Long-Term Rental Rules & Regulations for the Association of Property Owners of the Hideout, Inc.

Approved by the Board of Directors of the Association of Property Owners of the Hideout, Inc. (“the Hideout”), the following will be added to the community’s Rules and Regulations regarding Long-Term Rentals:
Definitions:
BEDROOM: A room or space designed to be used for sleeping purposes with two means of egress (one of which may be a window acceptable under the latest International Residential Building Code), a closet, and in close proximity to a bathroom. Space used for eating, cooking, bathrooms, toilet rooms, closets, halls, storage or utility rooms and similar uses are not considered Bedrooms. Space used or intended for general and informal everyday use such as a living room, den, sitting room, or similar is not to be considered Bedrooms
DAY GUEST: A visitor to the Long Term Rental property, but not constituting an occupant.
OCCUPANT: Person staying at the Long Term Rental property overnight. A person located on the Long Term Rental premises shall be deemed an occupant unless established otherwise by the Owner, Person in Charge, or Tenant and must be listed as an occupant on the rental application.
OWNER: Person having legal or equitable ownership of the Long Term Rental property. If there is more than one such person then owner shall mean each such person, indvidually and jointly.
PERSON IN CHARGE: A person or agent with actual authority to represent the Owner for the purposes of contact and communication regarding the Owner’s Long Term Rental. A Person in Charge must reside or have an office within fifteen (15) miles of the Long Term Rental property and be able to act as the legal agent for the Owner. The Hideout must be notified, in writing, within fourteen (14) days if there is a change in the identity of the Person in Charge.
TENANT FAMILY: In accordance with the Hideout By Laws, Article ll (L), “Tenants” means a person or persons entering into a lease of a private home of a Member. One couple and dependents OR not more than three unrelated adults are considered “renters” for amenity use purposes. All others are considered “guests of Tenants”.
LONG TERM RENTAL AGREEMENT: A Hideout issued document granting permission for the owner of a Single Family Dwelling to use said residence as a Long Term Rental.
LONG TERM RENTAL: Any residence in the community utilized as a Single Family Dwelling rented for the purpose of overnight lodging for a period of between 29 overnights 12 months.
SINGLE-FAMILY DWELLING: A residential dwelling for one or more persons, each related to the other by blood, marriage or legal adoption, or a group of not more than 3 persons not so related, together with his or her domestic servants, maintaining a common household in such dwelling. (PC 11 5/11/70)
TENANT: For the purposes of Long Term Rental rules in the Hideout, “tenant” shall refer to the primary individual who signed an agreement with the Owner or Owners agent for the use of the Long Term Rental for a period of between 29 Overnights 12 months.
TENANT PRIVILEGES: In accordance with the Hideout By Laws, Section 8 page 5: The Owner in good standing who leases their residential unit for occupancy shall be deemed to have assigned limited membership privileges to the tenant provided, however, that a copy of the lease or Association rental form shall be filed in the Office of the Secretary of the Association. By the mere acceptance of the lease and act of occupancy, the Tenant shall be deemed bound and shall abide by all guest, rental, and other rules, regulations, ByLaws and policies of the Association. Once membership rights are assigned by the Owner, the Owner shall not have privileges of use of the amenities or facilities and may not occupy the rental property. The privileges are reinstated upon expiration of the Lease. Neither the lease nor the Association rental form shall relieve or release the Owner from their obligations and responsibilities incident to their membership. If an Owner rents to another member in good standing, then the Owner need not assign their membership rights and privileges.
Long-Term Rental Agreement Required
No owner of any property in the Hideout shall operate a Long Term Rental without first obtaining a Long Term Rental Agreement from the Hideout. Operation of a Long Term Rental without such Long Term Rental Agreement having been submitted and accepted in full is a violation of Long Term Rental rules and will subject the owner of the lot in question to citations, fines, and review by the Hideout Disciplinary Committee.
Property Owners will be responsible for damages incurred by tenant(s)/renters to any Association owned property and accepts responsibility of insuring tentant(s)/renters’ compliance with all rules and regulations, By Laws and policies of the Association.
Only members in good standing may engage in a Long Term Rental of their Single Family Dwelling in the community.
Amenity badges will not be issued unless all POA fees are paid in full and the Long Term Rental unit has submitted agreement paperwork in full.
Property owners are not permitted to rent their property to anyone who within the last two (2) years has violated the rules and regulations and in which case said violation constitutes a crime as defined in the PA Crimes Code.
*Property owners are responsible for ensuring compliance with any applicable state, county or local township ordinances or taxes related to operating a rental property.
