










With Brookhaven Supervisor Edward Romaine a candidate for county executive, changes may be on tap for the leadership of Brookhaven, Suffolk’s largest town, and if the next supervisor is promoted from within, changes will come to the town council as well.
Expressing interest in becoming the town’s chief administrative officer is Councilman Daniel Panico, who has served as Romaine’s Deputy since 2012, and Town Highway Superintendent Daniel Losquadro. Both are being considered by the Republican and Conservative parties with the final decision coming at their nominating conventions later this month.
Representing Brookhaven’s 6th Council District, which encompasses the Moriches Bay Area, Panico replaced Keith Romaine, son of the county executive candidate, who passed away unexpectedly in 2010. Panico is a graduate of William Floyd High School and received a Bachelor’s Degree in History and Political Science from Stony Brook University. From there, he earned a law degree from Touro Law School and had a private law practice. He has also served as a Senior Deputy Suffolk County Clerk and was a member of the Town of Brookhaven Planning Board. Both he and
The race for the most important seat in county government came into focus last week as Brookhaven Supervisor Edward Romaine emerged as a candidate to succeed Suffolk Executive Steve Bellone, who is exiting the role due to term limits.
Currently a presumptive nominee, Romaine, 74, has been screened by the Republican and Conservative parties and is expected to be endorsed at their upcoming conventions. On the Democrat side, former federal prosecutor and past-chair of the Suffolk Planning Commission, David Calone, has been campaigning for the seat.
In a recent interview with the South Shore Press, the Bay Area resident covered a wide-range of concerns facing Suffolk and his plans to duplicate the success he’s had in the town by holding down taxes, protecting the environment and addressing quality of life issues such as zombie homes and crime.
“Show us the money,” was Romaine’s call in setting a priority to get the county’s share of the $1 trillion federal infrastructure bill passed by Congress last year and New York’s $4.2 billion environmental bond act, which was approved by voters in November.

Elected highway superintendent in 2013, Losquadro has served as a Suffolk Legislator and member of the state Assembly covering northeastern Brookhaven. The Shoreham resident has been credited with establishing a comprehensive road resurfacing and drainage plan which is on track to repave every Brookhaven street at least every 15 years.
As a member of the town board, Panico has tackled Brookhaven’s solid waste management issues, including the closure of the Yaphank landfill. “We want to shut down the facility earlier than we are permitted by the state for health reasons,” Panico said, noting that the future of Long Island garbage is “reduce, recycling and rail.” He supports the construction of a kiln that would convert recycled glass into building materials as a response to the collapse of the recycled glass market.
With highway department expenses making up a large portion of the town’s budget, Losquadro has been recognized as a tight steward of taxpayer dollars. He said he is looking to bring his legislative and executive experience to the supervisor’s office with a focus on spurring economic development
by making the town more business friendly. He is a graduate of the State University of New York at Stony Brook having earned a B.A. degree in history. For nearly a decade before taking office, he worked as a senior property claims estimator for State Farm Insurance. He is a graduate of Shoreham-Wading River High School.
Replacing Romaine, who has also served as a Suffolk legislator and county clerk, will be no small task as Brookhaven faces a number of critical issues such as revenue loss from the closure of the Yaphank landfill and personnel expenses as the town workforce ages out and retires. In running for county executive, Romaine said he will keep in close contact with Brookhaven and Suffolk’s other nine towns to bring home Long Island’s share of
the $1 trillion federal infrastructure fund and the state’s $4.2 billion environmental bond act money.
Neither Brookhaven Democrat leader Anthony Portesy or the Suffolk Democrat committee responded to requests from the South Shore Press to comment on their candidates in the November election.
“Both Dan Panico and Dan Losquadro would make excellent supervisors, though it will be tough to fill the shoes of Ed Romaine,” said a GOP supporter who backs both candidates. “Either way, the taxpayers will be well served.”
If Panico were to run for supervisor, his council seat will be on the ballot in November and both parties are expected to name candidates at their conventions
later this month. Regardless of the supervisor’s race, the Republicans will stick with town board incumbents Mike Loguercio in district four and Neil Foley in the fifth, with the question of Councilwoman Jane Bonner leaving her district two seat to run for the county legislature still open. If she were to vie to replace the termlimited Sarah Anker, more changes could come to the board. Rounding out their ticket, the Republicans will nominate a challenger to Democrat Councilman Jonathan Kornreich, the district one incumbent the Democrats are expected to support for reelection.
