Candidate residency questioned at city council By CARMEN RODGERS Staff Writer

As the 2016 election ramps up, so do questions and concerns over candidacy. As of now Tallassee has four official candidates. Jeanna Kervin was first to announce earlier this year. Following Kervin, Trey Taylor made his announcement to enter the race. George McCain entered soon after Taylor and Johnny Hammock entered the race two weeks ago. Since these announcements, rumors have swirled about the residency of some candidates. So much so that one council member was moved to comment on the subject at Monday’s city council meeting.

“I know it’s election time,” said Councilman David Stough. “Apparently, a lot of people have not read the laws or don’t know the laws.” Stough then went on to read the 1975 Alabama Section 1143B-4, which states clearly that anyone who is seeking an elected office, must live within the said city or town for at least 90 days prior to his or election. Following the reading, Stough made clear the definition of residency. Under Alabama law a candidate must use their domicile address. The definition of domicile is as follows, “Simply put, your domicile is your home—the state you consider your permanent place of residence. If you aren’t living there right now, then it’s the place to which you intend to return and make

your home indefinitely. You can have more than one residence, but only one domicile.” City Attorney, John Smith reiterated this definition by giving the example of his time as college student attending Auburn University who after graduation returned home. “Residency and domicile are two different things and what the law has been interpreted to mean is domicile. Not where you rent a house but where you intend to go. When I was in school at Auburn, my residency was in Auburn. My domicile was where I grew up in Phenix City,” said Smith.

People in the Reeltown area could soon see lower costs for homeowners insurance. In an effort to lower their ISO rating, the Reeltown Fire Department has opened their second firehouse. Currently, the Reeltown Fire Department has an ISO rating of 5, which could soon be lowered. “This new station is located in a territory that will overlap a five mile radius from the other firehouse,” said Alan Milam, Chief of the Reeltown Fire Department. Last March the students in Tallassee High School’s music department teamed up with Tallassee Automotive for the Ford’s Drive One For Your School Event. This was a fundraiser for the music department and all they had to do was get people to test drive a Ford. It was that simple. For every car driven Ford donated $20 to the school’s music department. “We raised $5,360 for the music boosters department and divided it amongst all the students,” said Mike Durham, Sales Manager for Tallassee Automotive. “We had a great turnout with great help from the music boosters promoting it. That is 280 test-drives out of a possible 300.” According to Durham, this was the most See FUNDRAISER • Page 7

Department serves around 1500 people. The hope is to lower the ISO in the Macon county area of Reeltown. The Fire Department adjacent to Reeltown High School has an ISO of 5 and the hope is to have the same ISO in the area of the second firehouse, as well. “Hopefully we can get a 5 ISO rating down here and save the residents some money,” Milam said.
