No fault divorce, one year on…

It is now one year since the arrival of no-fault divorce in England and Wales. As the biggest change to divorce law for decades, the advent of the no-fault process has transformed divorce and separation. Couples are now able to seek a divorce without having to blame their partner. No-fault divorce has also removed the ability to contest a divorce.

Has no-fault divorce caused an increase in divorce applications? Initially, there was an influx of people starting the divorce process, but this was largely people who had held back from starting until the new system was launched, as it allowed a more amicable approach.

While enquiries for divorce have been rising, and recent statistics revealed that divorce applications have risen to the highest level in a decade, this is likely to be due to several different reasons, including the Covid-19 pandemic, which put huge pressure on relationships, the ever-deeper cost of living crisis, and the increasing ease of a “DIY” divorce.

What about the financial arrangements? No-fault divorce has played a role in changing the context in which couples choose to go through divorce. Anecdotally, more people are turning to DIY divorce and ‘kitchen table settlements’ (where the couple sits at the table to decide the ins-and-outs

of the separation) to make their breakup official. However, it is important that couples take legal and financial advice to understand the full impact of the settlement, especially regarding their longterm needs. One of the most common potential pitfalls of a DIY divorce, where people have not sought legal, pension or financial advice, is decisions around the family home and the division of pensions.

In the moment, a larger share of the family home in exchange for disregarding a pension share can seem like a good outcome, providing immediate security. However, pensions have long-term benefits, sometimes with financial uplifts or bonuses, making them more valuable than they seem on paper. Not getting comprehensive advice in this area could mean people make ill-informed decisions, and potentially find themselves in a much more vulnerable financial position upon retirement.

A LIFE LESS ORDINARY

The lives of St Ivians from the 1800s and the challenges they faced can seem extraordinary to us. No-one demonstrates that more than Emma Hurl, who sent five sons to war and was a boarding-house keeper extraordinaire. This is a snapshot of life then.

Born Emma Maria Mapperley in 1863, to Ann and Samuel. Her father was a chimney sweep and as was the practice then, kept a ten year old apprentice to climb up narrow chimney flues. But by the time of Emma’s birth the use of child apprentices was outlawed.

The Bell

Samuel had moved on and although still operating as a sweep, he’d taken over the license of a pub on The Waits, named The Bell. Samuel expanded The Bell to become a lodging house with the most impoverished boarders eating with the family. In 1871 there were 18, of which five were tramps. Emma was surrounded by ‘guests’ from far and wide - three tramps were Irish and one boarder even came from New York, USA. In her teens Emma worked as a dressmaker whilst her father continued as a chimney sweep.

Arthur still worked as a carpenter besides being a licensed victualler and he and Emma had three sons. So, as well as her children, a father and 17 boarders to look after, it might be a bit of an understatement to say Emma was kept busy feeding and tidying for 22 people! By 1901, there were six sons and a daughter, aged between one year and 17 years, also 10 lodgers and one boarder, plus Emma’s retired father. Lodgers by then weren’t provided with meals, so that made life a little easier for Emma.

Five of the six sons went to fight in WWI. One of them, Walter, was one of the most prolific of letter writers and had several published in the Hunts Post telling of his experiences in war. However, a

In Green Street, at the back of The Bell, lived Arthur Hurl. Arthur, was born in Fenstanton and followed his father’s trade as a carpenter. Emma and Arthur met, fell in love, and married in 1882 when Emma was 19 years old.

Arthur moved into The Bell, probably to be with his wife and when Emma’s mother died in 1889, the license of The Bell (or The Eight Bells as it was called at the time) was transferred to him. Emma’s father, aged 72 years, became just another lodger in what had become his daughter and son-in law’s business.

German shell landed in his trench and he and his companions were killed. Walter is named on the St Ives War Memorial. The four remaining brothers returned from WWI unscathed with one, Albert, winning the Military Medal for bravery in battle.

Arthur had given up the The Bell’s licence in 1918. By 1921 nearly in their 60s, Emma & Arthur were living in five rooms in The Broadway - with them were two sons, a daughter-in-law and a grandson. The census shows they lived with son Ernest and family at 38 West Street in 1939 with both listed as ‘incapacitated OAP’. Emma died in 1940 aged 77 years with Arthur's death the following year.

As we go to print, work has begun to install the Bandstand. By the time the magazine reaches you it is highly likely that the bandstand will be in place. We still have to install the electrics and complete the list of supporters who have helped pay for it. Around the outside will also be images about St Ives, which when completed will allow us to have a formal opening ceremony, hopefully before the end of June. Details of this will be on the Town Team website www.stivescambridgeshire.co.uk and also on the Town Council Facebook page once the date has been agreed.

Chapel Arts @ the Corn Exchange

Meanwhile our popular Chapel Arts Concerts continue. May’s concert in the Free Church saw an audience of over 100 people enjoy a wonderful concert from two great classical guitarists, Daniela Rossi from Cambridge and Cristiano Poli Cappelli who travelled from Italy just to perform here. Normally the concerts are on the last Friday of each month but next month (June) the wonderfully entertaining Dickie de Vere & The Dorchester Mavericks will be playing on Thursday 29th June.

