Purpose

This form is to be signed by each Participant (or the parent/guardian of any Participant under the age of 19) involved in the Program. In consideration for the educational, social, and other benefits to be provided, the receipt and adequacy of which is acknowledged, Participant agrees as follows.

Liability Release

Health Care and Emergencies

UA does not accept responsibility or liability for providing health care services or health care insurance for Participant. Participant should consult their own medical care provider, and warrants their physical fitness to participate in the Program to the extent the Program may cause mental or emotional stress, which may result in related medical conditions. Participant authorizes UA to obtain any necessary medical treatment for Participant while arriving at, during, or while leaving the Program. Participant agrees to be responsible for the payment of any fees and charges that may be imposed by any doctor or hospital facility in the provision of medical care to Participant. Further, Participant agrees to indemnify and hold UA harmless from any claim that may be made by a doctor of medical facility of said fees and charges incurred in the provision of medical care to Participant.

Conduct

THIS IS A RELEASE OF LIABILITY. Participant knowingly and voluntarily waives, releases, exculpates, and discharges UA and any related third party entities or contractors from and against any and all Potential Liabilities connected with the Program. By signing this form, the Participant voluntarily agrees to discharge UA and any related third party entities or contractors in advance from all such Potential Liabilities.

Participant agrees, for the duration of the Program, to abide by all applicable federal, state, and local laws as well as the rules and regulations for the Program. Participant also agrees to follow posted signs as well as instructions and directions of University officials and Program directors.

The Participant agrees to hold harmless and indemnify UA from and against Potential Liabilities related to or arising from Participant’s involvement in the Program.

Assumption of Risk

The Participant understands and acknowledges that there are risks, including significant risks, inherent in all activities that can result in loss, damages, injury, or death, including, without limitation: • Premises risks, including premises that may be owned by others including uneven surfaces, cracks, steps, wet floors, etc.; • Injury risks from falls, collisions, or accidents (such as cuts, bruises, torn muscles, sprains, broken bones, concussion, etc.); • Financial risks arising from any advice, opinions, suggestions, facts, data, or other information shared during the program and acted upon by you; • R i s k s f r o m o t h e r s involved in the Program such as transmitted illnesses or others’ actions; • Health risks, such as heart or respiratory events as well as other risks inherent in potentially stressful activities, including things identified as “injury risks” herein; • Equipment risks, including failure, misuse, inherent risks, and risks from UA or non-UA equipment; • Other risks and hazards beyond the control of UA, including criminal acts that can result in serious injury or death. Unique risks potentially related to the Program may include but are not limited to:

Participant acknowledges that photographs and possible videos may be taken and irrevocably and perpetually authorizes UA to broadcast these images. Participant releases and discharges UA from any potential claims related to the broadcast or use of their image, and any potential claims related to the work. Participant waives any right to inspect or approve the work or the broadcast of their image. This agreement shall be interpreted in accordance with applicable law. This is the entire agreement of the parties, and any changes must be in writing.

Definitions

The following terms have the stated meaning when used in this document: • Applicable Law – the laws of the State of Alabama, without regard to conflicts of laws provisions. UA does not waive, but reserves, all immunities, including Article I, section 14, of the Alabama Constitution. Claims against the University must be made to the State Board of Adjustment. To the extent not barred by immunity, nor required to be filed before the Board of Adjustment, exclusive venue and jurisdiction of all disputes shall lie in the state and federal courts of Tuscaloosa County, Alabama. • Broadcast - to use, reuse, broadcast, publish and/or copyright, in whole or in part, for advertising, promotion, publicity, trade, educational, commercial, merchandising, packaging, public relations and media purposes, in all media, worldwide without limitation, in perpetuity. • Image - image, picture, name, biographical information, voice, statements, recordings or interviews made by or attributable to the person who is appearing in the work, verbatim or otherwise, photographic portraits, drawings, visual representations, video tapes, motions pictures, or other use of likeness in whole or in part, and any reproductions thereof. • Participant – the person participating in the Program or any University employee (regular or temporary), 3rd party employee, student, or volunteer working in any capacity to facilitate or support the Program. If the Participant is under age 19 or is under some form of court-ordered guardianship or custodial arrangement, permission and acknowledgment by a parent/guardian is required.

Program – HomeFirst including all activities incidental or connected therewith, such as housing, dining, training, activities, and transportation. Programs may be held on or off University property. The terms of this document will apply regardless of Program location, including to and from the event(s). UA – The Board of Trustees of The University of Alabama (hereinafter referred to as “UA” or “University”), including The University of Alabama, affiliated foundations, and their respective trustees, officers, employees, agents, representatives and volunteers. Purpose

This form is to be signed by each Participant (or the parent/guardian of any Participant under the age of 19) involved in the Program. In consideration for the educational, social, recreational, and other benefits to be provided, the receipt and adequacy of which is acknowledged, Participant agrees as follows.

Liability Release

Health Care and Emergencies

UA does not accept responsibility or liability for providing health care services or health care insurance for Participant. Participant should consult their own medical care provider, and warrants their physical fitness to participate in the Program. Participant authorizes UA to obtain any necessary medical treatment for Participant during the Program. Participant agrees to be responsible for the payment of any fees and charges that may be imposed by any doctor or hospital facility in the provision of medical care to Participant. Further, Participant agrees to indemnify and hold UA harmless from any claim that may be made by a doctor of medical facility of said fees and charges incurred in the provision of medical care to Participant. The Participant is required to provide the name(s) and contact number(s) for a parent, guardian, or other party that is a reliable contact in the event of emergencies.

Conduct

THIS IS A RELEASE OF LIABILITY. Participant knowingly and voluntarily waives, releases, exculpates, and discharges UA and any related third party entities or contractors from and against any and all Potential Liabilities connected with the Program. By signing this form, the Participant voluntarily agrees to discharge UA and any related third party entities or contractors in advance from all such Potential Liabilities.

