Without your help in this way we could not continue our work with rehabilitation, re homing or veterinary costs. We operate a non-destruction policy, our OAP unit houses pets who’s owners may have passed away or are unable to care for them due to their own ill health. We constantly need to maintain the rescue kennels, cattery and aviary and upgrade as often as we can. More spaces are needed daily and the funds received from donations help us to provide a high level of care, food and veterinary treatment as and when needed.

tested, enabling affordable veterinary care and treatment for local pets and peace of mind for their owners. Not only do our vets treat and care for our own animals, we have opened our doors to provide affordable and compassionate care to owners and their pets.

Pet Food Bank – Non means tested, free pet food for those who maybe struggling, helping them

to keep their pets. During the current economic climate, a little extra help is sometimes needed and we are here to help people take care of their beloved pets. We have a large food store and cater for cats, dogs and rabbits. We offer a non-means tested service so that anyone is able to come and ask for help, all we ask for is proof of address, such as a utility bill. Or a letter from a support worker (or similar) if the person needing pet food is homeless.

The charity relies on legacies, gifts and donations just as many other charities do, if you wish to consider leaving Pet Rescue Welfare Association a gift in your will, that gift is marked by a permanent reminder of your kindness. Chapter One Charity Trustees: managing the risk of wills disputes The last five or so years have seen an increasing number of successful inheritance claims against deceased estates by aggrieved loved ones. The outcome of some of these cases, particularly court rulings in favour of an adult child, surprised many – and will undoubtedly be relied on to encourage more claims by adult children in future.

Meanwhile, the public is increasingly generous towards charities in their wills. In 2018, more than £3 billion was given to charity in wills – a 50 per cent increase since 2008.

This means charities are more likely than ever to be unwillingly involved in disputes involving a claim against a deceased estate where the deceased’s will includes charitable legacies.

This means the approach of a charity inadvertently involved in a wills dispute needs to be considered very carefully. A key legal principle for charities is that their trustees must act in the charity’s best interests and they have a duty to protect and to recover assets belonging to the charity. This duty covers assets in the form of legacies under the terms of a will.

Challenging a will Wills can be challenged in a number of ways, though individuals wishing to contest a will do not have an unfettered right to bring a claim simply because they feel hard done by. Claims can properly be brought in restricted circumstances, particularly: • Under the Inheritance Act (Provision for Family and Dependants) Act 1975

on the basis that the will has not provided reasonable financial provision for a

dependent or, increasingly, an adult child; • Where it is unclear or doubtful whether a charitable bequest in a will is valid; • The deceased did not have ‘testamentary capacity’ to make a will and/or

did not have the requisite knowledge and approval of the contents of a will; • The deceased was under undue influence to make the will, or it was forged or fraudulent; •

The will was not executed in accordance with strict legal requirements.

In the case of a successful claim, the charity is likely to lose out. For example, if the deceased leaves the residuary estate to charity but a claimant wins their claim – the amount available to the charity will be depleted; and if a challenge relating to the validity of the will itself is successful, the charity will not receive anything from the estate.

The ‘problem’ of adult children There could be an even greater risk of disputes involving adult children given recent research from the Office for National Statistics (ONS), showing that more than a quarter of retired people now specifically exclude family from their wills. Instead, they are choosing to leave their estates to other individuals and to worthy causes, though some are undoubtedly conscious that they may need to rely on what would otherwise be their children’s inheritance to foot the bill for the cost of care in their old age.

So in the current financial environment where younger generations are increasingly reliant on ‘the bank of mum and dad’ for university funding, property purchases, etc. the risk of inheritance claims in future is not difficult to see.

Will makers considering naming charities in their wills, while disinheriting close family members, need to think about the potential risk of a claim against their estate. If a risk is identified, their solicitor must discuss how it can be addressed, for example, by leaving a clear letter of wishes explaining the decision. This could prevent expensive litigation draining the client’s estate of its cash.

The famous case of Illot v The Blue Cross and others [2017] UKSC 17 is a salutary lesson. The deceased left most of her estate to three charities and excluded her long-estranged daughter, but the court allowed the daughter’s claim to the extent she was awarded a comparatively small amount (£50,000) out of the estate.

However, the court also emphasised that testamentary freedom remains a key legal principle: the testator had chosen to benefit the three charities so they remained the key beneficiaries of the estate.

