This notice informs you that Brittany Carney has filed a Wis. Stat. § 5.05 complaint against you with the Wisconsin Elections Commission (Commission). A copy of the complaint is attached to the email transmitting this notice letter. The complaint alleges that you made false representations affecting elections in violation of Wis. Stat. § 12.05.

The Commission is required to notify you within 5 days of receipt that a complaint has been filed against you and provide you "an opportunity to demonstrate to the commission, in writing, within 15 days after receiving the notice, that the commission should take no action against the person on the basis of the complaint." Wis. Stat. § 5.05(2m)(c)2.a.

I, Paul Pustina, hereby respond to the complaint filed by Brittany Carney as follows:

Allegation 1:

Paul Pustina created a community group called "Arena Community Team" (ACT}. He has monthly meetings and has used his ACT team as a campaign platform.

Response:

The complainant asserts that I created the "Arena Community Team" (ACT}. I did not create ACT. This statement is inaccurate for the following reason:

1. ACT's Origin: The Arena Community Team is a volunteer-driven organization dedicated to promoting transparency, engagement, and collaboration within our Village and Town. ACT was formed in January 2024 out of an idea of a Village resident. Due to my previous involvement in Village government and community activities, I was asked to join. ACT does not accept outside financial contributions.

2. Purpose and Activities of ACT: ACT was established to support open communication and encourage civic participation. The primary goal is to make local governance more accessible by sharing recorded Village board meetings, keeping Village and Town residents and businesses well-informed and actively involved with local government and promoting community involvement. To facilitate discussions about the future of our Village and Town. The belief is that an informed and engaged community leads to stronger leadership and better governance.

ACT supports various community activities, including distributing voter information, assisting with local fu ndraisers, volunteering for and participating in local events such as the Arena Steak and Chicken Feed (VFW), the Yolanda Peterson & Mary Jones Memorial Parade and ACT hosted their first community potluck dinner.

3. ACT's Monthly Meetings and Guest Speakers: The monthly meetings have included guest speakers from local organizations, including Fire ChiefTodd Pinkham, Interim EMS Director Steve Wilkinson, Courtney Norton (previous Village of Arena Public Safety Committee Chair), Iowa County Administrator Larry Bierke, Iowa County Sheriff Mike Peterson, former Arena Police Chief Nick Stroik, Rich Judge from the River Valley Housing Coalition, Ray Porter from the Dane-Iowa Wastewater Commission, and Trustee Matthew Schroeder, who held a listening session. All Board members have been invited to participate. These efforts aim to strengthen community involvement and facilitate meaningful dialogue. We believe that fostering transparency and open dialogue is essential to good governance. Public engagement is critical to building a well-informed and cohesive community and we encourage residents to participate in discussions that shape the future of our Village and

Town. Arena is a Village of approximately 888 people. The Village will only prosper if people overcome prejudices and opposing views and communicate with each other.

Allegation 2:

Brittany Carney states that the three questions for the ACT flyer could be taken from the answers in the Spring Green Home News.

Response:

The complainant's assertion regarding the flyer's questions is inaccurate. My response is as follows:

1. The questions posed in the ACT flyer were different from those in the Spring Green Home News.

2. Brittany Carney thanked ACT for reaching out but expressed that she wanted to focus on presenting her platform through "neutral" channels. ACT understood this to be a decline of participation in the flyer. ACT not being a "neutral" channel, is an opinion. Furthermore, ACT chose not to use her answers from the Home News, as it was felt if it did, it would be accused of plagiarism. Also, there is the fact that all the other candidates that responded, submitted answers to ACT.

3. ACT proceeded to distribute a flyer that included all candidates, noting that Brittany Carney chose not to answer the questions.*

Allegation 3:

Brittany Carney accuses ACT of being able to alter her responses.

Why would ACT alter any response that Ms. Carney would provide? She would have a record of her response and any alteration would be immediately obvious.

Allegation 4:

Brittany Carney accuses myself and my wife of being "absolutely opposed to me being re- elected."

