A LETTER TO OUR READERS

“The time is long overdue for us to take marijuana off the federal government’s list of outlawed drugs.” -Bernie Sanders This year was yet another amazing year for cannabis. We are at the precipice of a majority of states legalizing medical cannabis with 23 having done so already, as well as our nation’s capital. Of course we are also at four states plus Washington D.C. that have legalized adultuse cannabis. In the hemp movement we now have 27 states that have defined hemp as being different from marijuana and that are ready to take advantage of the industrial hemp research pilot program. At the same time, we have Colorado, Oregon, Kentucky, Tennessee and Vermont with registered farmers that are growing hemp and making products. A massive decortication plant is about to become operational in North Carolina and U.S. hemp sales are up 25 percent from 2014 hitting a whopping $500 million. Cannabis is now responsible for two of the fastest growing industries in the United States and we aren’t even scratching the surface of how it is going to affect our economy in the long term. We finally have a presidential candidate in Bernie Sanders who truly gets it. The Ending Federal Marijuana Prohibition Act Sanders introduced on November 4th is the best proposal ever presented by a presidential candidate. It would allow states to regulate cannabis similar to alcohol or cigarettes, but more importantly it would remove cannabis from the Controlled Substances Act. The act of removing it entirely, as opposed to just a rescheduling, puts cannabis in the category that it deserves. The larger ramifications of de-scheduling would open up the floodgates of so many avenues for the cannabis plant to thrive. First and foremost, tax code 280E would not be able to apply to state-licensed marijuana businesses, which causes them to be taxed at a crippling 60-70 percent rate. In addition, the banking issue would most likely go away immediately, making the entire industry safer by eliminating the need to hold on to huge amounts of cash. On the hemp side, removal from the CSA would open up crop insurance for farmers to grow the most useful crop on the planet. The lack of crop insurance up to this point has made hemp a very high-risk crop to grow for farmers that can’t afford to chance a devastating hailstorm or tornado destroying an entire harvest. There are many reasons, in my opinion, to want Bernie Sanders as our next president. He has proven himself over his political career to be a man of the people by consistently fighting for the lower and middle class with a commonsense approach. But it is his stance on cannabis that shows him as the best option for both the hemp and marijuana movements. It is for this reason THC Magazine fully endorses Senator Sanders as the best presidential candidate. I would go as far to say that if you are in either the hemp or marijuana industry and you aren’t getting behind Sanders for president, then you aren’t fully invested in the game. If these two quickly growing industries put our full force behind him we will be a voice to be reckoned with on the national political stage in 2016. One Woman’s Ambiguous Journey into Medical Cannabis by Regina Nelson by Caroline Hayes

Author Regina Nelson was sick and tired of being sick and tired due to her health condition. Between the pain she was experiencing and the side effects of the prescription drugs, Nelson’s quality of life was suffering. For a while, her road was long and unsuccessful, but after turning to her old friend cannabis, Nelson found the relief she needed. Cannabis has been her savior in more than one way. “And considering that I have raised six (yes, six) children to semi-responsible adulthood, while working in corporate Human Resources, business consulting and often carrying a full-time student course load…cannabis kept me sane,” Nelson says in the introduction. But cannabis wasn’t only a sanity protector, it aided in helping her with the severe fibromyalgia pain. Once she was able to control her pain, she then was able to help others with their conditions, and in turn further her own research. All her experiences combined have driven her deeper into medical cannabis research and practices. Nelson is an incredibly educated woman who is working on her Ph.D at the Union Institute and University in Vermont, with a focus in ethical and creative leadership studies and interdisciplinary research within the medical cannabis movement.

What was once something Nelson kept a secret for so many years is now something she is being incredibly revealing about. Her purpose is to not only educate the people interested in medical cannabis, but to ‘dispel false beliefs’ about her beloved medicine in the uninterested folks. What Nelson found when she stepped out of the closet, so to speak, was a new world, a community that supported her more than she ever imagined. She hopes that her voice will encourage others to tell their story to help medical cannabis become available in more states. Theorist could be used as a tool to provide knowledge to people who don’t know much about medical cannabis, or it could even be useful in a 100 level college course on the topic. Honestly, I wouldn’t call this the most exciting read but I do think there is valuable information here and the way she relates this information is clearer than what you might read in a scholarly or medical journal. It’s credible, she sites her sources and relays factual information in a well thought-out manner. I have no doubt her journeys as a patient and student could be an inspiration to some. I recommend this book to anyone who might be looking to continue learning more about the effects of cannabis on the endocannabinoid system, how to use it and further practices of cannabis as medicine.

Tristan Hodges by Caroline Hayes

Living the NorCal American Dream, glass blower Tristan Hodges is a dedicated family man. He’s collaborated with some of the biggest names in glass and his solo work is on the rise. His love for skateboarding has influenced his most recent line of work, Halfpipe.

Where do you live? I live in a small costal town in Humboldt County, which is in Northern California. What got you interested in blowing glass? I’ve always been creative. When I was young I liked to paint and carve things out of wood. I eventually started smoking weed. My friends and I would make pipes out of random stuff when we were young. What’s your favorite technique that you use? I don’t really have a favorite technique. I like doing different things and challenging myself. From where do you work? I built a shop at home in my garage. On your Instagram page it says, “I like to sculpt the things that have sculpted me.” What ‘sculpts’ you? My current body of work is called Halfpipe. Skateboarding has always been a part of my life so I wanted to pay homage to that. Before that I did a series of cameras inspired by my girlfriend’s love of photography. She has helped me grow a lot as a person. Blowing glass is a way for me to process the things in my life.

What do you like about your work? I like everything about my work. I like the fact that I make pipes for a living. You can’t beat that, I mean for real. What are your favorite types of pieces to create? I like sculpting things. Do you have a favorite piece? I don’t have a favorite piece. I enjoy the process of the product. Each piece has its ups and downs. I learn something along the way. I like to try new things and challenge myself. Professionally speaking, what is your goal? I love blowing glass. It’s important to me to show my daughter that following your dreams and living a life you feel good about is worth the hard work. I’ve never really fit into mainstream society but I have built a life for myself that I’m passionate about. It feels good to do that and provide for my family, and I want to continue that. I want to continue to challenge myself in creating work that is reflective of me and a positive offering to our community. Do you have any upcoming shows? My first solo show, Halfpipe, will be at the Emerald Glass Gallery in Arcata, California on December 5th, 2015. I’m really stoked on this show, I’ve been working really hard and [have] done some collaborations with other artists in the glass community. Reviews of Colorado’s finest cannabis infused products Cherry Sucker by Mountain High Suckers, 20mg reviewed by Monocle Man

Mountain High Suckers has been leading the way in CBD enriched edibles since 2009 here in Colorado. They have created some of the best tasting suckers and lozenges on the market today. The whole line of mouthwatering flavors are all tested and have a full spectrum of cannabinoids. Their newest cannabis confectionery creation is the Cherry Sucker. At 20mg this is a great option for someone new to edibles or the crafty veteran that can handle high doses. The novice can break the sucker into pieces to start slow and the experienced customer can easily enjoy the whole sucker. One of the biggest problems I have encountered with most cherry-flavored edibles is that it can taste like cough medicine. Mountain High Suckers sourced a cherry flavoring that actually pairs amazingly with cannabis and is now easily our new favorite flavor. The initial effects started within 30 minutes with a warm body high. It was a fully functional high but certainly helped me relax. Hemp Eats Mint Chocolate Chip Hempseed Clusters Makes about 24 pieces 4 cups cacao chocolate chips 1 teaspoon real vanilla extract 1 teaspoon all natural mint extract 2 cups hemp granola (we like Nature’s Path Organic Hemp Plus Granola Cereal but if looking for a gluten free option, Purely Elizabeth or Go Raw make a gluten free options. Pretzels work great too if granola isn’t your thing) 1 cup crushed hazelnuts, chopped dried cranberries and hulled hemp seeds Instructions Line a large baking sheet with parchment paper and set aside. Simmer a few inches of water in a large saucepan. Place a medium size glass bowl inside of saucepan; on top of the simmering water, making sure that it fits snuggly. Melt the cacao chocolate chips in the glass bowl, stirring frequently, making sure not to burn the chocolate. Once a smooth consistency has been formed, add in vanilla and mint extracts. Next, fold in the hemp granola. Once combined, scoop chunks of mixture onto parchment paper. Place in fridge until solid.