*Last minute bookings during non POA business hours must be called into the gate, rental agreement submitted, and fees paid online prior to the rental party arriving. Noncompliance may lead to violations and penalties.
Long-Term Rental Agreement Requirements
A. Long Term Rental Agreement applications shall contain all of the following information:
1. The name, address, email, and 24 hour telephone number of the Owner.
2. The name, address, email, and 24 hour telephone number of the Person in Charge if different from the Owner. A local person in charge shall have written authorization to accept service for the owner.
3. The total number of bedrooms in the Long Term Rental shall be identified. Floor plans for the Long Term Rental, including total habitable floor space and total number of bedrooms displaying windows and closets, must be provided. Floor Plans must be signed and dated.
4. Signatures of both the owner and/or the local Person In Charge.
5. Owners Declaration showing the location and number of on site parking spaces, signed and dated.
B. A Long Term Rental Agreement shall be issued only to the owner of the Long Term Rental property.
1. A separate Long Term Rental Agreement is required for each Single Family Dwelling being rented as a Long Term Rental.
2. A Long Term Rental Agreement is effective for a period of between 29 days 12 months and must be renewed for each new, subsequent Long Term Rental.
3. The Hideout will provide forms and procedures for the processing of Long Term Rental Agreement applications.
4. Long Term Rental Agreements are non transferrable. If ownership of a Long Term Rental changes, the new Owner(s) must complete a new Long Term Rental Agreement form before renting out the Single Family Dwelling for a Long Term Rental.
5. The Owner or Person in Charge shall respond to Hideout Public Safety forthwith after being notified of the existance of a violation of rules pursuant to Long Term Rentals or any disturbance requiring immedediate remedy or abatement. If the Person in Charge is not the Owner, they shall immediatley advise the Owner of any notification of a violation.
Long-Term Rental Standards
A. Occupancy of a Long Term Rental shall be limited to no more than: Two (2) persons per documented bedroom plus four (4) additional persons Bedrooms are defined earlier in this document as: A room or space designed to be used for sleeping purposes with two means of egress (one of which may be a window acceptable under the latest International Residential Building Code), a closet, and in close proximity to a bathroom. Space used for eating, cooking, bathrooms, toilet rooms, closets, halls, storage or utility rooms and similar uses are not considered Bedrooms. Space used or intended for general and informal everyday use such as a living room, den, sitting room, or similar is not to be considered Bedrooms.
B. Amenity Badges: As has always been the case for any rentals, the primary rental group (not exceeding the indicated and approved maximum occupancy for your particular lot and consisting of no more 3 unrelated adults and their families) will have the opportunity to purchase amenity badges along with their gate access. If anyone else in the rental party wishes to have amenity badges, those can be purchased for an additional non refundable fee at the POA, Tues Sat 8AM 4PM. During the new homeowner orientation, owners of lots are provided with 6 amenity badges automatically, which can be used by your renters during their stay. Anyone over the age of 7 is required to wear an amenity badge at all times while in the Community common areas and to access the Community’s amenities (ski hill, golf course, etc.).
C. Access to specific amenities, such as the pool, would require a pool pass sticker upon the amenity badge. Specific amenity passes can be purchased for an additional fee by the Registration Department or at that particular amenity’s facility.
D. Outdoor parking for occupants and day guests shall be limited to available parking areas on the Long Term Rental property. In no event shall parking for Long Term Rental tenants include spaces in any public street right of way or on any lawns or vegetated areas. A maximum of one car per bedroom is permitted for any Long Term Rentals. Vehicles are to be a minimum of 5’ off of the edge of the common roadway.
E. A Long Term Rental property shall not have any outside appearance indicating a change of use from the surrounding residential uses.
F. Neither Long Term Rental occupants nor guests shall engage in disorderly conduct or disturb the peace and quiet of any neighborhood, neighboring lot, or person by loud, unusual, or excessive noise, by tumultuous or offensive conduct or creating a dangerous or physically offensive condition.
G. Overnight occupancy of recreational vehicles, camper trailers, and tents at the property where the Long Term Rental is located shall not be allowed. Outdoor overnight sleeping of occupants or guests of the Long Term Rental is prohibited.