Opening the door for even more change to the town board is the departure of Kevin LaValle, whose district three seat is now up for grabs following his election as Brookhaven Town clerk. Rounding out the town slate for the GOP will be Receiver of Taxes Louis Marcoccia, who has held the seat since 2007.
Joining the county-wide ticket with Romaine will be the Suffolk legislature incumbents from Brookhaven: Nick Caracappa, James Mazzarella, and Dominick Thorne. Suffolk County executive will be the key race on this year’s ballot as the district attorney, comptroller, and clerk are not up for election.
the region in making sure that money makes its way to Long Island,” Romaine said in noting the substandard condition of area roads and bridges, lack of sewers, and the need to preserve water resources, open space and farmland. “The fact that tens of thousands of commuters are still riding diesel trains every day is an insult to the economic engine that our region represents. We need to fully electrify all three lines that serve our county.”
The Brookhaven Supervisor was part of the Long Island delegation of legislators, supervisors and mayors who came out against Gov. Kathy Hochul’s plan to usurp local zoning authority to place multi-family housing projects in the suburbs. “There’s a red line between the interests of New York City and Long Island and we are in a constant battle to make sure it doesn’t get crossed,” Romaine said. “My Democrat opponent, whoever it may be, will not stand up to the forces that run Albany and Washington. I am geared up and ready to fight for the future of Suffolk County. The people who live here are worth the struggle.”
Elected to the town’s top post in 2012, Romaine has also served as a Suffolk legislator and county clerk. He has vied for county executive before and made several bids for Congress. He was a history teacher in Hauppauge for 12 years and taught as an adjunct professor at Dowling College, Stony Brook University and Suffolk
Community teaching economics, public policy and history.
Romaine was Brookhaven’s first Commissioner of Housing and Community Development and was later appointed Director of Economic Development. He is a 44-year resident of Center Moriches where he lives with his wife, Diane.
“Ed Romaine has demonstrated a long record of accountability and proven results for the taxpayers. He’s an unmatched political force at the ballot box,” said Suffolk GOP Chairman Jesse Garcia, who also serves as the Brookhaven Republican leader. “From improving the town’s bond rating to Triple A and holding the line on taxes to improving our quality of life through the removal of 400 zombie homes and preserving farmland and open space, Ed Romaine is exactly what our county needs to get back on track.”
Romaine promised to be a loud voice against illegal immigration and the open southern border. “Fentanyl and the other illicit
drugs pouring into the United States are killing our children and it has to stop,” the Supervisor said. “We’re seeing gangs coming into the country, human trafficking, a huge increase in crime,” he said in railing against the bail laws and soft-on-crime policies of the Democrats. “I will fight every day to make our communities safe. I support law enforcement and will make sure the men and women in law enforcement who protect us get the resources and respect they deserve.”
With Suffolk’s fair share of the state environmental bond money, Romaine said he will focus on expanding the Forge River Watershed Sewer Project and groundwater programs throughout the county. “We have to get rid of the cesspools if we are to protect our water for future generations.”
Boasting of support from top environmental groups—the Long Island Environmental Voters Forum, Sierra Club, and League of Conservation Voters—Romaine favors wind, solar and geothermal as alternatives to fossil fuels. He’s addressed Brookhaven’s solid waste issues with a town-wide recycling program and solar projects and said his plans to close the Yaphank landfill and regional ash fill are on track.
An early challenger for the Democrat line, Calone said he is focused on addressing climate change, noting that his work quarterbacking the county’s first
Comprehensive Plan in over 40 years and serving as chair of Suffolk’s Superstorm Sandy Review Task Force will help the county better prepare for future challenges. He created the Long Island Unified Solar Permit Initiative, which resulted in Suffolk winning a prestigious National Association of Counties Achievement Award.
Calone is a longtime board member of the United Way of Long Island and Community Development Corporation and said he is committed to initiatives that address inequities in health, housing, and economic opportunity. His “Farmers for the Future” idea enabled new Suffolk County farmers to buy the equipment they need and led to significant funding flowing from the state to East End farmers.
