What are the advantages of buying at auction?
There are many advantages, two of these are:
• If more than one person is interested in a particular property, an auction demonstrates free and fair competition enabling the purchaser to buy the property at a price that is competitively achieved against other known bidders.
• If you are the successful bidder you know that the vendor cannot withdraw and the property is yours on completion, which usually takes place 28 days after the auction.
What does the catalogue tell me?
The catalogue gives you the description of the property, details on how to view each property and the Common Auction Conditions. It is important you read these. These are prepared by the Auctioneer, stating the basis on which the auction is carried out.
Should I inspect the property?
YES. It is essential that you view and know as much as you can about the property prior to auction. Local searches and copies of further legal documentation can be obtained by the Auctioneer or direct from the Solicitors named in the brochure. To view outside of the specified times contact the Auctioneers office.
Do I need a Building Society survey?
A valuation carried out by the building society is only required should you need a mortgage. Again, this and any other financial advice or arrangements must be organised well in advance of the auction day.
Should I have a survey carried out?/Can I buy with a mortgage?
Anyone who is unsure or has doubts about a property is recommended to have a survey carried out. The Auctioneers will be pleased to recommend a firm of Surveyors/Valuers to you. Surveys should be arranged well in advance of the auction day.
Is there a guide/reserve price and what is the difference?
A guide price gives you an indication of the price the property is expected to sell for and what the vendor will accept. A reserve price is the lowest price the vendor will accept. This is agreed between the vendor and the Auctioneers. Most properties entered into the auction have a reserve price. This is confidential and not discussed to any parties, unless occasionally a “declared reserve” is advertised.
What do I have to pay on the day?
It is important that you have all finances ready for the day of the auction. Should you be the successful bidder a 10% deposit will be required on the day. This may be paid by Building Society cheque, Debit card, personal cheque or bankers draft. The balance plus any agreed disbursements will be due on completion, normally 28 days from the auction date. The deposit cheque should be made payable to Boultons Limited, as the Agent for the Seller. The deposit will be used to satisfy the Auctioneer’s commission with the balance paid over to the vendor’s solicitor upon completion. Successful bidders will also have to pay the Auctioneers Administration Charge, currently £900 including VAT, prior to signing the Contract. Cheques may be presented for Special Clearance the day following the Auction.
In the event of the Auctioneers’ Administration Charge not being paid at the auction then the Auctioneer is authorised to take this administration charge from the deposit paid. The balance then to be paid on completion will therefore be increased appropriately.
Do I need a solicitor to be in attendance?
No, but it is wise to notify your solicitor of the auction and show them the auction brochure along with any other information about the property you are interested in. Your solicitor may obtain the legal documentation on your behalf. All the necessary legal documentation may be inspected from 7 days prior to the auction. Documents may be available by email.
What do I need to bring with me on the auction day?
Firstly, remember to call the Auctioneers office on the DAY of the auction to see if the property you wish to bid on has not been withdrawn or sold prior. Have details of your solicitors name, address and telephone number, your 10% deposit and administration fee and two forms of ID.
How do I bid?
Make sure you signal your bid clearly. Do not stand in a crowded corner. The Auctioneer will acknowledge your bid. Bidding early for your particular Lot will make the Auctioneer aware that you are interested in the property. Do not leave it too late or you could miss out!
What if I am a successful bidder?
When the hammer falls, if you have made the highest bid, you are the successful bidder, subject to any reserve price having been reached or exceeded. You are now bound by Contract to buy the property. The Auctioneer’s assistant will ask you for your details. A member of staff will take you over to the solicitors desk to sign an Agreement/ Memorandum of Sale, You will be asked to pay 10% of the purchase price and the Auctioneer’s administration charge of £900 including VAT. The Auctioneer is legally authorised to sign two Contracts on behalf of the buyer and seller if required.
Do I have to insure the property?
Yes. You must make sure that you are covered from the date of auction.
