A LETTER TO OUR READERS

Very recently I was given the privilege of getting a tour of Pure Hemp and their facilities. For those of you who don’t know them, you should definitely start paying attention. They have an amazing facility that is bio-refining Colorado-grown hemp into sugars, lignin and pulp. These three substances are basically the building blocks for thousands of hemp products. While sitting in their conference room several thoughts occurred to me. The first of which was how many brilliant, passionate individuals are collaborating on how to best create an entirely new manufacturing industry right here in Colorado. The other thought that came to mind is how different the marijuana and hemp industries are. In its inception the legal marijuana industry was fairly simple. Simple of course does not mean easy, especially when you account for the myriad regulations one has to navigate. But it is a fairly simple process to go from seed to sale. You grow your product, harvest it, trim it, cure it, and it is ready for sale. When looking at the hemp industry, you have to account for farmers trying to procure seeds at a reasonable price, facilities like Pure Hemp to process that raw material, then you have to find buyers to turn those substances into another product that could either be the final iteration ready for sale or yet another intermediate substance to be sold and modified yet again. The amount of moving parts one has to navigate just to turn that hemp into a finished product can be staggering. You then have to account for the fact that it is much harder to reach the consumer in all of the markets hemp can infiltrate. With marijuana, there was already a very active consumer base that couldn’t wait to purchase a legal product. No more back ally purchases. No more visits to a dirty dealer’s house in which you didn’t even know if the weed you bought was what they said it was. With hemp, we are talking about shifting the consumer’s perception of products they already purchase. They need to be educated that there’s an alternative that’s better than what they are used to buying. We have to create more converts. And when you talk about the many amazing industrial uses of hemp, you have to convince huge corporations that there is a better source material out there for them to use. Many of the large corporations that can take advantage of hemp are generally much slower to make decisions like this without seeing that the proof is in the pudding, so to speak. I’m not saying all of this to paint a grim picture of the where the hemp industry is going. Rather, I want you all to understand that it is going to take a longer time to get it to where we all would like to see it. I actually left the tour of Pure Vision feeling incredibly encouraged. There is an amazing group of people out there that are thinking of all the challenges I have laid out and many more I can’t even comprehend. The creation of an entire agricultural and manufacturing industry is happening right now. This is something that we haven’t seen in America since the industrial revolution. In addition we have the benefit of hindsight to grow this industry the right way for the 21st century. While there are some truly great thinkers building this from the ground up (literally) there is a part of the equation where you and I can make a difference. One might say it is the most important part of the emerging industry. It is our job to create as much demand for hemp products as possible. Start buying as many hemp products as you can. Spread the word to your friends to do the same. Contact the major car companies to tell them to start using hemp. Do the same with clothing companies. The list goes on. Let’s make 2016 the year of hemp. The hemp industry is like a hundred-car freight train. It will take a lot of energy to get it out of the station and up to speed but when we do, it will be unstoppable. Free the plant, save the planet.

This Colorado original 6 Arm Bubbler by TreeHouse Glass, a local Berthoud company, provides a great experience to cannabis consumers of any category. Interestingly, TreeHouse Glass is run solely by the three owners who also operate as the company’s fulltime glassblowers. The 6 Arm Bubbler piece stands around 11 inches tall, the perfect size for a daily bubbler, and the thickness of the glass is noticeable. When you hold the bubbler it feels like it was made well and I appreciated the tiny details they included such as connecting the percolator arms to help with strength and stability. The TreeHouse Glass logo is also pretty great — a childhood tree house with birds perched and a tire swing hanging from the tree — located on the center of the piece, which adds a fun touch to a more scientific piece of glass. When I took my first rip of flower using their 18mm martinistyle bowl I was immediately impressed with the diffusion and the smoothness of the hit. Exhalation came with no harshness and great flavor, and the chug or draw on the piece was perfect. To give the piece some extra variety, I decided to give it a try as an oil rig. Switching out the 18mm martini bowl with one of my existing 18mm drop down attachments and a quartz nail was easy, and it fit with no issue. The result of my first dab with the TreeHouse piece was equally impressive. The diffusion of the six percolator arms was noticeable and the flavor of the dab was fantastic. Inside the Indo Expo
On January 30 and 31, the third Indo Expo will once more be taking over the Denver Mart for another sold-out show. As in shows past, the Indo Expo will offer cannabusinesses and ganjapreneurs the opportunity to mix, mingle and educate on all things related to the industry. In just over a year of operation, the expo has quickly become the premier business-to-business trade show in Colorado, positioning itself on the forefront of the legal cannabis wave. It’s a lofty claim to make, but with two shows a year and a swelling exhibitor list, Indo Expo seems to be doing just that. “So much of the industry exists here,” says Indo Expo Executive Director Chris Olson. With Colorado at the forefront of legal cannabis, the premier business expo in the state would seem to win the title of premier business expo in the country, if not the world, and Olson is working hard to make that happen. “It’s growing, it’s getting stronger,” says Olson. “It seems that we’ve won the trade show battle here in Colorado.” Olson’s sentiment is not undue arrogance, though. The booming medical, adult-use and hemp markets have drawn a plethora of trade shows highlighting every aspect of legal cannabis and a variety of essential and ancillary products, often to an overwhelming degree. It can be a confusing mess for those looking for the definitive source on legal cannabis, with traveling trade shows setting up shop anywhere there is opportunity. But unlike other shows, Olson says it’s the connection to the players in Colorado, and the hard work that goes into it that truly sets Indo Expo apart from the crowd. It’s the boots on the ground, building relationships with the frontline manufacturers, growers, industry front-

runners and business leaders that makes Indo Expo shine. “We’re very Colorado strong,” says Olson. “I think the main thing that separates us from the other shows is that we’re really connected to the industry here.” This year’s event continues the trend of sold out shows. With the largest turn out yet, over 75 vendors will be in attendance, offering products and services ranging from cutting-edge grow tech, to business and security services. It’s an opportunity for those within the industry to learn from and network with one another, and an opportunity for those curious about legal cannabis to stand on the precipice of innovation. “As the industry evolves, the show needs to evolve with it,” says Olson, and this year’s event will reflect changes that have occurred in this nascent industry since Indo Expo’s first showing in November 2014. Notably, says Olson, this means addressing the issue of improper pesticide usage, a topic that will be addressed by vendors as well as the wealth of speakers giving seminars. On that subject, this year’s expo will feature notables in the fields of business, marketing and security, as well as grow legends such as Ed Rosenthal, Adam Dunn and Bubba Kush. It looks as though the Indo Expo will once again set the standard of B2B trade shows going into the new year. For anyone curious about the industry, or just looking to strengthen their understanding and make new connections, the Indo Expo is likely the best opportunity one will have to do so. Say what you will about social media but it may be one of the most important means of connection between humans these days. The term “word of mouth” has a slightly different meaning these days because that now involves the internet being one of those sources. Without a lovely little app we call Instagram, I might not have taught myself this month’s artist and his artist collective. One picture led to link, leading to a website, to an email address, which ultimately got me in touch with Peter Westermann of Threyda. This local artist was enthusiastic, cooperative and grateful to be in THC’s January issue. As a Denver-based artist, what do you love so much about the Mile High City? There certainly are a lot of things to love about Denver. I really appreciate seeing the mountains and expansive skies every day when I’m out and about, but more than anything the people here make all the difference. Besides being friendly and pleasant, I find that they are some of the most open and interested in the arts, creativity and new ideas that I’ve seen. It’s very easy to find passionate support here for creativity and craftsmanship. I’m still often surprised how receptive people are to my work here.

