Justice for Health Evaluation Introduction Justice for Health received more than 140 pieces of overwhelmingly positive coverage between 18 April to 17 May, with the bulk of coverage in the week of 25 April in the run up to the all-out junior doctors’ strike.  

Highlights include:    

Summary Campaign coverage commenced on 18 April with a Guardian front page story by Denis Campbell: ‘Hunt in U-turn over threat to Junior Doctors’, placed by Fran Silman. Later in the day she appeared on the Today Programme and Channel 4 News, challenging the legality of Jeremy Hunt’s imposition of the junior doctor contract. This story was run by the Press Association and picked up extensively by national and regional print and online media.

On 25 April, tpr media secured a prime-time slot for Ben White to appear on ITV’s Good Morning Britain, where he resigned live on air. Ben received tremendous support from presenters, Piers Morgan and Susanna Reid, appearing at 6:30am and then at 8:10am, where he was interviewed alongside former Health Secretary, Edwina Curry. Later that day, Ben was interviewed by ITN (prerecorded syndicated nationally), BBC London Lunchtime News, London Live and ITV National News with Nina Hossain. Sophie Toumazis accompanied Ben to Good Morning Britain and ITV National News, and briefed him before the interviews.

The Justice for Health team commissioned a peer-to-peer survey which demonstrated unanimous support for the all-out strikes by junior doctors. This was given to Denis Campbell as an exclusive, and later issued to the broader press by Marie-Estella Mcveigh and tpr media. A statement of support from New Zealand doctors was also widely issued by tpr media.

On 26 April, Ben was interviewed again on Good Morning Britain and later in the day on the Jeremy Vine Show and LBC. Ben’s on-air resignation was featured in most UK national and London titles as part of the wider junior doctor strike coverage, with their online sites re-playing clips. The Daily Mail questioned whether this was a PR stunt but overall it was reported sympathetically. tpr media placed open letters by Ben in both The New Day and The Mirror and a comment piece in the Telegraph online. Ben’s resignation was one of the prominent human interest stories of the week.

Nadia Masood was interviewed by BBC Health Correspondent, Hugh Pym, on the Today programme protesting at St Thomas’ Hospital picket line, alongside a junior doctor opposed to the strikes. She then appeared on The Victoria Derbyshire Show, where she took part in a Skype tpr media consultants 17 May 2016

@JustHealth #JusticeForHealth discussion with viewers. Amar Mashru gave a forceful interview to Huw Edwards on the BBC early evening news and wrote a comment piece for Guardian online.

On 29 April, Nadia also appeared on LBC’s Andrew Pierce Show where she was interviewed about the junior doctors strike as well as other news stories of the week.

The following week (8 May), Nadia on appeared Sky Sunrise and throughout the day on Sky news bulletins (pre-recorded) where she discussed the resumed negotiations between the BMA and NHS employers; she later appeared on LBC’s Clive Bull Show.

Demonstrating their ongoing support and interest for the campaign, Good Morning Britain invited Ben back onto the programme on 10 May. There was widespread regional coverage. We’ve included key pieces in the main evaluation report, (see contact sheet in appendix for full regional coverage breakdown).

Hunt’s change of tack, which was prompted by a high court challenge which is due to start today, may mean the health secretary has misled parliament over the contract imposition because he has spoken of the threat repeatedly in front of MPs in the House of Commons.

Junior doctors are due to strike for a fifth time on 26 and 27 April, this time opting out of all care, including emergency treatment.

Hunt has now rowed back from his claim that he has the right to exercise what he called the “nuclear option” of imposition. His U-turn is revealed in a letter from the government’s lawyers seen by the Guardian and confirmed by the Department of Health.

Hunt’s insistence now that he is merely “introducing” the contract has prompted questions about his negotiating tactics during the seven-month dispute and whether he has been breaching his powers by using the threat.

He regularly outlined in House of Commons debates, speeches and interviews that the government’s intention was to compel junior doctors to accept changes that have provoked anxiety across the medical profession and the NHS. Norman Lamb, a Liberal Democrat health minister under Hunt until last May, said: “It appears that this is now in a state of shambles and that the secretary of state is in a hole and can’t move forward on this. The government’s latest legal position seems to show that Jeremy Hunt had no power to impose [the contract] all along.”

Lamb, who was an employment lawyer before becoming an MP, added: “This is quite a dramatic change from the assumption that people have had that the health secretary is able to force junior doctors to abide by this contract. If he’s changed the language from ‘imposing’ to ‘introducing’, it may be that there’s no way the government can continue to try to get this contract implemented. It looks like the contract is dead in the water, that it has no life in it, like the dead parrot in Monty Python.”

The fact that Hunt is no longer claiming to be imposing the contract is outlined in a five-page letter sent last Friday by the government legal department to Bindmans, the solicitors acting for a company called Justice for Health, formed by five junior doctors. They are going to the high court today to

formally initiate a judicial review of the lawfulness of Hunt’s right to impose the contract, in which Saturday will become part of a trainee medic’s usual working week for the first time.

In the letter, government solicitors state that Hunt has decided to “proceed with the introduction of a new contract” and that he is legally entitled to do so under the NHS Act 2006. It does not mention “imposition” at any point or cite any of Hunt’s countless uses of that threat.

Asked by the Guardian if the health secretary was imposing or introducing the contract, a DH spokeswoman confirmed that it was the latter. “New terms are being introduced for junior doctors as their current contract expires – because agreement could not be reached with the BMA. The secretary of state decided the contract should be introduced based on advice from David Dalton,” she said. Dalton is the chief executive of Salford Royal hospital trust, who Hunt recruited in January as the chief negotiator for NHS Employers in talks with the doctors’ union, which broke down in early February.

In a letter to the government’s lawyers, Saimo Chahal QC, the five doctors’ solicitor, said Hunt was “clinging to the fiction that he had a legal power to make this decision” to impose the contract. She added: “If the secretary of state was pretending to have a decision-making power but in fact only had the power to make recommendations to NHS bodies and others employing junior doctors, the secretary of state will have acted unlawfully by purporting to exercise a power he never had.”

Labour claimed government policy was now “in complete disarray”.

Heidi Alexander, the shadow health secretary, said: “Government lawyers appear to be trying to rewrite history in an attempt to get Jeremy Hunt out of what could be a very significant legal problem.

The reason why this is so significant is that junior doctors have entered into a period of unprecedented industrial action off the back of his decision to impose the contract.”

Hunt is likely to face questions in parliament today as a result of his volte-face. Dr Francesca Silman, one of the five junior doctors taking the legal action, said: “Is Jeremy Hunt wilfully misleading the nation by suggesting he has the power to impose a contract, or is he incompetent and leading doctors to strike unnecessarily? Junior doctors have been asking these questions for months and we are desperate for an answer.”

Political pressure on Hunt over the dispute is building inside his own party. A well-placed Conservative MP said that ministers and MPs, especially women, were privately appalled that the DH’s own equality impact assessment of the new contract admits that it will discriminate against female doctors, including lone parents and those working part-time.

“The fear is that the acknowledged gender discrimination will damage our standing with female voters”, said the MP.

Labour tells Jeremy Hunt to clarify position on junior doctors' contract Denis Campbell

Labour has called on the attorney general to clear up the mounting confusion over whether the health secretary, Jeremy Hunt, has the power to impose a new contract on junior doctors. Heidi Alexander, the shadow health secretary, has written to Jeremy Wright asking him to clarify whether Hunt has the legal right to force 45,000 NHS trainee medics in England to accept new terms and conditions, which have already prompted four strikes.

Hunt deepened the uncertainty over his legal powers in the Commons on Monday when he again said that he was “imposing” the contract, even though both the government’s own lawyers and his department of health insist that he is merely playing a key role in its “introduction”.

“We are imposing a contract with the greatest of regrets,” Hunt told MPs when answering an urgent question from Labour. He is facing a high court challenge from five junior doctors who claim he does not have the power to impose the contract.

In her letter to Wright, Alexander writes that government lawyers’ “failure to point to any specific power relied upon by the secretary of state appeared to suggest that a new contract was not being imposed, but merely approved”.

“This has caused considerable confusion, which today’s urgent question in the House of Commons only added to, as the secretary of state appeared to contradict the argument of the government’s legal department by confirming that he was imposing a contract.”

Hunt was asked by four MPs yesterday to identify the basis of his power to impose the contract, but did not do so, simply insisting that “the secretary of state does have that power and we are using it correctly”.

Alexander has asked Wright, the government’s chief legal adviser, to “set out explicitly where in the defined roles and responsibilities of the secretary of state it gives him the power to impose a contract on NHS employers”, and also why government lawyers did not identify the source of that power when it wrote last Friday to solicitors for the five junior doctors.

Hunt denied that the government had changed its policy from imposition to introduction “This house has been updated regularly on all developments relating to the junior doctors’ contract, although there has been no change whatsoever in the government’s position since my statement to the house in February,” he said.

Lawyers for the medical quintet challenging him in the high court claim that the provisions of the Health and Social Care Act 2012, in which the then health secretary Andrew Lansley set out to limit the health secretary’s power over the NHS, mean that Hunt was exceeding his powers by deciding on 11 February to impose the contract after two months of talks with the British Medical Association failed.

Junior doctors have already staged four strikes over the new plans and a further all-out strike is set to take place on 26 and 27 April. Unlike during previous strikes, emergency care will also be withdrawn.

In the newly revealed letter, sent last Friday by the Government Legal Department to solicitors acting on behalf on a group of junior doctors opposing the contracts, Government solicitors state Mr Hunt will “proceed with the introduction of a new contract” and that he is legally entitled to do so under the NHS Act 2006.

At no point does the five-page document mention an “imposition”.

In response, Mr Hunt has said on Twitter that the government has done what it is “entitled to” following a "disappointing" and “needless refusal” to negotiate by the British Medical Association (BMA).

A Department of Health spokesperson said there had been no change in the Health Secretary’s language in relation to the contracts.

Junior doctors are objecting to a new contract under which they would be required to work more weekends and lose extra pay on Saturday in exchange for a basic pay rise of 13.5 per cent.

The Government says the contract will help implement the Conservatives’ manifesto pledge of improving care at weekends, dubbed a “seven-day NHS”, while junior doctors say a new contract will put patient safety at risk by incentivising unsafe staff rostering.

The dispute has become increasingly bitter and has seen junior doctors go out on strike for the first time in 40 years.

Mr Hunt's contract has also been criticised by the director of the World Health Organisation (WHO), who says it contradicts the status of women set out by the United Nations.

NINE MILLION PATIENTS FAILED BY POOR GP CARE The workload of GPs must be reduced to allow patients to get 15-minute appointments, union leaders have said.

The British Medical Association (BMA) said changes were needed to reduce ‘unprecedented’ strain on surgeries. It called for the number of patients seen each day to be limited by a national standard, with new centres taking any additional cases.

