It’s not over for Sereno, the rule of law MAY 11, 2018 will be remembered in the Philippines as a bad, terrible day for the rule of law and also for democracy. It was the graduation speech that Chief Justice Sereno delivered last year in Ateneo de Manila that insiders say prompted the President to order her removal. HE Supreme Court voted Friday 8-6 to oust Chief Justice Maria Lourdes Sereno, saying she was unqualified for the office because her failure to file the required number of statements of assets, liabilities and net worth (SALNs) was a clear indication of dishonesty and a lack of integrity.
PADRE Faura Street in Manila was a cacophony of sound and color on Friday as supporters and critics of erstwhile Chief Justice Maria Lourdes Sereno marched in front of the Supreme Court building to await the tribunal’s ruling on the quo warranto case filed against her. Both pro- and anti-Sereno camps brought posters, signs and audio systems to announce their positions in the contentious issue, with the pros sporting red ribbons in defiance of the top magistrate – red also being the color identified with President Rodrigo Duterte, who had called for the Chief Justice to step down and who endorsed the petition through the Solicitor General. In granting the quo warranto petition filed by Solicitor General Jose Calida against Sereno, the Court declared the position of chief justice vacant and directed the Judicial and Bar Council (JBC) to begin the application and nomination process. Sereno, who became the first female chief justice in 2012, is now also the first top magistrate to be removed from office through a quo warranto petition, which deemed she was never qualified for the position from the beginning. Sereno, 57, would have served as chief justice until 2030 or another 12 years before her retirement if not for her ouster. In a press briefing, Supreme Court spokesman Theodore Te said Sereno was “adjudged guilty of unlawfully holding and exercising the office of the chief justice” and was therefore ousted. He was joined by Vice President Leni Robredo, Senators Ralph Recto, Juan Edgardo Angara, Sherwin Gatchalian, Panfilo Lacson, Joel Villanueva, Franklin Drilon, Francis Pangilinan, Antonio Trillanes IV, Risa Hontiveros, Bam Aquino and Leila de Lima, the Catholic Bishops Conference of the Philippines, the Association of Major Religious Superiors in the Philippines and Sanlakas. “If the law is already clear, there is no more need to explain. It is clear in the Constitution that an impeachable officer can only be removed through impeachment,” said Aquino who appointed Sereno. “In my own opinion, we see a forced decision whatever the explanation of the majority.” Robredo said Sereno’s ouster set a “very dangerous precedent that may seriously undermine the independence of the judiciary.” “We express alarm over this decision in the strongest terms,” she said.