Response:

This is an opinion. Ms. Carney seems to say that being "absolutely opposed to me being re- elected", in the context of the complaint, indicates that we have no right to express our opinion or point out facts that pertain to her actions on the Village Board without being prosecuted. Furthermore, the inclusion of my wife in this complaint is irrelevant, as the complaint is against me.

Allegation 5:

Brittany Carney states "Considering Paul is running this group and running for Village President."

Response:

I do not run ACT. I am a member of ACT. I was asked to become a member after the group was formed in January of 2024. I am running for Village President. I did not decide this until late October 2024, after being asked to run. I will relinquish my membership if elected.

Allegation 6:

Brittany Carney accuses myself and my wife, Susan Pustina, of harassment.

Response:

The complainant's statement that also accuses my wife of harassment is not relevant as the complaint is against myself. However, I respond as follows:

1. Freedom of speech is a fundamental right for all citizens, and pointing out facts is not harassment. Criticism or sharing of information that is truthful or fact-based cannot be considered harassment under the law. The editorial outlined in the complaint is backed up by YouTube videos of meetings.

Conclusion:

Based on the above responses, I respectfully submit that the complaint filed by Brittany Carney, outlining violations of Wis. Stat. 5.05 and Wis. Stat. 12.05, contains factual inaccuracies, is frivolous and does not promote cause for further investigation. I request that the Wisconsin Elections Commission dismiss this matter in light of the information provided in this response.

I also request the Elections Commission to consider Wis. Stat. 5.05 (2m)(c)2.am. "If the commission finds, by a preponderance of the evidence, that a complaint is frivolous, the commission may order the complainant to forfeit not more than the greater of $500 or the expenses incurred by the commission in investigating the complaint.''

*Attached is a communication regarding if the flyer needed to have a disclaimer regarding who was distributing it. Since it was a flyer not advocating any particular candidate, ACT did not even have to put an acknowledgement on the flyer.

It does not appear that the attached flyer contains express advocacy ("Vote for ... ", "Elect. .. ", "Defeat. .. ", etc.). As such, a disclaimer is not required. We encourage people to list the payer, but it would not be required. In a situation like your second communication, it appears this would contain express advocacy. The proper attribution statement would be "Paid for by [committee name]." If your candidate committee name (on the CF-1 registration statement filed with the village clerk) is simply Paul Pustina, then the disclaimer should read ••Paidfor by Paul Pustina". "Authorized by" is not required. I would also note that this communication could likely count as an in-kind contribution to the other candidates supported. In that case, the disclaimer would also need to include their candidate committee names and would count towards contribution limits.

Paul Pustlna created a community group called ·Arena Community Team· {ACT). He has monthly meetings and has used his ACT team as a campaign platform now that he is running for the village of Arena president seat. I have been a village trustee for just over 2 1/2 years and am currently running for re-election. I was contacted by Paul's wife Susan Pustlna on Thursday, January 30th via my trustee email and asked to answer three Auestions so that the ·Acr group can print flyers off and hand them out to every house in the village. After I did not respond to this message, Paul Pustina received my personal email through an open records request and emailed me on February 12th. He asked me to respond to the ·Acr questions no later than Friday, February 14th at 11:00am.After receiving this email from Paul, I sent an email via my trustee email to his wife Sue and cc'd him stating that I believe sharing my vision with the community through a more neutral channel would be appropriate. I then told them that I had answered these AUestlons already and that they can get those answers In the Home Newspaper that was printed on Wednesday, February 12th. Paul responded to my email from his personal email and signed it from his wife which they invited me to attend an "ACT" meeting.

Paul physically went door to door In the village of Arena on Saturday, February 15th and put these flyers on every door. After reviewing the flyer, it listed my name and that I chose not to answer the questions. I did not refuse to answer these questions; I told Paul and Susan Pustina where to find my answers to the same questions they were asking. Since the "ACT" group is not a legitimate organization there is nothing keeping them from altering my responses. They are also absolutely opposed to me being re-elected. I believe this is a blatant lie that was printed to make me look unwilling to speak with our icommunlty and to sway our primary election in Arena. If the ACT group was unbiased, they would have printed my answers from the Home Newspaper. Considering Paul is running this group and running for the vlllage president, I feel like this really ls a conflict.

