n atmospheric emission licence is in the process of being issued to the Cape Town Iron and Steel Works (Cisco) factory to the dismay of nearby residents who claim their health are affected by air and noise pollution from the plant in Fabriek Street that operates 24/7. Luthando Tyhalibongo, a spokesperson of the City of Cape Town, confirmed the licence was signed on Wednesday 11 September. Residents from areas such as Vredelust, Jagtershof and Highbury have voiced their grievances with the factory on their doorstep since it resumed operations in October 2017. The factory, that originally opened in the 1960s, closed in 2010. Houses sprung up in the surrounding areas during the time the plant was closed. In a meeting with residents in April, mayor Dan Plato said the City had ‘‘exhausted many avenues’’. He said the matter had to be escalated to national government – specifically the department of environmental affairs (DEA) and the department of trade and industry (DTI). At the time reference was made to the provisional atmospheric emission licence (PAEL) granted to Cisco, that was due to expire this month (September). Tyhalibongo said in response to an enquiry there is no formal application process involved in converting a PAEL to a “final” atmospheric emission licence (AEL). The national Air Quality Act states: ‘‘The holder of a provisional atmospheric emission licence is entitled to an atmospheric emission licence (AEL), when the commissioned facility has been in full

compliance with the conditions and requirements of the provisional atmospheric emission licence for a period of at least six months’’. Tyhalibongo said there is no public participation process prescribed when converting a PAEL to an AEL. In a previous response to TygerBurger, Zahid Badroodien, Mayco member for community services and health, said the City’s air quality management unit and the compliance and enforcement unit of the DEA conducted a joint unannounced compliance inspection of Cisco on 12 June. Last week Tyhalibongo said the City has “to date not received a copy of the compliance report from the national department”. He said the City thus undertook a further compliance inspection on 23 August, which was supported by an official from the provincial department of environmental affairs and development planning. “The findings of this inspection found the facility compliant with the provisional atmospheric emission licence and hence an AEL was issued.” With regards to Plato’s commitment to take the issues to a national level, Tyhalibongo said: “In July, the mayor wrote to both ministers of environmental affairs and economic development, but has had no response to date”. Tammy Carter of the Save Kuils River environmental action group, said she’s concerned about the City’s claim ‘‘that Cisco is in ‘full compliance’ and was therefore issued with an AEL while at the same time saying they don’t have the outcome of the compliance inspection”. She said this is an indication that the process is a sham. V To page 2.
