Governing board increases fees for nonresident students

Palomar College's governing board approved a 10 percent increase in nonresident tuition during a special meeting held on Jan. 21.

The increase to $179, up from $163 begins this summer. It will affect nonresidents, including international students.

According to projected nonresident tuition income, roughly 8 percent of Palomar students are nonresidents. Many out-of-state students receive sports scholarships or other tuition grants, so the increase will not affect them.

However, the question still arises as to why the board instituted the increase in the first place. The short answer is that the cost of education goes up each year.

The college is required to set the nonresident fee rate by Feb. 1 every year.

Community colleges have the option of using the maximum fee, the statewide average of $181 per unit, or calculating their own average, according to Phyllis Laderman, Palomar's director of fiscal services.

Palomar's average, calculated by the number of full-time students and the cost of education, equated to the $179 fee that the board voted on. The increase will bring the college's nonresident fee income to $1.9 million, up from $1.7 million. Laderman said that this is not an insignificant increase and that the college will put the extra income to good use.

Cholesterol screenings are being offered to students and staff at a reduced cost during the month of February at the Health Center. Call (760) 744-1150, ext. 2380 or the Escondido Health Center at ext. 8105 to schedule an appointment. Free Blood Pressures are also available at 8 a.m. in the Health Center on the San Marcos campus.

CLUB RUSH

Get screened during Healthy Heart Month The Health Center will be organizing Healthy Heart Month, offering students and staff health screenings at an affordable price throughout February.

Healthy Heart Month "is a month dedicated toward looking at issues with the heart," Director of Health Jayne Conway said.

This special promotion will consist of cholesterol screenings for both students and staff as well as blood pressure tests.

Students and staff will receive their test results and information on healthy eating.

The Health Center is offering packages, $10 for students and $15 for staff, which will include cholesterol, low density lipoprotein, high density lipoprotein and triglycerides screenings.

Also included in this package, is two weeks free in the fitness center offered by Michelle Fifield, Fitness Center coordinator, for both students and staff.

"It really applies to everyone," Conway said. "People are more at risk if high cholesterol and triglycerides are a high risk in their family."

Student Gov't holds first meeting of 2008 The Associated Student Government added two members to its ranks at its first meeting of the semester Jan. 30.

Josue Glaciano and Veronica Rodriguez were appointed as senators of the ASG. Their official appointment as senators will happen after they are approved by the ASG at its next meeting.

Interim Director of Student Affairs Sherry Titus, discussed a proposed reconfiguration for the 100 section of the Student Union building. The reconfiguration would have the ASG offices together in one area rather than separated as they are now. The board voted to have a tour of the space before meiJ?.bers make a decision.

Cafeteria Supervisor Diane Lach, presented information on Recyclemania, a program and competition among colleges across the country, designed to help raise recycling awareness on campus. The board will vote at its next meeting whether Palomar will participate or not.

Fight drags on in labor talks Professors are becoming irritated at speed of negotiation, district's counterproposals ASHLEY CAIN THE TELESCOPE

After much time, debate and negotiations, the fight continues between the Palomar Faculty Federation and the Palomar Community College District, with faculty demanding the district to cough up money and benefits while administrators insist money is tight.

The first labor proposal was brought to the district by the PFF in April 2007. Five months later, the district offered a counterproposal, which labor leaders said was unacceptable because it was less than half of the original proposal.

Immediately the PFF shot back with a counterproposal, which was answered Jan. 30, according to Roger Morrissette, chief negotiator for PFF. The district's response was "exactly the same thing again, except this time they took a few things off the table," Morrissette said. "Their offer (Jan. 30) was actually less than their offer in September and that is a violation of the state law called regressive bargaining."

Morrissette said he plans to sue for the violation.

Bob Deegan, president of Palomar, said the district's counterproposal was generous while still maintaining fiscal stability for the district.

"The district has made an offer that matches the highest amongst our comparison colleges," Deegan said. "We listed out what the highest rate peo-

ple got, what was the lowest, what was the average and we matched the highest."