Its report claims doctors are suffering from ‘overload’ and said ‘significant’ action is needed to help a service facing ‘increasing and unprecedented pressures.’ Appointments currently last ten minutes.

Mr Lamb, who was an employment lawyer before becoming MP added: ‘This is quite a dramatic change from the assumption that people have had that the Health Secretary is able to force junior doctors to abide by this contract.

'If he’s changed the language from “imposing” to “introducing”, it may be that there’s no way the Government can continue to try to get this contract implemented.

‘It looks like the contract is dead in the water, that it has no life in it, like the dead parrot in Monty Python.’

The four ‘emergency care only’ strikes since January have led to the cancellation of nearly 25,000 operations and some patients have been waiting months for a new slot.

But on Monday and Tuesday next week junior doctors are planning a total withdrawal of care in which they would even refuse to treat emergency patients.

The revelations could mean Mr Hunt is accused of misleading Parliament, by repeatedly claiming he has the legal right to impose the new contract.

They are outlined in a five-page letter sent last Friday by government lawyers to Bindmans, the solicitors acting for a

company called Justice for Health, formed by five junior doctors.

They are going to the High Court today to seek a judicial review over whether Mr Hunt could lawfully impose the new contract.

Mr Hunt said on Twitter last night that there was ‘no change of approach’ and that a ‘new contract will be introduced’ for junior doctors from August.

He wrote: ‘Government done what entitled to following disappointing & needless refusal to negotiate by BMA.’ Almost three-quarters of doctors struck off the medical register in Britain are from overseas, figures have revealed.

Some 330 of 460 banned from practising between January 2010 and December 2015 had trained abroad.

Of those struck off, the most came from India, Pakistan and Nigeria.

Julie Manning, of the 2020 Health think-tank, told the Mail on Sunday, which obtained the figures using Freedom of Information laws: ‘The public needs reassuring they are all truly fit to practise.’

But a Department of Health spokesperson said: "We have today written to the BMA to make clear that it is not credible to call for imposition to be lifted when they refused to negotiate on the one remaining issue of Saturday pay that separates the two sides.

“More than 500 doctors have already signed up to a new contract that was 90 per cent agreed with the BMA, following 75 meetings and 73 concessions made by the Government.”

In a letter to Dr Malawana, Mr Hunt said: “We must be clear that anyone deciding – at your urging – to withdraw potentially lifesaving care for patients is making a choice to do so. Many will find this disproportionate given the matter still in dispute is Saturday pay rates.”

Junior doctors say that the dispute is about more than pay, and have warned that a new contract not backed up by additional funding to pay for a big boost in the medical workforce will spread the profession too thin, leading to dangerously under-staffed wards.

The last-ditch letter from the BMA came as the medical regulator, the General Medical Council (GMC), issued guidance warning that some hospitals “may struggle to cope” during next week’s strikes, which will be the first to see junior doctors walk out from all types of care, including A&E departments and other emergency services.

The escalation has prompted stark warnings over patient safety from senior doctors including the NHS medical director Professor Sir Bruce Keogh and the chief medical officer Dame Sally Davies.

Dr Malawana himself sought unsuccessfully to convince union colleagues before the announcement was made that paediatric emergency services should be excluded from the strike, according to internal emails seen by the Health Service Journal last week.

GMC chief executive Niall Dickson called on “every doctor contemplating further and escalated industrial action to pause and consider again the possible implications for patients” and said that the “right option” for some may be not to strike.

“The GMC cannot second guess the situation facing each doctor in training in England – that must be a matter for individual judgement. But given the scale and repeated nature of what is proposed, we believe that, despite everyone’s best efforts, some hospitals may struggle to cope. In these cases where local circumstances are particularly acute, the right option may be not to take action that results in the withdrawal of services for patients,” he said.

In his letter to Mr Hunt, Dr Malawana wrote: “With a week to go to the start of the first full walkout of doctors in this country, I am writing to make a clear offer in a bid to avert industrial action.

"Simply put, if the Government will lift the imposition, junior doctors will call off next week’s strike action on 26 and 27 April.

“The imposition of this contract is tremendously damaging to the morale of junior doctors and medical students and has resulted in a complete breakdown of trust between doctors and the Government. It is this decision which has led to the current, lamentable situation, the resolution to which is now squarely in your hands.

“As you know, no junior doctor wants to have to take industrial action, but they have been left without further recourse. Junior doctors who I meet up and down the country are saying they will not accept a contract being forced on them, a contract which the Government’s own equality impact assessment acknowledges to be discriminatory to women."

The decision to impose the contract came in February, after Mr Hunt was advised by his chief negotiator, NHS hospital chief executive Sir David Dalton, that there was “no realistic prospect of a negotiated outcome”.

Imposition means NHS trusts will be forced to offer the new terms to junior doctors beginning new contracts from August. NHS foundation trusts, which have more autonomy, can in theory set their own terms and conditions but the Department of Health has said it expects the contract to be rolled out nationally.

The contract will require junior doctors to work more weekends for less pay on Saturdays. Basic pay will increase by 13.5 per cent to compensate. However, there is no additional funding being offered, so junior doctors fear the current workforce will be spread too thinly and rotas will be understaffed more often during the week, endangering patients.

There are also concerns over plans to drop automatic annual pay increases, which the Government’s own impact assessment said would disproportionately impact on women doctors who take time off for maternity leave.

Calls are growing for doctors professional bodies, the medical royal colleges, to intervene and act as an intermediary between the Government and the BMA to prevent the dispute from escalating any further.

In a strongly worded statement, the president of the Royal College of Psychiatrists Professor Sir Simon Wessely, said the dispute had become “a matter of deep concern and genuine alarm.”

“Both sides have a duty to do all they can to minimise harm to patient care. Even at this late hour there is time to step back from the brink,” he said. “History and the public will not be kind to any party who is not seen to have gone the extra mile to try and resolve this dispute, not least because as was seen earlier, the difference between the two sides is no longer vast. It is time to put aside pride, or short term political calculations.”

Hospitals are finalising plans to help them cope with 48 hours of unprecedented disruption after a last-ditch attempt

by MPs to avoid this week’s all-out strikes by NHS junior doctors failed to break the deadlock between them and the health secretary.

Specialists from other hospital departments will be drafted into A&E units on Tuesday and Wednesday to help with the extra pressures caused by junior doctors’ decision to withdraw cover from emergency care areas for the first time in the NHS’s 68year history.

Hospitals are asking patients to stay away from A&E during the walkouts, which will be staged from 8am to 5pm each day, unless it is an emergency and are bringing in consultants as cover. A total of 12,711 non-urgent operations and 112,856 outpatient appointments have been cancelled as part of determined efforts to ensure patients’ safety when there are far fewer doctors on duty than usual.

New survey findings shared with the Guardian suggest that a large majority of junior doctors in England could take part in the stoppages, despite warnings from the profession’s regulator, the General Medical Council (GMC), and leading medics that their action could harm patients and wreck public trust in doctors.

That will be a blow to Jeremy Hunt and his fellow ministers at the Department of Health, who have been hoping that trainee doctors below the level of consultant would start to desert the campaign against the new contract he plans to impose on them from August. They have already staged four walkouts since January.

In the first attempt to gauge participation in this week’s action, 903 (78%) of 1,158 junior doctors questioned in one survey said they would take part in strikes. Of the 249 who said they would not take part, only 53 said they intended to actually cross picket lines. They include doctors who disagree with strikes as a tactic and a few who fear patient safety may be compromised. Most of the other 196 will be on night shifts or pre-arranged leave and so are unable to join in anyway.

“The strength of opposition to these contracts remains strong amongst junior doctors, with this week’s strike turnout likely to be significant”, said Dr Francesca Silman, who is one of five junior doctors seeking a high court judicial review alleging Hunt has no legal power to impose the contract.

Silman said she had conducted the survey via email, using junior doctor mailing lists rather than social media.

Junior doctors strike will not put patients at risk, say senior medics During the walkouts, junior doctors will refuse to work in life-or-death areas of care, including acute medicine, maternity services, emergency surgery and intensive care.

The Royal Stoke University hospital is bringing in two locum consultants to help staff its acute medicine unit and is asking patients with all but genuine emergencies to stay away from its A&E unit because of what it calls “an unprecedented situation for the NHS”.

It has reminded its junior doctors of last week’s GMC advice that they should think again about striking in case patients come to harm, especially in hospitals that will struggle to cope without them.

Hospital bosses have been talking directly to junior doctors in some areas of care to ask them to consider coming in.

Like other hospitals across England, Stoke has had to cancel far more planned activity than during the previous four strikes. It has postponed 883 clinics and operations, compared with 321 during the most recent 48-hour walkout.

The Royal Free hospital trust in north London is switching specialists from their usual duties in paediatrics, acute medicine and surgery to the A&E units at its main hospital and Barnet hospital.

Southampton General hospital is also reallocating clinical staff but stressed that “all emergency and urgent services will be fully-staffed at all times during the strike”.

The strikes look certain to go ahead after Hunt rejected an eleventh-hour compromise, produced by a cross-party group of MPs, that would have led to them being called off in return for his agreement to pilot his controversial changes to junior doctors’ terms and conditions.

The olive branch, which was backed by the British Medical Association, the doctors’ union, was contained in a letter from Heidi Alexander, the shadow health secretary; the Lib Dem MP and former coalition health minister Norman Lamb; Dr Dan Poulter, like Lamb a member of Hunt’s ministerial team until last May; and Dr Philippa Whitford, an SNP MP who is also an NHS breast cancer doctor.

Hunt dismissed the plan, saying on his Twitter feed: “Labour ‘plan’ is opportunism. Any further delay [to imposing the contract] just means we will take longer to eliminate [the] weekend effect [of higher death rates among patients admitted to hospital on a Saturday or Sunday].”

The Guardian understands that David Cameron told Hunt to maintain his firm stance in the bitter dispute in two separate conversations late last week. The prime minister was adamant that there should be no climbdown from the tough rhetoric and combative tactics Hunt has employed since the row first flared in September.

Sir David Nicholson, the head of the NHS in England until 2014, criticised Hunt’s decision to impose the contract rather than reach agreement. “Our future consultants, leaders and chief executives will forever remember you win by the exercise of power and imposition a catastrophe for the NHS”, he tweeted.

Hunt wrote to Dr Mark Porter, the BMA’s leader, at the weekend asking him to call off the strikes and talk to him on Monday about other non-contractual issues relating to junior doctors’ working lives. This week’s “extreme action … seriously risks the safety of many patients who depend on the NHS”, he wrote.

Trainees coming out of medical school can expect a basic starting salary of £22,636.

This is currently boosted through bonus payments for working more than 40 hours or and/or time worked outside 7am­7pm Monday to Friday.

A fully qualified nurse starts on approximately £22,000. Hours worked on Saturdays, Sundays, public holidays and on weekdays between 8pm and 6am receive a pay premium.

