Seashore Projects Underway Thanks to Hurricane Sandy Money

Work from the Fire Island to Montauk Point Coastal Storm Risk Management Project has started off the Bay Area’s Outer Beach with millions of dollars of Hurricane Sandy funds on tap for to stabilize and enhance one of the region’s most popular recreation areas.

Preliminary work has begun for the dredging of Moriches Inlet with sand targeted to strengthen local beaches and the Fire Island National Seashore. The pristine stretch of seaside is home to Brookhaven’s Great Gun Beach, Suffolk’s Smith Point Park and the Otis Pike Fire Island High Dune Wilderness, named for a former congressman and the only federally designated wilderness in New York. Collectively known as Fire Island, the barrier beach was severely damaged by the October 2012 superstorm which opened the door for the recovery aid.

The hydraulic dredging project, awarded to the Great Lakes Dredge & Dock Corporation, is designed to improve boater safety repositioning 220,000 cubic yards of sand from the inlet to the coastline that separates Moriches Bay from the Atlantic.

FIMP funding has also been used to build shorebird sanctuaries along the bay and the oceanfront just west of the inlet. Residents are hopeful that the preserves will be populated by endangered birds including the piping plover, whose nests have led to Fire Island beach closures during the height of the summer season.

Great Lakes is also scheduled to begin the dredging of 110,000 cubic yards of sand from Shinnecock Inlet to also clear the way for boaters and bolster local beaches. Work on both projects, totaling $24.5 million,

is expected to be completed by the end of March, according to James D’Ambrosio, Public Affairs Specialist with the U.S. Army Corps of Engineers, which is managing the work. Another Army Corps project funded by the Sandy money was the replenishment of approximately 550,000 cubic yards at Gilgo Beach. Dredging of 700,000 cubic yards of sand at Robert Moses State Park is currently in progress, D’Ambrosio reported.

Efforts to protect the 82-mile coast from Fire Island Inlet to Montauk Point have been ongoing since the federal Rivers and Harbors Act was approved in 1960. The floodplain targeted by FIMP includes not only the bays and ocean beaches, but also more than 46,000 residential and non-residential structures, schools, hospitals, firehouses, and police stations. They include the towns of Babylon, Brookhaven, Easthampton, Islip, and Southampton, as well as 12 incorporated Villages and the Poospatuck and Shinnecock Indian Reservations. The target area affects more than 150,000 residents with an influx of thousands more during the summer months, according to the Army Corps. The massive federal program was funded at $1.7 billion through the Disaster Relief Appropriations Act of 2013.

“Long Island’s ability to take care of our coastline and waterways is essential for the health, safety, and prosperity of our community,” noted U.S. Rep. Andrew Garbarino, whose congressional district includes the Outer Beach. “The FIMP project is critical to reducing flooding, erosion, and storm damage along our shores while also preserving the natural environment and ecosystem –

and it was a long time coming.”

According to the Congressman, “Years of negotiation and coordination at all levels of government have gotten us to this point. We have seen recent delays after the dredging contracts were awarded with the work not progressing at the pace we’d like to see, but it is of the upmost importance that we keep the project on track and as close to expected completion dates as possible.”

Assemblyman Joseph DeStefano, whose district includes Smith Point and the Outer Beach, noted the park was named for William “Tangier” Smith, an early settler of New York. He was the former mayor of the City of Tangier on the Moroccan Coast and moved to the area in the 1600s when he purchased large parcels of land from the Unkechaug Indians to create the Manor of St. George in what became the Town of Brookhaven. In 1701, Smith served as acting Governor of New York with his name also given to a local subdivision and the Tangier Smith Elementary School. Another area namesake, William Floyd, was a local landowner, Revolutionary War soldier and signer of the Declaration of Independence.

The vast coastal resource will be enhanced by the construction of a new Smith Point Bridge, a $112 million project just west of the existing structure that will feature a scenic overlook, pedestrian walkways, and a 300-foot fishing pier into Narrow Bay. With construction expected to begin next year and last until 2027, the new bridge will boast a 55-foot clearance and eliminate the need for a drawbridge, a feature of the existing 64-year-old span

that would often snarl traffic along William Floyd Parkway. The county is also planning to upgrade the bathrooms at Smith Point Park, build new ball courts, and improve the nearby Shirley Marina, according to the area’s county legislator, James Mazzarella.