than myself for a good number of years at this point. My main goal was to assemble a team of highly skilled and modern artists to help show people art and clothing in ways they hadn’t seen before. I wanted to somehow alert more people to the amazing things happening in the current world of art. There are a lot of misconceptions people have about what modern art is like these days. A while ago we reached a point where there are so many different talented creators in the world making so many things that people lost track of what was really happening in the grand scheme of things. Just like music there is something being made for everyone if you are willing to look, and it’s exciting to help people find the style of artwork that speaks to them most. Does Threyda have a home base, office and/or store front? We haven’t had a store yet due to moving around a lot and wanting to keep things simple and online at first. I’ve run the business out of my home in three different locations now, which is just now coming to an end. We recently started moving into our first dedicated office space in Denver. We’re hoping to open the first retail location close to downtown sometime in 2016.
Your work is beautiful and inspiring. Can you talk about the artistry process a bit? (i.e. mediums used, technique, etc?)
Who is one of your biggest influences, someone who you would be honored to collaborate with?
My process fluctuates often because I enjoy trying to constantly shift things to keep finding my next formula. Right now I’m doing a lot of work with paint and my digital drawing tablet. I have a few different mediums I’ve put serious time into at this point, and they have all been mixing in whatever ways seem constructive for that particular idea. Each medium has its own strength and I’ve had a lot of fun trying to explore how they can combine to result in something special. As far as my technique goes, I like to try and be as intuitive as possible – not over thinking things and letting my subconscious call the shots on what to do next.
I’d have to say the band Tool is one of my biggest influences in getting me on the path I’m on now. The list of artists I’d be honored to collaborate with is huge, there’re so many people to look up to right now. Someone that randomly comes to mind would be James Jean; I’m amazed at the level of mastery and diversity he shows in all his work.
What helps you get in your artist groove? Music, exercise, cannabis, nature? Music is a huge source of creativity energy for me. Just hand me some creative tools and put on my favorite soundtrack and I’m ready to roll. It’s connected to the visual arts in a very profound way and they inform each other on a lot of different levels, it’s easy to see this at play in many creative people. While I’ve always had that drive to create things, finding out about cannabis certainly gave me many new angles for how to think about what I was doing. It’s also a great way for some of us artists to keep focus and find a new type of attention to detail. You are the founder of the art collective Threyda. Tell us a bit about getting that going, how long has it been in existence and your vision for this. Threyda was a concept I came up with about six years ago. I was a few short years into doing my art full time and was very interested in starting some type of art and clothing related project. I had dreams of being an Art Director and doing something bigger

Do you have any advice for aspiring artists? Make creating things your number one habit! Don’t stop trying new things and looking to improve on your skills from every angle. I think the “always the student” mentality is one that will get people the furthest – there is always more to learn and new things you can do. Getting stuck with certain habits or mindsets can often be harmful in a creative journey. Where are your works displayed? Galleries, online, coffee shops? I’ve dabbled in a few shows here and there lately but nothing permanent until we get the first retail spot all finished for Threyda. Sweet Mary Jane has been consistently making delicious gourmet edibles for over five years now. In every edible they make you can see a lot of originality and love. I was amped to sample their True Confections as this little gem of an edible took home third place in the 4th Annual THC Championship. True Confections is a generous layer of peanut butter sandwiched between bittersweet chocolate and a salty pretzel. While I loved the bite size treat I found myself wanting just a little more of the delicious chocolate and a little less peanut butter. The salt in the pretzel however helped balance the edible to bring it all home. Each of the four bites per package contained 25 mgs of THC. The effects were extremely consistent. Activation would kick in right around 45-60 minutes each time I sampled. I also found True Confections to have a very even hybrid affect with moderate pain relief, making it a great “any occasion” type of product. Over the past few months, I have made a few lifestyle changes. One of these changes is the movement to a healthier diet. In the area of cannabis infused edibles, there isn’t a vast selection of healthy choices currently available in the marketplace. Igadi’s Granola Bites are a pleasant diversion from the infused cookies and brownies, medicated chocolates, gummies and other “not-so-health-conscious” options available at local dispensaries. The ingredients in the granola bites are pretty much top notch. Igadi uses brown sugar and agave for sweetness instead of bleached white sugar. That’s a huge plus in my household. The bulk of the granola bite is Pumpkin Seeds, Almonds, Dried Apricots and Dried Cranberries with Oats, Flax and Chia Seeds throughout. The granola bites come four to a container and contain 25 mg of THC in each bite for a total dosage of 100mg THC per container. Packaging is a simple food-grade container in black with an attached label. The granola bites were used as part of my new diet and workout regimen. I ate two bites at 6:00 a.m. as I was preparing to head to the gym for an upper body weightlifting and aerobics workout. An hour later, as I was stretching and preparing for the weight lifting session, the THC from the granola bites had started to kick in. I’ve had a love hate relationship with vape pens since they came out. Hemp Eats Greek Salad with Hemp Oil Dressing Serves 4 Salad Ingredients: 4 cups mixed greens 1/2 cucumber, chopped 1/2 cup pitted and drained Kalamata olives, halved lengthwise 1/2 cup feta cheese, crumbled 1/2 cup artichoke hearts, roughly chopped 1/4 cup sun dried tomatoes, roughly chopped 1/2 cup toasted hemp seeds (can buy toasted, see page 23, or follow recipe below) Dressing Ingredients: 1/2 cup red wine vinegar 1 Tablespoon fresh chopped basil (1 teaspoon dried) 1 teaspoon fresh chopped oregano (or 1/2 teaspoon dried) 3 Tablespoons lemon juice 3/4 cup hemp oil 2 Tablespoons feta Freshly ground pepper or sea salt
Directions: Start by toasting the hemp seeds. Warm a skillet over low heat. Add 1/2 cup hemp seeds. Stir constantly, for about 2 - 3 minutes until they start to brown and become a bit fragrant. Be careful not to burn. Remove from heat when done. In a large serving bowl, add the mixed greens, olives and other vegetables.
Sweet Hemp Oatmeal Pomegranate Cookies Makes about 2 dozen Ingredients: 3 Tablespoons room temperature butter 1/2 cup brown sugar 1/4 cup raw, unfiltered honey 1 egg 1 Tablespoon water 1/4 cup flour 1/2 teaspoon sea salt 1/4 teaspoon baking soda 1/4 teaspoon cinnamon 1/8 teaspoon nutmeg 1 1/2 cups rolled oats 1/4 cup hemp seeds 1/4 pomegranate seeds hemp oil for greasing pan
Directions: Heat oven to 350째F. Lightly grease a cookie sheet with hemp oil, about 1/2 Tablespoon depending on the size of your pan. In a large mixing bowl, combine butter, brown sugar, honey, egg and water until smooth. In a different mixing bowl, combine flour, salt, baking soda, cinnamon and nutmeg. Sift all of these together. Add the oats in and mix. Next, slowly add the dry ingredients to the wet mixture. Fold in hemp hearts and pomegrante seeds. Using a Tablespoon, drop dough onto greased cookie sheet. Bake 12-13 minutes, until the bottoms are golden brown.

