How a Few Bad Actors Are Impacting All Texas Dealers HB 718: on the cover
The deadline for implementation of HB 718 which requires the transition to metal plates of July 1, 2025, will have passed by the time most of you read this article, but I had to turn this in for publishing prior to that date. I cannot say what July 1, 2025, brought for us, but I can say TIADA has been working on HB 718 and issues that caused it since long before I came to TIADA over four years ago. Temporary tag fraud was the catalyst for the sweeping changes in dealer operations and Texas law. While the problem was serious — one individual was found to have issued more than 700,000 temporary tags improperly — the legislative response with HB 718 has created challenges for every licensed dealer in the state, most of whom have been operating responsibly all along.
At TIADA, we’ve been clear: the vast majority of Texas dealers follow the rules and deserve a system that works for them — not one that treats all dealers like potential fraudsters. Unfortunately, HB 718’s broad approach means that honest dealers are now facing increased costs, administrative hurdles, and operational complications due to the actions of a few bad actors.
Progress Was Already Underway Before HB 718
It’s important to recognize that TIADA and other stakeholders worked with the Texas Department of Motor Vehicles (TxDMV) and had already implemented reforms to combat temporary tag fraud prior to HB 718.
The biggest change was tighter licensing requirements with more extensive checks on everything to eliminate fraudsters from obtaining licenses in the first place. TIADA supported additional checks for new licensees during this process but thought those who had been licensed for a long period of time should not face this additional scrutiny. Unfortunately, we were unable to secure an exemption based on time licensed. Dealers have paid the price for this change by having longer processing times and having to spend time providing numerous documents to TxDMV. I will note we supported efforts by TxDMV to increase the money available to hire TxDMV licensing staff during this legislative session. This should help decrease wait times for renewals, yet we still plan to look for additional ways to help address this issue for dealers.
A few other notable changes were the introduction of a temporary tag allotment system to monitor and control the volume of tags issued. Along with the ability of temporary tags and mandatory fingerprinting for both new applicants and renewing dealers. These reforms were effective in reducing fraudulent tag issuance and the results clearly showed it. As an association, we understood dealers were already incurring costs related to increased oversight, however these more targeted approaches were less burdensome than the alternatives that we felt might occur if the issues were not addressed. HB 718 was passed into law despite these changes that drastically reduced fraud occurring and us having clear evidence based on the year over year change in the number of tags issued dropping in half.
Why Law Enforcement and Legislators Pushed for HB 718
Law enforcement agencies advocated for faster changes, citing challenges in tracking paper temporary tags with license plate reader technology. Instead of allowing existing
reforms to continue proving their effectiveness, the legislature opted to mandate a switch to metal temporary tags for all dealers. Ironically, the reforms already implemented

by TxDMV before HB 718 — such as enhanced licensing requirements and tag allotment controls — had been so effective that a law enforcement official, during testimony before the Texas House Transportation Committee, attributed the reduction in fraudulent tags to HB 718, even though it had not yet taken effect. This confusion underscores just how impactful the earlier reforms were in addressing the core issue.
The HB 718 solution was designed to make enforcement easier, but it overlooked the reality that the majority of dealers were already compliant and changing laws alone does not fix issues that were greatly exaggerated by law enforcement who testified before the legislature that paper tags were the cause of deaths and human trafficking. Meanwhile many stakeholders believed law enforcement needed to address the issue themselves as too often we saw people driving with expired or fake tags while driving during our daily lives.
TIADA’s Role in Shaping and Mitigating HB 718
TIADA opposed the bill as originally drafted. Once it became clear HB 718 would pass, our focus shifted to reducing its negative impact on our

Stakeholders, including TIADA, successfully postponed the effective date to July 1, 2025, from the original date of September 1, 2023, providing dealers and TxDMV more time to prepare for a substantial system change. I cannot imagine how poorly implementation would have gone on September 1, 2023. This new effective date allowed stakeholders to successfully advocate for the passage of SB 1902, which addressed major operational issues created by having to store the plates from cars that were sold to the dealer if they were previously registered in Texas. Now, dealers will simply remove the plates off a car and transfer them to any vehicle the customer purchases from them.
Another significant change secured by stakeholders resulted in a new tag type for out-of-state customers. Initially, the legislature planned on dealers using the same tags for both in state and out of state customers and requiring the dealer to retrieve all out of state tags from their customers. Thankfully, after hearing our concerns about the ability of dealers to obtain anything from a customer after they get their car,