I have attached all email correspondence for your review as well as my email correspondence with the Home Newspaper. I have also included news articles that were published in the week of February 19th in the Home Newspaper as well as the Dodgeville Chronicle. This letter to the editor was written by Susan Pustlna and specifically calls me put by name. This is only a small portion of harassment I have received from Paul and his Wife Susan Pustlna.

I am seeking re-election because I have had the privilege of serving on the board for the past few years. During this time, our team has successfully tackled numerous challenging issues, bringingfinancial stability that now enables us to Invest in our community and its residents.

One significant obstacle we encountered was the burden of maintaining a police force that was patrolling parts of Iowa county without reimbursement to our village for those professional services. This left us with limited funds to tackle infrastructure issues or developing/maintainingour parks and recreational areas. By addressing this challenge, we have been able to redirect resources to pressing needs within our community while still contracting for police coveragethrough the county.

Additionally, we have successfully negotiated a fair and financially protected fire/EMS agreement, ensuring the safety and well-being of our residents while also beingfiscally responsible.

Furthermore, I have taken a strong stance against being bullied or manipulated based on fear tactics. I am determined to pursue better contracts and agreements for the benefit of the Arena residents, ensuring that their needs and Interests are prioritized.

What ls the most critical Issue faclug the residents of your community? How do you propose to respondto it?

We have a lot of infrastructure Issues that have gone unattended and will need to be addressed. Not only within our village limits but also at our Dane/Iowawastewater facility. I am focused on making upgrades that village residents not only benefit from but also feel proud to be a part of.

This Primary Election will be held to determine who will be on the ballot for the 3 OPEN Village of ArenaTrustee seats.

Election rules state that only 6 candidates can run for 3 open seats, so, since we have 7 candidates running. we must hold a Primary Election to eliminate one candidate.

ACTreached out to all the candidates and asked them to answer the following questions: Why are you running? What life/Work experience do you bring? What are your concerns regarding the Village?

Don Helt

I am running for Village Trustee to bring respect, accountability and transparency to the position. I will try my very best to represent the best interests of the residents of Arena.

What experience do you bring? Life/Work experiences.

My goal is to work with other Board members and members of the community to make Arena a place we all want to call home and be proud of. I have 15 years of management experience and I have been working for the last 24 years, as a Receiving Supervisor. I have the knowledge to deal with people and of handling tough financial decisions.

What are your concerns regarding the Village?

My actions as a Board member are goingto rely heavily on the input I receive from Village residents. Our current Board is focused on filling their own personal agenda. Public Safety will be my number one priority. We need to take care of problems and safety issuesbefore the unthinkable happens. Examples are the California wildfires. flooding and more locally. the 1984 Barneveld tornado.

My intent is to bring critical thinking and problem-solving skills to the issues we face as a village. As a local business owner and mother of five I have a vested interest in the safety and prosperity of our community. I also would like to be more involved with helping our parks and recreation department with having kids in sports.

I have lived in Arena for most of my life, serving as a Firefighter then EMTfor over 50 years. I served for 15 years as EMS Service Director, on the VillageBoard for 6 years, 4 of which I was Village President followed by 6 years as Municipal Judge. I am active in my church and have served on the Governing Board for many years.

What are your concerns regarding the Village?

We currently have issues concerning Public Safety involving both the lack of a

Police Departmentand problems recruiting volunteersfor Fireand EMSand funding the department. wehavestonn water and ground water problem areas. We needto collaborate with landowners to open more access to both residential andcommercial development all while keeping propertytaxes under control.

I, Paul Pustina, hereby respond to the complaint filed by Kevin Reimann as follows:

Allegation 1:

Paul Pustina started a community group called “Arena Community Team” (ACT).

