ENTRE VILLES ET BORD DE MER Ces temps de crise sanitaire ont été difficiles pour tout le monde à travers le globe, quel que soit le lieu ou les circonstances socio-économiques. Une chose que nous avons tous apprise : nos foyers sont plus que des simples endroits pour dormir, ils sont le centre de nos familles, le reflet de nos personnalités, un endroit à vivre dans le sens le plus large du terme : un environnement pour travailler et exister, certes, mais aussi pour se ressourcer et renouer, avec nous-mêmes, nos familles, des valeurs délaissées et peut-être même la nature ! Le marché de l’immobilier de luxe s’est révélé extrêmement résistant pendant cette période : non seulement l’immobilier de luxe est considéré comme un investissement alternatif, mais de plus en plus de personnes ont également le souhait de «surclasser» leurs logements et donc la qualité de leur vie : soit en recherchant une résidence principale plus grande, mieux située ou offrant des atouts supplémentaires, ou des résidences secondaires qui sont, littéralement, des havres de paix, surtout pendant des périodes difficiles. This unprecedented pandemic has been challenging for everyone around the globe, no matter what their location or the social – economic circumstances. Grande nouvelle ! L’organisation et la tenue de la 161ème édition de la vente aux enchères des Hospices de Beaune ont été attribuées à Sotheby’s et ce pour les 5 prochaines années ! Fier de cette nomination, Jamie Ritchie, Directeur Mondial Sotheby’s Wine, déclare : «Il n’y a pas de plus grand honneur pour notre équipe internationale que d’organiser la plus célèbre et la plus ancienne vente aux enchères au monde. Depuis 1859, cette vente fixe les prix pour le nouveau millésime en Bourgogne, agissant comme une référence pour tout le marché.» Cette vente caritative qui reste fidèle à ses valeurs fondatrices voit l’institution verser chaque année à une œuvre caritative les profits de la vente de la «Pièce du Président», tandis que le produit sert à l’entretien du patrimoine ainsi qu’à la modernisation des équipements et bâtiments hospitaliers.

The proceeds are used to maintain the hospital’s heritage and to modernise its equipment and buildings. 2021, L’ANNÉE QUI VA BATTRE TOUS LES RECORDS EN IMMOBILIER DE PRESTIGE 2021, THE YEAR THAT WILL BREAK ALL RECORDS IN PRESTIGIOUS REAL ESTATE Animés par deux motivations majeures qui visent à améliorer leur qualité de vie et à investir dans une valeur refuge, les Français continuent à investir dans l’immobilier de prestige. Driven by two major points, aiming to improve their quality of life and invest in safe investments, the French continue to invest in prestigious real estate.
Il suffit de regarder les chiffres qui parlent d’eux-mêmes, puisque Sotheby’s International Realty France - Monaco, a réalisé en 8 mois un volume de ventes de 910 millions d’euros, soit une hausse de 43% par rapport à la même période l’an dernier. A la fin du mois d’août, le réseau avait finalisé plus de 660 ventes à un prix moyen de plus de 1,37 million d’euros. «2021 sera sans doute l’année de tous les records en matière d’immobilier de prestige.», s’étonne son PDG, Alexander Kraft. «Nous avons d’ores et déjà plus de 300 millions d’euros de transactions dans les tuyaux, qui devraient se concrétiser d’ici la fin de l’année. Il est donc très réaliste de penser que nous allons dépasser nos résultats records de l’année 2020 en 2021 avec une hausse du volume de ventes entre +30 et +40%.»
Retour des acheteurs étrangers On note également le retour des acheteurs étrangers sur le marché immobilier de prestige français. Avec pour l’instant surtout des Européens, mais, depuis fin juin, de plus en plus d’Américains se repositionnent sur des biens, dans leurs zones de prédilection, à savoir à Paris et dans le sud.

Un marché sans ralentissement Nombreux sont les acquéreurs français qui souhaitent ajuster leur mode de vie en achetant plus grand, plus vert, plus au calme, avec un espace bureau pour télétravailler. Quand d’autres opèrent un véritable changement de vie et déménagent. «Nous avons vécu la rentrée la plus active de ces 20 dernières années. L’enthousiasme des Français pour l’immobilier de prestige en général et pour les résidences secondaires en particulier s’est maintenu.»

