A Reflection on the Past It’s summer 2019, and all of us at North Dakota United are probably taking a look back at the school year that just ended, while keeping one eye pointed toward what is ahead. United Voices reflects this split focus. We take a look way back, all the way back to 1969 and the effects that were felt by a teachers strike in Minot, 50 years ago. I’m personally so grateful to those teachers who risked everything, and lost their livelihoods, so that future generations of teachers could benefit.

Also, we take a detailed look back at the 66th Legislative Assembly in Bismarck, which just finished up. And we detail the major efforts of faculty and staff at the University of North Dakota, in building

up their own local and taking action to stave off a hike in parking fees.

We’re also looking forward, as we preview a special offer for NDU members to receive free tickets to the ND State Fair this summer, and tell you about a program we are running with First Book to provide free books to educators at Title 1 schools in our state.

We also welcome David Marquardt into our pages, as he will become our new Vice President of Education in July.

President’s Post

Successful at Legislature NDU tracked 166 bills, saw mostly positive outcomes Well, friends, the 66th Legislative Assembly is in the books, and I am happy to report that your lobby team feel that, on the whole, North Dakota United fared quite well. We began the session tracking some 166 bills that we believed were of interest or had an impact on the work lives of our members. Working with our friends in both parties, we were able to secure several favorable outcomes on most of them.

Among the highlights, we: · were quite pleased to have made the case for and played a role in getting an adequate salary increase for state employees. · helped maintain both the PERS health and retirement benefits plans, meaning that public employees will not have to pay premiums for their health insurance and will retain their definedbenefit pension plan. · were able to stop legislation that would allow for the diversion of public monies into “education savings accounts,” or vouchers, for kids to attend non-public schools and universities. · were able to mitigate the effects of a bill that tripled the probationary status of teachers from one year to three years while removing workplace rights for those teachers. This bill would have allowed for a probationary teacher to be fired without obligating the district to meet with that teacher or allow union representation. The final bill was stripped of that offensive language, and the probationary status of teachers was increased by just one year. · were instrumental in passing SCR

4004, a first-of-its-kind study of the issue of disruptive learning in the state. Because of our efforts, the Legislature will study the sharp increase in children arriving at school with trauma that impacts their ability to learn and causes them to disrupt classes and injure teachers, ESPs and other students. · were instrumental in defeating a bill that would have removed the names and missions of institutions of higher education from the ND constitution. · were instrumental in the passage of a school finance bill that increases the per-pupil payment 2% in each year of the next biennium. That means that the $9,646 figure that has been in place for the past three years will rise to $9,839 next year and to $10,036 per pupil by the end of the biennium.

In addition, the bill includes on-time funding for schools in the second year of the biennium among other things that allow schools to retain more money.

To be sure, we did not get everything we wanted, but we are still pleased with most outcomes as they relate to our members. I want to close by thanking every one of our members who worked hard to elect good people, who wrote an email encouraging legislators to vote our way, and who contacted us and stayed connected to our communications as we worked at the Capitol. Hello, my name is David Marquardt and I have been recently elected as your new Vice President of Education. I will officially begin taking over the role after the National Education Association Representative Assembly in July.

I am finishing my 20th year of teaching elementary in Fargo Public Schools. I have been very active in Fargo Education Association, where I am currently on the executive board. I have been president, vice president in past years and will again be president this coming fall. I have been active in negotiations as a committee member and negotiator for several years.

I have also been on the Board of Directors for North Dakota United for the past nine years. My amazing wife is a social worker in the Fargo Public 4

Schools. We have three amazing children who are finishing up their freshmen, seventh and fourth grades.

I truly have a passion for public education. As your vice president, I will be working closely with the NDU Board of Directors on some important issues like teacher and student safety, professional development for all members, and non-member conversations, to name just a few. I hope you will contact me with what you need. I want to hear your voice.

I am proud of what NDU has done for our members and continues to do for us all. It is vital that we continue to build strong relationships with our friends in education throughout our state. I look forward to working with ND and U! I want to wish you all a very enjoyable summer.

Compensation Increase Worth Celebrating

Minimum salary raise will benefit 80% of public workforce

The North Dakota 66th Legislative Assembly ended on the 76th day, and for state employees and higher ed faculty and staff, there are several things to celebrate. Before the session began, Governor Burgum and the Legislature both indicated that state employee compensation would be a priority to ensure that the state would be able to be competitive in recruiting and retaining a quality workforce.

The 2019 compensation package will continue to fully fund the NDPERS grandfathered Sanford Health family insurance premium, and also appropriated a 2% pay raise for state workers in 2019 and 2.5% for 2020.

Many of us would have liked to see a higher percentage appropriation after two years of zeros, but the Legislature did provide a meaningful increase for all employees by fully funding a $120 per month minimum and capping all increases at $200 per month for employees. Salary increases between $120 and $200 will be based on the employee performance. The 2.5% increase for 2020 does not include a minimum or a maximum and will be based on performance.

The $120 minimum is the largest minimum that has ever been granted by the Legislature, which ensures that all full-time employees receive at least a $0.69-per-hour increase. The $120 minimum benefits 79.5% of state employees, while only 46 employees

will be hurt by the $200 maximum.

This is why the increase should be celebrated, as it provides a salary benefit that helps almost all state employees.

The minimum and maximums also apply to faculty and staff at each university, which for the first time in many years will provide a guaranteed equitable distribution of salary increases for higher ed employees.

