WELCOME TO THE CLOWN SHOW:

49 CFR 371.3

Ladies and gentleman! Step right up!

Behold the greatest farce on wheels— where bad brokers hold invisible strings and truckers magically foot the bill.

The FMCSA promises to protect truckers through transparency, but 49 CFR 371.3—the rule designed to ensure brokers disclose essential transaction details—has become more of a circus act than a safeguard. What should be a clear standard feels like an illusion, leaving truckers struggling to make sense of hidden fees

and inaccessible data. Brokers exploit the lack of oversight to shield critical financial details, effectively sidelining truckers from understanding the true value of their work. Meanwhile, the FMCSA’s inaction sends a troubling message: transparency is optional, and truckers are left to fend for themselves in a system stacked against them.

what exactly is the fmcsa 49 cfr 371.3?

At its core, 49 CFR 371.3 requires brokers to maintain transparency in financial transactions between carriers and shippers. This includes disclosing the exact rates paid by shippers and the amounts retained by brokers as commissions or fees. In theory, this regulation ensures truckers are fully informed about the financial agreements impacting their livelihoods. It was designed to empower carriers, providing them with the knowledge needed to negotiate fairly and protect themselves from unethical practices.

However, the reality is far different. Brokers often withhold this critical information, creating a veil of secrecy that leaves carriers in the dark. They exploit loopholes in the system, effectively shutting out truckers from the very transparency they are entitled to. Without proper enforcement, the regulation exists in name only, making it impossible for truckers to advocate for fair rates or expose exploitative practices. This lack of transparency not only puts truckers at a disadvantage but also reinforces a power dynamic where brokers wield disproportionate control.

YOU HAVE A RIGHT TO YOUR TRANSACTION RECORDS

Under 49 CFR 371.3, carriers have the legal right to request full transaction records from brokers, including details about shipper payments and broker commissions.

The current regulation is designed to ensure transparency and protect truckers from hidden fees and exploitative practices. However, less than 10% of truckers are aware of these rights, leaving many vulnerable to brokers who refuse to disclose critical information.

This lack of awareness, combined with the FMCSA’s failure to enforce the rule, has created a system where

FMCSA’S ROLE AND ENFORCEMENT FAILURE

The FMCSA’s responsibility is to enforce the regulations outlined in 49 CFR 371.3, but their failure to act has turned the rulebook into a toothless document. Complaints from truckers about withheld information are often met with silence or bureaucratic runarounds. Brokers, emboldened by this lack of oversight, continue to operate without fear of repercussions, knowing the FMCSA rarely steps in to hold them accountable. This regulatory gap allows brokers to manipulate rates, obscure critical financial details, and maintain a stranglehold over carriers who are left with little recourse. The agency’s inaction has created an uneven playing field where brokers dictate the terms while truckers absorb the risks and consequences.

This lack of enforcement doesn’t just harm individual carriers; it erodes trust across the entire industry. When drivers lose faith in the system meant to protect them, it fosters resentment and instability in an already challenging profession. By ignoring the rule’s intent, FMCSA leaves truckers as unwilling performers in a circus controlled by brokers, forced to play along with unfair practices or risk financial ruin. The consequences ripple beyond the drivers themselves, affecting the efficiency and integrity of the supply chain as a whole. Without strong enforcement of transparency regulations, the industry becomes a breeding ground for exploitation and distrust, damaging its long-term viability.

transparency exists only on paper. Brokers frequently ignore or evade requests for records, knowing there are little to no consequences for noncompliance. Educating truckers about their rights is crucial to shifting this imbalance. By understanding and asserting these protections, truckers can start holding brokers—and the FMCSA—accountable for the transparency they’ve promised but failed to deliver.

Join NOOA today and together we can make a stand for broker transparency!

We

don’t remember buying tickets, but it feels a lot like a circus. Ringleaders promised transparency with 49 CFR 371.3, but bad actors continue to profit while truckers are left holding the bag.

Transparency in the trucking industry is not just a concept—it’s a lifeline. Yet, for most truckers, navigating the tightrope of broker dealings feels more like a dangerous balancing act. Hidden fees, opaque contracts, and vague financial disclosures create a precarious situation where carriers are left to guess at the truth. Without enforcement of 49 CFR 381.3, this tightrope becomes thinner, and the risks of falling into financial instability grow higher with each step.

Despite the regulation’s intent, the lack of clarity leaves truckers exposed to a system where brokers dominate the financial narrative. This imbalance forces carriers to operate on assumptions rather than facts, undermining their ability to negotiate fairly or protect their interests. As long as these conditions persist, truckers will continue to walk a perilous line, where a single misstep could mean losing everything.

