NOTICE OF PUBLIC MEETING REGARDING DEVELOPMENT CHARGES Take notice that on Tuesday, November 14, 2017, the Council of the City of Markham will hold a public meeting pursuant to The Development Charges Act, 1997, regarding proposed development charge rates and policies that will be applied throughout the City. It is proposed that enactment of a development charges by-law by Council would occur on a date subsequent to the public meeting. Development charges are levied against new development, and are a primary source of funding for development-related capital expenditures. Good riddance to employee discount tax idea

Hopefully, by now, employees in Canada’s retail sector - or what remains of it, at least - can breathe a little easier knowing the Canada Revenue Agency isn’t poised to take aim at the discounts they receive from their employers. Such incentives, which range from the meagre - a small percentage off the retail price of a given item, for example - to the generous - such as being able to buy merchandise at the employer’s cost - are commonplace in the customer service industry and serve as something of an enticement for would-be employees in a sector where a great many of the front-line staff members are paid minimum wage. Given that, it seemed the CRA was effectively talking about flipping retail workers upside down and shaking them by the ankles until their loose change fell out. The controversy began earlier this month when a 2016 update to CRA documents, stating that employees who receive a discount on the price of merchandise owing to their employment should have the value of said discount included in their income, was thrust in the spotlight via a Globe and Mail story. The policy went on to say the value of the benefit should be calculated as the difference between the retail price of the item less the amount the employee paid. No amount would be included in the event the same discount was offered to members of the public in some manner. Business groups, some of whom had decried the notion when it first came up but whose objections largely went unnoticed, argued it would be a nightmare to track their employees’ discounts, while other stakeholders voiced concern that employment incentives could be scrapped altogether by companies simply to avoid the aggravation. Despite a Liberal MP initially suggesting that any employee discount not offered to the public at some point would be fair game under the new rules, the federal government quickly distanced itself from the policy, expressing "disappointment" in CRA bureaucrats, and prompted Prime Minister Justin Trudeau to tweet assurances to retail workers that their discounts weren’t in the crosshairs. The government, in consultation with industry stakeholders, will now go back and review the policy and craft a new response to the 2011 court ruling that triggered the update in the first place. In any case, after the PR mess, it’s safe to say the idea of taxing retail employee discounts won’t soon be resurrected, and that’s a good thing. It was a wrong-headed idea that unfairly targeted workers in a sector primarily comprised of people at the lower end of the income spectrum.

• LETTERS & COMMENTARY • Time for changes at Vaughan City Hall Re: LETTER TO THE EDITOR: Why were Culture Days scheduled on holy days?, Oct. 7. Although I agree wholeheartedly with Mr. Weinberg, I must ask another question regarding the agenda of the City of Vaughan council: Where was Alan Shefman, Ward 5 Councillor? Mr. Shefman, who is of the Jewish faith, was not heard from. Sandra YeungRacco, Ward 4 Councillor, was another not heard from. Mayor Maurizio Bevilacqua claims to be a friend of all cultures within Vaughan. He truly dropped the ball this time! Mr. Weinberg: You are absolutely correct.

The City of Vaughan council has gone stagnant and the residents deserve a changing of the guard. One past councillor is finally gone; maybe it is time for the rest to move on. I would suggest that all of the residents, of all cultural and religious affiliations, examine the Vaughan political arena. It’s wake-up time. Howard Kramer

months as before? Most Ontaxians are well-organized with their monies; they pay water each three months, their taxes two to four times a year, and want to pay their heating gas bills every two months. We do so much banking that this is adding to the time consumption of customers - regardless of what form of banking we do, it is adding to the costs of operating a utility/business that will cost people more in the long run and, of course, gain a touch more PST/HST for the government. There is a great disrespect for Ontaxians by their government and this needs to be changed by election or other more forceful means. What they are and who will do it remains to be seen.

This recent monthly payment scam needs to be implemented to help only the few people who have not looked after their lives and futures and perhaps a few unfortunate others, all of whom did not anticipate the evil of the political party they voted into office last time. We need to give their heads a shake ... if there is anything to shake. Additionally, I hope no one is stupid enough to arrange direct withdrawals from their bank accounts with the worst offenders the utilities and public services (municipal service ’corporations’ or either federal or provincial government). This could be financial disaster when mistakes are made because of whom you are dealing with. Nick Bird

the United States. So the GTA bid, which includes sites in Milton, Burlington, Oakville, Mississauga, Brampton, Pickering, Ajax, Toronto as well as Vaughan and Markham, is in tough. Amazon has stated it needs a footprint of up to eight million square feet for its headquarters, limiting the available sites. That’s more than twice the size of the parking lot at Canada’s Wonderland. In Vaughan, the site falls in the Vaughan Metropolitan Centre on lands that were previously targeted for a potential casino. Vaughan has up to 475 developable acres of land while Amazon has stated it needs about 100 acres eventually. Mayor Maurizio Bevilacqua said Vaughan is ready to welcome Amazon. "The bid by Toronto Global clearly demonstrates that Vaughan is the place to be. We have a broad view of the world and endless opportunities to take our city to the next level. As a growing city we take pride in our ability to attract investment," the mayor said. "The Vaughan Metropolitan Centre is about creating a unique experience where people can live, work and play, all within the same city core." In Markham, the land pegged for Amazon’s headquarters would lie just east of current developments, north of the 407 and south of Enterprise Road. Markham’s site is 55 acres, or six to eight million square feet, which is more than adequate for Amazon’s needs, Mayor Frank Scarpitti said. "It is a human friendly environment, where we’re going to