Response:

The complainant asserts that I started the “Arena Community Team” (ACT). I did not create ACT. This statement is inaccurate for the following reason:

1. ACT’s Origin: The Arena Community Team is a volunteer-driven organization dedicated to promoting transparency, engagement, and collaboration within our Village and Town. ACT was formed in January 2024 out of an idea of a Village resident Due to my previous involvement in Village government and community activities, I was asked to join. ACT does not accept outside financial contributions.

Allegation 2:

Kevin Reimann states that ACT is nothing more than a biased group that is a campaign platform for his own candidacy.

Response:

The complainant’s assertion is an opinion and inaccurate. Mr. Reimann has never attended an ACT meeting. My response is as follows:

1. Purpose and Activities of ACT: ACT was established to support open communication and encourage civic participation. The primary goal is to make local governance more accessible by sharing recorded Village board meetings, keeping Village and Town residents and businesses well-informed and actively involved with local government and promoting community involvement. To facilitate discussions about the future of our Village and Town

The belief is that an informed and engaged community leads to stronger leadership and better governance.

ACT supports various community activities, including distributing voter information, assisting with local fundraisers, volunteering for and participating in local events such as the Arena Steak and Chicken Feed (VFW), the Yolanda Peterson & Mary Jones Memorial Parade and ACT hosted their first community potluck dinner.

2. ACT’s Monthly Meetings and Guest Speakers: The monthly meetings have included guest speakers from local organizations, including Fire Chief Todd Pinkham, Interim EMS Director Steve

Wilkinson, Courtney Norton (previous Village of Arena Public Safety Committee Chair), Iowa County Administrator Larry Bierke, Iowa County Sheriff Mike Peterson, former Arena Police Chief Nick Stroik, Rich Judge from the River Valley Housing Coalition, Ray Porter from the Dane-Iowa Wastewater Commission, and Trustee Matthew Schroeder, who held a listening session. All Board members have been invited to participate. These efforts aim to strengthen community involvement and facilitate meaningful dialogue. We believe that fostering transparency and open dialogue is essential to good governance. Public engagement is critical to building a wellinformed and cohesive community and we encourage residents to participate in discussions that shape the future of our Village and Town. Arena is a Village of approximately 888 people. The Village will only prosper if people overcome prejudices and opposing views and communicate with each other.

Allegation 3:

He is using ACT to also campaign for his “supporters” Steve Wilkinson, Don Helt and Joe Hipsky. This is an opinion. ACT is not being used to campaign for my “supporters.”

Allegation 4:

Kevin Reimann did not submit answers for two reasons. “First, I submitted my responses for my candidacy to the local legitimate newspaper, Home News. Secondly, I did not trust this group to not alter my responses and it is not a legitimate group in my opinion.”

Response:

1. The first part of this allegation shows he refused to submit answers. Which is his right.

2. The second part of the allegation that his responses would be altered is an opinion. What would be gained by altering his answers?

3. ACT not being a legitimate group is an opinion.

Allegation 5:

Paul pustina went door to door in the Village of Arena on Saturday, February 15th, 2025, putting flyers on every door. That was witnessed by me and other residents.”

Response:

I did distribute flyers in the Village. I only distributed flyers in one section of the Village. I did not see Mr. Reimann on that day as I was not distributing flyers on the side of town he lives on. I am sure other residents did see me distributing flyers.

Allegation 6:

Kevin Reimann states that he believes the order of candidates is a conflict and states he believes the flyers unfairly tainted the vote and results.

Response:

These two statements are opinions.

1. By not answering the questions, which is his right, Mr. Reimann bypassed an opportunity to present his reasons, to residents, for running for Village Trustee.

Conclusion:

Based on the above responses, I respectfully submit that the complaint filed by Kevin Reimann, outlining violations of Wis. Stat. 5.05 and Wis. Stat. 12.05, contains factual inaccuracies, personal opinions which provide no basis for the complaint to be taken seriously, is frivolous and overall, does not promote cause for further investigation. I request that the Wisconsin Elections Commission dismiss this matter in light of the information provided in this response.

