he Thornton Islamic Society (TIS) is going head to head with the City of Cape Town. An alleged outstanding water bill of more than R420 000 and an expiring lease agreement has TIS up in arms. According to Faizel Jacobs, secretary for the TIS, the city failed to communicate the rezoning of the property in Poplar Avenue, Thornton, as well as what the purpose of the facility is. Councillor Ian Neilson, mayoral committee member for finance says, however, that no final decision has been made.
He continues: “The proposed lease is duly being considered in consultation with the various service departments as per the standard city business processes.” He nonetheless adds that the proposed lease area is zoned for public open space purposes. But a condition limits the use of the property for public place recreation, and not institutional purposes.
Sport “The proposed lease area is within a sport precinct and it is the recommendation of the city’s Sport, Recreation and Amenities Department to retain it for such use,” Neilson says before adding that the original month to month lease stated that the property was
to be used for educational purposes and not for purposes of a public place of worship. However, according to Jacobs the TIS not only uses the facility on the property to offer madrassah classes for children, or to participate in the five required daily prayers. “The facility is also used for burial ceremonies and to finance community-based projects. Even scouts make use of the facility which TIS is involved in,” Jacobs says. TIS has apparently responded to the city on several occasions asking that they either be granted a long-term lease or for the option to purchase the property. “Once we have received a long-term contract to acquire the land, it is our intention to build a multi-functional community cen-

To date, the TIS says they have had no feedback from the city regarding this matter even after they have been leasing the facility the past 13 years. But Neilson said that during April this year a subcouncil meeting was held to discuss their plight and the outcome has not yet been determined. He adds that the allegations pertaining to non-communication are false.