Mailing Cannabis Publications Declared Illegal Officials with the U.S. Postal Service have declared the mailing of publications containing ads for medical or adult-use marijuana to be a violation of federal law. An advisory issued to the Chinook Observer out of Long Beach, Washington asserts that mailing ads for marijuana businesses, and the publications that contain them, violates Postal Service standards and is a potential felony due to the Schedule I status of the plant under federal law. Dispensaries in Colorado are currently barred from advertising out of state, but this interpretation of the law means that mailing publications such as The Hemp Connoisseur, even within state boundaries, could potentially bring legal consequences. What measures are in place to enforce this assertion remains unclear, though the advisory mentions the responsibility for enforcing the Controlled Substances Act falling on the DEA. U.S. mail is protected under the Fourth Amendment, and a warrant is therefore required if law enforcement officers seek to open any parcel suspected to contain illegal materials.
DEA Eases Restrictions on CBD Research
lawsuit brought against the state of Colorado by neighboring Nebraska and Oklahoma regarding legalization of marijuana in the state. The lawsuit, filed by the Nebraska and Oklahoma Attorney Generals, alleges that legalization of marijuana in Colorado has negatively impacted the plaintiff states as a result of state-legal marijuana crossing the border. “Entering the type of dispute at issue here -- essentially that one state’s laws make it more likely that third parties will violate federal and state law in another state -- would represent a substantial and unwarranted expansion of this Court’s” jurisdiction, Verilli wrote in the brief, according to CNN. Despite this development, Oklahoma Attorney General Scott Pruitt has stated that he intends to keep pursuing the lawsuit. Whether or not the Supreme Court will hear the case remains to be seen as of this writing.
North Dakota Hemp Pilot Program Shows Promise A test crop of hemp grown by researchers at the North Dakota State University Langdon Research Extension Center shows promise for the crop in the state. Researchers planted 12 varieties of hemp from Canada, Australia and France in order to discern which would be best suited for farming in North Dakota.
Researchers studying the effects of cannabidiol will have a slightly easier time accessing the cannabinoid thanks to a relaxation in the DEA policy. Researchers will now be able to apply for a waiver to expand their studies beyond their DEA and FDA approved outlines, without requiring additional approval from these regulating bodies.
Results of the program showed that grain and fiber yields were comparable in the Canadian crop to those grown in Canada, while French varieties that require seeding later in the year produced fiber more readily than grain. An Australian variety, which had the shortest season of all types, produced the greatest fiber yield, but did not produce grain at all.
Currently, such research is supplied by federally approved sources such as the National Institute for Drug Abuse and a number of pharmaceutical companies that develop CBD isolates. Although many companies in Colorado currently produce CBD extracts, these do not meet federal standards and will not be affected by this decision. However, some 76 studies currently underway could benefit from the decision, according to The Denver Post.
“It’s a start. But there’s still a lot of research to be done,” said researcher Bryan Hanson, according to The Dickinson Press.
Hemp Growing Too Well in Canada The Winnipeg-based Manitoba Harvest company is reporting that 2015’s hemp harvest has outpaced projections by two to five times. Expecting a yield of 200 to 500 pounds of hemp per acre, the company was surprised to find their farms returning as much as 1000 pounds per acre. Manitoba Harvest generally buys up to 75 percent of Western Canada’s hemp crop, according to the Winnipeg Free Press, but will significantly scale back plans for next year’s crop due to the glut of hemp harvested last year. This decision comes in spite of the fact that the company has seen a 30 to 40 percent increase in hemp sales, according to a company spokesperson.
Obama Administration Advises Supreme Court Against Hearing NE/OK Lawsuit A brief filed by Obama administration Solicitor General Donald B. Verrilli, Jr. last month urged justices of the Supreme Court to decline hearing the

North Dakota became the first state in the country to legalize hemp farming in 1999, but the industry lay dormant until the passage of the 2014 Farm Bill granted states authorization to conduct pilot programs and prompted the passage of North Dakota’s House Bill 1436 in 2015, which created a regulatory framework for the hemp industry in the state.
Debate Over Impact of Marijuana on Colorado Tourism A study commissioned by the Colorado Tourism Office seems to indicate that marijuana may be a contributing factor in the surge of tourism the state has seen over the past two years. A questionnaire given to potential visitors intended to test the effectiveness of the state tourism office’s $5.3 million “Come to Life” ad campaign revealed that marijuana legalization influenced vacation decisions in 49 percent of respondents. While this number seems to fly in the face of tourism officials, who have previously denied that legalizing the most widely used illegal substance in the world would draw visitors to the state, only eight percent of responders who traveled to Colorado claimed to have actually visited an adult-use dispensary. The figures have created some debate with Colorado Tourism Office officials, who maintain that the number of people visiting the state as a result of the more progressive marijuana laws is an insignificant fraction of total visitors.
Across the Globe Mexico Issues Permits to Grow Cannabis The Mexican government has issued the first ever permits to grow and possess marijuana for personal use. The permits were issued to the four plaintiffs in a recent Supreme Court decision, which ruled that using marijuana is covered under the right of “free development of personality.” However, the ruling and the permits extend only to the four plaintiffs, and the decision does not represent a full legalization of cannabis in the country. In response to this development, Mexican president Enrique Peña Nieto has stated clearly that he opposes legalization, saying, “I am not in favor because it has been proven, demonstrated, that consuming this substance damages the health of children and youths,” according to The Guardian. A national debate around the issue is scheduled to occur sometime this month, which will include public comments and input from experts on the topic.
Marijuana Policy Project Banned in Mississippi The Marijuana Policy Project, one of the nation’s foremost advocacy groups working to legalize cannabis, has been effectively banned in the state of Mississippi. The state government has decided that MPP is not allowed to claim non-profit status in Mississippi and is barred from collecting any funds in the state, and as a result the organization will likely have some difficulty disputing the pronouncement. The decision is the result of MPP Executive Director Rob Kampia’s previous felony conviction, the result of an arrest more than 20 years ago for growing marijuana. “After I was convicted for growing my own marijuana while in college, I co-founded MPP in order to repeal marijuana prohibition in all 50 states — something we can no longer do in Mississippi,” wrote Kampia in a statement on the MPP blog.
Air Canada to Allow Medical Cannabis Patients to Carry Medicine Following an incident in which a medical marijuana patient was denied the ability to board a flight, and the subsequent fallout, Air Canada has announced that it has amended its policy on medical cannabis. Michael Korchak was flying from Halifax to Toronto with his prescribed medication when he was stopped at the gate and told he would not be allowed to board unless he relinquished his cannabis. Korchak eventually relented and purchased a ticket for a flight through a different airline, on which he flew without issue. “I was really embarrassed,” Korchak told Canada’s CTV News. “I have never really felt like I was a victim of discrimination before. This was the first time, and it was awful.” Since the incident has gone public, Air Canada has claimed that the airline has changed its policy to allow for medical marijuana in flower form in addition to pill form, provided it is accompanied by the necessary documentation. The airline also claims it will grant Korchak a full refund for his flight.
Lax Marijuana Laws May Lead to Stricter Workplaces A survey conducted by the Society for Human Resources Management seems to indicate that businesses operating in states with adult-use cannabis laws have stricter policies regarding cannabis use than those in states with medical cannabis only. According to the survey, 82 percent of the companies queried in legal adult-use states had zero-tolerance policies in place regarding the usage of marijuana, versus just 73 percent of companies in medical-only states.
The MPP is soliciting help from supporters in surrounding states to assist in fighting the decision.
Additionally, the survey found that companies operating in medical-only states were more likely to have exemptions in their marijuana policy, with 22 percent of respondents claiming an exception for medical use versus just 11 percent in adult-use states.
Omaha Tribe Planning to Grow Hemp
Drug Policies Failing
The federally recognized Omaha Tribe, which occupies a reservation on the Nebraska-Iowa border, has decided to move away from plans to legalize adult-use marijuana in favor of industrial hemp. The decision comes after federal raids on tribal marijuana grows in California, and the choice made by the Flandreau Santee Sioux in South Dakota to suspend plans for retail sales of marijuana that would have begun this month. The Omaha Tribe has also faced strong opposition from Nebraska’s U.S. Attorney Deborah Gilg, who vowed to take prosecutorial action if the tribe proceeded with legalization and sales of marijuana.
According to data from the Government Accountability Office, current goals in the reduction of drug use and associated deaths set by the Office of National Drug Control Policy are being missed by a wide margin. The goals initially set by the ONDCP in 2010 sought to reduce monthly drug use, chronic drug use, drug-induced death and disease, and drugged driving by 10 to 15 percent by 2015. While data for 2015 is not yet available, this goal looks to go unmet, with drug-related deaths increasing substantially from 2009.
In November, the tribal officials voted to explore the potential economic opportunities of legalizing cannabis on the reservation that, despite being home to a casino, has an unemployment rate of 69 percent. The move came nearly a year after a memo to all U.S. Attorneys —including Gilg— from the Justice Department seemed to grant tribes the same sovereignty on the issue of cannabis as states, which have thus far been uninterrupted by federal officials in operating legal marijuana programs.
However, the ONDCP claims that the goals would have been met had marijuana usage been removed from consideration. “The apparent lack of progress on several other measures is entirely attributable to the increase in marijuana use in recent years,” ONDCP press secretary Mario Moreno Zepeda told The Washington Post. The ONDCP oversees all federal drug control spending, which is projected to hit a record high of $27.6 billion in 2016.

