Appeals Court acquits four of RBC robbery

By Vivian Tyson The Turks and Caicos Islands Court of Appeal overturned the sentences of Bernard Coalbrooke, Daniel Been, Odessa Williams and Darrison Nash, who were convicted for the January 13, 2012, Royal Bank of Canada gun robbery and attempted murder on one of their clients.

The Appellate Court, comprising President Edward Zacca, QC, Elliot Mottley, QC and Ian Forte, QC, made the ruling on Monday (January 12, 2015).

Coalbrooke was sentenced to eight years for robbery and seven years for attempted murder with the sentences to run concurrently; Been, Nash and Williams were each sentenced to seven years for attempted murder and six years for robbery. They, too, had their sentences running concurrently.

A seven member mixed jury, comprising four men and three women, on February 20, 2013 found them guilty.

Investigators charged them for robbing Dwain Fulford of $75,000 in cash, which belonged to C.A.M Money Transfer. The hold-up men shot and injured Fulford in the process.

Police charged on a joint enterprise basis, meaning that while all may not have been part of the physical hold-up, could have played what they described as a passive role.

The attorney added: “My Submission was that there was not enough evidence for the judge to send the case to the jury. The decision of the jury to find them guilty was irrational because they hadn’t enough evidence before them to decide.”

Premiers eyes TCI as number one destination for private jets

The opening of Blue Heron Aviation FBO at the Providenciales International Airport and the impending relocation of the Provo Air Centre to a more futuristic home is most likely to reinforce Turks and Caicos Islands’ already mega jet center appeal amongst its regional counterparts, according to Premier Hon. Dr. Rufus Ewing.

The premier who brought remarks at the opening of the Blue Heron Aviation FBO on Monday (January 12, 2014) told audience members that at current the Turks and Caicos Islands is ranked third in the Caribbean for private jet charters only to Nassau, Bahamas and St. Maarten.

In the meantime, Michel Neutelings, one of the main forces behind the setting up of the facility, said that Blue Heron, which is a member of Signature Flight Support – the world’s largest fixed-base operation and distribution network for business aviation services – indicated that the opening of the jet center marks a new era in Fixed Based Operation in both the TCI and the region.

Planning Department approves Dolphin Cove Construction

By Vivian Tyson The Physical Planning Board has approved the Dolphin Cove’s approximately $3million construction of a dolphin attraction on the Island of Grand Turk but requested that a number of stipulations be in place before sanctioning actual construction.

Neil Burrowes, developer of the dolphin park, made the revelation during an interview with The SUN earlier this past week.

“Planning gave us a document outlining all the steps we need to do to seek approval to build. There are about 15 points that Planning gave us that we have to work through before we get the building permit. We have our architect working through what needs to be done, so that we can get permission to build,” Burrowes said.

Burrowes explained that local architect Oliver Stubbs is charged with the responsibility to develop the project. He noted that Stubbs is working closely with the Physical Planning Department to ensure that Dolphin Cove develops the project to its environmental and other specifications.

He said that once Dolphin Cove proved that it has complied with all the steps, and if the Physical Planning Department gives its stamp of approval, the issuing of a permit to construct would follow. He said that after the construction of the facility the Physical Planning Department would do another inspection, and if approved, would then issue with an occupancy permit, thereby giving the green light for the facility to become operational.

Burrowes explained that it should take maximum three months for the architect to address the Planning Department’s requested

building steps.

“We have given him (Stubbs) a request to do as fast as he can. God’s willing, maybe two months, maybe three months,” Burrowes added.

Stubbs, who confirmed that the Physical Planning Department has approved the construction of the aquatic attraction in principle, explained that he has been waiting on that bureaucratic entity to furnish him with the details on the steps so he could get his technical people cracking on the project.

“They gave me the detailed development permission in principle, which means that we have approved the project. But I am still waiting for them to give me a terms of reference so that I can get my marine biologist and these other people to do a full EIA (Environmental Impact Assessment) of the area.

Burrowes, in the meantime, revealed that he has been itching for the Turks and Caicos Islands Dolphin Cove Project to commence since several jurisdictions in the region, which are moving to bolster their tourism product, have been luring a Dolphin Cove attraction, and is eager to complete this project before moving on.

He also said he was pleased with the turnout of Grand Turk residents during a town hall meeting to pitch the project sometime ago.

“I am excited. We are also pursuing other opportunities. We have the money, we have the dolphins, we have the people and we have other locations. There was such a big turnout of people looking for opportunity; so many cab drivers and taxi guys who could double and triple their income, but it is really unfortunate that it has taken so long,” Burrowes said.

Clara Gardiner awarded an OBE in New Year’s Honours list

Mrs. Clara Gardiner, the Permanent Secretary of Border Control and Labour, received an OBE in Her Majesty The Queen’s New Year Honours this month.

According to the Governor’s office, the Award was for Mrs Gardiner’s services to immigration issues in the Overseas Territories, and Turks and Caicos in particular.

Speaking about the Award HE The Governor Peter Beckingham said: “ I was delighted to read in the New Year’s Awards that Clara Gardiner was honoured

with an OBE. I have seen a good deal of Clara’s work, not least when there have been the threats of illegal immigration from chartered sloops arriving in TCI. She is evidently a dedicated and resourceful member of the Public Service. Her Award is a tremendous recognition of the work that she, and many members of the Immigration service, do for Turks and Caicos.”

