Can anyone be a journalist? Researcher examines Citizen journ A NEW article detailing the relationship of two U.S. Supreme Court cases and how they work together to uphold freedom of expression has been published in the Georgia Law Review by William E. Lee, professor of journalism in the University of Georgia Grady College of Journalism and Mass Communication. Lee’s article focuses on New York Times v. Sullivan and its companion case, Abernathy v. Sullivan, in which the court upheld the First Amendment rights of both the press and ministers active in the civil rights movement. These rulings affect today’s citizen journalists. The article, “Citizen-Critics, Citizen Journalists, and the

issue of the Georgia Law Review. While many are familiar with the landmark case New York Times v. Sullivan, the companion case of Abernathy v. Sullivan has not earned the same recognition. Both cases ruled on an editorial advertisement published in the New York Times in 1960 movement. L.B. Sullivan, public safety commissioner of Montgomery, Alabama, sued the New York Times for defamation, and in a separate case sued four Alabama ministers who appeared to have endorsed the advertisement. It was later discovered that they did not help sponsor the ad. Both the New York Times and the four ministers were found liable in Alabama courts and appealed to the U.S. Supreme Court. Lee’s article explains why the Supreme Court ultimately blended the two cases together and ruled in favor of the New York Times and the four ministers on First Amendment grounds. “It’s important to understand that by blending the Abernathy and Times cases, the court was holding that both the ministers professor of communication law, said. Pay the BIR or else.... Thank you, Yolanda?

We need to see the cross

I KNOW the title sounds macabre. Almost sacrilegious and unrespectful. But just read the column with an open mind. As I was working on this issue, a friend suddenly pops up at my Messenger, asking me who we should be thanking for the tight preparations we had for the onslaught of Ruby, which admirably, has led to almost zero casualties in all LGUs. Well, I answered simply that we had to thank

THAT’S simply because without the cross, there’s no other way but for us to get spoiled. Our sense of freedom and of what is good, right and fair would get unhinged from its proper foundation, and would fall easy prey tive allurements of the world, and the wiles of the devil.

recorded history in modern times, has taught us one big lesson – that we have to be well prepared and heed government. I knew he was expecting me to name people, but he laughed and said “maldita gyod ka, but Well, I just had to be brutally honest. If not for Yolanda, do you think that we would have prepared as we had for Ruby? I think not. Anyway, the preparations paid off. There was minimal loss of lives, which is the primary objective. You can always replace things, rebuild houses and your homes, but not resurrect the dead. An update I just got is that there were two deaths in Leyte Province; 6 in Northern Samar; 6 in Eastern Samar and 1 in Biliran. we’ve had, even with ordinary typhoons, we can conclude that the pre-emptive evacuations and lives and properties have indeed worked. And had Yolanda not struck the region last year, I can imagine the mayor’s remaining hair falling off, including that of the vice mayor’s, in trying to convince people to evacuate from their homes. My worry though, is that because some people might think we have gone overboard with the evacuations, even re-evacuating people already in coastal schools to uphill barrios, it might lead the hardheaded Pinoy to be stubborn again next time. They might think we are OA, but for our house, I told the hubby that we keep the window boards around, in a high, dry place, for the next typhoon season. We must admit it, we live in a typhoon belt. We may have had a reprieve of around 10 years when we didn’t have a typhoon passing through, but the reality that we are back again on the typhoon belt is stark. As Ormocanons, lumad or not, we already a preemptive measure that the experience never happens again, city authorities then passed an ordinance prohibiting people from living along riverbanks. Unfortunately, this ordinance has been forgotten. There was a huge outcry against illegal logging, but unfortunately, the practice continues with powers-that-be ignoring it, even abetting it. Just this week, a refrigerated van was caught illegally transporting lumber. While the lumber presumably comes from felled trees after Yolanda, it can also be presumed it was from freshly cut trees because who are we to tell? Now, the horrors of Yolanda is still fresh in our minds. But three years from now, a decade from now, will we still remember that? see

