COUNT I- ATTEMPTED MURDER IN THE FIRST DEGREE
The defendant is charged with the crime of attempted first-degree murder. The Commonwealth must prove beyond a reasonable doubt each of the following elements of that crime:
1.The defendant intended to kill Sam Smith;
2.The defendant acted with malice; and
3.The defendant did a direct act toward the commission of first-degree murder, which amounted to the beginning of the actual commission of first-degree murder.
ATTEMPT - DIRECT ACT 8.140
The direct act required to be proved in an attempted crime is an act that shows a present intention to commit the crime. The act need not be the last act prior to the actual commission of the crime, but it must be more than mere preparation.
MALICE - DEFINITION 33.220
Malice is that state of mind which results in the intentional doing of a wrongful act to another without legal excuse or justification, at a time when the mind of the actor is under the control of reason. Malice may result from any unlawful or unjustifiable motive. You may, but are not required, to infer malice from any deliberate, willful, and cruel act against another, however sudden.
FIRST DEGREE MURDER - DEFINITION 12.22
Murder is the unlawful killing of another human with malice aforethought. First degree murder is defined as the unlawful killing that is both willful and premeditated.
PREMEDITATED - DEFINITION 10.21
Premeditated is when an individual contemplates, for any length of time, undertaking an activity and willfully takes action.

INSTRUCTION NO. 1
The defendant is presumed to be innocent. You should not assume the defendant is guilty because they have been charged and are on trial. This presumption of innocence remains with the defendant throughout the trial and is enough to require you to find the defendant not guilty unless and until the Commonwealth proves each and every element of the offense beyond a reasonable doubt. This does not require proof beyond all possible doubt, nor is the Commonwealth required to disprove every conceivable circumstance of innocence. However, suspicion or probability of guilt is not enough for a conviction. There is no burden on the defendant toproduceany evidence.Reasonabledoubt isadoubtbasedonyoursoundjudgment after a full and impartial consideration of all the evidence in the case.

You may consider the manner of the witnesses on the stand, their intelligence, their opportunity for knowing the truth and for having observed the things about which they testified, their interest in the outcome of the case, their bias, and, if any have been shown, their prior inconsistent statements, or whether they have knowingly testified untruthfully as to any material fact in the case.
You may not arbitrarily disregard believable testimony of a witness. However, after you have considered all the evidence in the case, then you may accept or discard all or part of the testimony of a witness as you think proper.
You are entitled to use your common sense in judging any testimony. From these things and all the other circumstances of the case, you may determine which witnesses are more believable and weigh their testimony accordingly.

Report of Detective Morgan Oleman

4 unit of the Masonia County Police Department (“MCPD”). I hold a Bachelor of Arts
My name is Morgan Olemen, and I am a Detective in the Homicide Investigations
5 degree in Criminology from Florida State University and I attended the Masonia County
6 Police Academy. I started my career in 2018 as a patrol officer, then was promoted to
7 accident investigations. Then, in 2022, I was promoted again to Detective and assigned to
8 the Homicide Investigations unit. I assumed my role as a detective in the MCPD on
9 February 1st, 2022. I am trained in witness interviews, blood spatter investigation, crime
10 scene investigation and preservation, and homicide investigations. I am a member of the
11 Masonia State Homicide Investigations Association and recently published my first
12 article, "Homicides, Suicides, or Accidents?" in the 2021 Masonia Prosecutors Digest. I
13 have never testified as a detective or an expert witness at trial before, but I have testified
14 as an officer. The case of Sam Smith was my first investigation as a detective. 15

February 14th, 2022: The Scene
On February 14, 2022, at 8:05 PM, I received a call from dispatch to 123 Arlington 17 Blvd, Masonia County, Masonia 19888. I was dispatched to the scene because an
individual experienced a severe and lethal allergic reaction and believed the allergic 19 reaction was caused intentionally by another person. One or two other responding officers
were also dispatched, but I was the first to arrive. Dispatch informed me a neighbor called
911 after finding the individual.

on the scene. The paramedics were tending to the victim who was lying on a stretcher. The
victim was identified as Sam Smith. The paramedics informed me Sam Smith’s child,
Carson Smith, was waiting inside the house. Sam Smith was then taken to the hospital, and 26 I could not speak to Sam Smith then due to Sam’s condition. 27
The remaining paramedics informed me that Sam Smith was in medical distress

