CONTRACTOR: Any person, firm or corporation who pursues the occupation or business of general building construction and who contracts to render services and supplies for others in the erection and construction of buildings (ECCR Section 201 01/23/99).

SUBCONTRACTOR: Any person, firm or corporation who is not engaged in the general construction business but who normally subcontracts for specific work to a general contractor for the specific mechanical discipline to a building, including but not limited to electrical, plumbing, heating, etc. (ECCR Section 201 01/29/99).

CONTRACTOR RULES Below is a summary of various policies adopted by the Association of Property Owners of the Hideout, Inc. (The Hideout), for contractors working within the Community. For a complete listing of all Rules & Regulations governing the construction of, or improvements to, properties within the Hideout, contact the Hideout Environmental Department at (570) 698-4100 x108 or x166, located in the POA Administration Building.

1. For short-term contracting, a one day or one-week pass must be obtained and displayed on the dashboard or rearview mirror of the vehicle being used by the Contractor. The pass will allow Contractor(s) to enter and exit the Community during established Contractor hours for the term of the pass. The pass may be obtained at either the Main Entrance (off of SR590) or North Gate Entrance (off of Avoy Rd). Contractors may not enter the community via the Stock Farm Rd entrance.

2. Annual Stickers permitting travel within the Community during established Contractor hours, will be provided for a $30.00 fee per business vehicle belonging to a Contractor following the presentation of proper Insurance (see Item #5), a PA Contractor Registration (HIC Number) Card, and valid vehicle Registration. These “Stickers” must be renewed each subsequent year for a fee. Contractor “Stickers” and “Passes” may be revoked at the discretion of the ECC. 3. A Gate Access Card (GAC) may be purchased by a Contractor in exchange for a fee. The GAC will be registered for one specific vehicle and remain valid for the life of that vehicle, (provided annual contractor fees are paid). Please note: A GAC does not function as a form of vehicle identification. All vehicles with a GAC must also have proper vehicle identification as listed above. The GAC permits the holder entrance into the Community without having to wait for Public Safety personnel to manually open the gate during Contractor hours.

4. Restrictions for vehicles of more than 10 tons gross weight during the spring thaw conditions shall be imposed on a weekby-week basis by Hideout Management. Signs will be 6 | Page

conspicuously posted at all entrances advising when and where the restrictions are applicable.

5. ALL Contractors working within the Hideout are required to maintain valid Insurance as listed below:  Workmen’s Compensation Insurance as required by law.  Contractors Certificate of Insurance, with the POA listed as the certificate holder, in the amounts of $1,000,000 General Liability, $500,000 Personal Injury, and $500,000 Property Damage.  Automobile Liability and Property Insurance of not less than $300,000 to any one person, $500,000 to any one person in any one accident, and property damage of $100,000.  ALL Subcontractors, if any, shall carry the same insurance protection as above set forth for contractors. The contractor, and all subcontractors, if any, shall protect, indemnify, and save harmless the POA and its employees from any losses, costs, damages, or expenses.

6. In addition to Contractors submitting their Certificate of Insurance, all Contractors must submit a copy of their State Registration with the Attorney General’s Office noting their PA HIC number.

7. Any contractor related equipment with or without signage, actively being used to perform work with a valid Hideout Building Permit, may be left on site during the normal work week (Monday 7AM-Friday 5PM). The equipment should be stored as far back in the driveway as possible. All equipment MUST be removed for all Hideout recognized Holidays and weekends. All construction debris MUST be picked up and removed daily, nuisance debris classification will be at the ECC’s discretion. Work must be performed in a continuous manner every day that the trailer is on the lot. Equipment cannot be left on the lot if the contractor is working somewhere else. If project work is suspended on the lot during the week, the equipment 7 | Page

must be removed immediately. Non-compliance will result in a fine, and additional penalties for repeat offenses will be imposed up to and including the loss of Hideout privileges. (Board of Directors motion 16-51) 8. ALL Contractors are reminded that Hideout Public Safety personnel enforces the PA Vehicle Code with regard to the operation of vehicles on Hideout roadways. Contractors must obey all posted speed limits.

9. Hideout Building Permits, in addition to any local Township permits, are almost always required for any exterior alteration, whether or not said alteration involve structural modifications or fees. Always consult with the Hideout Environmental Department prior to performing lot improvement work.

1 110. The Hideout Trash and Recycling Center is available for MEMBERS ONLY to dispose of household trash.

Contractors are not permitted to use this facility to dispose of non-member trash.

The bulk garbage facility at the Maintenance Complex will NOT accept construction related material (it is not considered to be bulk trash). Members and/or contractors performing interior or exterior improvements, will be instructed to take all construction materials to the local landfill.