TIADA and others achieved success by securing a new, lower-cost limiteduse metal plate ($10) with restricted use, addressing concerns about insurance premiums and misuse that would have arisen from the original bill requiring dealer plates instead of agent and vehicle-specific tags.
Dealer Feedback Shaped Implementation
Once the bill passed, TIADA put all its resources into helping to implement the bill as we knew our members depend on the ability to deliver cars to their customers at the time. TIADA hosted nearly 20 town halls with TxDMV staff to discuss the upcoming changes, relay dealer concerns, and clarify requirements. This dialogue helped improve numerous aspects of implementation and influenced the rulemaking process — most notably preventing onerous requirements like entering tag information for every test drive. During the initial town halls, there were many questions that required follow-up, as the complexities of the new law were still being fully understood by all parties. Over time, TxDMV staff provided more clarity as they incorporated feedback and insights from previous meetings with dealers. Through this ongoing collaboration, our relationship with TxDMV staff and local tax assessor offices strengthened, as we collectively worked to implement a significant legislative mandate that presented challenges none of us had originally sought.”
Even with extensive preparation, we believe complications will arise now
that HB 718 has taken effect. Additionally, we already have items that we want to work on for dealers. For example, dealers must now obtain tags from county tax offices if a vehicle is going to be exported rather than handling these internally. This creates a new and inconvenient step.
TIADA will continue to work with regulators and other stakeholders to address issues, and we will continue to seek feedback from dealers to ensure future changes are practical and dealer friendly.

Texas 89th Legislative Session Ends with Major Wins for Independent Dealers
The 2025 Texas legislative session has officially concluded, and the Texas Independent Automobile Dealers Association (TIADA) was on the ground every step of the way, advocating on behalf of you and your dealership. Thanks to the dedicated efforts of TIADA and the support of numerous industry stakeholders, Texas dealers are now in a stronger position following the passage of two key bills.
SB 1902 serves as a much-needed correction to the unintended consequences of HB 718 (2023), which required licensed dealers to issue metal license plates at the time of sale to combat fraudulent paper tags. While that law aimed to address a real problem, it created significant logistical and security challenges for dealerships — requiring plates to be removed from trade-ins, stored on-site, and tied to the vehicle instead of the customer.
SB 1902 addresses those concerns by allowing the license plate to remain with the customer, not the vehicle. This change simplifies dealership processes, reduces security risks, and eases the operational burden. It’s a clear example of how effective legislative advocacy, driven by dealer voices, leads to meaningful change.
HB 4134 is another key victory, giving dealers and related finance companies more flexibility in how they accept electronic payments. The bill authorizes holders of retail installment contracts to charge a convenience fee when buyers choose to make payments electronically — such as by credit card, debit card, or electronic funds transfer — without having to route those payments through a third-party processor.
The convenience fee must be reasonably related to the actual cost of processing the electronic payment

and is capped at the lesser of $10 or 5% of the payment amount. Dealers must offer at least one fee-free payment option, such as cash. Buyers must also be informed of the fee amount before completing an electronic transaction.

Plate Expectations: What Texas Dealers & Buyers Need to Know

ffective July 1, 2025, a new law in Texas significantly changed how license plates are issued when vehicles are sold by a dealer. Thanks to House Bill 718, passed by the 88th Legislature, motor vehicle dealers will now issue metal license plates directly to buyers at the time of vehicle delivery — replacing the familiar paper temporary tags.
What This Means for Consumers:
Buying from a Dealer? If you’re purchasing a new or used vehicle from a Texas dealership, you’ll now leave the lot with your permanent metal license plates already installed. No more waiting for a plate in the mail or displaying paper tags.
Buyers should keep the receipt for the issued plates in their vehicle until the official registration sticker arrives by mail.
Law enforcement will use this receipt to verify the vehicle’s pending registration.
Trading In a Vehicle
Under Senate Bill 1902 (89th Legislature), dealers can now transfer general-issue plates from a traded-in vehicle to another unit in inventory, within 10 days, as long as the plates match the type of vehicle (passenger, truck, etc.).
Specialty plates remain the property of the original owner and should be retained for future use or transfer.
Private Party Sales Stay the Same
No changes are coming to private sales between individuals. Here’s a quick refresher:
Sellers must remove their license plates and registration sticker before handing over the vehicle.
Why the Change?
Issuing Metal License Plates at the Point of Sale
Plates can be reassigned to another vehicle owned by the seller, provided they match vehicle type — but must be processed at the local tax assessor-collector’s office.
Sellers should also submit a Vehicle Transfer Notification to TxDMV within 30 days. Buyers must apply for title and registration within 30 days and obtain new plates for the vehicle.
This move aims to improve:
Customer convenience
Vehicle traceability
Law enforcement safety
It’s also a direct response to fraud and abuse involving counterfeit temporary tags — a concern that’s grown across Texas in recent years.