Professions at the top of the scale include law firms and financial services while those at the bottom include public sector employees and retail.

Someone going in to a law firm can expect a starting salary of about £37,000, banking or financial services, £31,250, consulting or business services £28,500 and IT & Telecommunication £28,500.

Meanwhile, those working in the public sector average £23,750, a teacher £23,000 and retail £21,500.

A JUNIOR doctor resigned from his job live on television this morning to devote his time to the legal fight against health secretary Jeremy Hunt.

Dr Ben White made the announcement while being interviewed by Piers Morgan and Susanna Reid on Good Morning Britain.

Speaking on the eve of the first full walkout in NHS history, the 33-year-old told the presenters he and his colleagues have been backed into a corner.

He said: “I've taken the decision, well I will do so today, to resign as a training doctor to focus on a legal campaign, legal proceedings to fight the contract, to fight on behalf of patients and fight for the future of the NHS. “And I feel that I've got an obligation to do that on behalf of my patients.

“I really feel like we have been backed into a corner and there's not a lot of sense coming out from the Government's side of things at the moment.

“We all feel like it's been a long six months.

“We have to put patients first and we can see at the moment the understaffing and the underfunding that's taking place in the NHS - an A&E had to call in the military recently to staff it, in my hospital we had more admissions in 24 hours than we've ever had before.

It says the contract is unsafe and argues the Health Secretary has no legal right to force it on the majority of doctors.

But on Good Morning Britain, London-based Dr White told patients that consultants would be covering emergency care and so they should go to hospital if they need to.

And he said he was sympathetic to the thousands of people who have had operations cancelled because of the industrial action.

Mail Online reports Dr White is in his fourth year of specialist training, having qualified as a doctor around 2010.

Doctors at his level earn around £38,000 in basic pay, and it is said to cost the taxpayer roughly £600,000 to train them.

Junior doctors have rejected a deal for working weekends that would boost their pay by almost a third on Saturdays.

The “time plus 30 per cent incentive", for working just one Saturday in four, is not for nurses, paramedics or other staff such as porters.

Medics will leave A&E departments, maternity units and cancer wards at 8am tomorrow in protest at the Government's plan to rip up their contracts and impose new hours and pay.

A total of 125,000 operations and appointments have been cancelled to free up other staff in advance.

The bitter dispute centres around a new contract in England which the Government says will create a truly sevenday service.

Under the new contract, normal working hours will be extended from 7pm to 10pm on weekdays and will include Saturday from 7am to 5pm for the first time.

Julie Ann Lovell’s daughter, Karen, died at Wythenshawe Hospital in Manchester at 9pm on Wednesday; just four hours after the strike over proposed doctors’ contracts came to an end.

The 33-year-old had been in critical care for several weeks following a heart operation.

In a Facebook post addressed to Mr Hunt, Ms Lovell said she “fully support[s]” the junior doctors’ actions, saying her daughter “did not die due to this strike”.

The 51-year-old said she would not “accept” her daughter’s death being included in “any statistics” aimed at demeaning striking doctors, praising the staff at Wythenshawe Hospital for their “care and attention”.

The health secretary appears to be backing away from claims he is prepared to impose a new contract without the agreement of the BMA.

BY NEW STATESMAN The Guardian has today suggested that Jeremy Hunt has “u-turned” over his proposed new contract for junior doctors.

A letter seen by the newspaper and verified by the Department of Health appears to show that Hunt has “retreated from his claim that he has the right to exercise what he called the ‘nuclear option’ of imposition”.

Hunt has previously threatened to force through changes to junior doctors’ contracts without the agreement of the British Medical Association. Junior doctors have been on strike four times over the proposed changes, and are due to strike again in an escalated action which includes emergency care later this month.

Justice for Health, a company set up by a group of junior doctors, is scheduled to start a judicial review of Hunt’s right to impose the contract in the high court today.

Yet the five-page letter seen by the Guardian, sent from the Government Legal Department to Justice for Health’s lawyers, reveals that Hunt no longer claims he will impose the contract.

Shadow health secretary Heidi Alexander has suggested government lawyers “appear to be trying to rewrite history”. Calling the strikes so far “a period of unprecedented industrial action” for the profession, Alexander raised the possibility that Hunt may have “misled parliament” with regards to his willingness to impose the controversial contract on doctors.

The solicitor acting for Justice For Health was quoted in theGuardian as saying: If the secretary of state was pretending to have a decision-making power but in fact only had the power to make recommendations to NHS bodies and others employing junior doctors, the secretary of state will have acted unlawfully by purporting to exercise a power he never had.

Dr Francesca Silman said the government was putting pressure on employers to impose new pay and working conditions on junior doctors to combat Hunt's inability to do so.

She added hospitals operating outside local authority control were under "huge financial pressures" and that one government agency had already threatened to remove trainee medics if trusts refused to issue them with the new contracts.

Speaking ahead of a High Court challenge today, Dr Silman accused Hunt of imposing his contracts by stealth.

"This is something weâ&#x20AC;&#x2122;re a bit worried about," she told BBC Radio 4's 'Today' programme.

She claimed Health Education England, a public body charged with oversight of the NHS workforce, had written "threatening letters" to hospitals, warning trainees would be fired unless they were hired on the new contract.

"These trusts are all under huge financial pressures," Dr Silman said. "There is unprecedented under-funding of the health care system at the moment..."

"Weâ&#x20AC;&#x2122;ve got so many different sources on how deeply involved the government are in putting pressure on these bodies - itâ&#x20AC;&#x2122;s very clear."

The medic, who works in a GP's practice in north London, is one of five junior doctors, calling themselves 'Justice for Health', seeking a judicial review into Jeremy Hunt's repeated threat to "impose" the new contract on thousands of NHS workers.

Her commencement of action in the high court today comes as Labour said the health secretary could have misled parliament by speaking of the threat to force new working terms on doctors in front of MPs in the House of Commons.

A department of health spokeswoman told The Huffington Post UK: "This is a fair and reasonable contract that is a good deal for junior doctors and the NHS and is supported as such by chief executives of the national bodies that represent hospitals.

Health Education England said of Dr Silman's allegations: "Junior doctor training is based on a number of rotations around different NHS employers.

"A single national contract has always been used to ensure the system works, and a single national contract is the only way it will work in future.

We have to ensure junior doctors get the full range of training they need but also that patientsâ&#x20AC;&#x2122; needs are met in every employer where rotations are undertaken. This cannot be done with a complex system of multiple contracts.

"We need to ensure that every part of the NHS, and patients in every part of the country, have fair access to the doctors they need."

According to The Guardian, Justice for Health received a letter from the Government that outlined the change in Mr Hunt's approach.

The group crowd­funded their legal campaign and have so far raised £135,000 to pay lawyers to act on their behalf.

A spokeswoman for the campaign group said their High Court case is likely to be heard in early June.

The new contract is part of the Government's drive to improve care over weekends after its research suggested mortality rates were higher. The DH highlighted that it will not be imposed on NHS foundation trusts, which are free to determine their terms of employment.

Mr Hunt tweeted on Sunday: "As set out in BMA's own FAQs on legal position. Govt done what entitled to following disappointing & needless refusal to negotiate by BMA."

She also warned that if the legal challenge is upheld, the Jeremy Hunt’s repeated claims to MPs that the contracts would be imposed raises the possibility that he misled Parliament. She said: “This revelation is crucial because junior doctors have entered into a period of unprecedented industrial action off the back of the Tories’ decision to impose the contract. Rather than trying to clarify the situation, Hunt has stayed quiet and refused to negotiate any further.

“His motives, judgement and competence are now being called into question. If Jeremy Hunt is now claiming he isn’t imposing the contract, then this also raises the prospect that he has misled Parliament.”

The apparent softening of the Tory Government’s line on the contracts comes in a letter from solicitors representing the Department of Health in the high court case. Writing to the lawyers bringing the challenge, they do not mention Hunt’s repeated threat that the contracts would be “imposed”, and claim that the lawsuit is “simply misconceived”.

Consultants would continue supporting their junior colleagues but Modi called for the government to return to the negotiating table with the British Medical Association (BMA).

A group of junior doctors called Justice for Health are mounting a legal challenge at London’s High Court to the new contract.

Their move comes in advance of next week’s all out strike by junior doctors on Tuesday 26 April and Wednesday 27 April.

Junior doctors are set to withdraw emergency care in their two days of action between 8am and 5pm each day, which is unprecedented in the history of the NHS. Hunt tweeted today (Monday 18 April) that the government had done “what entitled to following disappointing and needless refusal to negotiate by BMA.” The chairman of the BMA’s junior doctors committee Johann Malawana said the government was unwilling to return to talks with them.

While the chances of the British Medical Association cancelling the two­day strike due to start on Tuesday remained slim, its chairman Mark Porter was mulling an invitation from Mr Hunt to call off the action and instead meet him to discuss improving junior doctors terms and conditions.

Mr Hunt, however, came under further criticism last night for having rejected a cross­ party proposal backed by the BMA that the new contract for junior doctors should be tested in a local pilot scheme before being rolled out nationwide. He dismissed it as “Labour opportunism”.

‘Disgrace’ Shadow Health Secretary Heidi Alexander, who negotiated the deal with the BMA, hit back angrily: “Jeremy Hunt’s handling of these negotiations has been nothing short of a disgrace. He has undermined staff morale, destroyed trust and alienated a generation of junior doctors. With a strike just a matter of hours away, this issue is now above party politics,” she said.

After rejecting the proposal, Mr Hunt put forward his counter offer.

He said he was prepared to meet Mr Porter on Monday to discuss “workforce and funding requirements for seven­day services” as well as other issues outside the contract which he said have been of concern to junior doctors.

Jeremy Hunt’s letter “Whilst we will now be proceeding with the new contracts, that does not mean that we cannot build trust with further talks on a range of issues that can improve the terms and conditions for junior doctors,” Mr Hunt wrote in the letter.

“I would like to propose that instead of proceeding with this week’s industrial action, you meet with me to discuss [them].”

If the strike goes ahead it would be the first “total walkout” by doctors, including Accident and Emergency Staff, in NHS history. It has led to warnings that patients will die during the strike, which will see junior doctors refuse to perform even emergency care.

“The government doesn’t want us to shine a light on the shady practices that are going on in the NHS, and I think we need to,” Dr Ben White told BuzzFeed News.

Laura Silver BuzzFeed News Reporter, UK Ben White, who studied medicine for seven years and has been a junior doctor for an additional seven years, announced on Monday on ITV’s Good Morning Britain that he will be resigning from his job to focus on campaigning for better patient safety.

White is one of several doctors who formed the campaign group Justice for Health, which has launched a legal battle over a new junior doctors contract that many believe to be unsafe for patients and unfair to doctors.