Risk management So how can charities effectively manage wills disputes? In its guidance for charity trustees, the Charity Commission warns that legal action can present significant risk to a charity’s beneficiaries, assets and reputation. It makes clear that the decision whether or not to initiate or defend legal action must only be made in the best interests of the charity. It must also be balanced against the potential risks and consequences of legal action.

The Commission also “expects trustees to consider legal action only after they have explored and, where appropriate, ruled out any other ways of resolving the issue in dispute”. For good measure, it also says charity trustees must be able to explain and justify their approach to the issues (remember, trustees can be held responsible for breach of duty).

So where does this leave charities involved in wills disputes? To ensure the best approach to any dispute, strategic legal advice should be taken from expert charity solicitors to ensure the trustees comply with their legal duties from the outset.

Where the trustees are presented with a weak claim that has little merit, different forms of alternative dispute resolution (ADR) can be deployed to resolve the matter.

However, trustees must remain mindful that they must be satisfied they have the power to implement any settlement terms before doing so.

If the circumstances are suitable, mediation can be particularly effective. An independent third party such as a lawyer or representative from another organisation, acts as mediator between the parties in dispute to help them come to an agreement.

Alternatively, a willingness to negotiate an agreement to resolve the dispute early – with or without advisers – could be the wisest course of action. If the trustees can reach a mutually agreeable settlement which is in the charity’s interests, a formal compromise agreement can be drawn up which is then legally binding on the parties.

Also, bear in mind that the civil court system works in such a way as to encourage the parties in a dispute to consider working to settle the claim as early as possible to avoid litigation. Indeed, the court can refuse to hear a claim unless the parties have considered mediation or other ways to settle the matter. Trustees should also note that the court can award costs against a party who has refused to go to mediation, or has refused a reasonable offer to settle a claim.

There are also wider issues to consider. The charity’s reputation could be on the line; and the trustees’ response to a dispute will reflect on the charity in some way. A robust but reasonable response, for example, should not rebound negatively on the charity, but an aggressive approach is likely to leave the charity appearing tightfisted and unsympathetic.

It would not be unusual for more than one charity to be named in a will in dispute, in which case the trustees of each charity may decide to collaborate and defend a claim together. If the matter could be settled early to avoid the need for litigation, a joined-up approach to mediating or negotiating an agreement may be in the interests of all the parties. In any situation, expert legal advice is a must.

Chapter Two Encouraging legacy gifting A significant proportion of charitable giving is derived from deceased estates.

Or to put a more human spin on it, charities consistently benefit financially from the generosity of people who want to leave money to their chosen charities in their wills.

Individuals whose lives are touched by charitable causes naturally want to show their appreciation to charities in the form of a financial gift on their death – as well as, or in addition to any lifetime charitable donations they might choose to make. A cancer patient or their family may want to leave a legacy to Macmillan Cancer Support or the hospital where they were treated. Animal lovers may want to leave their estate to their favourite animal charity or rescue centre. A long-standing member of a church may choose to leave a legacy to their local place of worship.

Whatever the altruistic reasons for leaving money to charity – and there are many reasons why people want to do so – the charities themselves are heavily dependent on charitable giving in people’s wills. Fortunately, although the public’s trust and confidence in charities has taken a knock in recent years in the wake of various scandals involving various high-profile charities, charitable legacies have reportedly reached an all-time high of more than £3 billion.

Charitable legacies are booming and private client lawyers continue to play a vital role in encouraging their wills clients to leave legacies to charity. It is a win win for all: charitable giving helps the most vulnerable in society and other deserving causes, and the clients themselves get to support their favourite charities and, while doing so, reduce any inheritance tax payable on death.

So what do the latest statistics tell us about charitable giving in wills? According to Smee & Ford’s latest report (in partnership with Wilmington), for the first time ever legacy income has surpassed the £3 billion mark. It also reports that 16.7 per cent of the value of charitable estates (donor wealth) went to charities and 6.3 per cent of the population leave money to charity, with the most popular charitable cause for a single bequest being a place of worship.

In separate research, the Top 100 Fundraisers Spotlight Report (2019) shows legacy gifting accounts for a huge sum in fundraising income (25.8 per cent). This giving increased from £7m to £21m in just two years. The report confirms how legacy gifts remain “hugely important to fundraising charities”.