28 caused by anaphylactic shock when they arrived. I asked the paramedics if Sam Smith
30 unable to speak from the allergy attack. However, right before falling unconscious while
provided them with any additional information, but was informed Sam Smith was nearly
31 lying on the stretcher, Sam Smith told the paramedics that Carson Smith had tried to kill
32 Sam by purposefully causing the allergic reaction. The paramedics immediately took Sam
33 Smith to the hospital in an ambulance, and I did not have a chance to speak with Sam Smith
34 until later. 35
Based on the information I received from dispatch and the paramedics, I walked up 36 to the house to investigate for any signs of criminal activity. I knocked on the door, and an 37 individual who identified as Jamie Scott opened the door and invited me inside. I entered
38 through the front of the house and proceeded into the kitchen. Jamie was visibly upset and
39 described findingSamSmith gasping for air on thegroundwhenJamie arrivedat thescene. 40
I asked Jamie to stay in the area so I could follow up with further questions. 41
As I entered the house, the other responding officers began to set up containment 42 procedures in the area. These officers remained outside. I glanced around the kitchen and 43 walked into the adjacent living room. I did not find any evidence of forced entry or a

struggle in the home. In the living room, an individual, who I later learned was Carson 45 Smith, was sitting on the couch. Carson Smith showed no reaction to my presence and did
46 not speak as I entered the room. Carson was not under arrest, detained, or in custody at this
47 time. I approached Carson and asked if they knew what had happened to Sam Smith.

I proceeded back into the kitchen. I first noticed food on the kitchen table and two
51 glasses of wine. One glass appeared to be untouched. The food appeared to be pasta in
52 takeout containers: one with red sauce and one with green sauce. The pasta with the green
53 sauce pasta had been consumed before my arrival, and the fork was partially out of the
54 container. I am unaware if anyone touched the food before I arrived. I took photographs of
55 the food on the counter and the glasses of wine. After photographing the food, I closed the
56 containers and called for backup to preserve the evidence. The food was sent back to the 57 station for a toxin test, but I never saw the results. Later in this investigation, I called the
58 laboratory to check in, and the chemist told me the test results showed peanuts found in the
59 pasta with pesto sauce. I asked for a fax of the report, but they were backed up. 60
While photographing the evidence, I noticed Carson Smith left the living room and 61 entered the kitchen. Carson appeared visibly upset that I was taking photographs of the 62 food. Then, Carson repeatedly asked me if taking photos of the food was necessary.
Carson’s face was red, and they were stuttering over their words. At that point, I began an
investigation into Carson Smith.

I began by asking Carson Smith who owned the car parked in the house's driveway.
Carson replied that the car belonged to them and permitted me to search it.

69 immediately apparent. While searching Carson Smith’s car, I found two bags of trail mix,

70 one open and one closed. There was also a pack of gum in the side pocket of the car door.
I also found a receipt for snacks to go in the center console. Additionally, I found a white
72 water bottle on the passenger seat. I took photos of the items as I found them. No additional
73 items were found in the car. After photographing the items, I bagged each item. I only

74 photographed one of the two bags of trail mix.
Next, I left the residence and drove to the hospital to check on the victim, Sam
76 Smith. When I arrived, the nurse informed me Sam Smith was partially conscious and
77 asked to speak with a law enforcement officer. After walking to Sam Smith’s room, I saw
78 Sam Smith lying on a hospital bed with multiple IVs hanging from their arm. I approached
79 Sam’s bed and asked if they could speak with me. Sam Smith said, “yes, I would really
80 like to report a crime” in response. I asked what crime, and Sam Smith responded “My
81 child, Carson, tried to kill me by putting peanuts in my food. They know I am allergic and
82 I know they did it because I wouldn’t give them money.” I replied, “Can you explain why
83 you think they would do this?” Sam Smith replied, “Carson is broke and wanted to cash
84 out on my life. They’re a monster. I can’t talk about this anymore.” Sam Smith was crying
85 and declined further questioning at that time. I returned to take a formal statement.