THC Championship Crowning the Best in Colorado Cannabis

On December 13, 2015, the fourth annual THC Championship Awards were held at the Cervantes Masterpiece Ballroom in Denver. The private, industryonly event was a chance for many in the Colorado cannabis community to get together and enjoy a night of drinks and great live music while celebrating each others’ efforts in the only legally operated cannabis competition open to adult-use and medical judges in the state. The event featured awards in a variety of categories including Overall Champion, Best Edible, Adult-Use and MedicalUse Sativa and Indica as well as awards for Best Shatter, Solvent-less Concentrate and Wax. Some of Colorado’s best cannabis companies were present at the event including Denver Rec, Green Man Cannabis, The Herbal Cure, Incredibles, Craft 710, Sweet Mary Jane, Dabble Extracts and others. The award ceremony also featured a raffle for the participating judges with some of the prize packages featuring gear by Cloud Pen, rigs and flower pieces by Purr, and various clothing and accessories by Chiefton Supply Co. The environment was lively and provided everyone from the Colorado cannabis companies a chance to relax and enjoy a night of recognition for the hard work the people involved put in to make the industry so successful. The judges had a full 30 days to blind test the samples from all of the categories, make their informed decisions and submit their votes. Lab testing and connoisseur judges with level two interprener certification were also part of the scoring consideration at this years event. This year’s event featured a new addition to the previous champion list and for the first time in the THC Championship history a flower entry won the Overall Champion award. Green Man Cannabis earned the top honor for their strain Star Killer, which also took home the award for best Medical Hybrid. During a conversation with Corey Buffkin, the owner of Green Man Cannabis, he relayed his love and passion for cannabis and how proud he was of his team for bringing home multiple awards at this year’s event. Corey mentioned, “It feels really good to have the best bud in any competition that is being blind tested. It’s validation for the grind we go through day in and day out, and shows us we are staying consistent.”

Consistency proved to be the common theme of the night for Corey and Green Man Cannabis as they also took home the award for Adult-Use Hybrid with their strain Motor Breath. The edibles category was dominated by Incredibles with their Affogato bar winning Best Edible and their Black Cherry 50/50 CBD bar winning for Best CBD Edible. Denver Rec took home the awards for both Adult-Use Sativa and Adult-Use Indica with their strains Cookie Dough and Pure Kush. The Herbal Cure and their strains Lemon Skunk and OG Kush won the awards for best Medical Sativa and Indica. Dabble Extracts took home the victory in the shatter category for their Gelato and Extracted Colorado took home the Solvent-less award for their Scotty’s Sour G Rosin Tech. Critical Cure by EndoCanna won the award for best CBD Extract and Craft 710 won the Wax/Budder category with their Lemon G. New companies in the Colorado cannabis industry, including Dabble Extracts, who won the award for best shatter, were able to have their business and products validated by a community of experts. In an interview with the Dabble Extracts team following their win, owner Joshua Hindi mentioned Dabble’s goals of making sure “it is the cleanest possible product we can put in front of a patient so that they truly experience all of the medicinal benefits without any of the possible negative aspects of a dirty concentrate, and to make sure there is a concentrate out there I would feel comfortable giving to a family member.” The 2015 THC Championship awards were a great success for everyone involved. With turnout growing every year, the future of Colorado’s premier cannabis competition is only getting brighter. Star Killer by Green Man Cannabis reigned supreme at this year’s event, but everyone involved could count themselves as winners in knowing that they are making a difference in the Colorado cannabis community for medical patients and recreational consumers alike by producing high-quality products that people can feel good about.

The Push Toward the Industrial Hemp Farming Act by DJ Reetz
Changing the political course in America is no easy feat, especially when it comes to cannabis. After nearly a century of misinformation, building support from voters and the legislators they elect presents a daunting task. In January of 2015, just such a daunting task was proposed with the introduction of the Industrial Hemp Farming Act of 2015, which is aimed at once and for all legally severing hemp from marijuana. The bill would unshackle this foundational American industry, allowing the crop to be grown similarly to all other agricultural crops, without the added scrutiny and restrictions currently hanging over it as part of the 2014 Farm Bill. But change like this does not come easy, and while opinions are certainly shifting, the battle has not yet been won. “The challenge is that from the federal perspective… there’s no distinction between marijuana and hemp. So from their perspective it’s all marijuana, it’s all a Schedule I drug and it’s all illegal. So that’s where they start,” says Zev Paiss, Executive Director of the National Hemp Association. Currently, the NHA is behind an educational campaign that the organization hopes will help address this issue: a cross-country bus tour powered by hemp biofuel intended to spread awareness for the myriad applications and economic potentials provided by hemp, and the need for a clearer legal distinction between hemp and marijuana. The bus tour will shadow the presidential caucuses, providing education to those places gripped with the political fervor stirred by the presidential race. “So much of this is education, just letting people understand that industrial hemp is different than marijuana,” says Paiss. While educating voters is an essential part of the political process, educating lawmakers is an equally integral, if not even more important, piece of the puzzle. To this end, the campaign has acquired the services of the veteran communication and lobbying firm Grayling. If these two components can meet, lawmakers will get a crash course on hemp while being confronted with a voter base more educated on the topic than ever before, making support for the Industrial Hemp Farming Act not just common sense, but a political necessity. But pulling at the riggings of American politics can’t be done with good intentions alone, and to that end the NHA is reliant on the donations of hemp supporters and the companies that make up this emerging industry. Chief amongst the supporters is Colorado’s own Bluebird Botanicals, which has pledged $35,000 to the campaign. Bluebird currently offers a line of CBD extracts that, despite being headquartered in a legal hemp state, the company imports from European sources, a byproduct of the murky legality surrounding the interstate commerce of these cannabis extracts. Passage of the Industrial Hemp Farming Act would open the doors to more local options for Bluebird and companies like it to source their extracts locally, without fear of running afoul of overzealous drug warriors. “If we pass this we wouldn’t be dependant on our European sources. Right now, to be able to sell nationwide, we’re dependent on farms across the world that I can’t always oversee,” says Brandon Beatty, founder of the company. “If we were to make it fully legal in the