Calone, 49, lives with his wife and three children in East Setauket and currently works as a venture capitalist. In addition to his four years with the justice department, he served for two years in the state Attorney General’s Office. Calone was also a trustee with the Long Island Power Authority for three years. Having made an unsuccessful bid for Congress in 2016, he’s reported a war chest approaching $1 million for the county executive race. He’s won the support of the Brookhaven Town Democrat Committee with the final decision on his candidacy expected at the party’s upcoming county convention.

Eastport-South Manor Central School District classrooms took time to celebrate the power of reading aloud during annual World Read Aloud Day, held on Feb. 1. Teams of select district high school students, many of whom are members of the English Honor Society, shared their favorite books with younger students enrolled at Dayton Avenue, Eastport, Tuttle Avenue and South Street elementary schools.
World Read Aloud Day encourages people throughout the world to read aloud together and share stories to advocate for literature and the written word. On posters scattered throughout the elementary schools, the reason to read aloud included improved listening, expanded vocabulary and spelling, affirmation of the value of reading, sparking important conversations and providing time to bond with one another.

In her war against fossil fuels, the governor is pushing to:
Prohibit the installation of oil and gas heating and cooling systems in new residential and commercial buildings starting in 2025
Prohibit installation of fossilfuel heating equipment when retrofitting existing residential and multi-family buildings up to three stories in seven years and higher multi- family and commercial buildings in 2035.
Eliminate gas ovens for all residential, commercial and restaurant use.
Hochul’s regulations cover all plumbing, heating, electrical, lighting, insulating, ventilating, air conditioning, and refrigerating equipment
powered by oil and natural gas.
“New York sits on a Saudi Arabia of natural gas, but because of Woke politicians such as Kathy Hochul, we’re not allowed to touch it,” said Assemblyman Joe DeStefano in speaking out against the governor’s plan. “Let’s say no to Kathy Hochul’s assault on our economic well-being and open the door for our own clean and inexpensive natural resources.”

According to energy experts, windmills and solar panels couldn’t even come close to providing the power consumed by New Yorkers, especially for the expensive electric vehicles pushed by the Progressive Democrats who have bought into the war on fossil fuels. Numerous studies show that blackouts and energy rationing would be the new normal if restrictions such as those pushed by Gov. Hochul are put in place.
“We’re already seeing energy disasters taking place in California as fossil fuel plants are eliminated from the power grid,” DeStefano said. “And in England, people are resorting to burning wood and coal to keep warm and are creating pollution that they haven’t seen since the days of Charles Dickens.”

One thing that unites Republicans and Democrats on Long Island is our full-throated opposition to Governor Hochul’s proposed MTA tax increase.
At a time when many businesses and people are leaving New York for states with lower taxes and a more pro-business stance, the governor’s proposed tax hike will only drive more enterprises out of Long Island.
Instead of punishing the men and women of New York who invest in our state with this tax hike, we should incentivize more businesses to build their operations here on Long Island.
Brookhaven Town Supervisor Ed Romaine was correct when saying that MTA Chairman and CEO Janno Lieber displayed “arrogance” by assuming we Long Islanders would sit by and pay a higher fee for tickets and more taxes. Rather than punishing the blue-collar commuters who already struggle with inflation, rising gas prices, and high taxes, the MTA should reform itself by tightening its infamous spending sprees and become an economically efficient agency that Long Islanders can use.
The chairman has chutzpah asking us Long Islanders to pay more. I stand firmly opposed to any tax increase that would negatively impact our local economy here on Long Island, and I ask my colleagues in the Assembly and Senate to oppose this tax hike.

…Any claim that New York state is business-friendly amounts to little more than wishful thinking. Cumbersome taxes, fees and regulations have established a business climate that stifles prosperity and growth. The extension of higher business taxes, an increased MTA payroll tax and a perpetual minimum wage hike will only add to those frustrations.

The title is long but what’s being considered are projects that have financial costs with a very long series of dollar numbers. “Coastal Defense Megaprojects in an Era of Sea-Level Rise: Politically Feasible Strategies or Army Corps Fantasies?” is its title.