A market with no signs of slowing Many French buyers want to adjust their way of life by buying larger, greener, quieter properties, with an office space to work from home. Others are making real life changes and moving. "We have had the most active income in the last 20 years. The French buyers’ enthusiasm for prestigious real estate in general and for secondary residences in particular has persisted." The return of foreign buyers We also note the return of foreign buyers to the French prestigious real estate market. Liant à jamais Claude Lelouch et son film culte Un homme et une femme à l’élégante station balnéaire de la Côte fleurie. Une ville qui fait partie intégrante de son histoire, puisque depuis toujours il vient s’y ressourcer. «La Normandie c’est un peu ma pharmacie, et la maison que j’y possède depuis 50 ans, mon refuge». Un sentiment partagé par sa compagne la romancière Valérie Perrin qui durant deux décennies, prit plaisir à vivre ici. «J’ai besoin de cette mer et de ces terres où mes enfants ont fait leurs premiers pas.» C’est en Bourgogne cependant, région où sont ses racines, que Valérie fait évoluer ses personnages de roman. Justine et Violette Toussaint qui les premières, lui ouvrirent grand le cœur du public, mais encore Etienne, Nina et Adrien, les protagonistes de son dernier livre TROIS, sorti au printemps dernier. Chabadabada Chabadabada… For 55 years these love birds have been whispering this famous French tune to each other along the promenade in Deauville, forever linking Claude Lelouch and his iconic French film ‘Un homme et une femme’ to the elegant Côte Fleurie seaside resort. The town is an integral part of his history, having always gone there to recharge his batteries. "Normandy is like my pharmacy, and the house I have owned there for 50 years, my refuge." A feeling which is shared by his partner Valérie Perrin, the novelist who enjoyed living there for 20 years. "I need this sea and these lands where my children took their first steps.” However it is in Burgundy, from where she originates, that Valérie develops the characters within her novels: ‘Justine and Violette Toussaint’, for whom the public first opened their hearts, but also ‘Etienne, Nina and Adrien’, the protagonists from her last novel ‘TROIS’, which was released last spring. Although currently a full-time author, Valérie is also a screenwriter, which is a good way to fuel long discussions on their respective works of art. And there are many! Claude Lelouch’s 50th film, ‘L’Amour c’est mieux que la vie’ will be released in January, whilst Valérie starts the preparatory work for her next novel.

FLORIAN BARTHÉLÉMY, CHASSEUR ET ARMURIER PASSIONNÉ FLORIAN BARTHÉLÉMY, PASSIONATE HUNTER AND GUNSMITH Né dans une famille de non-chasseur, Florian Barthélémy s’est fait un nom, à moins de trente ans, dans le petit monde de l’armurerie. Nichée au cœur de la Sologne dans le village de la Ferté Saint-Aubin, l’Armurerie Barthelemy & Co fait partie de ces bonnes adresses qui se transmettent dans les camps de chasse. Mais également aux quatre coins de la planète, lors d’échanges entre collectionneurs. C’est dire le talent de ce jeune homme, sorti major de promo de l’école d’armurerie de Saint-Étienne en 2011. Puis formé chez les plus grands, tels que Lebeau-Courally à Liège et Hartmann & Weiss à Hambourg. Nostalgique de la France, Florian Barthélémy reprend à 26 ans «La Canardière», une ancienne quincaillerie solognotte transformée en armurerie. Un lieu où depuis cinq ans, l’entreprise fait perdurer un précieux savoir-faire, celui de l’armurerie fine de luxe, en perte de vitesse depuis 1900. Dans ces deux grands ateliers, cœur de l’armurerie, on discute techniques au coin du feu. Florian Barthélémy was born in a family of non-hunters and made a name for himself in the small world of gun making before the age of thirty. Nestled in the village of La Ferté Saint-Aubin, in the heart of Sologne, the Armurerie Barthelemy & Co is highly recommended and a name that is shared in hunting camps. It is also shared around the world, during discussions amongst collectors, which speaks for this young man’s talent, who graduated top of his class at the Saint-Etienne Gunsmith School in 2011. He went on to train with the best, such as Lebeau-Courally in Liege and Hartmann & Weiss in Hamburg. Nostalgic for France, at the age of 26 Florian Barthélémy took over ‘La Canardière’, an old DIY shop in Sologne and turned it into an armoury. A place where, for five years, the company has been nurturing the precious skill of making fine luxury weapons, which has been losing momentum since the 1900s. In these two great workshops, which are the heart of the armoury, techniques are discussed by the fire. We claim back weapons, recondition them, check they are in compliance with norms, refine the settings, perfect the engravings… but above all we live by our motto: ‘A quality armoury at the service of your passion.’