The compensation package received by state employees and higher education employees also includes a 11% monthly employer contribution to a defined benefit (DB) or defined contribution (DC) retirement plan. The retirement plan includes a retiree health care benefit, which provides an employee with $5 per month for every year of service to purchase any type of health care benefit an employee may need.

The total compensation package passed by the 2019 Legislature was in the spirit of the compensation philosophy passed by the 2011 Legislative Assembly, which stated: “The compensation program for classified state employees must be designed to recruit, retain and motivate a quality workforce for the purpose of providing efficient and effective services to the citizens of North Dakota.� NDU and its members will continue to advocate for compensation that achieves the goal of making the state a place where quality people want to work, and employees feel valued. ndunited.org

50 Years Ago, Minot Teachers Went on Strike

Educators recall how their community was strained by strife felt within profession

It is March 28, 1969, and the Minot School Board has just moved to issue teachers’ contracts in a special session by formally terminating negotiations between the teachers and the board. Negotiations had broken down several days earlier, with teachers unhappy over a decreased rate of increase on their pay. Their superintendent was instructed to issue contracts with a $6,000 base salary and a revised salary schedule, eliminating four lanes – from 10 down to six.

frustrated at how quickly negotiations were terminated. “We could have arrived at a more satisfactory agreement, I believe,” Rudy Zupetz, president of the Minot Federation of Teachers, told the Minot Daily News. “Had the board’s team not insisted upon winding everything up Friday night. They felt they could not keep the news media waiting upon further negotiations.”

Minot teachers were not alone in the frustrations they were feeling 50 years ago, nationally or in the state of North Dakota. An editorial in the Williston Herald from February of 1968 stated that “a new breed of militant educator

is rising in this country,” and quoted Sam M. Lambert, executive secretary of the National Education Association, as saying: “the average male classroom teacher cannot afford to give his family even a moderate standard of living in a large city.”

requested that “negotiations with the Minot School Board on several matters, including teachers’ salary schedule, employment security and restoration of educational programs such as remedial reading and elementary music,” be reopened.

U.S. Bureau of Labor statistics from that year estimated that a household income of $9,200 per year was required for a family of four to live a “moderate” lifestyle.

Fifty years before the #RedforEd movement, which has involved thousands of teachers in several states, including West Virginia, Oklahoma, Kentucky and Arizona, performing similar actions for similar reasons, the North Dakota education system faced a similar reckoning. Teachers across our state, and the United States, felt they weren’t getting the resources they needed in order to give students the quality public education that they were promised.

“Teachers who have lived and taught in communities for a lifetime are putting jobs on the line in an effort for better salaries, which they strongly maintain will result in better education for their community’s children,” wrote Dick Palmer, the editor of the North Dakota Education Association member magazine, The North Dakota Teacher, in March of 1968.

Larry Lane was a young teacher at Jim Hill Middle School at that time. He taught history, geography and basic math, and said that salary then was not his primary concern.

“I think for some of the people it was,” Lane said, “but I was quite young. I guess it was such a free-wheeling time, I had already interviewed a couple of places in California, and they had given me a contract option. We had people flying in from everywhere, from Washington D.C., I don’t know where all. They were just trying to hire up as many as they could get because everybody was looking for teachers at that time.”

On April 2, approximately 150 of Minot’s 430 public school teachers went on strike. According to a news release from the MFT, the teachers

The Minot Federation of Teachers was an affiliate of the American Federation of Teachers, and mostly represented junior high and high school teachers. The Minot Education Association, which consisted mostly of elementary teachers, then had 260 members in Minot and was an affiliate of the National Education Association.

Lane said he wasn’t a member of either association. “I never believed in it,” he said, but when his colleagues went on strike, he joined them at the labor hall for the first two days. “As far as the unions were concerned, I think the Federation supported the teachers a lot,” Lane said.

“I’ve always been union,” Gloria Lokken said. She was an education student at Minot State College, as it was known then, and supported the teachers in their action. “My husband is union, and I’ve always been union,” she said, “so, I continued on page 8

might have had a different attitude than many people, but that’s the only way we could get ahead.”

than anything else. … I was just kind of divorced from it.”

Trading off headlines, splashed across the front page of the newspaper, were stories about the strike and of a catastrophic flood of the Souris River in Minot. The flood would eventually cause millions of dollars in damage to businesses, homes and private property, and displaced thousands of Minot residents from their homes.

Lokken, who was a student at Minot State during the strike, supported the teachers. “When you’re looking at going into an area where you’re going to make your money and make your future, we wanted things to be better for teachers,” Lokken said, “because they weren’t. And it wasn’t fair.”

The strike would continue for a third day as some students returned to classes from holiday on Tuesday, April 8. The school board directed its attorneys to seek an injunction in court against the teachers, and District Judge Roy A. Ilvedson granted the request. In a memorandum opinion of Judge Ivedson, he wrote, “I have determined that it is my duty to issue a temporary restraining order to restrain and enjoin the teachers of the public schools of Minot from engaging in a strike.”

Teachers defied the judge’s order, and some picketed in front of the school administration building. They held signs that read: “Injunction No, Negotiate Yes” and “No Contract, No Work.”

By this time, Lane said he had mostly disassociated himself from the protests.

