THANKFUL FOR WHERE WE CAME FROM, WHERE WE ARE, AND EXTREMELY EXCITED ABOUT WHERE WE ARE HEADED
Iam not sure where 2024 has gone. As I sit down to write my final article as President for the UCON Magazine, I am amazed by the fact that 2024 will be over in less than a month and a half.
In just two weeks (from now), Thanksgiving will arrive, marking the beginning of the holiday season. Thanksgiving is one of my favorite holidays because it serves as a time to look back upon the year and reflect on where I am. Where I am as a father to my two daughters, Claudia and Ella; as a husband to my wife, Amy; as a leader at McGuire and Hester; and as a member of my community, including my involvement with UCON.
I will keep my comments brief on the family side, but I am so grateful and appreciative of the love and support I have from my wife and two daughters. They are my biggest fans (and I am theirs), while also challenging me to be a better version of myself. Amy and I are so blessed to be a part of our daughters’ lives as they start their careers in NYC. I am also thankful to have my wife and best friend by my side for the last 27 years, and am so excited to see where the next 27 years take us.
Reflecting upon my time at McGuire and Hester, I am amazed at how far we have come. When I started working full-time in 1993, we had ~45 employees, and now we have over 600. We were 100% family-owned in 1993 and in 2024 we are celebrating over 20 years of being 100% employeeowned. In 2026 McGuire and Hester will be in business for 100 years. I am immensely
proud and thankful to be a part of the leadership team that steers our company into its 100th year of existence.
Looking back on 2024, it has been an incredible year for UCON! From a membership perspective, it has been off the charts, and we are in great financial shape for 2025 and beyond. When I joined the UCON Board in 2018, the board was contemplating a move to Southern California. It is amazing to see that 6 years later we are now a prominent voice for contractors in the region. The UCON brand and expertise is being sought out by many contractors. Unions are also referring UCON to their signatories. There is no dispute, UCON is the strongest voice representing Union Contractors statewide and we plan on growing stronger.
This year, UCON’s CEO, Mark Breslin, announced his plans to retire at the end of 2025—ready to turn the reigns over to the next generation (scan the QR code to listen to his video message). Mark will dedicate 2025 to make this transition to new leadership as seamless as possible. Although a new CEO has not been selected, I am extremely confident that under Mark’s guidance, as well of that of existing and past board members, we will find and empower the next CEO to continue to make this organization standout and be a leader in our industry for years to come. The organization has shown its value and commitment as noted in the UCON member satisfaction
survey results (enclosed with this issue). We thank all of you for taking the time to complete the survey. Your input is important in shaping the direction of the association— your association, your voice.
In closing, I feel truly blessed and thankful for where I have been and where I am now, and I want to reiterate that the future looks bright. I am grateful for the privilege of serving on the UCON Board. And I would like extend my gratitude to each one of our 2024 Board Members (shown in the sidebar on the opposite page) for your support, and dedication, as well as your sharing of your knowledge and leadership. You have elevated
the organization throughout the year. This role provided me the opportunity to forge meaningful relationships with all of you, and learn from varying viewpoints, an experience that I will treasure for many years to come.
I wish you, your family, and your company Happy Holidays, and I look forward to seeing you all in 2025.

2024 was a year of talent expansion and growth for UCON labor relations. We added two professionals— Director of Labor Relations Derek Borghi and Labor Contracts Manager Liz Castro—to our Labor & Member Services team in order to continue providing the firstclass service that our contractor members have come to expect.
We created new company-specific training offerings on key labor relations and union contract issues, like subcontracting, payroll rules, pre-jobs, Skilled & Trained
Workforce, jurisdictional disputes, and dispatching / hiring rules—which we provided for free to all UCON members upon request.
Finally, we recently held a two-day multi-association negotiations training to provide both seasoned and novice negotiators with a solid foundation and new tools for collaborative negotiations.