The following month on Friday 28th July we have a special Chapel Arts concert with Max de Bernardi & Veronica Sbergia. They are on their European tour, fresh from their home in the USA and we have been fortunate to get them for an evening. So if country & western, folk and swing music are your thing you can book online at

The Old Riverport Jazz & Blues Festival

The programme for the Festival is being printed at the moment. It features 25 free concerts over four days from 14 to 17 September in 13 different locations throughout St Ives. An online version, which you can download and print, is available on the Town Team website www.stivescambridgeshire.co.uk

The Old Riverport Ukulele Festival

This is taking place on 7th October and tickets are selling well. Details of the Festival can also be found on the Town Team website and will appear in the next edition of NOW. If you are interested in attending you will need to book soon as over 70% of the tickets have already been sold.

Coronation Big Picnic

We must mention the fabulous event that the Town Team, working with the Town Council and FESt, held on 7th May in the Town centre to celebrate the coronation of King Charles III.

What’s New Happening for June and July

• Mayor Philip Pope was elected for his second consecutive term as the Town Mayor at the annual Mayor Making event on 10th May with Councillor Craig Smith elected as the Deputy Mayor. At this event The Mayor presented his recognition Awards and donations to members and groups of the community and local charities which make a real difference in the community of St Ives.

• The Refill Shop of Ikigai is a small vegan business in White Hart Lane St Ives which has won a national environmental award at the Good Small Business Awards to become the Retail and Wholesale Activities Industry Champion Martin Cooper, owner of The Refill Shop of Ikigai, said: "It was a complete surprise and a great honour to win the award. We have worked really hard to ensure everything we do has a positive impact on our planet, and that we do what we can help others to do their bit for our environment too." Martin added: "It was a truly inspirational event to attend, with so many people doing such great work to protect our planet and do some good for our world.

• Needed at St Ives Library: Young Volunteers (12-18 years) are wanted to help with their Summer Reading Challenge. So if you enjoy working with others, why not join the Library over the Summer for a few hours each week talking to children about books they have read, handing out stickers and helping with activities. Please ask at the St Ives Library for a volunteer pack.

• The Repair Café event will again take place on 17th June, in the St Ives Methodist Church Hall from 1 pm to 4 pm. To book a slot for repair please email stivesrepaircafe@gmail.com or use voicemail 07377 014401 or you can take your broken items on the day ready for assessment and repair at a later date. So pop in and enjoy drinks and homemade cakes! This event is an initiative of the St Ives eco action group.

• COSI are holding a Summer Concert on 9th July to celebrate the Coronation of King Charles III. The Chamber Orchestra of St Ives will be performing a programme of twentieth-century British and regional music. • ST IVES CORN EXCHANGE ASBESTOS ROOF REPLACEMENT WORKS

The St Ives Corn Exchange community building in the centre of town will be undergoing major renovation work. As part of the Town Council’s ongoing commitment to maintain the historic character and integrity of their properties, the asbestos roof sheets above the main hall have reached the end of their life and need to be replaced. Following Planning, Listed Building and stakeholder engagement and consent, the roof finishes are to be replaced Whilst works to replace the existing roof sheets with another is a relatively modest scheme, the challenge of access, health & safety and keeping as many facilities open for the community simultaneously to the works, means that the Riverport Café and main hall balcony will be closed from Monday 24th July 2023 to 29th September 2023 whilst the roof sheets are replaced. All other facilitates and the building as a whole will remain open for the duration of the works. However, an alternative coffee shop provision will be provided. More details will be posted and available for your information closer to works being undertaken. TOWN SURVEY: WHAT FEATURES OF ST IVES SHOULD WE PROTECT?

That St Ivians care about their town has been evident in many ways in its past. The recent Master Plan document as an example generated comments about why a generic planning approach to revitalising the town centre is not good enough, that there is a greater need for a balanced approach which develops its future whilst protecting its much loved character and heritage.

The Civic Society is proud of its long engagement with town planning and endorses the listing of its significant historic buildings, bridges, its chapel etc and now thinks the time is right to prepare a conservation schedule which shines a spotlight on the local features in your neighbourhood - so please let me know what features exist in your area which you would like saved for the future?

This might be something historic, or a more contemporary feature which deserves recognition: possibly a neglected public footpath or common space, an interesting piece of street furniture, a shop frontage or set of gates, a telephone box which could be converted to something useful for your community, or perhaps a building which deserves a blue plaque to honour its history.

You can contact me on the Society’s website stivescivicsociety.org.uk or come along to the June talk and add your suggestions to the conservation list you will find on the registration table. We’ll add your suggestions to those we have already gathered and will publish the final list later this year before it is submitted to be part of the Neighbourhood Plan for St Ives.