It is a detailed analysis just out about proposed “megaprojects” involving the U.S. Army Corps of Engineers that the Corps sees as protecting coastal areas from storms made extremely intense due to global warming or climate change.
Consider $119,000,000,000. That $119 billion would be used for a plan featuring a series of retractable gates built in a six mile stretch out in the Atlantic Ocean from New Jersey to the Rockaways. Writing in The New York Times in 2021, Ann Barnard reported: “The giant barrier is the largest of five options the Army Corps of Engineers is studying to protect the New York area as storms become more frequent, and destructive, on a warming Earth.” Her article was headlined: “The $119 Billion Sea Wall That Could Defend New York…or Not.”
It continued: “The proposals have sparked fierce debate as New York, like other coastal cities, grapples with the broader question of how and to what degree it must transform its landscape and lifestyle to survive rising seas.”

This scheme was succeeded—after its cost, environmental impacts and practicality were questioned—by what Barnard in The Times described in an article last year as the Army Corps’ “latest vision of how to protect the region from future storms: a $52 billion proposal to build moveable sea barriers across the mouths of major bays and inlets along New York Harbor.”
“If Congress approved the proposal,” she went on, “the federal government would pay 65 percent” of the $52 billion cost.” "The plan," she added, would also include “31 miles of land-based levees, elevated shorelines and sea walls. It would require approval from the state and local governments that would foot the rest of the bill.”
Whether $119 billion or $52 billion—taxpayers will be deeply affected.
And also last year, for Long Island Dr. Malcolm Bowman, an oceanography professor at Stony Brook University’s School of Marine and Atmospheric Sciences, presented a study he did that proposed “sea gates” to serve as storm surge barriers at south shore inlets from East Rockaway Inlet on to five other inlets including Fire Island, Moriches and Shinnecock Inlets.
It is titled “Protecting Long Island from Future Sandy Flood Events: A
BY NANCY BURNER, ESQ.South Shore Sea Gate Study.” The gates would be mostly left open but when a big storm approached, they’d close to prevent storm surges from entering the bays into which the inlets lead.
In presenting his study, funded by the New York State Department of Environmental Conservation, Bowman told the Long Island Regional Planning Board about the “sea gates—“Think of them like a saloon door.” As for cost, he set no figure but acknowledged that the plan would be in the multi-billion dollar range.
That “Coastal Defense Megaprojects in an Era of Sea Level Rise” report in the current issue of the Journal of Water Resources Planning and Management of the American Society of Civil Engineers was
written by a professor from Rutgers University and two professors from Princeton University—including Dr. Michael Oppenheimer. They conclude: “We are pessimistic that storm surge barriers will be politically feasible climate adaptation options” for reasons including “modern environmental laws that provide avenues for expression of oppositional views within the decision process” and “the allure of alternative options that are more aesthetically pleasing and cheaper and faster to implement even when they do not offer equivalent levels of protection—e.g. green/nature-based solutions.” Before joining the Princeton faculty, Oppenheimer was for 20 years the chief scientist at the Environmental Defense Fund, launched and long headquartered in Suffolk County.
In medicine, there’s a focus on the cause, not just the effect, of a disease. These “megaprojects” focus on an effect of global warming, of climate change. Would it not be a wiser—and economically far more practical—to focus on the cause? Instead of the billions upon billions of dollars being proposed to try to deal with an effect, we need to get at the main cause of global warming: the burning of fossil fuels: coal, gas and oil.
Efforts to combat global warming/ climate change—notably a rapid transition to clean, green fuels—have for years not been strong enough. There’s been talk and talk, and some action. But time and again necessary steps have been blocked by vested interests—the coal, gas and oil industries—and politicians in denial of climate change often in the pockets of these industries.
As UN Secretary-General Antonio Guterres declared at last year’s COP 27 Climate Change Summit: “We are in the fight of our lives, and we are losing. Greenhouse gas emissions keep growing, global temperatures keep rising, and our planet is fast approaching tipping points that will make climate chaos irreversible. We are on a highway to climate hell with our foot still on the accelerator.”
We must, indeed, fully challenge and counter the cause of an existential global illness.