Just as the Texas summer is heating up, the auto market is cooling down from a frenzied surge of buying that marked the start of new trade policies and a heightened period of change for the economy and the auto market. From here, the future is hard to predict with policy uncertainty still very high, but the shortand longer-term implications not all bad for Texas independent auto dealers.
President Trump initiated sweeping changes to trade, immigration, and fiscal policies from Day One of his second term, and the auto industry has been one of the most impacted industries. Our team estimates that new tariff policy could add approximately $5,700 in costs to the average imported vehicle — a big number for the U.S., which imported nearly half of the new vehicles sold in 2024.
Dependence on imports varies substantially by segment. The most import-dependent segments are at the two ends of price spectrum: the most affordable vehicles and luxury vehicles. Most of the vehicles priced under $30,000 are now facing tariff costs that might make them unviable in the market.
At this point, we’re just beginning to see how manufacturers deal with these added costs, and we certainly do not believe that the American consumer can absorb it all. Consumers today are more price and payment sensitive than they were in 2020 and 2021, so unlike the rampant inflation we saw through the last supply chain crisis, we expect that the average new vehicle price will only rise 4-8% this time around. Still, with average prices up near $50,000, the industry has an affordability problem and tariffs do not help.
As cost and price dynamics alter the market landscape, we expect the new vehicle market to contract to a 15-15.5 million market annually, down from what had been a 16.5-17 million market. Our forecasts assume that after further trade negotiations, the average tariff rate should fall closer to 10% rather than 25%, as was the case for the U.K. But we think some amount of tariffs are here to stay, as the President wants a source of revenue to offset income tax cuts while also leveling the playing field for important sectors like automotive and encouraging more manufacturing in the U.S.
What does this mean for an independent dealer in Texas? With fewer, more expensive new cars, the used car market will have even stronger demand.
However, tight supply in the used car market is a difficult reality thanks to pandemic-era declines in new vehicle production and sales. Now we expect the wholesale market to get tighter over the next two years, so the challenging supply environment
that dealers have faced over the last few years is here to stay in the near term. Sourcing inventory will remain a hard but vital part of a dealer’s operations.
The surge in demand in March and April reduced supply in retail and wholesale and caused an increase in prices in both new and used vehicles. However, as prices increased, demand cooled, supply improved modestly, and used
vehicles returned to being depreciating assets.
From what we have already seen play out, this is not 2021 all over again. Back then, consumers had the upper hand in a hot labor market, the housing market was booming and $4 trillion in stimulus was flowing through consumer pocketbooks; interest rates for auto loans were at all-time lows.
Pent-up demand remains significant, but the current demand is particularly price and payment sensitive. Interest rates have not come down much from a 25-year high in February, and they are not likely to change much for the rest of this year. The Fed will be slow to act as they await evidence of what will happen to inflation and the labor market before they make any change in rate policy.
With the right inventory at the right price and the right credit offerings, independent dealers can be successful in this environment. The risk on the demand side is if economic conditions deteriorate into a recession. While the risk is elevated, the odds favor the economy avoiding a recession.
Texas is a step or two better than the U.S. in almost every key economic metric. As a result, the Lone Star State faces even lower recession risk and would likely experience a milder decline than the U.S. if a recession were to unfold.
That said, even within Texas, market trends will vary based on exposure to industries impacted by tariffs and trade but also by changes to immigration and fiscal tax and spending policies. Now more than ever, auto dealers need to know their market, understand their target customer, offer appropriate credit solutions, and source and price inventory appropriately.