At issue is whether Palomar has the money to give both fulltime and part-time faculty more money through salary increases and other benefits.

Deegan said that when PFF members insist the district has money, he suspects they are looking at unavailable money such as funds saved for retirees' health benefits. He added that the PFF points to the budget's ending fund balance, which are largely restricted funds saved for certain programs.

Labor negotiators insist Palomar has the money through $2.7 million of equalization money the college received last year. In 2006, the state gave $130 million to under-funded community colleges across the state.

"All the PFF has been asking for in this contract negotiation is our fair share of the equalization money," Morrissette said.

Deegan said the equalization money is a part of the funds that were offered to the PFF in the counterproposal.

"They're considered revenues, they're in the mix," he said.

"Their proposal is just prohibitively expensive at this time," Deegan said. "We (have) to find a way to see if we can find an agreement about the dollars available in the budget."

Along with pay increases for full-time faculty, the PFF is pushing to give part-time faculty extended office hours and to

pay them for preparation pay.

"Part-time faculty teaches 60 percent of the courses offered at Palomar and only gets paid for their time in the classroom," Morrissette said. They do not receive pay for office hours, creating exams, quizzes or lectures, as well as grading papers and tests.

Morrissette said the PFF believes students are also being cheated. Morrissette said teachers are turning down crashers every semester and the solution is to hire more full-time faculty.

"The administration cares more about putting money away for a rainy day than taking care of its employees," Morrissette said.

Deegan said the district will be hiring 10 new full-time employees this year and would prefer to hire more, but they can't afford it.

The faculty federation is now waiting for the district to discuss the proposals.

"We'll tell them again that their offer is unacceptable," Morrissette said. "We'll request again for them to offer us a counterproposal to the one we have sitting on our table."

If the district and the PFF cannot come to an agreement they may have to sit before a mediator to decide who is right and who is wrong. Deegan agreed if they cannot come to terms, a mediator might be helpful. However, he said he would rather settle this without 0

The San Marcos City Council voted against a rooming house ordinance that would have limited the number of leases single family residence can have to two, thus eliminating mini-dorms.

Although the City Council voted against the ordinance they are still looking for a solution to problems that have crept up between students and residents.

Mini-dorms, or homes that are rented to three or more students under three or more leases, are on the rise as the student population of San Marcos grows.

With the swell has come an increase in complaints of traffic, noise and litter in many neighbor-

hoods, leaving the city as the arbitrator between students and residents.

"We are trying to be pro-active rather than re-active," San Marcos Mayor Jim Desmond said, referencing the problems SDSU is having with mini-dorms. "We need to learn to live together cooperatively," Desmond said.

Mayor Desmond suggests if students host a party, they should inform the neighbors; make sure the noise is under control at a reasonable hour and leave a number for neighbors to contact should problems arise.

He said common courtesy would solve a lot of problems.

However, the reality of the situation is that a couple of students are being disrespectful of their

neighbors and the city is trying to find a solution to the problem, in the form of the rooming house ordinance.

The ordinance in its existing form has not been well received.

"The current form throws the baby out with bath water," Mike Preston, San Marcos city councilman said.

"It is punishing students who are looking for reasonable housing when we don't need to. The solution is going to take a twopronged approach. We need more housing for students and we need the students and the residents to work together," Preston said.

The city is trying to tackle the problem from both angles. Mayor Desmond said the city plans a University Village that will be

located between Barham Drive and the Interstate 78 freeway.

University Village will be zoned for student housing, providing needed housing for CSU students, as the campus only has dorms for freshmen.

They are also working on a development called Palomar Station, that will be situated on 14 acres near George's Burgers by Palomar College. The ground floor of the development will contain retail space and the upper levels will contain condos available to both students and the general public.

In order to improve relations between students and other residents, the council is forming the Student and Neighbor Relations Commission, which will have rep-

resentatives from Palomar College, Cal State San Marcos, the city and possibly the U.S. Marines.