The Minister of Border Control and Labour, The Hon Don Hue Gardiner, joined the Governor in welcoming this Award. The Minister

said: “I am thrilled that my Permanent Secretary has received this distinction . It is a great honour to her, the Department and TCI, and a mark of her hard work and perseverance in a challenging environment.”

Mrs Gardiner will be invited later this year to Buckingham Palace to receive the Award from Her Majesty or another member of the Royal Family.

Still no breakthrough in Kenley Walters’ murder

By Vivian Tyson Investigators, at press time, were still not able to apprehend anyone in connection with the December 27, 2014 killing of Kenley Walters, who unknown assailants stabbed to death while partying at Club 2005 along the Five Cays road in Providenciales.

A source close to the investigations said that the police have been relentless in their investigation, already interviewed a number of persons in the hope of getting a strong lead. But so far they have not been given strong enough leads to create a path to catch the murderers.

The police are baffled that no one has decided to come forward to give information, considering that Walters, who was knifed to death by his attackers in a crowded nightclub, may have been murdered in front of dozens of partygoers.

On Monday (January 5, 2015) the police, along with the dead man’s family, comprising his father Kenneth, older brother Kenrick and stepmother Lida, held a news conference at the police headquarters on Old Airport, Providenciales, to essentially call for witnesses to come forward.

He was a quiet young man with a caring heart, who loved his family very much, and who had a passion for playing basketball,” Kenrick Walters said during the news conference.

Kenley Walters’ unsolved murder marks several recent killings that the police are yet to crack, mainly for lack of witnesses. Businessman Robert Been was gun-downed on the night of Tuesday March 4,2014, as he and his wife were about to board their car at the back of their Grace Bay building complex. And despite the family putting and police putting up $50,000 for a breakthrough in the case, no one has come forward.

On December 31, 2013, one of three hold-up men shot and killed Joscelin Odisse at the Altagracia Restaurant and Bar along the Bight Section of the Leeward Highway in Providenciales.

That murder is still unsolved.

The body of 31 year-old Gardiner, a resident of Kew in North Caicos, was discovered along the side of the road leading to Kew on that island on July 26, 2014 at about 5:30 in the morning.

Ministry of Health urged to ask tourists for assistance

By Vivian Tyson An America citizen is urging the movers and shakers in the Ministry of Health to tap into the overly medically influential cadre of tourists who come here frequently and are willing to assist local causes if asked.

The advice came from Lori MorrisHughes, who was addressing the graduation of 22 Emergency Medical Technicians (EMT) at the St. Monica’s Anglican Church in Providenciales on Thursday, January 8, 2015. She told the room that there are a great deal of persons out there willing to donate if they are aware of Turks and Caicos Islands’ needs, but said those persons would have to be approached.

Her plea is not an original call. Last year, Michael Goldberg and his wife Nancy, a Canadian couple who own a unit at the West Bay Club Resort in Providenciales, made similar suggestions after they rescued the Turks and Caicos Island National Primary School Spelling Bee competition, after Dr. Carlton Mills, former Minister of Education and Head of the Grace Bay Resorts Foundation approached them.

It turned out that they are avid fans of the Annual Scripps Spelling Bee competition, which they ensured watching every year.

Morris-Hughes said that the prearrangement with the local customs department made it much easier for the gifts to arrive in the TCI. “The easiest part was working with the customs to help it in easily.

Chief Justice Ramsay-Hale explains why she doesn’t live in Grand Turk

Chief Justice Margaret RamsayHale says it’s more practical for her to reside in Providenciales instead of the island capital of Grand Turk.

Addressing the recent opening of the Supreme Court, the country’s first female Chief Justice admitted that questions have been raised as to why, as Chief Justice, she does not reside in Grand Turk as former Chief Justices have done.

She explained: “I am the civil and commercial Judge and because most of the civil work is generated in Providenciales, I preside here. This is, as I have discovered from Sir Richard Ground’s Review, in keeping with a long-standing tradition that the Chief justice would sit in Providenciales to hear civil causes for the same reason that much of the civil work is generated in Providenciales.”

She added: “The demands of the civil and commercial Bar have grown exponentially since 2001 when there were 131 civil cases filed including divorce matters in contrast to the now 272 cases generating, as I have said over 400 hearings, in 2014. Given the demands of the work, I made

Chief Justice Ramsay-Hale said she wanted to “assure the traditionalists” that she will continue to split her time between the two islands as she has done since taking office. She said it is intended that the Judges of the Supreme Court

“We are of the view that in order to save costs and rationalise the system, Providenciales cases should be tried in Providenciales and Grand Turk cases, in Grand Turk,” RamsayHale added. “Before I took office, Providenciales cases were tried in Grand Turk incurring extra expense

for all parties for no other reason than that was where the Chief Justice sat. Of course, a peculiar difficulty arises where the witnesses are all in Providenciales and the Defendant is in Prison in Grand Turk. Currently, we are transporting prisoners on public aircraft back and forth daily, as there is no provision for those persons to remain in Providenciales until their trial is concluded.”

The Chief Justice said a case that comes readily to mind is a 2 defendant murder trial which lasted some 4 weeks, noting that travelling on public aircraft is an obvious security risk and additionally it is an enormous financial burden to the State, therefore a solution must be found.

“I have had an informal discussion with the responsible Minister Hon. DonHue Gardiner who has informed me that the matter is under consideration and we look forward to an early resolution of the question of housing prisoners here on Providenciales for the duration of their trials,” the Chief Justice added.