Living a ‘sayings-based’ life LIFE IS what we make it, so to speak. When life goes wrong, we tend to blame God. But when life seems good, so much so when hapin our life, God was never in the picture. Of course, not all. There are those whose faith are beyond reasonable doubt. There are those who consider trials as tests in one’s faith without reservation, that God is really good at all times. Just keep the faith. After all, “faith can hurdle obstacles”. According to a statement by Deputy Ombudsman for the Visayas Virginia Palanca - Santiago during one of the seminars I attended in Ormoc during the pre-Yolanda era, the number one reason why people, both in government and in private sectors, succumb to graft and corruption is due to their unconditional love for their families. We must all remember that “bad is bad even if everybody is for it and good Most, if not all, of our actions are driven by our ambitions in life. Of course, we must do it so that all our actions must be directed and motivated to a particular objective in the future. Such objective perhaps, is a result of our past musings to live life to its fullest and to enjoy what is there to relish in life. Christ’s cross is the effective counterbalance of our freedom, which can swing in any which way. It keeps our freedom in the orbit of truth and charity that can only come from God, our creator and father. It heals what is wounded, cures what is sick in us, especially our tendency to be lazy and complacent. It makes us humble and simple, protecting us from the dangers of pride, bigotry, conceit and self-righteousness. It assumes all our sins, mistakes and other stupidities, and atones for them, repairing what they damage, making up for whatever we ourselves cannot anymore resolve humanly. It also serves to strengthen us, making us more resistant to the different evils of this world. and wisdom, widens our perspectives and compassion It pushes us to where we ought to go but usually do not like to. It’s a stimulus for growth in all aspects of our life, goading us on the road toward human and Christian maturity. Above all, the cross is the strongest proof of love. It somehow captures the whole range of love which is not contented only with giving and sharing, but also of suffering for the loved one. It is the grand school of mercy. The good effects of the Christ’s cross are abundant. They are actually beyond accounting, because the dignity proper to us as well as our capacity to do evil for which the cross serves as a foil, are also beyond accounting. In short, it has many mysterious good effects. We actually need the cross more than we need air. That’s why we have to train ourselves to love the cross, seeking it actively and not waiting for it to come. Knowing the way we are, with our wounded condition, this is the proper attitude to take toward the cross. But we have to make sure that we have the right understanding of it. We have to be wary of the reductionist if not perverted attitudes toward the cross. Sad to say, the world today is also full of doctrines and ideologies that promote such attitudes. So we have to be always watchful and discerning, frequently rectifying our intentions, promptly correcting ourselves when we notice we have strayed from the right path. We can start by taking advantage of the constant opportunities to embrace the cross in the usual events of our day. We should not eat

Thoughts on Christmas 2014 THE APPROACH of December augurs many things about Christmas that come to mind. If Jesus Christ chose to be born on a This is the season of Advent in the calendar of the Catholic Church. Advent comes from the Latin word: “advenir” which means “to come.” Jesus Christ is the One who will come. Advent for this new year is also the start of the Liturgical year, Cycle B for 2015. The matter of His coming can be seen in two ways: the coming on the last day when all humanity will be judged for the last time. This latter thought can be what is found in the Bible, the Gospel according to St. Matthew: “When the Son of Man comes as King and all the angels with him, he will sit on his royal throne, and the people of all the nations will be gathered before him. then he will divide them into two groups, just as a shep-herd separates the sheep from the goats. He will put the righteous at his right and the others at his left. Then the King will say to the people on his right, ‘Come, you that are blessed by my Father! Come and possess the kingdom which has been prepared for you ever since the creation of the world. I was hungry and you fed me, thirsty and you gave me a drink; I was a stranger and you received me in your homes, naked and you clothed me; I was sick and you took care of me, in prison and you visited me. The righteous will then answer him, When, Lord, did we ever see you hungry and feed you, or thirsty and give you a drink? When did we ever see you a stranger and welcome you in our homes, or naked and clothe you? When did we ever see you sick or in prison, and visit you? The King will reply, I tell you, whenever you did this for one of the

The Gospel on Sunday NOVEMBER 14, 2014 Third Sunday of Advent John 1:6-8, 19-28 A man came, sent by God. His name was John. He came as a witness, to bear witness to the light, so that everyone might believe through him. He was not the light, he was to bear witness to the light. This was the witness of John, when the Jews sent to him priests and Levites from Jerusalem to ask him, ‘Who are you?’ He declared, he did not deny but declared, ‘I am not the Christ.’ So they asked, ‘Then are you Elijah?’ He replied, ‘I am not.’ ‘Are you the Prophet?’ He answered, ‘No.’ So they said to him, ‘Who are you?