11. Improvement Contractors are prohibited from working in The Hideout on the following Holidays: New Year’s Day, Martin Luther King Jr’s Birthday, President’s Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day, and Christmas Day. Contactor Hours are:

RULES REGARDING IMPROVEMENTS 1. BUILDING PERMITS are REQUIRED in The Hideout for almost all exterior lot improvement.

2. Any exterior lot improvement performed without first securing the proper Permit will result in the Lot Owner being assessed a non-refundable Fine of $250. A non-refundable Fine of $500 will be assessed for a second violation.

3. No Building Permit will be issued if the Member is not current on Dues and Assessments on ALL properties owned.

(Amended May 18, 2003).

4. All Permits issued by the Hideout (ECC) shall be a revocable license. Upon Member’s failure to remain in good standing, all Permits shall be revoked. The Environmental Manager shall be authorized to extend the Permit in such instances where revoking said Permit shall constitute an imminent danger to the Membership or to repair damage to the property. (Amended April 9, 2005).

5. Every improvement, once begun, shall be completed within six (6) months, with the exception of new single-family dwellings.

New single-family dwellings are to be completed within (1) year.

6. All improvements must conform to the Building Codes adopted by the Commonwealth of PA, local Townships, and any other regulatory agencies, the ECC Rules & Regulations, and the Declaration of Protective Covenants of The Hideout (Please visit Hideout website for full details).

7. Lot Owners, Homeowners, and Contractors are required to replace trees as recommended by the ECC / Environmental Manager, that are removed prior to or during construction of a new home or structure due to special circumstances and/or hardship designation. This tree replacement should be completed within six (6) months of the issuance of a Certificate of Occupancy or project completion. (Amended Sept 16, 2006) (See Hideout website for complete policy on Tree removal and Replacement, with mandatory PERMIT prior to removing trees).

8. The use of Protective Barriers for the containment of soil and debris during any construction activity taking place on a Member owned property is the Property Owner’s responsibility whether the work is being performed by themselves, a guest, and their renter or a hired Contractor. This rule also applies to any work activities being performed on our common areas, roads, or amenity whether performed by our (Public Works or RS&W) personnel, or outside Contractors. (Amended April 19, 2008).

9. Each lot, whether occupied or unoccupied, and all improvements shall at all times be maintained in good and clean condition. Management shall take necessary corrective action and bill Property Owner if they fail to comply with this regulation.

10. All Contractors are reminded that they are also bound by The Declaration of Protective Covenants of the Hideout, the ByLaws, the Consolidated Rules & Regulations, the Building Code, the Environmental Control Committee Manual Section 3, and the violation of said documents may result in fines and/or revocation of their working privileges within the Community.

11. Please submit all permit applications requiring ECC Review and approval to the Environmental Department no later than noon time on the Thursday before the scheduled meeting.

OVERVIEW OF CONSTRUCTION RULES Contractor Hours: Contractors will be limited in any operations relative to construction or repairs as follows: Monday through Friday, between the hours of 7:00 AM and 5:00 PM, Saturday, 9:00 AM to 5:00 PM. Except in an emergency and with prior permission of the ECC, no contractor work may occur on Sundays.

Procedural Requirements: All owners are requested to engage a general contractor of proven ability, competence, and financial responsibility to ensure completion of the work under the contract.

Permit Issuance: All persons desiring to undertake any new construction, structural alteration or changes in the use of a building or lot, shall apply to the ECC for a Permit by filling out the appropriate forms, signatures by both Lot Owner and Contractor, and submit the required fee, if any. Except where permits are not required in the Rules, it shall be a violation of the Rules or the Declaration for any person, firm, or corporation to proceed with the erection, alteration, enlargement, demolition, or movement of a building, structure, or other improvements unless an appropriate application for a permit shall have been made and a permit granted. In cases where permits are required for any of the aforementioned construction, be either Township, County, State or other agencies in jurisdiction, those permits shall also be obtained and copies provided when the application for a permit within the Hideout is made. (ECCR Section 115 3/17/91).

No building Permit will be issued if member is not current on dues and assessments on all properties owned. (BDR 5/18/03) All Permits issued by the Hideout POA shall be a revocable license. All necessary permits, including municipal, sewer connection and otherwise, shall first be obtained and presented with the application and appropriate filing fees to the Hideout POA for ECC’s approval for a Building Permit (ECCR Section 113 3/22/88) Once a Permit is obtained and the applicant desires to alter or deviate from the terms of the application, plans or specifications submitted at the time of securing the Permit, the applicant shall notify the ECC of said changes or modified plans and specifications and file such modified plans and 11 | Page

specifications with the ECC and obtain written approval thereof before the changes or modifications are implemented.

Power of Disapproval: The Committee may disapprove any application if in the judgment of the Committee reasonably exercised; the proposed improvement will be inharmonious with the Development, or the improvements erected on other Lots.