“Long Islanders love living here and having access to such a spectacular waterfront is a big reason why,” Mazzarella said. “We enjoy some of the finest white-sand beaches on any coast and have great boating, fishing, surfing, clamming and crabbing. It’s no wonder people come from all over the world to enjoy what we have right here in our own backyard,” he added, pointing out the popularity of the area’s camp grounds, Wave snack bar and summer music. “And let’s not forget the cooling breezes and spectacular sunsets.”

Highlighting the everchanging dynamics of the barrier beach was the opening of a new inlet west of Smith Point by Hurricane Sandy, a onceyawning breach that recently closed itself off. The seashore is characterized by ever-changing

dune lines, sandbars, and a wide variety of flora and fauna such as pine trees, beach plum and the ever-present poison ivy whose berries turn bright red in the winter, as well as whitetail deer, foxes, and the illusive snowy owl. In the waters off these spectacular sands can be seen whales, seals, and massive schools of menhaden that are a major food source for bass, bluefish and sharks. Huge manta rays and giant sunfish visit the area and the waters are a magnet for anglers on the hunt for blackfish, flounder and fluke. Many a childhood memory is filled with catching snappers off area docks with homemade bamboo poles.

Just outside of the inlet is the Moriches Reef, an 850acre marine habitat managed by the state Department of Environmental Conservation that consists of sunken barges and boats, armored vehicles, railcars, and pieces of the old Tappan Zee Bridge. Legislator Mazzarella said he will look into the possibility of amending the Moriches Reef with the remains of the old Smith Point Bridge.

CORRECTION

In a story in last week’s paper about the Brookhaven landfill, we have been advised by town staff that Councilman Panico's comments were incorrectly quoted. The facility will stop taking construction and demolition debris in 2024, before the expiration of the permit for the facility. This is not being done for health reasons, as the facility is continuously monitored by the town, state and federal EPA. The facility will continue to accept incinerator ash from residents’ household waste under the permit issued by the DEC until the allowable amount is filled.

Mazzarella Presents Mastics-Moriches-Shirley Community Library with Environmental Grant

Legislator James Mazzarella (R-Mastic) recently joined with Mastics-Moriches-Shirley Community Library President Joe Maiorana, Trustee Joseph Furnari, and Director Kerri Rosalia along with Deputy County Executive Peter Scully and Suffolk County Commissioner of Economic Development Sarah Lansdale to present a $168,900 grant to be used to replace the existing wastewater system at the main branch of the library with a new Innovative/Alternative wastewater treatment system.

“Improving and preserving water quality is of critical importance to every resident in Suffolk County and across Long Island, and this grant will help us move forward with that goal,” said Mazzarella. “I want to thank my colleagues in the legislature and partners in Suffolk County government for making this possible.”

Mazzarella sponsored legislation that made this grant possible and it will be utilized to replace the existing wastewater system at the main branch of the library on William Floyd Parkway with a new Innovative/ Alternative wastewater

treatment system. The funding will offset the cost of this new system for the taxpayers within the library district while replacing an outdated septic system with an environmentally friendly alternative that removes nitrogen from wastewater before it is discharged.

“The library is extremely appreciative of the continued support of Suffolk County,” said Library Board President Joe Maiorana. “Together with our municipal partners, the board of trustees and administration are committed to delivering library services in an environmentally friendly manner. I want to add a special thank you to former library trustee, Legislator Jim Mazzarella for supporting our

Losquadro and Panico Announce Completion of $400,000 Concrete Project in Mastic Beach

Dan Panico have announced the completion of a concrete project on Neighborhood Road from the Mastic Beach Fire House to Commack Road and in the vicinity of St. Jude Roman Catholic Church in Mastic Beach.

Crews removed and replaced 4,260 square feet of ADAcompliant sidewalk, 15,698 square feet of concrete sidewalk, 653 square feet of concrete aprons, and 2,491 linear feet of concrete curbing. The total cost for this paving project was approximately $400,000; it was funded through a Community Development Block Grant (CDBG).

“This was a significant concrete project in the business district of Mastic Beach,” said Superintendent Losquadro. “In particular, it involved the removal and replacement of a substantial amount of sidewalk

that needed to be brought into ADA compliance.”

Councilman Panico said, “The completion of this highway project will have a positive impact on the Mastic Beach community by providing safer passage for pedestrians and parishioners at St. Jude’s Church.”

the Mastics-Moriches-Shirley Community Library is located within a waterfront community situated on the Mastic/Shirley Peninsula, it is important to the library trustees that modern technology be utilized to make the main branch environmentally friendly. Enhanced IA septic system designs have shown great promise for removing much of the nitrogen in wastewater before it enters surrounding groundwater, and surface waters.