Government will be looking to secure a budget for the construction of a new venue for the ultra-popular Thursday Fish Fry, which has attracted scores of tourists and local alike each week.

The Thursday Fish Fry is currently housed at the at the Bight Park on Providenciales, which was the subject of controversy last year, when the Department of Environment and Maritime Affairs (DEMA) – the custodian of the venue – had served a letter of eviction to the Tourist Board, operators of the event.

DEMA claimed the eviction notice was due to the Tourist Board conflicting with the original agreement such as the cleaning up of the location each night after an event is held; making sure that the amplified music does not affect residents in the area; and updated payment for usage of the venue.

DEMA said in a letter to the Tourist Board that the Tourist Board was not holding up its end of the bargain, hence its decision to evict the event.

He said that the funds included in the budget for the creation of the Fish Fry venue, is to be used to develop the venue to host not only the popular event but also other happenings.

“We will also be looking at major investment infrastructure for the Fish Fry plus for the various equipment that will be used to host things like the Fish Fry and other major events,” the premier said.

Food and trinket vendors, as well as taxi operators benefit greatly from the Thursday Fish Fry, frequented by dozens of tourists each week. On many occasions, food vendors report inventory sold out.

In addition to local music, the ever-popular Junkanoo band entertains patrons. The Fish Fry is also a place from which a number of Turks and Caicos Islands residents collect their Thursday dinner.

Mike Misick’s new Lawyer complains of unfair and unequal treament The new lawyer for former Premier of the Turks and Caicos Islands, Michael Misick, has complained that the court system here is giving his client unfair and unequal treatment.

On Monday January 12th, local attorney Beryn Duncanson, who has replaced British Queen’s Counsel Courtenay Griffiths who withdrew as Misick’s lead lawyer because of lack of funding, told the Court of Appeal (Edward Zacca, QC, Elliott Mottley, QC, and Ian Forte, QC), that outgoing Supreme Court Registrar David Chetwynd said he would only release funds for Misick’s lawyers after the corruption trial has concluded.

The trial against Misick, some of his former colleagues and a few local lawyers, has not yet started because of various legal challenges and appeals.

In a letter to Mr. Chetwynd dated January 9th, 2015, Duncanson wrote: “As you know, I am trying to organise legal representation for Mr. Misick on very short notice and the woefully and completely inadequate terms of legal aid. I note that earlier today again you repeated to me the same position as in our prior telephone discussion about these matters....You refuse to pay any brief fee upfront for any counsel to appear for Mr. Misick (until the end of trial, you say). I have been simply unable to find any proper senior counsel (juniors, let alone QC!) willing to accept instructions in this case

Duncanson added: “The level, and terms, of Legal Aid approved for the other nine co-defendants in the subject case were bad enough, but your decision to treat Mr. Misick’s Legal Aid differently in terms than those terms accorded at least to the other codefendants is manifestly unreasonable and prejudicial.”

Misick was approved by Chief Justice Margaret Ramsay-Hale on December 3rd, 2014, but due to the “continued obstinate and unreasonable refusal” by Chetwynd to allow for proper upfront brief fees and fees commensurate with the Crown’s lawyers (such as Helen Garlick and Andrew Mitchell, QC,) it is impossible for him to brief senior counsel to attend.

Several British and local defence lawyers who appeared in the case have been complaining about the tremendous difficulty they have had in dealing with Chetwynd regarding payment.

If fact, one of the UK lawyers James Shepherd told the court last year that Chetwynd simply refused to communicate with the overseas lawyers. The Court of Appeal said the matter should be brought to the attention of Chief Justice Margaret Ramsay-Hale.

Lawyers in the corruption case, which has cost the Turks and Caicos Islands, approximately US$11million a year over the past four years, have already complained to British and local authorities about the fees.

In a document date May 24th, 2014, which was obtained by The SUN, 11 UK-based lawyers stated: “It is accordingly submitted that the quantum of remuneration of the legally aided defence teams is now wholly inadequate and requires an

urgent upward review. It should not be forgotten that UK lawyers have to pay income tax, significant chambers expenses and professional indemnity insurance. The brief fee is no longer proportionate given the more than doubling of the size of the Prosecution case. The expenses are wholly inadequate. They fail to provide any reasonable sum to compensate for the cost of accommodation, subsistence and car hire for the trial period.”

The document was endorsed by Howard Godfrey, QC and Louise Oakley; Michael Turner, QC, and Roy Ledgister; Ann Cotcher, QC; Malcolm Bishop, QC ; Icah Peart QC and Stephen Akinsanye; Richard Bendall and Cairns Nelson, QC, and James Shepherd.

Leading and junior counsel from the UK cannot be expected to undertake lengthy pre - trial preparation and a long trial in the TCI without reasonable funding. The changed circumstances outlined above together with the level of accommodation and subsistence costs render the current level of remuneration uneconomic for defence attorneys.”

Professional Certification for Government Human Resources Staff Four members of the TCI Government Human Resource Management Directorate (HRMD) are set to benefit from a professional development course funded by the Governor’s Office, Jubilee Fund.

The four members of HRMD have had their membership of the Society of Human Resources Management (SHRM) paid for by the Jubilee Fund.

They will now complete online coursework and examinations in the Dominican Republic to achieve certified HR professional status. The four officers working towards their HR certified status are: Keisha Taylor, Karresa Gardiner, Catherine Ann Forbes and Cherice Boyce.

The Governor’s Office in TCI manage the funds allocated to it by the Foreign and Commonwealth Office.