Crispy Smashed Sweet Potatoes Serves 3-5 Ingredients: ½ cup whole, unshelled hemp seeds 1 teaspoon + 2 Tbs hemp oil 5 lbs sweet potatoes, washed and pierced with fork 8-10 sage leaves, roughly chopped ½ cup crumbled feta ½ cup dried cranberries Salt and pepper to taste Directions: Preheat oven 450°F. Bring a large pot of lightly salted water to a boil. While the water is boiling, warm a medium skillet over low heat, add hemp seeds, stirring constantly, until they start to crackle and brown, about 2-3 minutes. Be careful not to burn. Remove from heat and drizzle with 1 teaspoon hemp oil. Toss so the seeds are fully coated and set aside. Once the pot of water has come to a boil, add the potatoes and boil for about 20 -30 minutes, until

When potatoes are done, quarter each vertically and place on prepared baking sheet. With a piece of parchment paper over top of potatoes, covered by a dish towel, smash down each sweet potato, until sides split open. Drizzle them with hemp oil and salt and pepper to taste. Evenly divide chopped sage and place on top of each potato. Bake in preheated oven for 25 minutes, or until edges are crispy. Remove crispy edge smashed potatoes from oven, top with toasted hemp seeds, crumbled feta and dried cranberries. Season with salt and pepper to taste. Transfer carefully from baking sheet to plates or serving dish. Serve warm.

Colorado Voters Approve Use of Marijuana DEA Chief Calls Medical Cannabis “a Joke” Tax Dollars Colorado voters cast their November ballots overwhelmingly in favor of keeping tax revenue generated from legal adult-use marijuana sales. Proposition BB, which asked voters if the state could retain the $66.1 million collected in the first fiscal year of legal marijuana sales, passed with a statewide approval of 69 percent. While the $66.1 million was lower than the initial predictions of $67 million to be collected as a result of state taxes on adult-use marijuana, overall state tax revenue was above predictions, prompting the potential refund under the Colorado constitution. The state will now have an extra $40 million dollars to spend on school construction, $2.5 million for marijuana education and prevention campaigns, $2 million for bullying prevention school grants, $2 million for drop-out prevention school grants, $2 million for youth mentoring services, $1 million for poison control centers and local government marijuana impact grants respectively, as well as smaller amounts for substance abuse programs, roadside impairment training for law enforcement officers, and funding for 4-H programs at the Colorado State Fair. A remaining $14 million was not yet allocated when voters approved the measure. In Denver, over 80 percent of voters approved Measure 2B, which authorized the city to retain some $5.3 million collected from the 3.5 percent sales tax on adult-use cannabis during this same period. While in Pueblo County, voters approved a measure that will phase in a 5 percent sales tax on marijuana growers to fund college scholarships for local high school graduates to attend area colleges. In contrast, a similar measure that would have funded college scholarships for students in Denver by increasing sales tax on all products by .08 percent was narrowly defeated.

Cannabis Growers Approved in Florida The state of Florida has selected five nurseries across the state to grow lowTHC strains of cannabis in accordance with the Compassionate Medical Cannabis Act of 2014, the CBD-only medical cannabis law passed last year. The law, which was passed by state legislators and signed into law in June of last year, sets strict limitations on the production and distribution of cannabis medicine, limiting THC content to .8 percent and allowing doctors to dispense the medicine only to those with intractable cancer and seizure disorders. The law also does not consider smoking cannabis as a legally valid form of intake. Out of 28 applicants, the five chosen producers were able to prove 30 years of operation in Florida, the ability to produce 400,000 plants at a time and a fastidious understanding of the surrounding regulations. The selected nurseries will also have to post a $5 million performance bond. According to the Miami Herald, four of the five nurseries selected were represented on the rules committee that set the guidelines for approval, which has drawn criticism from other applicants and advocates. The nurseries now have until June 2016 to begin cultivation.

In a move that has medical cannabis activists and users fuming, the head of the Drug Enforcement Administration dismissed the idea that smoking cannabis constituted medicine. At a November press conference DEA chief Chuck Rosenberg stated, “We can have an intellectually honest debate about whether we should legalize something that is bad and dangerous, but don’t call it medicine — that is a joke,” according to CBS News. Rosenberg had previously made headlines when he made the bold statement that marijuana was in fact not as dangerous as heroin, an assertion that distinguished him from his predecessor Michele Leonhart, who avoided such relatively informed conclusions. The comment has earned Rosenberg the ire of the cannabis activist and patient communities, prompting a petition for his dismissal on change.org that as of this writing had garnered over 130,000 signatures. Rosenberg has only held the position as head of the DEA since May of this year, after Leonhart abdicated the job following a scandal involving DEA agents attending parties funded by drug cartels at which agents had sex with prostitutes and received money, expensive gifts and weapons. Rep. Earl Blumenauer (D-Ore.) echoed the call for Rosenberg’s resignation, saying, “What is a joke is the job Rosenberg is doing as acting DEA administrator…. He’s an example of the inept, misinformed zealot who has mismanaged America’s failed policy of marijuana prohibition,” according to The Huffington Post.

Alaska to Allow Cannabis Consumption Adult-use cannabis stores in Alaska will be the first such in the nation to allow for on-site consumption. The Alaska Marijuana Control Board voted 3-2 in favor of changing the definition of “public” under the state’s adult-use law to allow for consumption at some dispensaries. Consumption will be limited to designated areas at only certain licensed shops, and the board’s ruling has not yet codified exactly what those places will be. Currently, no other legal adult-use states have any similar provision in place, leaving visiting cannabis consumers with extremely limited options of where to partake. “This would put, I think, Alaska in the forefront on this issue,” said Chris Lindsey, a legislative analyst with the Marijuana Policy Project, according to the Associated Press.

Hemp Market Projected to Continue Growing The Boulder-based Hemp Business Journal is projecting that the nationwide sale of hemp products will grow to $500 million by the year’s end. That figure represents a 25 percent growth from the previous year’s amount, which topped out at around $400 million dollars, up 25 percent from 2013. While the estimate is still preliminary, the continued growth is big news for


Across the Globe farmers in Colorado, which leads the country in domestic hemp growth. The potential for hemp CBD extraction is of particularly interest, as the market has only recently emerged and is mostly unregulated outside of Colorado. “A couple of years ago, there was no CBD market,” said Sean Murphy, publisher of the Hemp Business Journal, according to the Daily Camera. “(Look) how fast that emerged in a year or two.”

Ohio Officer Fired for Support of Legalization A police officer in Vermillion, Ohio was allegedly terminated for wearing a pin in support of a group seeking to legalize cannabis in the state. Former police captain Michael Reinheimer wore a pin on his uniform that said simply “I Support Legalize 2016” during a police auction. Reinheimer says that he supports the group because his wife has epilepsy and does not always find relief from her current medication. The city’s police chief denied that Reinheimer was fired over the pin, claiming that it was the result of continued disciplinary problems, and using his position as a police officer to advocate for a political cause was simply the final straw. Reinheimer plans to appeal his dismissal and, if necessary, sue the city, according to Cleveland.com.

Ireland Decriminalizes Drugs for Personal Use Ireland’s chief of National Drug Strategy announced plans to decriminalize personal possession and use of drugs during a lecture at the London School of Economics last month. Irish drug minister Aodhán Ó Ríordáin said that possession and use of drugs such as cannabis, cocaine and heroin will no longer be treated as criminal issues in the country, and plans to open injection clinics in Dublin where intravenous drug users can safely inject starting next year. Selling drugs will remain a criminal offense. Ireland now joins other European nations such as Portugal, Spain and Italy, as well as a number of Latin American countries, that have moved to treat substance abuse as a public health issue rather than a criminal one. “I am firmly of the view that there needs to be a cultural shift in how we regard substance misuse if we are to break this cycle and make a serious attempt to tackle drug and alcohol addiction,” said Ó Ríordáin, according to the Independent.

Medicinal Hemp Processing Facility Coming to Pueblo CBD Biosciences has announced plans to open a large-scale hemp processing facility in the former Boeing building in the city’s airport industrial park, according to The Pueblo Chieftain. The company says the facility will create

163 jobs, ranging from scientists to office workers, and has received $8 million in economic incentives from the Pueblo City Council. Plans for the facility include not only the extraction of CBD, but also the processing other parts of the versatile plant, and building research and development partnerships with the local college and university. “We’re not accustomed in Pueblo to being on the leading edge, but here we are,” said Pueblo Economic Development Corporation Chairwoman Barbara Vidmar, according to The Chieftain.

