INTRODUCTION

However careful you are during your group activities, accidents can still occur which is why it’s sensible to protect yourself with insurance. Having the right insurance is likely to provide reassurance for any third parties you might interact with when planning and gaining permissions for your activities.

There are a number of insurances available to community groups depending on what type of group you are and the activities involved. As a group you should consider Public Liability insurance. This will cover your group organisers and your volunteers for your legal liability to meet claims for accidental injury to your own volunteers and any third parties and their property where you, your group or your volunteers are at fault. Personal Accident insurance gives your group members reassurance that they can claim for injuries sustained during group activities.

Through partnership with Zurich Municipal we are able to offer discounted insurance to our Community Network Members.

WHAT POLICIES ARE AVAILABLE ON THE TCV SCHEME? COMBINED PUBLIC LIABILITY AND PERSONAL ACCIDENT This policy is highly recommended for all groups working with volunteers in the UK. We offer both Public Liability and Personal Accident cover in our combined policy. The extent of cover is dependent upon the amount of manual work carried out each year. Other extensions can be added to the cover.

You only pay for the cover you need.

PUBLIC LIABILITY Covers you and any volunteers helping you in respect of your legal liability for damages and claimants costs and expenses arising from (a) accidental bodily injury including death, illness and disease (b) accidental damage to third party property as a result of a negligent act or accidental error or accidental omission.

PERSONAL ACCIDENT Cover provides agreed benefits in respect of selected categories of persons following death or disablement arising from an accident and/or an assault.

EMPLOYERS LIABILITY Increasingly more and more groups are securing external funding allowing them to be able to employ staff. We can offer Employers’ Liability Insurance, underwritten by Zurich Municipal, up to a maximum of 5 employees (or part time equivalent).

The Employers’ Liability Insurance provides £10 Million pound worth of cover and costs start at £145.50 per annum. Cover is available to groups who hold the TCV Combined policy.

Employers Liability Insurance - Covers you in respect of your legal liability to Employees for damages and claimants costs and expenses arising from accidental bodily injury including death, illness and disease and Legal defence costs.

Unpaid staff are classed as volunteers. Our underwriters state that ‘Volunteers do not fall within our definition of an employee’. If you take out Public Liability and Personal Accident Insurance with TCV this will provide cover for your volunteers.

ALL RISK PROPERTY INSURANCE ‘All Risks’ insurance covers any items that your group own and wish to insure on a replacement basis. ‘All Risks’ cover will indemnify you up to the sum insured selected for any loss, damage, theft or accidental damage. This cover is not restricted to any one location so you are insured anywhere within Great Britain. Property insured on the policy will have automatic cover for Public Liability indemnified under Section A of your combined policy. Cover starts from £18.55 for property and £30.74 for tools and is available to groups who hold the TCV Combined policy.

All Risk Property Insurance - Property insurance cover for specific items owned by you for any loss, damage, theft or accidental damage All Risk Tools Insurance – Insurance specifically for your hand and power tools for any loss, damage, theft or accidental damage SPECIAL EVENTS INSURANCE If you are hosting or organising events with an expected attendance of over 500 people (on site at any one time) then you can temporarily extend your Public Liability cover for the length of the event. The policy can cover for “Non Hazardous” events such as fetes, fun days, carol concerts, music recitals, car boot sales, children’s parties, disco’s, community days, sports events, walking parades and carnival events. WHO CAN APPLY?

TCV Insurance is available to groups associated to TCV through the Community Network Membership scheme. Each independent group must hold its own policy as umbrella policies are not allowed under the scheme.

TO QUALIFY FOR A TCV POLICY YOUR GROUP MUST BE: • directly involved in conservation or environmental activities or the preservation of a green space • an independent, constituted organisation with your own committee or board of trustees and bank account* • a charitable or voluntary organisation (non-for-profit) * Groups who are controlled by a parent organisation may not require their own insurance policy. Please check with your parent organisation first to see if you are covered by their insurance.