For 2014/15, the Jubilee Fund budget allocation was £40,000 (around $60,000).

The funds are being used to support a total of eight Government projects, of which HR enterprise is the first to be announced. The Fund aims to support the development of the highest professionals standards

Lilg Ministry, which owns Rhema Records, was in the Turks and Caicos Islands performing at a number of events, including a Youth Crusade in Providenciales on Friday (December 12, 2014) and interviewed by a number of media houses.

The members - Vanrico Lilg Hanna, CEO for Rhema Records, and two of his protégés, Young Tuck and Young Heart, were also here to promote their respective albums. Hanna’s new album – Still I Rise – was released on January 1, 2015. Young Heart and Young Tuck already had their albums released are said to getting a great deal of rotation, especially in the Bahamas.

Hanna said that ‘Still I Rise’, is an encapsulation of his life’s journey from

He said some of the tracks on the album had been released before,

but he chose to remix and rerelease them on the album. The official launch took place at the Galleria Cinema in Freeport, Bahamas, which took the form of a red carpet event, and which required attendees to wear red, black and white, Lilg’s Ministry’s colour form.

Hanna said that since the album is so profound and well done, he expects great things from it. He said that the name of the album was inspired by late poet Maya Angelou.

UNICEF Sponsored Early Childhood Education Workshop

The United Nations Children’s Fund (UNICEF) in collaboration with the Turks and Caicos Islands Ministry of Education, Youth Sports and Library Services hosted an Intervention seminar for early childhood practitioners throughout the Islands, from January 12 -14th at the Regent Palms, Providenciales.

The workshop was facilitated by both regional and local educators and expertise within the field of Early Childhood Development (ECD).

The main goal of this workshop is to expose participants to the key features of designing an effective screening and early intervention system for children at risk.

At the end of the workshop, participants will be able to: Ø Understand the importance of the Early Childhood period and its impact on later development Ø Describe normal physical, cognitive, language, sensory and socioemotional development in the early years Ø Describe deviations in normal development in the early years ØUnderstand the importance of screening and early identification of children with developmental and behavioural disabilities and disorders Ø Understand the difference between

screening and diagnostic tests Additionally, the early childhood sector is one such area that the Ministry of Education has committed to strengthening both from a human capital development standpoint and infrastructure wise. The Education Sector Plan, 2013-2017, Strategic Imperative 6, clearly outlined key pointers that the ministry has adopted.

The central tenet would be to: Ø review guidelines to allow all children an opportunity to enroll at ages 2 and 3 year. Ø register and supervise a sufficient number of schools to allow all children the opportunity to enroll Ø review the curriculum guidelines to ensure that they are appropriate for use in the Turks and Caicos Ø Provide both pre-service and professional teacher development opportunities for early childhood teachers Ø provide professional and technical assistance to the early Childhood Centres.

All law enforcement agencies said they only use commercially produced targets, not photos of human beings for target practice.

“The use of those targets doesn’t seem correct,” Alex Vasquez, a retired FBI agent, said.

“The police have different options for targets. I think the police have to be extra careful and sensitive to some issues that might be raised.”

Dennis said the police department uses an array of pictures including that of whites, and Hispanic males. What concerns his police department, he said, is that the picture was from someone that happened to be arrested by his agency.

“That individual would be someone that was on the streets of North Miami Beach,” Dennis said.

In Germany, police arrested two people following a raid on 12 homes and a mosque. A police spokesman said the suspects were probably part of an extremist cell that recruited fighters for Syria.

In Belgium, police uniforms, explosives and guns including four AK-47 assault rifles were found in the apartment where the two gunmen were killed on Thursday in the raid in the eastern town of Verviers.

Their identities have not been released.

WASHINGTON — The Obama administration, following through on its declaration of warming ties with Cuba, has eased travel restrictions and opened a wide range of new export opportunities with the communist island.

Times Square had 1 million revelers, zero tickets

NEW YORK - Of all the statistics from the recent New Year’s Eve in Times Square - 1 million revelers, 2,000 pounds of confetti, thousands of police officers, dozens of surveillance cameras there is one number that stands out: zero, as in zero tickets for low-level crimes.

No tickets for having an open container of alcohol, no tickets for public urination, no tickets for double parking, no tickets for furry, costumed characters hassling tourists to take their picture. Add in low-level arrests, and there was just one, for a subwayrelated offense.

And that wasn’t just on New Year’s Eve. That was for the entire week containing the holiday.

During the Christmas week, when the neonlit streets were every bit as jammed, the total for such infractions was 23 - compared to more than 650 summonses

per week the previous year, according to police statistics.

Times Square is perhaps the most jarring example of a slowdown in low-level enforcement across New York City amid tension between rank-and-file police and Mayor Bill de Blasio, whom they accuse of encouraging violence against cops by siding with protesters after the chokehold death of Eric Garner. They were particularly incensed by comments in which the mayor warned his biracial son to be wary in dealing with officers.

In the two weeks after two NYPD officers were shot to death in their patrol car Dec. 20 by a fugitive who had ranted online about avenging police killings, low-level arrests citywide dropped 61 percent. Sea level rise accelerating more than once thought WASHINGTON - The world’s oceans are now rising far faster than they did in the past, a new study says.

The study found that for much of the 20th century - until about 1990 - sea level was about 30 percent less than earlier research had figured. But that’s not good news, scientists say, because about 25 years ago the seas started rising faster and the acceleration in 1990 turns out to be more dramatic than previously calculated.