The following are some key new employmentrelated laws that impact California construction employers. These laws become effective January 1, 2025, unless stated otherwise. A more detailed Endof-Year Bulletin is being sent out to our contractor members. Information on new legislation that impacts our industry is featured in the Legislative Scorecard on pages 20-23.
AB 1034 extends the Private Attorneys General Act (PAGA) exemption for unionized construction employers until January 1, 2038. This means employers with certain qualifying collective bargaining agreements can continue to avoid specific PAGA-related litigation, such as claims for unpaid wages, missed meal and rest breaks, and other labor code violations. Without the exemption, these claims can be costly, as PAGA allows employees to bring lawsuits on behalf of other workers, potentially leading to significant penalties and settlements. All of UCON’s CBAs have PAGA exemption language that we have negotiated with our union partners, and UCON was heavily involved in securing this extension.
Employers in California can no longer require employees to use their accrued vacation time before accessing benefits through the state’s Paid Family Leave (PFL) program. PFL provides wage replacement for individuals taking time off to care for seriously ill family members, bond with a new child, or support a family member in the military. This change allows employees to access PFL benefits directly, without first depleting their vacation leave.
SB 1100 restricts employers from requiring a driver’s license for job applicants unless driving is a core job function and no alternative transportation methods are viable. This new requirement could affect job postings and hiring practices, particularly in construction roles that may involve travel but not necessarily driving duties.
SB 988 introduces new protections for independent contractors. It requires written agreements for freelance workers performing services valued at $250 or more and mandates timely payment terms. Employers need to maintain these records for at least four years. This affects construction companies that frequently use independent contractors for specialized projects, ensuring clear terms and payment practices.
SB 399 will prohibit employers from holding “captive audience” meetings, which are mandatory sessions where employers discuss religious or political matters, including unionization. This means that employers can no longer require employees to attend such meetings under threat of adverse actions, such as discipline or termination. This change primarily aims at protecting employees’ rights during union organization efforts, impacting how employers can communicate their stance on unionization, but it does have other impacts on employer communications as well.
In accordance with previously enacted state law and to account for inflation, California’s state minimum wage will increase to $16.50 per hour on January 1, 2025. This increase applies to all employers, regardless of size. Annual minimum wage adjustments are based on the Consumer Price Index (CPI), with increases capped at 3.5% to address inflation.
• Written Notices: If any non-union, nonexempt employees’ pay rates will change due to this increase (or for any other reason), employers must provide written notice to those employees within seven (7) calendar days of the change.
• Exempt Employees: The minimum salary thresholds for exempt employees are also impacted by this increase and should be reviewed to ensure compliance.
• Local Minimum Wages: In localities with their own minimum wage (e.g., San Francisco, San Jose, Oakland, and many other cities), employers should review rates for non-union, non-exempt employees, as these may exceed the state minimum wage. Note that local minimum wage increases do not affect exempt employees.
Union wage rates typically remain well above the state minimum wage, but to comply with various state laws, these rates must be at least 30% above the state minimum wage. UCON has successfully added language to many of our union agreements to ensure automatic adjustments to any rates (e.g., pre-apprentices, apprentices, travel time rates) that may fall below this 30% threshold due to annual state minimum wage increases. In cases where automatic adjustments are not included, UCON has secured special side letters to keep our collective bargaining agreements (CBAs) in compliance.
For 2025, the minimum rate that meets the 30% threshold is $21.45. Revised rate sheets were sent out to signatory members and have been posted for one or more classifications/rates in the following agreements:
• Carpenters (S. CA) Master Agreement
• Carpenters (San Diego) Building & Engineering Agreements
• Laborers (N. CA) Master Agreement (Travels rates in both Supp. No. 2 and Supp. 7)
• Laborers (N. CA) Traffic Control / Highway Improvement Agreement
• Laborers (N. CA) Landscape/Irrigation Site Work Agreement
• Laborers (S. CA) MLA – General Construction Worker Classification Agreement for Private Work
• Laborers (S. CA) Landscape Agreement
• Laborers (S. CA) Parking and Highway Improvement Agreement
• Laborers (S. CA) Utility Agreement
There are mandatory changes for 2025 to several of the required notices. California employers also must post the Wage Order that applies to their business operations, as well as any notices required by local ordinances (such as in the cities of San Francisco, San
Jose, Oakland and Emeryville) or work on federal projects. You may also need to post unique posters depending on your business model.
UCON is continuing to partner with Labor Law Compliance Center to provide UCON members with updated posters at discounted rates. Contractor members will also be sent one free poster as a member benefit. A notice with information on how to order is posted in the UCON Contractor Resources Library (search using the word “poster”). Don’t forget that all California employees with five or more employees must provide harassment prevention training to employees upon hire and every two years after that. Supervisory employees must receive two hours of training while non-supervisory employees must receive one hour of training. This training can be provided by the unions, but not all unions are set up to track this information, and ultimately the employer is responsible for ensuring that the training occurs as required.