The city hopes the commission can open communications between the two sides by improving the ordinance to better serve the needs of everyone.

"We are trying to strike a balance between providing housing for students and protecting neighborhoods," Chris Orlando, a San Marcos city council member said.

"At end the of the day the ordinance needs to focus on behavior. A group of students living in the same house is not a negative thing, how they interact with the neighborhood is what matters."

California votes no on Prop. 92 Community colleges are the building block to success for so many people in California.

Junior colleges across the state, like Palomar, allow students to prepare for four-year universities, such as San Diego State and Cal State San Marcos.

The more than 2.5 million students and 109 community colleges in California give those a chance to go to school for the fraction of what a four-year college would cost them. And for many students, community college is a second chance or a means to improve their lives.

So you would think that lowering the cost of classes, and setting limits to how high tuition could go would be would be an idea welcomed with open arms within our communities.

Guess again.

On Election Day, Proposition 92, which would have lowered the costs of community colleges across California to $15 a unit failed to pass, wiJ;h. only one of California 's 58 counties voting yes on the propos1non.

This ~ severely affect tht:: futu:e of the Palomar community along With the rest of the Califorma community colleges.

According Highereducation.org over 70 percent of California 's college students are enrolled in community colleges.

By lowering the fees for classes California would have been able to open a window of opportunity to thousands of people who currently cannot afford to go to college because of the current $20 a unit enrollment fee.

1? 2004 when California increased the tuition fees to $25 per urn~, 3~5,000 fewer students enrolled than expected, according to stansnc~ reported by Allan Hancock College in California.

When California turned down Proposition 92- with more than 57 percent of the voters saying no, it also turned down affordable college that increases the opportunity for people to seek degrees and enhance the work force.

In today's spiraling economy, wouldn't it be better for those who are looking to improve in the workforce to go back to school?

For some, that $5 a unit is a stumbling block they can't get over.

Let's see how well California can survive on the income of a McDonald's worker, because if our community isn't going to college that's the type of salary we have to work with.

According to YESonprop92.com, community college students who receive a vocational degree or certificate earn 90 percent more in wages than without.

What do you think people are spending that extra 90 percent on? The better our community is doing the better our economy is.

Many opposed Proposition 92 because of the projected $14 million deficit projected for next the year, but one has to ask themselves what we really would be investing in.

Investing in Proposition 92 would have been an investment into the future of California. . Each and every community would have reaped the benefits of 1ts people gaining an education and increasing the workforce · around them.

But I guess that isn't something anyone would want to be apart of. Way to go California.

Living in a modern U.S. society you would think that, for the most part, we live in a world of equality. There are laws to protect us from discrimination against sex, religion, race, and so forth.

But apparently in the United States freedom from discrimination doesn't apply to you if you are a homosexual male who wants to donate blood.

They are banned from giving blood. Ever. That makes perfect sense, because blood from a gay male isn't human blood. Right?

The idea that we are actually living in a world that still allows laws to discriminate against a person for their personal beliefs and lifestyles is baffling.

When will our society learn that you cannot oppress people from living the life that makes them happy?

First it was for the Black American's "own good" that the white man enslave him, because he wouldn't be capable of taking care of himself.

Then there is the woman, who needed a man to do everything for her.

There are countless instances ·throughout the country's history that show discrimination is not a battle worth fighting.

During the 1980s AIDS crisis, the Federal Food and Drug Administration placed a lifelong ban on allowing any male who had had sex with another male since 1977 to donate blood. This was attributed to the significantly higher risk these men were at for being infected with AIDS. Now over 25 years later with advances in blood screenings, one has to wonder if this provi-

sion is based on medical fact or homophobia.

It's understandable that there are those out there who don't agree with homosexuality.

And by all means believe what you want. But seriously shut your mouth and open your mind. You can't restrict other people's lives because you don't agree with their way of living.