He told us he had been wrestling with the decision over whether he should continue practising medicine as his campaigning responsibilities have grown in the face of health secretary Jeremy Hunt’s continued refusal to lift the forced imposition of the contract and return to negotiations with the British Medical Association (BMA).

3. “I don’t feel like I’m leaving for good. I love being a doctor, I love looking after my patients, and I want to be able to offer them the best possible service in the NHS,” White told BuzzFeed News.

“Campaigning for patient safety will be an extension of that, to try and get enough staff so we can genuinely offer our patients the best service,” he said.

“I think the best thing I can do for my patients is to try and get more staff in A&E. How can you do that when the government is actively limiting the amount of money hospitals can use to employ staff?”

Seeing A&E departments under extreme pressure in London hospitals over the last three years and becoming deeply involved in the junior doctors contract dispute during the last six months has been a real “eye-opener”, White said.

“We need to have an open public debate and to make as much of a deal of it as possible so the public are aware of where we see the health care service going,” he said. “The government doesn’t want us to shine a light on the shady practices that are going on in the NHS, and I think we need to.”

White highlighted recent calls from hospitals to bring the army in to support overstretched emergency departments that were eventually rejected by the government.

“More people are coming through the door in A&E than ever before, and more people want to see their GP than ever before, and the government do not have a plan to tackle it,” White said.

White said he will now continue to pursue the judicial review of the junior doctors contract launched by Justice for Health but will also work with groups such as Safe Staffing Alliance and whistleblowing organisation Patients First to address numerous issues within the NHS in a transparent and public way.

“We’ve come too far just to give up on it all and go back,” he said. “I think I will go back to working as a doctor eventually, but for now I want to carry on campaigning.”

5. Junior doctor Roshana Mehdian told BuzzFeed News she was left in tears after watching White resign live on TV and described it as “a time of great distress” for many junior doctors.

“I have come to know Ben well since this dispute started, and his dedication and passion for the NHS and its patients know no bounds,” she said. “I watched him resign live on TV with my friends who are also junior doctors and there wasn’t one of us with a dry eye left in the room.

“It is time of great distress for us and patients, and we implore the government to work with us rather than against us and do what is right for patients: lift imposition and negotiate.”

White echoed Mehdian’s call for the government to intervene and stop two days of walkouts by junior doctors, beginning at 8am on Tuesday.

“We need to stop imposition – it’s not too late for Hunt to call off the strike if he genuinely wants to negotiate with the BMA,” White said.

He said it was important for members of the public to remember that there will still be senior doctors providing care in hospitals during the walkouts. “If you are unwell you need to go to hospital and you will be looked after,” he said.

It's the third strike by junior doctors since the beginning of the year, but during this walkout they will not be providing on-call emergency care.

They've been driven to this by the Conservative health secretary Jeremy Hunt, who wants to impose a new contract that would make them work more hours, stretching them beyond their capacity and, they say, endangering patients.

The strike is likely to go off as the other two did. It will cause disruption â&#x20AC;&#x201C; thousands of outpatient clinics will be affected and planned surgeries will be postponed â&#x20AC;&#x201C; but the walkout is unlikely to pose any serious danger to patients. We're unlikely to see the Sun's warnings of emergency field hospitals being set up in tents coming true.

With the dispute continuing to escalate, what happens next? Is it possible that the sensationalist warnings could become less ridiculous? Will the fight only end when NHS hospitals begin to look like something from a Vietnam war epic IRL and not just on the front pages of the tabloids?

Beyond this week's strike, neither side looks set to budge. The health secretary is giving no signs of conceding anything to the doctors and has stepped away from the negotiating table.

"Everybody credible has told Jeremy Hunt to keep talking to the junior doctors... 22 different medical royal colleges have tried," says Dr Phil Hammond, Private Eye's health correspondent of nearly 25 years. "I suspect that if we kidnapped Jeremy Hunt's kids he'd not return to negotiations. I don't know what's gone on with him. He's got tunnel vision."

On the other side, the junior doctors appear steadfast in their resolve to not accept the contract as it stands. Emails sent by the chair of the British Medical Association's (BMA) junior doctors committee, Dr Johann Malawana, seen by the Health Service Journal, said if this week's strike had no effect, an indefinite strike from the 8th of June was one option in their ongoing campaign.

However, the junior doctors â&#x20AC;&#x201C; like the royal colleges â&#x20AC;&#x201C; have been continuing in their attempts to get Hunt back to the negotiating table. "Even up to the last minute, this weekend, we've literally been standing outside the Department of Health trying to speak to Jeremy Hunt to avoid this strike," says Dr Jeeves Wijesuriya, a junior doctor and member of the BMA's negotiating team. "He says the door is open and that he wants junior doctors to come back to talk to him, while in reality he's been sneaking out the back door of the department to avoid us. We've been to his place of work, his home constituency, but he's dodged us everywhere. He's so illusive."

With Hunt seemingly adamant in his opposition of negotiations, and the doctors equally steadfast in their opposition to his new contract, it seems the dispute could continue well into the summer and become increasingly messy.

Crucial is the question of whether or not the BMA would support more strikes beyond the ones planned for this week. "Part of the government's strategy, I think, is hoping that the BMA will implode in time," says Dr Hammond.

"The government know the BMA is divided and it has always been divided... If the junior doctors were to announce an indefinite strike, the top of the BMA would buckle and they'd announce they don't agree with it."

Facing down the BMA would be its own reward for Hunt, suggests Hammond. "Hunt is coming to the end of his reign and he wants to go out with a bang... in terms of his future political ambitions, showing he's toughed it out with the BMA and, within his own party â&#x20AC;&#x201C; it makes him look tough."

But he can't rely on beating the BMA alone. Five junior doctors have launched a judicial review against the health secretary. Calling themselves Justice for Health they are challenging his claim that he can impose the contract on the doctors against their will. "We're saying to Hunt: you don't have the authority to impose a contract change; your powers to make such major changes to the NHS were devolved to the organisation itself in 2012 under the Health and Social Care Act," says Dr Francesca Silman, one of the five doctors launching the challenge.

Justice for Health found that the majority of doctors in the NHS are not employed by organisations that Jeremy Hunt actually controls. Hunt's decision to close Lewisham hospital's A&E and other services in 2012 was challenged in a similar way, Dr Silman says. "He lost in the High Court because he didn't have the legal power to make that decision." The current legal challenge to the contract dispute follows similar arguments and so has precedent to be successful. The BMA has also launched a similar legal challenge against the health secretary.

The government is currently trying to change consultant contracts to make them work a seven-day week as standard. Once again, they're trying to cut consultant pay at the top and the bottom of the scale. These changes are currently being negotiated with the BMA, which is tight-lipped on the progress of the talks. "[The consultants] strength of support for the junior doctors would suggest that many of them wouldn't accept a new seven-day contract," says Dr Hammond. "Industrial action by the consultants would be a lot more serious if it did

happen; it could be a very long and protracted dispute."

The junior doctors strike has happened without causing some sort of dire medical emergency so far because the senior doctors have covered them, so a strike by consultants over similar contract changes could be very messy indeed, and seems inevitable if the government attempts to impose a similar contract. Thousands of junior doctors â&#x20AC;&#x201D; a term used for medical practitioners who are working while still going through their years of training â&#x20AC;&#x201D; walked out of both routine and emergency care. It is the latest in a series of strikes over working hours and pay but is the first that has affected intensive care and maternity and accident and emergency wards.

The NHS said "military level" contingency planning had been carried out to protect patient safety during the 48-hour strike, including the cancellation of nearly 13,000 operations and more than 100,000 appointments, the redeployment of nurses and more senior doctors into emergency care, and the cancellation of holiday and study leave.

There are more than 55,000 junior doctors in England, around a third of all medical staff. Doctors who belong to the trade union British Medical Association (BMA) have been in a long-running dispute with the government over planned changes to their contracts, which would mean an extension of their standard working hours to include evenings and Saturdays.

The contract is being changed to make basic hours (and pay) last from 7am to 10pm, and 7am to 7pm on Saturdays, as part of a government manifesto pledge to create a "seven-day National Health Service."

The Health Secretary Jeremy Hunt has offered an 13.5 percent basic pay rise but the BMA says this is offset by an overall reduction in the pay for antisocial hours, particularly Saturday pay â&#x20AC;&#x201D; disputed by the government which says three quarters of doctors will take home a pay rise. While the BMA agrees with the government drive to create a seven-day NHS it says there is a dire shortage of doctors and funding.

A letter sent by the BMA to Hunt over the weekend suggested the new contract be gradually phased in, so its implications could be analyzed at a select few hospitals before being implemented more widely. However, this offer was turned down by the government.

In an interview with BBC Radio 4, BMA chairman Mark Porter accused the government of distorting research and statistics to buttress its non-existing case on this. He said the government had given junior doctors no other choice.

"The health secretary is trying to find some way to throw mud at the junior doctors of this country who have been providing weekend and night emergency cover since the NHS started," he said.

Porter said they had advised their members to take part in contingency planning and the NHS had put in a "magnificent effort," meaning that senior doctors would deliver the necessary care. Porter also denied that the BMA had refused to talk. "We have said repeatedly and always that we will call off the strike if the government will call off the imposition. By contrast the government has said... that there is nothing that will get it to call off the imposition."

Karen Smith, who had her spinal procedure cancelled for this coming Thursday, told BBC Radio 4 she was "devastated" when she heard it had been put off. "I am desperately disappointed that it hasn't gone ahead but I do support the junior doctors 100 percent," she said.

"We put our lives in their hands... and our families lives as well and [they're a] highly educated group of people and if they all say that this contract that's been imposed on them isn't safe then I believe it isn't safe."

Clare Marx, president of the Royal College of Surgeons, said: "It just shows how sorry a state we are at at the moment, I didn't ever think we'd get to this stage. The current dispute has got to a lose-lose situation," something she said was particularly impacting patients.

Speaking to parliament on Monday afternoon, Health Secretary Jeremy Hunt said he had spent three years trying to solve this issue, holding 75 meetings. Hunt blamed the "difficult" junior doctors committee for the standoff. It was "totally inappropriate" to withdraw emergency care, he argued.

"We could have had a negotiated solution a long time ago," he said, but claimed the BMA had gone for an "outright win."

"Do you move forward or do you give up?" he continued. "When it comes to patients' safety we're moving forward."

"Where health secretaries have made mistakes in the past is where they have been too willing to compromise on patients' safety."

A poll carried out for the BBC by Ipsos MORI found that public support for the junior doctors is increasing, with around 57 percent backing them against the government.

A junior doctor resigned from his post live on television this morning after insisting he and his colleagues have been 'backed into a corner' by health secretary Jeremy Hunt.

Dr Ben White sensationally quit as a training doctor while being interviewed by Piers Morgan and Susanna Reid on Good Morning Britain.