What happens if the property does not sell? Please register your interest with a member of staff. Properties that are withdrawn because they did not reach the reserve price often sell immediately after the auction.
What happens if I cannot attend the auction? You may be able to bid by proxy or telephone. Further details are available from the Auctioneers Offices with information also available to the rear of this catalogue. NOTE, ARRANGEMENTS NEED TO BE MADE AT LEAST 3 WORKING DAYS PRIOR TO THE AUCTION.

The public are advised to time their arrival at the venue at least half an hour before the auction to secure appropriate car parking at the stadium and access to the auction room.
The auction will commence promptly at 7.00pm and will be conducted in Lot order.
The Auctioneers will not be able to answer questions from the rostrum once the auction has commenced. All queries to be addressed to the appropriate Auctioneer’s office before 4.00pm on the auction day and between 6.00pm – 7.00pm at the auction venue.
A copy of the contract and supporting legal pack will be available for inspection, from the appropriate office, 7 days prior to the auction for each Lot. Copies may be available for collection, post or fax at a cost of £40 inclusive of VAT (payable in advance). Where available documents may be emailed at no charge (with the exception of documents larger than A4 size).
Bidders are required to register with the Auctioneers upon arrival; a numbered “Bidding Card” will then be issued. Bidders are obliged to show this clearly to the Auctioneer and appropriate staff upon request. Registration facilities will be available from 6.00pm on the day of the auction.
Completion will take place 28 days from the auction date, unless alternative arrangements have been made with the Auctioneers prior to the auction.
Keys for vacant properties will not be released prior to the auction or until completion has taken place.
Please remember; this is a property auction, the purchaser will be the highest bidder, subject to any reserve price set by the vendor. The fall of the hammer represents exchange of contract. The successful purchaser will be approached by a member of the Auctioneer’s staff to supply; name, address and details of their solicitor or legal representative. The successful purchaser will be required to pay a 10% deposit of the realised bid price and sign
the contract prior to leaving the venue. Cash deposits will not be accepted. Cheques should be made payable to Boultons Harrisons Ltd, the Auctioneers as Agents. Deposit cheques once cleared will be used to satisfy our invoice for selling the property. If you intend to pay the deposit by debit card please notify your Bank prior to avoid any transaction failure.
Most Lots are subject to “block viewings”. Additional accompanied viewings may be arranged upon request.
Purchasers are advised to insure the property at the earliest opportunity following exchange of contracts. Vendors are also advised to retain the buildings insurance, until completion has taken place.
Illustrated catalogues should also be available at the auction. An addendum may have been prepared itemising any additional information which may have come to the Auctioneer’s attention after the catalogue has been printed.
It is against the law to smoke in public buildings. Mobile phones should also be turned off or set on silent during the auction.
Successful bidders will be required to pay an Auctioneer’s Administration Charge of £900 inclusive of vat for each Lot purchased at the fall of the hammer on exchange of Contracts – cheques payable to Boultons Harrisons Ltd.

*GUIDE PRICE The guide price is an indication of the seller’s current minimum acceptable price at auction. The guide price or range of guide prices is given to assist potential buyers in deciding whether or not to pursue a purchase. It is usual, but not always the case that a provisional reserve range is agreed between the seller and the auctioneer at the start of marketing. As the reserve is not fixed at this stage and can be adjusted by the seller at any time up to the day of the auction in light of interest shown during the marketing period, a guide price is issued. This guide price can be shown in the form of a minimum and maximum price range within which an acceptable sale price (reserve) would fall, or as a single price figure within 10% of which the minimum acceptable price (reserve) would fall. A guide price is different to a reserve price. Both the guide price and the reserve price can be subject to change up to and including the day of the auction.
RESERVE PRICE Unless otherwise stated, all property is sold subject to a reserve price whether declared or not. The reserve is the seller’s minimum acceptable price at auction and the figure below which the auctioneer cannot sell. The reserve price is not disclosed and remains confidential between the seller and the auctioneer. Both the guide price and the reserve price can be subject to change up to and including the day of the auction.
