Looking Forward ND United keeping an eye on efforts to recruit, retain public employees

At ND United, we are working hard to prepare for the 2022 ND United Delegate Assembly, among other things. For example:

We are closely monitoring and providing information to the Interim Retirement Committee. As you know, this committee has been given the responsibility to develop a plan to close the Defined Benefit (DB) to new state employees on Jan. 1, 2024. What the committee is discovering is that there is not a simple means through which to accomplish its goal.

In fact, the committee is learning from Kansas and Oklahoma that it is an extraordinarily complex process and that any savings the committee is looking for may not occur.

There has been other evidence from West Virginia, which ended its DB plan only to open it up again because closing it was too expensive. The fact of the matter is that we know, based on the Haye’s Group study, that public employees in ND earn 8% to 12% less than their counterparts in the private sector with similar education and training. The DB retirement plan, as well as the health insurance plan afforded to public employees, are excellent tools to recruit and retain the high-quality workforce necessary to provide the vital public services that North Dakotans expect and deserve. We are prepared to fight hard to maintain this important benefit.

I have been asked by AFT’s Randi Weingarten to serve on the AFT Teacher and School Staff Shortage Task Force, and I am happy to do so.

Prior to the pandemic, I viewed this issue as a recruitment and retention issue. After all, ND’s fine colleges of education were graduating plenty of educators to fill the open positions. The issue was that many of them delayed entry into the profession until they found a job in a district that matched their financial and quality of life expectations.

Now, every district in the state is having difficulty finding teachers, paraeducators and substitute teachers. Some districts have resorted to hiring teachers from the Philippines in order to meet their staffing needs.

This task force is looking at the causes of the shortage and will make recommendations to mitigate the shortage and make education a more attractive career option for America’s young people.

I’ll have much more to report at the 2022 ND United Delegate Assembly on April 23 in Bismarck. Until then, thank you for your service to the people of North Dakota. And thank you for your membership in North Dakota United. ndunited.org

STRENGTH IN NUMBERS:

2021 Wins for North Dakota United Members

2021 was a hard year for everyone — especially educators and public employees. But, together, we had some great wins that will lead to better pay, working conditions and benefits.

One thing for sure is that there’s still a lot of work to do. We’re stronger together, and our collective voice can help move the needle toward positive change for educators across the state.

Parental Leave Wins in Valley City & West Fargo We worked together with the Valley City and West Fargo Education Associations to address parental leave.

VCEA successfully negotiated five days paid maternity, adoption and paternity leave, and WFEA negotiated for a separate maternity leave bank of up to five days. This is important work, and while five days is not nearly enough for new families, it’s a small step in the right direction. The fight continues.

Professional Development Expansion We expanded our professional development offering and will organize over 60 different book studies this year to help teachers fulfill their PD requirements. There is a wide range of course topics including things like leadership, classroom management, social justice and practical teaching strategies.

We Secured Public Employee Raises After a year of public employees going above and beyond to keep North Dakota safe and served during the COVID-19 pandemic, NDU members advocated for a 3% pay raise for each year of the biennium because ND’s dedicated public employees have earned it.

We were successful in securing a 1.5% raise for the first year and 2% for the second, but we have more work to do to ensure legislators recognize the outstanding work public employees do every day.

Fought for Increases to K-12 Funding and Won After contentious negotiations, the Legislature passed the bill with everything advocated for by ND United. Our efforts helped secure a 1% increase in the K-12 funding formula in each year of the next biennium. In addition, the language we proposed declaring that 70% of all new monies would go to salary increases for teachers and education support professionals was also adopted. Considering that the House GOP pushed for 0% increases for each year of the biennium, the efforts of our union gave the Senate conferees the support they needed to stand firm.

Defeated Voucher Threats to Public Education Together, we defeated three voucher schemes that would have diverted tax dollars away from our classrooms to private schools and home schools. While we prevented three voucher bills from becoming law this session, if trends from this year follow, we will see even more vicious attacks on public schools and our classrooms.

Your union membership and standing united is a powerful way to ensure North Dakota’s students have the public education they deserve for years to come.