Preliminary design for the new system to be installed is expected to reduce approximately 450 pounds per year of nitrogen loading into our groundwater. In addition to this, both the Mastic Beach Branch and the Moriches Branch have been built utilizing similar nitrogen reducing technology.

Grant funding is vital due to the high number of properties on the Mastic/Shirley Peninsula operating on cesspools, which

do little to mitigate the flow of nitrogen into groundwater. In January of 2019, residents of the community overwhelmingly approved the construction of the Forge River Watershed Sewer District.

In addition to this initiative, in 2020 the Suffolk County Legislature expanded the scope of the Water Quality Protection and Restoration Program to include the area known as the Forge River Watershed. This expansion made it possible for the Library to apply for competitive environmental grants for clean water initiative projects such as these.

“Long Island is surrounded by water. We swim, surf, boat and fish in it aside from just simply enjoying being near it,” said Mazzarella. “We must all take responsibility to protect our drinking water and reduce pollution in our local waters to simply safeguard our way of life.”

Sheriff Toulon Delivers Presentation at Las Vegas Corrections Conference

Suffolk County Sheriff Errol Toulon, Jr. attended the Corrections USA (CUSA) Conference in Las Vegas earlier this week. Sheriff Toulon presented on Corrections Intelligence Gathering and shared his insights on the importance of analyzing data and trends to help solve crimes and keep law enforcement and the public safe. The conference was attended by notable law enforcement persons including

Nevada Attorney General Aaron D. Ford and CUSA Chairman Jim Baiardi.

Suffolk County Sheriff’s Office Correction Officers Lt. Sean Springsteen and Inv. Christine Fanning were honored with Valor awards at the CUSA conference for their work in Corrections.

Community Clean Up

On Sunday, February 12, Boy Scout Troop 138 joined with the Mastics and Shirley Chamber of Commerce for Community Clean Up Day. They met in the parking lot of Applebees and cleaned up the road along Montauk Highway. There were many volunteers who helped out the community groups.

South Country Makes Second 202324 Budget Presentation to Board of Education

South Country Central School District Superintendent of Schools Antonio Santana delivered a second presentation regarding the 2023-24 school budget to the school board during a meeting on Feb. 1.

Santana’s presentation was developed in conjunction with Jennifer Segui, the district’s assistant superintendent for finance and management services, and included information on the New York State tax cap and the district’s revenues.

Santana provided information on the role of the tax cap in the budget process, the difference between the tax cap and the tax levy, and shared how both are calculated.

Additionally, he recommended that the board of education consider approving a $1 million interfund transfer to capital. A transfer to capital is a budgeting tool that allows the district to make improvements to its facilities on an ongoing basis and also garner building state aid.

Santana rounded out the

presentation by speaking about revenues that the district uses to offset the budget, including property taxes, state aid and its appropriated fund balance.

The presentation was the second in a series of upcoming budget workshops. The first presentation was held on Jan. 24 and reviewed the resources used to build the budget, including external and internal auditors, financial advisors, stakeholder input, experienced business officials and discussions with knowledgeable superintendents.

Four additional presentations are scheduled prior to the April 19 board of education budget adoption. All presentations are held at 7:30 p.m. in the district office and are livestreamed on the district’s YouTube channel.

SUFFOLK CLOSEUP It's Ed Romaine vs. Dave Calone for Suffolk County Exec

The race this year for Suffolk County executive—the top position in Suffolk County government—is taking shape with a contest between Republican Edward Romaine and Democrat Dave Calone.

Romaine was first elected Brookhaven Town’s 70th town supervisor in a special election in 2012, and re-elected with large margins since. He has extensive county experience. Romaine was a member of the Suffolk Legislature from 1986 through 1989 when he was elected Suffolk County clerk, a position he held for 16 years. In 2005, he returned to the legislature and was re-elected three times before running for and becoming Brookhaven Town supervisor.

It was a family tragedy that caused him to depart the legislature and run for Brookhaven Town supervisor. It was after his son, Keith Romaine, a two-term Brookhaven Town councilman, seen as moving up and becoming town supervisor, died at just 36. The young supervisor, of Moriches suddenly contracted pneumonia and passed away from complications caused by a virus that attacked his heart. Ed subsequently ran for town supervisor to do what his son “might have done.” As he explained: “If my son had lived, he would be supervisor.”