A BALANCING ACT WITH NO NET

Truckers are expected to balance their businesses on the edge of uncertainty, relying on brokers to act in good faith. It’s a gamble that rarely pays off. The astounding lack of transparency creates a one-sided dynamic where brokers hold all the cards, leaving carriers with little choice but to trust incomplete or misleading information. Requests for transaction records under 49 CFR 371.3 are often met with hostility or outright refusals, forcing truckers to operate blindly.

Without a safety net in the form of strict enforcement, every misstep—be it hidden fees, unexpected deductions, or unexplained rate discrepancies— pushes carriers closer to financial collapse.

Every

TIGHTROPE TRANSPARENCY

hidden fee or withheld document chips away at a trucker’s ability to stay afloat. Hidden Costs

TIGHTROPE OF TRANSPARENCY

THE TRUE COST OF HIDDEN TRUTHS

While brokers promise fair negotiations, many hide critical financial details like shipper rates and their own commissions. This secrecy makes it impossible for carriers to verify they are receiving their rightful share. Hidden costs or inflated broker fees often eat into a trucker’s profits, turning an already challenging profession into an unsustainable endeavor. Without full transparency, truckers are left questioning every deal, unsure of who truly profits from their hard work.

Shippers, too, are often kept in the dark about where their payments ultimately go, perpetuating a cycle of mistrust across the industry. Transparency isn’t just about fairness—it’s about creating a more efficient and equitable system for all parties involved. Without it, brokers continue to operate as unchecked intermediaries, using opacity as a shield for questionable practices. The result is an environment without trust.

This lack of accountability damages the integrity of the entire logistics chain, creating inefficiencies and fostering resentment among its key players. When truckers operate without clear financial insights, they are less likely to make informed business decisions, such as investing in better equipment or expanding their operations. This stifles growth not only for individual carriers but for the industry as a whole, which relies on a healthy and competitive ecosystem of drivers and operators. By refusing to disclose data, brokers harm the financial well-being of truckers and erode the potential for longterm partnerships across the supply chain. Addressing this lack of transparency is essential for building a stronger, more sustainable industry.

We see it. They see it. They see us see it. We see them see us see it.
The Elephant in the Room

TIME FOR BAD ACTORS TO TAKE A BOW

FINAL CURTAIN CALL

The curtain is lifting at last, and the fight for a fair and transparent trucking industry for small business truckers begins here.

For years, truck drivers have carried the weight of the economy, yet they’ve been left fighting for scraps hidden behind broker contracts and inaccessible rate sheets. The industry has thrived on obscuring pricing, leaving our nation’s drivers in the dark about the true cost of the freight they haul.

Truck drivers have carried the weight of the economy, yet they’ve been left fighting for scraps hidden behind broker contracts and inaccessible rate sheets. The industry has thrived on obscuring pricing, leaving our nation’s drivers in the dark about the true cost of the freight they haul. Transparency has always been promised but rarely delivered, leaving drivers in a constant battle to uncover the details of their own work.

At the heart of this issue lies 49 CFR 371.3, a regulation designed to require brokers to disclose key financial details about shipments. In theory, this rule would ensure transparency and prevent brokers from exploiting carriers. However, weak enforcement and widespread noncompliance have rendered it ineffective. For many truckers, understanding their true worth feels like an impossible dream—a reality brokers are all too happy to maintain.

Year after year, drivers face shrinking profits while brokers tighten their grip on the financial flow of the industry. Every hidden fee and every unexplained deduction pulls more value out of truckers’ pockets, often leaving them to question the fairness of the entire system. Truckers operate on

Hidden Losses

Transparency is more than a demand—it’s a necessity for survival.

razor-thin margins, and the lack of transparency not only undermines their ability to plan for the future but often forces them into desperate situations just to stay afloat.

Meanwhile, brokers thrive on the system’s opacity. By controlling the flow of information, they maintain a disproportionate amount of power, dictating terms and withholding critical details from both carriers and shippers. This secrecy creates a culture of exploitation, where the work of truckers is undervalued and their role in the industry dismissed. Without access to transaction records or clear accountability, truckers are left playing a game where the rules are stacked against them.

But change is on the horizon. Drivers across the country are beginning to unite and demand enforcement of CFR 371.3. What was once a quiet frustration is growing into a loud and organized movement, calling for fairness and transparency. The push for accountability isn’t just about uncovering the truth—it’s about restoring dignity to an essential workforce that keeps the economy moving.