Bankruptcy Filed After Repossession: Supreme Court Case Offers Guidance
Dealer Question: I repossessed a car last week because of default on payments and failure to maintain property-damage insurance. I just received a fax from an attorney advising that my debtor filed Chapter 13 bankruptcy today. She is demanding that I return the vehicle immediately. Since I repossessed before the bankruptcy was filed, can I refuse?
Answer: In prior responses to this question (before 2021), the answer has been that you probably can’t refuse to return the vehicle to the debtor within a reasonable time without fear of being charged with violating the bankruptcy stay. However, because of a 2021 U.S. Supreme Court case, the answer is now that you do not have to make immediate return of the vehicle, although you can’t attempt to collect any balance or resell the collateral without permission of the bankruptcy court. And it is likely that the bankruptcy court would require returning the vehicle if a motion for turnover is filed by the debtor.
Repossession (or anticipation of repossession) is often the event that triggers bankruptcy filing. It is thus not unusual for the car creditor to get a call from a debtor’s attorney just after repossession, advising that bankruptcy has been filed and demanding that the vehicle be returned to the debtor. We often receive calls from dealers seeking guidance in this situation.
Most car creditors and lien holders know by now that the filing of bankruptcy is effective to stop the creditor from attempting to collect a debt, including repossession of collateral. We have addressed, in prior articles, the liability a creditor faces for repossessing collateral after a bankruptcy has been filed, and after the creditor has been notified of the bankruptcy. (We have also discussed the fact that any notice is sufficient to advise the creditor of the filing of the bankruptcy, regardless of the form of the notice, and that the creditor can’t refuse
to recognize the bankruptcy just because he or she has not received official notice from the bankruptcy court.)
A more difficult question arises when a buy-here-pay-here dealer (or other car creditor) has lawfully repossessed a vehicle, then is informed that the debtor filed bankruptcy after the repossession. As shown by the large number of calls

In many cases the debtor may have already visited a bankruptcy attorney to discuss available options.
What makes the situation even more frustrating is that often the debtor had been hiding the vehicle prior to repossession. The creditor may fear that after giving it back to the debtor, it may never be seen again.