Maître Christophe Huet, lawyer at the Paris Bar, founding partner of the Paris business firm Huet & Associés, brings us his expertise in the matter of taxes specific to property tax (Impôts sur la fortune immobilière: IFI).
Quels conseils donneriez-vous à nos lecteurs pour anticiper les enjeux de l’IFI? L’IFI est calculé sur la différence entre la valeur vénale du bien au 1er janvier et le solde des emprunts souscrits pour son acquisition et sa rénovation. En cette période de taux d’emprunts faibles, un acquéreur peut privilégier le recours à l’endettement afin de limiter la base imposable à l’IFI, étant précisé qu’il existe néanmoins des restrictions fiscales à cette déduction (ex : prêts familiaux, etc.). L’IFI étant à déclarer pour chaque foyer fiscal, il peut être opportun de détenir un bien immobilier de valeur par une société civile immobilière (SCI) dont les titres seront répartis entre parents et enfants dès lors que ces derniers ne sont pas rattachés au même foyer afin que le seuil de 1,3 M€ par foyer, soit utilisé par les différents associés de la SCI. Quand et comment préparer sa succession lorsque l’on est soumis à l’IFI ? En France, on hérite en moyenne du premier de ses parents au-delà de 60 ans. Une femme de 85 ans a une espérance de vie moyenne de sept ans et demi et 30 % d’entre elles fêteront leur 95ème anniversaire. Ces données démographiques sont essentielles pour déterminer une stratégie de transmission. Il est souhaitable de conduire cette réflexion dès l’acquisition, mais il n’y
a ni âge minimum ni âge maximum pour s’organiser. Nous recommandons à nos clients de répartir leur patrimoine entre différentes sociétés afin d’en améliorer la transmission entre leurs ayants droit et de se protéger sur le plan juridique leur vie durant, eux et leur conjoint. Alors que l’IFI représente annuellement un coût modéré (0,5 % à 1,5 %), nombre d’assujettis n’anticipent pas qu’une part importante de leur patrimoine devra être vendue afin de régler les droits dus à l’État (de 5 % à 45 % en ligne directe ; 35 % et 40 % entre frère et sœur ; 55 % pour des neveux et nièces). En résumé, il faut anticiper et pousser loin sa réflexion jusqu’à envisager un saut de génération. What advice would you give our readers to anticipate IFI issues? The IFI is calculated on the difference between the actual value of the property on 1st January and the balance of the loans borrowed for its acquisition and renovation. In this period of low borrowing rates, a buyer may favour the use of debt in order to limit the tax base of the IFI, since there are nevertheless tax restrictions on this deduction (e.g. family loans, etc.). With the IFI to be declared for each tax household, it may be appropriate to hold a valuable property by a civil property company (Société civile immobilière, SCI) whose shares will be divided between parents and children if they are not attached to the same household so that the threshold of 1.3 million € per household, is used by the various partners of the SCI.
When and how do you prepare for inheritance when you are subject to IFI? In France, on average, one inherits from the first parent after the age of 60. An 85-yearold woman has an average life expectancy of seven and a half years, and 30% of them will celebrate their 95th birthday. This demographic data is essential to determine an inheritance strategy. It is best to think about this from the moment you buy, but there is no minimum age or maximum age to organise yourself. We recommend that our clients divide their wealth among different companies in order to improve the inheritance between their beneficiaries and to protect themselves legally during their and their spouses’ lives. While the IFI represents a moderate annual cost (0.5% to 1.5%), many taxable people do not anticipate that a substantial share of their wealth will have to be sold in order to pay the rights owed to the state (from 5% to 45% for direct descendants; 35% and 40% between siblings; 55% for nephews and nieces). In short, one needs to anticipate and do some forward thinking to the point of envisaging a generational leap.