Successful bidders are required to provide Boultons Harrisons Limited with proof of identity and proof of current residential address by producing the following documents at the auction:
A photographic ID, such as a current passport or new style UK driving licence AND
A utility bill, bank or building society statement, or credit card bill issued within the previous three months, providing evidence of residency at the correspondence address

If the bidder is acting on behalf of a limited company, the bidder will be required to provide personal proof of name and address, and in addition:

A prospective purchaser wishing to make a telephone or proxy bid (a “Bidder”) must complete, sign and date the form included in this catalogue. A separate form must be completed for each Lot on which a bid is to be placed.
The Form must be delivered to the Auctioneers’ Huddersfield Office at least 72 hours (3 days) before the start of the Auction together with the appropriate payment as mentioned below.
Each form must be accompanied by an Auctioneers Administration Charge cheque for £900.00 including VAT (payable to Boultons Harrisons Ltd) together with a deposit payment of either:
a. 10% of the Bidder’s maximum bid in the case of a bid by proxy, or

Cheques will only be accepted if given to the auctioneers in sufficient time for them to clear through the banking system prior to the Auction to include special Clearance Fee of £50.00.
The deposit cheque must be made payable to “Boultons Harrisons Ltd” as Agents for the Seller. The deposit will be used by the Auctioneers to satisfy their commission due upon the fall of the hammer. The balance will be paid over to the seller’s solicitor upon completion.
In the case of a proxy bid the Bidder hereby authorises the Auctioneers and their staff to bid on his behalf as his agent up to the maximum amount of the authorised proxy bid. If successful the Bidder will be notified as soon as possible. If the Bidder is successful at a figure which is less than the maximum of the authorised proxy bid the whole of the Bidder’s deposit will be used as a deposit towards the purchase price. If the Bidder is unsuccessful the full amount of the Bidder’s deposit will be refunded to the Bidder promptly after the Auction (without interest).
In the case of a telephone bid a member of the Auctioneer’s staff will attempt to contact the Bidder by telephone before the Lot in question is offered for sale. If contact is made the Bidder may compete in the Bidding through the Auctioneers’ staff. However if telephone contact cannot be made or the link breaks down the Bidder hereby authorises the Auctioneers and their staff to bid on his behalf up to mid point of the guide price for the Lot in question. If the Bidder is successful at a price which is higher than the Auctioneers’ guide price the Bidder must within 24 hours of the Auction provide the Auctioneers with the additional funds to make the amount of his deposit equal to 10% of the Purchase Price. If the Bidder is successful at a price which is less than the guide price the whole of the Bidder’s deposit will be used as a deposit towards the purchase price. If the Bidder is unsuccessful the full amount of the Bidder’s deposit will be returned to the Bidder promptly after the Auction (without interest).
If the Bidder is successful the Bidder hereby authorises the Auctioneers to sign the Memorandum of Sale on his behalf.
If the Bidder wishes to withdraw or alter his instructions or to attend the auction to bid personally it is his Responsibility to notify the Auctioneers in writing before the Auction and also to notify the Auctioneer in charge of the Auction before the Lot in question is offered for sale.
The Auctioneers will not be liable for any failure to bid due to inadequate or unclear instructions being received or for any other reason. The Auctioneers have absolute discretion as to whether or not and in what manner to bid.
The Bidder is deemed to have full knowledge of the Common Auction Conditions the General and Special Conditions of Sale and the Notice to all Prospective Buyers herein. The Bidder is also deemed to have full knowledge of any addendum produced by the Auctioneers at or prior to the Auction; the Bidder is therefore advised to check whether any relevant addendum has or will be produced, but the Auctioneers will not be liable to the Bidder if he fails to so check.

What you need to know – Notice to Prospective Purchasers
Buying at auction is a simpler process than you may think, but you need to be well prepared for auction day. It Is important to appreciate if you bid at auction, and your bid is successful you will have entered into a binding Contract to purchase the Lot you are bidding for. When you have decided which property interests you, we suggest the following course of action.