bankruptcy was In Re Frank R. Zaber in the Northern District of Texas. In that case, GMAC had repossessed Zaber’s vehicle on April 9 when he fell behind on payments. On April 15, Zaber filed a Chapter 13 bankruptcy. He promptly notified GMAC of the filing and presented proof of insurance and demanded return of the vehicle.
When GMAC refused to return the vehicle, Zaber filed a motion asking the court to force GMAC to return the vehicle to him (formally called “turnover of property of the estate”) and to find that GMAC intentionally violated the bankruptcy stay.
After an emergency hearing, the court found that GMAC had intentionally violated the bankruptcy stay by refusing to return the vehicle in a reasonable time after notice of the bankruptcy was given and proof of insurance was presented.
The court looked to the statutory language of the bankruptcy stay found in Section 362(a)(3) of the Bankruptcy Code, which prohibits a creditor from taking “any act to obtain possession of property of the estate… or to exercise control over property of the estate.” The court found that the first part (“obtain possession” ) referred to repossession, but that the second part (“or to exercise control over property of the estate” ) applied to the refusal of a creditor in possession of collateral to return it once a bankruptcy had been filed. That is, even though the creditor took possession prior to bankruptcy, the subsequent filing of bankruptcy imposed a duty on the creditor to return the property. The creditor’s failure to return it amounted to an exercise of control of the property of the (bankruptcy) estate in violation of the automatic stay.
In addition to compelling return of the vehicle, the court ordered GMAC to pay Zaber’s attorneys fees and to reimburse Zaber for the cost of a rental car between the time the vehicle should have been returned
and the date it was actually given back.
The majority position of courts around the country has been that the debtor retains property rights in the repossessed collateral until the time that the vehicle has been properly and legally disposed of by the creditor under the requirements of the Uniform Commercial Code. Under the U.C.C., a debtor has the right to redeem repossessed collateral up until the time it is legally disposed of. This right of redemption is the legal basis used by these courts to hold that the collateral remains “property of the estate” and thus subject to the bankruptcy stay.
In the past, because of the potential for damages to be assessed against a car creditor for failure to immediately return a vehicle under the holding of the Zaber case, we had advised our clients to return the vehicle after a post-repossession bankruptcy filing once coverage of property-damage insurance was established.
However, the Supreme Court has now overthrown the line of cases, such as Zaber, that held that the refusal of a lien holder to return property upon the filing of a bankruptcy was a violation of the bankruptcy stay. The rule announced in the Fulton case is that the mere retention of (bankruptcy) estate property after the filing of a bankruptcy petition does not violate the bankruptcy stay provision
With the Fulton case as authority, we now advise our clients that they are not obligated to make immediate return of the vehicle.
The facts of the Fulton case involved the impoundment of vehicles by the city of Chicago for failure to pay fines for motor vehicle infractions. Some of the vehicle owners filed Chapter 13 bankruptcy petitions after impoundment and demanded the return of their vehicles. When the city refused to return the vehicles, actions were filed in the bankruptcy court claiming a
violation of the bankruptcy stay (Sec. 362(a)(3) of the Bankruptcy Code). The bankruptcy court and the Federal Court of Appeals found the city to have violated the bankruptcy stay by refusing to return the vehicles. The Supreme Court in Fulton overturned the holdings of the lower courts and found that the mere retention of the vehicles did not violate the stay.
It’s important to note that the Court’s opinion did not say that a lien holder was not affected by the bankruptcy, but only that retention of the property did not violate the stay.
The impact of the Fulton case is somewhat tempered by the fact that the bankruptcy stay, even when the bankruptcy is filed after a repossession, still prohibits any attempt to collect indebtedness or to resell the property. Thus, the creditor can’t go forward with the usual non-bankruptcy disposition of the collateral, and must still obtain relief from the bankruptcy stay (such as a lifting of the stay) in the bankruptcy court.
Another factor that limits the benefit to creditors of the Fulton decision is that debtors can seek, through the filing of an adversary action in the bankruptcy court, an order requiring the creditor to turnover the collateral to the debtor.
The big difference between preFulton law and the current state of the law is that the creditor no longer faces the prospect of penalties and paying debtors’ attorney fees for the refusal to make immediate return of the vehicle. This fact can serve as leverage in negotiating the conditions under which the vehicle might be returned, or even possibly seeking to have the stay lifted or modified by the judge.
As is the case now and was before Fulton , a car creditor should send the required repossession notice (assuming bankruptcy has not yet been filed) as soon as possible after repossession to start the holding period. If, for instance, a creditor
sent appropriate notice, waited the appropriate time period, and disposed of the collateral – all prior to the filing of the bankruptcy – the courts have held that the vehicle is no longer property of the estate.
In one actual case we handled, the car creditor had sent strict foreclosure notice to the debtor, and the 20-day holding period had expired before the bankruptcy petition was filed. No written objection to the strict foreclosure was given to the dealer during the 20-day period. The debtor’s counsel filed a motion for turnover and for sanctions against the dealer when the
dealer declined to return the vehicle. After a hearing on the debtor’s motion, the court ruled that, under the strict foreclosure rules of the U.C.C., all redemption rights were cut off after the 20-day period expired, and the property reverted to the creditor. With no property rights with which to bring the collateral into the bankrupt’s estate, the court held that the dealer was not subject to the bankruptcy stay.

resold. That is, if the secured creditor sends a private sale notice with the usual 10-day period before the vehicle is to be resold, the debtor’s right to redeem doesn’t end with the expiration of the 10 days, but rather when the collateral is sold. Thus, even if the 10-day period has
passed, the unsold vehicle remains property of the estate. If the vehicle is sold on the 11th day, and the debtor files bankruptcy on the 12th day, the vehicle is not subject to the bankruptcy.
As in the pre-Fulton days, creditors should consider retaining
knowledgeable counsel to represent them before the bankruptcy court. The rules and procedure are often complicated and don’t lend themselves to self-representation. Also, neither the bankruptcy judge nor the Chapter 13 trustee is charged with advocating for the rights of individual creditors. And, unfortunately, the rights that creditors have must often be asserted through affirmative filings that require knowledge of the law and bankruptcy procedures.