“That was during the flood, of course,” he said, “and I was fighting the flood. I was on [the picket line], maybe a couple of days. I’d see it in the papers more

As the flood worsened and caused all schools to close April 11 and 12, Judge Ivedson began to call teachers into court to face contempt charges for defying his injunction. The Associated Press reported that 22 teachers were sent to jail, and the Minot Daily News published a list of 125 teachers who were fired. Larry G. Lane was one of the names on that list.

“Because of how young I was, it didn’t bother me at all, being fired,” Lane said. “In fact, it sometimes gets to be almost funny when we talk about it. … But I have no animosity of anybody or any of it.”

Lane said he went on to work for the government in vocational rehabilitation for 38 years, and that all the other teachers who were fired either left the area to continue teaching or changed occupations.

“Most of the people were young, and they went all over the country. I’d seen 8

them come back, periodically.

Lokken would go on to teach in the Minot school district after graduating from college in 1972, and also became a local and state leader in her education associations, including a term as president of NDEA. She said she was inspired by the bravery of those teachers who made a stand for public education and lost their livelihoods for it. “It was a long-held drama,” Lokken said. “If you were in that group, you weren’t hired back to Minot. But it did send our people into understanding that you had to be united and fight for your rights.”

In 1969, the North Dakota Legislature would pass HB 175, enshrining Chapter 15-38.1 into the ND Century Code, titled “Teachers’ Representation and Negotiations.” This is the legislation that gave public school teachers the right to collective bargaining.

The Minot teachers strike is seen as a primary impetus to passing this legislation and a major moment in organized labor history for North Dakota. “It caused our people to fight for their rights later on,” Lokken said.

“Because they saw what happened to the people who were brave enough to stand up for what they believed in, at such an emotional time in so many ways.”

Lane said he wasn’t aware that the stand that he and his fellow teachers took back then had paved the way for the teachers’ negotiations law, but he’s happy to have played a part in that. His granddaughter, Dawn Bodtke, is finishing her 12th year of teaching in Minot at Longfellow Elementary. “She’s a very good teacher,” Lane said, “and she’s reaping some of the benefits of it, I think.”

Bodtke said that her grandfather didn’t talk about the strike too often, but

she did know he had been a teacher.

“His mom was a teacher,” she said, “and we would go visit her one-room schoolhouse in Montana. And I just kind of grew up always knowing I wanted to be a teacher.”

While the MFT folded shortly after the strike, the MEA continued on as the exclusive bargaining agent of teachers in Minot. Their local recently finished 2019 negotiations with the Minot Public School board by agreeing on a two-year contract that will raise their base salary $1,300 in the first year, and $1,500 in the second. This year’s process stood in contrast to contentious negotiations in 2018, which ended in impasse. But teachers stayed in their classrooms and continued to work hard at preparing the next generation of North Dakotans for the future, as they have for the past 50 years, in Minot and across the state. This is a testament to how effective the collective bargaining law has been for educators.

“You can already hear a difference in morale this year in Minot Public Schools teachers compared to last year,” Bodtke said. “It wasn’t us against them this year.

It felt like we were a united front.”

Thanks to the sacrifice of 125 teachers who lost their jobs in Minot back in April of 1969, and those 22 who were sent to jail for their efforts, North Dakota teachers have since made great gains.

“Nobody wants to strike,” Lokken said.

“It took a lot of gumption. ... They knew they were laying down their job.

They were threatened, and they went to jail. I can’t thank those people enough for having the guts to go through with it.”

2019 Legislative Wrap Up

Overall, a win for ND United Members

“While ND United did not get everything we wanted from the

66th Legislative Assembly, we do consider our efforts there to have been successful and beneficial to our members. While we have accomplished much on behalf of our members, we have more work to do and we are up to the task! ” — Nick Archuleta, NDU President

Consider this: We were able to secure adequate salary increases for state employees, protect the free speech rights of higher education faculty on campus, protect the PERS defined benefit pensions that our members deserve, guarantee continued family health insurance without a member contribution, strip the antiemployee language from a ridiculous probationary teacher bill, secure a 2 and 2 percent increase in the K-12 funding bill that will provide $10,036 per-pupil funding in the second year of the biennium, and much more.

FUNDING: House Bill 1003 ND University System Funding Position: Supported Outcome: Passed — ND United was pleased to see that the ND University System’s budget was increased by 6% for the upcoming biennium, especially after the 2017 reduction that led to the elimination of nearly 700 full-time employee (FTE) positions. This biennium’s increase is a step in the right direction and will allow for an increased compensation package for employees, as well as investments in building projects on campuses across the state.

Senate Bill 2006 Income Tax Elimination Position: Opposed Amendment Outcome: Amendment removed during conference committee — This bill, the budget of the tax commissioner, was amended to include language related to using the Legacy Fund to provide for an income tax rate elimination.

That language was removed during conference committee.

Senate Bill 2023 NDPERS Funding Position: Opposed FTE reduction Outcome: FTE restored — The ND Public Employee

Retirement System (PERS) funding bill was going to eliminate a very important position in that office – the full-time employee (FTE) in charge of Medicare Part D, which provides prescription drugs for about 9,000 people in North Dakota. This reduction in staff was put in place by a House appropriations subcommittee, and we were thrilled to help get the position restored during conference committee.