As a legislator and town supervisor,

Ed Romaine, of Center Moriches, has been highly active especially on environmental issues and pressing for sound fiscal policies. He was a major legislative force in battling and stopping the operation of LILCO’s Shoreham nuclear power plant. As the top elected town official in Brookhaven, Suffolk’s largest town, bigger than Nassau County, Romaine’s major undertakings have encompassed protecting the Carmans River and promoting the use of renewable energy. “We have put up solar panels everywhere,” he has said.

Romaine started his professional life as an educator and taught history at Hauppauge High School. He initially began serving in government as Brookhaven’s first commissioner of Housing and Community Development and later director of Economic Development.

Calone is a lawyer and a former state and federal prosecutor. In the U.S. Department of Justice from 1999 until 2003, his focus included both terrorism and corporate fraud. He announced in July that he was seeking to be the Democratic candidate for county executive.

Calone was chair of the Suffolk County Planning Commission for eight years, a trustee of the Long Island Power Authority and a board member of the Community Development Corp., an affordable

housing nonprofit. In business, he is president and CEO of Jove Equity Partners, a private equity and venture capital firm. He serves as a director of several U.S. companies.

There was a “kick-off” in Stony Brook last month for the Calone campaign with 250 people in attendance. Also last month, Calone, of East Setauket, said contributions to his campaign had reached $1.7 million.

Says Calone: “The county executive role is not about left or right—it’s about moving Suffolk forward. As a former prosecutor and businessman, I am ready to lead our county to become safer, more affordable, and with more opportunity for everybody.”

A wrinkle earlier in the Democratic Party’s process of choosing a candidate for county executive this year was that Southampton Town Supervisor Jay Schneiderman considered running. “I’ll be a good candidate,” said Schneiderman in November. He was first elected Southampton supervisor in 2015 after being a Suffolk County legislator and is the only person to ever serve as supervisor of two Suffolk towns—first East Hampton and then, after being on the legislature, Southampton. However, last month he decided not to run saying that “for a variety of reasons, I have decided not to enter the county executive race at this juncture.”

If he had gotten the nomination it would have been an interesting

pairing considering that Romaine had been Schneiderman’s history teacher at Hauppauge High School

Suffolk Democratic Chair Rich Schaffer said following the Calone the kick-off: “As former prosecutor and as a business leader, Dave will lead a coalition to energize Democratic voters across the county.” That would be important if it happens because a key reason many Democratic candidates in Suffolk didn’t fare well in the 2022 election was the Democratic turn-out here—a 7.8 percent decrease from the 2018 election. Meanwhile, Republicans increased their turn-out from 2018 by 5.7 percent.

And then there is how Suffolk’s huge number of independent voters will ballot.

Regarding voter figures in Suffolk, the latest numbers from the New York State Board of Election (from November) show most are enrolled Democrats—380,756. The Republican total is 343,940. But then there are the independents, listed by the board as “Blank” voters—312,975. These independents are often the key in Suffolk elections

This year is the last for Steve Bellone as Suffolk County executive due to term limits. A Democrat from North Babylon and lawyer, he was a member of the Babylon Town Board and that town’s supervisor before his election as county executive in 2011.

In 2023, a New York Medicaid applicant can have $28,133 in assets, and certain other exempt assets, such as tax deferred retirement account. This means that an applicant will not be disqualified if they have an IRA, 401k, 403(b) or other tax deferred

retirement account that exceeds $28,133.

A trust can also provide for protection of your assets. Since Medicaid can only recover or “claw back” assets from the probate estate after death, placing assets in Trust will avoid a Medicaid lien. When created for this purpose, the trust document often allows the creator to receive all income from trust assets, but under no circumstance may principal be used for the benefit of the creator. The creator can also maintain the power to change the trustees and after-death beneficiaries.

If the trust allows the applicant to receive trust income, this will be paid out to the applicant and considered as part of the Medicaid application, as well. While there are income limits for the Medicaid program, applicants with excess income should seek advice on how to utilize the program and protect their income.

