative to the U.S. Congress.

By Rob Roper A number of public school teachers and administrators have recently raised serious concerns about re-opening schools this fall.

Harwood Union Superintendent Brigid Nease penned a long letter sounding the alarm about the overwhelming challenges facing the system.

On July 30, the House Education Committee held a three-plushour special meeting to hear from school officials about how they are preparing to open for the coming school year. Principals don’t even know if they have enough staff to open. One superintendent did a survey, and 50 percent of her staff were either high risk for COVID or lived with someone who is.

Teachers are waiting to hear what the plan is before they decide if they’ll take part, or part ways.

Principals also don’t know how many students they’ll have. Education Secretary Dan French testified that filings to homeschool are up 75 percent, but the one agency employee designated to handle this paperwork is overwhelmed.

The real number is larger and is likely to keep growing as parents learn more about what’s really in store.

Libby Bonesteel, superintendent for Montpelier-Roxbury, opined that schools are unequipped to handle most health issues.

“We’re not a hospital setting,” she said, and pointed out that the symptoms of COVID-19 are symptoms young kids exhibit all the time.

What are teachers supposed to do if a student has, for example, diarrhea? This is the number one COVID symptom for young kids, but it’s also brought on by a bad mix of junk food or a host of other reasons. Should school officials assume it’s COVID? Shut down the school?

If multiple kids exhibit symptoms such as a runny nose or fever (she said it’s common for four or five kids to exhibit fever on a given day), schools don’t have the resources to isolate them all. What if a child or teacher actually does test positive for COVID? “I understand the safety guidance,” said Bonesteel, “but when it’s put into reality in a school building, it’s just not realistic.”

Superintendent Nease wrote, “… I think we are going to try to reopen school, and I think we will fail in ways that may have permanent, unrecoverable repercussions for our students, school systems and community.”

Nease, Bonesteel and their colleagues have my sympathies, but more so do the parents and primarily the students who need to have some return to stability now. For many, if not most, families, the ad hoc remote learning program schools put into place in the spring

Families can’t afford another year of chaos. If the public schools aren’t in a position to offer a stable, predictable, effective learning experience, for whatever reasons, then other options need to be made available.

Even the New York Times recognized that alternatives are necessary with an article called “Remote Learning? No Thanks,” exploring some of the creative solutions parents are turning to, such as: — Genuine home schooling (learn more about Vermont options at www.VHEN.org.)

— Home schooling “clusters” in which home schooling parents come together to share resources and labor among families.

— “Pandemic Pods,” a similar but less formal arrangement to “clusters.”

— Parents hiring full-time tutors for their own kids.

— “Microschools,” in which multiple families hire a teacher/tutor to teach a handful of children.

— Established, professional remote learning programs.

To illustrate the popularity of (or desperation for) such options, the Times cited a new Facebook group, “Microschools and Pandemic Pods” that, as of this writing, has nearly 30,000 members. see GUEST COLUMN page 5

But when one looks at these solutions, it’s clear that they work best for families with financial means. The money to hire a tutor or the flexibility to forego a salary to homeschool aren’t universal.

The worry that a COVID-induced gap in quality learning will lead to greater outcome inequities is a real concern.

This is why the state should consider allowing funding to follow the child into some or all of these alternative solutions so that lower income families also have the options to homeschool or hire professional help. In some cases, such as micro-schools and pods, changes to the law may be necessary to allow kids to access a stable learning environment.

We spend $1.8 billion a year in Vermont to educate our children.

That’s what the money should be spent on. If the public school system can’t do this job, the money should be diverted into functional educational opportunities for kids.

That’s who the system is really for, right?

Unbalanced energy article Hurrah for Jason Starr’s thorough coverage of July 28’s public hearing on the proposed town energy plan (“Residents debate adopting town energy plan”) — a plan that charts a course for us all to switch from fossil fuels to renewable energy. I also can’t help but make the connection between the frequency of the Williston takeoffs and the lack of official Williston representation at any of the sound mitigation meetings I attended.

Both South Burlington and Winooski had multiple city representatives in attendance looking out for the citizens of their communities. Williston sent no one.

I can only imagine that this lack of representation has given the Air Force/National Guard the green light to grace Williston with the “sounds of freedom” more frequently than surrounding communities.

These constant interruptions are affecting our way of life and no doubt will be affecting our property values soon. Williston should do something to protect her citizens.

The pain of fishing As Lake Champlain is home to countless fish, it is important to realize that they are deserving of humane consideration. Over the past decade, a large body of scientific evidence has proven that fish feel pain, and research suggests that fish even experience emotions.

A study that highlights their avoidance of threatening stimuli investigated fear in rainbow trout. It concluded that they learned to swim to a safe area as a result of being exposed to a light cue that signaled a plunging dip net was coming toward them (Yue et al, 2004).