A: I am a widow in my early 70s. I have two daughters and a great family dynamic. I assume when I die, my estate will be split evenly amongst my two heirs so I am hesitant to have a will drawn up. Am I making the right decision?
In New York, many assume the process you described above would be simple and clear. However, planning for our later years and after death, although difficult to discuss, is crucial. Those who plan are taking the steps to ensure that their own wishes are followed and needs are met, while creating clear instructions for their agents and heirs. These instructions come in the form of documents including Power of Attorney, Health Care Proxy, Living Will, MOLST, Last Will and Testament, and possibly a Trust.
A last will & testament (or “will”) is a document that states how you want your assets to be handled after your death. In that document, you nominate an executor, the person who will oversee your estate, and list the beneficiary(ies) of your assets. You can list a set dollar amount or certain items to a named beneficiary – this is called a specific bequest. The document will
also list “residuary beneficiaries” that will take the remainder of your estate in set percentages or shares. Often times it is assumed or mistaken that this document is simply shown after your death and your executor can carry on with business as usual. News flash! Your will has to go through the court process of “probate” after your death. Probate is the legal process in which a will is reviewed to determine whether it is valid and authentic. Without probate, the will is just a list of your wishes and intentions. The process is what validates the document, and results in an executor being formally appointed by the court with the ability to collect and distribute your assets to all intended individuals.
Probate requires that the deceased person’s legal next of kin be notified that the will was admitted to probate. If the next of kin are being disinherited or are difficult to locate, probate will likely be a timely and costly process worth avoiding. Owning
real property in multiple states also presents issues because probate would be required in each of the states where the property is located. Joint ownership of property will avoid probate, as will naming a beneficiary on an asset.
Another option you may consider in addition to a will and to avoid the probate process is a document called a trust. Once signed, the document creates a legal entity, an “alter ego” of the creator of the trust, which can then own things. Trusts
can own real property, brokerage accounts, CDs, and other classes of assets. The trust document defines the rules by which the various trust assets must be managed. Similar to a will, the trust can list who will handle trust assets in the event of incapacity or upon death, and also list how trust assets will be distributed at death. The trust lays out the rules of the game, including the powers of the trustees. There are many types of trusts both Revocable and Irrevocable that Estate Planning Attorneys uses for specific purposes and plans. Therefore, it would be best to contact a professional to discuss your specific situation and not leave your estate to chance.

The minute the confetti stopped falling, sports bettors across the country ran to their sports books and mobile devices to see if they could grab some early odds for next year's
big game. The usual suspects sit atop the odds with the Chiefs opening up as the favorite at +500. With Patrick Mahomes in his prime and Andy Reid patrolling the sidelines this was a pretty obvious favorite. Next up is Josh Allen and the Buffalo Bills at +550. The Bills have been knocked out of the playoffs much earlier than expected for two seasons in a row but it's hard to deny they have a pretty good championship window and management is expected to be aggressive this offseason.
The San Francisco 49ers come in at +700 even with question marks on who will be under center. The Bengals and Eagles are 10 to 1. Both have stacked rosters led by good, young quarterbacks and dynamic receiving cores. The Cowboys round out the teams who are under 25 to 1, as they come in at +1200 to win it all.
The rest of the field looks like this. The Chargers and Ravens are +2500. Packers, Bucs, Jags, and Lions are all +3500, these will surely shift once Rodgers makes his decision. The Giants, Saints,
Vikings, Dolphins, Rams and Broncos are +4000. The Jets are just below that at +4500 along with the Browns and Raiders. Perennial contenders the Pats and Steelers are +6000 while the Panthers, Titans
and Colts are all +7000. The Bears, Seahawks, Washington, Falcons, and Cardinals are all +9000. Pulling up the rear are the Texans +12000.
While we're pining to be afloat with a deck beneath our feet, we might even feel compelled to venture out with proper planning. If so, the Float Plan, oft spoken of and more often ignored, can be key for you and those closest to you. That’s what this column is about.
The Float Plan is nominally known as a mechanism for ensuring that missing vessels are indeed missed in time for action to be taken that might otherwise lead to the rescue of the crew rather than the recovery of their bodies. “Boat-A is supposed to be at Payne’s Marina in the Great Salt Pond on Block Island at this time and date. Is it there?”