We are limited to insuring organisations with an income of £120,000 or less and a maximum of 5 full time employees (or parttime equivalents) Cover is for a 12 month period and must run concurrently with association. Employers Liability and All Risk Property Insurance can only be taken out in conjunction with the TCV Combined policy.

APPLICATION PROCESS

Groups can apply for membership and Insurance at the same time, by downloading the forms from our website. Please provide as much detail as possible when completing the application and give us a daytime telephone number or email address where we can contact you should we have any queries.

If you require a quote please forward the forms by post or email making sure you note that you only require a quotation at this stage. We aim to provide a written quote within 5 working days.

If you are sure of the insurance that you require you can calculate the premium on the form and send that application to TCV via email or the post. Applications are usually processed within 3 working days although during busy times (spring/summer) this may take up to 2 weeks. We will always endeavour to process urgent applications as soon as possible so please let us know if your application requires immediate attention.

PAYMENT METHODS

RENEWAL PROCESS

We are able to accept payment towards membership and insurance using the following methods:

We are currently unable to pre-print renewal forms; we therefore issue a new application form to be completed each year. You will receive a renewal invitation either by post or email 8 weeks prior to the renewal date and a further reminder 4 weeks prior to the renewal date. We prefer to receive your completed forms at least 2 weeks before the renewal date to allow for processing or referring. Forms can be posted or scanned and attached to an email. Once the renewal date has passed a final reminder will be sent to you to advise the policy has ceased. We cannot backdate cover once the renewal date has passed. Policies will be restarted from the date of receipt of both the completed forms and the payment.

Cheque made payable to ‘TCV’. The cheque can be produced from a private or group account and sent in with the application.

Bank Transfer: Please request our bank account details prior to submitting your application.

Credit or Debit card: Please call in to make payment over the phone after submitting your application.

Invoice: Please request an invoice at the time of application providing the name, address and contact name of the organisation to be invoiced (if not yourself) and a Purchase Order number if applicable. Invoices must be paid within 30 days of the start date of the policy. Documents will only be issued when full payment is received.

FREQUENTLY ASKED QUESTIONS

ASSOCIATION AND INSURANCE REQUIREMENTS WHAT CRITERIA DO WE NEED TO MEET TO BECOME COMMUNITY NETWORK MEMBERS AND TAKE OUT INSURANCE? Your group’s aims must not be political or conflict with those of TCV’s. To take out the insurance you must also be an independent, not for profit organisation included in the list of groups we can insure, with an income of less than £120,000 and no more than 5 full time employees (or part time equivalents) WHAT IS A PARENT ORGANISATION? A larger organisation that is in control of your group.

We would consider your group being part of the same organisation if the head office is aware of, and has approved, the activities of your group, that the head office has the right to determine how your group is operating and has control over what goes on, and that they could close your group down if they wished to. In this case the parent organisation would be liable for your group and should cover your group’s activities on their current insurance.

WE RUN A GROUP OURSELVES BUT UNDER THE HEADING OF A LARGER ORGANISATION. IS THIS THE SAME AS A PARENT ORGANISATION? If you are part of a franchise, where the Head Office doesn’t really have a say over how the group is run, we would consider your group to be independent and you should hold your own separate insurance.

DO ASSOCIATED GROUPS HAVE TO TAKE OUT TCV’S INSURANCE? No, we recommend that all groups hold Public Liability Insurance, but it does not have to be taken out with us.

CAN A GROUP PURCHASE INSURANCE FROM TCV IF THEY ARE NOT MEMBERS OF THE COMMUNITY NETWORK? No, only members can purchase TCV insurance.

HOW MUCH DOES IT COST TO JOIN THE COMMUNITY NETWORK? Currently £38 per annum.

WHAT CAN HAPPEN TO A GROUP IF THEY DO NOT HAVE INSURANCE?