Survey: ALL new home construction will require three (3) Survey stages to be performed by a licensed Surveyor: (1) Plot Plan showing proposed site and improvement(s), (2) Survey when footers are poured and/or piers are in place to verify location compliant to set-back rules, (3) “As-Built” survey for final approval, (a) Survey shall include altitude/elevations at all property corner markers, and (b) altitude/elevation of all corners of the proposed residence, (c) these elevations are required for ALL new construction activity. ***A current As-Built survey, indicating property lines, setbacks, and final locations of all permanent structures, is required for ECC permitting review/issuance as well as for residential resale inspections to occur. (BOD Motion 19-79) Environmental Beauty: No three adjacent dwellings are to be exactly alike in front elevation. No two adjacent dwellings are to have the same setback from the road.

Set Backs: Except as shown on the Plat, every dwelling shall be at Least: a. 50 feet from the nearest lake b. 25 feet from the front Lot line

c. 10 feet from each side Lot line d. 25 feet from the rear Lot line

Wetlands: The Association REQUIRES that the property owner, or their builders, arrange, prior to any new home construction, excavation, filling, or improvement activity, to have an accredited expert perform a soil survey to determine if, and delineate where, wetlands exist on the property to be improved/disturbed.

Plans: An Application for a Permit shall be submitted to the ECC on a form supplied by them and shall be accompanied by two (2) sets of plans and full 12 | Page

specifications setting forth the extent and character of the work. (ECCR Section 116 3/17/91). The plans and specifications shall have attached: a plot plan drawn to scale showing the size and location of the lot, the proposed building, decks, stairs, chimneys and other exterior structural members in their proposed location and their exact relation to the lot and street lines. The survey plot shall be prepared and certified by and under the seal of a licensed land surveyor of the Commonwealth of Pennsylvania.

Upon the approval of the plans and specifications, one approved set of plans shall be accessible at all times at the construction site for Township Code Inspections or ECC usage. No change shall be made in the approved plans or specifications without the approval of the ECC. No preliminary rough sketches, incomplete or photo copies of stock sketches will be accepted.

(ECCR Section 116 3/17/91).

Any changes or modifications by the contractor shall be approved by the ECC as a matter of record without revision to said drawings (ECCR Section 118 5/1/94).

Residential Lots: No improvement except a Single-Family Dwelling and such outbuildings as are usually accessory thereto shall be constructed, placed or permitted to remain on any Residential Lot. Minimum Area: Each single-family dwelling constructed shall have a fully enclosed first floor area (exclusive of roofed or unroofed porches, terraces, garages, carports or other outbuildings) of not less than 750 square feet, and 550 square feet for the first floor living space if building a two-story dwelling.

Do not include unfinished basements in this calculation.

Single-Family Dwelling: A residential dwelling for one or more persons.

Single-Story Construction: Each dwelling shall be single-story, unless splitlevel or two-story construction is approved by the Committee.

Exterior Finishes: Are to compliment the immediate areas. Natural earthtone color finishes are required. Samples must be submitted.

Completion of Construction: Every improvement shall be completed within six (6) months, with the exception of new single-family dwellings. New single-family dwellings are to be completed within (1) year. An extension 13 | Page

may be granted by the ECC for hardship situations. Permits must be SIGNED and RETURNED to Environmental Department upon completion of project.

Color Approval: Acceptable colors are on file at the POA Office. Earth tone colors set the standard with white not being acceptable for foundations, siding, roofing, and entire structures.

Exterior Materials: No metal structured pre-fab mobile type home will be permitted on residential lots (ECCR Section 17 1707 08/01/96, amended 04/11/14) Exterior Decks and Porches: Exterior decks and porches shall be constructed of California Redwood, Cedar, Pressure Treated Wood (PTW), or composite. Material shall be consistent with earth tone shades.

White or similar hues are unacceptable.

Detached Garages: Detached garages shall be limited to single story construction. The construction of detached garages shall be limited to 600 square feet. Detached garages in the Hideout will require a concrete floor per specifications below:  Construction of any detached garage in the Hideout will conform to the current International Residential Code (IRC2015) Building Codes as adopted by the Commonwealth of PA.  Concrete slab to be a minimum of 4” thick.  Concrete slab to be at least 3500 PSI compressive strength. If wire mesh is used, it should be epoxy coated. Fiber-reinforced concrete is allowed.

Prohibition of Used Buildings: No used building shall be placed on any Lot. Accessory Outbuildings: No garage or shed shall be built on any Residential Lot before a dwelling is built on that Lot. property is the property owner’s responsibility whether the work is being performed by themselves, a guest, a renter, or a hired contractor.