I also request the Elections Commission to consider Wis. Stat. 5.05 (2m)(c)2.am. “If the commission finds, by a preponderance of the evidence, that a complaint is frivolous, the commission may order the complainant to forfeit not more than the greater of $500 or the expenses incurred by the commission in investigating the complaint.”

This Primary Election will be held to determine who will be on the ballot for the 3 OPEN Village of Arena Trustee seats.

Election rules state that only 6 candidates can run for 3 open seats, so, since we have 7 candidates running, we must hold a Primary Election to eliminate one candidate.

ACT reached out to all the candidates and asked them to answer the following questions: Why are you running? What Life/Work experience do you bring? What are your concerns regarding the Village?

Don Helt

I am running for Village Trustee to bring respect, accountability and transparency to the position. I will try my very best to represent the best interests of the residents of Arena.

What experience do you bring? Life/Work experiences.

My goat is to work with other Board members and members of the community to make Arena a place we all want to call home and be proud of. I have 15 years of management experience and I have been working for the last 24 years, as a Receiving Supervisor. I have the knowledge to deal with people and of handling tough financial decisions.

What are your concerns regarding the Village?

My actions as a Board member are going to rely heavily on the input I receive from Village residents. Our current Board is focused on filling their own personal agenda. Public Safety will be my number one priority. We need to take care of problems and safety issues before the unthinkable happens. Examples are the California wildfires, flooding and more locally, the 1984 Barneveld tornado.

I will do my best to give the residents of Arena the voice and representation they deserve.

Joe Hipsky

I'm running for village trustee to see the return of, and be an advocate for; fiscal responsibility, basic public services, and decorum at the board level. I hope to represent the wants and needs of the growing population of younger families in the village and provide insight that wm help attract and retain future generations of village residents.

Police Department and problems recruiting volunteers for Fire and EMSand funding the department. We have storm water and ground water problem areas. We need to collaborate with landowners to open more access to both residential and commercial development all while keeping property taxes under control.

What made me decide to run for trustee?

I want to see the momentum of much needed improvements continue to progress. These include upkeep of streets, parks, and public services. I want to do my civic duty and give back to the community.

What is the most critical issue facing the residents of your community? How do you propose to respond to it?

The most critical issue facing our community is continued maintenance and improvement to streets, water, and sewer infrastructure. To keep highly qualified personnel to run and maintain our village.

QUESTIONS

As a prospective village trustee, I would have liked to be included in the scheduling of this event as I had previously scheduled conflicts at this time. I apologize for my absence but I’m out of town in attendance of a Marines officer candidate school graduation ceremony. Below are my thoughts on the questions posed.

GENERAL:

1. What made you want to run in this municipal election?

I feel like there is a negative aura around our current board and town. I decided to be the change I wanted to see in my village.

2. What do you feel set you apart from the other candidates? (What experience do you bring to the village board and why do you think we should elect you?)

I hope to bring a tech centric mindset to the board and bring my generation into the conversation through a digital reimagining of how the board meetings operate. I think in a town of under 900 people, I can help us do a better job of crowdsourcing ideas. We don’t need to rely on our expertise alone, and I think we can accomplish it in a cost effective manner.

3. If elected, what do you plan to accomplish in your first 100 days? (What are your goals for the Village of Arena if you are elected as Village President/Trustee and why should we elect you? Be specific and transparent.)

4. What is your approach to handling controversial and complicated issues? (How will you handle conflicts of interest or any ethical dilemmas that may arise during your time in office?

I would advocate that board members dealing with conflicts of interests should recuse themselves from voting on issues they may disproportionately personally benefit from, but should still be included in the conversations.

5. How do you plan to involve residents in the decision-making process in our village? (What is your approach to addressing community concerns, and how would you involve citizens in finding solutions? How are you going to be transparent to the residents and taxpayers of the Village of Arena?)

Currently, village board meetings don’t adequately address residents who come with concerns. I hope to help amend how the current board interacts with residents at meetings, and to try and increase accessibility to people who can’t make it by hosting meetings on zoom or a similar service. I also hope to leverage AI for note taking and other recurring tasks to help automate processes.

6. How would you address issues of social inequality, discrimination, and ensure access to opportunities for all community members?

