An attorney representing Matthew Clate McDaniel has filed three motions as the legal process for the man accused of the Jan. 17, 2016 murder of Norman Dean Crayton moves forward. McDaniel’s attorney Davis Whittelsey is seeking a one-term continuance, to have potentially incriminating statements made to investigators excluded and to have evidence seized from McDaniel’s vehicle thrown out due to what the motion calls an “illegal search.” The motions claim that the statements made by McDaniel and all evidence collected from his vehicle should not be admissible because the traffic stop was illegal because he had broken “no rules of the road,” and that there was no warrant when the evidence was collected.