H. All Long Term Rentals shall have a clearly visible and legible notice posted within the residence containing the following information:
a. The name and Owner of the unit or Person in Charge and a telephone number at which that party can be reached on a 24 hour basis.
b. The emergency number sign for the lot and the lot number/street name, which would be provided to 911 or Public Safety dispatch if need be.
c. The maximum number of occupants permitted to stay in the residence and the maximum number of day guests permitted at any one time.
d. The maximum number of all vehicles allowed to be on the Long Term Rental property and the requirement that all guest parking must be parked in the available parking areas on the property, not in or along any private or common roadways or on any lawn or vegetated area on the property.
e. Household trash expectations and where to take trash/recyclables. Refuse shall not be left or stored on the exterior of the property at any time.
f. Notification that an occupant or guest may be cited and fined for creating a disturbance or for violating other provisions of the Hideout’s Long Term Rental rules or community standards, including parking and occupancy limits.
g. Copies of the Hideout governing documents.
Fees, Terms, and Renewals
A. Long Term Rental fees, payable to The Hideout upon the filing of a Long Term Rental Agreement application, as listed in the fee guides.
B. Any Long Term Rental Agreement is good for the timeperiod indicated from the date of issuance until expiration and must be renewed yearly, as well as with each new subsequent Long Term Rental.
C. Long Term Rental fee rates may be changed at any time by the Hideout Board of Directors.
Enforcement
A. Hideout staff, including its Public Safety Officers, shall have the authority to administer and enforce all provisions within the rules pertaining to Long Term Rentals.
B. The issuance of a Long Term Rental Agreement is not a warranty that the premises is lawful, safe, habitable, or in compliance with Long Term Rental requirements.
C. If there is reason to believe that any provision of the rules of Long Term Rentals are being violated, the Board of Directors or their appointee may or may cause through an authorized representative of the Hideout, entry onto the premises to ascertain the existence of Long Term Rental violations. In those matters where the nature of an alleged violation is such that an inspection of the interior of a building or structure is necessitated, prior arrangements must be made with the owner or his agent to secure access thereof.
Marketing
The marketing of a Hideout based Long Term Rental in which the advertised occupancy exceeds the maximum occupancy requirements permitted by these rules, or which promotes any other activity which is prohibited by Long Term Rental rules established by The Hideout, shall be a violation subject to a Failure to Comply citation, fines starting at $1,000.00 for the first violation up to $3,000.00 including the potential for suspension of property rental privileges for subsequent violations.
Notice of Violation
If it appears to a Hideout staff member or Public Safety Officer that a violation of the Long Term Rental rules exists or has occurred, the staff member or officer shall send a written notice of violation to the Owner or Person in Charge by personal delivery or to the Owner by US First Class postage mail. The staff member or Public Safety Officer shall identify the premises which is the subject of the violation, enumerate the conditions which constitute the violation, cite the specific sections of Long Term Rental rules which are violated, indicate the action required to correct the violation, and provide a time frame (established by the staff member or Officer) to correct said violation. If possible, a phone call will be placed to the Owner or Person in Charge to inform them of the issue at hand and to have it remedied forthwith.
Nuisance
In the interest of promoting the public health, safety, welfare, and in an effort to minimize the burden on neighboring properties, Hideout management, employees, and the community’s infrastructure by Long Term Rentals, a violation of any of the provisions within Long Term Rental rules is declared a public nuisance.
Violations and Penalties
A. Long Term Rental rules and policies shall be enforced by Hideout staff, Public Safety Officers, the Hideout Disciplinary Committee, and/or brought before the local courts of Wayne County, Pennsylvania. Any legal disputes will be litigated at this venue location. Any person, partnership, corporation or other entity who or which violates or permits a violation of the Long Term Rental rules of the Hideout shall, upon conviction in a summary proceeding, pay any fine costs per violation, plus all court costs and reasonable attorneys fees incurred by The Hideout in the enforcement proceedings Each day or portion thereof that a violation exists or continues to exist shall constitute a separate violation. Further, the appropriate staff member or Public Safety Officer of The Hideout are hereby authorized to seek equitable relief, including injunction to enforce compliance with all Long Term Rental rules established by the community and its Board of Directors.
B. Illegal renting activities will result in the following fine structure:
a. 1st Offense: $1,000.00
b. 2nd Offense: $2,000.00 plus six (6) month suspension of rental privileges
c. 3rd Offense and subsequent Offenses: $3,000.00 fine plus permanent suspension of Long Term rental privileges.
C. Long Term Rental Agreements may be revoked, or denied renewal for three (3) uncured or repeated violations of the established Long Term Rental Agreement for any particular property enrolled in Long Term Rental activities. The revocation or denial to renew a Long Term Rental Agreement shall continue for six (6) months for the first set of three (3) uncured or repeated violations, and continue for one (1) year for any subsequent sets of violations.
Owners Severally Responsible
If the Long Term Rental premises are owned by more than one owner, each owner shall severally be subject to disciplinary action for a violation of The Hideout’s Long Term Rental rules and regulations.