INSURANCE COSTS WHAT DOES TCV CHARGE FOR ITS’ INSURANCE? The minimum Public Liability and Personal Accident Insurance cost is £102.38, of this TCV receives a £39.50 administration fee. The Underwriters receive £59.32 and there is a 6% insurance premium tax. Additional premiums apply for insuring manual work with hand tools; the use of power tools, chainsaws and to extend the liability cover to any land.

CAN WE GET A GRANT TO ASSIST US WITH THE COST OF OUR INSURANCE? If you are a new group you may be eligible for the Chestnut Fund start up grant of £150 towards insurance. Please see the form and criteria on our website for more details.

INSURED PERSONS WILL TCV INSURE COMMERCIAL ORGANISATIONS OR SELF EMPLOYED PROFESSIONALS? No, only groups of volunteers and non profit making organisations.

ARE SUBCONTRACTORS COVERED BY TCV INSURANCE? Only if they are working voluntarily (paid expenses only) or on a ‘labour only’ basis under your supervision. If they are working unsupervised or being paid to provide a professional service they will need to have their own insurance cover.

ARE VOLUNTEERS WHO ARE NOT FORMAL MEMBERS OF THE GROUP, BUT WHO JOIN ON FROM TIME TO TIME, COVERED BY THE POLICY? Yes provided they are volunteering on your behalf. We would advise that you make a record of who takes part on a task day, try and ensure that more experienced members of the group supervise new members and that everyone involved is aware of the risks and has suitable safety clothing/equipment.

WILL TCV INSURE GROUPS WHO HAVE PAID MEMBERS OF STAFF? Yes. You have a legal requirement to possess Employers Liability Insurance where members, wardens or officials have a contract of employment or are in receipt of payment for their duties (over and above volunteer expenses) TCV can provide you with this cover, but any recognised policy is acceptable.

If the group are liable at law, action could be possible against the trustees or organising committee and they would have to arrange their own defence in the absence of a public liability policy.

TCV HAS HELPED SEVERAL LOCAL COMMUNITY AND CONSERVATION GROUPS GET STARTED, BUT NO LONGER SUPERVISE, MANAGE OR OWN THEM. BECAUSE THEY ARE NOW INDEPENDENT GROUPS DO THEY NEED TO PURCHASE THEIR OWN INSURANCE?

WE DO NOT CARRY OUT ANY PRACTICAL TASKS ARE WE STILL ELIGIBLE FOR THE INSURANCE?

Yes as long as you meet the criteria. We have an option to cover your group with Nil project days. The cover starts from £62.88 but must be upgraded to include project days before any active conservation work is undertaken. This can be done at any time during the policy year and will be calculate on a pro-rata basis. Mid-term amendments may be subject to a £10 administration fee.

WE WILL BE WORKING WITH SPECIAL NEEDS VOLUNTEERS; DO WE NEED TO NOTIFY YOU? TCV’s insurance does not differentiate between or exclude any particular group from the cover. All that we ask is that groups carry out risk assessments for all activities, which should take into account the abilities and needs of their volunteers.

FREQUENTLY ASKED QUESTIONS

OUR GROUP RUNS TWO SEPARATE PROJECTS EACH SUNDAY, INVOLVING A TOTAL OF 40 VOLUNTEERS. WOULD TCV INSURANCE PROVIDE COVER FOR BOTH PROJECTS? Yes, provided that the activities did not differ from the information declared on the insurance application form and did not take the groups number of project days over those declared.

AN ASSOCIATED GROUP WITH TCV INSURANCE, OFFER AN AFFILIATION SERVICE (FREE OF CHARGE) TO INDEPENDENT PARISH AND COMMUNITY GROUPS THROUGH THEIR ‘PARISH ENVIRONMENT SCHEME’. IS THIS ALLOWED UNDER TCV’S RULES? Although Groups may choose to affiliate to other groups, they cannot benefit from the insurance of another group, where that insurance is provided by TCV. In fact it is illegal for that group to resell it.

