Bill filed to target catalytic converter thefts

verters by an organized crime ring and thefts of firearms not properly secured in vehicles, drove up the reported auto theft crimes by 11 percent.”

This heinous enterprise even led to the death of Harris County Sheriff’s Deputy Darren Almendarez last March.

“This is an appalling public safety issue that we have to get under control, criminals are willing to kill over these converters,” said Senator Bettencourt. “Houston Police Department Chief Finner and his officers are on the front lines trying to stomp out these crime rings. Senate Bill 465 will help

them by putting the obvious into law, only folks who work in areas that handle catalytic converters in their day-to-day operations should be in possession of a catalytic converter.”

SB 465 will help law enforcement and prosecutors across Texas charge and convict criminals targeting catalytic converters. Under SB 465, if a person is in possession of a catalytic converter that’s been removed from a vehicle, they then have committed a crime, unless they are on an approved list of businesses that can legally possess a catalytic converter that’s been removed from a

vehicle. The list of approved businesses includes employees of wrecking and salvage yards, metal recycling entities, garage automotive shops, or other entities who possess converters through the course of everyday business.

However, if a person associated with the previously mentioned businesses knows that the catalytic converter was acquired illegally, they are not protected under this statute and will be charged and prosecuted.

Furthermore, SB 465 will add organized crime statutes that automatically increases

the offense one category higher than the most serious offense listed if the convicted person is linked to organized crime.

“During the interim, I sat on Chairman John Whitmire’s Senate Committee on Criminal Justice and heard stories from Texans leaving work, parades, the grocery store, and finding their catalytic converters missing and the culprits long gone.

If passed, Senate Bill 465 will help law enforcement crack down on these catalytic converter crime rings,” concluded Senator Bettencourt.

The 60-day deadline for filing bills is March 10, 2023.

Senator Paul Bettencourt (R-Houston) filed Senate Bill 465 in response to the 5,300 percent jump in catalytic converter theft insurance claims in Texas since 2019. The spike is fueled by organized criminal rings who target catalytic converters for the precious metals inside them (palladium and rhodium) that are worth more per ounce than gold.
Houston Police Chief Troy Finner put out a statement highlighting the double-digit increase in auto thefts in Houston, “The city experienced an increase in property crimes in 2022. Thefts of catalytic con-

Senate reopens redistricting hearings

In order to ensure they are following the very letter of the state constitution, the chair of the Senate Redistricting Committee announced Wednesday that the panel is re-opening the process for the drawing of state Senate districts.

Senator Joan Huffman of Houston chaired that committee last session when state House, Senate, school board, and US Congressional districts were redrawn as they are every 10 years following the national census.

Due to the COVID pandemic, however, the US census results were delayed into 2021. This pushed back the state redistricting process by some months, but the Legislature was able to pass redrawn district maps in the third called session, which fell in October of ‘21. All Texas state lawmakers and congressional members were elected in 2022 based on these maps.

The issue arises for state districts because Article III, Section 28 of the

constitution reads “The Legislature shall, at its first regular session after the publication of each United States decennial census, apportion the state into senatorial and representative districts.”

Because the final maps were approved during a special session in the fall and not the 140-day regular session beginning in January, there is some concern that it might raise legal issues.

“I am proposing that the 88th Legislature take up the Senate map again…out of an abundance of caution, to ensure that the Legislature has fulfilled its duty to apportion the state into senatorial districts at its first regular session after the publication of the 24th decennial census of the United States.”

Reappointed chair of the committee by the Lt. Governor, Huffman said that the panel will begin to take public testimony, both in person and virtually, in a series of regional meetings beginning on Wednesday, January 25 and running through Saturday, January 28. “This will ensure that every Texan can participate in the regional hearings, and we can

have conversations with people from all parts of the state,” she said.

Also Wednesday, Senators drew lots for term length, to reset the staggering of district terms. Unlike the House, whose members must stand for election every two years, Senators serve four year terms. To avoid situations where the entire body is up for election, the Texas Senate, like the US Senate, staggers terms so that only half of the chamber’s seats are up for election in any given cycle.