Senate Bill 2265 K-12 Funding & Policy Position: Supported Outcome: Passed — SB 2265 is the K-12 funding and policy bill for schools in North Dakota, and contains many relevant and impactful changes. It increases the per-pupil payment by 2% in year one, and 2% in year two of the biennium.

It converts the school calendar requirement from 175 days to 962.5 hours of instruction for elementary students and 1,050 hours of instruction for middle and high school students. It increases the On Time Funding factor, and works to move all school districts toward being on the funding formula, including allowing districts to keep more of their “in-lieu revenue.” It repeals some of the language related to weather closures but still requires the district to make up hours. It continues rapid enrollment funding for one more year. It appropriates $800,000 for music education grants. And, finally, it provides for the creation of a legislative education funding formula committee to study the K-12

funding formula including the components, adjustments and weighting factors.

Senate Bill 2362 Repayment to the Common Schools Trust Fund Position: Supported Amendment Outcome: Passed — During the middle of the legislative session, news broke that $137 million dollars had been misallocated from the Common Schools Trust Fund over the past decade. Simply, a certain percentage of oil extraction taxes were supposed to go into the Fund, but did not. The amendment to SB 2362 repaid the principal into the Fund as a one-time payment of over $64 million dollars.

RIGHTS: Senate Bill 2320 Free Speech at Higher Education Institutions Position: Supported amendment Outcome: Passed — North Dakota United members were perplexed with this bill, which at first glance seemed to promote a positive, democratic ideal: allow anyone on a higher education campus to have their own ideas and express them freely. However, it had darker undertones of regulating what a professor could say during class time, even making them vulnerable to potential lawsuits if they expressed their ideas. Thankfully, Sen. Erin Oban (D-35) was able to offer and pass amendments that removed the concerning language. Up through the end of the session more attempts were made to amend this bill, but continued on page 12

they ultimately failed, leaving a bill that basically promotes freedom of speech and freedom of assembly on college campuses.

SAFETY: House Bill 1206 & Senate Bill 2172 Guns in Public Places Position: Opposed Outcome: Failed — At the outset of the legislative session, HB 1206 created a Class 1 “exempt” license for concealed carry of firearms in public places.

That bill was defeated in the Senate, but then amended onto SB 2172.

In this iteration, it sought to allow individuals to attain a Class 1 “exempt” license and carry their guns into schools, universities, churches, public places, etc. Thankfully, this terrible idea was again defeated in the Senate.

House Bill 1332 Armed First Responders Position: Opposed Outcome: Passed — HB 1332 allows schools to develop a plan, which must be approved by local law enforcement and the Department of Homeland Security, to be submitted to the North Dakota Department of Public Instruction, for an “armed first responder,” who cannot be anyone with direct supervision of students. There are rigorous training requirements, and the bill was amended to keep these plans confidential. North Dakota United worked diligently to make sure that this armed first responder bill has language in it that says that when a teacher or an administrator is in a school 12

Senate Concurrent Resolution 4004 Study on the Impacts of Violent and Disruptive Behaviors in Schools Position: Supported Outcome: Passed — North Dakota United stands firmly in support of this resolution, which would study “the impact of violent, disruptive and inappropriate behavior within the educational environment perpetrated by students against other students, teachers and other school personnel, and the need to implement a uniform reporting system.” We hope this extremely important topic will be studied during the interim legislative session.

SALARY & BENEFITS: House Bill 1419 Defined Contribution Plan Position: Opposed Outcome: Failed — HB 1419 would have changed the state pension plan into defined contribution, replacing the current defined benefit plan. North Dakota United strongly prefers the defined benefit plan as it ensures our public employee members know ahead of time the exact benefits they will receive.

The bill was amended into a study in the House after NDU President Nick Archuleta and PERS testified on the grave outcomes of the language of the bill. It is such a horrible idea that even the possibility of a study was killed in the Senate.

Senate Bill 2015 State Employee Raises Position: Supported Outcome: Passed — After living and working through a biennium without any raise or compensation adjustment, permanent state employees will now receive of a 2% increase in the first year of the biennium, with a minimum of $120 per month, and a maximum of $200 per month.

Close to 80% (79.5% or 5,504) of employees will benefit from the minimum, while only 46 people will see their increase lowered by the max. Those statistics only include state agencies, and do not reflect higher education. In the second year of the biennium, employees will receive a 2.5% increase, with no minimum or maximum amount.

Senate Bill 2046 Ends Employee Health Insurance Credit Position: Opposed Outcome: Passed — This bill ends the Employee Health Insurance Credit by not covering any public employees hired after 2019. North Dakota United opposes degrading benefits for all of our members – present, past and future.

Senate Bill 2047 Decreases the Multiplier for New Hires Position: Opposed Outcome: Passed

— SB 2047 decreases the multiplier of the PERS plan from 2.0 to 1.75.

The multiplier is used to calculate a public employee’s benefit upon retirement, multiplying their years of service by that number to determine what percentage of their salary they will receive. Again, this bill degrades a current benefit offered to our members, and is one NDU stood firmly against.

Senate Bill 2048 Increases Employer and Employee Contributions to the PERS Retirement Plan Position: Supported Outcome: Failed — SB 2048 would have increased employee and employer contributions into NDPERS by 1 percent each, which is an idea ND United has supported over multiple sessions. This increase would have put the NDPERS defined-benefit pension plan for public employees back on a trajectory to being fully funded. It was turned into a study in the House, but its failure in the Senate has only “further delay(ed) a solution to the PERS funding crisis,” as stated by Rep. Pamela Anderson (D-41) during debate on the House floor.