Recently San Jose State College President Don Kassing suspended all college related blood drives until the FDA reviews its highly discriminate policy on homosexual donors.

This bold action has been met with mixed reaction. Some believe it is too dramatic of a move claiming lives will be put at risk due to the lack of blood.

When our country goes to war, we go with a purpose to make a change; we also go with the understanding that lives will be lost in the battle for change and progression.

Now it may sound harsh, but life is harsh. Without sacrifice you will never see change.

Many people died in the civil rights battle for the equality of all races and genders. Even further back to the roots of this country, many lives were sacrificed for the idea of "Life, liberty and the pillsuit of happiness."

I guess the dream of our country only applied to straight people.

Ah, young adulthood- a time when newfound freedom and poor judgment collide, sometimes spectacularly. Drink till you puke, shop till your credit's ruined, party all night, sleep all day, abuse your body and fall in love for all the wrong reasons.

Your parents worry. Once in a while, the police show up. But the tabloids hardly ever write about it.

Then there's Britney Spears, whose every misstep plays out with the entire world watching.

At 26, she's experienced higher highs and lower lows than most people will ever know - from uber-suecessful pop maven to unfit mother and substance abuser- in full view of the cameras.

Every move plays out like a tragic pop song. Two failed marriages, two babies, an ugly custody battle in which she lost visitation rights. The pack of photog-raphers who trail Spears caught her shaving her head, shopping for a car in her wedding dress, and swimming in the ocean in her underwear. Photos showed her attacking a photographer's car with an umbrella, weeping on a curb after a reportedly rocky reunion with her parents, being wheeled into an ambulance after a confrontation with her ex over the kids. Distanced from her family, she's even invited photographers into her inner circle.

The papers revel in her maternal failings and her emotional meltdowns. It is perhaps the most thoroughly documented mental breakdown ever, and it isn't pretty.

If you believe half of what you read, which you probably shouldn't, then it's easy to conclude that Spears is selfish and unstable, bent on self-destruction.

That's true of a lot of people, sadly. But those transgressions

are harder to live down when they play out in the white-hot limelight. Mistakes look so much better in the rear-view mirror than through the long lens of a paparazzi camera.

The lost meaning behind Black History Month JARRED POWELL

When it comes to the month of February, there are a number of things that come to mind.

The first thought most often comes to mind is Valentines Day. There is nothing like showing your love and admiration for the man or woman you love.

A few know this as the time that the Super Bowl is played and the end of yet again, another fabulous football season.

But more importantly February is recognized as Black

History Month; a month dedicated to celebrate and recognize the acts of heroism and contributions made by Black Americans in American society as well as the rest of the world.

In today's society, the meaning and exploration of this month has gotten lost in a nation that is more concerned with material things and political conflicts.

In the past everyone regardless of grade, were taught the achievements of African American persons in the month of February.

An educational period that many people benefited from and looked forward too. It was seen as important to emphasize the accomplishments of those who made so many things possible for a race that once so oppressed.

Now its seems that this time of month goes unnoticed. This is could be because people just do not care anymore.

The Africana studies program on campus goes almost unnoticed.

Two years ago the program was not available due to low

enrollment according to Professor Paula Johnson Nash, multicultural studies and Africana Studies professor. " If a student isn't involved or associated with the Africana Studies department then its highly unlikely that students wouldn't attend," Nash said. " This could be largely due to a lack of teachers, limited diversity and not enough student interest."

The Africana studies program teaches more then just teach Africana or African American studies. The pro-

gram teaches literature, family, sociology and psychology from a black perspective. It promotes unity and awareness of the history of black Americans and helps promote the celebration of Black History Month.

In a bold but highly controversial move believed to be the first by a U.S. college, San Jose State University President Don Kassing has suspended all campus blood drives because of a long-standing U.S. Food and Drug Administration policy that bars gay men from donating blood.

The FDA's policy "affecting gay men violates our non-discrimination policy," Kassing said in a lengthy email sent to faculty, staff and students earlier this week.