Malawi to Start Growing Hemp The government of the southeast African nation of Malawi has approved plans to begin cultivation of hemp on a trial and developmental basis. The crop would be grown at an agricultural research station in the capital of Lilongwe starting sometime next year. While some in the country see the plant’s potential to spur economic growth in the impoverished nation, others hold onto views that the proposal will lead to drug use. “That will just give an easy access to marijuana. The country will have so many problems. Some of the problems are shootings and suicides as it is in some states in the U.S., like California,” said Nelson Zakeyu, director of Drug Fight Malawi, according to VOA News. Those with a more concrete understanding of the differences between industrial hemp and marijuana see hemp as potentially more profitable than the country’s leading export crop, tobacco. “I understand the money it fetches is more than what tobacco would fetch for a given unit area. So we think that if we go this direction, we might even surpass what even what [sic] we get from tobacco,” said Joseph Chidanti Malunga, deputy chairperson of the parliamentary committee on agriculture, according to VOA.

Democratic Presidential Hopefuls Weigh in on Marijuana Democratic presidential contender Sen. Bernie Sanders (D-Vt.), who has in the past voiced support for legalizing cannabis and ending the federal war on drugs, backed up his talk last month when he introduced a bill to the Senate that would remove cannabis from the Controlled Substances Act. The Ending Federal Marijuana Prohibition Act is similarly structured to the Regulate Marijuana Act introduced into the House of Representatives earlier this year by Rep. Jared Polis (D-Colo.), which is currently being held in committee. Hilary Clinton, when asked about the issue following this news, stated support for medical marijuana and said that she would hope to have cannabis reclassified into Schedule II of the CSA, which would allow for greater scientific access similar to that enjoyed by cocaine and methamphetamines. While Clinton’s proposal seems like a half-measure compared to Sanders’, she has in the past stated that consumption of marijuana should not be a criminal offense.

Issue 3 Ohio and the Vote Against Legalizing Cannabis by Samuel Farley

Ohio became the most recent state to vote on, and decline, a cannabis initiative when voters decided against Issue 3. If Issue 3 in Ohio had passed, it would have legalized cannabis for recreational use for adults over the age of 21. The initiative would have also allowed for one cannabis retail store for every 10,000 Ohioans, which would have meant more cannabis shops than McDonalds in the state, according to Cincinnati ABC affiliate WCPO. The citizens of Ohio voted down the measure on Nov. 3, 2015. One of the main issues with the ballot was the limited number of businesses that would have been allowed to operate. Only ten facilities, known as MGCE, or marijuana growth, cultivation, and extraction facilities would have been allowed to produce cannabis and sell to the statewide retailers. The lack of open business opportunity seems to have played a role in the bill being defeated with a 64.1 percent vote against Issue 3. Some of the main investors in those MGCE facilities were local Ohio celebrities including former 98 Degrees member Nick Lachey, Woody Taft (relative of former President William Howard Taft) and former professional basketball player Oscar Robertson. Each MGCE facility would have been allowed to grow and cultivate cannabis as well as produce concentrates and edible products. The measure presented other problems for Ohioans, the limited number of statewide licenses would have created included price inflation, limited

product selection, and quality. By limiting the number of facilities that are allowed to cultivate cannabis and cannabis related products, the state would be limiting the number of businesses that can develop and the number of products that consumers have the opportunity to choose from. Interestingly, all ten of the land plots that were prepared to be MGCE facilities in Ohio were all larger than 13.4 acres, the largest being 76.8 acres, which is a massive amount of space for cannabis-related business. All of the land plots had the necessary space for the various facilities needed to produce large amounts of cannabis, edibles and concentrates for all of the statewide retail stores. Many people in Ohio, including Dave Holthaus, an editorial board member of WCPO, voted against legalizing cannabis for a variety of reasons. One main issue Holthaus pointed out in a video by WCPO was, “Right now, only four states plus the District of Columbia allow pot to be sold for recreational use. Why don’t we see what happens in those states first before we jump in for fully legal pot and why not consider legalizing medical marijuana first?� Holthaus and other Ohioans agreed that fully legal cannabis in both recreational and medical forms was not a change that the state was ready for in 2015. We will have to see what the state lawmakers and citizens of Ohio decide the next time the issue of legalizing cannabis in any form is brought up on a state ballot.

ChromicCon 2015 by Samuel Farley

The second annual Chromic Con once again took over the Speak Easy Vape Lounge in Colorado Springs on November 14 and 15. The private, open consumption event combined the love of all things cannabis, fantasy, and science fiction into one awesome and very smoked-out event. With notable cannabis celebrities in attendance inducing Craig X of “Super High Me”, actors Mark Dodson and Todd Holland, and Jeffrey Peterson, The 420 Comic, the event provided attendees a chance to get stoned with some of their comedy and film favorites. When walking into the Speak Easy Vape Lounge, one was immediately met with the omnipresent smell of burning flower and dab vapor. The event was filled with attendees dressed as their favorite fantasy, comic, or cannabis characters while they dabbed and smoked the afternoon away with fellow like-minded cannabis enthusiasts. The event featured music from DJ Chris Diablo and various booths with sponsors including The Hash Castle, Weed Wipes, and TC Custom Promos, among others. It was a truly unique event that allowed people to get together and consume cannabis while talking about their favorite fantasy characters and listening to great music and live comedy. The Speak Easy Vape Lounge provided access to a selection of dab rigs already set up with e-nails as well as a full section of glass pipes for consumers to enjoy. To help ensure cleanliness and the health of the club’s members and guests, they provided alcohol wipes at every station. During the event I had the opportunity to speak with Jaymen Johnson, the event organizer, and his enthusiasm for Chromic Con and the cannabis community in general was evident. At one point during our conversation

he explained, “I see the Chromic Con event as an example of how cannabis can continue to be accepted in mainstream culture.” The environment at the 2015 Chromic Con was lively and many of the events attendees came dressed as their own creative cannabis-themed fantasy characters. Included in the two-day event were multiple comedy performances and raffles with great prizes, including various glass pieces, t-shirts, and other smoking accessories. The comedy show hosted by The 420 Comic, Jeffrey Peterson, included Denver’s own Piper Shepard, Comedy Central comic Sean Savoy, and headliner Craig X. During a quick conversation with the host, Jeffrey Peterson, he shared his love of comics as well as his background as a former animator. As we continued to talk cannabis, Peterson mentioned his favorite part of being able to participate in the event is what will happen in the future as cannabis becomes more mainstream. “Chromic Con celebrates the combination of comic books and the world of cannabis and the people who love both. I hope the movement and culture continues to grow.” As cannabis continues to become more acceptable across the country, hopefully we will see more events like Chromic Con. Chromic Con provides the cannabis community with an opportunity to get together with like-minded stoners and consume cannabis while celebrating aspects of individuals’ lives and personalities in an open and legal setting. I met Nick Levich and Tommy Joyce, the founders of Blackrock Originals, on the patio of Galvanize Platte, a co-working space for startups in Denver. “We want to make a positive change on the industry, the same way that everyone in this building wants to make a positive change on education or ride-sharing,” Tommy told me. Nick and Tommy, University of Denver graduates, left school to enter careers in real estate and online retail marketing respectively. Both are industries where a certain type of style is expected around the office, a way of carrying oneself around colleagues. “I was in corporate America and knew people that were daily smokers, but you would never know it. They wore a suit to work every day,” Nick explained. As the co-founders entered the real world, they didn’t see cannabis brands that fit the needs of their established colleagues. “You get the flashy Bob Marley tie-dye, and that may appeal to some people, but as the statistics show, the overall majority is not lumped into that category.” According to the Colorado Department of Public Health and Environment, the agency put in charge of administering the Medical Marijuana Program of Colorado in 2000, the average license-holder in Colorado is 42 years old.