The current sea level rise rate - which started in 1990 - is 2.5 times faster than it was from 1900 to 1990, according to a study published Wednesday in the journal Nature. Scientists say that faster pace of sea level rise is from melting ice sheets in Greenland and West Antarctica and shrinking glaciers, triggered by man-made global warming.

“We’re seeing a significant acceleration in the past few decades,” said study lead author Carling Hay, a geophysical researcher at Harvard University.

“It’s concerning for cities along the U.S. East Coast” where water levels are rising even faster than the world average.

“It’s definitely something that can’t be ignored,” Hay said.

Previous research said that between 1900 and 1990, the seas rose about two-thirds of an inch a decade. The new study recalculates the 1900-1990 rate to less than half an inch a decade.

Old and new research both say that since 1990 seas are rising at about 1.2 inches a decade.

While hundreds of tide gauges around the world have been measuring sea levels since 1900, they have mostly been in Europe and North America with few in the polar regions or the middle of the oceans, Hay said. So past estimates of 20th century sea level rise gave an incomplete picture of the global effect, said study co-author Jerry Mitrovica, a geophysics professor at Harvard.

The new method uses statistical analysis and computer models to better simulate the areas in the gap, Mitrovica said.

Outside scientists praised the new study, but were still cautious about adopting the estimates until more studies could be done.

Ohio man planned to bomb US Capitol, kill officials

CINCINNATI - A 20-year-old Ohio man’s Twitter posts sympathizing with Islamic terrorists led to an undercover FBI operation and the man’s arrest on charges that he plotted to blow up the U.S. Capitol and kill government officials.

Christopher Lee Cornell, also known as Raheel Mahrus Ubaydah, told an FBI informant they should “wage jihad,” and showed his plans for bombing the Capitol and shooting people, according to a criminal complaint filed in federal court in Ohio Wednesday.

The FBI said Cornell expressed his support for the Islamic State.

Cornell’s arrest came only days after a grand jury indictment charged another Cincinnati-area resident with threatening to murder House Speaker John Boehner.

Boehner spokesman Michael Steel said in a statement Wednesday: “Once again, the entire Congress owes a debt of gratitude to the FBI and all those who keep us safe.”

The complaint against Cornell charges him with attempting to kill officers and employees of the United States.

Cornell was arrested Wednesday after buying two semi-automatic rifles and about 600 rounds of ammunition, authorities said.

The public was never in danger, said John Barrios, acting special agent in charge of the FBI’s Cincinnati division.

Messages were left Thursday for attorney Karen Savir, a federal public defender listed in court records as Cornell’s attorney. A working phone number could not be found for Cornell’s family.

His father, John Cornell, told The Cincinnati Enquirer in a story for Thursday’s editions that his son was a “momma’s boy who never left the house.”

He said his son endured frequent incidents of abuse as a practicing Muslim.

“Everything you’re hearing in the media right now, they’ve already painted him as some kind of terrorist,” John Cornell told the newspaper. ...

“They’ve painted him as some kind of jihadist. ...

The 14-block precinct in the heart of Times Square was among at least seven across the city where not a single summons was issued for parking, moving or criminal violations during New Year’s week - a statistic that makes some people nervous.

“It might make criminals more eager to do crime.”

The slowdown has overshadowed an overall, years-long decrease in every measurable crime statistic: complaints of crime, arrests and summonses. Crime of all kinds decreased 4 percent to all-time low in 2014, when there were 332 homicides, down

from 335 the previous year.

The slowdown in enforcement hasn’t translated to a rise in crime. In the past two weeks, reports of serious crimes were down to 3,704 from 4,130 in the same period a year earlier.

That has critics questioning Bratton’ signature crime-fighting tactic: the “broken windows” theory that targeting low-level infractions discourages more serious crime.

Some police reform advocates say the slowdown proves that the city can do without a tactic they see as heavyhanded.

But Bratton says the arrests are no less necessary, despite the let-up.

“The whole thesis of ‘broken windows’ is: If over time you don’t address an issue, over time it will create a larger issue,” he said.

Astronauts flee US side of space station but no sign of leak CAPE CANAVERAL, Fla. - In a rare scare, astronauts fled the American side of the International Space Station on Wednesday after an alarm indicated a possible toxic leak. NASA later said there was no leak of ammonia coolant and a computer problem likely set off the false alarm.

By Wednesday afternoon, the astronauts were back in the U.S. part of the orbiting outpost. Earlier, the six crew members had huddled safely on the Russian side - once when the alarm sounded and again following an initial all-clear.

“Hey everybody, thanks for your concern,” Italian astronaut Samantha Cristoforetti said via Twitter.

“We’re all safe & doing well in the Russian segment.”

The “unscheduled excitement,” as NASA called it, occurred around 4 a.m. EST, well into the station crew’s workday.

As alarms blared, the astronauts followed emergency procedures in slapping on oxygen masks, taking cover in the Russian quarters, then sealing the hatches between the U.S. and Russian sides. At the same time, flight controllers at NASA’s Johnson Space Center in Houston turned off non-essential equipment.

Within minutes, Mission Control gave an allclear, but sent the astronauts scurrying back over to the Russian side again when there was more evidence of a possible leak of the coolant.

The highly toxic liquid ammonia, flowing outside the space station, is used to cool electronics.

Flight controllers originally feared it had gotten into the water system running inside. Now, it’s believed that a failed card in a computer-relay box was the culprit.