Meanwhile, Remember a Charity conducted a poll of 2,000 people across the United Kingdom in Spring 2019. The organisation reports that a 5 per cent increase (to 40 per cent) of people aged 40 and over would be happy to give a small percentage of their estate to charity; and 65 per cent said it was acceptable to leave everything to charity if someone wanted to – and only a quarter felt their family would object to them making such a gift.

Evidently, people are positive about leaving money to charity and, despite recent high-profile scandals affecting the reputations of some big name charities, the public still recognise the need for charitable giving in their wills.

The tax breaks Charitable giving in a will can lead to significant inheritance tax savings for the deceased estate. Indeed, the tax benefits may be the will-maker’s primary reason for making a charitable gift in their will. They have the right under the principle of testamentary freedom to leave money to anyone or any charity they choose, even if they have no demonstrable tie to their charity/ies of choice (unless it is to the exclusion of a dependent who may then have a claim for reasonable financial provision).

So what are the tax benefits? Under the normal rules, inheritance tax is charged at the rate of 40 per cent on the value of a deceased’s estate that exceeds the inheritance tax threshold (also known as the ‘nil rate band’) of £325,000.

More deceased estates are chargeable to inheritance tax than ever before, primarily because of the steep rise in property prices in recent years, particularly in London and the Home Counties. This means it is vital for the majority of will-makers to consider how they can reduce the inheritance tax potentially chargeable on their estate.

Leaving money to charity will reduce any inheritance tax that may be payable. This is because the value of any charitable legacy will not form part of the estate for the purposes of calculating inheritance tax. Furthermore, if you leave at least 10 per cent of your estate to charity, the rate of inheritance tax is reduced to 36 per cent.

While many people know exactly what charities they want to benefit in their will, others need inspiration. With more than 168,000 charities registered in the UK, it can be a challenge deciding which charity to leave a legacy to, but solicitors can help clients focus their minds on the areas that interest them most and help them make a wise and tax-efficient decision.

You can of course change your mind. People’s circumstances can change and you can change your will at any time. Indeed, nearly half of individuals who leave charitable legacies go on to change their minds, according to one legacy fundraising consultant.

What’s next?

Charities have much to take comfort from, given the encouraging evidence that individuals are as mindful as ever of charities when making their wills. And there are expected developments that will undoubtedly increase charitable legacies even further. The Charity Tax Commission (CTC) has proposed reforms including a VAT exemption on charitable wills, with the effect that solicitors will not charge VAT on wills containing a charitable legacy.

If the government gives effect to the proposal, private client practitioners will be incentivised to advise clients to consider making charitable gifts in their wills, and explain the cost-effectiveness of so doing. A significant rise in charitable legacies would undoubtedly result.

Chapter Three Charities: a call to action and ethical fundraising Charitable giving is firmly bound up with trust and reputation. That may be an obvious statement but charities in the UK still have much to learn about maintaining and protecting the public’s perception of them if they want to continue relying on the public for financial support.

Perhaps the slump in public confidence in the reputation of charities made the charitable efforts of Bolton plumber James Anderson hit the news headlines in 2019.

Anderson was lauded for carrying out vital plumbing work in the homes of elderly and vulnerable customers – and not charging them. His motivation was not 15 minutes of fame (he was already locally known for his philanthropy), but rather it was his genuine concern for the vulnerable who otherwise had no choice but to be cold because of the prohibitive cost of repair works.

Anderson’s endeavours are what people like to associate with charity, whether through an individual or a registered charitable organisation – as the chair of the UK’s charities regulator has recently highlighted.

In early October 2019, Baroness Stowell, chair of the Charity Commission, told charities that this “confirms to us what we already know – that charities as organisations are not the only vehicles through which charity is delivered. What charities are, however, is the shop-window to, and therefore should be living embodiments of, what makes charity distinct and special in the eyes of the public”.

But she said that collectively, charities are not delivering their full potential as sources of belonging and cohesion – that charities do not “have the public’s benefit of the doubt”.

So what’s wrong with charities today? Speaking at the Commission’s annual meeting, Stowell said people no longer assume charitable organisations reflect or share their understanding of charitable endeavour and behaviour.