He said: 'I have taken the decision that I am resigning as a trainee doctor to focus on a legal campaign to fight the contract on behalf of my patients and on behalf of the NHS.' We have to put patients first and we can see at the moment the understaffing and the underfunding that's taking place in the NHS ­ an A&E had to call in the military recently to staff it, in my hospital we had more admissions in 24 hours than we've ever had before.

This isn't being listened to ­ we have to look to the future, I think.

He said: 'If I had had an operation cancelled as a result of the strike I would be very annoyed or worse ­ there's a chance I could have been harmed as a result of having an operation cancelled.

'We are sorry for that.'

Dr White, who is originally from Greater Manchester, is currently a gastroenterologist at Newham General Hospital in East London.

Doctors will typically move into a specialism such as emergency medicine or radiology. These basic salaries range from £30,000 to £69,325.

The NHS Employers Organisation, which is opposing the BMA, says the average salary of a junior doctor is £37,000.

How does their pay compare to other graduate professions?

Figures from the Association of Graduate Recruiters show graduates typically start out on salaries ranging from about £21,000 to £37,000.

A fully qualified nurse starts on approximately £22,000. Hours worked on Saturdays, Sundays, public holidays and on weekdays between 8pm and 6am receive a pay premium.

Professions at the top of the scale include law firms and financial services while those at the bottom include public sector employees and retail.

It will be the first time in this country that doctors have staged a full walk­out. In previous strikes junior doctors provided emergency care cover.

Here is a timeline of how the dispute developed: 2015 October October 12 ­ Junior doctors demand “concrete assurances” from the Health Secretary Jeremy Hunt, saying the “threat” that a contract will be imposed upon them must be removed.

October 17 ­ Up to 20,000 people take part in a protest in London over the Government’s plans to impose a new contract for doctors. Under the plans, the contract will reclassify doctors’ normal working week to include Saturdays and late evening working, with critics arguing it could lead to pay cuts of up to 30%.

November November 4 ­ Government offers doctors time­and­a­half for night shifts, time­ and­a­third for Saturday evenings and Sundays and an 11% pay rise.

November 19 ­ A total of 27,741 doctors (98%) vote in favour of strikes after being balloted by the BMA.

Premium pay could start at 9pm Monday to Friday rather than the original offer of 10pm. Dr Johann Malawana, chairman of the BMA’s junior doctor committee, welcomes the involvement of Sir David Dalton but says an agreement could still not be made. Talks remain ongoing.

January 18 ­ David Cameron says the Government has not ruled out imposing a new contract on junior doctors if their dispute over new terms and conditions cannot be resolved in talks.

January 19 ­ The BMA suspends plans for 48­hour industrial action due to take place on Jan 26, on the basis that some progress is being made in the talks.

February 9 ­ Government is accused of blocking deal put forward by the BMA that would see junior doctors’ basic pay rise by about half the 11% offered by ministers in return for Saturday not to be treated as a normal working day. Jeremy Hunt refuses to deny claims that he rejected a deal that could have averted further industrial action.

February 10 ­ Thousands of junior doctors all over England take part in the second day of strikes.

February 23 ­ Three 48­hour strikes are announced by junior doctors to take place in March and April.

March March 9 and 10 ­ Thousands of operations are cancelled as walkouts take place over two days.

March 31 ­ Details of the new contract are published by the Government on the same day the BMA launches a judicial review challenging the lawfulness of the decision.

April April 5 and 6 ­ A second legal challenge is made by NHS staff campaign group Just Health and more strikes are held, causing around 5,100 procedures to be postponed. The cast of Green Wing reunited at the hospital they filmed at to show their support for junior doctors.

Justice for Health, set up by five junior doctors, took out a judicial review challenging the legality of imposition in the High Court.This is another sign of the mounting crisis facing the Tory government and shows that industrial action is putting pressure on Hunt.But referring to "introducing" instead of "imposing" in itself is not a U-turn. When announcing imposition in January, Hunt told parliament he was "proceeding with the introduction of the new contract".Hunt is on the run—but only escalating action will push back this attack. Last night, more than 200 Junior Doctors gathered at the Secret Cinema production in Canada Water to stage a huge protest against the impact that new contracts will have on patient safety and the future stability of the NHS.

The protest was part of Secret Cinema's ongoing drive to promote social causes. Secret Cinema is currently staging of Danny Boyleâ&#x20AC;&#x2122;s cult classic 28 Days Later, and recently laid on a free screening for hundreds of junior doctors and NHS staff.

The company is supporting the Justice for Health campaign, which this week forced the current Health Secretary Jeremy Hunt to give an emergency statement to Parliament regarding the Governmentâ&#x20AC;&#x2122;s ongoing negotiations with Junior Doctors.

19.04.16 The legal basis for imposing a controversial new contract on junior doctors is increasingly in doubt after an urgent debate yesterday in the House of Commons.

However, in a second letter to Justice for Health, a campaign group issuing a judicial review of the decision, government lawyers said Hunt was merely exercising his power to “approve the terms of model national contracts” and “take steps leading to the introduction of model national contracts”.

When asked by Heidi Alexander MP, the shadow health secretary, for an urgent statement, Hunt initially referred to “introduction”. However, when Alexander accused him of causing the further strikes through “misplaced bravado and bullishness” by claiming to be imposing the contract when he had no legal power to, Hunt replied: “Let me answer the hon. Lady’s question very directly. Yes, we are imposing a new contract, and we are doing it with the greatest of regret.”

He claimed the use of the ‘introduction’ rather than ‘imposition’ terminology was because junior doctors will transfer to the new contract when they switch or start jobs, instead of changing contracts currently in place, and that NHS

foundation trusts are technically free to decide their own contracts, although he admitted that Health Education England have said a single national approach to contracts is essential.

Hunt was asked by four Labour MPs – Andy Slaughter, Jo Stevens, Stella Creasy and John Cryer – where his legal power to impose contracts came from, and refused each time to give a more detailed answer than “the secretary of state does have that power and we are using it correctly”.

Following the debate, Alexander wrote to Jeremy Wright MP, the Attorney General, saying: “The Secretary of State appeared to contradict the argument of the Government Legal Department by confirming that he was imposing a contract.

“This continued uncertainty over the powers of the secretary of state for health does nothing to ease the distress felt by staff and patients in the NHS about next week’s industrial action.”

Alexander asked Wright to set out explicitly the roles and responsibilities of the health secretary that give him the power to impose a contract, to explain why the government’s lawyers didn’t provide the source of that power, and to explain if the failure to do so is consistent with the health secretary’s duty of candour.

A number of MPs, including Dr Philippa Whitford, SNP MP for Central Ayrshire, and Jack Dromey, Labour MP for Birmingham and Erdington, echoed calls made last week by the heads of the Royal Colleges for Paediatrics and Child Health and for Obstetricians and Gynaecologists for Hunt to resume negotiations with doctors , which he also refused to do.

A number of Conservative MPs also supported the warning from Professor Terence Stephenson, chair of the General Medical College, that the junior doctors’ decision to withdraw emergency care in the next round of strikes on 26 and 27 April will put patients at risk. Dr Sarah Wollaston, Conservative MP for Totnes, and chair of the Health Select Committee, called for maternity units and casualty departments to be exempt.

He explained, "It will start with those in foundation year 1 from this August and proceed with a phased implementation for other trainees as their current contracts expire through rotation to other NHS organisations."While he acknowledged that foundation trusts were "technically able to determine pay and conditions for the staff they employ," Hunt warned that trusts that did so could see their funding for training posts cut.Alexander asked whether it was "legal for Health Education England effectively to blackmail trusts on the part of the health secretary by withholding funding," worth several million to each trust, but Hunt deflected the question.During the Commons debate Hunt was asked by four MPs to identify the basis of his power to impose the contract. "The secretary of state does have that power, and we are using it correctly," he said.Alexander has now written to the government’s chief legal adviser, the attorney general, Jeremy Wright, asking him to "set out explicitly where in the defined roles and responsibilities of the secretary of state it gives him the power to impose a contract on NHS employers." Her letter also asks why the government’s legal department failed to provide the source of that power in its letter to Bindmans LLP, the firm of solicitors acting for the group Justice for Health, which was set up by five junior doctors.On 19 April Justice for Health applied to the High Court for a judicial review, claiming that by seeking to impose a contract on junior doctors Hunt was exceeding his powers, which had been curbed by the Health and Social Care Act 2012. The BMA is also seeking a separate judicial review on the lawfulness of the imposition, on the basis of the government’s failure to pay due regard to the impact on equalities.Many chief executives of hospital trusts have signalled that they have little appetite for imposition, and some have told The BMJ that they have not ruled out varying terms and conditions.One chief executive of a foundation trust in the north of England said, "I think we would follow the general direction that the secretary of state has set. However, I would like there to be room for some local flexibility on contract negotiation to allow exceptions to be made when local circumstances warrant this."A chief executive of a foundation trust in the south east expected that "hospitals will potentially be forced into competition over local deals, distorting the recruitment market, and creating a tiered pay and benefits system for junior doctors," adding, "My fear is that we hold the line on the national contract, demoralise our staff still further, and enter a game of brinkmanship with neighbouring hospitals."Hospital trusts without foundation status do not have the same freedom to vary the contract but are also prepared to act if they are left with gaps in rotas and deteriorating morale among junior doctors. One chief executive of such a trust told The BMJ, "If the new rota construction suggests there are fundamental problems with the rota design, or the pay of the trainees, or some other significant consequence not intended, then we will raise our concerns up the line and consider not proceeding."In protest at the imposition of the contract junior doctors are set to strike on 26 and 27 April, by withdrawing emergency cover during strike action for the first time ever. As The BMJ went to press the BMA made a last ditch offer to Hunt to call off the strike if the government abandoned its plan to impose the contract in August.

Doubt over Jeremy Hunt's legal power to impose junior doctors? contract The legal basis for imposing a controversial new contract on junior doctors is increasingly in doubt after an urgent debate yesterday in the House of Commons. Jeremy Hunt, the health secretary, said on 11 February that he was imposing the contract, which includes a reduction in the times available for antisocial hours pay, following mass strikes by doctors.However, in a second letter to Justice for Health, a campaign group issuing a judicial review of the decision, government lawyers said Hunt was merely exercising his power to "approve the terms of model national contracts" and "take steps leading to the introduction of model national contracts".When asked by Heidi Alexander MP, the shadow health secretary, for an urgent statement, Hunt initially referred to "introduction".