The crew - three Russians, two Americans and the Italian Cristoforetti - stayed in the three, relatively small Russian compartments while Mission Control analyzed data. Engineers wanted to understand the computer failure and confirm “that the system is tight like we believe it to be,” space station program manager Mike Suffredini said on NASA TV.

They have also speculated that 38-year-old Oliver was ambushed after being forced to stop his car by a police barricade.

The US Government has also expressed its own concern about corruption and in 2013 suspended all aid to the local police.

Efforts to get British police involved in St Lucia murder investigation

Foreign Secretary Philip Hammond has been urged to help British police investigate the murder of former Surrey junior cricketer, Oliver Gobat, in St Lucia.

The 38-year-old’s charred body was found in a burnt out car on the Cap Estate, an exclusive resort on the Caribbean island, in April last year just hours after his family reported him missing.

Reports suggested he had been shot twice in the head before his body was doused in petrol and set alight.

Esher and Walton MP Dominic Raab - on behalf of Mr Gobat’s parents Theo and Helen, who are his constituents - has pushed for Mr Hammond to phone the St Lucian prime minister so British police can join the investigation.

Concerns have been raised about the use of the death penalty in St Lucia and these have so far prevented UK officers from getting involved.

“The foreign secretary knows my constituent Ollie Gobat was brutally murdered in St Lucia in an apparent assassination and I’m very grateful officials are discussing assurances on the death penalty to allow UK police to support the investigation at St Lucian request,” said Mr Raab in the House of Commons.

At least seven dead as vehicle plunges into St Vincent sea

KINGSTOWN, St. Vincent — At least seven people, mainly students, died after a minibus plunged into the sea in Rockguter, an area between Owia and Fancy on the northeastern tip of St. Vincent early Monday.

Police and government officials say that five bodies have so far been recovered from the sea, and one person died in hospital.

Another person died on the way to the medical institution.

Police are still trying to verify how many persons were in the minibus when it plunged into the sea sometime between 7 a.m. and 8 a.m (local time). Initial reports said that as many as 20 people, including 14 students from the North Union and Georgetown Secondary Schools respectively.

One police source has said that officials were told that the minibus, which is licensed to carry 18 passengers, was “full” when it left Fancy, the northernmost community in St. Vincent.

Residents say that minibus was

packed with students from the two communities further south in this North Windward constituency.

They said that the conductor was standing, suggesting that the minibus was carrying more people than it was licensed to carry, a common practice in St. Vincent and the Grenadines.

A large crowd has gathered at the scene where two Coast Guard patrol boats have been searching for bodies or survivors.

The efforts are being affected by especially large waves characteristic of the Atlantic side of St. Vincent, where the terrain is an alternation of steep inclines and deep gorges and winding roads.

Among the bodies recovered from the water is that of a female student. Health authorities said the body showed signed of trauma, presumable inflicted as it knocked against the large rocks that line the shore.

It is not yet clear what

caused the incident, but police say that villagers were notified by persons who jumped out of the vehicle before impact.

A grief stricken Prime Minister Dr. Ralph Gonsalves, speaking on national radio, said the “entire nation of St. Vincent and the Grenadines…has been touched by this tragedy of national proportion.

“We all grieve and ask God for guidance and strength as well as we lean on one another,” he said, noting that the recovery of bodies from the sea is ongoing.

“Some of the questions you have are not fully answered, that will come in due time, right now it is the task of making sure that everyone is accounted for. US judge dismisses lawsuit against United Nations NEW YORK – A United States judge has ruled that the United Nations is immune from a law suit seeking compensation for victims of the deadly cholera outbreak that left more than 8,000 people dead in Haiti.

The lawsuit had been filed by human rights groups and others, contending that the UN hadn’t screened the peacekeepers from Nepal for the disease that also sickened more than 700,000 since the first case was detected in October 2010.

In addition, the groups had argued that

the UN was responsible for poor sanitation and waste disposal practices that spread the cholera in the French speaking Caribbean Community (CARICOM) country.

But US District Judge J. Paul Oetken ruled Friday that UN’s charter provides broad legal immunity and that the international body hasn’t waived it.

“Where such an express waiver is absent, the UN and (its operation in Haiti) are immune from suit,” the judge ruled.

The groups were seeking unspecified damages from the Un

and attorney Beatrice Lindstrom said they plan to appeal the ruling.

“The court’s decision implies that the UN can operate with impunity.

We don’t think that is the law,” Lindstrom said in a statement.

Washington had argued against the suit at a hearing last year claiming that the UN needed immunity to complete its global mission, and letting the case continue would subject the international body to many more lawsuits from around the world.

The United States

wasn’t named in the suit, but federal prosecutors said they got involved because the US is the U N’s host nation.

In December 2012, the UN announced a US$2.27 billion initiative to help eradicate cholera in the country that was hit by an earthquake in 2010 that also killed an estimated 300,000 people.

Caribbean warned to be prepared for massive earthquake

PORT OF SPAIN, Trinidad – The Seismic Research Centre (SRC) of the University of the West Indies (UWI) is warning the region to “move expeditiously” towards building resilience amid predictions of the Caribbean being hit with an earthquake with a magnitude of eight or larger.

“We must develop, legislate and enforce Building Codes using up-to-date seismic hazard maps based on the latest available science.

Preparedness measures at the individual levels are insufficient and greater efforts are needed to facilitate self-resilience,” the SRC said in a statement as it marked the fifth anniversary of the magnitude 7.0 earthquake that ricked Haiti in 2010, killing an estimated 300,000 people.