So, in a nutshell, float plans are all about SOLAS - Safety Of Life At Sea. However, as the title infers, the development of a float plan delivers nothing but upside to the boat’s master and thus to the crew who are fully the master’s responsibility.
The ideal float plan involves the detailed analysis of getting to your destination and returning safely. The float plan provides the opportunity for the skipper to sit with his or her charts, in the calm of a kitchen, den or study, and literally walk through the passage with parallel rulers and dividers.
What is the goal of such detailed analysis? The net effect is to create your own Pilot Guide for the entire passage and to be able to assign predicted times to each leg. Deviation from predicted times is an early warning to the skipper that something is up – working against (or with!) a current, cross winds creating additional work effort for the engines to hold course, etc. All of this translates into fuel consumption “deltas” which ultimately leads directly to SOLAS issues – Safety Of Life At Sea…
If you have made an error in the development of your pilot guide, the rest of the guide is likely to be suspect and you’ll have to do what every skipper has done for centuries untold – improvise carefully… If the chart is generally consistent but winds and tides have done the inevitable, then the overall pilot guide is likely to still have integrity but, once again, you’ll have to do what every skipper has done for centuries untold – improvise carefully...

With respect to predicting the weather, I use the Weather.com website – www.weather.com - and the reason I do is because I can get weather prediction by the hour. If the chance of precipitation for a particular day is 50%, but it is 10% in the morning and 90% in the

Tides
Nothing is more likely to surprise you and more potentially perilous to happen than running aground – and understanding the tide is all about that. There are several good services to use but there is something very subtle about tide analysis that no chart gives you.
Tides change at different rates at different places (watch for a column here soon where we’ll talk Time and Tides.) Knowing the tides at an
inlet while spending the next 6 hours transiting from cove to bay “on the inside” could require major mental gymnastics in order to keep pace with the pace of the tide as it works its way through that inlet and across the bays and into the coves…

In a well-structured State of the Union address President Joe Biden demonstrated a pronounced detachment from the world as it exists in real time. The President recovered well from early momentary attention lapses, but during the address I was getting the feeling that he was speaking from somewhere in a parallel dimension. It was obvious that the purpose of this address was to launch his reelection campaign.
The President repeated the catchphrase “Let’s finish the job.” We should get used to this line because we will be hearing it a lot during ensuing months. “Let’s finish the job?” I, along with many Americans, am waiting for him to start it. There is speculation as to whether Biden will finish his current term, much less seek a second one.
Recent surveys indicate that the programs of our Chief Executive are not resonating with the American public. These polls are showing that most of us don’t understand what the Administration has
accomplished, since Biden took over.
These same polls indicate that most of us believe that we are worse off financially since Trump left office. Even among Democrats there is evidence of waning enthusiasm for a second term. Turmoil is mounting as House Republicans initiate investigations into corruption within the Biden family. Right now Biden’s best job security lies in the fact that his sitting Vice President is Kamala Harris who is perceived even in her own party as someone who is very difficult to take seriously. In fact in many circles the Veep is looked upon as a laughingstock.
The President flaunts the illusion that he is uniting the country while at the same time blatantly assaulting anyone offering opposing views. For instance, even in the face of non-support by leading Democrats, the President has diluted the word “racist” by using it so casually to describe those who opposed Washington control
of state election laws.
During the address the President said he would cooperate with China but vowed to “protect our country,” a reference to the Chinese spy balloon that traveled across our skies during the week.
“I’m committed to work with China where we can advance American interests and benefit the world,” he said. “But make no mistake about it: as we made clear last week, if China threatens our sovereignty, we will act
to protect our country. And we did.” Beijing denied that the balloon was an espionage device.
Biden had been expected to address competition with China but his speechwriters would have added that remark after the balloon crossed the skies above the United States, dominating the news cycle, before a U.S. fighter jet shot it down on Saturday.
I find it interesting that Several Republicans yelled
out “Liar!” when Biden charged them with wanting to sunset Social Security in exchange for averting a credit default. The leaders of the GOP in Congress are faced with a golden opportunity to challenge the lies and distortions of Biden’s State of the Union Address. They should use the speech as a blueprint for regaining the White House in 2024.