The issue has cropped up on college campuses across the country, primarily as gay student groups protest blood drives.

The American Red Cross and other national organizations that regularly run blood drives have also been pushing the FDA to revise the policy, which has been in place since AIDS first emerged in the United States in the early 1980s. State-ofthe-art blood-screening techniques make the lifetime ban unnecessary, the groups say.

The FDA policy affects any man who has had sex with another man since 1977. The agency says it is necessary because gay men are at increased risk for HIV, hepatitis B and other infections that can be transmitted by transfusions.

"This is not a political issue. We're not bowing to political pressure from some advocacy group," Larry Carr, SJSU's associate vice president for public affairs said.

"It's a position based entirely on principle. President Kassing stood up for our non-discrimination policy."

Local blood banks on Thursday blasted Kassing's decision, saying it could lead to a precipitous drop in blood donations at numerous Bay Area colleges and put patients' lives at risk.

Kassing's order, which takes effect immediately, applies to blood drives arranged by university employees as well as those organized by various student groups. At least two blood drives that were planned for this spring have now been canceled.

Some students say they disagree with the decision because donating blood saves lives.

"Blood drives make up a big part of the community service work performed by fraternities and sororities," said junior Jessica Glickman, an anthropology major and member of Kappa Delta.

"As a member of the Greek community, I know that the blood we have donated has helped people," Glickman said. "By banning blood drives, we're losing an avenue to help the others."

But other students said they were proud of Kassing for taking such a highprofile stand.

"It's discrimination," said junior Kelsea Scott, an English major. "This is a campus full of culture and diversity and that shouldn't happen here."

Miller Duong, a senior majoring in economics, noted that blood could be tested for HIY. "It's immoral to tell people no," Duong said. "Every person is human; Blood is blood."

Off campus, others echoed Glickman's concerns, saying that blood donations are a critical component of the American health-care system.

To see The Mars Volta in concert is an experience, but thanks to some bad fans, the band that is well known for their energetic live shows wasn't as good as it should have been.

The band that originally started in 1993 as At the Drive hm, lasted until2001.

It was then that The Mars Volta came to be.

Cedric Bixler-Zavala, then lead singer of At the Drive hm, and Omar Alfredo Rodriguez-Lopez the lead guitarist and CONCERT RE\'!EW vocals left and THE MARS VOLTA went on to start The Mars Volta.

OUT OF FOUR STARS Some of the VENUE: SOMA remaining members of At the Drive hm went on to start the band Sparta. Between The Mars Volta and Sparta it is easy to see why At the Drive hm broke up in the first place.

Members wanted to take the band in opposite directions and this is clearly shown in the contrast between The Mars Volta and Sparta.

Known for the lead singer's wild on-stage antics and wide vocal range, I knew I was in for a treat.

The San Diego show was a special one being because the band had just released its fourth studio album, "The Bedlam in Goliath."

kind was not allowed and all cameras would be confiscated. Little good that announcement did.

When the band came on stage, the camera flashes began and seem to irritate Bixler-Zavala.

On multiple occasions during the show the sound engineers at SOMA messed up and Bixler-

Zavala missed some vocal solos simply because he could not be heard through his microphone.

Aside from all of this, they put on a great show. Bixler-Zavalas on-stage antics were so amusing, especially his accent to the band's main 5-foot tall guitar amp. He proceeded to dance like

a go-go girl from the 1960s on top of it. Two stage hands had to hold both sides of it while he danced on top.

Bixler-Zavalas was wild; he would prance around and jump off drum sets and behaved like a madman.

What was interesting to see was his demeanor toward his band onstage. Yes, it was all for show, however for someone who had never seen The Mars Volta before, one would think they are about to break up.

On numerous occasions BixlerZavala would run over to his lead guitarist Rodriguez-Lopez and grab his tuning pegs on his guitar and twist them in the middle of guitar solos.

Rodriguez-Lopez was obviously used to this type of abuse because it never seemed to faze him and he never missed anote.