The SRC said that the earthquake in Haiti “should have been the wakeup call for a fundamental shift in regional mechanisms for coping with seismic hazards”.

It said major earthquake disasters around the world have stimulated similar shifts and resulted in greater resilience to seismic hazards in these regions.

“This has not happened in the Caribbean and the region continues to be extremely vulnerable to seismic events,” the SRC said, adding “research suggests that the region is capable of generating an earthquake of magnitude 6.0 or larger every 3-5 years.

“Of more concerns, we are long overdue for a magnitude 8.0 earthquake, which has 32 times more energy than the Haiti event. In light of these sobering facts, it is imperative for the region to move expeditiously towards building resilience to such events,” it added.

The SRC said that while there have been advances in many areas, “the effectiveness of the implemented strategy from country to country still needs to be measured.

“The need for broad based impact assessments for seismic hazards and risks is now greater than ever with clearly established short term and long term objectives. Every year that passes without the necessary measures being in place is a year closer to a repeat of the Haiti disaster. Now is the time to be ready,” the SRC added.

Man arrested for smuggling heroin in table from Dominican Republic SAN JUAN, Puerto Rico – The United States Customs and Border Protection (CBP) agency says field operations officers have seized 10.1 pounds of heroin concealed inside a decorative table found within a cargo van, driven by a male US citizen, arriving from the Dominican Republic.

CBP said the estimated value of the seized contraband is US$250,000.

Ezequiel Tineo Alcala, 45, was arrested and was expected to appear before US District Court for charges related to the smuggling and distribution of narcotics, CBP said.

It said field operations officers conducting vehicle inspections arriving on board the ferry M/V Caribbean Fantasy, selected Alcala’s Ford cargo van for a more intrusive inspection.

CBP said one of its canines alerted to a decorative table inside the van. The table was drilled revealing a residue which tested positive for heroin, CBP said.

The vehicle’s Puerto Rico registration appeared on behalf of the driver, Ezequiel Alcala.

“Criminal organizations seek to use the supply chain as a means to conceal and move narcotics,” said Marcelino Borges, director of field operations for Puerto Rico and the US Virgin Islands. “Our officers remain vigilant to detect and prevent any attempts to circumvent the security measures that are in place.”

Haiti’s new prime minister Eastern Caribbean faces instability, protests to market as single

Haitian Prime Minister Evans Paul Haiti has a new prime minister as it enters a phase of political uncertainty, with its parliament dissolved, opposition activists promising intensified street protests and its president ruling by decree because of a bitter standoff with lawmakers.

Prime Minister Evans Paul was selected last month but a political deadlock meant the Senate and Chamber of Deputies could not debate his nomination before their terms expired Monday.

Since President Michel Martelly can now rule by decree under the constitution, Paul automatically took office this week and began overseeing day-to-day government operations as the hemisphere’s poorest country faces social unrest that could undermine its fragile stability.

The former Port-au-Prince mayor said he deplored the fact that he was taking office without a vote and with no sitting parliament and blamed a group of opposition lawmakers for the deadlock. He said a new electoral council would be in place “in less than two weeks” to start organizing long-delayed legislative and municipal elections.

“It’s difficult to be approved by a parliament that is dysfunctional. And I’m not responsible for the dysfunction of the last parliament,” Paul, who was in the moderate opposition to Martelly before becoming prime minister, told The Associated Press.

The latest bout of political turmoil in Haiti has been brewing since shortly after Martelly took office in 2011 as a newcomer to politics with little support in parliament, which is critical in a country where

the constitution deliberately curbs executive power.

Martelly was supposed to call elections in 2011 for a majority of Senate seats, the entire Chamber of Deputies and local offices. But six opposition senators used parliamentary procedure to prevent a vote while accusing the president of abusing his authority to appoint supporters to the electoral council and other posts.

Haiti’s parliament was unable to pass a law to organize the elections and extend lawmakers’ terms before it dissolved, on the same day the country marked the fifth anniversary of the devastating 2010 earthquake.

On Wednesday, the Organization of American States said it supported the efforts of Haitian authorities to “hold free, fair, and inclusive elections as soon as possible.” Earlier this week, a group of ambassadors and the U.N. special representative in Haiti said Martelly has their support through the period of political flux.

During an AP interview at the prime minister’s official residence, Paul was sharply critical of violent anti-government street protests that have become increasingly common in downtown Port-au-Prince.

Protesters calling for Martelly’s resignation have burned tires and thrown rocks at riot police, who responded with tear gas and water cannons.

“People have a right to peaceful protest, a right protected by our constitution. But there’s also people taking advantage of the situation and who want to create chaos,” said Paul, who replaced Laurent Lamothe after he was forced to resign as prime minister.

Earlier in the day, a group of anti-Martelly activists promised a fresh wave of street protests, insisting the president is a “dictator” who longs to rule by decree.

Haitian historian Georges Michel, who blamed both the government and the opposition for the impasse, dismissed that idea.

“You look at these protests calling Martelly a dictator who has to go and you see a thousand or a few thousand people on the streets. Is that really a big popular movement to remove a president? Of course not. Like him or not, he’s operating within the framework of democracy and I believe a majority of Haitians support him,” he said.

Others see the protests as a more troubling sign.

Mark Schneider, who has followed Haiti for the Washington-based International Crisis Group, said political leaders have failed the country’s citizens and set it on a very dangerous path.