have shops, the Pan Am Centre is located there, a five-star hotel is opening up later this year, and of

course the addition of the new campus of York University, make it an ideal situation along with

the 15-minute transit service that GO is providing to the site," he said.

York Region Chairman Wayne Emmerson touts York Region in the bid by highlighting its hightech workforce and its focus on technology, a natural fit for Amazon. "York Region has the highest concentration of technology companies in the country and is already a top Canadian headquarter location for global companies such as IBM, AMD, Huawei, Honda, Toshiba, J&J, BMW, Allstate and Adidas. As Ontario’s fastest-growing large municipality, we are committed to creating world-class communities that attract and retain top global talent," he said. WILLS AND POWERS OF ATTORNEY FREQUENTLY ASKED QUESTIONS

The Wills Lawyer Over the last year, I have been writing about the importance of Wills and Powers of Attorney. I have tried to provide some insight into this very complicated area of the law. It is a topic that most people would rather not think about but realize they must, in order to protect their family. Many people have called me with questions, and I would like to share some of these questions with you. 1. Q. If I have a Will, why do I need to make a Power of Attorney for Property? A. It is important to realize that your Will only takes effect after you pass away. It has no relevance during your lifetime. Only a Power of Attorney for finances will protect you, in the event you are unable to manage your financial affairs due to accident or illness. The executor you name in your Will cannot help you, if you are ill and unable to manage your financial affairs. The executor’s role only takes effect once you pass away. 2. Q. I have a Will naming my brother as executor. Michelle Kotzer Now that my son is in his twenties I want to appoint him as my executor. Can’t I just scratch off my brother’s name and write my son’s name in? A. I do not recommend scratching any part of your Will. It would be prudent to see a lawyer about drafting a Codicil to your Will. If it is a minor change such as the name of an executor, a Codicil would revoke the appointment of your brother and appoint your son as your executor. It would also preserve the other existing clauses in your Will. If you want to make major changes to your Will, it is recommended that you make a new Will rather than a Codicil. 3. Q. My spouse and I cannot agree on whom to appoint as guardian for our minor children. Can’t we just leave this out of our Wills and let our families work it out after we pass? A. Appointing a guardian in your Will is an extremely important decision. If you do not appoint a guardian, you could have your parents fighting against your spouse’s parents over who is best to raise your children. This is not a good formula for family harmony. 4. Q. I have a son who is collecting benefits from the Ontario Disability Support Program from the Ontario Government (ODSP). I want to leave him my estate. How does his collecting ODSP benefits impact my Will? A. If you leave your child your estate as an outright distribution, this will most likely mean that he will be cut off his ODSP benefits. Setting up a Henson Trust for your son in your Will will mean that you are protecting his ODSP benefits, after you pass away. 5.Q. How often should a Will be reviewed? A. A Will should be a living breathing document. It should be reviewed on an ongoing basis to make sure it reflects your current life situation. If you are married, be aware that any Will you made before your marriage is revoked, subject to some technical exceptions. If you have separated since you made your Will, remember that under Ontario law, you are still considered married and if your Will refers to your spouse as the beneficiary of your estate, that spouse is the person you are separated from. He or she will inherit your estate according to your Will. If your previous Will made reference to your two children, but since that time you have two additional children, the additional children will not inherit from your Will. The same applies for grandchildren. If your Will leaves your son your house on Yonge Street but you have moved to a house on John Street, your son will not get that house on John Street. In my wills practice, I offer the public a free Will review. This means that you can make an appointment with me for me to look at your Will to see if it is up to date or a recipe for a family fight. I have found many problems in Wills that I have reviewed. Firstly, many of the Wills I have reviewed left assets that no longer exist or assets were left to people who have passed away with no back up beneficiary. I have reviewed Wills that were invalid because they were either not signed, not witnessed or signed and witnessed on different dates. Many of the Wills I have reviewed had no back up executor or back up beneficiaries in case the primary beneficiaries are not alive. If you are not sure if your Will is up to date, please feel free to give my office a call and set up an appointment for a free Will review. 6. Q. If I want to make a Will with you, what is involved? A. If you want to make a Will with me, generally there will be two appointments necessary. The first appointment will be for me to sit down with you, discuss your life situation, discuss your assets and draw up a Will plan for you. After the initial meeting, we will set up a time for the signing of your Will. At the signing appointment, I will go through the Will clause by clause with you. I will make sure that the Will reflects your wishes and that you understand each clause of the Will. If you have also made Powers of Attorney for Personal Care and Property, I will do the same clause by clause. If you are satisfied that the Will reflects your wishes, you will then sign the Will and/or Powers of Attorney in front of myself and my assistant. You will take the original Will home with you and I will keep a copy in a file in our office. If you do not have a Will and are not sure where to start, I offer a free Will consultation. York schools fail lead test TERESA LATCHFORD tlatchford@yrmg.com High lead levels were found in the drinking water of 24 York Region schools in 2016. A list released by the Ontario Ministry of the Environment and Climate Change shows the drinking water of more than 640 schools and daycares across the province, including 24 from York Region, tested above what Ontario deems safe lead levels of 10 parts per billion last year. The York Catholic District School Board’s St. Joseph Catholic Elementary School in Richmond Hill tested 12 times above mandated levels. Children are safe drinking the water at YRDSB schools, Zsigmond added. If there is any question about water quality, the taps are