From hidden clauses buried in contracts to inflated fees and vague payment structures, we shine a light on the ways brokers manipulate the system to their advantage. By understanding these practices, small business truckers can better protect themselves.

Truckers are owed what they’ve been promised— hidden fees and vague contracts must end now.

The fight for transparency goes beyond fairness—it’s about survival. For independent truckers and small business carriers, equitable access to information is not a luxury; it’s a necessity. Without it, drivers risk being priced out of the industry they helped build, losing their livelihoods to those who exploit their hard work. The lack of transparency doesn’t just hurt truckers; it weakens the entire logistics chain, creating inefficiencies and undermining trust.

Transparency is not optional. It’s a long-overdue promise that must be fulfilled for the health and sustainability of the trucking industry.

TLDR: Still Waiting for Transparency

The FMCSA’s 49 CFR 371.3 was meant to bring transparency to brokered transactions. It requires brokers to disclose transaction details, yet many truckers claim they’re met with evasion or worse when they request them. To many, transparency feels illusionary.

Truckers have long argued that bad brokers hide load payment data, and despite the regulation, enforcement is lax and compliance can be sketchy. Brokers often cite

confidentiality agreements, creating extra legal barriers in addition to their general shenanigans.

The debate rages, with truckers pushing for enforcement and brokers defending their stack. Will the FMCSA step up to bridge the gap?

For now, truckers further ensnare themselves in a prison of technology where the promise of fairness feels perpetually out of reach.

FACELESS FORCES

Understanding where your data comes from—and where it’s going—is no longer an option for truckers. This means staying vigilant about who’s using your info and how it’s defining your pay, safety, and future.

Understanding where your data comes from—and where it’s going—is no longer an option for truckers. This means staying vigilant about who’s using your info and how it’s defining your pay, safety, and future.

Every mile logged by an ELD creates a trail of digital information. Initially intended for compliance and safety, this data often finds its way into uncharted territories, transforming into a goldmine for marketers, insurers, and shadowy entities. These faceless forces operate quietly, harvesting data to profit at the expense of those who generate it. Without clear oversight, your routes, hours, and habits may end up shaping decisions far beyond your control.

Truckers face unique risks from this data misuse. While some entities leverage the information for targeted marketing or freight analysis, others may unintentionally pave the way for costly consequences, like freight guards

Truckers’ data doesn’t just drive compliance—it powers billion-dollar industries. Who’s really behind the wheel?

restricting access to loads or unfair algorithmic predictions impacting rates. Worse still, a security breach could expose route details or cargo information, leaving drivers vulnerable to theft or worse.

Who owns your ELD data? The answer is murky. Companies assure security but often prioritize their own interests. Data intended to improve systems or boost profits leaves truckers in the dark, navigating an industry shaped by forces they can neither see nor influence. Misused data could hike insurance rates, complicate regulatory requirements, or tighten profit margins. Truckers, unwittingly, become contributors to a dangerous cycle of exploitation.

Even advanced AI technologies exacerbate these challenges. Predictive algorithms crunch your data to estimate accident risks or fuel efficiency, but mishandled information can generate inaccurate conclusions, affecting everything from premiums to your reputation in the industry. The unseen hands steering these decisions rarely prioritize the trucker’s well-being.

Taking control begins with transparency. Ask tough questions about where your data is stored, who has access, and how it’s shared. Demand robust safeguards to protect against misuse. By doing so, truckers can reclaim their digital narratives and prevent faceless forces from hijacking their futures.

IT ALL STARTS WITH a little device BUT WHERE DOES IT END?

Truckers must unite to demand clear answers from companies about how their data is used and protected. Transparency is key to ensuring that ELD data benefits drivers rather than being exploited for profit. Simple steps like reviewing privacy policies, advocating for stricter regulations, and choosing providers committed to ethical practices can make a big difference. Your digital footprint is valuable—guard it as you would your cargo.

BUILDING NOOA: THREE YEARS IN

Advice: Keep going, even if the road gets dark,” Mike says. “Bad days don’t last forever, and just like sun through clouds, better times are always coming. You have to believe that. In trucking and in life, keep going.”

When Mike Boston first stepped into trucking advocacy, he wasn’t looking for fame—he was looking for basic respect. A trucker from urban New York, Mike knew the grind better than most. The long hours, the constant battles on the road and the lack of basic representation in the industry’s leadership drove him to create something better. NOOA wasn’t just an idea; it was a necessity. “I built NOOA

for people like me who were tired of being ignored,” Mike says. Two years in, that vision has started to change the game.