After the brief conversation, I further investigated Carson Smith the next day. First, 88 I found that Carson Smith had a criminal record. With a simple Google search, I also
89 discovered several tweets fromaTwitter account belonging toCarsonSmith with troubling
90 statements. The statements were made very close to the day of the incident. In conjunction

91 with Sam Smith’s accusations, this led me to investigate further.
I obtained Carson’s financial records and uncovered that Carson Smith was in
93 serious debt. Carson Smith owed a significant amount of money to a loan company and to
94 Bank of America. Also, I learned Carson was the sole beneficiary of Sam Smith’s life
95 insurance policy. Soon after uncovering this information, the toxicology report was
96 returned to my desk. The toxicology report confirmed Sam Smith experienced an allergy
97 attack caused by peanuts. I was a little worried about the alcohol consumption mentioned
98 in the report. I spoke to Sam Smith that night and did not notice signs of over-intoxication.
99 But, Sam was unconscious when I arrived and her blood was taken, so I did not have the
100 chance to do a formal assessment. However, when I spoke to her, Sam spoke in a clear tone

101 and showed no visible signs of alcohol consumption.
103 2022. I located Carson Smith at their address, 3314 E Kelton Lane Unit 105 Masonia City,
After completing my initial investigation, I interviewed Carson Smith on March 1,
104 Masonia. Zip code 85032 and Carson Smith came willingly to the police station. Caron
105 Smith came willingly. Carson Smith was read their Miranda rights, and Carson declined

106 the assistance of counsel.
After arriving at the station, Carson Smith asked “Where did Sam Smith go?” and

108 “How are they doing?” I told Carson Smith that I could not release that information. Then,

110 told me that they used their own car to get the food from the restaurant and started washing
I asked Carson Smith to sit down and speak to me about the events of that evening. Carson
111 theirhandswhenSamstartedhaving theallergicreaction that triggeredthe 911call.Carson

112 appeared distressed and refused to make eye contact.
I asked Carson Smith about the financial issue they were experiencing. Carson
114 avoided answering the question saying only that they had a handle on the situation. I asked
115 Carson about the night of February 14th, 2022. Carson said that Carson and Sam were
116 scheduled to have dinner that night but that, when they arrived, dinner was neither prepared
117 norordered.Thiscauseda fightbetweenCarsonandSam,afterwhichCarson leftthe living
118 room to order the food I photographed in the kitchen. Carson stated that they knew Sam’s
119 allergy to peanuts but were unaware if the order placed for Sam included peanuts. In my
120 investigation,I used the internet to map the route from SamSmith’s house to the restaurant.

121 The internet map indicated that the drive would take 10 minutes there and 10 minutes back.
When I asked Carson Smith about Sam Smith’s allergic reaction on the night of
123 February 14th, 2022, Carson again got visibly agitated. Carson said they witnessed the

124 allergic reaction as it was happening but were unable to do anything as it was happening.
Carson was not sure how 911 was called. I knew at this time that 911 was called by the
126 house phone of Sam Smith, but the caller did not identify themselves and the voice was
127 unrecognizable. I did not tell Carson Smith this information. To conclude the interview, I
128 asked Carson if they knew the terms of Sam Smith’s life insurance policy, to which Carson

129 replied that theywere“vaguelyaware.”When Iaskedif therewasanything further Ishould

know, Carson stated that they “loved Sam and would never kill anyone.” I proceeded to

Investigating Pasta Palace
On February 23, 2022, I began my investigation into Pasta Palace. I investigated
134 Pasta Palace to rule out any possibility of this being caused accidentally. I am not trained
135 in food safety or qualified in this area of expertise, so I relied on the standard practices of
136 experts within this area that I found online. I interviewed Bellamy King, reviewed
138
137 internal documents of Pasta Palace for any past incidents, and researched online reviews.
Based on my investigation, I concluded this incident was not caused by Pasta Palace.

I am voluntarily writing this statement. My name is Sam Smith, and I am over 18 years old. My address is 123 Arlington Blvd, Masonia County, Masonia 19888. I am of sound mind.
It isn't easy to talk about February 14th, 2022. My child, Carson, tried to kill me. I am sure of it. I am currently retired, but I used to work in real estate. I did very well and my husband, Henry, and I saved up our money. My husband died eight years ago, which was very hard on me. I especially noticed a difference in Carson after his death. Carson always was closer to Henry than to me, but after he passed away, Carson was even more distant. I really tried to reach out to Carson after Henry passed away, but the more I tried, the more Carson fought back.
Carson and I have always had minor disputes over the years. For example, Carson once wanted to borrow money for a fishing trip in Alaska, I said no. Carson was so upset that they did not speak to me for an entire month. I called many times. I knew if I lent Carson money, I would not get it back because Carson lived paycheck to paycheck.
I would always pay for dinner when Carson and I went out. Typically, we went out to dinner about once a month. I really looked forward to our dinners, but they always includedsomefighting. Iguessthat isanormalparent-childrelationship.Iguessnot totally normal because my child eventually tried to murder me. So ungrateful. We never were really “close.”