Williston & Williams County Merger When it was decided that these two school districts should merge, it meant scrapping the entire negotiated agreement and starting from scratch.

This could have posed major setbacks to teacher benefits, so the newly formed local association organized and reached out to NDU for help.

Together with NDU staff and attorneys, the Williston Education Association stood strong and rallied the community around teachers.

We managed to retain all the hard-earned elements in their original negotiated agreement.

NDU Received the Best Marketing Campaign Award North Dakota United received the “Best in Show” award at the 2022 NEA State Education Association Communicators Conference for our Everyday Superhero campaign. The campaign couldn’t have been a reality without the amazing work and participation from NDU members. Check out our campaign online at www.ndunited.org/heroes.

This award is part of a national competition for communications professionals that recognizes outstanding writing, design or production of a campaign. This award was the highest honor given — beating out submissions from all NEA state affiliates across the country. ndunited.org

‘Blanketed’ in Honors

Warwick para presented with award, quilts and hugs at school event

By Kelly Hagen, kelly.hagen@ndunited.org For the past 50 years, Deb Bertsch has been a comfort blanket for hundreds — probably thousands — of students at Warwick Public School. Her current job title is classroom paraprofessional, but like so many education support professionals (ESPs) in our state, she’s worn many hats in her decades of service.

“I was at one point the office person that was never in the office,” Bertsch said, “and I kept going through the typewriters back in the day. And they said, ‘We’ve got to get you a heavy-duty one, Deb!’ I’d work closely with the superintendent and the principals to get subs. But whatever, wherever, whenever, (I’ll do it) because we are a system. It is not one person that runs everything; you’ve all got to work together and make it happen.”

It was fitting, then, when Bertsch showed up at the school gymnasium on Nov. 19, 2021, to a surprise ceremony where she was awarded the 2022 North Dakota United ESP of the Year trophy and an honor quilt, just as warm, soft and comforting as she has always been.

“My superintendent, they knew at one point they were going to do it,” Bertsch said. “So, she had seen that quilt and she said, ‘No, that's good. That’s Deb’s quilt.’ They 6

presented me that one that day, and it’s beautiful.”

A month later, Deb was presented another honor quilt at a Warwick High School boys’ basketball game by the Spirit Lake Tribe and an honorary Native American name, C’ante Wast’e Win, which means “good-hearted woman.” “They just called me a couple of days ahead of time and said, because of everything that you have done throughout the years, we would just like to present you with your Native name,” she said. “And they said the proper way to do that is to invite you to a special time where we would do it and we would like to do it at the ball game … I said, that is such an honor.”

The best advice she had for all of the ESPs and educators across our state was to stay positive. “I just always try and keep the positive attitude and stuff because there’s been times when you just stop and you regroup and you stay positive and strong,” she said. “And you know that you’re there for the students, that some of these other things that are going on isn’t what it’s about. It’s the love for the students and the love that they give you back and the respect.

“Stay strong, stay positive. Realize the main reason you’re there is for the students. And just keep smiling.”

NDU Delegate Assembly Set for April

The 2022 North Dakota United Delegate Assembly is planned for April 23, 2022, at Bismarck State College, National Center for Excellence, Bavendick Stateroom.

The NDU Delegate Assembly is an annual gathering of delegates representing the locals and chapters of our union. Together, our delegates will deliberate and vote on leaders, business items, policy matters, resolutions and amendments to our governing documents. Additionally, Delegate Assembly is a great opportunity for members across the state to meet, network and build relationships with their fellow public educators and employees.

Local presidents should have already received an email from President Archuleta announcing the Delegate Assembly. Each local is guaranteed at least one representative. Larger locals are allowed one per 50 members or major fraction thereof.

Please complete and return the Delegate Report Form included with that email ASAP, but not later than April 13. Local presidents should make every effort to have their local represented at the Delegate Assembly.

Each local of ND United should have a process in place to determine who will serve as a delegate. If you are interested in being a delegate for your local or chapter, please contact your local president to find out how.

North Dakota United will be holding elections at the Delegate Assembly for the offices of NDU president, vice president-education, vice president-public employees and NEA director, as well as delegates to the National Education Association’s Representative Assembly in Chicago this July. Exact dates and details were unavailable at press time.