Last Saturday was “Respect for Fish Day,” an annual day of action created by In Defense of Animals to raise awareness that fish have the capacity to experience pain and emotions and possess intelligence. Since fish are generally not protected under humane slaughter laws, they are killed in atrocious ways, including suffocation, freezing to death and decapitation. In many instances, fish are skinned and butchered while fully conscious.

Broadband grants available The Vermont Department of Public Service launched a program last week to provide up to $3,000 in assistance to help households extend high-speed (broadband) internet lines to their homes, with $2 million in total funds available.

The program is called the Line Extension Customer Assistance Program (LECAP).

“While expanding access has been a longstanding challenge in Vermont, I appreciate the efforts of the Public Service Department team, the Legislature and many private partners to help get more Vermonters connected,” Gov. Phil Scott said. “This assistance program is another step forward in this challenging work, which is critical to increasing equity in education heading into our school reopening this fall.”

The funding was passed through Act 137 and developed in response to the COVID-19 emergency to help Vermonters access broadband.

“For the teacher or student living at the end of the dirt road with no internet access, the LECAP could be a lifeline,” said Public Service Commissioner June Tierney. “This is a great opportunity for qualifying Vermonters who need broadband service but have not been able to afford the full cost of a line extension.”

Dear Willie, The coronavirus crisis has lit a fire under many Americans when it comes to getting their affairs in older. Currently, fewer than half of American adults have prepared a will or living trust.

If you die without a will, the state you reside in will determine what happens to your assets. Every state has intestacy laws in place that parcel out property and assets to a deceased person’s closest living relatives when there’s no will or trust in place. But these laws vary from state-to-state.

Here is a general breakdown of what can happen to a person’s assets, depending on whom they leave behind.

Married with children: When a married person with children dies without a will, all property, investments and financial accounts that are “jointly owned” automatically go to the surviving co-owner without going through probate, which is the legal process that distributes a deceased person’s assets.

But for all other separately owned property or individual financial accounts, the laws of most states award one-third to one-half to the surviving spouse, while the rest goes to the children.

Married with no children or grandchildren: Some states award the entire estate to the surviving spouse, or everything up to a certain amount (for example the first $100,000). But many other states award only one-third to one-half of the decedent’s separately owned assets to the surviving spouse, with the remainder generally going to the deceased person’s parents, or if the parents are dead, to brothers and sisters.

Jointly owned property, investments, financial accounts or community property automatically go to the surviving co-owner.

Single with children: All state laws provide that the entire estate goes to the children, in equal shares. If an adult child of the decedent has died, then that child’s children (the decedent’s grandchildren) split their parent’s share.

Single with no children or grandchildren: In this situation, most state laws favor the deceased person’s parents. If both parents are deceased, many states divide the property among the brothers and sisters, or if they are not living, their children (your nieces and nephews). If there are none of them, it goes to the next of kin, and if there is no living family, the state takes it.

Make a Will To ensure your assets go to those you want to receive them, you need to create a will or trust.

If you have a simple estate and an

uncomplicated family situation, there are do-it-yourself resources that can help you create all these documents for very little money.

Some top-rated options include the Quicken WillMaker & Trust 2020 downloadable software (available at www.nolo.com) that costs $90 and works with Windows and Macs and is valid in every state except Louisiana; LegalZoom (www.legalzoom.com), which offers basic wills for $89 or $99 if you’d like assistance from an independent attorney; and Trust & Will (www.trustandwill.com), which charges $89 for a basic will.

If, however, you want or need assistance or if you have a complicated financial situation, blended family or have considerable assets, you should hire an attorney. An experienced attorney can make sure you cover all your bases, which can help avoid family confusion and squabbles after you’re gone.

Costs will vary depending on where you live, but you can expect to pay anywhere between $200 and $1,000 for a will.

Organizations/groups using fields or courts can bring in port-o-lets for their groups use only. The port-o-let will be signed for the group, locked, cleaned and used by the group only.

PARK AMENITIES Tennis, pickleball, basketball and volleyball courts are a first-come, first-use. No times are allocated to certain groups to use the courts. A group/organization can reserve a court for use and would have to supply the following: permit application, certificate of liability insurance and court fee. The group/organization would then be issued a permit for use at a certain date and time. A sign will

be posted at the court by the rec department with the reserved days and times to let the general public know.

If courts are not reserved, the rules signs at the courts ask that participants only play for an hour if others are waiting. Participants can also ask others to join in and play with you.

No organized camps, practices or fee-based lessons are to be conducted at any of the courts, unless sponsored by the recreation department.

The disc golf course, skatepark and ice rink are open to all to use. There are no allocated times for certain groups to use these amenities. Share, take turns and play together.

On the disc golf course, play rules should be that of regular golf: Let quicker players play through, or wait patiently for your turn at the tees.
