letter from the chairman Dear fellow USSA members and industry leaders: This has truly been a milestone year for the U.S. Superyacht Association! As we celebrate our fifth anniversary as the only national organization in the United States dedicated to the promotion and protection of the superyacht industry, I’m excited about the tremendous strides we’ve made in such a brief time. The board has been sharply focused on several key objectives: membership growth and development; regional expansion; increasing the exposure of the U.S. to captains and owners of superyachts; refining our image both in print and on the web and developing strong relationships with those national regulators and legislators that impact our industry. Through the hard work of some very dedicated volunteers, board members and a strong management team, we’ve accomplished those goals. Over the past year we’ve grown the association to nearly 200 members—an increase of nearly 40%! To improve our membership benefits and exposure, we’ve redeveloped our web site and Membership Directory. We brought in a new management team to help take us to the next level, we’ve restructured our bylaws, added regional networking events and board members; and have built strategic alliances with strong regional marine trade associations around the country. Our Captain’s Briefings, (in St. Maarten, Newport, RI, San Diego, CA and Fort Lauderdale, FL) designed to educate Captains and senior officers about how to come to the United States, have been extremely successful and well attended. The USSA, for the first time, had a member Pavilion at the Palm Beach Boat Show and moved to the exclusive Builder’s and Designers Tent at the Fort Lauderdale International Boat Show. Most importantly, on the advocacy front, the USSA participated for the first time with the American Boating Congress and made more than 27 Hill Visits during that event—furthering our relationships in Washington, D.C. An exciting new relationship we’ve developed this past year is as an Operational Partner with the America’s Cup Superyacht Event Authority. This internationally revered event is giving the USSA and its members exposure to the world’s elite yachtsmen. As I come to the end of my tenure as Chairman of the USSA, I do so with the confidence that we’ve established a great base of members and together we will all keep the momentum going to promote the Super Yacht Industry within the United States and to look out for each other’s best interests. John Mann will be an excellent Chairman and he has my full support along with the entire board. Let’s make 2012 an outstanding year for all of our businesses. Cheers!

what can owners and captains Do to protect their vessels, passengers and crews from increasing piracy attacks? by Corey Ranslem | Secure Waters Security Group

Security incidents and attacks against vessels of all sizes have been increasing in frequency over the past five years. Pirates along the Somali coast have moved their operations deep into the Indian Ocean attacking just about any type of vessel including warships. Yachts, sailing vessels, and cruising vessels are experiencing an increase in attacks throughout the Caribbean, Central, and South America. Attacks against vessels are also increasing along the west coast of Africa, South China Sea, and the Straits of Malacca. What can vessel owners and captains do to protect their vessels, passengers and crews? A common sense approach that focuses on situational awareness and contingency planning along with technology provides crews an advantage over potential pirates worldwide. Most vessel crews are not properly trained on threat recognition, and also do not know how to cope with

attacks and boardings. Moreover, many vessels do not have emergency plans in place to deal with attempted attacks and boardings. However, first-hand accounts of recent attacks (and attempted attacks) show that trained and prepared crews that are equipped with early-warning systems have usually been able to prevent attacks and hijackings. (The IMB—International Maritime Bureau— does not keep statistics on how, precisely, various attacks were prevented; that information is available only by reading individual attack reports and by interviewing crew members). Not incidentally, many if not all maritime-security experts believe the piracy attacks are not a problem that should be assigned to naval forces but, rather, a law-enforcement problem that requires action by law-enforcement agencies. In fact, most of the world’s navies have no “rules of engagement” covering piracy incidents and typically release pirates after they have been captured. Only recently, in fact, has the United States itself signed an agreement with Kenya and other nations to prosecute pirates.

Many nations around the world are attempting to prosecute pirates and not return them to their country of origin. Coast Guard and Naval assets ply the world’s oceans to provide protection but they are not always in the right place at the right time. • Within 48-hours of arrival, you must make ‘formal entry’ at the Marine Unit of a CBP Branch, with your arrival number, vessel documents, and CBP forms numbers listed below. • Meet all pre-entry requirements specific to your vessel. • When you enter your dockage location call (800) 432-1216 to report your entry to USCG (U.S.Coast Guard). • Call immediatley, and no crew or passengers should disembark the vessel. • You will be asked for all your vessel, crew and passenger information. This may seem redundant however this is the validation process in place at the moment.

• Once this process is completed you will be given your formal Entry Number which is required at Immigration Clearance and should be recorded. • Within 24-hours following entry into U.S. waters, everyone on board must physically go to any Immigration center with proper documentation, passports, visas, I-94s, etc. for a face-to-face clearance.

The options to run to nearby islands for a quick visa are really NOT an option like it has been in the past.

• The National Pollution Funds Center is tasked with administering the vessel financial responsibility portions of the Oil Pollution Act of 1990 (OPA) and the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA). • Water Pollution Certificate proves you have insurance in case of damage due to pollution, etc.

3) NTVRP (Non-Tank Vessel Response Plan)

NON-TANK VESSEL RESPONSE PLAN • These regulations outline the requirements for submission and approval of oil spill contingency plans for non-tank vessels operating in State waters and the requirements for demonstrating financial responsibility. • A non-tank vessel is described as a selfpropelled vessel of 400 GRT or greater that operates on the navigable waters of the U.S., carries oil of any kind as fuel for main propulsion and is not a tank vessel.

• If crew does not have a visa, I-94 is required. • A Visa Waiver ONLY allows a non-U.S. citizen or Legal Resident entry by commercial carrier (airline).