United Contractors (UCON) represents unionsignatory construction employers across California, relentlessly advocating for our members and the future of union contractors. Our annual Legislative Scorecard highlights the critical legislation we supported or opposed this year and showcases the return on investment (ROI) of UCON’s advocacy in Sacramento. Thank you to UCON’s Legislative Advisory Committee for your work in steering our positions throughout the legislative year.
The 2024 legislative session ended on September 30, with Governor Newsom completing his final actions on proposed laws. UCON had another successful session, headlined by significant reforms to the Private Attorney General Act (PAGA), including an extension of the PAGA carveout for union construction—our top priority. This carveout, signed into law, allows unionsignatory contractors to eliminate PAGA lawsuits through collective bargaining agreements (CBAs), saving millions of dollars and countless hours in litigation often initiated by opportunistic employment attorneys using PAGA as leverage.
In a challenging political climate, UCON’s primary goal is protecting the integrity of industry CBAs, which are critical for union contractors to remain competitive. State-mandated deviations from these agreements erode our members’ ability to compete, recruit workers, and organize contractors. Defending the sanctity of CBAs is a top legislative priority.
With a supermajority of Democrats in both houses, California’s political climate presents significant hurdles for employers. Many progressive bills—often environmentally slanted—can negatively impact our contractors and the industry. UCON is focused on defeating or amending harmful legislation to safeguard our members’ bottom lines. Despite these challenges, UCON successfully blocked or amended numerous bills that would have had detrimental effects on our industry.

This article is a look forward into how environmental regulations will impact UCON members in 2025 with some 2024 context.
New environmental regulations were advanced in 2024 in both air and water quality. The new Construction Stormwater General Permit went into effect in late 2023. The permit’s requirements have now been in effect for an entire calendar year.
2024, CALIFORNIA AIR RESOURCES BOARD’S (CARB) CLEAN TRUCK CHECK (CTC) PROGRAM STARTED REPORTING AND FEE REQUIREMENTS.
In 2025, the CTC program begins requiring non-gasoline vehicles with GVWR greater than 14,000 lbs. to be tested twice per year. Failure to perform the tests will result in registration holds at the DMV and possible fines. Expect disfunction for this program, since after all, both CARB and DMV are involved in this one.
CARB also has other regulations that are stuck in enforceability limbo. For certain regulations, CARB needs a waiver from the United States Environmental Protection Agency (USEPA) to have the authority to enforce. The highest profile of these is the Advanced Clean Fleets (ACF) regulation. The first requirement for high-priority fleets (those
companies with 50 vehicles with GWVR greater than 8,500 or have $50 million in annual revenue) to report was in 2024 and the first requirements to have Zero Emission Vehicles begin in 2025.
Another regulation that had its first requirements take effect in 2024 and requires a waiver from USEPA is the adopted amendments to the Off-road Diesel Regulation. Certain new provisions within these amendments like the new restrictions for adding certain vehicles with cleaner engines to fleets and the phase-out of vehicles with Tier 0, 1 and 2 engines require this waiver. The new administrative requirements, like those for project owners and prime contractors, are likely already enforceable. It is unclear whether the mandate to fuel subject off-road vehicles with renewable diesel (R99) is enforceable without the waiver.
It is not likely that USEPA will be issuing the waivers for these CARB regulations in 2024. If they are issued in 2025, it will probably be just before the administration changes on January 20, 2025. It is well known that the incoming administration will resist California’s push for the waivers and its progressive environmental agenda. Although California’s movement to mandate a shift to zero-emission vehicles may slow or stall, it is not likely regulations will be rolled back.

On Saturday, November 9, 2024, United Contractors celebrated its 35th Annual Advocacy Auction with a Cuban-inspired event, Havana Nights. The Claremont Club & Spa in Berkeley came alive with the rhythms of a 10-piece band and the vibrant energy of salsa dancers, creating an electrifying atmosphere for all attendees.
Guests were greeted to the fiesta with a champagne welcome and enjoyed the auction’s signature mojito cocktail and guava daquiri mocktail while bidding on the silent auction items. Once it was time for dinner, a conga line escorted guests into the ballroom where the energy was turned up. As the auctioneer took the stage, the atmosphere in the ballroom became one of excitement and competition. Bidding wars began, donors doubled down, and over $325,000 was raised! Está volao!
These funds will be used for UCON’s aggressive government advocacy efforts, enabling UCON to continue its legacy of taking action and delivering results for the construction industry.