Tree Removal: No tree over three (3) inches in diameter at breast height (DBH) may be cut down without the prior written consent of the Committee. ALL tree removals will require: (1) Site Inspection before a building Permit is issued by the ECC. The Environmental Manager will determine which trees, if any, can be removed, and how many need to be replaced, and (2) a separate Permit is required before any tree cutting (see ECC Manual – TREE PROGRAM on Hideout website).

Excavation Guarding: Excavations shall be properly guarded and protected to prevent the same from becoming dangerous to life or limb as per OSHA Rules.

Retaining Walls: Any wall to be constructed on any Hideout lot must be reviewed and permitted by the ECC. Walls of any kind are not permitted in any easement areas.

Concealment of Fuel Storage Tanks: Every fuel storage tank on any Lot shall be either buried below ground or screened to the satisfaction of the ECC. All propane tanks are required to be masked with lattice work or shrubbery within 90 days of their installation.

Vehicle Parking: No vehicle shall be parked on any street in the Hideout.

Vehicles in parking pads or driveways must be a minimum of five (5) feet from the roadway.

Signs: Except as permitted by the Committee, no person, shall erect or maintain upon any Lot or Improvement any sign or advertisement. (PC 2k 5/11/70).

All signs, with the exception of those displayed upon address posts, erected by or for the owner may not exceed 200 square inches in size or be nearer than eight (8) feet to the edge of any Hideout roadway.

Signs may not be permanently attached to any trees, but may be hung independently on trees, posts, and ornamental columns within the member's lot. Lighting for approved signs must be confined to illuminations of only the property in question.

No commercial signs are permitted in the residential sections with the following exceptions: • Builders are permitted to erect one sign per lot when a permit for a sign has been issued by the Environmental Control Committee.

• Said sign shall not be permanently attached to any trees.

• Said sign shall be no larger than 200 square inches.

• Said sign is to be removed the same day as project completion.

• Signs are not to be lighted in any way.

FOR MODULAR HOME CONSTRUCTION (Heavy Equipment, Cranes, Large Trailers) Expected Delivery Date:__________Time:____AM____PM 1. Verification of delivery MUST BE CONFIRMED with the Public Safety Manager, at least 48 hours in advance (570) 6984100 (x143).

2. Two (2) properly trained flagmen MUST be provided for traffic control during delivery and set-up. Method of traffic control to be determined by Hideout Safety personnel.

3. Delivery and set-up will be limited to Monday thru Friday from 8AM-5PM. 4. A long-term road closure to facilitate the staging or storing of delivery vehicles or the set-up of cranes is prohibited.

5. The Permit Holder is responsible for any and all damages caused to Hideout properties (this includes actions by his/her contractors).

6. All protective shipping materials removed from any unit(s) during set-up must be removed off-site or stored within the unit(s) at the end of each working day. Hideout dumpsters are not to be used for this purpose.

7. If necessary, the removal of trees requires an approved Permit from the office of the Environmental Manager. When excessive tree removal is deemed necessary to accommodate modular construction heavy equipment, the Permit Holder is required to plant new trees (size & quantity to be stipulated by the Environmental Manager).

8. The Permit Holder is responsible to arrange and pay for any necessary overhead utility relocation, service shut-offs, or replacements for damages.

DRIVEWAY GUIDELINES 1. Begin Driveway at the edge of road pavement.

2. ALL driveways require a small negative swale in the driveway near the edge of the driveway and before the street. This will permit water runoff to wash to the side of the road and not into the right-of-way.

4. The shoulder slopes usually from ½”/ft. (4%) to ¾” ft. (6%).

However, the shoulder slope should be maintained when constructing the driveway. Even though the shoulder width may vary, a minimum width of 3 feet shall be maintained when constructing the driveway.

5. Grades (G2) shall be limited to 15%.

6. Measurements taken at a minimum width of 3 feet with a 1.5-inch depth *If installing a culvert, 15” – 18” HDPE is recommended. Consider neighboring driveways and existing culvert sizes prior to installation.

Pavement Protection: If an excavator feels by installing the finished driveway a minimum of thirty-five (35) feet into the property with base, finished top, all grades, swales and/or culverts will protect the POA road edge, approval may be granted. (ECCR Section 1610 5/1/89) Road Damage Compensation: At any time during the course of constructing an improvement on any residential lot, should any road damage occur anywhere upon a POA road right-of-way immediately fronting said lot and also twenty-five (25) feet on either side of that lot, the contractor constructing such improvements shall be charged for damage repair on all areas documented on a square footage basis. This shall be charged at the going rate for such repairs, with a minimum charge of $100.00. (ECCR Section 1608 02/19/86) Driveways: All driveways shall be constructed so as not to impair drainage within the right-of-way, alter the stability of the improved area, or change the drainage adjacent areas.
