The best way to win the seller over is to be a buyer with convenient and reasonable terms, based on the current market. This means that, if you are obtaining a mortgage, you will already have a letter from a reputable lender stating you are able to purchase at the listing price or possibly even above. agent will also help you write a strong offer which allows enough time for the closing, to include inspections, the loan and title process and the sellers moving, without stress. In our current market, the pending period is around 35-40 days.

The Wolek Group, as a team, has systems and checklists in place to ensure no contract terms or timelines are missed. agent will communicate with the seller’s agent to

out what terms are best and will help you win the property. We have years of experience in developing strong working relationships with our cooperating agents, therefore helping our clients’ offers to get accepted.

OTHER TERMS WE MAY DISCUSS, DEPENDING ON THE CURRENT MARKET

Once you have found the property you love, we will complete a purchase agreement. While much of the agreement is standard, there are a few areas that you can negotiate:

THE PRICE

What you offer on a property depends on a number of factors, including its condition, length of time on the market, buyer activity, and the urgency of the seller. While some buyers want to make a very low offer just to see if the seller will accept, this often isn't a smart choice. The seller may be insulted by the low offer and decide not to negotiate at all. Also, a buyer may ask the seller to pay some of their closing costs. If you need a seller to help with your costs, keep in mind that is an amount that they are paying on your behalf and it comes off their

EARNEST MONEY

This is your “good faith” deposit. It shows the seller that you are serious about purchasing their home. At the time of contract, it is deposited into the listing Realtor’s

TREATMENTS, REPAIRS, REPLACEMENTS

Per the contract, you have the opportunity to perform inspections. Typically this is within 10 days of the Time Reference Date in the contract. After inspections are completed, if there are items that are not in “normal working order”, you may request that the seller make these repairs prior to closing. The seller may agree to these repairs or not agree. They may also counter-offer the repair list. If the buyer and seller do not agree on the repairs requested, the contract may be canceled and you will get your earnest money back and the contract is void.

HOME SERVICE AGREEMENT

A buyer can also ask a seller to pay for a Home Service Agreement. This will cover the mechanicals of the home for one year after closing. This warranty may cost $550 and up. There are several home warranty companies and we can provide you with brochures for your review.

INCLUSIONS/EXCLUSIONS

The contract states that all things attached to the property are assumed to stay. However, you can ask for additional items, such as a refrigerator, washer, dryer, etc. Also, a seller may exclude items from the sale. An example of an excluded item may be certain window treatments or a chandelier. These items must be written into the contract and agreed on by the buyer and the seller.

The seller will then do one of the following:

• Accept the offer

• Reject the offer

• Counter the offer with changes

By far the most common is the counteroffer. In these cases, my experience and negotiating skills become powerful in representing your best interests.

When a counteroffer is presented, we will work together to review counteroffer, making sure that we move forward with your goals in mind and ensuring that we negotiate the best possible price and terms on your behalf.

REPAIRS

After inspections are performed, the reports should be delivered to you within 24 hours. Once they are received, we will discuss which items (that are not in working order) you would like the seller to repair prior to closing. We will write up all of these items on a TRR (treatments, repairs, and replacements) form. The TRR must be delivered to the listing agent cancel the contract, due to inspection results, it must be done by this date in order to get your money you paid for inspections.

REAL ESTATE AGENT COMPENSATION AND PROFESSIONAL FEES ARE NEGOTIABLE AND THERE IS NO INDUSTRY STANDARD.

Working with a professional Agent, you are hiring someone who will guide you through the real estate process and may perform the following services: consulting in regard to properties and the purchase agreements, assisting in the communication and negotiation of contracts, and receiving delivery of any offers made by Buyer and accepted by Seller.

HOW REALTORS WORK & GET PAID

By submitting a TRR, you are waiving your right to cancel the contract, based on inspection results.

When the TRR is submitted to the seller and they sign “received by seller” they will have seven days to respond to the request. They may agree or not agree to all of the repairs requested or they may renegotiate the TRR or the terms. If an agreement is not reached, the contract may be voided and you would get your earnest money back.

BUYER BROKER SERVICE AGREEMENT.

A written agreement between Agent and Buyer must be signed and entered into before Agent may begin showing properties to Buyer.

AGENT PROFESSIONAL FEES.

compensation is due and payable upon closing. Compensation could be paid by Buyer, Seller or a combination of both, depending on the agreement. Before working together, this agreement will be reviewed and the terms will be decided. Changes may occur, only if in writing by all parties, if the compensation will be adjusted.