TEACHING & LEARNING: House Bill 1228 Local Control of Education Position: Opposed Outcome: Failed — This bill sought to add a new section to the North Dakota Century Code, giving school districts sole control continued on page 14

over “the supervision, development and instruction of kindergarten through grade twelve students including course content standards, required instruction, instructional time, assessments, attendance and graduation requirement for students residing in the district …” as well as “the negotiating, employment, termination, licensing and credentialing of teachers and ancillary staff.” In short, without any codes, laws or regulations in place a school would lose its accreditation, causing students to matriculate with a diploma that essentially means nothing outside of that particular school district.

Position: Opposed Outcome: Passed — This bill converts the school calendar requirement from 175 days to 962.5 hours of instruction for elementary students and 1,050 hours of instruction for middle and high school students. It was initiated by its proponents to supposedly allow for more professional development time and remove the role of the Governor to excuse storm days. ND United opposed this bill due to the fact that if it is ever taken to the fullest extent it could mean up to 14 fewer contact days with students each year and the potential effect that could have on contracts.

House Bill 1347 Probationary Period for New Teachers Position: Opposed bill; supported Senate amendment Outcome: Passed

House Bill 1287 Alternative Teacher Certification Position: Opposed Outcome: Passed — This bill amends the part of Century Code that lays out the rules for receiving a teaching license to allow both in-state and out-ofstate (online) alternative teacher certification programs to certify teachers for licensure. The only good news about this bill is that it expires on July 31, 2023.

— While HB 1347 did pass both chambers, at North Dakota United we consider our efforts on our biggest legislative fight of the session to be a win. In its original form, HB 1347 tripled the amount of time that newly hired teachers are kept on probation while simultaneously removing their right to due process

in their second and third years of employment. On the House side, ND United was able to get rid of the language that removed workplace protections, but the probationary period remained at three years. In a lively Senate floor debate, an amendment was introduced to reduce the three year probationary period to two years, which happens to be the same length as the probationary period school principals face.

HB 1347 was undoubtedly an attack on the rights of teachers, and we are thankful the horrific first version of the bill did not hold.

House Bill 1531 Teaching Noncore Subjects Without License Position: Opposed Outcome: Passed — HB 1531 allows for “community experts” without a teaching license to teach in hard-to-fill subject areas, with a permit. These “community experts” would be allowed to teach part-time in any subject except elementary education, special education, mathematics, science, language arts and social studies. ND United followed this bill closely as it enjoyed quite the ride of being amended in Senate Bill 2265, then Senate Bill 2013, before finally ending up in the OMB budget bill, Senate Bill 2015.

In the OMB bill we were able to add language saying that if a school hired someone under these provisions, they would have to enroll them in the teachermentoring program at the expense of the district.

Senate Bill 2025 Statewide Education Strategic Vision Position: Supported Outcome: Passed — North Dakota United has been proud to work with education stakeholders from across the state on this strategic vision. It works to cut duplication of services and ensure that all the stakeholders are working together, on a unified path, for what is best for North Dakota’s students.

SB 2025 grants the Superintendent of Public Instruction the duty of reviewing the strategic vision and reporting to the Legislature, ensuring the cooperation of all stakeholders.

Senate Bill 2142 Establishment of Education Savings Accounts/Vouchers Position: Opposed Outcome: Failed — This bill would have used public tax dollars for non-public education.

Similar to a bill introduced last session, NDU President Nick Archuleta testified vehemently against the bill and it failed by an overwhelming margin.

Senate Bill 2217 Teacher Incentives for Leadership in Education (TILE) Position: Supported Outcome: Passed as a potential legislative study — ND United certainly hopes this study is taken up by the Legislature during the interim because what the TILE bill would do is provide an opportunity for teachers to get into leadership positions without having to leave the classroom and become an administrator. ndunited.org

UND Gets United

NDU members at state’s oldest university form collectively active local

The University of North Dakota is older than North Dakota itself.

Founded in 1883, UND has been a witness to our state’s entire history. Over its impressive tenure, UND has been a hotbed for social consciousness and collective action. The university provided free housing for workers during the Great Depression, and in 1970, over 16

1,500 students gathered to protest the Kent State shootings, still the largest demonstration in UND history.

Making waves is nothing new at UND, and now there is another movement growing on campus to support the indispensable employees that make UND the respected institution of higher learning it is today.

UND United is the local affiliate of North Dakota United at UND. In the fall of 2018, this group took the leap from being a chapter of our statewide ND Public Employees local, to becoming their own local in Grand Forks.

Increasing threats of privatization and a variety of bubbling issues created a sense of urgency for the dedicated NDU members at UND, and they coordinated with NDU organizer Courtney Schaff to create a petition and distribute it across campus, demonstrating opposition to the university’s attempts to privatize the Building Services Department.

The petition garnered over 250 staff and faculty signatures, and the push to privatize Building Services has since lessened. Still, the members at UND knew they needed to keep the pressure on, and that privatization is only one issue among many that needs to be addressed.

UND United President Darin Buri is what you might call a reluctant leader. He wasn’t sure he was the right person for this role, but through the encouragement of his co-workers, he decided to run for President of UND United.