CANDIDATE FOR NDU PRESIDENT: NICK ARCHULETA proudly serves as the President of North Dakota United and has done so since the creation of North Dakota United in 2013.

Prior to being elected ND United president, Archuleta worked as a Spanish teacher at Century High School in Bismarck, a summer school History teacher at Bismarck High School, and as a Spanish and Social Sciences teacher in LeRoy, MN. He graduated from Valley City State University, having earned a bachelor’s degree with a double major in History and Spanish. Archuleta also earned an Advanced Professional Education master’s degree from the University of North Dakota.

In his capacity as NDU president, Archuleta oversees the overall governance of the organization. He works closely with both NEA and AFT regarding their relationships with our state affiliate. He serves as the organization’s spokesperson, as well as its chief lobbyist. Archuleta meets frequently with stakeholder groups such as NDU locals, school boards, the governor’s office, state legislators and a variety of organizations whose goals and missions intersect those of North Dakota United. He also serves on various boards and commissions within the state and nationally. For example, Archuleta serves on the ND Indian Education Advisory Council, the K-12 Coordination Council, and the Prairie Public Broadcasting Board of Directors, among others. Nationally, Archuleta has served, or is serving, on several NEA and AFT committees, think tanks and taskforces, including the NEA Human and Civil Rights Committee, the AFT Teacher and Staff Shortage Task Force, the National Council of State Education Associations, and is the current ViceChairman of the NEA Foundation.

Nick Archuleta was born in San Francisco, and has lived in New Mexico, Colorado and Minnesota. After high school, Archuleta worked several jobs including for Cominco American, a company that produced and marketed anhydrous ammonia. After turning down an offer to accept a position with the company in Beatrice, NE, Archuleta returned to college and earned his teaching degree.

He then accepted a position in LeRoy, MN where he taught for eight years. Upon accepting an offer to teach in Bismarck, Archuleta began teaching at Century HS, where he met and married his best friend, Mary Pat, who served as the Director of Choral Activities at Century High School for many years. They have three grown daughters and one son and make their home in Mandan.

CANDIDATE FOR VICE PRESIDENT-EDUCATION: ALICIA D. BATA teaches on interactive television from Cavalier and Park River to four other high schools in northeastern N.D. She was elected and served as the National Education Association (NEA) Director for N.D. for two terms. She was appointed by NEA’s president to serve on the Human and Civil Rights Committee in Washington, D.C., also for two terms. She was selected to participate in the Magna Carta Human Rights Project

by NEA, in conjunction with the National Union of Teachers (NUT) in England. She was voted by her peers on the NEA Board to be a delegate representing the U.S. at the World Congress of Education in South Africa. Bata is a National Trainer on the ELL Cadre and on the NEA Cultural Competence team. She is also a N.D. presenter of the “I Can Do It” classroom management workshop.

Bata was born in Buenos Aires, Argentina. Her first university degree was as a Literary English/Spanish Translator (Universidad del Salvador, Buenos Aires). She received her Bachelor of Arts degree, teaching certificate, ESL/Bilingual endorsement, and Master of Science degree in Education with a cognate in Bilingual Education from the University of North Dakota. She is married to a N.D. farmer, Bill, and has four children and three grandchildren.

CANDIDATE FOR VICE PRESIDENT-PUBLIC EMPLOYEES: GARY FEIST has been a tax auditor for the Office of State Tax Commissioner for the last 30 years, and currently works in the corporate income tax section. He served as president of the North Dakota Public Employees Association for 12 years and is the current president of the North Dakota Public Employees statewide local. He has held the office of NDU Vice President for Public Employees since 2013, and also serves as Vice Chair of AFT Public Employee Program and Policy Council. He is married, with three daughters, and lives in Bismarck.

CANDIDATE FOR NEA DIRECTOR: BRENDA SEEHAFER is a Title I teacher

from Rolla, where she has been teaching the last 19 years. She previously taught at Wolford and also worked at the UND Lake Region College library. Seehafer has a degree in Elementary Education from Minot State University.