One thing did faze Bixler-Zavala though, all of a sudden toward the end of their set, someone threw a plastic bottle up on the stage. He quickly said into his microphone, "What are you doing? Where I come from, things flying in my direction mean we don't like you.

What is this high school bull****?"

Despite the unruly fans it was a good show. It would be awesome to see them in a bigger venue, preferably an outdoor one and with an audience that is a little bit more mature and listens to the band's requests.

Perhaps if the crowd would have listened, the real fans could have enjoyed an encore. The Mars Volta had every right to walk off the stage after their last song and not come back.

Concert Hour unites young and old JULIANA FAUSNAUGH THE TELESCOPE

The first Concert Hour of the spring semester at Palomar College offered a trio of musicians playing jazz, cha-cha and blues on Thursday, Jan. 31.

A mix of students and senior citizens quickly filled almost every seat in the Performance Lab in room D-10. They quietly began to listen to the arousing layers of melodic beats and sounds.

The pianist, Larry Karush, introduced a fourth pedal to the piano.

The performances were by Karush, along with percussionist Randy Gloss and Joey De Leon.

They performed four songs that were very unique from one another.

The first song was Dovening the Blues, the second was Country,

third was Cha-cha 7 and the fourth was Songs for the New City part two and three.

The trio used an impressive array of sound equipment such as the drums, wood block which is the acquired fourth pedal to the piano and various other instruments.

They played high-pitched sounds such as chandeliers hitting each other to deeper sounds such as the drum rolls.

There were other sounds such as plucking, striking, strumming, scraping, and blowing tunes.

The concert was an infinite combination of sonorities and harmonic tensions with some luminous solos, especially from the pianist and the drummer.

The soloist De Leon and Karush, were no less dazzling, especially in the Cha-cha 7, a

showcase of virtuosity in which the pianist and drummer provided their own endless variety of accompaniment.

The performers were very catchy with their rhythmic tunes.

The audience was intrigued with the music as they began to nod their heads, tap their feet and remained in suspense during the performance.

The music is distinct from modem music and has changed drastically over the years from hard rock to hip hop, rap and R&B. Music of 2008 has made a gap between the older and younger cultures.

The gap seems to get bigger and distance between the older and younger generation of people.

However, blues and jazz brought these generations of people together and proved that there is

something in common between the cultures.

It is the new sounds and beats that jazz has to offer, it's like a breathe of fresh air.

When William Hopper, a senior citizen was asked why he attended concert hour he responded, "I enjoy good music and the professionalism."

Other students such as Jesse Jones watched the performance because it was required for their class and he also liked to listen to the different sounds of music.

Soprano/ pianist Ann Chase will be performing at the next Concert Hour on Thursday, Feb.14.

Costume and setting were believable for Sydney.

Camera angles and shot choices throughout the film allowed audiences to view the world as Sydney would, through blurry, healing eyes. This may irritate your eyes for the duration of the scene, but it allowed a newfound understanding for the vision impaired.

"The Eye" did not contain blood and gore to rouse the audience. Instead it used shocking images that spontaneously appeared to cause a scare, which didn't allow for a moment of rest.

The next dead soul was always creeping around the comer waiting to grab hold of Sydney. This is not a film for the weak hearted.

At no point did this movie seem slow. At a short hour and a half, it moved through the plot without resting on one particular issue. Almost devoid of a sense of time, it almost seemed that everything happened too fast.

"The Eye" is a horror movie that will frighten as well as teach the value of living life despite physical or mental obstacles.

"We got back to basics," Davis said. "We showed that once we do what our coach tells us to do we play good as a team."

Holloway also moved the ball around, recording a team high seven assists.

Cory Leitzke contributed with a team high 10 rebounds.

With the end of the season just a couple weeks away, the Comets hope to make a late surge through the PCC. "We had a few rough games, but we've been practicing hard," Firmes said. "We're going to show everybody that we can play."