Laughter is the best medicine least important of these brothers of mine, you did it for me! “Then he will say to those on his left, Away from me, you that are under God’s curse! Away the Devil and his angels! I was hungry but you would not feed me, thirsty but you would not give me a drink; I was a stran-ger but you would not welcome me in your homes, naked but you would not clothe me; I was sick and in prison but you would not take care of me. Then they will answer him, When, Lord, did we ever see you hungry or thirsty or a stranger or naked or sick or in prison, and we would not help you ? the King will reply, I tell you, whenever you refused to help one of these least important ones, you refused to help me. NI ATTY. MANING GOLO

Dear Atty. Golo,

SOME PEOPLE think that my laugh is too loud and I should probably tone it down a bit. I just laugh off the criticism because my laugh is part of my identity. I know that I am not very good in telling jokes but I enjoy listening and sharing laughs especially with family and friends. Research indicates that the benefits of laughter go well beyond the ever-important fun factor. Laughter may be a blood-pressure reducer, an immune-system booster, a stress buster and a friend maker. Laughter also releases endorphins, which energize and help elevate people’s moods. Studies have shown that laughter may strengthen the immune system. Functionally, laughter can help us see situations more positively and take our mind off the hard stuff. Sometimes we become too serious adults that it

Here are some to watch out for: Water and food-borne diseases. Salmonella and amoeba infections cause food poisoning and diarrhea. The drinking water may get contaminated by fecal material or spoiled food. It is therefore best to practice good hygiene and sanitation by avoiding defecation in open areas. And hand washing must be done at all times. Food must be handled with extra properly. We must keep the kitchen or cooking areas clean, and wash hands properly before handling food. How long? One should be careful in consuming leftover food because it may be contaminated with bacteria, fungus or parasites. Our tap water is chlorinated to make it potable. Eight to ten minutes of boiling the water is advised if the water source is untreated; yet, it may still contain spores that cannot be killed by boiling. Influenza manifested by colds, nonproductive cough, fever and generalized body weakness is also common during the cold

rainy days. It is spread by droplet nuclei and inhalation of contaminated air where a sick person sneezed or coughed without covering the mouth and nose. To avoid its spread, one must always cover his/her mouth and nose during sneezing or coughing to avoid treatment for such viral illness. Thus, water intake must be more than 8 glasses a day to keep our bodies properly hydrated. For the elderly, annual Flu vaccination is advocated. If not to prevent Flu infection, it can reduce disease severity. Leptospirosis - a disease caused by a bacteria - Leptospira. Rats are the main hosts. Transmission happens when one is exposed to the urine of rats contaminated with Leptospira. During rains and typhoons, rat colonies may at high risk of acquiring this infection. It is muscle pains; and possible yellowing of the eyes, liver and kidney problems and even seizures. It may occur 2-20 days after exposure to as maintaining a clean environment to avoid rat colonies to arise. For those who waded in for you to be given post exposure medication

“Here’s why I take comedies seriously: they present and celebrate the world in which we survive our own and others’ mistakes, follies, transgressions, and deep sins. However lightly, dimly, or bleakly, comedies revel in our survival— in the delaying of death and the staying of the curse. Comedies tell the story of ruined folk somehow avoiding ruin.”

that once engulfed the town more than 100 years ago. Of course, Mayor Pel Tecson did his best to implement pre-emptive evacuation then, but since the memory of the time when a tidal wave visited the town was already a distant past for the people, residents thought it would not happen again. But it did. Couple it with PAGASA’s insistence on using the politically Greek. In fact, at the height of the Ruby scare, the warning was for people along Ormoc coasts and the traditionally low-lying that could happen during the hours when it is high tide. It is coined in the past, hence it still is a politically correct term to use today, even if antiquated. And had it been used during the Yolanda warnings last November 2013, then probably, more lives would have been saved. And in memory of those who perished from Yolanda, whose deaths were painful and horrible, the only way we can honor them is to remember their plight. Disaster preparedness now is not a choice but a MUST. We owe it to them, and we owe it to our future generations.