“From our perspective, there was a drastic need for a stylistic upgrade and a service upgrade.” Nick and Tommy decided to create a lifestyle brand, Blackrock Originals, also known as Blackrock OG. Their first product is the Safety Case: a stylish, smell-proof case about the size of an iPhone, with the look of a sunglasses case, designed to fit in your pocket while carrying and protecting your daily cannabis essentials. The case works well with small smoking devices, such as vape and dab pens, joints and blunts, and small glass pieces, such as one-hitters. Open a briefcase with the Safety Case inside and your coworker, or boss, won’t look twice, as opposed to carrying a plastic baggie or an Altoid tin. “Status comes with being a professional. You’re not walking around with the same backpack you used in high school. Everyone’s functional and aesthetic standards go up as they mature and cannabis should be no different,” Tommy explained. “We wanted to make an impact in a way that would catch the attention of people that wear professional clothing and people who don’t subscribe to the ostentatious cannabis lifestyle, but still use it every night when they get home.” Nick added, “Regardless of what people say, we all judge on first impressions. We’re working on refining the perception of cannabis and this is the first thing that someone sees when you go to have a


smoke. If you’re showing up to the Curren$y concert with a plastic bag and squished joints, I might not even smoke them. You might have bunk in there based on how it’s stored and how it looks.” The company also wants you to have a high-end experience when shopping for their products. “We didn’t want our product associated with head shops. Nine out of ten people’s experience with head shops has been pretty sketchy and terrible. That’s not the service we want associated with our product.” As such, Blackrock OG is primarily selling the Safety Case online. Tommy took what he learned in his marketing career to make the website as customer friendly as possible, including a phone number on the website that you can call to get help with an order. “We did a lot of research on other brands. I would never enter my credit card into some of those websites. Just look at the website and tell me that you feel safe checking out of there. When that’s par for the course, it’s like, ‘Okay, we can do better.’” The case is also available at a limited number of stores in Colorado, such as The Herbal Cure in Denver, which offers the Safety Case stocked with free pre-rolls and flower when you buy one. “You just went to the dispensary and spent $50 or more on items; you may as well put them in a place that’s commensurate with the value of product you just got.” Blackrock OG has also partnered with O.pen Vape, the top selling vaporizer pen in the country. “It made sense for us with O.pen, being Denver-based, having the same ideas towards mobile smoking, empowering consumers to medicate on the go. How they sell, how they treat their customers, the brand loyalty, all that meshed. Those loadyour-own pens, you’ve got to have your flavors and a dab tool and the different pieces to get going, so people like being able to carry the whole thing in one.” O.pen Vape sells the Safety Case on their website, including as part of a deal to get one when you buy Open Vape’s Go.Pen Plus. Despite the growing visibility, online sales for the young brand have not been a walk in the park. Tommy came from online marketing and has a pretty good handle on what to do when it comes to marketing brands and services; however, the new industry has been more difficult than his past experiences. For instance, you cannot use the word ‘cannabis’ on Google or Facebook. “Having all these major avenues cut off has been a unique challenge.” One way the company navigates this is by advertising through Mantis, a cannabis-friendly online ad network which boasts 10 million monthly readers across more than 150 website partners, such as Medical Jane and Elite Daily. Another way Blackrock OG attracts attention to their site is through unique content. The website tries to portray how today’s smokers can “take the

high road” (also the company slogan). They show images of sail boats and private jets alongside curated playlists and original articles. According to Tommy, “It’s a variety of things that try to embrace the cannabis culture, but in a really positive way.” Nick and Tommy’s ultimate goal is to be categorized as a general lifestyle brand as opposed to being stigmatized as a purely cannabis brand. “You can buy a Coach wallet at Nordstrom to carry your credit cards and daily essentials. Why can’t you buy something to carry your smoking essentials? You can probably buy a flask at Nordy’s, why can’t you buy a cannabis case?” It’s only a matter of time before mainstream retailers open their doors to cannabis-centric products. Legalization has surfaced demographic information not usually portrayed by the mainstream media. It’s not just a market of hippies in their twenties, but middle-aged moms and dads and ambitious college grads. Retailers are learning that some smokers are more likely to shop at Nordstrom’s than Hot Topic. And with a diverse set of customers and tastes comes opportunities for differentiated products. The first brands to gain the loyalty of each growing market segment will have a significant advantage.

New York Medical Marijuana Examining the Beleaguered Compassionate Care Act

Manhattan Assemblyman Richard Gottfried first introduced the Compassionate Care Act, a bill to legalize medical marijuana, to the New York State legislature way back in 1997. It wasn’t until 2014, with the help of Senate co-sponsor Diane Savino, that the bill finally passed, opening the doors for medical marijuana to begin January 2016. Citiva Medical, a dispensary applicant that failed to pass the Department of Health’s rigorous yet opaque licensing evaluation, hosted a panel called “Medical Marijuana: Is New York Doing it Right?” Seated in close proximity to Gottfried and Savino at the panel was Alphonso David, counsel to Gov. Andrew Cuomo. David stated, “Cuomo’s position was that the federal government still considered medical marijuana a Schedule I controlled substance — the same category as heroin. The Department of Justice advised Cuomo’s counsel that the measure should be tailored narrowly in order to avoid ‘enforcement problems’”. “For a drug that’s widely available,“ Ethan Nadelmann, founder of the Drug Policy Alliance told the Village Voice, “New York’s medical marijuana is an absurdly restrictive system.” It allows treatment for 10 conditions only: cancer, HIV/AIDS, amyotrophic lateral sclerosis (Lou Gehrig’s Disease), Parkinson’s, multiple sclerosis, epilepsy, inflammatory bowel disease, neuropathies, Huntington’s disease, and damage to spinal cord tissue. After 18 months, the health commissioner, who makes all decisions regarding medical marijuana, can potentially add to that list Alzheimer’s disease, muscular dystrophy, dystonia, post-traumatic stress disorder (PTSD), and rheumatoid arthritis. The law sunsets in seven years unless reapproved by the state legislature. In the Village Voice, Gottfried revealed that, “Only after heavy negotiations that were unnecessarily restrictive did Cuomo finally, reluctantly sign the Compassionate Care Act. It was Cuomo himself who demanded limiting the number of growers in the state to five, the number of dispensaries to twenty,

and the number of treatable conditions to ten, Cuomo himself who insisted on the flat prohibition against smoking and the use of the whole plant.” The bill, at the beginning of negotiations, was much more expansive. Troy Smit, Executive Director of Long Island NORML, explains that, “It would seem that Cuomo has no skin in the game, as they would say. His stance towards cannabis has always been ‘less is better’. Less access, less dispensaries, less consumable forms, etc... He’s placing most of the responsibility upon the Commissioner of Health.” As Cuomo continually hedged, Savino stepped in to make the bill more palatable, taking out anything that even slightly resembled “California’s messy medical marijuana system.” Savino wanted to craft a bill that would not only help ailing patients, but create a new industry. However, with the dispensary licenses limited to five companies who can open only four dispensaries each, how much of an industry can actually be made? Though NY is the financial capital of the world, investors are shying away because the current, very restrictive medicinal market, is miniscule. Marijuanadoctors. com made plain the math; New York has a population of approximately 20 million people, 12,000 of whom are registered on the state’s cannabis website waitlist. Of that 12,000, around 73 percent qualify under the law. So for 20 dispensaries spread out, not necessarily evenly, over 54,556 square miles, seeing 2,000 patients per month, per dispensary, is a pretty tall order. Opening a dispensary in NY could cost you $5-10 million, and that’s before you’ve sold a single dose. Simply applying for the license cost applicants an upfront, non-refundable $10,000. Then there is the “conditionally refundable” fee of $200,000. On top of that, you have to post a $2 million bond. Count on annual cultivation and dispensary fees of $15,000, and fees under $100 for each employee, a manager’s license, moving the product between dispensaries, and occupancy. You also have to factor in consultants, lobbyists, architects, lawyers, and property purchases. The Shouse California


Law group estimates that it costs between $30,000-$500,000 to open a dispensary there. With your NY medical marijuana investments, you could get 10-20 dispensaries in California. These companies are also severely restricted in how they can help patients. Each dispensary can only make five “brands” of medicine that are exclusively oils, extracts, tinctures, and edibles. No whole plant products are allowable, and no smoking. There are other strangely restrictive policies. For example,