Participant agrees, for the duration of the Program, to abide by all applicable federal, state, and local laws as well as the rules and regulations for the Program. Participant also agrees to follow posted signs as well as instructions and directions of University officials and Program directors and supervisory staff.

The Participant agrees to hold harmless and indemnify UA from and against Potential Liabilities related to or arising from Participant’s involvement in the Program.

Assumption of Risk

The Participant understands and acknowledges that there are risks, including significant risks, inherent in all activities that can result in loss, damages, injury, or death, including, without limitation: • Tr avel/tr af f ic r isks such as accidents, crashes, and risks from autos operated by UA or the Program as well as autos operated by other individuals or entities, poorly maintained roads, sidewalks, as well as criminal acts that can result in serious injury or death; • Pr e mise s r isks, including those that may be owned by others and risks from water, such as drowning; • Injury r isks from falls, collisions, or accidents (such as cuts, bruises, torn muscles, sprains, broken bones, concussion, etc.); • Out door r isks, such as weather, lightning, heat or cold, insect bites/stings, allergic reactions to plants, dehydration, hypothermia, drowning, sunburn, animals, and limited access to medical care; • R isks fr om oth er s involved in the Program such as transmitted illnesses or others’ actions; • He alth r isks, such as allergic reactions, heart or respiratory events as well as other risks inherent in any strenuous activities, including things identified as “injury risks” herein; • E quip ment r isks, including failure, misuse, inherent risks, and risks from UA or non-UA equipment; • Ot he r r isks and h azar ds beyond the control of UA, including criminal acts that can result in serious injury or death. Unique risks potentially related to the Program may include but are not limited to:

Participant acknowledges that photographs and possible videos may be taken and irrevocably and perpetually authorizes UA to broadcast these images. Participant releases and discharges UA from any potential claims related to the broadcast or use of their image, and any potential claims related to the work. Participant waives any right to inspect or approve the work or the broadcast of their image. This agreement shall be interpreted in accordance with applicable law. This is the entire agreement of the parties, and any changes must be in writing.

Definitions

The following terms have the stated meaning when used in this document: • Appl icabl e Law – the laws of the State of Alabama, without regard to conflicts of laws provisions. UA does not waive, but reserves, all immunities, including Article I, section 14, of the Alabama Constitution. Claims against the University must be made to the State Board of Adjustment. To the extent not barred by immunity, nor required to be filed before the Board of Adjustment, exclusive venue and jurisdiction of all disputes shall lie in the state and federal courts of Tuscaloosa County, Alabama. • B r oadcast - to use, reuse, broadcast, publish and/or copyright, in whole or in part, for advertising, promotion, publicity, trade, educational, commercial, merchandising, packaging, public relations and media purposes, in all media, worldwide without limitation, in perpetuity. • Imag e - image, picture, name, biographical information, voice, statements, recordings or interviews made by or attributable to the person who is appearing in the work, verbatim or otherwise, photographic portraits, drawings, visual representations, video tapes, motions pictures, or other use of likeness in whole or in part, and any reproductions thereof. • Par t icipant – the person participating in the Program or any University employee (regular or temporary), 3rd party employee, student, or volunteer working in any capacity to facilitate or support the Program. You May Opt Out If You Do Not Want Us To Share Your Information HomeFirst is committed to ensuring the privacy of individuals who are enrolled in our program. We understand that the matters you discuss with us are very personal. This document is designed to provide you information on how we protect your privacy, inform you about your rights, and tell you how we keep your information secure. Please review it carefully. If while reading it, you have any questions, or require clarification before signing, please let us know. In order to effectively serve you, we will need to collect some personal information. The types of personal information we may collect include: basic identifying information, contact information, demographic information, housing and income information, and records of all HomeFirst activities. We only have access to collect information that you voluntarily give us. This information may be provided to us orally, on the application or on other forms. We assure you that all the information shared both orally and in writing will be managed within legal and ethical considerations. We will not sell your personal information to anyone. We will only release your personal information to third parties with your consent.

Types Of Information We Gather About You • Spoken or written information we receive from you on the application, other forms, or meeting notes, such as basic identifying information, contact information, demographic information, housing and income information, and records of all HomeFirst activities. • Information we receive during HomeFirst financial coaching sessions, such as your credit history, debt information, savings goal progress, and more.

How We Use Your Information We use the personally identifiable information we collect about you to help us provide the services you have requested. Once we obtain personally identifiable information from you, we may not disclose it to any third party except as necessary in the course of performing our services, with your consent, or as permitted or required by law. Internally, we may use this information to provide case management and support, track individual program outcomes, produce reports about use of services, and provide accountability for individuals and entities that provide funding to HomeFirst. We may also collect, use, and share anonymous aggregated case file information to evaluate our services, to gather valuable research information, and to design future programs. Unless permitted or required by law, HomeFirst will only disclose your personally identifiable information to third parties with your written or verbal permission.

How We Store Your Information Your data may be stored both electronically and in physical paper copies. HomeFirst restricts access to information about you only to UA staff or student coaches who need to know that information in order to provide services to you. HomeFirst coaches in non-administrative roles must have a PIN number unique to each participant to view any electronic participant’s information. To the extent there are any, paper copies will be secured by UA staff or student coaches in locked file cabinets. We maintain physical, electronic and procedural safeguards to protect your information as required by federal and state law.

As a HomeFirst financial coach, you will make your best efforts to: • You may “opt-out” to prevent the disclosure of your personally identifiable information. • If you choose to “opt-out,” we may not be able to provide quality services to you. • If you wish to change your decision, you may opt out of any future contact from us at any time.