Arrangements can be made through Boultons Limited, or as detailed in the catalogue.
Each Lot is sold subject to the Conditions of Sale. Different conditions may apply to each Lot. In particular, your attention is drawn to the Common Auction Conditions printed in the catalogue and to the Special Conditions that apply to each Lot. You should seek legal advice on the meaning of the Conditions of Sale.
Pass a copy of this catalogue to your conveyancer so he/she can then begin to make the necessary legal enquiries. Give plenty of time as you will be expected to enter into a legally binding Contract if your bid is successful at the auction.
Since you will enter into a binding Contract at the fall of the hammer and pay a substantial deposit, it is essential that all financial arrangements are made well in advance. This is particularly important if you need to arrange mortgage finance. If this is the case it must be sorted out well before auction day. You will normally be expected to complete the purchase and pay the balance of the purchase price 28 days after that auction date or earlier by mutual arrangement.
If you bid for a property, it is assumed that you have made all the necessary enquires beforehand. After the fall of the hammer it is too late for second thoughts. Arrange any surveys and/or finance well in advance. We will be pleased to co-operate where possible.
Once a property has been sold and Contracts exchanged, it will become your responsibility for insurance cover. Make sure you have taken out cover for the period between the auction and the legal completion date. This is usually 28 days. Your conveyancer will advise on the course of action.
An addendum may be available at the auction venue. The addendum may include information which has come to light following preparations of the printed catalogue. The addendum, although in loose format, forms part of the printed catalogue. Bidders are deemed to have read and understood any information contained in the addendum whether they have read the information or not.
PLEASE CHECK WITH US BEFORE THE SALE THAT THE LOT YOU ARE INTERESTED IN PURCHASING IS STILL AVAILABLE. SOME OF THE PROPERTIES IN THE AUCTION HAVE BEEN FOR SALE BY PRIVATE TREATY AND COULD BE SOLD BEFORE THE AUCTION DATE.
It is best to allow plenty of time before bidding on your particular Lot begins. If possible, meet the Auctioneer and let him know which particular Lot you are interested in. This will enable him/her to recognise you when bidding starts.
It is possible that there may be some last minute alterations and these will normally be printed on an addendum and available prior to the commencement of the auction
Be positive. Signal your bidding by definite movements, for instance the raising of your hand, catalogue or numbered bidding card. Contrary to popular belief “secret bidding and vague twitching of the eyebrow” have no place in a real auction.
If you have any doubts about bidding then speak to your solicitor who may arrange to do this for you, When the Auctioneer announces “Going for the first time, going for the second time, going for the third and last time – sold. This is the final stage of the sale process and you must not leave it too late if you want to bid, The Auctioneer will not necessarily use those words so do not rely upon waiting for that phrase.
If you are successful with your bid, one of our staff will approach you with a simple form to fill in, called a Memorandum of Sale. You will be asked to provide a deposit of 10% of the purchase price (subject to a minimum £3,000). The deposit can be a bankers draft, cheque or debit card. Two forms of identification must be produced for any deposits paid by cheque (MLA 2018) and purchases should note that cheques may be presented for special clearance on the day following the auction. You will also be asked to provide details of the solicitor who will be acting for you. Our staff will arrange the memorandum of Sale to be completed and you will then be asked to go to the Contracts desk to sigh the Memorandum of Sale papers. Completion of the sale will normally take place 28 days later.
You will not be entitled to receive the keys to the property until completion has taken place under any circumstances. Post Auction viewings will be made by appointment through Boultons Limited.
If the property you are interested in is withdrawn at the sale because it failed to reach its reserve price, please ask to speak to one of the staff, who will register your interest.
NOTE: None of the services or fittings and equipment have been tested, including any central heating systems and no warranties of any kind can be given – accordingly prospective purchases should bear this in mind when formulating their bid.