Hell is a place of eternal torment and punishment for those who have died in a state of serious sin before reconciling with God. Those who reject God’s mercy before death will suffer the loss of His mercy forever. The fallen angels whom Lucifer duped into following him into rebellion against the Creator had their will frozen upon their expulsion from heaven and now are condemned to the abyss, or as the Book of Revelation calls it “the burning lake” for all eternity.
Theologians who subscribe to a linear divine history believe hell to be an eternal destination. Those with a cyclic view see hell as an intermediary period between incarnations. Many believe hell to be a real topological location in another dimension, beneath the terrestrial surface.
There are however traditions depicting hell as a residence of the deceased under the exterior surface of the Earth’s crust. There are also those who
conceive of hell in the abstract as a state of loss rather than an underground site of flaming torture and fiery pains.
In his epic classical work the Divine Comedy, 14th century poet Dante Alighieri describes his journey through hell, purgatory, and Heaven. With the Roman poet Virgil as his guide, Dante travels downward visiting each of the nine circles of hell. In each circle he spends time with deceased sinners condemned for eternity for their sins against man, nature, and God.
Dante, who had been exiled from his beloved Florence for his political activism, wrote that hell is depicted as concentric circles of torment. It is the realm of those who have rejected spiritual values by yielding to bestial appetites or violence, or by perverting their human intellect to fraud or malice against their fellowmen.
The circles follow from top to bottom with the gravity of the sins punished and the
severity of the punishments increasing as Dante and Virgil descend. The higher circles punish the sins least offensive to God. As the duo descends, they encounter more serious

Each of these Leaseholders initially obtained their lease during Phase I (2010-2020) of the County’s Shellfish Aquaculture Lease Program under Cycle #3; and have been conducting shellfish aquaculture activities on their respective lease site for the past ten (10) years. The applicant must submit proof, to the satisfaction of the Town Attorney’s Office, that the covenants and restrictions, approved as to form and substance, referenced below, have been filed with the Suffolk County Clerk’s Office. Covenants 1. The subject premises shall only be used as a Compost and Mulch Processing and Storage Facility. 2. A 100-foot natural and undisturbed buffer area shall be maintained along the east side of Lots 3 and 4. 3. No processing or storage of materials shall occur within 25-feet of the subject property line. 4. The applicant shall obtain all necessary permits for the proposed bulk storage of petroleum and chemical products from the Suffolk County Department of Health Services pursuant to the Suffolk County Sanitary Code. 5. The mulch and compost processing and storage facility shall obtain a New York State Department of Environmental Conservation Solid Waste Permit for the operation. Development shall be in conformance with all applicable Town, County, State and Federal regulations. 6. The Facility entrance/exit apron, emergency gate apron, and the proposed parking areas shall be paved with bituminous asphalt pavement. 7. Planting and landscaping areas shall be established on the east side of Grucci Lane along the front of the property in accordance with an approved landscaping plan to include tree planting, grass, mulch areas and street trees. 8. A barrier fence along the east side of the site shall be installed to protect the 100-foot buffer area on the east from any intrusion. 9. The applicant shall obtain a Long Island non-potable water well permit from the New York State Department of Environmental Conservation for the proposed non-potable electric water well for mulch coloring activities and to fill the water truck for dust suppression purposes. 10. Sanitary waste disposal shall comply with the Suffolk County Department of Health Services Sanitary Code.
11. No free-standing leachate shall be produced
at the facility. 12. All roads within the Facility shall be routinely sprayed with water by the Facility's water truck to mitigate dust.
Inbound and outbound trucks shall drive at a slow rate of speed to reduce dust. The use of water spraying devices, placed in strategic locations, shall be used to mitigate dust, and apply water to mulch, compost, and topsoil piles if needed. 13. When odors are encountered onsite during the processing of mulch, piles shall be restacked (pulled apart and reassembled) or turned to mitigate odors and avoid anaerobic decomposition.
14. Turning of stockpiles of mulch and active compost shall not be performed on windy days minimizing off-site odor impacts.