With your NY medical marijuana investments, you could get 10-20 dispensaries in California. if anyone other than a patient or registered caregiver wanted to enter the dispensary, they would have to get a waiver from the DOH. If you don’t get the waiver, you must go to the front desk, state your name, date, time, purpose of the visit and the facts upon which the access was granted. Then you must be personally escorted by dispensary staff. This includes the fire department. Forty-three companies applied and five were awarded licenses by the NY State Health Commission: Etain, Bloomfield Industries, Vireo Health of New York (formerly Empire State Health Solutions), PharmaCann (PharmaCannis is its Illinois-based parent company), and Columbia Care. The Commission’s selection process was based on 13 criteria that included some of the very obvious, like manufacturing, dispensing, and quality assurance. But others, like “demonstrated moral character and competence of board members, officers, managers, owners, partners, principal stakeholders, directors, and members of the applicant’s organization,” are a little less objective. Peckham Industries is a 91-year-old construction business with deep roots in White Plains, about an hour north of NYC. Etain, one of the companies selected, is run by the well-connected Peckham family women, Amy, Hillary, and Keeley. According to their LinkedIn pages, Chief Operating Officer Hillary Peckham graduated from Hamilton College in 2014,and her past work experience includes teaching piano and swimming lessons; Keeley Peckham, Chief Horticultural Therapist, has a certificate from the New York Botanical Gardens as a Horticultural Therapist and taught environmental science at a summer camp; and Amy Peckham, CEO, has worked as a secretary and corporate advisor to the family business. Lohud. com reported that Peckham Industries and its political action committee has donated to NY campaigns about $135,000 in the past five years: $12,000 to Cuomo, and $15,000 to hometown politician Rob Astorino’s failed

gubernatorial bid in 2014. Court records show that Peckham Industries and its subsidiaries has a long history of legal actions and questionable practices, including bid rigging, improper behavior, and contract disputes, with more than a dozen lawsuits ending in undisclosed settlements. Lohud.com wrote, “Identities and other details about people leading new medical marijuana businesses were also supposedly critical to state Health Department officials’ evaluation. The agency cited its review of the ‘moral character and competence’ of principal stakeholders, board members and other leaders as part of the criteria for licensing companies.” Says Smit, “It’s not entirely clear why each applicant had their application denied or granted. Like much of NY politics there is no transparency.” The Deputy State Director for New York at the Drug Policy Alliance, Julie Netherland, agrees, saying, “What’s less clear, some of the questions that the denied applicants say, is why these questions from the DOH were selected. If you look at the top 10 of the ranked applicants, their scores are very close, it was a very tight ranking and not a lot of room between the top tier.” PharmaCann placed first and Bloomfield fifth, but the five below Bloomfield were within 1.5 points or fewer. The dispensary applications, numbering 1,000 or more pages apiece, have been released by the DOH, and dozens upon dozens of pages are redacted. This leads many to question the DOH’s puzzling application process. Some dispensary city residents are worried about how a marijuana business will affect their communities, and some had no idea a dispensary was coming to their neighborhood at all. Columbia Care, opening a dispensary in Suffolk County, has already run into issues with the local government. One scoring rubric key was geographic availability, but this, as it turns out, is more fantasy than reality. “In Albany there are three dispensaries; in western NY, there’s almost nothing, and in the north country there are two dispensaries that are only seven miles apart, and two on Long Island, which has a population of three million people,” Netherland says. “The other problem with the program is that the dispensaries only carry certain kinds of strains that may not treat your illness.” So if a patient lives in Albany but their local dispensary doesn’t carry their medicine, they may have to drive to say, Long Island or Queens, which is many hours by car away. THC reached out to the DOH and all of the dispensaries for comment, all either didn’t respond or declined comment, with the exception of PharmaCann. The CEO, who had to approve the questions, declined to answer the majority of them. The most substantive information they offered via email was that they were confident their NY dispensaries would be up and running by the January deadline, which, in Smit’s opinion, is very unlikely. Another patient obstacle is finding a doctor that will write them a recommendation. Doctors in NY must take a 4½-hour, $250 online course and maintain patient relationships for recommendation writing eligibility. Marijuanadoctors.com spoke to 500 doctors across NY about the Compassionate Care Act. Only one stated interest in the course, and some worry that doctors don’t feel prepared to write recommendations for a misunderstood medicine long outside the lines of U.S. medical protocol. This really puts the onus on patients to approach their own doctors and ask them to participate in the program, a potentially awkward situation. Netherland explains, “There is no provision for low-income patients. This is going to be a system that only serves affluent patients and lowincome patients will have to continue to buy on the illicit market. Cuomo’s overriding concern is misuse and diversion, instead of using it as a medicine. If someone wanted to game the system, it would be way easier to buy it on the black market.” Compassionate Care architect Gottfried introduced a new medical marijuana bill in the 2015 spring legislative session that would allow doctors to recommend smokable cannabis, add several conditions, and remove limits on growers and dispensaries. Cuomo told Politico that the program would provide for patients in need and still be among the most heavily regulated in the nation. If he finds it’s a risk to public health or safety, he can end it. In the meanwhile, Cuomo recently signed a bill temporarily allowing critically ill patients to get medicinal marijuana before the January start date, but so far that is the only Compassionate Act he has signed.

Feds Still lack respect for sovereignty Tribes are again dealing with promises made and broken

On October 28, 2014, a memorandum went out to all acting U.S. attorneys. Known as the Wilkinson memo for the Justice Department director from whose office it emanated, it offered guidance in federal policy relating to the legality of cannabis on Indian land. The memorandum doubled down on the Cole memo that had been issued in August of the prior year, granting sovereign tribes the same leeway on cannabis that had been granted to the states following a vote to legalize the plant in Colorado and Washington. The Wilkinson memo stated clearly that, “The eight priorities in the Cole Memorandum will guide United States Attorneys’ marijuana enforcement efforts in Indian Country, including in the event that sovereign Indian Nations seek to legalize the cultivation or use of marijuana in Indian Country.” Provided that tribes were to follow the points outlined in the 2013 memo, which included provisions such as not funneling money into criminal enterprises, preventing sale to minors, and preventing the flow of cannabis from a jurisdiction where it was legal into an area where it was not, the memo seemed to pave the way for tribes to follow in the footsteps of Colorado and Washington. It was big news for many in Indian country. In the past, tribes have used their sovereign status to generate income in ways such as casino gambling, tobacco sales and the sale of fireworks, and legalizing cannabis in all its forms would surely provide a much-needed source of income in these often marginalized communities. Less than a year later the first raid on a Native American cannabis facility shook this perception. The raid targeted a large marijuana growing facilities in northwestern California’s Modoc County, where members of the Pit River Tribe and the Alturas Indian Rancheria had been cultivating cannabis in facilities that included 40 greenhouses, each with the capacity for 1,000 plants according to a DOJ press release. The raid netted 12,000 marijuana plants and 100 pounds of processed cannabis ready for distribution, proudly touted as a successful law enforcement action carried out by the Bureau of Indian Affairs, the DEA, and the Modoc County Sheriff.

The raid shocked some observers, but given the size of the operation and the allegations of involvement from a Canadian tobacco interest, the narrative that the tribal grow had been in violation of California’s medical marijuana laws as well as the obvious violation of federal law persisted, and questions faded. The raid would serve as a warning. The Wilkinson memo would not grant immunity from intervention in all cases, but this particular instance seemed to show that offenders would need to do something large to get the attention of federal enforcers. Amongst the tribes that continued unhindered in their cannabis pursuits was the Flandreau Santee Sioux of South Dakota, who had become the first tribe to officially legalize recreational and medicinal cannabis on their reservation. The tribe had gained notoriety for the plan, with law enforcement in the surrounding area vowing to do everything in their power to put a damper on the idea. Never the less, the plan proceeded, and a cannabis resort that would offer patrons the opportunity to purchase up to a gram of cannabis at a time to be consumed on site seemed to be heading toward fruition with a planned opening at the end of December. The tribe had seemingly taken the Wilkinson memo’s point to heart, incorporating a rigorous seed-to-consumption tracking system that would ensure that no cannabis ever left their land, and even went so far as to offer shuttle services to prevent drugged driving. Working with a consulting firm out of Denver, the venture looked poised to break new ground and establish firmly that tribal sovereignty on cannabis was a tenable idea. But that appears to have changed when in October federal agents carried out a raid against the Menominee Indian Tribe of Wisconsin, seizing what they claimed was 30,000 marijuana plants. The raid once again highlighted the flexible interpretation of legality on the issue of tribal cannabis, but unlike the operation in California, the Menominee claimed to be growing industrial hemp through the College of Menominee Nation, a practice made legal not by default through the Wilkinson memo, but expressly allowed


under the 2014 Farm Bill, which allowed institutes of higher learning the legal right of way to grow hemp.

what they did here and I’m very disappointed by the actions that they took in Wisconsin.”

“They were attempting to comply with the farm bill and were operating, in their understanding, in compliance with the farm bill,” says attorney Tim Purdon, a partner with the firm Robins Kaplan LLP who was hired to represent the tribe shortly before the raid. Purdon says that his involvement in the debacle began just days before the raid, when a rising THC level in one of the strains prompted tribal members to request guidance from authorities. According to a DEA search warrant, the tribe had been in communication with federal authorities, inviting them to observe the endeavor at multiple junctions, and had allowed BIA officials to test the plants for cannabinoid levels. A statement from the Menominee claims that they had offered to destroy the offending plants themselves. “I thought that the offer the tribe made was very reasonable,” says Purdon. “They rejected that.”