Blaming the prevailing climate of “division and tension” against the background of Brexit, she said charities should be a healing force in societal divisions: “Charity is about the means not just the ends,” she added – and it is the role of the Commission to hold charities to account on the issue of public expectation.

What’s the Charity Commission doing?

The Commission committed in 2018 to regulating the sector with a clear purpose in the public interest and to ensuring charity can “thrive and inspire trust so that people can improve lives and strengthen society”.

It seeks to deliver on that by helping charities and others understand public expectations of charity, beyond the specific causes individual charities promote.

But what about those charities who are not acting appropriately or transparently, for example, the high-profile scandals engulfing the likes of Oxfam and Kids’ Company?

There are well-known failures among charities that have undermined public trust in what it means to be a charity: sex scandals, aggressive fundraising practices and taking advantage of the vulnerable – all quickly tarnishing a charity’s reputation.

As Baroness Stowell commented in Spring 2019, the public is often disappointed in charities. They see organisations focused more on their growth and expansion and protecting their corporate reputations, and not on the interests of the people they are supposed to be helping.

The Commission has previously said it will not ignore any complaint made about a charity but conceded that it may not always prompt an investigation, for example, if it was not proportionate to do so. However, the Commission has made a commitment to understanding what such complaints tell us about the public’s expectations of charity, for instance, complaints frequently centre around a lack of openness.

Ethical fundraising rooted in trust This has everything to do with fundraising. To raise funds, a charity needs to persuade people to give; and to encourage giving you need to foster a relationship of trust and transparency between the charity and the potential donee. But the series of scandals in close succession have dented the reputation of many a charity.

For charities not caught up in scandalous activities, the role of fundraising is daunting for charities and their trustees at the best of times – but when the public’s trust is dented it is understandably an even greater challenge for them. This means it is vital that they work hard to ensure the risk of any scandal of any nature is kept to a minimum.

As Stowell says, charities have the potential to “foster respect and admiration between people who look, sound, and think very differently from one another”. But if they are to meet this potential, charities must understand a fundamental point, that “charity is not just measured in the worthiness of a cause” and also in the way in which that cause is furthered - by the behaviours and attitudes displayed along the way.

This is much to do with ethics. The larger charities are already starting to embrace better approaches to fundraising which means donors are treated with more respect and humanity. This is what one might describe as ‘ethical’ fundraising, drilling down into understanding and adopting a critical approach to who you will (and won’t) accept charitable donations from; how you will react and response formally to an offer of gifts from an individual or organisation that could potentially damage your reputation; ensuring your fundraising techniques can withstand public scrutiny – and that of the regulator.

So how can charities implement ethical fundraising strategy? A clear and robust policy with which trustees and charities’ staff are familiar is an excellent start, covering the above issues at an absolute minimum.

The ethical considerations will vary from one charity to another depending on its charitable purpose; there will not be a ‘one size fits all’. Your policy will also necessarily reflect the size of the charity.

Plumber James Anderson’s charitable activities and, perhaps more importantly his motivations and his ethics, are undoubtedly a challenge to all charitable organisations.

There may not be a better place for charities to start than by establishing and maintaining ethical fundraising practices to ensure their charitable motivations and objectives are funded and fulfilled ethically - with little or no risk to the reputation of the charitable sector as a whole.

Chapter Four Fundraising in a digital age Technology in the 21st century has revitalised charitable fundraising efforts and a greater number of charities are adapting to the digital environment than ever before. Charities really need to adapt to survive.

With the advent of customer-friendly interfaces, the opportunities to harness technology to reach consumers and other potential charitable donors instantaneously are greater than ever. If charities can attract the attention of a donor, a huge hurdle has been overcome and they can then interact with the individual in a personal and engaging way, which is likely to convert to interest, trust – and financial support.

New digital fundraising platforms are key in the 21st century to expanding a charity’s reach. Ranging from text, online and contactless donations, the potential for capturing potential donors and encouraging them to donate is increasing year on year.

Text donations The digital donation market is ripe for the pickings. According to Phone-paid Services Authority (PSA)’s latest annual market review (to March 2019), £49.6m was donated to charity by text last year – a £12.1m increase on the previous year. Further, more than a quarter of donations to major charity telethons were also made by text (64 per cent of more than 8700 respondents to a consumer survey saying they made a charity donation in the past 12 months to support a telethon).