However, when Alexander accused him of causing the further strikes through "misplaced bravado and bullishness" by claiming to be imposing the contract when he had no legal power to, Hunt replied: "Let me answer the hon. Lady’s question very directly. Mr Hunt's Desperation and Breaking Doctor's Union Seemingly in a state of desperation, Jeremy Hunt has now written to the BMA Chairman asking him to call off the major strike next week [1]. Hunt must know, the BMA Chairman cannot unilaterally call off the planned strike action as the decision to strike was taken following a formal ballot of junior doctors. By­passing Dr Malawana may well be an attempt by Hunt to split the BMA, but hopefully the BMA will not succumb to such tactics. Those “seniors” [2] who are close to Hunt should tell him that “proceeding with the new contracts” [1] is not the way forward if Hunt is genuinely keen to rebuild trust with junior doctors. In any event, Justice for Health’s judicial review claim [3] (which seems to be a far more attractive legal challenge than the BMA’s) will decide as to the lawfulness of Hunt’s unilateral decision to impose contracts, and already there are signs that Hunt is retreating from his claim that he has a right to impose contracts [4]; as reported,he may well have also misled parliament in this regard.

Finally, when Dr Godlee says, “in reality it looks like being about breaking the doctors’ union” [2], one wonders whether she’s referring to the trade union, BMA; if that’s what she meant, then such a threat is likely to come from the overwhelming faith that doctors currently have in Justice for Health, which has enormous potential to form a separate union for junior doctors.

Strike still on despite TV resignations, pleas from presidents and MPs’ pilot plans

This week’s junior doctor strike is set to go ahead despite eleventh hour attempts by the BMA and royal colleges to get the government back to the negotiating table.

One junior doctor even went so far as to resign on live television in protest at the soon­to­be imposed contract.

A full strike is planned for 26 and 27 April from 08:00 to 17:00, when junior doctors will walkout and not cover emergency care.

Dr Ben White, a gastroenterology trainee at Newham General Hospital in East London, resigned while being interviewed by Piers Morgan and Susanna Reid on Good Morning Britain.

Dr White is part of the legal campaign launched by Justice for Health contesting whether the Health Secretary undertook a proper consultation prior to deciding to impose the contract.

Presidents of the royal colleges have also made a final bid to persuade the Prime Minister to intervene.

A letter to David Cameron says: “In our view, as leaders of the medical profession, the ongoing impasse in the dispute between Government and junior doctors poses a significant threat to our whole healthcare system by demoralising a group of staff on whom the future of the NHS depends.”

It’s signed by Professor Neena Modi, President, Royal College of Paediatrics and Child Health; Professor Jane Dacre, President, Royal College of Physicians London; and Professor Maureen Baker, Chair, Royal College of General Practitioners, among 10 others.

Some 112,856 outpatient appointments and 12,711 planned operations are set to be delayed due to the action, NHS England says.

Over the weekend, a cross­party plan by MPs was put forward for the new NHS contract to be piloted first.

The letter was organised by Labour’s shadow health secretary Heidi Alexander and was signed by Conservative Dr Dan Poulter, Liberal Democrat Norman Lamb and the SNP’s Dr Philippa Whitford.

The letter said: “If it remains your intention to introduce this new contract, we believe it should be piloted in a number of trusts/across a number of deaneries and for its impact on patients, staff and the ‘weekend effect’ to be independently evaluated.”

But Jeremy Hunt rejected the plan warning that “further delay” in introducing the contract “just means we will take longer to eliminate the weekend effect”.

Hunt put forward a counter­proposal to the BMA in a letter to the organisation’s chairman Mark Porter.

In it he said he was prepared to meet the BMA to discuss “workforce and funding requirements for seven­day services” as well as other issues outside the contract that have been of concern to junior doctors.

These include improvements in training, improving work­life balance and the burden of examination and training fees.

However, Mr Porter replied on Sunday, writing that a negotiated settlement “cannot take place with the threat of imposition hanging over our junior doctors’ heads”.

“If you agree to lift imposition while talks resume, we will immediately call off the industrial action”, he wrote in a letter.

The Government said it had 75 meetings with the BMA and three years of talks, and delaying reform further would mean not taking an important step in improving weekend care.

Hunt said of the strike: “The extreme action planned will be deeply worrying for patients, and place enormous additional strain on our NHS at a time of intense pressure.

“I therefore appeal to you one final time to call off strike action that will see doctors withdraw potentially life­saving care, and to meet with me on Monday to discuss a better way forward Dr Ben White’s comments on Good Morning Britain: “I’ve taken the decision, well I will do so today, to resign as a training doctor to focus on a legal campaign, legal proceedings to fight the contract, to fight on behalf of patients and fight for the future of the NHS. “And I feel that I’ve got an obligation to do that on behalf of my patients “I really feel like we have been backed into a corner and there’s not a lot of sense coming out from the Government’s side of things at the moment.

“We all feel like it’s been a long six months.

“We have to put patients first and we can see at the moment the understaffing and the underfunding that’s taking place in the NHS – an A&E had to call in the military recently to staff it, in my hospital we had more admissions in 24 hours than we’ve ever had before.

“This isn’t being listened to – we have to look to the future, I think.”

Crowdfunder attempts to fund legal projects as well as cases

CrowdJustice, the legal crowdfunding platform, has launched its first effort to fund a project, as opposed to a specific legal case, and has already raised half of the target amount from a corporate sponsor.

The Ipswich and Suffolk Council on Racial Equality (ISCRE) charity is seeking £2,000 to fill a funding gap left by the end of National Lottery support and what it hopes will be a successful application for a renewed lottery grant.

To date, CrowdJustice has raised money for 37 cases – the largest being £133,000 to help Justice for Health, a group of junior doctors challenging the contract the government is trying to impose on them – while another 13 crowdfunding bids are still live.

Justice for Health has this week had to launch an emergency second round of funding to cover a £30,000 security for costs order and its own legal costs, and nearly raised the £50,000 sought in less than 24 hours.

“What we don’t want to have to do is lose staff while we are waiting to hear whether the new grant is approved”, ISCRE’s director, Audrey Ludwig, told Legal Futures.

The CrowdJustice bid for funds began yesterday and has 29 days to run.

Half of the £2,000 target has already been pledged by a commercial third­ party funder, Balance Legal Capital.

Julia Salasky, CrowdJustice’s founder, a non­practising solicitor and former Linklaters associate, said she hoped the attempt to raise funds for legal projects rather than legal cases alone would be the “first of many”, but that legal cases would remain “at the core of what we’re doing”.

She pointed out that the ISCRE project helped a large number of people with legal problems, which was very much the platform’s focus. She added that a number of other organisations had approached CrowdJustice looking to raise funds for projects, ranging “from legal journalism to other law centres which have a gap in their funding”.

ISCRE is running a Tackling discrimination in the East project, which it says has helped more than 680 people so far. The free service has received funding from the Big Lottery Fund and its renewal application has reached the second stage. Ms Ludwig said she was hopeful it would be approved.

She explained that most of ISCRE’s clients were the “working poor” who could not afford private lawyers but were not eligible for legal aid. The discrimination project caters for the victims of “all kinds of unlawful discrimination”, including that involving disability, race and pregnancy.

The junior doctors contract would do nothing to deliver a 7 day NHS, experts agree. The government's refusal to back down is because they see doctors as a hurdle to their plans to dismantle what we understand by the NHS plans which have been a long time in the making.

Image: Flickr/Kevin21r Today, the BMA and the Junior Doctors begin unprecedented industrial action against the highly controversial contract – a full 48-hour walk out across all departments.

Let’s make one thing clear from the start – this in no way will affect emergency patient care. As Roshana Mehdian calmly and succinctly conveyed on “Newsnight” last Friday (and NHS England hurriedly confirmed an hour later) full contingency plans are in place, and there is now a specific website containing signposting to services on strike days.

So we can disregard the nonsense surrounding junior doctors being “militant” and their action being a “danger” to patients, and cut to the chase - the real reasons behind their industrial action and the objections to the contract. And the real reasons behind the Conservatives’ intransigence and unrelentingly bombastic attitude towards the BMA and its members.

Speaking to me, Dr Ben White, one of the 5 doctors from the “Justice for Health” group challenging the legality of Jeremy Hunt’s actions and who resigned as a doctor live on television Monday morning over the contract, said: “Despite concerns from public, patients and professionals, he has refused to listen and instead pushed on with a politically motivated agenda for an unfunded "7-day NHS".

White continued: “We already have seven-day emergency services staffed by junior doctors. Trying to stretch staff further would tip an NHS on the brink over the edge into the abyss. He has proffered a scenario which would be a perfect storm for patient safety.”

Indeed. In layman’s terms, we are witnessing a Government attempting to impose a wholly unsatisfactory contract by using an un-costed and untested regime as leverage for the argument – ignoring the recommendations from professional bodies and individuals.

In its evidence-scraping, the Department of Health has used studies and consultations from numerous institutions and experts (most notably the “NHS Services, Seven Days a Week Forum” document, authored by Sir Bruce Keogh), which all point to the fact that it is consultants working patterns that need to change if we were to realise a “7-day NHS” – not junior doctors.

The doctors pay review board said in its recommendations: “We note that junior doctors are already working across seven days: indeed, they play a vital role in the delivery of services, particularly in the evenings, at night and at weekends”. They go further, saying “reform (of the contract) is not directly linked to enabling 7-day services” – but stipulating that the removal of the non-emergency weekend working opt-out clause for Consultants, was.

The contract will also lead to longer shifts and reduced rest times, creating more dangerous conditions for doctors to be working under – and is fundamentally discriminatory against women. The evidence that a “7-day NHS” would decrease “excess deaths” at the weekend is at best tenuous (and at worst nothing but cynical propaganda).

The BMA officially states that “We could not agree to the unsafe and unfair preconditions proposed” but have repeatedly tried to make headway with Jeremy Hunt, while a cross-party delegation led by Shadow Health Secretary Heidi Alexander attempted to broker a deal at the weekend – both to no avail.

So why do the Conservative Government still insist on forging ahead with this contract, even when it flies in the face of mounting clinical and professional evidence?

If we look at how right wing think tanks have been intimately involved in both designing and imposing the contract, and examine the agenda of this right wing in a bit more depth, we begin to see that this is not really about a “7 day NHS”, nor is it really about the junior doctors..

One phrase: privatisation-by-stealth. A purposeful agenda, which requires considered analysis and historical context.

Things that are sorely lacking in most of the debate surrounding the Junior Doctor’s contract.

Rewind to 1988. Conservative MP’s Oliver Letwin and John Redwood published a document entitled “Britain’s Biggest Enterprise: ideas for radical reform of the NHS”, via the right-wing think-tank Centre for Policy Studies.

Comparing the health service to a “slightly wayward and much loved pet”, Letwin and Redwood alluded to the “establishment of the NHS as an independent trust, which increased joint ventures between the NHS and the private sector” – something unheard of then, but is exactly what we have now have had within the NHS for some time.

Both Oliver Letwin and John Redwood are still MPs, with Letwin currently being responsible for Government policy, and Chair of the Conservative Policy Review from 2005-2010. Both have, or have had, vested interests in private healthcare – Letwin being a former executive director of an investment company that specialised in healthcare, and Redwood? Pretty much the same.