The push toward privatizing Building Services struck Buri as contrary to the mission and values of the University to which he has given close to 20 years of service. The employees tasked with maintaining the physical spaces at UND are trusted with coming in and out of private offices and have access to sensitive conversations and materials.

“We have a relationship with the Building Services staff,” Buri said. “We

trust them because we all have a vested interest in UND and its mission. We know they care about this place and its students. These employees aren’t in the abstract; they are real people with real faces, and we care about each other.”

When these important roles are privatized, that sense of community and accountability can be lost. It was time for everyone at UND to step up.

Tom Peterson has been a Building Services staff member for nine years. He became an NDU member organizer in the fall of 2018 and had a front-row seat to the resistance against privatization in Building Services.

“

I like the feeling that we are all in it together to make positive change.

”

Being supported by his fellow NDU members campus-wide has made a huge impact on Peterson. “I used to think that unions were just about fighting over money and nitpicking, but I realized being a part of a union is about coming together and doing the right thing,” he said. “I love that NDU member meetings give me the feeling of unity across the campus. We support each other, and we are all UND employees.

It doesn’t matter how much money you make; we all want to make the university a great place for employees and students.”

Privatization wasn’t the only issue UND United has faced this past year. Raises have been hard to come by for many public employees, and it’s no different at UND. On top of that, there was a

move to significantly increase parking fees for employees, which would have been economically devastating to many employees. Once again, UND United gathered and took collective action to address these pressing concerns.

A legislative forum was held in at UND in March 2019, and the room was packed with NDU members. “The forum would never have happened without North Dakota United,” Peterson said. Because of the galvanized solidarity UND United had created, legislators took notice.

Buri shared that “the legislators stuck up for our staff and said that they allocated funds so that UND could give raises, not over assess fees like parking for staff.”

After the forum, legislators said that hearing directly from employees was crucial in their decision to implement salary raise minimums, ensuring that raises didn’t leave out vital employees like Building Services staff.

“Senator Kreun called me several times to discuss these issues,” Peterson said, “and he also said that the legislators were talking about the forum and our stories.

I really felt like it made a difference.”

In addition to the legislative forum, two subsequent forums were held about the parking fees specifically, which 18

drew hundreds of concerned employees and community members. UND administration subsequently announced there would be no changes to the parking fees for the 2019-20 school year.

In just under 18 months, NDU members at UND went from not holding regular union meetings to organizing powerful collective actions that resulted in tangible positive results for UND employees campus wide.

“We accomplish something every day,” Buri said. “It’s not just one person complaining anymore, it’s a group of people working on solutions. We went from a bunch of individuals to a united team.”

“I like the feeling that we are all in it together to make positive change,” Peterson added. “We support each other.”

How do we make this momentum contagious (across North Dakota)?

How do we reach across campuses, state agencies, K-12 schools and everywhere in between to come together for change?

UND United President Buri has some closing words of wisdom on the subject.

“You don’t have to be anyone special; you just have to step forward, be willing to talk to people and stand up for what you believe in.”

for our state were selected to attend the National Education Association’s Representative Assembly in Houston this summer. In addition to holding elections, Regional Assemblies are meant to be training and professionaldevelopment events.

President Nick Archuleta opened both assemblies with his remarks about the strong state of our union. He noted that the month of April marks the 50-year anniversary of teacher strikes in Minot that ultimately led to the collectivebargaining law for teachers that our state has followed dutifully since.

In 2019, ND United held two Regional Assemblies, in Fargo on April 6, and in Bismarck on April 13, as is required by our constitution in the years opposite of our biannual Delegate Assembly.

Elections were held for officer positions.

President Nick Archuleta and Vice President of Public Employees Gary Feist were re-elected in uncontested contests.

David Marquardt, Fargo, was elected as the new Vice President of Education, and Brenda Seehafer, Rolla, was elected as NEA Director. Additionally, delegates

Other topics of discussion and trainings held included a Legislative Update, organizing and communications trainings, an update on ND Public Employees Retirement System (NDPERS) and training on racial justice and implicit bias.

NDU teams up with First Book to award books to students in Title 1 schools

North Dakota United teamed up with First Book and the American Federation of Teachers to provide OMG Book Awards grant funding to four Title 1 schools across the state of North Dakota.

Sunnyside Elementary School in Minot was selected, along with Dunseith Elementary School, Jeannette Myrhe Elementary School in Bismarck and Eastwood Elementary School in West

Fargo, to receive grants to purchase books for all their students at the end of the school year and promote summer reading.

At Sunnyside Elementary, they turned their grant into a three-day celebration of reading. Called “Sunnyside Bakery and Books,” they were able to distribute free books and cupcakes to all their students.

and decide if it looks like a book they’re interested in or not at our book tasting and also taste some of the cupcakes,” said Sara Medalen, reading and math interventionist at Sunnyside and member of the Minot Education Association.

The three-day event at Sunnyside included guest readers including former students and Minot’s Fire Chief.

“I love the kids that when they took the books over into our reading area and they read the books, they said, ‘We get to keep these books, forever?’ Just to see that excitement on their face about reading that’s what we want, we want them to enter into the summer months and be excited about reading,” Medalen said.

At Eastwood Elementary in West Fargo, the entire school gathered in their gymnasium for a surprise announcement. They were told that books would be set on carts outside of their classrooms, and they were dispersed by “houses” to go back to their room and pick out a book they like the most.