United States, that would allow Bluebird to sell locally grown stuff nationwide and not be dependent on all the other farms. But then on a more broad scale, outside of Bluebird, I truly think it’s going to have a huge economic impact on the country.” For Beatty, the bill represents both the opportunity to further his own professional goals and to push a socially progressive agenda that will benefit the country as a whole. “It is both. Admittedly this will definitely benefit Bluebird, that’s part of the reason that I can go forward with it with such confidence and pour a certain amount of money into it without regret at all,” he says. “But the broader picture is huge.” “We really do need to change the way that we live in order to make sure that this planet is here for my grandchildren, so that is absolutely an inspiration for us doing this. I do believe in hemp, I do believe hemp can really help this world and help people,” says Beatty. Bluebird is offering not just its financial contribution to the cause, but is also soliciting its own member network for support, a network that Beatty says is in the range of some 15,000 email subscribers, but also includes the thousands of unique visitors the company’s website gets every day. With the support of innumerable enthusiastic hemp aficionados, the campaign could truly begin the cultural revolution, awakening this sleeping titan of industry, stirring economic development in fields from farming and manufacturing to technology and wellness. As Beatty sees it, the passage of this bill could spur growth that would outpace that seen in the burgeoning legal marijuana market, a market that is currently valued at an order of magnitude larger than that of domestic hemp. “I think that could be the opposite; hemp has so many different applications that it should be hugely more valuable than marijuana at a certain point,” says Beatty, rattling off some of the myriad uses that range from textiles to bioplastics. “At the same time passing the act would help… give confidence to the industry. Right now people are one foot in, one foot out, not sure if the DEA’s going to come into this state, do this. So people aren’t investing as they would be, they aren’t growing their companies, pouring their money back into their companies as they would be if they knew it was fully legal,” says, Beatty. “Once it’s fully legal we can really just build the industry to its potential.” In the end, the success of the NHA campaign and the Industrial Hemp Farming Act itself will rely on the ability of those in the know to elucidate the topic for those still under the yoke of cannabis ignorance. For companies like Bluebird, the task is equal parts shrewd business decision and civic duty. “We can all work together at this point to support the industry as a whole and make sure that we can all have companies 10 years from now, 20 years from now, and that no one can rip the rug out from underneath us,” says Beatty. “We plan to play an integral part in getting this passed. We’re going to continue, at least for the next year, to make this a big part of our business. We’re going to pour our resources, time, energy and money into this.”

“W
hat is the safest way to smoke pot?” is a question I get asked pretty frequently. Lives lost to cigarettes are a reality in America, resulting in a cultural fear of smoking. The relative safety of cannabis smoke compared to tobacco smoke isn’t always enough to overcome this. So while “Out of sight of New Jersey Governor Chris Christie!” is my favorite answer, not all smoke is created equal. Smoking, vaporizing and concentrates all have pros and cons. Let’s go through all three. Pot smoking is a time-honored tradition in many cultures for good reasons: 1) Heating the plant material activates the THC. 2) Smoking is a pleasant social ritual. 3) Inhaled cannabis takes effect quickly. 4) If you feel too high just pass the pipe on; the effects don’t last very long. Before the turn of the century, pot smoking used to be about buds and hash. If you were really hip, you could sprinkle some hash on your bud. But new methods of hash making, cannabis extractions, and vaporizers have complicated matters. For all their simplicity, joints, pipes and bongs aren’t very efficient at transferring the THC to your brain. Lighting your beautiful dispensary buds with a 500+ degree blast from your handy Bic destroys at least half the material upon contact, lost forever to heat and flame. Another 25 percent is lost to exhalation, leaving a paltry 10-25 percent of the original cannabinoids available for absorption by the body. Some of that remaining material forms new compounds through the process of heating and smoking. Analysis of cannabis smoke reveals it contains carcinogens and toxic by-products also found in tobacco smoke, such as carbon monoxide, polycyclic aromatic hydrocarbons (PAHs), and tar. Since dabs come in various consistencies of concentrates, it doesn’t matter if it’s BHO in a vape pen or nucleated propane wax: residual solvents leftover from the extraction process may be present. How Concentrates Are Made Hydrocarbon extractions use a solvent such as butane, hexane, propane, or carbon dioxide (CO2) to strip the trichomes from the buds and leaves. Gases become liquid under pressure and dissolve the trichomes off the plant material. Controlling the pressure and temperature during the process changes the potency and consistency of the end result. Afterward, the solvents must be evaporated off (called “purging”). This is why it’s not wise to make BHO at home: evaporating the butane without adequate ventilation can result in explosions. Commercial dab manufacturers use a purge oven or vacuum purge to safely heat and aerate the concentrate, allowing remaining solvents to evaporate off. Unfortunately, since hydrocarbon extraction is a newer process, many extraction systems are custom-made. Custom-made systems don’t come with a manufacturer’s table that displays settings for solvent type, temperature, or pressure, and the resulting residual levels of solvents. The same goes for purging processes. The only way to know is to test each batch of product. This can be costly and time-consuming. The simple athome test for residual solvents is easy: hold a dab near a flame. If it burns blue instead of just emitting wispy white smoke, it’s a “dirty dab”. CO2 extraction results in the lowest concentration of residual solvents of the hydrocarbon methods, but seems to have greater binding with residual pesticides and fungicides. When you concentrate the cannabinoids, the pesticides and fungicides are also concentrated. As such, a level of

