A Message From the Vice President Throughout the COVID-19 pandemic Teamsters Local 743 has been at the forefront to represent and protect our members. We have provided member appreciation lunches, we have conducted contract ratification votes by mail, and have held grievances and Labor Management meetings via Zoom conference to ensure continuity in the representation of our members. Teamsters Local 743 is a unique Union that cares about all our members. We provide resources and information for a variety of needs outside of the workplace to improve the lives of our members and their families. Local 743 is committed to protecting our members rights and jobs in the workplace. To ensure our members continue to have the necessary resources and training, Teamsters Local 743 has been conducting stewards trainings via Zoom conference. On June 15, 2020, Teamsters Local 743 held its first General Membership meeting via Zoom conference. Many members joined the meeting who would not have been able to attend the meeting in person. We have also conducted several departmental meetings with our members via Zoom conference. We continue to be creative in our representation and connection to our members in these unprecedented times. UNION STEWARD TIPS & RESOURCES TIPS FOR HELPING MEMBERS DURING INVESTIGATORY INTERVIEWS Q. A worker was called for an interview and asked if she saw another employee committing an unsafe act. Did she have a right to demand union representation?

A.

Yes, if she had a reasonable fear that her failure to timely report the incident could lead to her own discipline. For example, the company may have a published rule requiring workers to promptly notify supervisors when they observe safety infractions.

Q.

Can a worker who is instructed to undergo a drug screen insist on bringing a union steward to the test?

A. Yes. In a 2015 decision (Manhattan Beer Distributors), the NLRB said that an employer must allow a representative to attend a drug test to insure that the screener follows proper protocols.

Q. If a worker is called at home and questioned about an on-the-job accident, can he decline to answer until he has an opportunity to consult with his steward?

Quite often, Local 743 members are unfamiliar with their contract language and concepts of benefit offerings.

Georgetta Davis Local 743 Board Trustee Battles COVID-19 On The Front Lines I wake up every morning happy and ready to go to work. Once I get there, it s a bit overwhelming. We don t have all of our people. We are short-staffed, and I m working with a lot of people who are scared. Like so many other front line essential workers, managing the ever-changing environment and hazards of COVID-19 has been a struggle for Georgetta Davis, a Union Steward and Unit Clerk of 33 years at Rush University Medical Center and Local 743 Board Trustee. I find myself working two units at once most of the time, and as the front runners of the hospital, we are the lifeblood to many other departments and procedures. Having suffered through many personal and professional losses during this pandemic crisis, Georgetta has consistently encouraged the strength and perseverance of her co-workers and Local 743 members. We are all in this together. And, we will get through it if we stay strong for one another, continue to wear proper PPE and be as positive as we can be right now. With PPE shortages being a major issue for many front line workers, Georgetta gives much credit to Local 743 President Debra Simmons-Peterson for her persistence with management and executives at Rush University Medical Center to get more supplies to those workers who need them. Overall our Union has been for the people - wholeheartedly. Many things were fought for, including Hazard Pay, and not everything was a win, but it was important for our members to know that President Simmons-Peterson was on it, and communicated consistently to service the members.

Local 743 President Debra Simmons-Peterson released a statement expressing, “I feel it is irresponsible to remove or reduce these hospital services on the South Side of Chicago”. The Emergency Room at Provident Hospital services over 30,000 patients a year and provides inpatient and outpatient services to over 100,000 patients, and proposing to shut down these facilities does not fall in line with a commitment to integrated care. “Our communities will not survive if there is a further reduction in healthcare services, especially amidst the Covid-19 Pandemic”, says President Simmons-Peterson. “Now is not the time to remove critical resources from the people who are most vulnerable and most at risk”.

Mercy Hospital Members Gather To Oppose Local Closings Concerned Local 743 members gathered recently to oppose the closure of Mercy Hospital in early 2021, as well as the proposed cuts to crucial services at Provident Hospital.

Teamsters Local 743 has over 250 members employed at Mercy Hospital and 63 members employed at Provident Hospital. On September 10, 2020, Teamsters Local 743 along with the support of fellow healthcare worker unions, is hosting a car caravan parade to advocate to keep Mercy and Provident Hospitals open. GRIEVANCES & ARBITRATIONS Local 743 is celebrating a few of the victories for our grievants, stewards and staff! It is always our goal to find justice for our members, protect their benefits, secure back-pay, fight for better wages, win arbitration cases, and more.

The Grievant, Company and Union have entered into a settlement agreement resolving the grievance filed. Jose Silva was the Union Rep for this grievance. It was filed on July 30, 2019 and the matter fully and finally resolved May 4, 2020.

Local 743 filed and won an election petition to represent the library student clerks working at the University of Chicago’s libraries. From 2017 to 2018, the University challenged the election results but the challenges were denied by the NLRB. Ultimately, the Union was able to process two Unfair Labor Practice charges and the University agreed to engage in bargaining. Congrats UOC clerks!

Charges have been filed and processed in May 2019, disputing the Employer’s refusal to bargain over subject matters pertaining to the Employer’s relocation. Region 13 of the NLRB has issued a complaint over the such refusal and has scheduled a hearing in this matter to begin on August 18, 2020 absent a settlement before that.

