The Maluti A Phofung Local Municipality has been left red faced after some of its assets were attached last week Thursday (17 November 2022) It was reported by other media sources that a sheriff from Harrismith went to the municipality’s offices in the town and attached municipal vehicles and other items, all of this spectated by the municipal staff and workers This information and photos of the vehicles being towed away then went viral and several media sources use it in their headlines, claiming that the municipality is going bankrupt and that they will not be able to pay their salaries this month. The Maluti a Phofung Local Municipality then, in a media statement released on Wednesday 23 November 2022, stated that this event that occurred
lastweekwasunlawful Theythenhitback explaining the ongoing situation They wrote: “The High Court of South Africa’s Free State Division in Bloemfontein has ordered the Sheriff PK Foka to return the municipal vehicles that were illegally attachedlastweek Theorderreadsinpart thattheFirstRespondent(SheriffPKFoka) should ‘return the tools of trade (motor vehicles)belonging totheApplicant(MAP) as set out in the inventory’ “We are relieved that this matter has finally been resolved even though we had not anticipated that it would take this long, legal route,”saidtheExecutiveMayor,Cllr Gilbert Mokotso, as he welcomed back the said vehicles The Executive Mayor added thatwhathappenedwasunfortunateasthe Sheriff should not have even taken the
vehicles “Our pleas to the Sheriff fell on deafearslastweekasourmatterwiththat one service provider had been amicably resolved In fact, this was a long standing matter from many years ago and we managed to sit down with the service provider and had an agreement Taking these vehicles was illegal and has caused us a lot of inconvenience as they are used for revenue collection in the whole of Maluti A Phofung Our staff could not do anything for over a week This has caused us a big backlog which has affected our cash flow to an extent that our staff will receive their salaries in tranches up until 30 November 2022 as per their salary levels,” he added The Sheriff was also ordered to pay all the costs of the application.