Long-term tobacco smokers develop “smoker’s hack” when those membranes become irritated. There are some cases of similar irritation with long-term pot smoking. Like tobacco smoke, this generally resolves when the smoking activity is stopped for a while. Some believe the nasty PAHs are the result of the butane in the lighter reacting to the weed. They use wick to light their bowls. No data on that, but PAH levels in cannabis vapor are much lower than in smoke, so they may be on to something. Vaporizing cannabis as an alternative to smoking overcomes much of the inefficiency. The low- temperature vapor contains smaller quantities of toxic by-products, as well as a more efficient extraction of Δ9-THC from the cannabis material. Tests on cannabis vapor show 65-90 percent of the original cannabinoids are still present in the vapor, ready for inhalation. Even after accounting for exhalation loss, a robust 55 percent (average) of the originally present cannabinoids are bio-available in vaporized cannabis. You get a lot more bang for your buck. From a safety standpoint, vaporized whole flower cannabis is the best form of inhaled marijuana. So if vaporizing is safer and more efficient, then why the lingering fear? In a word: DABS. Vaporizing concentrates carries two risks not present with smoked or vaporized flower: Concentrated residual contaminants, and cannabinoid receptor oversaturation. Newer forms of cannabis concentrates such as butane hash oil (BHO) and other hydrocarbon-extracted oils such as those made with propane, can contain residual solvents and contaminants.
pesticide (organic or not) that would be acceptable in whole herb cannabis can suddenly become concentrated to an unacceptable level after CO2 extraction. Pesticide residue in edibles has been a news topic lately. Hopefully, this will lead us to better extraction and filtering methods to remove such residues. Does this mean all solvent-extracted dabs are “dirty”? No. Do all CO2 extracted dabs contain pesticides? Of course not. It means you need to be a careful consumer. Pass on a concentrate if it smells like lighter fluid. A CO2 extraction from a dispensary you trust is probably fine. Any concerns? Ask for lab test results. What Happens When That Dab Hits Your Brain Concentrates routinely test at 60-90 percent THC. Assuming an average 75 percent THC dab, and average total vapor bioavailability of 56 percent, your typical 1/10th of a gram dab delivers 40-45 milligrams of THC to your bloodstream in a single hit. Most non-dabbers reel when they calculate the doses dabs deliver, but there is appropriate dab use. On the medical side of marijuana, appropriate dab use is usually seen in patients with sudden onset acute episodic symptoms. Patients with conditions like migraines, cluster headaches, seizures, and muscle spasticity can sometimes avoid a potentially debilitating episode by taking a dab hit at the first hint of a coming attack. The high-dose of THC seems to “knock out” the episode before it really starts. Patients who are

dependent on cannabis to control their symptoms are a not a big concern; dependence and addiction are different things. Worrisome use is when the patient says they are compulsively using dabs whether or not they have symptoms. An example of a patient who is overusing dabs is one who typically had two to three migraine episodes per week, prior to starting dabs. If they now use dabs two to three times per week and have cut the number of fullblown migraine episodes down to one per week or fewer, that’s OK. But if the patient is now dabbing two to three times per day, every day, whether or not they feel a migraine coming on, then they my want to try something else. In the recreational realm, occasional dab use is also not a big concern. Problems start with that same compulsive use. A person dabbing several times per day, every day, may become so de-sensitized to the THC that they no longer get the same enjoyment from dabbing. That’s a sign of compulsive use. Danger Signs There are no dab studies on humans, but I did find a couple of high-dose cannabis studies involving rats. Studies of chronic, high-dose THC in the brains of rats show that the CB1 receptors can become over-saturated. This can cause the receptor to uncouple from its signaling cascade. The signaling cascade is part of the neuroprotective effect cannabinoids have on the brain. (Critical Review of Neurobiology 2003, SimSelley LJ1. “Regulation of cannabinoid CB1 receptors in the central nervous system by chronic cannabinoids”) In humans, known problems from chronic, high-dose THC use include: memory and attention problems, sleep disturbances, dizziness and disorientation, cognitive impairment, mood swings, low motivation, and low sex drive. But is the problem the THC or the residual contaminants in concentrates? In general, inhaled solvents do not seem to be damaging to the body with occasional use, but chronic use can result in neurological problems. Painter’s Syndrome is a form of chronic, solvent-based encephalopathy (read: brain damage) seen in people who work with inhaled organic solvents. It’s seen mostly in painters and furniture makers who work in

poorly ventilated shops. Solvents with lipophilic properties easily cross the blood-brain barrier. Cannabis is lipophilic, so it stands to reason residual solvents in a cannabis concentrate would have an easy time making it to your brain. The solvent residue affecting the brain is thought to be a reason some people get headaches from BHO vape pens but not CO2 oil vape pens. Painter’s Syndrome causes the exact same list of symptoms as chronic, highdose THC use. If you’re having any of the above symptoms, evaluate your concentrate use. Do you frequently use solventextracted concentrates? Can’t remember your last dab-free day? Are you using concentrates compulsively, regardless of symptoms or enjoyment? If any of these are true, it may be time for a cannabis vacation. No THC for at least two weeks, then reevaluate the symptoms. Still there? See a doctor. All better? Re-consider how and why you use cannabis. The long-term effects of cannabinoid receptor over-saturation are unknown. So Are Dabs Dangerous? We don’t know. There are no known cases of Painter’s Syndrome associated with cannabis concentrate use. Natural cannabis remains amazingly safe: no permanent negative effects from over-indulgence. Moderation appears to be key with receptor over-saturation. Studies on dabs and concentrates in the future may better answer these safety questions. Advances in extractions are happening quickly and I have high hopes that dab safety will only improve. The bottom line is this: occasional use of dabs from a trusted dispensary appears as safe as any other cannabis use. Use solvent-free dabs whenever possible. If you have any concerns about the safety of dabs, don’t use them. hese days the savvy prohibitionist is moving away from some of the outdated lines of bullshit that were foundational in the criminalization of cannabis. Sure, they may still be driven by the greed of their corporate masters to push socially harmful policies built around racism, bigotry and half-cocked scientific evidence, but the narrative is changing with the times to reflect a slightly less woefully ignorant populace. These days most of the prohibitionists who want to be taken seriously have dropped the “marijuana promotes violence” talking point in favor of something a little more in line with basic common sense, and some are even dropping the “marijuana will cause you to fail in life” argument in light of the wealth of successful public figures who admit to past or current use.