Charges were filed concerning Claridge’s refusal to execute the CBA. The Board issued a default decision ordering the Employer to execute the CBA and give retroactive effect to its terms. In addition, it must make employees whole for any losses associated with its failure to execute the CBA. The Parties agreed to a bilateral settlement agreement, but Claridge still failed to comply. The matter was picked up again and decided by the Board.

Dear Brothers and Sisters: Who would have ever thought that this cycle would come full circle?

Robert May Director of Field Services The spread of the coronavirus is challenging Unions to rethink their approach to training as government mandated travel bans, telework and social distancing have prohibited the traditional in-person training. With no vaccine in sight, we are looking at different approaches to training for our union stewards. The Union is in the process of creating online training modules to ensure our stewards are given the proper tools to represent their members. Our goal is to have virtual sessions that will create structured learning. We are also looking into developing ways to bring members closer to the contract and get their feedback with biweekly zoom chats or livestream Q&A’s. The hope is that this will lead to conversations that build solidarity and show members that the employer is responsible for workplace safety. Our responsibility is to hold the employer accountable. Black Swan employees receive well-deserved rewards for their hard work On the May 15, 2020 pay date, all Black Swan employees received a big welcoming surprise, after weeks of stalled negotiations. Employees finally received an approximate 20% bonus added to their paychecks and the potential for more in the future. According to the company, “Everyone is working hard during these hard times and we felt this bonus was appropriate.” The employees were very happy with the outcome, and are currently planning on how to use their bonus monies at a time of great need.

LOCAL 743 SUCCESS STORIES Ronnie Bynum: Grievance victory at UCMC Ronnie Bynum (Patient Transportation Specialist) is a 16-year employee at the University of Chicago Medical Center who, with the help and persistence of his Union, was victorious with his grievance. Ronnie Bynum has this to say about Teamsters Local 743: “President Debra Simmons-Peterson and my Union Representative Robin Sullivan fought hard on my behalf - they never gave up. I am very grateful to have a Union that works hard and fights for their members”.

Discrepancies with company documents leads to reinstatement Gerald Thompson, a Housekeeper at Mercy Hospital, was terminated in April 2020 for allegedly having four (4) incidents of ‘No Call No Show’. A grievance was filed the same day by Michele Brewer on his behalf. His termination grievance was heard in two parts by Union Reps Precious Morris and James Thomas on May 12th and May 15th. After the Union pointed out discrepancies with company’s documents, it was determined that Mr. Thompson would be reinstated and made whole from April 2020.

Undocumented company findings leads to reinstatement with back pay Donta Walton, Security for Community Care Center, was terminated in May 2020. A grievance was filed immediately on his behalf by Steward Timothy Myatt. During the grievance hearing, held May 29th, the Union Rep, Precious Morris, pointed out several discrepancies and undocumented findings in Donta’s file. On June 1st, the company agreed to bring Donta back to work with back pay, where he will be able to return in early June 2020.

LOCAL 743 SUCCESS STORIES Clements National closes its doors after 50 years After almost 50 years in Chicago, Clements National permanently closed on May 31, 2020. This news was extra devastating to those families employed there since there were a lot of married couples, brothers, sisters, cousins and in-laws, all working under the same roof. Even though there was no severance package in the current contract, President Debra Simmons-Peterson instructed the Business Agents to negotiate and demand a fair severance for our members. The union negotiated, among other benefits, vacation pay, 20 weeks of severance pay, and all banked sick days to be paid out. Local 743 will also be committed to helping these members find work at other Local 743 shops.

Capitol Carton Deal Finally Reached Gabriel Arzate, union steward from Capitol Carton, worked tirelessly to make sure his co-workers received the raises they deserved after 7 long months of negotiations.

New Union Steward Catches Company Error Joan Stanley, a new Union Steward at Aperion Tolleston Park, caught a huge error. The company tried to delete the weekend premiums that are outlined in the contract. Now, the company has to pay retro back to January 2020. Excellent job in staying diligent and informed, Joan. We need amazing Stewards like you to keep Employers in line and held accountable. Keep up the good work!

The union was able to get wage increases higher than they ever had. They will also get improvements on their retirement plan. One of the biggest issues members had was the temporary employees and now they will be part of the bargaining unit as well. Kudos to Gabriel for all his hard work!

Local 743 ratifies agreement with RTC Recent Ratifications to the RTC contract include a 3 ½ month extension with a $400 bonus. In addition, 2 issues that were reached in negotiations will take effect immediately. The Cycle Counting department (which never gets overtime) will now be included in the production list for overtime. The company will now hire direct and not through a temp agency. Those hired will be on probation for a 90-day period.

I personally lost a close friend and several members to COVID. Our immigrant community has suffered as they are unable to collect any government assistance like the stimulus check, unemployment, etc.

BEVERLY SISSON Beverly was a Local 743 member for four decades at the Rush University Medical Center. She was elected to the Local 743 Executive Board as a Trustee and served from January 2014 to December 2019.

GOLEEN BRADLEY Goleen served as Local 743 Recording Secretary & Trustee under President Simmons-Peterson from January 2014 to December 2019. She was also a decades-long employee of the Central States Pension Fund and the Recording Secretary of the Chicago Chapter of the Teamsters National Black Caucus.