IF A GROUP CONSISTS OF A NUMBER OF INDIVIDUAL VOLUNTEERS WORKING IN DIFFERENT LOCATIONS E.G. TREE WARDENS, FOOTPATH WARDENS, WHO MAY EACH HAVE SMALL GROUPS OF LOCAL VOLUNTEERS TO HELP THEM, CAN THE WARDENS BE REGARDED AS COMPRISING OF ONE GROUP FOR ASSOCIATION PURPOSES? Yes, however, once the local group takes on a permanent existence (with its own management committee, constitution and bank account), it will be expected to associate separately for insurance purposes.

Groups should not take direct responsibility for children under the age of 8, they should be accompanied by a parent or guardian whenever possible (or teacher/leader in the case of group activities).

Children age 9 to 14 must be supervised by one adult to every 8 children.

Children over 14 only require close supervision when using sharp edged tools, power tools, strimmers and mowers.

ARE THERE ANY RECOMMENDATIONS FOR CHILDREN USING TOOLS? Yes, we recommend the following minimum ages for the use of certain tools. Training, close supervision and PPE should be provided at all times.

Children’s plastic hand tools – from 4 years.

Gardening tools, small hand saws, pruners and hammers – from 8 years.

Carpentry tools – from 12 years.

Larger sharp edged tools, bill hooks, mattocks and crowbars – from 14 years.

Strimmers and mowers, small power tools – from 16 years.

Power driven machinery including chainsaws, brushcutters, tractors etc – from 18 years.

PUBLIC LIABILITY INSURANCE WHAT IS A PROJECT DAY?

OUR GROUP WORKS ON NUMEROUS SITES. IS THE POLICY SITE SPECIFIC? No the combined policy is active anywhere within the UK territorial limits and on numerous sites at the same time.

WORKING WITH CHILDREN ARE WE INSURED TO WORK WITH CHILDREN? Yes but we recommend that you are not directly responsible for them and have a teacher, parent or leader present. If this is not possible you should obtain parental consent for the child to be with your group, for them to be carrying out conservation work and for emergency treatment at a hospital or doctors, should it be necessary. Appropriately sized safety equipment and clothing should be made available and risk assessments must cover the fact that children are taking part.

DO WE NEED TO BE DBS (FORMERLY CRB) CHECKED IF CHILDREN ARE ATTENDING OUR PROJECTS? DBS checks are only required if a group member is having regular, unsupervised contact with a child or vulnerable adult.

Regular contact could be daily or weekly over a medium to long period. Unsupervised means an adult left alone with a child. A child is a person under the age of 18.

WHAT SUPERVISION RATIOS ARE ADVISED WHEN WORKING WITH CHILDREN? Children under 4 should not take part in practical conservation work.

Children age 4 to 8 must be supervised by one adult to five children.

A project day consists of 8 hours of active manual work per volunteer so a project day can be split many ways: 1 person working 8 hours, 2 people working for 4 hours, 4 people working for two hours or 8 people working for an hour.

For example: 10 volunteers work one hour each per week (52 hours per year) 10 x 52 = 520 hours, divide by 8 = 65 project days Only active work goes towards a project day. Meetings, walks, talks, open days, events etc are not active work and are automatically covered by the policy.

IF WE USE HAZARD WARNING SIGNS (AVAILABLE FROM TCV RETAIL), AND THEREBY ACKNOWLEDGE A POTENTIAL HAZARD, ARE WE INVALIDATING OUR INSURANCE OR LEAVING OURSELVES OPEN TO CLAIMS IN THE EVENT OF AN ACCIDENT INVOLVING A MEMBER OF THE PUBLIC? No, displaying warning signs does not in any way invalidate the liability cover. Our insurers would support the action taken to reduce potential risk.