Another bonus placing a

residence in trust is often a good idea to ease administration at death. When a primary residence is transferred to the trust, the creator can maintain the exclusive right to reside in the property and remains responsible for all maintenance, utilities, upkeep, etc. If properly drafted as a Grantor

Trust, real property taxes will not be negatively impacted if the trust is revocable or a Medicaid asset protection trust. Also, the creator can still receive a $250,000 ($500,000 for a couple) exemption on capital gains tax if the residence is sold during the creator’s life. The benefits of placing a residence

in trust can be even more crucial with a cooperative apartment, or “Co-Op”, as New Yorkers would say. With the delays of the probate process, a cooperative often sits vacant during that time without the nominated executors or beneficiaries having any access. Monthly maintenance payments continue to be due and, while that bill is mounting, the apartment cannot be cleaned out or sold.

As the NBA heads into the second half of the season, the New York area teams are both heading in opposite directions and hope to find some success late in the year.

The Nets had a massive overhaul before the break dealing away their two star players, but the return doesn't have bettors feeling any confidence in this team. Brooklyn brought back a lot of talent, but no one can make up for KD in the minds of Nets fans and backers. Mikal Bridges, Spencer Dinwiddie, Cam Johnson, Dorian FinneySmith, Jae Crowder, 5 first rounders, 2 second rounders and a swamp of a 1st is a massive retooling for Irving and Durant. But, with those changes can a

plummeting in odds. The Nets were essentially 6 to 1 to win the NBA title with Durant and Kyrie, now they have all but disappeared off the board sitting at 80 to 1.

Not all is long in Brooklyn though as they have played basically .500 ball since KD was dealt. They also still sit right in the middle of the pack for a playoff berth, and this team isn't throwing in the towel.

VETERANS WAY The Pact Act and Your VA Benefits

The PACT ACT is a new law that expands VA health Care and benefits for Veterans exposed to burn pits, Agent Orange, and other toxic substances. It is perhaps the largest health care and benefit expansion in VA history. Named in honor of Sergeant First Class Heath Robinson, a decorated combat medic who died from a rare form of lung cancer, this historic legislation will help deliver more timely benefits and services to more than 5 million veterans across all generations who may have been impacted by toxic exposures while serving our country.

The Pact Act ensures veterans can receive highquality health care screening and services related to potential toxic exposures. For post 9/11 combat veterans, the bill extends the period of

time they have to enroll in VA health care from five to ten years post discharge. For those combat veterans who do not fall within that window, the bill also creates a one-year open enrollment period. This expansion means that more veterans can enroll in VA health care without having to demonstrate a service connected disability.

The Act codifies the VA’s new process for evaluating and determining presumption of exposure and service connection for various chronic conditions when the evidence of a military environmental exposure and the associated health risks are strong in the aggregate but hard to prove on an individual basis.

The legislation removes the need for certain veterans and their survivors to prove

service connected if they are diagnosed with one of 23 specific conditions. This list includes 11 respiratory related conditions, along with several forms of cancer, including reproductive cancers, melanoma, pancreatic cancer, kidney cancer, and brain cancers such as Glioblastoma. Survivors of veterans who died due to one of these

conditions may now also be eligible for benefits.

Many of our veterans have no knowledge of the Pact Act, and have not had any association with the VA health care. Those suffering from PTSD, or other problems resulting from combat are afraid of the stigma that the “D” in PTSD. They fear they

will get the label Mental Disorder for the rest of their lives. They also have been out of the service for years before the symptoms of the different conditions occur. For example, I recently met a veteran in a local hospital emergency room who was suffering from chest pain for weeks and had problems breathing. Knowing he was a veteran I asked him where he served. He served two years in Iraq and Afghanistan. I then asked if he was around any of the burning pits common in those countries. He told me that there were many at both bases he was stationed at. He knew nothing about the dangers of those pits and the toxic gases they give off. Nor did he know anything about the Pact Act or that he could get better coverage at the VA, could include disability coverage.

The Gospel of James is a second-century infancy gospel telling of the miraculous conception of the virgin Mary, her upbringing and marriage to Joseph, their journey to Bethlehem, the birth of Jesus, and events immediately following. It is the earliest surviving assertion of the perpetual virginity of Mary, meaning that her virginity did not just exist prior to her giving birth to Jesus but also thereafter.

The Gospel of James is assumed to have been in circulation c.150 AD. The author claims to be James, the half brother of Jesus by an earlier marriage of Joseph but in fact his identity is unknown. The gospel is an elaboration on the birth narratives in the gospels of Luke and Mathew and many of its elements notably its very physical description of Mary’s pregnancy by the midwife Salome suggest that it was and attempt to deny the arguments of the Marcionites, unorthodox Christians who held that the

birth of Jesus was entirely supernatural.