The Menominee have so far argued that the farm was in compliance with the farm bill, an argument that doesn’t require the legal right of way established by the Cole and Wilkinson memos. “If it’s legal, then the Cole memo and the Wilkinson memo don’t matter,” says Purdon. “There are no Cole factors implicated here, this is intended to be industrial hemp.”

Purdon, a former U.S. Attorney himself, says he was puzzled by the decision to raid the farm rather than work with the all-too-cooperative tribe. “I would think that the scarce resources of the Department of Justice would be a lot better allocated to … focusing on heroin and opiate use than what was intended to be a lawful industrial hemp farm,” he says. The DEA search warrant describes the presence of a consultant who was not a member of the Menominee tribe, the reason given to suspect that the operation was in violation of the Cole memo and by extension the Wilkinson memo. Absent in the search warrant is any mention of the cannabinoid levels in the plant matter tested by the BIA official. “As a former U.S. attorney who has been involved in these types of situations, I don’t understand how they analyzed the Cole memorandum in a way in which they thought that they should be prioritizing raiding what was intended to be an industrial hemp crop,” says Purdon. “I don’t understand

Neither the U.S. Attorney’s office for the Eastern District of Wisconsin or the BIA responded to requests for comment on the issue made by THC, but so far no criminal charges have been filed relating to the raid. The confusing motivation for the actions of federal enforcers has resonated with the Flandreau Santee Sioux, who canceled their plans to open a cannabis resort and destroyed their entire crop following the raid on the Menominee farm. The operation was also being assisted by a Colorado consulting firm, which would seem to expose them to the same violation of the DOJ memos as the Menominee. Still, other tribes are moving forward with their own legalization efforts. In November the first such cannabis venture in the country opened, run by the Squaxin Island Tribe in Washington State. The retail marijuana store is operating in a state that has already legalized cannabis, making the venture slightly less risky than those developing in other areas. For the Menominee, the only avenue of recourse seems to be a lawsuit filed last month in federal court. The suit is aimed at strengthening the legal standing of the tribe’s actions under the Farm Bill, rather than relying upon the tenuous guidance of the Wilkinson memo. For the time being, this avenue of economic development may not be as available as some would think, and once again Native Americans find themselves fighting the federal government to uphold promises made.

ustin Trudeau is the Canadian Liberal Party’s newly elected Prime Minister, and he has said, “We will legalize, regulate, and restrict access to marijuana.” The Canadian Liberal’s politics would be a bit left of our American Democrats, and to avoid confusing them with American liberals, will be referred to as the CLP (this is not an official party name). Trudeau is the young and popular son of one of Canada’s most beloved and longestserving former Prime Ministers, Pierre Trudeau. Canada has had medical marijuana in place for more than a decade, and Vancouver, British Columbia (home of the much-touted “BC bud”) even has marijuana coffee shops, where, much like Amsterdam, police choose to look the other way. Some theorize Trudeau’s strong legalization stance was presented as a wedge issue foil to his former opponent, Stephen Harper of the Canadian Conservative Party. The Canadian Conservative Party, or CCP (again, not an official party name), runs a bit left of American conservatives. Harper said at a campaign stop in Montreal that, “Tobacco is a product that does a lot of damage. Marijuana is infinitely worse and it’s something that we do not want to encourage.” The Trudeau administration is newly born, but so far they have made minimal steps toward legalization, having issued directives to the county’s justice minister, attorney general, health minister, and public safety and emergency preparedness minister to begin preparing for legalization, but offering no concrete plans or timeline for legalization. Randal French is an observer of both American and Canadian politics, currently living in Lethbridge, Alberta, a politically right-leaning enclave about 70 miles north of the Montana border. French is a dual citizen of the US and Canada and has lived and voted in both countries. “Trudeau ran an extremely positive campaign, and Canadians are really more liberal at heart. But, Justin is the son of Pierre Trudeau, who was an extremely adept politician and intellectual giant. Justin is not so smart, but he had some benefits. He grew up in Ottawa, has his father’s connections, and is very rarefied. Justin would never be Prime Minister if he had to start from scratch.” Stat Canada reports, “In 2012, 43 percent of Canadians reported that they had used marijuana at some time in their lives.” That is just a little short of Pew Research’s 49 percent for Americans. French continues, “Even though he got in some trouble for using, he’s never really hidden it. He didn’t openly campaign on it but it was understood.” French contrasts Canadian and American attitudes about marijuana use, saying, “But here, there’s no stigma attached. I would go and smoke on the back deck. Lethbridge is the most conservative place in Canada; no one cares. Even Costco, the most conservative, family-friendly place ever, had a poll in their magazine that said something like 78 percent of Canadians supported marijuana.”

When it comes to world politics, Canada seems to operate quietly and politely under the radar, but if the CLP’s marijuana ideas are put into place, they could make a big splash when it comes to international drug treaties In the US, attitudes on marijuana use and legalization seem to be shifting somewhat, but there is still a lot of ambivalence. Morgan Fox, Communications Manager for The Marijuana Policy Project, says that Canadian legalization, “May bring about an attitude change in Americans, it might make a lot of people wonder what’s going on with US policy. It may have an effect on tourism, or on border states decriminalizing or legalizing, though most people aren’t bringing anything across the border. The US has never really much cared for what Canada does in terms of policy.” One person who you would think needs to care about Trudeau’s marijuana promises is Dr. Jane Philpott, the CLP’s newly appointed minister of health. A family doctor whose practice and advocacy spans two continents, she has worked with Médecins Sans Frontières (Doctors Without Borders) and faith-based organizations in Africa on AIDS care and refugee advocacy. Her agenda as Canada’s new health minister includes negotiating a new health accord and pursuing government funding of certain medications, but a search of her websites and social media doesn’t show a timeframe for marijuana legalization. So the US doesn’t pay much attention to Canadian policy. The Canadian minister of health has more pressing issues, and the CLP has no concrete legalization plan. It seems the people who really want to get this show on the road are Canada’s already-established medical marijuana producers and American investors. The Canadian Press wrote, “Experts say American institutional investors looking for cannabis plays are headed north, where medical access to the drug is legal countrywide, to avoid running afoul of US federal laws or sinking money into companies that could be shut down by US federal authorities.” Some US companies are increasing their Canadian holdings or listing their own companies on the Canadian market. After Trudeau’s victory, Canadian marijuana companies saw a spike in their market prices. Canada’s medical marijuana market really started to boom in 2014, when the Canadian federal government required that patients buy from licensed producers approved by Health Canada instead of homegrown marijuana production. In June, two of Canada’s largest medical marijuana firms, Tweed and Bedrocan, merged into Canopy, giving them more than 25 percent of the registered patients across the country and making them the industry leader by far, their combined market cap triple the size of their closest rival. Some predict that by 2024 there will be 400,000 medical marijuana patients, nearly one percent of the country’s population, and if recreational sales are put into place the market

value could be in the low billions. Canopy is also eyeing expanding to other countries, in particular South America, where the world’s sole legal country, Uruguay, resides. There are three United Nations drug treaties in place. Each one added more rules to what the current US War on Drugs is based on, the Single Convention from 1961. The New York Bar Association wrote in a report that, “The Single Convention forms the basis of the global drug control regime as it exists today. At its heart, the Single Convention limits use and possession of opiates, cannabis and cocaine to medicinal and scientific purposes. Recreational use is not permitted in any form under the Single Convention.” The Convention also established the drug scheduling system (marijuana is Schedule I). It also requires its signatories to enact measures against selling, distributing, purchasing, cultivating, etc. All of the US states involved in the cultivation and sale for adult-use or medical purposes are technically breaking these treaties. Drug policy reform group The Beckley Foundation has commissioned lawyers and drug policy analysts to examine and recommend alternatives to the current treaties. One possibility brainstormed by their group is that countries wishing to change their drug laws “pass countermanding national legislation,” which could potentially invalidate international

law commitments. They also wrote that any departure from agreed upon treaties would “open up the options for national governments to implement new drug laws for their individual nation, a country’s domestic drug law would therefore be the responsibility of that country alone.” The United Nations General Assembly Special Session will convene in 2016 at UN headquarters, where all 193 member states will have equal representation. If Canada has some firm plans for legalization in place by spring 2016, they could be trailblazers in creating new treaties. This, in turn, could give other countries more control in forging their own drug policies. But unless and until that happens, perhaps the slogan of the CLP should be, “We will legalize, regulate, and restrict access to marijuana... eventually.”