ARE WE COVERED FOR DAMAGE TO THE GROUP’S PROPERTY? The All Risk Property insurance has been designed to cover all of the group’s property against theft, loss or damage. There is no cover for property on the combined policy.

IS OUR GROUP COVERED FOR WORKING UP LADDERS? Yes, you are covered to work up to heights of 5 meters.

However the insurers expect common sense and reasonable care to be taken. Please let us know if you intend to work at heights of over 5 metres.

FREQUENTLY ASKED QUESTIONS

ARE BATTERY POWERED OR MAINS RECHARGEABLE SCREWDRIVERS AND DRILLS CONSIDERED POWER DRIVEN? No, they present a lower level of risk. Only engine, petrol/ diesel or generator driven hand held equipment are considered power driven.

CAN ANYONE USE CHAINSAWS ON THE PROJECT IF WE HAVE PAID FOR THE CHAINSAW INSURANCE? No. Only operators with a valid TCV Chainsaw Permit are insured to use a chainsaw under TCV insurance. For details of how to obtain a permit, please contact Customer Services.

ARE WE COVERED FOR ADMINISTERING FIRST AID? Yes, public liability extends to cover first aid whether qualified or not. It would not be a person’s intention to do harm.

WE ARE PLANNING TO INSTALL SOME CHILDREN’S PLAY EQUIPMENT IN OUR PARK, HOW DOES THIS AFFECT OUR INSURANCE? The underwriters have agreed that groups who are responsible for play equipment can be covered under the public liability insurance but only if their main activity is environmental improvement and not the provision of play equipment. You must however inform us of the type and scale of the equipment before we can give out final approval.

Groups must ensure that the equipment is regularly inspected and maintained. The equipment itself could be covered under the All Risk Property Insurance. For further guidelines please see our All Risk FAQ. WE WISH TO INSTALL A BMX TRACK/MOUNTAIN BIKE TRAIL. CAN THIS BE COVERED BY THE POLICY? No, the policy will not cover the installation of facilities used for leisure or sporting purposes.

ARE WE INSURED FOR USING RIVERBOATS? Insurance would apply whilst engaged in conservation or conservation related activities aboard a water vessel up to 5 metres in length. There is however, no provision for damage to the boat or other boats caused by the boat you are on.

This will need to be covered by a separate marine policy, which should be held by the owners of the craft.

WHAT ACTIVITIES DO WE NEED TO DECLARE ON THE APPLICATION FORM? Please make a list of everything you do as an organisation, both manual and non-manual tasks. We risk assess all of your activities against our policy guidelines.

WE ARE A TENANTS AND RESIDENTS ASSOCIATION, AND AS WELL AS PRACTICAL CONSERVATION TASKS SUCH AS LITTER PICKS, WE HAVE A COMMUNITY HOUSE WHERE WE HOLD A PLAYGROUP AND CLASSES AVAILABLE TO THE LOCAL RESIDENTS. CAN ALL OF THIS BE COVERED UNDER OUR PUBLIC LIABILITY AND PERSONAL ACCIDENT INSURANCE? Yes as the building is under your group ownership or lease then the public liability extends to those visiting and using the building, however the building and contents will not be covered on this policy. For clarification of what is and is not covered please contact TCV on 01302 388883.

ARE WE INSURED TO SPRAY PESTICIDES? Yes as long as the correct PPE is worn, the person is competent and a risk assessment is completed.

WHAT SAFETY PRECAUTIONS ARE A GROUP EXPECTED TO TAKE? 1.

Instruct all volunteers in safe ways of carrying out work.

2. Educate volunteers about the dangers of each type of tool they and other members of the group will be using.

3. Follow the manufacturer’s safety and operating instructions applicable to those tools.

4. Ensure appropriate protective clothing and safety equipment is worn.

5. Follow good practice Health and Safety techniques for the specific activity.

6. We advise that all groups obtain a copy of the Health and Safety Overview and other TCV literature, and work to the precautions laid out in them. Your local TCV office will assist associated groups with general or specific Health and Safety questions.