The exception to this rule is the election immediately following a redistricting year, as was the case in 2022. With all 31 members elected or re-elected last November, the entire body could be back on the campaign trail for the 2026 cycle. In order to re-establish the two-cycle balance, senators took turns drawing lots: in this case, 31 sequentially-numbered sheets of paper drawn out of a bowl.

year term. Because of the effort and cost involved with a campaign for office, it’s a fairly high-stakes proposition that members nevertheless greet with a genial good humor.

The 2023 Texas legislative session opened Jan. 10, with property taxes, gun control and the power grid expected to be among the top issues on the agenda.

The Texas Standard talked to political journalists Niki Griswold of the Austin American-Statesman and James Barragàn of the Texas Tribune to see what might be upcoming.

Griswold predicts the “so-called culture war issue” could take center stage, with a number of bills already filed regarding the rights of transgender children and their parents, as well as battles over what books should be made available to children in the classroom and libraries.

Barragan said the state’s predicted $27 billion surplus will attract a number of factions wanting a piece of that action. Gov. Greg Abbott has called for about half the surplus to be spent on property tax relief, while House Speaker Dade Phelan is pushing for more spending on infrastructure.

Griswold pointed out that Lt. Gov. Dan Patrick wields considerable power in the Legislature and is keenly interested in more fixes to the state’s electric grid.

The regular session will last 140 days, as set by the state constitution.

Ag agency: Climate change threatens food supply

A new report released last week by the Texas Department of Agriculture concluded climate change is a potential threat to the state’s food supply and could produce food insecurity. The report comes after a historic drought decimated crops and forced ranchers to sell the highest number of livestock in more than a decade.

The Texas Tribune reported the food access study, published by TDA and the University of Texas Rio Grande Valley, noted that “climate instability is strongly associated with water quality, soil degradation, droughts, fires, floods and other environmental disasters.”

The report was submitted to the Legislature on Dec. 31 and points to other factors that make it harder for Texans to access and afford food, such as wages not keeping up with inflation and lack of access to food in rural areas.

“The important takeaway here is that there are significant gaps that need to be addressed between what researchers calculate to be a living wage in Texas, the

wages that Texans are actually receiving, and many of the poverty thresholds that determine eligibility for assistance programs,” the report says.

Abbott calls for action on ankle monitor violations

Abbott last week sent a letter to legislative leaders calling for legislation to create criminal penalties for parolees who cut off their ankle monitors.

That action comes in the wake of an October incident in which parolee Nestor Hernandez was charged with pulling a handgun and killing two hospital employees while visiting his girlfriend and their newborn child at Methodist Hospital in Dallas. He was shot by a Methodist Hospital police officer but survived and is now being held without bond on capital murder charges.

A few weeks later, another parolee, Zeric Jackson, was accused of fatally shooting a man at his former girlfriend’s Dallas apartment.

“It is clear that the ankle monitors, a condition of their parole, were not effective in deterring or otherwise preventing these individuals from going on to commit violent crimes, resulting in three innocent lives being lost,” Abbott wrote.

Currently, there are no criminal penalties for a parolee cutting off an ankle monitor.

Beware of online phone scams

The Texas Department of Insurance is urging Texans, especially older adults, to beware of both phone and online scams. In 2021, more than 6,700 Texans over age 60 reported losing more than $159 million to fraudsters, TDI reports.

Some common scams:

A caller offers to fix a non-existent computer problem or to renew a software or security subscription that does not actually exist.

A caller purports to be a grandchild calling from another country and needing hundreds of dollars quickly.

A call or email that says you have won a sweepstakes or lottery but requires you to pay thousands of dollars in bogus fees in order to claim the larger prize.

Someone adopts a fake identity to gain affection and confidence, in hopes of eventually building a relationship that enable the scammer to steal money.

Emergency SNAP benefits again extended

The U.S. Department of Agriculture has again provided the state with more than $344.1 million in emergency Supplemental Nutrition Assistance Program food benefits for the month of January, benefitting about 1.6 million Texas households

The funds are distributed by the Texas Health and Human Services Commission. Each SNAP household will receive at least $95 in emergency allotments in addition to its regular allotment.

Since April 2020, the federal government has provided more than $9.3 billion in benefits to Texans through SNAP.

