TERMS AND CONDITIONS OF MEMBERSHIP

By making payment, you agree to and accept the following terms and conditions of membership:

1. Membership

1.1. Your membership will officially start on the date of your first payment is made

1.2. Your membership is personal to you. You cannot transfer it to another person.

2. Fees

2.1. Payment will be made in monthly instalments

2.2. For as long as you remain an active and paying client, your full price membership fee will not increase for the same level of program which you are signing up for today.

2.3. Your discounted membership fee will remain in effect for the first 12 months of your membership. After that your membership fee will increase to our standard full price fee

2.4. All fees are payable even if you do not choose to utilise your membership.

2.5. All payments are non refundable and non-transferrable except in the cases outlined in section 4.

3. Cancelling Membership

3.1. Memberships cannot be cancelled prior to the agreed contract length that you have signed up for

3.2 You are signing up for a minimum term. Should you wish to cancel at the end of, or after your fixed duration minimum term, you are required to provide a written request to cancel at least 28 days prior to the final payment you wish to make.

3.3. Should you choose to stop attending sessions and utilising your membership, your monthly payments must still be made.

4. Limited Right To Cancel

4.1. During the period of the agreement you may cancel the agreement only:

1. If we fail to maintain the standard of service you would reasonably expect.

2. If we alter the operating hours of the services unreasonably.

3. If you develop a medical condition which prevents you from using the services on an ongoing basis. An appropriate medical practitioner must provide written evidence that this is so.

4. If you move away from the area by a distance which we consider, at our sole discretion, to be too far to travel to the services for regular use. We shall require evidence that such a move has taken place.

5. If you lose your employment and are unable keep up the repayments as a result. You must produce documentary evidence and initially we shall be prepared to suspend payments for up to two months and review with you your financial situation thereafter.

5. Changing the Agreement

5.1. We can change the agreement at any time. We will give you 14 day’s notice of this change in writing at the address you have given us.

6. Facilities and services

6.1. You are entitled to use the services made available to you for your category of membership package.

6.2. Before using any exercise equipment and/or exercising with us you must read and sign the Physical Activity Readiness Questionnaire

6.3. We may need to close the facility or part of it for repair/refurbishment on the grounds of health and safety or improving customer service. Fitness sessions may also have to be cancelled due to unforeseen instructor unavailability. In the above circumstances we will use our best endeavours to:

6.3.1. Give as much notice as is reasonably practicable by informing all members.

6.3.2. Arrange for alternative session times and/or locations during a period of closure.

6.4. Management reserve the right to change the session timetable. Prior notice will be given relating to session cancellations or the introduction of new sessions.

6.5. Missed training sessions will not be transferred or carried over to another week or month.