The sector is quickly cottoning onto the opportunities presented by texting. Since its November 2018 launch, Donr - a text-to-donate platform enabling charity donations by mobile at a ‘fair’ fee - more than a thousand charities have signed up to use the service (similar platforms include Donate and JustTextGiving).

And according to management software firm Blackbaud, millennials donated 30 per cent of the total amount given to charity this year (£2.7bn), making them the largest donor group in the country. This is the generation that enjoys an all-round digital experience, so an invitation to donate by text is unlikely to be accepted unless there is the opportunity to see a video or a fundraising event, or related social media posts and photographs of an event, or a backstory to the requested donation.

But don’t take young people for mugs: millennials are, says the Charity Commission, more generous towards charities at Christmas and more likely to research a charity before donating. According to the Commission, more than half of those between 18 and 24 years admit to checking out a charity before donating, compared to just 29 per cent of over-75s.

Text donations naturally lead to the use of contactless payment technology. Similarly, there are apps such as Give as you Live which allows people to raise money for charities when they buy goods without cash at more than 4,300 retailers. Thousands of UK charities are already registered with the app and the technology is particularly accessible for smaller charities that lack the financial resources of the larger charities.

Crowdfunding Crowdfunding has fast gained momentum and is now firmly established as a popular and effective method of fundraising, both for individuals and for charitable (and other) organisations. Charities are missing a trick if they are not embracing crowdfunding in an appropriate setting. For instance, in circumstances when financial support is quickly needed for an urgent cause, social media can be effectively harnessed to publicise a crowdfunding campaign extremely fast.

Then there are smart devices in the home. An increasing number of people now own smart devices such as the Amazon Echo and Alexa. Far from being a fad, these smart devices are increasingly used in a variety of ways, and their capabilities are now being recognised in the charitable sector.

In 2018, for example, the British Heart Foundation (BHF) was the first charity to launch an Amazon Alexa skill allowing individuals to donate money (and furniture) using voice commands – from the privacy of their own homes. Other charities to follow BHF’s lead include the NSPCC and Breast Cancer Care.

Room for improvement However, there are concerns that charities are not yet up to speed with the pace of change in technology. The charitable sector is reportedly operating up to 10 years behind the commercial sector when it comes to embracing digital transformation.

The consequences are charities could be missing a trick and not taking advantage of the full benefits technology offers their fundraising efforts.

Reported figures tend to bear this out. The Third Sector’s Fundraising Conference in spring 2019 was told that 53 per cent of all charitable donations between 2014 and 2018 were cash, compared with a mere 22 per cent of all spending in retail. Further, a fifth of charities lacked the ability to take online donations – even though, for instance, 86 per cent of under 20s say they would donate to charity online through a smartphone.

Consumer behaviours and expectations change rapidly reflecting the constantly evolving landscape, and charities need to keep up. As Krystyna Grant, BHF’s head of innovation has said, larger charities have a “responsibility to our beneficiaries to keep up with the technological pace of change and meet our audience where they are online”.

The key takeaway is that charities serious about adapting their fundraising efforts in the technological age in which we all live and work need to consider whether they need to shift their focus. This is not to suggest traditional methods of fundraising need to be compromised – there remains a genuine place for fundraising methods which stand the test of time.

But new generations are less likely to be reached in traditional ways. Charities need to shift gear and invest in technology to facilitate fundraising specifically aimed at millennials and the incoming generations. If they don’t they will lose out to other charities.

Charities must not forget social media in their general fund-raising strategies. The power of social media cannot be underestimate, and charities ignore this highly accessible tool at their peril. Used effectively, it can drive engagement with the charity, publicise activities and campaigns, gain a trusted following and garner financial support. Social media marketing can also be closely targeted thanks to the way the algorithms work in sorting posts in a user’s feed based on their relevancy.

The larger and established charities unarguably have the resources to invest in digital technology while smaller charities will find it much more of a challenge. However, there are organisations such as Charity Digital which helps charities to accelerate their use of technology which charities will find invaluable.

Gifts from legacies have helped us build a new barn to provide more indoor accommodation, create field shelters to protect the donkeys from rain and sun, fund our donkey therapy programmes for people with specific needs, and help our animals work with special school youngsters.