Yet another round of product recalls due to improper pesticide use has shown that the problem is not going away any time soon. As officials struggle to catch up to an industry that has relied heavily on self-regulation, thousands of products have been recalled, plants have been put on hold or destroyed, and consumers may be left wondering if the product they are consuming can be considered safe. A recent executive order from the office of Gov. Hickenlooper seems aimed at creating a state-wide crackdown on the off-label usage of pesticides in commercial marijuana, directing the Colorado Department of Agriculture and the Department of Revenue to “utilize all existing investigatory and enforcement authorities established by law to protect against the threats to public safety posed by contaminated marijuana.” The order follows yet another round of product recalls stemming from suspected unsafe pesticide applications, and mandates that these state bodies, the CDA and the Marijuana Enforcement Division — which operates as part of the Department of Revenue — take immediate action. It’s an admirable goal, and one that consumers should welcome, but highlights the shortcoming of these state agencies to regulate safe business practices thus far. The pesticide issue came to the forefront in March of this year, when officials with the Denver Fire Department conducting code inspections discovered growers were using pesticides not approved for products meant to be combusted and inhaled. The discovery prompted the Denver Department of Environmental Health to place thousands of plants on hold, with some manufacturers choosing to destroy their crop rather than wait for the pesticides to evaporate to acceptable levels. The incident prompted an investigation by The Denver Post, which found that several commercially available products contained residual pesticides, spurring the notable offender, Mahatma, to report companies that submitted contaminated material for processing, leading to further quarantines and recalls. Worth noting in all of this however is that these recalls and holds were carried out by the Denver Department of Environmental Health, and not by one of the state agencies that is tasked with regulating the cannabis industry. Operating under the broad authority given by the Denver municipal code, the Department of Environmental Health has chosen to take action to mitigate what officials see as a threat to public health. “Consumer safety is Denver Environmental Health’s top priority when it comes to investigating potentially harmful pesticide residues on marijuana products. We have a responsibility to protect the public and have been working with the industry to help them understand the importance of having effective controls in place for monitoring and identifying these residues. The Department will continue to take a balanced approach by educating industry and consumers while using effective enforcement tools to address this issue,” writes DEH Food Safety Section Manager Danica Lee in a statement to THC. The health department’s involvement in cannabis began in 2010, when officials began conducting inspections of edible production facilities, a natural extension of food safety inspections. But it wasn’t until this year that the concern over pesticide use prompted the department’s further involvement. For now, these enforcement efforts seem to be limited to companies that are reported, rather than the result of investigative actions by the department. “Denver Environmental Health investigates leads on pesticide residue contamination issues from a variety of different sources, including complaints from customers, complaints from marijuana business employees, referrals by other inspectors and city agencies, and test results collected as a part of other active investigations,” writes Denver Communications Advisor Dan Rowland in an email statement. “The city does not have any regulations that directly address pesticides and marijuana – that’s handled at the state level – but we do investigate when contamination and other public health

concerns come to our attention. Currently, there is no enforced required testing of these products across the industry in part because there are no certification programs in place for pesticide residue testing at marijuana labs.” Still, actions such as those seen recently are limited to Denver, though due to the high number of production facilities within municipal limits there may be a cascading effect touching dispensaries elsewhere in the state. Until mandatory pesticide testing is rolled out next year, issues will likely continue to arise and the executive order coming from the governor will surely bring more violators into public view.

“There is a real potential that some cultivation facilities inside and outside of Denver are using unsafe practices. Until comprehensive, random testing is enforced, contamination of plant material from pesticide residues will continue to be a significant concern,” says Rowland. Known Contaminants At the center of the current controversy are four widely used chemicals. All have EPA approval for use of one kind or another, but none are approved for use on crops that are meant to be combusted. Currently, tobacco is the only crop used in this manner with established guidelines for pesticide use. Tobacco, however, is generally regarded as unsafe for consumption, and standards for chemicals used on the plant may not meet the high standard of safety that cannabis consumers would demand. Myclobutanil The active component of the commonly sold fungicide Eagle 20, myclobutanil is approved for use on a wide variety of fruits and vegetables. Currently, the Pesticide Action Network lists the chemical as a “bad actor” for its negative developmental and reproductive effect and its possible endocrine disruption. The World Health Organization classifies myclobutanil as a class III toxin, indicating it is slightly hazardous. The average lethal dose in mammals when the chemical is consumed orally as a solid is listed as greater than 500mg per kilogram of bodyweight, making it slightly more toxic than some of the other chemicals on this list. EPA tolerances for myclobutanil residue in food never exceeds 10 parts per million, with most food listed as well below that number. However, the most troubling consideration of the use of myclobutanil in cannabis cultivation is that it is shown to produce hydrogen cyanide when combusted. To contrast with myclobutanil, hydrogen cyanide has an average lethal dose of only one to three milligrams per kilogram of body weight when consumed orally. The gas is extremely dangerous when inhaled, and has even been used in gas chamber executions. Avermectin The crucial part of 132 different insecticides such as Abermectin, Prevamite, Reaper, and Vivid, avermectin is used to kill pest insects on a range of edible crops, as well as inside greenhouses and is even sprayed directly onto structures as a means of pest control. The chemical attacks the nervous

system of invertebrates, and because of its intended target has also been shown to be deadly to honey bees. It also has one of the lowest acceptable residue tolerances of the pesticides on this list, according to the EPA, with most applications allowing for less than .1 parts per million. Of the chemicals on this list, avermectin has the lowest average lethal dose, requiring just 10mg per kilogram of bodyweight to be fatal in rats when consumed orally. This has earned avermectin a spot on the PAN “bad actor� list, both for its acute toxicity and potential effect on development and reproduction. PAN also lists it as a suspected endocrine disruptor. While not shown to produce the same toxic gases when burned as some other pesticides, at least one material safety data sheet for a product containing avermectin warns that toxic materials are formed during exposure to high temperatures, including, but not limited to, carbon monoxide and carbon dioxide, both common byproducts of combustion. Spiromesifen Spiromesifen is an insecticide and acaricide used by some cannabis growers to target spider mites and airborne insects. It is used legally on edible fruits and vegetables, cotton, in greenhouses and on ornamental plants, and is sold in brands such as Forbid and Oberon. The EPA residue tolerances for spiromesifen range from .02 parts per million on corn and tuberous vegetables, to 86 parts per million on certain types of cowpea crops. Spiromesifen may be the least dangerous chemical on this list, and is deemed to have a low acute toxicity by the European Food and Safety Authority. The

average lethal dose for oral consumption is listed as greater than 2,000mg per kilogram of bodyweight and it is not known to produce the toxic gases associated with other entries on this list when burned, though a material safety data sheet from the manufacturer does warn against inhaling the smoke when spent containers are incinerated, and adequate information on potential dangers is not available. Nonetheless, the chemical is not on the Colorado Department of Agriculture’s list of allowable pesticides for use in cannabis growing. Imidacloprid Possibly the most widely used insecticide in the world, imidacloprid is the active ingredient in over 750 pesticide products, including flea treatments for domestic animals such as Advantage. Products containing the chemical are used on a variety of edible crops and it is approved for use in greenhouses. Because of its widespread use, imidacloprid is believed to be a contributing factor in honeybee colony collapse disorder. The residue tolerances listed by the EPA for imidacloprid are mostly below 10 parts per million on edible crops, dipping down to .05 ppm for cranberries and in meat products, but can be as high as 48 ppm on dried herbs. The average lethal dose in oral consumption is shown to be 450mg per kilogram of bodyweight, but, much like myclobutanil, the real danger may lie in the transformation that occurs when it is heated. Imidacloprid has been shown to release toxic gases when burned, including hydrogen cyanide and hydrogen chloride.

ne of the most talked about topics in the world of cannabis has been testing requirements, contaminant data and laws regarding labeling or in some cases the lack thereof for flower, edibles and concentrates in legal cannabis states. The oldschool days of growing cannabis in your closet or pressing hash made from the trichomes are long gone. Instead, today’s cannabis is grown by professionals in state licensed indoor grow facilities, or by highly skilled home growers who prefer to grow their own medicine. Now, new products that are made with butane, propane, CO2, and other extraction methods to obtain the final concentrated cannabis products have been introduced to many markets. Concentrated forms of cannabis (including edibles) are popular among patients and recreational users alike because of the increased potency and increased discretion associated with their use (no burning flower smell or ashtray). However, as concentrates and other forms of cannabis have begun to increase in popularity, so has the conversation revolving around the chemicals and solvents used and the health risks that may be associated with their consumption. Colorado currently requires testing for residual contaminates for recreational cannabis, and requires that the data be listed on the labels of cannabis products as well as all ingredients and chemicals used in the process of growing the flower. Colorado limits the amount of residual solvents that are allowed to be on a cannabis product that makes it to market. On the medical side, that same testing is not required and won’t be required until July of 2016. If cannabis was originally legalized to provide medicinal benefit for ill patients who need it for serous illnesses, then shouldn’t the patient and their health and safety be the foremost concern for the lawmakers involved? Interestingly, under the current regulations, only recreational cannabis products are required to be tested and labeled with the data involving contaminants, pesticides, and residual chemicals. It seems counterproductive to at least not have the equal testing and labeling requirements in place, so that medical patients can have access to the same parts per million and pesticide information as consumers in the recreational market. By not having that information made available on packages to medical patients, they are denied the chance to choose a healthier product.

