Background

The Texas Compassionate Use Program (TCUP) allows a boardcertified physician to prescribe medical marijuana to patients diagnosed with a qualifying condition.

Originally enacted in 2015, the Texas Legislature expanded the program in 2019 and 2021 to include more qualifying conditions, such as PTSD and all forms of cancer.

As of March 2022, there are over 22,000 TCUP patients and 557 prescribing physicians.

TEXAS VS. OTHER STATES

There are some key differences with the TCUP program compared to other states with medical marijuana programs.

The first difference is that patients don’t need a stateissued ‘medical card’ to participate. Instead, patients just need a prescription from a registered physician. Prescription information is regulated by the Texas Department of Public Safety (DPS). This ensures that enforcement bodies like the Police Department are able to identify legal TCUP patients.

The second difference is that smokable marijuana flower is still illegal. This means that patients cannot buy, grow, or smoke marijuana flower in the state of Texas.

The third difference is that dispensaries aren’t allowed to store product inventory in retail locations like other states. The last difference is that Texas regulations restrict the amount of THC that a product can contain - 1% by weight.