“Coming from a Title 1 school, a lot of our kids don’t have books at home, and can’t afford to bring those home,” said former fifth-grade teacher and West Fargo Education Association President Kjiesta Moch. “We actually let them pick based on ‘house points.’ The school is divided into four different houses. It’s kind of a Harry Potter concept where they can take a reading quiz or read a book, they get points toward their house..”

Students were then allowed to sit in the hallways and have a “reading party” with

their friends and their new books.

At Dunseith Elementary, each student was able to choose a book of their own to read this summer. “It was so fun to see the students happy with their book, and it is a great way to help promote summer reading,” said Tammy Julson, the school librarian and Dunseith Education Association member.

A kindergarten student had a birthday the day she got her book, and she said, “This is my favorite day ever!”

And at Jeannette Myhre, Bismarck Education Association member and kindergarten teacher Dawn Olson went from classroom to classroom, distributing books to all their students.

“I have personally heard from students that move often that they don’t have books at home. When they move it’s not possible to take personal libraries with, so getting a new book for their own is a special gift,” Olson said.

2019 NDU Foundation Scholarship and Grant Winners Supporting North Dakota United members, dependents of members and students preparing to enter into education as their profession, the NDU Foundation has awarded over $300,000 in scholarships and grants since it gave its first $500 scholarship in 1991.

Dan Hinnenkamp, a retired Grand Forks math teacher and president of the NDU Foundation, recently announced that this year 17 different individuals from across North Dakota will be sharing in nearly $24,000 in grants and scholarships.

“Sorting through more than 75 applications is a daunting task for the Foundation’s Board,” said Nick Archuleta, who is both a member of the Foundation Board and president of NDU. “What we found was a large number of worthy candidates who are helping build a stronger North Dakota.”

The NDU Foundation is an independent not-for-profit corporation which receives it funding from the earnings on five named endowments, memorials and other gifts from members and supporters of Public Education and Public Service in North Dakota. The 11,500 members of NDU annually assess themselves $4 to operate the Foundation.

This year’s list of scholarship and grant recipients are: Olivia Becker, of Bismarck, has been awarded an NDU Horace Mann ND Agents Graduate Education Scholarship.

Becker will receive a cash award of $1,000 to pursue her master’s degree in Elementary Administration. She is a Bismarck native who obtained her degree in Elementary Education from the University of Mary in 2014. She started teaching at Saxvik Elementary School and recently was nominated for the 2018 Bismarck/Mandan Teacher of the Year. She is connected with educators all over the world through social media and hopes to be a school administrator in the future.

McKenzie Carson, of Walhalla, has been awarded an NDU Member/Dependent Scholarship. Carson, the daughter of Jana Carson, Walhalla, will receive a cash award of $1,000 for her freshman year of nursing study. Carson currently attends North Border-Walhalla High School and is planning to pursue nursing at the University of Jamestown. She worked in an ambulance service and has a strong interest in the medical field. She has an extensive amount of community

service and is focused on going into emergency medicine.

Debora Dragseth, Ph.D., of Dickinson, has been awarded the NDU Workplace Innovation Grant. Dr. Dragseth will receive a cash award of $305 for running a scholarship program at Dickinson State University. She is a professor of Business Administration. This will be her 13th year of teaching at Dickinson State University. She is a contributor to The Scholarship Corner, which was incepted in January 2019.

Mariah Fitterer, of Bismarck, has been awarded an NDU Education Scholarship and a Gary and Cindy Rath Scholarship. Fitterer, the daughter of Keith and Alice Fitterer, Bismarck, will receive a cash award of $1,750 for her senior year at Dickinson State University. She attended New Salem-Almont High School and is currently pursuing her Elementary Education degree at Dickinson State University with a Early Childhood endorsement. She has been a private tutor for elementary school students since August 2018 and is a co-owner of Fitterer’s Fireworks in Glen Ullin.

Fitterer firmly believes each connection with a student is important, and one of her major goals is to help each one to reach his or her fullest potential.

Weston Gunther, of Jamestown, has been awarded an NDU Education Scholarship.

Gunther, the son of John Gunther, Jamestown, will receive a cash award of $1,000 for his junior year of English

Education study. He attended Devils Lake High School and is currently pursuing his English Education major at the University of Jamestown. He is also a minor in History. Gunther lived in Yemen and China, and he aspires to be an international educator.

Erik Holland, of Bismarck, has been awarded the NDU Workplace Innovation Grant. Holland will receive a cash award of $500 for a professional development program for teachers to learn about North Dakota history. He has been the Curator of Education at the State Historical Society of North Dakota since April 2010. He studied Archaeology and Anthropology at the University of North Dakota and at the University of Wisconsin-Milwaukee, and he received his Master of Arts degree in History with certificates in Public History and Museum Studies.

Benjamin Kensok, of West Fargo, has been awarded an NDU Education. Kensok, the son of Amy Kensok, West Fargo, will receive a cash award of $1,000 for his freshman year of Music Education study. He is a senior at West Fargo Sheyenne High School. He plans to pursue a degree in Music Education and a minor in Jazz Studies at the University of North Colorado. He gives music lessons to middle school students and plays piano at Holy Cross Catholic Church.

Jill Kvilvang, of Valley City, has been awarded an NDU Horace Mann ND Agents Graduate Education Scholarship.