Building the organization wasn’t really about reinventing the wheel all over; it was about building a stronger one. Mike surrounded himself with the right people— drivers, industry insiders and visionaries who weren’t afraid to shake things up a

Conversations with Michael Boston, President

“You don’t go far in trucking without the right connections,” he says. “It’s not about kissing rings; it’s about finding like-minded people who share your values and your fight.” Together, they carved a path that challenged outdated systems, proving that collaboration could rewrite the rules.

Two years might seem like a short time, but for NOOA, it’s been packed with wins of all sizes and more than a few lessons. From advocating for transparency in freight to standing firm against brokers who undervalue drivers, NOOA has earned its place as a voice of reason and change. Mike isn’t shy about pointing out the flaws in the system, but he also brings solutions to the table. “We’re not here to complain,” he says. “We’re here to demand better for truck drivers and show it’s possible.”

The organization’s journey hasn’t been without its challenges, but Mike views every obstacle as an opportunity to push harder and aim higher. Whether it’s fighting for fair freight rates or educating drivers about their rights, NOOA is proving that change starts with determination and action. The team’s unwavering commitment has turned heads across the industry, with many truckers seeing NOOA as a much-needed ally.

What’s next for Mike and NOOA? “More work,” he says with a grin. For him, success isn’t a finish line—it’s the road itself. As the organization continues to grow, Mike is laserfocused on expanding NOOA’s reach and impact. Whether it’s through more advocacy or new partnerships, he’s determined to make sure NOOA becomes a cornerstone of advocacy and change in trucking. Mike sees each victory, no matter the size, as a step toward a better future for drivers across the country.

Mike hopes that NOOA’s journey inspires other small business truck drivers to step up and take charge of their futures.

What Has Been the Biggest Challenge Building NOOA?

Mike reported the toughest part of building NOOA wasn’t the long hours or the uphill battles—it was finding the right people and steering clear of the wrong ones. “You can’t build something solid with shaky hands,” he says. In an industry filled with hidden agendas, Mike quickly learned to trust his gut and lean on those who shared his vision. Avoiding empty promises and aligning with people who brought real value became his focus. That clarity has been key to NOOA’s growth and resilience in a cut-throat industry.

What Has Been the Best Moment You’ve Experienced?

For Mike Boston, the best moments have been twofold. First was seeing members flood into NOOA after he took a bold stand for drivers’ rights. “It wasn’t just about the numbers—it was the solidarity,” he says. People brought their voices and trust, proving the power of a shared mission. The second came with the launch of NOOA’s magazine, turning years of frustration into a platform for change. “Seeing our stories in print, reaching drivers everywhere— that’s when it felt like we were making real waves,” he reflects.

REMEMBERING

JIMMY CARTER

Jimmy Carter’s legacy of championing fairness and opportunity resonates deeply with NOOA. His visionary leadership in advancing trucking reforms paved the way for countless independent operators and small businesses, embodying the spirit of resilience and innovation. His dedication to equality and transparency remains an enduring inspiration to us all. Thank you, President Carter.

REMEMBERING

CARTER

Jimmy Carter, the 39th President of the United States (1977–1981), was a dedicated public servant and humanitarian. Born in Plains, Georgia, he rose from humble beginnings as a peanut farmer to serve as a naval officer and later a politician committed to human rights and peace. Carter’s presidency is remembered for his dedication and focus on energy conservation, the Camp David Accords, and groundbreaking deregulation efforts, including reforms in aviation and the trucking and transportation industry. After leaving office, he devoted his life to global humanitarian work, founding the Carter Center and earning the Nobel Peace Prize in 2002. A man of humility and principle, his enduring legacy continues to inspire generations.

Driving Change in the Trucking Industry

Jimmy Carter’s presidency had a profound impact on truckers, primarily through the Motor Carrier Act of 1980. This legislation, part of his broader deregulation efforts, aimed to introduce greater competition in the trucking industry. By reducing barriers to entry and easing restrictions, the act allowed independent truckers and small businesses to compete more effectively with larger companies,

fostering innovation and cost savings in the transportation sector. The deregulation also helped to lower consumer costs for goods transported via trucking by streamlining routes and improving operational efficiency. However, it brought challenges, as some established operators struggled to adapt to the more competitive landscape, highlighting the broader economic shifts Carter sought to navigate during his presidency.