Carson rarely would initiate our get-togethers, but on occasion, Carson would reach
out. On February 1st, 2022, Carson called me asking if I wanted to go to dinner on
Valentine's Day. I did think it was a little odd for Carson to plan us dinner two weeks in
advance. I was not looking forward to eating dinner alone. But Carson knows I hate
cooking, so this was meaningful. Ever since Henry died, Valentine's Day has been lonely 27 for me. I was in a brief relationship with someone after Henry’s death a year or two ago,

28 but that ended fast. So, I usually spend Valentine’s Day alone.
30 February 12th, 2022. Carson called me saying there were no reservations available at the

On February 14, 2022, Carson arrived at exactly 6:00 PM. I barely spoke to Carson
36 since the last time we had dinner, about a month or two ago. Carson was dressed nicely
37 and seemed to be in a good mood when they arrived. Carson walked in the front door 38 holding a box of chocolates and a card and I almost cried.
I was hungry, so I suggested we order dinner immediately. Carson helped me look
up the Pasta Palace menu on my computer. Every time we go to the Olive Grove, I order
spaghetti with pesto sauce; it is my absolute favorite, and they make it so well. I have never
ordered anything else at the Olive Grove except for spaghetti with pesto sauce. I
immediately looked on the menu to see if they had it at Pasta Palace. When Carson saw me

looking at the menu, Carson said “don’t worry, I already checked to make sure they have

55 anything on the menu with peanuts, but the electronic menus are a little hard to read on the

I got up and poured a glass of wine, but Carson stayed on the couch. Carson looked anxious. I noticed Carson’s posture looked tense like they had something important to say or ask. Finally, I asked “is everything ok? How is your job going?” I did not want to start one of our fights, but I wanted to know if something was bothering Carson. But Carson was noticeably tense when I began to pry. Carson replied “Everything is fine. My job is fine.Why doyou always askabout my job?” Istarted to reply, butCarsoncut meoffbefore I could, saying “Never mind, it doesn’t even matter now.” I walked back over to Carson and said “Ok then. Let’s just watch my show.”
I asked because I cared, but I guess that didn’t matter to my only child. We sat in silence for another ten to fifteen minutes. I didn’t want to ask Carson anything at this point. It’s like I can not even talk to Carson without risking Carson getting moody. I don’t know why Carson got so upset about questions over jobs. If Carson needed help with money, Carson never had a problem asking for help in the past, even though I would rarely give Carson money. But I would always give Carson my parental advice free of charge. Especially advice on securing a job because I was so successful in my career, which everyone who knows me, knows. Eventually, I broke the silence. “So, how about relationships? Any new special people in your life you want to talk about then? Did I see a picture on Facebook with you and someone? What is their name?” It was Valentine's Day, after all. Who spends Valentine’s Day with their parent? But that set Carson over the edge, I think. Carson abruptly stood up, looked at me with this glare I have never seen before, and quietly said, “No.” Carson looked very angry, but I don’t understand why. Carson is a very private person, but I am the parent here, and I like to ask my child questions. I thought Carson might have just been hangry. Carson just let out a big sigh and walked into the kitchen. About five minutes later, I heard Carson leave through the front door.
While Carson was gone, I looked up Pasta Palace on my phone to see how far away it was from my house. Google Maps showed it as only being about 10 minutes away. I was so hungry at this point. Carson left around 6:30 PM, so I estimated the food would get here at around 7:15 PM. But I was wrong. Carson did not come back until 7:53 PM. I’m sure it was 7:53PM because I was staring at my phone playing Wordle when Carson arrived and sent a text with my Wordle to my neighbor. I know the roads around my house get confusing, but Carson was gone for a long time.
Carson walked in the front door holding a brown bag of food and the car keys. I was so hungry I just walked into the kitchen and grabbed a fork, not even bothering to transfer the food out of the to-go containers like I usually would. Carson placed the brown bag on the kitchen table and walked away to the bathroom. I heard the sink running. I opened the brown bag, and my food was sitting on top; I could see the green sauce through the container. 110