The times are changing, and most of the serious professional regressives will even concede that maybe people shouldn’t have their lives ruined because they happen to have a bit of plant matter in their possession. Instead the prohibitionist has moved on to a battle that is not yet lost. Having been so thoroughly trounced by basic reason thus far, the prohibitionists are now turning their efforts to preventing a legal market from taking hold, and chief amongst their arguments is the heartfelt desire to prevent another “Big Tobacco” from taking root.
Alter the product to make it even more unsafe to consume If manufacturers of legal cannabis want to meet the standards laid out by their tobacco slinging counterparts, they’re going to have to make some serious additions to their product in order to do so. This means adding things like ammonia to boost the effectiveness and addictiveness of their product.
Given the large amount of money that is being dumped into some legalization campaigns, such as that most recently seen in Ohio, the claim of disrupting the next Big Tobacco seems to hold a little bit more weight than it did when it was first leveled at grassroots activists fighting for social justice and personal freedom. Still, even with profit-driven capitalists steering the cannabis movement, there are a few key differences. So in order to help these prohibitionists’ views better line up with reality, here are a few things that manufacturers of legal cannabis can do to be more like the tobacco industry; because obviously hoping for the inverse would be foolish. Sell a highly addictive product Clearly, the number one thing that cannabis manufacturers could do to imitate tobacco companies is knowingly sell a highly addictive product, and then do their best to obfuscate that fact. Prohibitionists will say that this is already the case, and I wouldn’t make the claim that cannabis use is entirely free from the risk of dependence. According to the National Institute on Drug Abuse, dependency can develop in as much as nine percent of cannabis users. But NIDA also states that, “Most smokers use tobacco regularly because they are addicted to nicotine.” Since “most” is a larger percentage than less than one tenth, cannabis growers have some ground to cover when it comes to the addictiveness of their product. Addiction can most clearly be seen in the inability of users to cease usage, despite the knowledge that the substance they are using is harmful to them. In this regard, tobacco definitely outdoes cannabis. According to the World Health Organization, as many as 70 percent of tobacco smokers report the desire to quit, but less than one percent of smokers actually succeed without formal treatment. Shaking a marijuana addiction, on the other hand, is generally as easy as having your wealthy parents pay some dick a few thousand dollars to give you a stern talking to. But the issue here isn’t just the ridiculous disparity in the addictive properties of these two substances; it’s how honest manufacturers are in representing this potential. So as long as cannabis manufacturers deny that their product has any risk of dependency (even if it may be lower than tobacco, alcohol or prescription opioids) they still have a shot to fulfill the prohibitionists’ prophecy. The cannabis industry would also have to lie to Congress to make this comparison complete, as the top executives of the seven largest American tobacco companies did in 1994. Sell a product that kills people It’s a widely known fact that tobacco causes cancer. While some in the medical field are quick to associate smoking anything with lung cancer, the reality of the situation is that tobacco itself may be the true culprit. Inhalation of any kind of smoke causes exposure to harmful byproducts
According to the Centers for Disease Control, tobacco use causes some 480,000 premature deaths per year and is the single largest cause of preventable death in the US, resulting in $289 billion in annual economic costs. This accounts for one out of every five deaths in the United States, a slightly higher number than the roughly zero in five deaths attributed directly to cannabis use. In order to achieve the kind of mortality rate enjoyed by tobacco, half of all legal cannabis purchases would need to be accompanied by a .45 round to the face.
In order to match Big Tobacco’s menace to public health, Big Weed’s going to need to make some friends on Capitol Hill. Of course, by make friends I mean throw enough money at our elected officials...Reality According to the tobacco companies themselves, there are 599 known additives used in commercial cigarette production, mostly designed to increase the effect of nicotine and mask that shitty flavor of slow, uncomfortable death. The end result is a product that, according to the Surgeon General, is unhealthier than it was 50 years ago. If legal cannabis manufacturers want to catch up in this regard, they’re going to have put some serious research and development into making their product more addictive, and come up with some kind of bullshit marketing gimmick designed to make the product appear safer while actually increasing its harms — something along the lines of “light weed.” Make some powerful political friends In order to match Big Tobacco’s menace to public health, Big Weed’s going to need to make some friends on Capitol Hill. Of course, by make friends I mean throw enough money at our elected officials so that if they wanted to spend every one of their copious number of days off rolling naked in piles of money their floppy old-white-guy balls would never have to touch the same picture of Andrew Jackson twice. In 1998, shortly after their shenanigans had finally been exposed in the most public way possible, the tobacco industry spent a total of $73 million on lobbying and various political campaigns, according to the Center for Responsive Politics. This amount has waned in the intervening years, now that debate about the nature of tobacco products has been settled, but

still held at $14 million in 2014, a figure that includes paying some 165 lobbyists. And this money goes heavily to conservative politicians, the same ones who so strongly oppose reforming broken drug laws on the basis of their hypocritical “morality” and, of course, protecting public safety. Former Speaker of the House of Representatives John Boehner, who once replied to a NORML-supporting constituent with a statement saying, “I am unalterably opposed to the legalization of marijuana or any other FDA Schedule I drug. I remain concerned that legalization will result in increased abuse of all varieties of drugs, including alcohol,” received some $137,700 from the tobacco lobby during the 2013-2014 election cycle. In order to win the support of these (largely conservative) legislators, Big Weed is going to have to make it rain on these hoes like they were strippers in a rap video; which is to say, participate in the American political system in the customary manner. If the developing cannabis industry can just follow the steps outlined here, the potential to become a pillar of American industry on the scale of the Big Tobacco may yet emerge and prohibitionists will, for the first time in their storied careers obstructing progress and liberty, be proven right. It’s going to take hard work and a lack of morals, but if those in the cannabis industry can just shake that moral ideology that has so far bogged them down, perhaps national cannabis usage will approach the 43 percent mark that tobacco saw in 1964 when the Surgeon General first published a report addressing the health issues created by tobacco use. Though, we might have to make sure that homegrowing isn’t a continued part of any future legalization efforts, thereby ensuring that consumers won’t always have personal control of this relatively safe crop.

The Upcoming Changes To Colorado’s Cannabis Purchasing Laws by Samuel Farley

new, industry-wide bulletin that was released on December 8, 2015 presented some of the details for the new purchasing limit laws for legal cannabis sales in the state of Colorado. The new regulations shed some light on the upcoming purchasing limits for in-state and out-of-state purchasers. Currently, any person over the age of 21 who is a resident of the state of Colorado is able to purchase one ounce of cannabis or twentyeight grams (including edibles and concentrates). A single gram of concentrates equates to a single gram of cannabis and for edibles, one thousand milligrams of THC is equal to one gram of cannabis. Currently, people from other states visiting Colorado are legally able to buy a quarter ounce of cannabis and cannabis-infused products. The new regulations mandated by House Bill 141361, which are set to go into effect in October of 2016, aim to limit accidental overconsumption

Many questions come to mind when considering the reasoning behind these new purchasing limits. Although officials in the state of Colorado claim to be acting in the name of consumer safety, many disagree with the limitations. By comparison, citizens are not limited in the amount of alcohol they can purchase during a single transaction at a liquor store, yet it is assumed that regardless of the amount of alcohol an individual purchases that they have their own limitations and have the right to consume any amount of alcohol in their own home that they would like. Many argue the same rights should be given to those who prefer to use a drug that has been proven to be significantly safer than alcohol. If citizens aren’t limited to purchasing two bottles of whiskey or a single case of beer, then why should cannabis consumers face such strict limitations? Under the new rules, the purchase limits of one ounce for residents and ¼ ounce for non-residents remains, but the newly defined equivalency means that one ounce of flower is equal to eight grams of concentrate or 80 ten-milligram servings in edibles. This means that residents could only purchase eight grams of concentrate per transaction, while out-of-staters are limited to two grams, the equivalent of ¼ ounce of flower. Residents can purchase up to 800 milligrams of edibles, but non-residents will only be allowed 200 milligrams. Totals are considered in sum, so a resident that purchases a half ounce of flower would then be limited to purchasing four grams of concentrate in the same transaction, or the equivalent 400 milligram edible dosage. A non-resident purchasing an eighth of flower would then be limited to a single gram of concentrate or 100 milligrams in edible form. The new equation is: one ounce of flower = 8 grams concentrate = 800 milligram of edibles. This basic formula applies to the total purchase, with non-residents allowed one quarter of this. All proposed limits are stated as per transaction.