15. The Facility Manager shall routinely inspect the outdoor areas for signs of vectors. A professional vector exterminator contractor shall be made available if warranted. 16. Noise levels attributable to operations at the Facility shall not exceed ambient sound levels at the property line as set forth in Town Code and New York State Department of Environmental Conservation Part 360 for suburban settings. 17.
All equipment vehicles at the Facility shall have engine mufflers and idling of vehicles and equipment shall be kept to a minimum.
18. The Facility shall be equipped with a dedicated fire hydrant line for firefighting purposes and the facility design layout shall include an emergency entrance/exit gate for egress. 19. The office trailer, employee trailer, and aboveground storage tank area shall be equipped with fire extinguishers and first aid stations. 20.
A double 20-foot-wide swing gate shall be located at the northwest corner of the Facility for emergency purposes (i.e., evacuation, secondary means of egress, fire truck access and rescue). 21. Fencing shall be installed along the west, north and northeastern portion of the Facility to supplement the existing fencing along the southern and southwestern portion of the Facility. 22. A double 25-foot-wide swing gate shall be located at the Facility entrance road and access to the Facility shall only be permitted when an attendant is on duty. 23. All incoming loads of yard waste debris materials shall be monitored by on-site
personnel for unacceptable materials. 24. The operator shall install one up-gradient monitoring well and one downgradient monitoring well to monitor groundwater conditions associated with the proposed composting activities. The up-gradient monitoring well shall be installed in the northwest corner of the subject property, and the downgradient monitoring well shall be installed in the southeast corner of the subject property. 25. Groundwater monitoring and sampling activities should be performed once, annually, between the months of September and November.
An independent environmental consultant shall collect one liquid sample from each monitoring well to be analyzed for Target Analyte List metals (23 metals). One field blank shall also be collected for quality assurance/quality control purposes. Samples shall be analyzed by a New York State Environmental Laboratory Approval Program certified laboratory. Sampling guidelines and protocols shall adhere to New York State Department of Environmental Conservation, Division of Environmental Remediation groundwater guidance values and the established water quality standards compiled in New York State Department of Environmental Conservation Technical and Operational Guidance Series guidance document. 26. No chemical testing shall be performed on mulch or compost materials as these materials are considered organic and clean, and shall only be derived from tree wood, wood debris, yard trimmings, and yard waste. 27. Materials that shall be prohibited from the facility include municipal solid waste, food scraps and food processing waste, soiled or unrecyclable paper known as SourceSeparated Organics, biosolids, Construction and Demolition debris (fill material, demolition wastes, and construction wastes), adulterated or contaminated wood (wood containing adhesives and paint; creosote-treat wood; copper, chromium, arsenic treated wood, asbestoscontaminated materials, and other pesticide or pressure treated lumber), hazardous waste, industrial waste, liquid waste,
asbestos, medical waste, radioactive waste, septic/ sanitary waste, sewage sludge, dredging materials, petroleum contaminated soils, urban fill materials, and any other hazardous waste and/or material. 28. Upon approval of the New York State Department of Environmental Conservation Engineering Report and Facility Manual, copies shall be provided to the Town of Brookhaven Department of Planning, Environment and Land Management, Town Fire Marshal, and the local fire department. Copies of these Reports shall also be permanently maintained and stored in the office trailer. 29. The operator shall train its employees in the identification of potentially hazardous materials that may be encountered entering the Facility pursuant to a New York State Department of Environmental Conservation approved Employee Training Plan. Should any unacceptable waste be identified within the confines of the Facility, it shall be treated as outlined in the "Unauthorized Waste Control Plan", of the facility's Engineering Report. 30. All processed material piles shall be turned, or restacked (pulled apart and reassembled), at least once in every 180-day period. 31. The applicant shall submit a Stormwater Pollution Prevention Plan for the proposed construction of the Facility. 32. Silts and organic materials that collect inside the bio-retention swales and settling ponds shall be routinely maintained to prevent the accumulated materials from entering the bio-retention basins. Accumulated materials shall be collected and transferred to the active/ curing composting piles. RESOLVED, that the Town Board, as Lead Agency, has determined that pursuant to 6 New York Codes, Rules and Regulations Part 617.3 and 617.6, the proposed action is deemed to be a Type I Action for which a Negative Declaration has been issued.