“Trucking is something I always wanted to do growing up,” Randy recalls, his voice filled with nostalgia, remembering his wide-eyed wonder for trucks. “It’s just one of those things that fascinated me growing up.” His journey began decades ago, hauling for P&D Products and eventually venturing into independent contracts that would span across states and seasons.

Even now, with almost half a century of trucking experience, Randy’s passion for the job remains unshaken. “If I could do it all over again, I’d choose trucking every time.”

“It’s been a good living.”

Beyond respect, Zach feels an overwhelming sense of pride when he talks about his father. Seeing his dad’s commitment to the family and his profession instilled in Zach a profound appreciation for the values of resilience and perseverance. “It’s not just about driving the miles. It’s about keeping promises, showing up, and making sure your word means something.”

Zach often finds himself inspired by stories his dad shares from the road—navigating treacherous weather, meeting delivery deadlines, and maintaining a reputation for reliability. “Every time I hear him talk about what he’s faced out there, I realize how much grit it takes.”

Zach’s earliest memories are intertwined with the image of his father heading out for hauls. “I was just a little kid when he started. I remember tagging along with him whenever I could,” Zach shares.

One memory stands out vividly as the best day ever for Zach—the day his dad brought the truck to school. “All the kids thought it was the coolest thing ever,” he said thoughtfully. “We all had our picture taken. It was a big deal to us kids.”

When asked about the future of trucking, Randy remains optimistic. “It’s a good industry if you can handle the challenges. You just have to stay alert and be ready for anything,” he explains. Despite growing complexities like stricter regulations and new technologies, he believes opportunities remain for those who persevere. “Trucking has its ups and downs, but there’s always a need for people who can get the job done.”

Zach echoes this sentiment. “My dad’s dedication taught me that no matter what you do, you give it your all. I’ve learned that trucking is more than just driving—it’s about responsibility and perseverance,” he reflects.

Together, Randy and Zach remind us that trucking is not just a profession but a cornerstone of family, community and tradition. Their shared journey in trucking bridges generations, touching on some of the familiar sacrifices and joys that come with life on the road. It’s a legacy of resilience, love, and a shared commitment to keep moving forward together.

Protecting Roads Today Driving Safer Tomorrow

Autonomous trucking holds incredible potential, but safety must lead the way. Current systems lack the capability to perform essential tasks beyond driving, putting both truckers and road users at risk. NOOA is committed to advocating for solutions that prioritize safety over speed, ensuring that innovation doesn’t come at the cost of lives or livelihoods.

Human drivers are irreplaceable in managing critical operations such as pre-trip inspections, cargo security, and responding to emergencies. These responsibilities require expertise and judgment that technology cannot yet replicate. NOOA believes that keeping skilled drivers involved ensures not just safety but the smooth functioning of trucking operations as a whole.

As we embrace innovation, NOOA believes in preparing the workforce for change. Through training and upskilling programs, drivers can take on evolving roles in monitoring and maintaining autonomous systems, keeping them at the center of the industry’s future. These efforts are critical to ensuring a fair and equitable transition as technology advances.

Safety, accountability, and sustainability must be the cornerstones of automation’s growth. NOOA calls on policymakers, industry leaders, and truckers to work together to secure a balanced and responsible approach for the road ahead. Collaboration is the key to protecting the integrity of the industry while embracing its next chapter.

Supporting Truckers’ Safety Shaping the Industry

NOOA is dedicated to ensuring that advancements in trucking technology serve to enhance—not endanger—road safety. By advocating for practical solutions and collaborating with industry leaders, we’re driving the future of trucking responsibly.

Comprehensive Safety Standards. Autonomous systems must meet rigorous, transparent safety standards addressing not only driving but also trucking’s operational essentials. These include deploying warning devices, cargo inspections, and pre- or posttrip evaluations, all critical to safety. Standards should reflect real-world challenges and ensure the secure integration of autonomous technology into a complex industry.

Hybrid Human-Autonomous Systems. Until full autonomy is achieved, hybrid systems must be utilized. Human operators should manage tasks like emergency device deployment and inspections. This approach ensures safety while capitalizing on automation’s strengths, creating a balanced and efficient trucking system.

Workforce Transition Programs. As automation grows, drivers must be prepared for new roles. Training programs should help transition them to positions like fleet monitoring and system maintenance. This ensures experienced drivers remain integral to the industry while adapting to its evolving needs.

Accountability Framework. An accountability framework is critical to autonomous trucking’s success. Developers, manufacturers, and carriers must uphold strict safety standards. Clear guidelines ensure accountability and reinforce public trust, preserving safety and integrity across the trucking industry.