Eschino and many others agree that the real conversation begins with consumer knowledge and education. Citizens have to be educated about cannabis and the effects of overconsumption in any capacity (conventional smoking vs. edibles vs. concentrates). The primary concern for Eschino and many in the legal cannabis industry is that the state government is limiting opportunities for small businesses. The bottom line for many in the cannabis industry is that adult consumers should be able to educate themselves and purchase whatever amount of cannabis and cannabis-related products they desire. Another concern for Eschino is that business owners do not want consumers to feel bad about the process of buying cannabis in any regard, and he doesn’t want the state of Colorado to miss out on revenue. In closing he mentioned, “I don’t want customers to think they are doing something wrong. And my big fear is that if the equivalency law goes through the way it is now, it will cost cannabis businesses money and cost the state of Colorado tax revenue dollars.”

alk about cannabis, especially in the realm of industrial hemp, invariably leads somebody to offer up the bromide that there are “gray areas” of the law. The law is vague and confusing, so it is said, which creates uncertainty about what is legal and what is illegal. But when I read the black letter of the law, I find little if anything that anyone would ever call gray. Federal drug laws may be a lot of things, including silly, counterproductive, and downright bad, but they are not vague or confusing. I find no shades of gray. Make no mistake about it, cannabis plants, all cannabis plants, are classified under federal law as marijuana, a Schedule I controlled substance. Not only that, but most parts of the cannabis plants are also considered marijuana; in particular, the leaves and flowers. Nor does the law stop there. “Every compound, manufacture, salt, derivative, mixture, or preparation” of marijuana is also classified as marijuana. All varieties of cannabis plants contain dozens or hundreds of chemical constituents. These include cannabinoids, nitrogenous compounds, amino acids, proteins, glycoproteins, enzymes, sugars, hydrocarbons, alcohols, aldehydes, ketones, simple acids, fatty acids, esters, lactones, steroids, terpenes, non-cannabinoid phenols, flavonoids, vitamins, and pigments. To the extent that any are derived from the leaves or flowers of cannabis, federal law classifies them as marijuana. One might challenge the wisdom of that definition all day long, I certainly do, but disagreement over what the law says does not make it any less clear. Colorado is experiencing a boom in the market for cannabinoid products derived from cannabis. Most noteworthy perhaps is Δ-9 tetrahydrocannabinol, the multisyllabic psychoactive goody that we have all come to know and love as THC, popularly consumed throughout the ages for its recreational and medical benefits. But there is a veritable alphabet soup of cannabinoids found in cannabis besides THC, dozens or hundreds of them. They include tetrahydrocannabivarin (THCV), cannabidiol (CBD), cannabinol (CBN), cannabichromene (CBC), cannabigerol (CBG) and a host of others. Every single cannabinoid meets the federal definition of marijuana, because they are all derived from the leaves and flowers of cannabis. Every single one of them is a Schedule I controlled substance, making their unauthorized manufacture, possession and distribution a federal crime. There is a flawed popular perception that the key to illegality in the world of cannabis is THC. But THC appears nowhere in the federal definition of marijuana. Federal law does not care whether a cannabis plant is chock full of THC or has any measurable concentration of the substance at all. It simply does not matter whether the stuff made from cannabis could give one a buzz or not. It is all equally illegal in the eyes of the law. Many wish to believe that industrial hemp is different. A number of states, including Colorado, define industrial hemp to mean cannabis with a below-threshold concentration of THC in the plant tissue, generally recognized as no more than 0.3 percent by dry weight. Other than the narrow exception for academic research and development articulated in the 2014 Farm Bill, no similar distinction exists in federal law. But low concentrations of THC in industrial hemp does not help the plant avoid the onus of federal prohibition. Cannabinoid products are all classified as marijuana, regardless of the variety of plant from which they were made and regardless how much or how little THC the plant or the product made from it might contain. Manufacture of cannabinoid products in Colorado is booming. But they are not being regulated in a consistent manner. Cannabinoid products made from what the state has defined as marijuana are strictly controlled under complex and pervasive regulations promulgated and administered by the Marijuana Enforcement Division in the Department of Revenue. In contrast, the only aspect of state-defined industrial hemp that is subject to regulation is cultivation, by the Department of Agriculture. hemp is not regulated at all. In fact, Colorado law actually accords statutory immunity to anyone who processes and sells products made from legally registered and cultivated industrial hemp. Section 108(2) of the hemp regulatory statutes provides as follows: “[A] person engaged in processing, selling, transporting, possessing, or otherwise distributing industrial hemp cultivated by a person registered under this article, or selling industrial hemp products produced therefrom, is not subject to any civil or criminal actions under Colorado law for engaging in such activities.� The stark difference in Colorado between the regulation of marijuana and industrial hemp presents a particular challenge to federal drug enforcement. In a now-famous memorandum authored by Deputy Attorney General James M. Cole on August 29, 2013, the U.S. Department of Justice effectively gave the nod to states such as Colorado to experiment with regulated cannabis markets. Federal law enforcement policy since issuance of the Cole Memorandum generally has been to avoid prosecution in states where cannabis is legal, provided that actors play by state rules and avoid implicating certain federal law enforcement priorities. One of the enumerated law enforcement priorities is to prevent the diversion of marijuana from a state where it is legal to another state where it is not. Therein lies the problem in Colorado. Diversion of cannabinoid products made from industrial hemp is now occurring on a large scale. Transporting cannabinoid products made from industrial hemp across state lines places them in the stream of interstate commerce, where federal law, not Colorado law, controls. And federal law is clear: any product made from the leaves or flowers of any cannabis plant is marijuana. Interstate sales of cannabinoid products cannot be characterized as anything other than trafficking in a Schedule I controlled substance. Such activities not only break federal law, but they implicate at least one of the law enforcement priorities set forth in the Cole Memorandum, against diverting marijuana out of state. So far, the federal government has been remarkably tolerant of interstate sales of cannabinoid products, other than for those rich in THC. Relatively few attempts have been made to impede their transport outside of Colorado. But that does not reflect any change in the law, only a relatively lax attitude by

the current administration in Washington. That could change dramatically with the next administration, or for that matter, at any time. The current situation cannot continue. It exposes the regulated cannabis market in Colorado to the risk of significant intervention by federal law enforcement. Recent calls have been made in some circles in Colorado for implementation of regulations that would apply to all cannabinoid products, without regard to the source material from which they were made. Such regulations would include licensing, standards for quality and content, labeling, and prohibitions against export out of state, as long as the products remained federally illegal. Not surprisingly, some in the industrial hemp sector have reacted with vehement indignation to such proposals. The very thought of having their industry lumped in with marijuana offends their self-image of moral superiority and entitlement to special protection. But the reality is otherwise. There is but one plant, cannabis. There is but one body of federal law against it. Cannabis has but one future. We must all sink or swim from the same boat. Federal drug laws are bad and need to be changed. Prohibitions against cannabis, all cannabis, both marijuana and industrial hemp, should be abolished. But until that day comes, the State of Colorado must rationalize its current regulatory system to avoid implicating federal law enforcement priorities set forth in the Cole Memorandum. As an industrial hemp attorney, I support regulation of the processing and sale of cannabinoid products, including those made from industrial hemp. I have little doubt that it is coming. Resistance to regulation might delay the day of reckoning, but cannot forestall the inevitable. The industrial hemp sector can choose to be part of the problem, by denying that there is one. Or it can be part of the solution, by working to create a sound, reasonable and fair system of regulation. I would respectfully counsel the latter. David B. Bush is the managing member of David B.