In 2005, a pamphlet by Tory ‘modernisers’ including one Jeremy Hunt, called “Direct Democracy: an agenda for a new model party” was released.

On the NHS, the pamphlet spoke of the ambition being “in effect denationalising the provision of health care in Britain”, and described the NHS as a “a centrally run, state monopoly designed over half a century ago” which is a “fundamentally broken machine”.

Fast-forward to the near-present, and in 2012 the “Health and Social Care Act” was introduced, and was a step on the path towards this vision.

The 2012 Health & Social Care Act removed the legal obligation on the Secretary of State’s to provide and secure comprehensive and universal healthcare. It handed a weaker duty to local Clinical Commissioning Groups (CCGs), meaning they can decide whether to take away services, or even start charging for them.

The Act also effectively said CCGs had to let private firms bid to take over any bits of the NHS they fancied, strengthening previous non-statutory guidance and entangling the NHS further in EU competition law.

So, what is the next step in the privatisation-by-stealth of the NHS? The answer probably lies within the “Reform” think-tank.

While Conservative cheerleaders provide the doctrine, institutions like Reform provide the mechanisms to implement it. The think tank Civitas recommended the scrapping of the nursing bursary; Reform endorsed “reducing centralisation” (“Why let a good crisis go to waste?”) and they also pushed for the takeover of “failing” hospitals by private companies (remember Hinchingbrooke?).

In a document from this month entitled “Who cares? The future of general practice”, Reform suggest that (in terms of the NHS) the current commissioning system is too fragmented, and a “healthcare system that acts as one” was needed, that should “cover the whole care needs of defined populations. Integrated commissioning bodies should replace today’s fragmented commissioners. Whole-population-care contracts should be capitated, with commissioners able to attach bonus payments to incentivise improved care in specific areas. Contracts must also be time-limited and the appropriate size to incentivise competition between providers”.

Translated? Whole geographical areas could be offered up to one private company to operate.

This leviathan approach ties in nicely with the Governments current mission of integrating health and social care, with the devolution of overall power relating to budgets in Manchester being the test model for this, and more than 20 other authorities lining up to follow. Could the centre of the Northern Powerhouse be the first place to have its entire health, primary and social care provision operated by one, singular (private) provider?

Key individuals from the private sector have been moved into public office: Simon Stevens – formerly a president of American healthcare firm UnitedHealth, now CEO of NHS England; Nick Seddon – former director of Reform thinktank, now Cameron’s personal advisor on health ; Stuart Rose – board member of Bridgepoint Capital who own Care UK, drafted in by Cameron as an NHS consultant; the list goes on.

So is this why administrations like the Conservative are seemingly hell-bent on selling off public assets, and reshaping them so it’s easier to do so? The blurred lines between big corporations and big governments are foggiest when it comes to the revolving door into the House of Lords. Around 25% of Conservative Peers have vested interests in private healthcare.

“Corporatism” – those blurred lines I mention above – is at the heart of the Government’s strategy surrounding the NHS, and pretty much every other policy decision we see in the modern world – because ultimately the winners are corporations (with profits) and politicians (with careers).

Jeremy Hunt is the current public protagonist of this stealth privatisation policy. But he’s merely another puppet in a long line of ministers on strings (including his private health-promoting cousin) from both Conservatives and Blairera Labour.

But how is the battle over the Junior Doctor’s contract and a “7-day NHS” related to all this?

underfunding, “top-down reorganisation”, the crippling ‘Private Finance Initiative’, CCGs... The drip, drip approach has been essential. The NHS is the 5th largest employer in the world and an organisation of epic proportions, it couldn’t have been privatised in just one parliamentary term. As the director of the right wing Adam Smith Institute admitted a few years back, when asked if the government would really turn the NHS into nothing more than a franchise, a kitemark - "It's been 20 years in the planning,,, I think they'll do it".

Earlier this year a Department of Health draft report ( leaked to The Guardian) stipulated that the 7-day NHS proposals would cost £900m more per annum and require 11,000 more NHS staff. The Department admitted it couldn’t “evidence the mechanism by which increased consultant presence and diagnostic tests at weekends will translate into lower mortality and reduced length of stay”.

Fundamentally, the imposition of this contract will be irreparably damaging to the health service - a fact the Junior Doctors are acutely aware of.

By instigating chaos via an unfunded, unnecessary and unworkable policy, the Government will be able to claim that they’re out of options; that the only remedy left for a crippled NHS is to put it out of its misery and allow the private sector to step in – and with contracts worth around £25bn having been put out for tender in recent years with anything from 33 to 70 percent going to private companies, some worrying signs appear to already be there.

This is classic right-wing “shock therapy”: damage and destabilise a public service so much that you can present privatisation as the only way to revive it. The corporate vultures can move in to pick over the remaining flesh on the bones. Time and time again this strategy has been used around the world, not just on public assets but in some cases on whole countries – note Pinochet’s coup in Chile, mentored by laissez-faire economists like Milton Friedman.

British Rail, a pertinent and similar example, had its funding more than halved between 1982 and 1990 from £1.3bn to just over £500m, and suffered numerous “top-down reorganisations” including the “Organising for Quality” initiative which aimed to decentralise power and put control of budgets into regional cost centres, It was the target of think-tanks like the Centre for Policy Studies (see Letwin/Redwood) floating ideas around about privatisation from the mid-eighties onwards. It was generally scorned by the Government and the press, projecting an image in the public’s minds of an outdated, cumbersome and failing public sector monolith that couldn’t even produce a good sandwich.

The end result? The fire sale of British Rail in 1993 – and the exact same technique is now being applied to the NHS. The dispute we are witnessing is a microcosm of what’s really going on in the NHS: A Government which has little regard for either staff or patients; whose only concern is fattening the clinical turkey up for a corporate Christmas, and who ultimately are showing no signs of relenting from an agenda which has been in the making for three decades.

While the public currently support the industrial action, fickleness and manufactured consent via a complicit media are never far away – and once their backing has gone, then the Government has won.

Simply put, the battle surrounding the contract is just another weapon in the Conservative’s (and their corporate bedfellow’s) armoury in the war against a public health service. Historical context sorely needs to be considered in this, otherwise history will judge us and our actions – and it will not be favourable.

While Oliver Letwin and his ilk appear to disdainfully consider the NHS a “wayward pet” whose only hope is to be put out of its misery, the thoroughbred that is our health service is by no means ready for the knacker’s yard, yet – and the fight for its life must continue, well beyond the next two days.

A JUNIOR doctor resigned from his job live on television this morning to devote his time to the legal fight against health secretary Jeremy Hunt.

Dr Ben White made the announcement while being interviewed by Piers Morgan and Susanna Reid on Good Morning Britain.

Speaking on the eve of the first full walkout in NHS history, the 33-year-old told the presenters he and his colleagues have been backed into a corner.

He said: “I've taken the decision, well I will do so today, to resign as a training doctor to focus on a legal campaign, legal proceedings to fight the contract, to fight on behalf of patients and fight for the future of the NHS. “And I feel that I've got an obligation to do that on behalf of my patients.

“I really feel like we have been backed into a corner and there's not a lot of sense coming out from the Government's side of things at the moment.

“We all feel like it's been a long six months.

“We have to put patients first and we can see at the moment the understaffing and the underfunding that's taking place in the NHS - an A&E had to call in the military recently to staff it, in my hospital we had more admissions in 24 hours than we've ever had before.

The gastroenterologist is one of the leading figures in the NHS staff campaign group Just Health, which has made a legal challenge to try and block the new junior doctor contracts.

It says the contract is unsafe and argues the Health Secretary has no legal right to force it on the majority of doctors.

But on Good Morning Britain, London-based Dr White told patients that consultants would be covering emergency care and so they should go to hospital if they need to.

And he said he was sympathetic to the thousands of people who have had operations cancelled because of the industrial action.

“If I had had an operation cancelled as a result of the strike I would be very annoyed or worse - there's a chance I could have been harmed as a result of having an operation cancelled.

“We are sorry for that," he said.

Mail Online reports Dr White is in his fourth year of specialist training, having qualified as a doctor around 2010.

Doctors at his level earn around £38,000 in basic pay, and it is said to cost the taxpayer roughly £600,000 to train them.

Junior doctors have rejected a deal for working weekends that would boost their pay by almost a third on Saturdays.

The “time plus 30 per cent incentive", for working just one Saturday in four, is not for nurses, paramedics or other staff such as porters.

Health Secretary Jeremy Hunt wants to increase basic pay for junior doctors by 13.5 per cent while boosting starting salaries by 19 per cent in his crusade for a seven-day NHS. But the British Medical Association is furious he plans to impose a new contract after failing to reach a settlement with the union.

How long have you worked in the NHS for?

“I qualified in 2001. I’ve taken quite a long route for a junior doctor, I qualified when things were very different. I’ve seen a lot of changes but this is the worst I’ve ever seen it in terms of morale and people actually leaving because it’s not sustainable or safe the way things are going at the moment.”

“They’re consistently underfunded – the NHS – since they [the Conservatives] got into power so over the last five years most of the UK hospital trusts have flipped from doing okay with their budgets to being in deficit, and we can see that on the frontline – we hear the government talk about how much extra money is being put in but we can see clinically on the frontline that’s not the case.

There’s increasing numbers of rota gaps, so if you have a rota with eight doctors, there may be six doctors, so that’s a quarter of your workforce that’s missing. Those gaps are filled by agency workers, and then since November this government has imposed agency caps for junior doctors and for nurses. While that seems on the face of it an admirable idea, to reduce the amount of money that’s spent on locums, at a time of chronic shortages of staff because there’s no funding it leaves the service demoralised and you restrict the options hospitals have to actually keep things safe, to fill those gaps and get staff. Then you have situations like in Chorley – their A&E department is closing, not because it’s a planned cut, but because they’ve simply run out of doctors by the end of this month. The gaps are unsustainable and unsafe since the locum cap came in in line with this changing junior doctors’ pay to be less – although they keep telling everyone it’s the same.

They’re restricting that, and then emergency medicine is one of the most short staffed specialties, with huge gaps at senior levels, so anybody that they [the A&E department] try to get, there’s just nobody responding to them. Similarly here in Leeds at the St. James’ intensive care unit, they had an extra six­bedded intensive care unit area and that’s had to close because of ongoing issues with nurse staffing related to nurse agency pay being reduced – and then the skilled intensive care nurses who are required to run those beds aren’t working. There have been eight liver transplants cancelled due to not having beds available.

I’ve worked in that unit five or six years ago and I don’t remember them ever saying we’ll have to reject this organ/send it back or deny our patient a liver transplant because there’s no nurse. There’d always be a bed, there’d always be a way. So things are really desperate, they’re really, really bad. It’s already at crisis point.”

And will this new contract make it worse?