She is currently the NEA Director from North Dakota and serves on the NDU Board of Directors.

She is also currently a co-facilitator for the NEA Enterprise-wide Vision for Leadership Development System Think Tank. She serves NDU on the UPAC Committee, the Resolutions Committee, the Foundation Board, and is a member of the GROW Team. She is also a facilitator for online book studies for NDU’s Professional Development department. She was cocaptain of the Political Action Committee representing ND during the virtual RA in 2021. Brenda is also active at the local level. She is the Rolla Education Association president and is also a local bargainer.

Brenda is the current State President for the North Dakota Literacy Association (NDLA). She is serving in this position for a second year, as well as covering the roles of President-Elect and Past President. She will continue to serve in this position for one more year. She has served in this role previously, as well as in other state level and committee positions for NDLA. She has also helped with planning and putting on statewide NDLA Literacy Conferences and Summer Institutes, which she is doing again for an October, 2022, State Conference. She has chaired the Silent Auction for these events as well. Her local reading chapter is the Chautauqua Literacy Chapter. She is currently the President of the Chautauqua Literacy Chapter and has held this position for several years. She has also served in other officer roles for the Chautauqua Literacy Chapter. She helps promote Literacy projects in her school and in her community.

Brenda is First Vice-President of the North Dakota Delta Kappa Gamma (DKG) organization; she is sharing some of the state responsibilities with the State President. She is also currently one of the planners for their State Conference that will happen in June of 2022. She also has held state officer positions for DKG in the past. She is also currently her local Lambda chapter president. She has held other officer jobs at the local level, too.

Brenda serves on the local Leadership Team at her school. She is also one of the 7th grade class advisors at her school. Brenda formerly served on an ESPB committee called the Program Approval Advisory Committee for several years.

“I was raised on a farm near Drake and attended grades K-12 at Drake School. I received a degree in Elementary Education from Minot State University. Minot State is where I started my involvement in what was then the student program of NDEA and was even the president on that campus for one year. I have several credentials in education, as well.”

CANDIDATES FOR NEA REPRESENTATIVE ASSEMBLY: TIM THUESON is currently a grade 5 and 6 math and reading strategist at the Bakken Elementary in Williston and a member of the Bakken data committee.

He has been a member of NEA-NDU since 1977 and a pre-retired life member since 2000. At the state level, he served on the PR Commission (6 years), Advocacy Commission (6 years) and named an NDU Ambassador in 2009. At the local level, he has been president of 3 different locals, GRC and membership contact (16 years), a negotiating team member, and the building and membership representative in 2 schools. He has been an NDU state delegate to several NDU and NEA representative assemblies. He currently is vice chairperson on the NDU Resolutions committee. He is actively involved in school improvement process in each district that he has worked and has been on several AdvancEd team visitations.

Thueson has received many recognitions over his tenure in teaching, including: Who’s Who Among America’s Teachers (three times); listed in Who’s Who Among America’s Professionals (two times); a Melvin Jones Fellowship awardee; a lifetime member of the North Dakota Firefighters’ Association; four Lions Club International President’s Certificates, and the 2011 Inductee into the North Dakota Lions Clubs Hall of Fame.

Thueson is a member of the Communications, Speech and Theater Arts Association of North Dakota. He helped develop the North Dakota Theater Arts Curriculum Frameworks and wrote curriculum for NASA at the Goddard. He is involved in a local Lions club serving as the treasurer. He has been director and president for the North Dakota Lions Foundation and the North Dakota Lions Eye Bank. Tim graduated Cum Laude from Mayville State University with bachelor’s degree in elementary education.

He received his Master of Science Degree in Education from Minot State University. He is married to Lynell, and they have one son, Mark.

EMILY DISSETTE is an Early Childhood Special Education Teacher (ECSE) at Roosevelt Elementary School in Minot. She has served as local building representative for the Minot Education Association since 2018, NEA RA state delegate in 2019, and Student NDU (SNDU) local and state positions from 2014-17.

She received a bachelor’s degree in Elementary Education and bachelor’s degree in Early Childhood Elementary from University of Mary.