7. Carry out Risk Assessments.

EVENTS IS OUR GROUP COVERED FOR MEETINGS, EDUCATIONAL, PUBLICITY, COFFEE MORNINGS, OPEN DAYS, STALLS AT FAYRES, SELLING PRODUCE ETC? Yes. Cover is operative within the definition of insured persons (members of the group) whilst involved in your group’s activities, e.g. fundraising towards the group’s activities.

However cover is limited to an attendance of up to 500 people on site at any one time. Larger events can be quoted for. If you are organising a fete/fayre you are only insured for your own liabilities and should advise/ensure that other stall holders and organisations present have their own insurance.

ARE WE INSURED TO OPERATE A BOUNCY CASTLE AT ONE OF OUR FUNDRAISING EVENTS? No but you can purchase additional cover for the use of bouncy castles. For details of our event cover please contact Customer Services.

CAN WE INSURE ITEMS BORROWED OR HIRED FROM OTHER ORGANISATIONS OR COMPANIES? Yes we can offer temporary All Risk cover for items in your care over a short period of time. For details please contact Customer Services.

CAN WE HAVE PRIVATE BONFIRES ON OUR SITE? The insurance covers you for small bonfires to burn cuttings, which are a result of your conservation activities. You must carry out a risk assessment.

CAN WE HOLD A PUBLIC FIREWORKS/BONFIRE EVENT? You would need to take out TCV Event cover for bonfire parties and firework displays and follow the BIS guidelines on Firework Safety, please contact TCV for up to date information and an event application form.

ARE WE COVERED FOR A PROGRAM OF WALKS/WALKING EVENTS? Only if your main activities during the year are practical environmental improvement tasks.

FREQUENTLY ASKED QUESTIONS

PROPERTY OUR GROUP PROPERTY IS STORED AT OUR MEMBER’S PRIVATE ADDRESSES. IS IT NOT ALREADY COVERED BY THEIR HOME INSURANCE POLICY? No, an individual can only insure their own property. It is up to the owner of the property to purchase adequate insurance, regardless of its storage location.

INCIDENTS DO WE NEED TO NOTIFY YOU OF EVERY INCIDENT, EVEN IF NO-ONE IS GOING TO CLAIM? Yes, you must report every incident that results in an injury, property damage or theft/ loss even if no-one intends to make a claim on the policy at the time. Please record the following information: Group name and reference number

IS THE ALL RISK INSURANCE SITE SPECIFIC?

The All Risk Property insurance is not site specific but we do require all the storage addresses for the All Risk Tools insurance.

A brief description of the incident

WE HAVE £10,000 WORTH OF PROPERTY BUT IT IS SPLIT EQUALLY OVER 2 LOCATIONS. THE CHANCE OF US LOSING ALL THE PROPERTY AND CLAIMING FOR THE FULL £10,000 AT ONCE IS VERY LOW. CAN WE JUST TAKE OUT A POLICY FOR £5,000 WORTH OF COVER? No, this would be classed as under-insuring. If you only insure 50% of your items then the compensation paid will also be proportionately reduced.

IF WE ARE INSURING TOOLS UNDER THE ALL RISKS INSURANCE, WHAT PRECAUTIONS AGAINST THEFT SHOULD WE BE TAKING? One key test in measuring your tool store’s security is to imagine that you have lost the key and ask yourself ‘how would I get in?’ If your doors and window frames are rotten or weak, could they be forced open? Consider what security measures are in place – alarms, padlocks, security lights etc. Remember that a claim will only be considered if there is evidence of forced entry to the tool store and a crime reference number has been issued.

Stores in remote locations should have reinforced doors and windows with grills fitted, be made of substantial construction and have suitable strengthened locks and hinges. In addition, security screws are now available that cannot be unscrewed.