News from Samar

Thank you to my good friend Andone Larrazabal and family for graciously allowing me to charge my gadgets, with beer and pulutan included, as I work on this issue. We cannot put on our generator as yet, because we have to check the lines if there are no problems. I know I will be swamped with questions when power would be back. The NGCP’s recent advisory is that it would be surveying and assessing the damage to its transmission lines. It will only be that time that they could give us a timeline when we will have power again. Meanwhile, Leyeco V is also doing parallel line rehabilitation. The damage is not as bad as it was last November so I guess, we could have power here in Ormoc in a week’s time. It may be as long as 15 days for Tacloban and longer for those in Samar.

one of the least of these my brethren, ye have done it unto me.” And he sent this gospel of the Kingdom of Man into the uttermost ends of the earth. So the light came into the world and the men who lived in darkness were afraid, and they tried to lower a curtain so that man would still believe salvation lay with leaders. But it came to pass for a while in diverse places that the truth did set man free, although the men of darkness were offended and they tried to put out the light. The voice said, “Haste ye. Walk while you have the light, lest darkness knoweth not wither he goeth.” Along the road to Damascus the light shone brightly. But afterwards Paul of Tarsus, too, was so afraid. He feared that other Caesars, other prophets that might one day persuade men that man was nothing save a servant unto them; that men might yield up their birthright from God for pottage and walk no more in freedom. Then might it come to pass that darkness would settle again over the ‘lands and there would be a burning of books and men would think only of what they should eat and what they should wear, and would give heed only to new Caesars and to false prophets. Then might it come to pass that men would not look upwards to see even a winter’s star in the East, and once more, there would be no light at all in the darkness. And so Paul, the apostle of the Son of Man, spoke to his brethren, the Galatians the words he would have us remember afterwards in each of the years of his Lord: “ Stand fast therefore in the liberty wherewith Christ has made us free and be not entangled again with the yoke of bondage.”

It may just be a matter of self-discipline in terms of following a schedule, even if not having one does not make much of a difference. It could just be a matter of guarding our senses, purifying our imagination and memory, struggling to smile and to say some nice words even in the midst of some contradictions. There are endless possibilities. Or it could be taking coffee without sugar, bread without butter, taking more of what we don’t like and less of what we like. Or taking up some physical exercises especially when we tend to lead a very sedentary lifestyle. It is through these that we make ourselves ready to face the big challenges, trials—in other words, the big crosses—of our life. It is through Christ on the cross, full of love, understanding and mercy. We should also see to it that our seeking and loving the cross should make us more loving and understanding towards others. If that is not so, then we are seeking and loving the cross wrongly. And again, sad to say, cases like this are also plenty. We have to seek the cross properly and abidingly, but with naturalness. be inspired to make our dreams come true, and by so doing, we must “aim for the stars, for at least, if we fail, we still land on the moon”. Still on ambitions. As humans, we are capable of realizing our dreams in the future. We just simply put our words into actions. Or simply, “walk the talk”. We are superior from the rest of the animals created by God. Even if we are not the biggest in terms of physical characteristics, we are imbued with a rational brain superior to all creations. Accordingly, “what the mind can conceive, the body can achieve”. We are humans and it is really a must for us to have outlooks in life. Are we not ashamed of a Multicab, a non-human obviously, whose body sports the phrase, “When I grow up I want to be a dump truck”? Despite the trials and challenges that characterizes our existence, our resiliency motivates us to bounce back. If the challenges and trials are considered acts of God, then by all means, He has a message for us. And perhaps, such message has something to do with how we live our lives. Do we live them according to God’s purpose? Or we just live our lives just for the heck of living. And if the challenges and trials are results of our wrong choices on the options of life, then by all means too, we have to struggle to get back and pick up the pieces and start a new and more discerning slate. We should struggle not to commit the same mistakes all over again but if it can’t be avoided given our fragility as humans, at least we should try to reduce the incidence or make lesser mistakes. Remember, “to stumble twice with the same stone is a proverbial disgrace”.