Medicine That Works

One of the most important aspects of the argument for equal testing requirements is the idea that there are many medical cannabis patients who suffer from diseases and also have compromised immune systems. During a conversation with Tyler Vines, the manager of Natural Selections, a retail and medical cannabis dispensary in the north Denver area, she mentioned the importance of equal labeling for the benefit of the patients who need to use cannabis as a medicine. “I wish they would regulate it even more so. Right now the limit [for residual butane] is 800 PPM, which is still too high.” The long term or even short term effects of consuming cannabis or concentrated cannabis products with high levels of residual chemicals is largely unknown, and access to contaminant data for patients on the medical side is crucial. Teri Robnett, the founder of Cannabis Patients Alliance, an organization at the forefront of advocating for change and the rights of patients in Colorado, knows the importance of microbial and residual chemical testing for patients. “The problem is that we do not know how these chemicals affect patients who smoke and inhale them, and what happens to the chemicals when they are heated. It’s important for patients to know the products they are getting are clean, safe and good medicine,” She said. Medical patients deserve the same ability and opportunity to choose a product based on cleanliness and safety as the consumers on the recreational side. Although the medical cannabis is taxed at a lower rate, the health and value that medical cannabis brings to the patients who truly need it should not be ignored. When medical testing rolls out in July of 2016, medical cannabis products will have the same testing and labeling requirements as retail cannabis. Patients across the state will finally be able to make an educated choice about which cannabis product to purchase and consume. Hopefully other states that begin to legalize cannabis use Colorado as an example and initiate equal testing and labeling requirements from the beginning, so that patients and recreational consumers in other states can make the same educated choices.

elcome to Colorado! We’re glad to have you. Or, at least, some of us are. Except for the curmudgeonly natives who despise anyone not born on a 14er, the late-blooming hipsters who have lived here just long enough to know that the people coming here now are ruining the place, the regressive nanny-state know-it-alls who are confident enough in their moral sense to despise you for your cannabis use, and the government and tourism officials who refuse to acknowledge that cannabis draws people to the state, we’re all really glad you came. It’s great that you have come to this beautiful state to partake of our dank progress. Those of us that partake of it ourselves are happy to share. But if it’s your first time, I offer you this handy guide to navigating the Colorado cannabis cavalcade, or more accurately, “The Tourist’s Guide to Shutting the Fuck Up.” What follows are a few things that you might want to keep to yourself in order to get the maximum enjoyment out of your visit and avoid pissing everybody else off. Buying Other Drugs Some habits are hard to break, like assuming that the person who sells you weed has access to a stash of other recreational intoxicants. While your guy at home might have a closet full of questionably pure chemical adulterants, the nice budtender working the counter at that legal shop that is just one arbitrary decision away from being raided by the DEA definitely doesn’t. Maybe you came to party, and you’re just looking to get fucked up and yell, “Woo!” every time your best bro aims his handy cam at you. Well, buying drugs, much like yelling stupid shit, needs to be done in the appropriate time and place. The dispensary is not that place, for “woo!”-ing or buying hard drugs, so keep that shit to yourself and we might not be able to immediately identify you as a jackass of the highest order. Smuggling it Back Home Maybe you didn’t get the memo — the one filed by the U.S. Department of Justice, that is — but Colorado weed flowing into other states is one of the things that the feds don’t want to have happen with legal cannabis. Undoubtedly you come from a place that sucks a lot more than Colorado — it’s understandable — and your state is run by stupid people who steadfastly support stupid laws for stupid reasons, not the least of which is endearing themselves to their base of stupid voters. But traipsing into a dispensary and proudly announcing that you plan to violate federal law and potentially bring undue scrutiny to an industry that is trying so goddamn hard to keep it legal is not a very good idea. Your budtender cannot advise you on this task. Hell, most cannabis users who live here will tell you to fuck off for doing this. Personally, I don’t care if you want to be Han Solo with your weed; I’d rather you were buying your product from a reputable source and dumping money into our tax coffers than whatever else you would be doing. But that requires you be a little bit smart about your plans, and the first part of that is shutting the fuck up about what you are going to do. Otherwise you might end up frozen in carbonite, which in this analogy is federal prison. Price Wait a minute, you’re telling me that your shady friend/dealer, who pays zero taxes to anyone, hooks you up with a better deal than a highly regulated dispensary that pays uncharacteristically high excise tax at every juncture of business? Man, he must have the hook up on his lab testing.

When you make a purchase at a dispensary you are paying roughly 30 percent in taxes, the net result of said excise taxes as well as sales tax. You are also paying for the extremely high cost of doing business in an industry that isn’t allowed to make most standard business deductions when filing taxes and must foot a penalty because these businesses don’t have access to banking and therefore must pay those taxes in cash. You are also paying for the test results that show you just how much THC is in your bud, as well as the salary of every skilled employee that made that transaction happen, from budtender on up to master grower, all of whom must be appropriately trained in navigating the minefield of compliance. Your buddy might have better deals. He sure as shit isn’t funding school construction with every purchase you make, though. So you should probably stifle your bitching that prices are just a bit higher than you expected them to be in the legal market. Quality Maybe it’s a little more reasonable to expect higher quality in the legal market —actually, that’s completely reasonable — but when you’ve scoured the state to find a $30 quarter, you have to take into consideration the previously noted price dynamic. Low price or quality, you generally have to choose one or the other. You can certainly find some amazing bud in a dispensary, but you should be prepared to pay for it. When you complain to your budtender that you can get better quality bud at home for the same price, that look of mild bemusement that they reply with is probably just masking their bubbling contempt for your lack of understanding of the process that exists here. I would sincerely hope that the guy who has four lights going inside his place of residence can produce higher quality bud than a 100-light production facility. That’s like the difference between Coors Light and a home brew. You came looking for Oscar Mayer hotdogs, so don’t be alarmed it there’s a bit more pig anus involved than you expected. Employees Must Be Stoned Budtending seems like a pretty cool gig; you get to sell weed, look at weed, smoke weed, and listen to people’s stupid-ass ideas about what it is you do on a daily basis. Just because someone works in a dispensary doesn’t mean they’re getting stoned all day, every day. Sure, budtenders have a little bit more leeway when it comes to medicating —which is different than getting stoned, mind you — but if your budtender is high as giraffe nuts when you’re making a purchase, you’re probably in the wrong place. By this logic, working at a liquor store must also be fun because you get to pound the booze like a 14-year-old who just found the keys to the liquor cabinet. Liquor stores don’t hire winos to work the counter, and most dispensaries don’t tolerate that kind of behavior from their employees. I guess it’s nice to imagine that in this pot paradise we’ve created, employees getting stoned at a dispensary don’t potentially jeopardize the license of the business. So be a little thoughtful when you’re interacting with you licensed cannabis sales associate professional and they’ll probably do the same. If you follow the points outlined here, your chances of having a good experience while shopping for legal weed increase, and your chance of ending up as the butt of a joke the second you walk out the door decreases. After all, we’re happy to have you funneling money into our local economy and our public works. Except of course for those cranky asshats I mentioned earlier; they could probably use a good shut-the-fuck-upping themselves.

Meet John, the owner of Rocky Mountain Organic Medicine. The road that lead him to start RMOM was an unfortunate one. In February of 2009 John’s wife was diagnosed with colon cancer. She went through surgery followed by eight months of aggressive chemotherapy and radiation. As an alternative to the anti-nausea medication, she used cannabis to ease her discomfort. When John visited many of the dispensaries open at the time, he didn’t find one that he would feel comfortable sending his wife to by herself. They were all seedy in some form or another, and he knew there had to be a better way. In September 2009 he opened RMOM and brought a new level of professionalism to this industry.