“It’s going to make it worse. You’re talking across hospital care and primary care, it’s all been cut. This is why doctors are out on strike – it’s not about pay, we’ve never asked for more pay. A lot of us have been promised a pay freeze, and they’re offering to reduce wages for new entrants. They’ve been saying it’s cost neutral and we’ll be working more antisocial hours but it won’t reduce coverage in the week. But there aren’t any extra doctors. It just doesn’t make sense.

There are the same number of doctors, they want us to do more weekend and evening work to have this seven­day NHS which is to increase elective care, so planned operations like knee replacements that don’t need to be done on a Sunday but that’s what they’re asking us to do. We’re at crisis point to cover the emergency care we’re doing already – they want to have extra cover on Sundays to put on extra clinics etc. which don’t need to be there, and this is going to drive doctors away because doctors are already working maybe every third weekend. The government’s kindly offered to limit it to a maximum of every second weekend… but that’s not sustainable, and doctors will choose to go and practice in Australia or just give up because they’re so demoralised. It’s totally counterintuitive, taking our most trained individuals and telling them you don’t support them and putting them in dangerous conditions.

They’ve also removed the safeguards against long hours. On paper there will be safeguards, but instead of the system we have now to back that up, the system that they’re going to have is essentially to pay the doctor for the hours they have done over and above the contracted hours – which shouldn’t happen anyway

– but at the moment they have heavy punitive fines, and have to pay the doctor a penalty fee, but the heavy fines are on the trust so they avoid doing that because it costs them. Now they have a nominal fine to pay to themselves and that budget will go to the hospital library or such like which they should be funding anyway, so it’s ludicrous – if doctors are worked over the limits, they can just say we’ll fine ourselves and give that money to the library. That’s not a safe system. The hospital isn’t taking any kind of hit to stop that behaviour, there’s nothing to stop them from trying to run units with no staff.”

Does Hunt have the legal authority to impose the contract?

“That’s an interesting question. There’s a group of junior doctors who call themselves Justice for Health, they’ve crowdfunded tens of thousands of pounds to be able to mount a legal challenge to the government, separate to the BMA’s actions. Within a few hours they were able to hit their first targets, so they could have a legal team. It’s now starting to look like the government might not be able to impose it, which would be shocking, to have had the first strikes for decades off the back of something that can’t actually be imposed.

We’re very hopeful that that will progress, but the government have made a statement saying they are going ahead with it anyway, so we have to continue to fight that battle”.

The General Medical Council recently suggested hospitals might struggle in the event of a total strike. Is a strike a proportionate response?

That’s not exactly what they suggested – if you think about it, consultants are the backstop of the service anyway. If a junior doctor was hit by a bus, the consultant would be the first person that would step in to do their job for the night. They have to be capable of doing the job.

What the GMC has said is, if you work in a department where you don’t think your consultant will be able to cope or there won’t be enough staff available and you think patients would be harmed, it would be unethical to participate in the strike. That’s fair, but hospitals have had a long notice period – they know it’s going to be a full walkout strike – so they can cancel their outpatient clinics and scheduled operations that are not time critical like knee operations. They have been warned that this is happening and have had plenty of time to put safeguards in place.

Then consultants are very unified in saying they have our back, they are covering the important services and patient safety will not be compromised. And that’s an important message for us to get out to the public.”

So the GMC has been misquoted in the press?

“I think they’ve been misrepresented – you can say what you like about the tone of a statement saying consider that if you’re endangering patients that’s unethical, I mean that’s not exactly warm and encouraging, but you have to ask what government pressure’s been put on them to make those statements.

It’s been interesting that the royal college – each major specialty has a royal college that organises training and development to do with that specialty – the royal college of paediatrics has been incredibly forceful this week, as Neena Modi, their head, has come out to say that they’re absolutely confident that the strike will be safe, but that what’s really important is that it’s getting dangerous day­to­day in hospitals because of staff shortages.

I’m hearing from paediatricians, junior doctors that I know, that they’re being asked to do the job of two doctors looking after sick children at nights and weekends, and no provision is being made to cover that shortfall – it’s not sustainable. I did a paediatrics job a couple of years ago in Bradford and there were huge

gaps of maybe two or three doctors missing out of nine or ten. So we’d constantly be doing extra shifts, and just trying to keep going. For Jeremy Hunt to turn round in that climate and say that we don’t have a sense of professionalism is just horrendous. The royal college of paediatricians, Neena Modi’s statement has been a watershed.

This is the reason doctors are on strike. They’re not very motivated by pay really, but patient safety is under threat and that is why we can’t accept this contract.”

Finally, why are you personally so passionate about opposing the contract?

“I’m a woman, I work part­time, and I’ve personally had consequences of stress­related illness due to working days into nights into days and feeling constantly jetlagged for years. Doctors sign up to do a minimum of five years to be a GP, ten years to be a consultant. So you’re looking at ten years of constant jetlag, never knowing if you’ll be able to be off for Christmas, or your birthday, or even your wedding, you know – I don’t think it’s sustainable for junior doctors to accept a worsening of that for no reason and with the prospect of their status being downgraded moving forward. I can only see that more people are going to suffer as a consequence of that, potentially leave the profession and not be able to keep the NHS going. I think it’s vandalism on a national scale, it’s a national resource. British people want the NHS and they want it to be public, but the Health & Social Care Bill means that in England the government is already making these huge changes to the NHS so that it’s not in public hands anymore and it’s moving to an American­style system where they’re asking private companies to come in and bid for care like cataract operations. And they can exclude whoever they want. That is not what British people want, and it’s all been done by stealth.

In places like the U.S. they spend about a third of the health budget on admin and chasing people around.

We have one of the cheapest health services in any modern economy because there is no chasing people around or over­investigating, we make the best of the limited budget we have – but anyone can walk in. If you go to a system where you can only get care if you’re a registered person, if you’re a disenfranchised person – a traveller, an abused child, or you can’t get organised payments or bring birth certificates etc. – you get nothing.

It’s small government, just trying to get profits for private healthcare companies and it’s not about patient safety. This is a totally bizarre ideological project.”

A total of nearly 25,000 procedures have now been cancelled as a result of industrial action during the row. Junior doctors are expected to stage a fifth strike tomorrow and Wednesday (April 26 and 27) when they will fully withdraw labour between the hours of 8am and 5pm. It will be the first time in this country that doctors have staged a full walkout. In previous strikes junior doctors provided emergency care cover. Here is a timeline of how the dispute developed: 2015 October October 12 - Junior doctors demand "concrete assurances" from the Health Secretary Jeremy Hunt, saying the "threat" that a contract will be imposed upon them must be removed. October 17 - Up to 20,000 people take part in a protest in London over the Government’s plans to impose a new contract for doctors.

Under the plans, the contract will reclassify doctors’ normal working week to include Saturdays and late evening working, with critics arguing it could lead to pay cuts of up to 30%. November November 4 - Government offers doctors time-and-a-half for night shifts, time-and-a-third for Saturday evenings and Sundays and an 11% pay rise.

November 19 - A total of 27,741 doctors (98%) vote in favour of strikes after being balloted by the BMA. November 30 - Strikes planned for December 1, 8 and 16 are called off at the last minute. Government agrees to suspend its threat to impose a new contract. 2016 January January 4 - BMA announces three strikes in England in January and February when only emergency care will be available. Talks between the union and the Government last less than an hour before breaking down. January 12 - Thousands of doctors walk out for the first strike in 40 years. Around 4,000 operations and procedures are cancelled during the 24-hour walkout. January 13 - Nick Hulme, chief executive of Ipswich Hospital NHS Trust, warns junior doctors’ views are being ‘’skewed’’ by ‘’misinformation’’ about the dispute on social media. January 16 - A new offer from the Government says that, as part of an overall agreement, a premium rate of pay could kick in from 5pm on Saturdays rather than 7pm. Premium pay could start at 9pm Monday to Friday rather than the original offer of 10pm. Dr Johann Malawana, chairman of the BMA’s junior doctor committee, welcomes the involvement of Sir David Dalton but says an agreement could still not be made.

Talks remain ongoing. January 18 - David Cameron says the Government has not ruled out imposing a new contract on junior doctors if their dispute over new terms and conditions cannot be resolved in talks. January 19 The BMA suspends plans for 48-hour industrial action due to take place on Jan 26, on the basis that some progress is being made in the talks. January 29 - Talks break down between the BMA and the Government. The main sticking points are unsocial hours, how rotas would be staffed and the fact the Government wants to ‘’punish’’ doctors who worked the hardest. January 30 ­ Family doctor and head of the BMA’s general practice committee, Dr Chaand Nagpaul, warns that GPs are operating in ‘’a state of emergency’’ because of problems with resources and staffing levels. February February 1 - The BMA announces a strike will take place the following week on Wednesday February 10. February 2 - Health Secretary sends letter to BMA council chairman, Dr Mark Porter, saying he is ‘’sorry to learn’’ that strike will be going ahead and that his ‘’door is open’’ for negotiations. February 6 ­ Vanessa Redgrave and Dame Vivienne Westwood join hundreds of protesters for a ‘’masked march’’ through London in protest over pay and conditions. February 7 - The Scottish Government launches a recruitment drive to encourage junior doctors to consider careers in Scotland. February 9 - Government is accused of blocking deal put forward by the BMA that would see junior doctors’ basic pay rise by about half the 11% offered by ministers in return for Saturday not to be treated as a normal working day. Jeremy Hunt refuses to deny claims that he rejected a deal that could have averted further industrial action. February 10 - Thousands of junior doctors all over England take part in the second day of strikes. Junior doctor resigns over new contract on liveTV A junior doctor announced his intention to resign live on television on Monday out of frustration over the new contract.

Dr Ben White told viewers of ITV's Good Morning Britain that he would be leaving his post as a trainee doctor to join the legal campaign against the contract.

Junior doctors are set to start an all­out strike at 8am on Tuesday and the NHS has already cancelled 125,000 operations and appointments in preparation.

Dr White assured patients that if they are unwell they should go to hospital as consultants would be covering emergency care.

He said: "I have taken the decision that I am resigning as a trainee doctor to focus on a legal campaign to fight the contract on behalf of my patients and on behalf of the NHS." Asked why it had come to this, he was visibly upset and said: "I really feel like we have been backed into a corner and there's not a lot of sense coming out of the Government's side of things.

"We have to put patients first and we can see at the moment the understaffing and the underfunding in the NHS."

He said: "If I had had an operation cancelled as a result of the strike I would be very annoyed or worse ­ there's a chance I could have been harmed as a result of having an operation cancelled.

"We are sorry for that."

The strike is "not just for now", Dr White said, it is "for the future of the NHS".

Dr White is part of the legal campaign launched by Justice for Health ­ an organisation made of a group of doctors. They argue that the "decision to impose" the contract by Health Secretary Jeremy Hunt was not lawful as he failed to undertake proper consultation before the decision.

It is separate from the British Medical Association's challenge.