bagged and sealed to prevent use, bottled water is provided and parents will be notified. According to Health Canada, the toxicity of lead has been extensively documented in humans, based on blood lead levels. The strongest effect of exposure documented is in children and reductions in intelligence quotient (IQ) scores. Studies have also linked lead exposure to reduced cognition, increased blood pressure, renal dysfunction in adults and adverse neurodevelopmental and behavioural effects in children. While 10 PPB or under is considered acceptable lead levels in drinking water across the province, organizations like the World Health Organization warns that any lead exposure is too much. It also points out

that children under six years absorb more lead if exposed and any loss of intelligence is irreversible since the human brain is incapable of repairing itself. The York Region District School Board has an independent vendor responsible for testing the water at all schools annually. If a school’s water exceeds the allowed 10 PPB, it is reported to York Region Public Health, according to Zsigmond. If there is a concern, a letter is sent home to parents with information regarding the situation, water alternatives that will be available to students and contact information should they have any questions. Additional water testing is conducted until lead levels are deemed acceptable and access to the water is reinstated.

Concord’s Silverman tees off on PGA Tour rookie season JOHN CUDMORE jcudmore@yrmg.com Ben Silverman has reached the big leagues. The trick now is to prove he belongs with the best golfers in the world. The Concord native made his debut as a member of the PGA Tour at the Safeway Open held Oct. 5 to 8 at the Silverado Resort in Napa, California where he finished in a tie for 43rd place. It marked the arrival of Silverman to a destination that may have taken a bit longer to achieve but one he never doubted would ultimately be achieved. Silverman, however, never swayed in his confidence to reach the top level in his sport. "It was never a decision whether I would play golf," said Silverman, in a telephone interview from Mayacoo Lakes Country Club, near his home in West Palm Beach, Florida. "I never had a doubt that I was going to do

Silverman, who turned pro in 2010, will hold conditional status for the 2018 season. That means he will compete in a certain number of events without having to qualify on the Monday of tournament week. He anticipates playing in between 15 and 30 tournaments in the 2018 season. The Vaughan Secondary School graduate was a walkon at two Florida schools, including Florida Atlantic University in Boca Raton where he graduated with a bachelor’s degree in psychology. He spent much of his teenage years playing at the Mandarin Golf and Country Club in Markham, now known as Upper Unionville. He currently is an honorary member at Maple Downs Golf and Country Club in Vaughan.

Paranormal investigator Lynda Quirino from the Georgina Paranormal Society says there are ghosts and spirits haunting various parts of York Region, some she and her team have witnessed. We gathered a list of five sites in York Region that are allegedly haunted and here they are: Sharon Temple (East Gwillimbury) The Sharon Temple was built in 1832 and is a designated National Historic Site of Canada. Though it’s not technically haunted, people have reported hearing sounds of a large feast being prepared, music and footsteps. Quirino calls a "residual" haunting, imprinted in the character of the building. "It was a large gathering place, a lot of things happened there," she said. "It’s an energetic imprint." Eaton Hall (King) The house once belonged to Lady Eaton, wife of department

store magnate John Craig Eaton, and it is believed that she still roams the grounds with other ghosts. It was built in 1938 and Quirino has had her own strange encounters there. "It had a really charged atmosphere," she said. "I knocked on the door of a little room, and someone said ’Hey!’ but no one was in the house with me." Heintzman House (Thornhill) Built around 1817, it’s one of the oldest homes in the Greater Toronto Area. Author John Robert Colombo writes in Mysteries of Ontario that it’s haunted by Colonel Cruikshank, the first owner of the property. "This tall, slightly bent man wearing a leather jerkin appeared in the upper hall overlooking the foyer. His expression was one of anger, as though he resented being disturbed by this noisy group of strangers occupying his home," Colombo writes. Stephen Leacock Theatre (Georgina) Quirino says Stephen Leacock may haunt his theatre. She said people have reported feeling things and in specific cases, an unknown spirit would steal the towels in the female dressing rooms.