“I was born in Rugby and graduated from Rugby High School. I attended the University of Mary where I double majored in Early Childhood and Elementary Education. I am married to Jordan, who is a diesel mechanic. We have 2 boys (5 and 2 years old.) I am involved locally in the Minot Education Association as a Building Representative. I am also a representative from my school to our Superintendent’s Advisory Committee.” ndunited.org

Public employees like educational support staff, snowplow drivers, and public health employees work hard to support our schools, keep our roads safe, and serve our family members.

But the hard-earned benefits of North Dakota’s dedicated public employees could be at risk because some North Dakota legislators want to eliminate pensions and guaranteed retirement payments administered by the North Dakota Public Employee Retirement System (NDPERS) for new state employees starting in 2024.

The 2021 Legislature tasked the Interim Retirement Committee with concocting the plan, which could put public employee retirement security at risk because removing new employees from the system eliminates the guaranteed funding mechanism that makes the fund work. The Legislature expects to take a final vote in the 2023 legislative session. There are already indications that if NDPERS pensions fall, especially while the fund is on the right track, pensions for teachers and other public employees, including the Teacher’s Fund for Retirement (TFFR), may be next in line.

Before diving in deeper, it’s important to share what’s at stake for all members who have a defined benefit pension.

WHAT DO I GET WITH A DEFINED BENEFIT PENSION (NDPERS or TFFR)?

1. Your future retirement is secure with guaranteed lifetime monthly payments that are easy to predict based on your pay and years of service. The longer the service, the greater the benefit.

2. Retirement payments are guaranteed to the employee.

3. A proven retention and recruitment tool that helps hire and keep dedicated public employees and educators and ensures the quality North Dakotans expect.

4. Includes options for guarantees to ensure family members of a deceased retiree are taken care of.

5. NDPERS and TFFR are professionally managed without risk to the employee.

WHAT WOULD IT MEAN IF MY PLAN IS CHANGED TO A DEFINED CONTRIBUTION PLAN? The Interim Retirement Committee hasn’t made a clear indication as to the final product, but it will likely be a defined contribution plan.

1. Your employer’s contribution ceases upon your retirement, leaving your retirement security at the mercy of the stock market, which could cause payments to run out before your death.

2. Determined by the employer’s limited contribution.

3. Makes it harder to hire and keep good employees, putting quality services at risk.

4. No guarantees for your loved ones after your death.

5. The individual retirement plan is managed at the cost to the employee. The employee bears all risk for the fund’s health.

The NDPERS main plan includes participants across North Dakota United membership, including state employees, city/county employees, educational support professionals and many higher ed support staff. And NDU members are standing together to protect pensions and retirement security.

Members have been central and leading in our organizing and advocacy efforts, which have included talking to colleagues, former co-workers, and family members to make sure they know about potential risks to public employees, retirement security and public services.

So far, the Interim Retirement Committee has moved forward despite new information about a healthy recovery by the NDPERS main fund after compromises and contributions by public employees paid off. The most recent report from 2021 showed that NDPERS is on the right track to being fully funded in 40 years. Having some unfunded liability is common across the country, and being on track to 100% is great news.

But that assessment relies on contributions by and for new state employees who some legislators would prevent joining the plan.

Legislators have not increased benefits in more than 20 years, and public employees have already done their part to shore up the fund. But some legislators are

responding to the good faith of public employees with disrespect and by ignoring testimony from states who created recruitment and retention crises after closing pension plans as well as an example from Oklahoma where states are paying more tax dollars than before closing pensions.

WHAT CAN I DO AND WHAT ARE WE DOING COLLECTIVELY AS NDU ABOUT IT? To ensure legislators understand that public employees at every level are their constituents who also provide public services North Dakotans rely on, North Dakota United’s Capitol team, led by President Nick Archuleta, is engaging with the Interim Retirement Committee and making sure they have information about the true costs of making this change, including the inefficiency of maintaining two systems.

As members, we are responsible for protecting our pensions and retirement security, so public employees, educators and retired members across our union are already speaking out to make sure their colleagues, co-workers and acquaintances know about the threat to NDPERS. That’s how one voice becomes three, and how we build a sustainable campaign that legislators will hear in 2023.