Pet Rescue and Rehoming Centre – Founded 2001. Taking in unwanted and abandoned animals and finding them loving homes.

Pet Rescue welfare association - Pets of all ages and breeds need our rescue service now more

than ever. Strays, abandoned, relinquished and bereaved, all would have a story if they could talk. We rely heavily on donations, monetary or in kind. Without your help in this way we could not continue our work with rehabilitation, re homing or veterinary costs. We operate a non-destruction policy, our OAP unit houses pets who’s owners may have passed away or are unable to care for them due to their own ill health. We constantly need to maintain the rescue kennels, cattery and aviary and upgrade as often as we can. More spaces are needed daily and the funds received from donations help us to provide a high level of care, food and veterinary treatment as and when needed.

Community Vet Clinic and Fully Equipped Surgical Unit – Opened to the public 2007. Non means

tested, enabling affordable veterinary care and treatment for local pets and peace of mind for their owners. Not only do our vets treat and care for our own animals, we have opened our doors to provide affordable and compassionate care to owners and their pets.

Pet Food Bank – Non means tested, free pet food for those who maybe struggling, helping them

to keep their pets. During the current economic climate, a little extra help is sometimes needed and we are here to help people take care of their beloved pets. We have a large food store and cater for cats, dogs and rabbits. We offer a non-means tested service so that anyone is able to come and ask for help, all we ask for is proof of address, such as a utility bill. Or a letter from a support worker (or similar) if the person needing pet food is homeless.

The charity relies on legacies, gifts and donations just as many other charities do, if you wish to consider leaving Pet Rescue Welfare Association a gift in your will, that gift is marked by a permanent reminder of your kindness. Stokenchurch Dog Rescue was originally formed in 1963, by local residents, to save the lives of stray and unwanted dogs.

Since then many thousands of dogs have been brought to us and have been successfully re-homed.

We never destroy a healthy dog, believing that somewhere there is a kind and permanent home for every dog. We also take in and care for the sick, the old and the traumatised. If we have room, we offer them all a home and do everything within our power to rehabilitate them whenever possible, both physically and psychologically.

We also have a fostering system whereby dogs who have not adapted well to kennels can live with a family on a temporary basis.

SDR is self-financing and all running costs are obtained through the continued efforts of our volunteers.

CHRONIC PAIN THE SILENT EPIDEMIC  A staggering 28 million adults experience chronic pain  Over half of sufferers endure chronic pain all day, every day.  Around 1 in 10 people suffer from such extreme levels of pain it is

that is either moderately or severely disabling.

 Chronic pain is the silent epidemic because it isn't as visible or as measurable as other conditions, despite the fact that it can have a devastating impact on quality of life.  Thousands of sufferers lose their jobs because the pain is so bad

that they cannot work.

 Pain stops sufferers enjoying walking, shopping, sleeping; even playing with their

children.

Chronic Pain affects people of all walks of life, 43% of the population suffer from chronic pain.

We also research on Cancer Pain, many cancer research charities are prevented from funding work on cancer pain. Their Trust Deeds specify ‘research into the cause and cure of cancer’ and this, of course, excludes pain. Yet for every £50,000 donated to cancer research, chronic pain research receives donations of less than one (1p) penny.

Research costs money, and there is always an urgent need to provide more funds for more research.

The Pain Relief Foundation DOES NOT receive funding from the NHS or any other Government body.

Instead, our vital work depends entirely on donations and the generosity of people like you.

The Passage’s mission is to provide resources which encourage, inspire and challenge homeless people to transform their lives.

Based in London, The Passage initially provides a warm welcome, food and drink, showers and clean clothes leading to assessment, support finding employment, comprehensive advice, welfare and medical support facilities for homeless people.

Outreach services are also provided on a 24x7 basis.

We have 16 self-contained studio flats to support very long term rough sleepers as well as another 40 bed hostel for rough sleepers. Our Home for Good project provides a volunteer based support service to former rough sleepers following resettlement. Last year over 3,000 individuals were helped.

St Mungo’s outreach teams go out each night to meet people who are sleeping rough and to help them move away from the streets.

We’re also one of the few homelessness charities that accommodate people with dogs or other pets wherever possible, reducing barriers for someone to come off the streets.
