lthough the meeting organised by the subcouncil at Kuils River Technical High School (KTHS) on Thursday 17 October was about the City’s projects in Highbury, several residents rather wanted to talk about the prospects of a private development on the school’s grounds. The project to build a five-a-side soccer facility was put on hold after the soil preparation was already done. TygerBurger did not receive a response from the education department when reporting on this earlier (‘‘Residents not thrilled”, 9/10). The Mayco member for spatial planning and environment, Marian Nieuwoudt, did respond on the zoning of the property and whether there was a need for public participation, environmental impact (EIA) and traffic studies. In short the answer was that the current zoning (of the school’s property) allows the planned land use and therefor no public participation, EIA or traffic study are necessary (from the City’s perspective) as these were done before the school moved to the current site. The school’s principal Quintin Pick told TygerBurger the project was put on hold as he was informed final approval must be given by the provincial minister of education. According to him the reason was the scale of the project. On TygerBurger’s latest enquiry, Bronagh Hammond, spokesperson of the provincial education department, said the department received an application from the school for the minister’s approval “in terms of Section 36 (4) of the South African Schools Act (Sa-
sa), to allow the school to develop the fields and enter into agreements to lease the facility to other users.” Hammond pointed out KTHS falls under the Metro East Education District (MEED) but said the district does not approve development on school property. She is “not sure who gave the go-ahead for the project to start” initially. She said the department was informed of construction happening at the school. “The WCED instructed the principal to cease development, which they complied with, until the necessary approvals are in place.’’ As to the correct process to be followed by the school’s governing body when there is a partnership with a private entity and private money is used to develop a facility on a government school’s property, Hammond referred to a department circular relating to a specific section in the South African Schools Act (Sasa). According to the act a school governing body may lease or alter immovable property of the school “to provide for school activities or to supplement the school fund” and may ‘‘allow any person to conduct any business on school property to supplement the school fund.” But this is subject to approval by the provincial minister of education. Hammond said the minister’s approval is normally subject to further conditions which states that development may not proceed until the conditions have been met. These include that it is the school’s responsibility to ensure the correct zoning is in place and that building plans are approved by the local authority and department of public works. V To page 2.