Kvilvang will receive a cash award of $1,000 to pursue her Master of Education degree in curriculum and development. Kvilvang graduated from high school from Verona Public Schools in a class of only 10 students. She then obtained her Elementary Education degree from Valley City State University in 1992 with a minor in Early Childhood and a kindergarten endorsement; at the University of Jamestown, she earned her Master of Education degree. Her first teaching job was in Belcourt, but now she currently teaches second grade in Valley City. She is also a single mother with two sons serving in the Armed Forces.

Alyxaine Mansfield, of Dickinson, has been awarded an NDU Member/ Dependent Scholarship. Mansfield, the daughter of Shari Mansfield, Dickinson, will receive a cash award of $1,000 for her freshman year of nursing study. Mansfield is currently a senior at Dickinson High School and plans to pursue nursing at the University of North Dakota. Her mother is a Special Education teacher and Mansfield hopes to work with and improve the lives of children for her career in the medical field.

Paige Meyer, of Valley City, has been awarded the Mary Cripps Special Education Scholarship from the North Dakota United Foundation for the 2019-20 year. Meyer will receive a cash award of $750 toward her study in education. Meyer majored 26

in Elementary Education through Valley City State University and is currently attending the University of North Dakota to obtain her Master of Science degree in Special Education.

She believes that special education is her true calling and hopes to stay in North Dakota as a special education teacher.

Meyer said, “Teaching is not only my career, it is my passion,” and she believes her most important objective as an educator is to make her students into lifelong learners.

Sara Phan, of Fargo, has been awarded the NDU Foundation Ethnic Minority. Phan, the daughter of Trac Phan, Fargo, will receive a cash award of $750 for her junior year of study in education. Phan attended Fargo South High School and is currently a sophomore at North Dakota State University. As an Elementary Education major, she believes every student is different in his or her own unique way. She discovered her calling to teach after a visit to her first-grade teacher’s classroom. She has made the Dean’s list in college three times and has an extensive volunteer experience.

Anna Roaldson, of Bismarck, has been awarded an NDU Member/Dependent Scholarship. Roaldson, the daughter of Janine Roaldson, Bismarck, will receive a cash award of $1,000 for her freshman year of study. Roaldson is currently a senior at Bismarck High School. Due to her interest in the medical field, she plans to pursue a Doctorate of Physical Therapy at the University of North Dakota.

Katie Sather, of Valley City, has been awarded the Mary Cripps Special Education Scholarship. Sather will receive a cash award of $750 for study toward receiving her Master’s of Special Education degree. She originally worked in banking and landed a management role. It was while holding that leadership position when she realized her interest in teaching. She was already a mother even while she was completing her undergraduate studies in education; in her last semester, she gave birth to her third child. Sather is always open to learning, cherishes connections with students, and wants every student to know that his or her teacher cares.

Marissa Schuldheisz, of West Fargo, has been awarded an NDU Education Scholarship.

Schuldheisz, the daughter of Kevin and Jennifer Schuldheisz, West Fargo, will receive a cash award of $1,000 for her senior year of Elementary Education study. Schuldheisz graduated from West Fargo High School in 2016 and is currently a junior at Mayville State University. She is pursuing a minor in Early Childhood Education and has made the Dean’s list for every semester during her time in college. She is the daughter of an elementary school principal in Fargo.

Christopher Strand, of Hatton, has been awarded the Ron & Ann Anstrom Scholarship for English, Math or Science Instructors. Strand will receive a cash award of $5,000 for his Master of Arts

degree in Secondary Mathematics Education. Strand comes from a family of teachers, and both of his parents were proud educators. He has taught in both big and small schools and is currently in his eighth year of teaching.

From his experience, he believes there is a strong value of community in small-town North Dakota.

Allison Thomes, of Fargo, has been awarded the Ron & Ann Anstrom Scholarship for English, Math or Science Instructors. Thomes will receive a cash award of $5,000 for her Masters of Arts degree in Science Education.

Thomes attended North Dakota State University. In the spring of 2016, she graduated with her Bachelor of Science degree in Biological Sciences and Biological Sciences Education and a minor in Chemistry. She currently teaches biology and STEM physical science at West Fargo High School.

Katherine Tolstad, of Souris, has been awarded an NDU Horace Mann ND Agents Graduate Education Scholarship. Tolstad will receive a cash award of $1,000 to pursue her Master’s degree in Family and Consumer Science Education. She graduated from North Dakota State University in May 2008 with a Bachelor of Science in Family and Consumer Science Education. One of her career goals is teaching life skills to her students.

Previously, Tolstad taught at Bottineau High School, but is currently at Westhope High School. She is in her 11th year of teaching.

It’s Finally Here!

Spring, I mean. I didn’t know for a while if Mother Nature was going to skip spring and head right back to winter.

For those of you who thought I meant the school year or work career, it too will soon be over. Last week, my neighbor boy told me that he has 21 more days of school left. He is excited to finally to be able to done with 6th grade. I smiled at him when he told me the days and his plans.

All I could think of what his teacher or bus driver or you are thinking of the last days for your year. For many of you who are retiring soon, the list of lasts have been underway for a while. My last meeting, my last field trip or bus trip, or…. you can add to this list. One thing that won’t be your last is your life-long dedication to your profession and union. You can continue your involvement by joining

the ND United Retired organization.

As you have read many times this year, I have informed you the life-time dues are going up $50.00 starting on September 1, 2019. This is a national not state increase in dues.