In James’ gospel Mary is presented as an extraordinary child destined for great things from the moment of her conception. Her parents were the wealthy Joachim and his wife Anne. Distressed that they had no children Joachim went into the wilderness to pray, leaving his wife Anne behind to lament her childlessness. Their prayers were answered when angels announced the coming child. In the seventh month of Anne’s pregnancy she delivered her daughter.

This underlines the exceptional life that Mary will live. Anne dedicates her child to God and vows that she will be raised in the Temple. Joachim and Anne name their daughter Mary and when she is three years old they send her to the Temple to live. There she is fed each day by an angel.

Request for Written Comments on Proposed Shellfish Aquaculture Lease Renewals

Notice is hereby given that the Suffolk County Department of Economic Development and Planning has received three Lease Renewal Applications from existing leaseholders that wish to renew their lease for an additional ten (10) year term. Each of these Leaseholders initially obtained their lease during Phase I (2010-2020) of the County’s Shellfish Aquaculture Lease Program under Cycle #3; and have been conducting shellfish aquaculture activities on their respective lease site for the past ten (10) years. WHEREAS, on December 1, 2022, a duly advertised public hearing was held to consider the application of 359 Portion Road, Inc. for a change of zone from J Business 2 to J Business 6, special permit for major restaurant with accessory drive-through and waivers of special permit criteria on property located on the north side of Portion Road, west of Hans Boulevard, in Lake Ronkonkoma, New York, further identified by Suffolk County Tax Map Number 020064800-0500-010000; and WHEREAS, after due consideration and deliberation; BE IT HEREBY RESOLVED by the Town Board of the Town of Brookhaven that the above application for a change of zone from J Business 2 to J Business 6, special permit for major restaurant with accessory drive-through and waivers of special permit criteria is hereby approved subject to the following: Conditions 1. The applicant must submit proof, to the satisfaction of the Town Attorney’s Office, that the covenants and restrictions, approved as to form and substance, referenced below, have been filed with the Suffolk County Clerk’s Office. 2. The submission of 50% of the land use intensification mitigation fee in the amount of $2,347.50 shall be submitted prior to effectuating the zoning per Town Code Section 8582.F. The check shall be made payable to the Joseph Macchia Environmental

Preservation Capital Reserve Fund. Covenants

1. Submission of the outstanding balance of the land use intensification mitigation fee in the amount of $2,347.50 shall be a condition of final site plan approval per Town Code Section 85-82.F. The check shall be made payable to the Joseph Macchia Environmental Preservation Capital Reserve Fund. 2. No access to Jamar Lane shall be permitted.

3. At the time of site plan application, the developer shall submit a plan that shows the lot being utilized for a major restaurant with accessory drive-through located on the southerly portion of the property in compliance with the concept plan prepared by Labcrew Engineering, P.C., dated November 2021, with a revision date of 11/12/22, and received by the Town Clerk’s office on 11/16/2022. At the time of site plan application, the Planning Board shall determine the location and configuration of the office buildings and cross access shown on the northerly portion of the property.

4. The structures on the north end of the property shall not be used for Bar, Tavern or Night Club, Billiard Hall, Catering Hall, Community Movie Theater, Delicatessen, Dry Cleaner, Laundromat, Major Restaurant, personal service shops, Restaurant, retail sales establishment, or take out restaurant.

5. Minimum front yard setback for the building shall be no more than 17 feet at its closest point to the Right-of-Way and shall be maintained as a planted landscaped area or surface to provide outdoor seating in compliance with the “Main Street Business District Design Manual”.

6. A minimum 30 foot landscaped rear yard buffer shall be maintained along the rear property line except shall reduce to a 25 foot buffer in the northwest corner that fronts on Jamar Lane. RESOLVED that the following waivers from Town Board Special Permit Criteria are approved:

1. Brookhaven Town Code Section 85483.B.(3) – Side yard drivethrough facilities shall have a one-way access exiting the site for only the drivethrough facility: exit not exclusive to drive-through approved.

2. Brookhaven Town Code Section 85-483.B.(6) – Drivethrough facilities shall be screened from view of the

primary or secondary main street: drive-through not screened from primary main street approved.

RESOLVED that the Town Board, as Lead Agency, has determined that pursuant to 6 New York Codes, Rules and Regulations Part 617.5(c) (26) and (33), the proposed action is deemed to be an Unlisted Action for which a Negative Declaration has been issued.