The number of new COVID-19 cases in the past week in Texas rose to 39,019, with 131 deaths reported by the Coronavirus Resource Center at Johns Hopkins University. HUNTING THE HUNTERS

With the close of whitetail muzzleloader season this past weekend, deer season is officially closed with the exception of some ranches managed by Texas Parks and Wildlife where deer can be hunted through February. It’s now time to do some predator control and reduce the number of coyotes and bobcats. For many years, I thought that only coyotes took a heavy toll of newborn fawns in Texas but I know for a fact that full grown bobcats also kill fawns and occasionally grown deer as well.

I remember hunting down near Menard with an outfitter several years ago when I heard a very vocal struggle back in the woods near hunting stand that was unoccupied. Brush was breaking and I could occasionally hear a distinctively ‘cat’ sound. I was positive a mountain lion was attempting to take down a deer. After the evening hunt, we found a button buck that had been killed by a bobcat. Tracks were everywhere and the claw marks on the small buck clearly fit those made by a bobcat. It appeared the cat had attacked head on, the damage was to the neck and throat area. I keep trail cameras going year around close to my home and keep close check on activity around several corn feeders. I watched a mature doe several years that had distinctive markings on her throat. She was a regular at all the feeders and because of the white markings, very easy to identify. One day she showed up with fresh claw marks and what appeared to be puncture marks on her throat and shoulders. She had obviously been in a serious battle for her life against a bobcat. I love seeing bobcats in the woods and my biologist buddies say that for every one I spot there are sure to be several more on a given tract of land that I’ll never see. I don’t get

a lot of opportunities to take bobcats while hunting deer or hogs, maybe a couple of opportunities a year but if given the opportunity I plan to help thin their numbers this year.

Because of their habit of hunting as a pack, coyotes can be lethal on a deer herd. I live on a few acres with other homes in fairly close proximity. A half-mile from my house is thousands of acres of wetland and a 50,000 acre ranch. Because most hunting close to home is for waterfowl, deer and wild hogs, predator numbers have been allowed to get out of control. Pets are occasionally attacked. A couple years ago, my wife’s pet goat was killed by coyotes about this time of year only 40 yards from our back door. It’s common to hear coyotes howling and occasionally spot them in the yard. Many hunters don’t wish to ruin a deer or wild hog hunt by shooting predators.

Because of the many wild hogs in the area, it’s not uncommon to

witnessed coyotes killing young pigs, I’ve witnessed this twice in the past couple years, usually around a corn feeder. A pack of three or four coyotes will surround a sow with pigs and when her back is turned, one will run in and grab a pig. I believe this steady diet of wild pork is one reason for the boon in coyote numbers not only where I live but across much of the state. There can only be one dominant canine predator in an area. Up north where wolves are prevalent, coyote numbers are few. Where coyote numbers are strong, there are few foxes. Out in west Texas in sheep and goat country, coyotes have been trapped and hunted relentlessly for decades. You can’t raise sheep and goats in areas with coyotes. But, grey fox numbers are strong and they have become the dominate canine.

The bottom line is that man has disrupted nature and the balance between predator/prey. It’s

our job to keep these animals in check and as a hunter that equates to some late winter fun. Watching a coyote come bounding in to a call really gets the adrenaline pumping. I’ve had them almost run over me a few times in their efforts to ‘catch’ that rabbit or bird they were listening to! I once did a magazine article with one of the top coyote hunters in North Dakota and watched him bring in a coyote from a good quarter mile away with his super loud electronic caller. The critter never slowed his pace and came within mere feet of us. I use an electronic predator caller that works off a cell phone App and Bluetooth. It’s called The Bullet by Convergent Hunting Solutions. I set it out in front of where I’m hunting and remotely control the different sounds and volume. I’ve used it effectively on not only coyotes and bobcats but wild hogs as well when using the different ‘hog’ sounds. This type call is very effective because of

its range and sound realism but mouth blown calls are also very effective. This past summer, I watched my friend Larry Weishuhn aka. “Mr. Whitetail” use a mouth blown call to bring a coyote out of some very heavy cover but it was the squeaking sound he made by sucking on his fist that brought the song dog out into the open where our friend Kenneth Shepherd could make the shot.

When it comes to rifle choices, it’s hard to beat a .22/250 or .223 for coyotes but your favorite deer rifle will suffice. I have a couple of predator hunting articles assigned this winter where I will be using a big bore air rifle and another for a crossbow hunt. I’ll probably do my calling from a tree stand when hunting with the crossbow. Ole’ Wile E. Coyote is a bit too sharp to fool at close range from ground level!