I opened my container and sat on the chair at the kitchen island with my glass of wine. I was so hungry that I didn’t bother waiting for Carson to return and started eating alone. I grabbed some pasta on my fork and took a huge bite. After a few minutes, everything in my body started to tighten. I remember feeling pain and trying to yell for help. I can’t remember much, but I know Carson was standing there staring at me but did not do anything to help me. I remember looking into Carson’s eyes while lying on the ground. Carson looked calm and did not say a word. That is when I knew Carson did this to me. The last thing I remember was lying on the ground and looking up to see the paramedics standing over me. I told them Carson tried to kill me before I blacked out.
When I woke up, my neighbor was with me in the hospital. I was so disoriented, I kept asking the doctors what happened. The doctors told me I had a severe allergic reaction to peanuts and that my reaction was so severe that I must have eaten more than one peanut. I checked the ingredients of the food I ordered, and I asked Carson to tell the restaurant no peanuts, so the only way they could have gotten there was if Carson put them in my food. I remember that cold look Carson gave me as I struggled to breathe. Carson is the only one who would benefit from me dying. I told the police that Carson put the peanuts in my food because Carson knew I was deathly allergic, then Carson left me alone to die. I'll always love my child, but I hope Carson goes away for a long time.

My name is Bellamy King. I am over 18 years of age and a resident of Masonia County, Masonia. The defendant has subpoenaed me to testify.
I am a college student at Masonia State University, majoring in economics. I am basically broke, so I work at Pasta Palace in my free time. I have worked at Pasta Palace for about two years. As I said, I need money while I am at college, and the Pasta Palace is almost always hiring. The pay is decent, but nothing to really write home about. My responsibilities at the Pasta Palace include a little bit of everything. I run food, prep side dishes, work expo in the kitchen, and seat tables, but usually, I man the phone, take orders, and help package take-out and delivery orders. I just put “hostess” on my resume though so it is less confusing.
On February 14th, 2022, I worked a double at Pasta Palace. It was a holiday, and three other people called off, which sucked. I started off the day by taking reservations, but I worked in the kitchen most of the night packing up take-out orders all by myself. On February 14th, 2022, I took Carson Smith’s order. I remember because the order came through right in the middle of the holiday dinner rush, and I happened to be standing next to the phone. The kitchen was backed up, and everyone got mad at me because I had taken the order. It’s not like I can just say “no” though.
Anyway, the order was really boring too. Pesto pasta and spaghetti Pomodoro. Really felt like the kind of thing you could just make at home. I don't remember if the

person on the phone said anything about any modifications or allergies. I don’t write that
stuff down when the restaurant is slammed. I usually tell the kitchen, and they are good at
remembering. We have allergy tickets that we should be placing on the order after the 26 kitchen receives them, but they fall off. It was more effective to tell the kitchen.
Our kitchen is also great about keeping things that are not allergy friendly separate 28 from the rest of the kitchen. My manager told me this line cook got into a bunch of trouble
29 for bringing personal snacks into the kitchen. After that management got these pink
30 allergen tickets that we were supposed to label everything in the back with and we were
31 prohibited from bringing outside food anywhere near the back. But I know people still

32 sneak in their own food; these are long shifts, and pasta gets boring.
Also, I have worked in many kitchens, and this one is the most organized I have
34 ever seen. Everything is wiped down quickly, I can reach all the shelves, and all the 35 ingredients are sorted very clearly. As long as I’ve been there, I have only ever seen one 36 incident with a lady whose young daughter had an issue with something she ate containing
37 something she was allergic to. That was right when I started working at Pasta Palace about
38 two years ago, and that was not my table, but I was there when it happened and saw the
39 Yelp review. Not a good look. That server got fired. I had to write the incident report. 40 The food that Carson Smith ordered would have been handled by the kitchen until 41 I packaged it, so if the kitchen knew about an allergy, all the allergen precautions I
42 discussed would have been applied. That night, I put their order into the to-go boxes, taped