“They allowed partisan and personal issues to carry the country over the cliff where the executive is ruling by decree and there is the greatest likelihood of political paralysis and street violence. These issues should have been resolved two years ago and they have been allowed to fester and now we are about to see the explosion,” he said via email.

In rejecting the $324.5 million deal, Koh repeatedly referred to a related 2013 settlement involving Disney and Intuit.

Apple and Google workers got proportionally less than Disney workers, Koh wrote, even though plaintiff lawyers had “much more leverage” against Apple and Google.

To match the earlier settlement, the deal with Apple, Google, Intel and Adobe “would need to total at least $380 million,” Koh wrote.

In the short court filing on Tuesday, the companies said plaintiffs would file a detailed explanation of the new deal “imminently.” Koh will then likely decide whether to accept or reject it.

Brazil’s Petrobras scandal could exceed $28billion

SouthWest Airlines Southwest Airlines has agreed to pay a $1.6-million fine, the largest penalty so far for stranding passengers on a delayed flight for more than three hours.

The fine was imposed by the U.S. Department of Transportation over the storm-related delays of 16 Southwest flights on Jan. 1 and 2, 2014, at Chicago Midway International Airport.

A Brazilian police officer investigating a kickback scheme at state-run oil company Petrobras said the total amount of money involved could exceed $28 billion, making it the country’s biggest-ever money laundering probe.

“If you consider the value being investigated, the value of the Petrobras projects, certainly the potential of the investigation is to surpass that value by a lot,” Federal police agent Erika Marena said in a rare telephone interview.

Marena, speaking from the southern city of Curitiba where the probe is based, said police are investigating the possible involvement of more foreign companies and 750 infrastructure projects in addition to contracts involving Petroleo Brasileiro SA, as the firm is called formally.

Though she could not yet say exactly how much money may have been laundered in the kickback scandal, she said the case is likely bigger than the nearly $30 billion found to have been illicitly transferred abroad in a separate case between 2003 and 2007. She was also involved in that case, known as Banestado, Brazil’s biggest money laundering incident to date.

There is no axe to grind, says CLive Lloyd

Clive Lloyd, the former West Indies captain and current chairman of selectors, has said that the absence of “exceptional performances” from the pair of Dwayne Bravo and Kieron Pollard, coupled with the selection panel’s vision to move forward and look for young talent, were the chief reasons for omitting the two senior allrounders for the ODIs against South Africa and the World Cup. Lloyd said the decision had been a difficult one and was debated heavily. He insisted that it was not the end of the road for the discarded pair and it was up to the players to regain their spots on the back of performances.

“It was a very difficult decision. I can tell you it went on for two days. We suspended it to give a chance to think about things and so on. There were a lot of discussions,” Lloyd told ESPNcricinfo in an exclusive interview on Tuesday. “But then you get to a point where you say, right, this is where we want to go. It is very difficult for people to understand or to accept. But we want to move on.

“I don’t think they have had any exceptional performances. Nobody (of the pair) has got exceptional performances as far as (playing for) West Indies is concerned. They have been there and thereabouts.

We really and truly want to pick people on what they have done for our cricket and not for anyone else.”

Despite being part of the 30 probables for the World Cup, Bravo and Pollard had already been left out of the five-match ODI series against South Africa.

Pacquiao agrees to terms for Mayweather fight

The question now is whether the long-reluctant Mayweather will finally sign on the dotted line for what could be an astonishing $120 million payday for the fighter who flaunts his money better than anyone.

“Your guess is as good as mine,” Arum told The Associated Press. “I don’t want to be antagonistic and say he’s not on board and not going to sign. The representation is that he is on board with this.”

Arum said negotiations with Mayweather’s representatives over the past few weeks resulted in agreements on everything from the date and site of the fight (MGM Grand in Las Vegas) to purse split (reportedly 60-40 in Mayweather’s favor) to the type of gloves the boxers will wear.

But Mayweather has yet to personally agree to the fight, and the possibility remained that Arum was publicly discussing Pacquiao agreeing to terms to try to up the pressure on the unbeaten boxer to sign.

“We’re waiting for Mayweather to sign a document saying, ‘Yeah,’” Arum said.

Just what Mayweather is thinking remains unclear. Though he declared on Showtime last month that he wanted the fight, he rarely speaks to the media between fights and his manager, Al Haymon, almost never speaks publicly.

Mayweather put out pictures of himself in front of a private jet and his new cars this week along with a picture of his Las Vegas mansion, but said nothing about the Pacquiao fight on social media.

Arum said the negotiations have been at the highest levels, and Pacquiao agreed to all the demands by the Mayweather team.

“We took our stands on certain issues, but essentially we acquiesced on most things,” Arum said.

Arum said he planned to meet with Pacquiao on Thursday in Los Angeles to formally get his fighter’s signature on the terms of the bout. Pacquiao flew from the Philippines on his way to judge the Miss Universe pageant on Jan. 25 in Florida.

Arum said the fight would be held at the MGM, where Mayweather has fought exclusively for years. The 15,000-seat arena would be scaled for a $40 million live gate. He said with pay-per-view revenues, the bout could generate $200 million.

With a 60-40 split, that would mean a potential $120 million payday for Mayweather and his team and $80 million for Pacquiao and his promoter. Both would be record purses for fighters.

Mayweather has resisted a Pacquiao fight for five years, first claiming Pacquiao would not agree to drug testing and later saying he wasn’t worth facing him in the ring. But Arum said Pacquiao has long since agreed to the testing, and the pressure has built on Mayweather to come to terms on the bout.