I would handle it on a case by case basis as the issues present themselves. I’m not proposing to solve the injustices of the world. I think I can help provide a positive environment for our small community.

7. How would you foster a culture of collaboration and inclusivity in local government decision-making?

By extending accessibility, I think we can draw in ideas from the community. Not everyone is passionate about every issue, but everyone is passionate about something. If we can leverage AI to parse meetings and timestamp points in the conversation that may be of interest, providing a mechanism of digital participation, we can engage with people on their interests and timeframes. Resident participation will increase usable data collection, which will help the board make community decisions.

HOT TOPICS:

8. If elected, what three steps would you take to put our village on a firmer financial footing? (How would you ensure that taxpayer money is spent efficiently and responsibly? Knowing the village has an annual audit, do you think the village needs a forensic audit and if so, cite specific evidence? Do you believe the Village of Arena needs to be audited yearly? More than once a year? Why? And do you believe the EMS/Fire should be audited yearly?)

If the general election follows the primary, then there will be several new members on the board. With a changing of the guard, it would be good to get everyone up to speed and on the same page as to what the village finances are. I personally don’t agree with some of the ways money has been allocated, but that is something that

can be discussed at board meetings among board members, with increased informed input from residents.

9. What is your view on the ACT (Arena Community Team) group? (Who are the core members of the ACT group? What is the purpose of the ACT group? Are you a member of the ACT group? If you are elected, will the ACT group still exist? If you are a member, how will you be able to be part of the ACT and be trustees concurrently?)

My understanding is that ACT is a group of residents that get together to brainstorm ideas for community involvement and improvement. ACT is not a government entity, it’s just a group that connects over a common cause. I don’t see a reason why they can’t be more involved in village ongoings as long as the two interests align.

10. What is your stance on having a Police Department again? (The Village residents voted to have the police department removed from the Village? Would you work on bringing a department back to the village? How much of the overall budget do you feel would be appropriate for a police department in Arena?)

I am open to bringing back the police in some capacity.

11. Would you consider having “clean up day” in the spring?

Like a highway cleanup? Would need more info.

12. With the open space at the Village Hall, what is your plan for the vacancy?

13. How do you plan to support local businesses and encourage economic growth in the community? (How does everyone plan on bringing businesses to Arena?)

I aim to focus on what makes Arena attractive amidst its neighboring towns. We are a small bedroom community. I think we should lean into that.

14. Do you value village employees, and will you allow them to do their jobs without being micromanaged?

I value competent employees with high morale. There is plenty of work to be done, I have no intention of micromanaging anything or anyone.

15. Do you think it is responsibility of the village board to hire EMT’s and recruit volunteer EMTs for Fire/EMS?

I think we have a joint interest in protecting the assets and residents of our village. Curating a positive relationship with our public services by working together is a net good.

16. What are your plans for maintaining the streets and infrastructure of the village if you are elected?

I plan to maintain them, and attract more residents/businesses to help maintain them.

This is a bedroom community, and I think we are uniquely able to attract residents because of this.

17. What is your plan to deal with the flooding issues on Oak St, Pine Rd, Pine St? There was a ditch to help with water flow, it was filled in, would you be willing to have it dug out again? What about stormwater drainage?

I would be interested in investigating what natural flood management techniques could be implemented through seeding of native flora.

18. Why do you think Arena can’t keep a bar and/or restaurant in the Village?

I hope to be a part of the change to remedy that.

Paul, when you were President is it true Vortex was looking into building in Arena? Why didn’t they?

Don and Joe, in your bios from the Primary Election, Don said the current board is focused on filling their own personal agenda. Could you please tell us exactly what their personal agenda is? Joe, you said individual agendas are being prioritized before public concerns. Could you please tell us which board members’ agenda is prioritized before public concerns?

The first step towards addressing public concerns is through active listening at village board meetings. In a small community setting, residents should expect to get feedback in real time about their concerns. When they are given a short window to speak to a non receptive board, what message does that send? We don’t have to agree, but we have to be willing to engage.
